Is My Agent a Swindler? Dear Doreen, I feel like I have been ripped off by my real estate agent! He had me pay for things like ads in the newspaper, hiring a professional photographer to take pictures of my house (or, he said, he’d take photos with his iPhone). He even wanted me to pay for the open-house signs. When I asked for a discount on the commission, he said, “No way.” My listing expired. My house didn’t sell. I’m out all that money. Is this normal? I’ve never heard of this. Ripped Off Dear Ripped Off, Many homeowners don’t realize real estate agents are independent contractors, even though they might work under the umbrella of a large company. Agents can set their own procedures and this agent obviously wants to be paid for the marketing costs. While not typical, this type of practice is becoming more popular as marketing costs rise. If your home was in poor condition, priced too high, or in an unpopular location, the agent would have been wasting his marketing dollars. Remember, houses sell for three reasons: 1) condition, 2) location and 3) price. You signed the agreement stating you would pay the marketing costs, so you really can’t complain. Another cautionary tale: Read and review before you sign! Doreen

very family is a unique story and I know dozens. What’s astounding is there are often remarkable similarities. Soda Expelled From School Other snack foods get an ‘upgrade.’

“T

he machines are there, but there’s no soda. It just says ‘sold out,’ ” said 15-year-old Marlin Begalke. Yes, kids, he’s referring to the latest dietary changes implemented at Boulder Creek High School and all Deer Valley Unified schools, not a scene from some post-apocalyptic TV drama. Thanks to the federal Smart Snacks standards—the newest phase of the Healthy, Hunger-Free Kids Act—DVUSD students now suffer the school day without soda. Fully implemented by the district July 1, 2014, the Smart Snacks initiative uses USDA standards to raise the bar on school campuses and put healthier snacks in the hands of students. The standards aim to bring more whole grains, fruits and vegetables, and higher nutrient values to food snacks served and sold on public school campuses during the school day—defined curiously as midnight to 30 minutes after the final bell.

“Soda is not being sold in any vending machine on campus that students can access,” said Kerrie Zigler, director of food services for DVUSD. Gatorade and flavored waters are no longer sold in middle schools, but high schools may sell calorie-free flavored water or drinks that contain less than 10 calories per 20 fluid ounces. Sandra Day O’Connor High School Senior Marcus Miranda said his school swapped out its fountain lemonade and iced tea with sugar-free versions in the cafeteria. How far do the new changes go? Students may see some new a la carte items in the snack lines this year. Zigler told In&Out, “Corn tortilla chips with salsa, whole-grain granola bars, baked chips and whole-grain fresh baked cookies” are some of the new items featured in the lower grades. Hummus plates are now hitting the shelves in high schools. Items sold by outside vendors—such as the once-popular Chickfil-A sandwiches or pizza from Barro’s or Oggi’s have disappeared. Not surprisingly,


CURRENTS » SCHOOL a la carte sales in the first two weeks of school are down 10 percent from last year, Zigler said. But don’t expect apples or celery sticks in vending machines any time soon. [See “Smart Snack Guidelines, Page 16.] “The BGHS vending items (reduced-fat Cheetos, baked chips and low-fat ice cream bars) meet the Smart Snack standards,” said Zigler. Similar items—Oven Baked Flamin’ Hot Cheetos, Cool Ranch Doritos and Blue Bunny Fudge Bars can be found in vending machines at Boulder Creek High School. While DVUSD sets the standards, the machines are managed by an outside contractor which might explain why Miranda couldn’t find any of the above snacks at SDOHS. “The vending machines now only have water, fruit snacks, NutriGrain bars and granola bars,” he said. While implementation of the Smart Snacks standards won’t have students eating fistfulls of raw spinach and running off to save Olive Oyl, they demonstrate a move in the right direction. One small step for DVUSD and a great opportunity for kids actually willing to eat healthy. io

I

was once accosted, “Have you ever tried kale chips?” I defensively snapped back with, “Are you talkin’ to me? Do I look like I eat kale? I’m a tough guy! Why would anyone eat kale chips?” Shocked and clearly appalled by my aggressiveness, the instigator mustered enough courage to then ask if I would like a sample. I growled and accepted the challenge. The 10-year-old farmer’s daughter pushing kale chips at the farmers market was relieved when this “hangry” (a state of anger caused by hunger) carnivore’s eyes calmed. She had tamed this beast. High-fives were flying. All the kale was purchased, and the young lady shared her kale-to-kale chip recipe with me. I then left after giving her an apologetic gratuity and more high-fives all around. I like my tough-guy persona. I do, however, have a confession: I’m not secure enough to cook, serve or eat kale chips around my family or friends; I eat them in secret. I hide them in a Pringles can. I love kale chips. I eat large quantities when no one is home. I don’t know if I will ever have the chutzpah to serve them to guests. I feel so much better with this weight lifted off my manly chest. I hope if you’re ever confronted by that kale-pushing bully at the farmers market, it won’t be as traumatic as my encounter. Take this tip: When you see her, just politely reply, “Why, yes, I love kale chips. Two bunches please.” Ciao, Bella!

1 Pre-heat oven to 300 degrees. Tear kale off stem into large pieces. Spread on cookie sheet in one layer. 2 Lightly drizzle or spritz with olive oil and sprinkle with salt. Gently toss. 3 Bake for 15–20 minutes until crisp. Keep an eye out… They go from perfectly crisp to burnt pretty quickly.
