American flags, red and white table cloths, balloons, bubbles, candies, tents for the gleaming sun and the Tomberlains’ Treat Truck gave it the great American patriotic spirit. The setting was a parking lot behind Silver Grizzly. Clients and their families brought lawn chairs and coolers anticipating a good time. Children enjoyed

themselves as they ran around, playing ring toss and blowing bubbles. But that is not all. Noonday band rocked the evening. To sweeten the party, Cole Tomberlain and Randy Lott manned the grill. Juicy super-sized hot dogs and mouth-watering links; fourth of July cookies and various drinks kept clients happy and hydrated. Charles Tomberlain Insurance Agency and Sugar Magnolia Properties ended the evening with an exhibition of fireworks that stunningly illuminated downtown Longview.

AG Paxton Obtains $900,000 Judgment ...From Page 1

Richard J. Burns in connection with his sale of property in an illegal Caldwell County subdivision known as Century Oak Estates. The state’s lawsuit against Burns included allegations that he engaged in unlawful conduct in the sale of lots in Century Oak. Burns deceptively represented that lots were fit for residential use when in fact some were in flood plains, others had illegal septic tanks, and purchasers were unable to obtain building permits because Century Oak Estates was an unplatted and unrecorded subdivision which had never been approved by Caldwell County. The judgment bars Burns from engaging in similar deceptive sales practices and prohibits him from acting as a residential mortgage loan originator without a license as required by the Texas Finance Code. Burns is also prohibited from engaging in contract for deed financing without complying with the requirements of

Attorney General Ken Paxton the Texas Property Code. The judgment further establishes a refund program to be implemented by an independent third party settlement administrator who will provide notices to eligible consumers with details about the program and its options. Burns is ordered to fully cooperate with the settlement administrator and his failure to cooperate subjects him to a potential penalty of $450,000. In resolving this case, Attorney General Paxton worked with Caldwell County District Attorney Fred Weber and also received the cooperation of the Texas Department of Savings and Mortgage Loans.

Student Debt Means Fewer Public Servants — and More Bankers

Indebted students trained for public service are instead cutting bait and heading for Wall Street. By Alyssa Aquino Cum laude, my diploma reads — “with honor.” But cum debitum, “with debt,” is a bit more accurate. Collectively, America’s student borrowers owe $1.7 trillion. On average, each graduating senior this year is beginning their life around $37,000 in the hole. That looks like a lot, but when you’re living with student debt, you look at that number and don’t even flinch. The debt is so normal it’s like an inside joke for pretty much everyone in my generation. Except we’re the punch line. I graduated class of 2015 from a private, liberal arts college — a “most selective” one, U.S. News and World Report assures me. It was also an expensive degree, Sallie Mae reminds

There was a calculus there, and one part of it was “I liked the feeling of it.” I know, this type of sentimental idealism is a privilege. It’s no surprise I came out with the equally sentimental notion that I wanted to do non-profit work — which makes it that much harder to pay those loan bills. It’s baffling to my Filipino parents. They didn’t cross the ocean and consign themselves to discrimination and demeaning jobs because they liked the “feel of it” — or even on the promise that their lives would be better. They did it on the promise that my life would be better. And that I wouldn’t owe anyone anything. They could live underwa-

ter, they decided — but they at least expected their children to take a breath of fresh air. Well, sometimes it feels like the air is polluted. And the water is teeming with loan sharks. So much so that some companies — among them many banks, financial institutions, and other large for-profit businesses — have begun including student loan repayment assistance in their salary packages. I have to admit it’s tempting, especially since the Trump administration wants to end a federal program that would forgive the student loans of people who commit to public service work. What’s the alternative, after all? Having a non-profit career in something you care about can require years of

barely remunerated labor: an unpaid internship, volunteer work, a minimum-wage second job, or a salary that barely meets the threshold for a living wage. Prioritizing a career in something you care about,

in addition to paying rent and groceries, requires consigning yourself to a debt you’ll live with until you have children. That is, if you have children — since you don’t want to deal with their student debt either.

It’s not surprising to me that some of my classmates decide to return to school — maybe if they add more letters to their degree they’ll magically land a job they’re passionate about with a salary that can pay the bills. It’s also not surprising that some of my peers decide to join the other side, cashing in on connections and scooping up those high-paying corporate jobs. But what happens when you have a generation of people trained to enter the public service entering Wall Street instead? What a loss. This is just one facet of the student debt crisis — others include putting off starting a family or buying a home. Too many of us are saddled with debt, and too many of us are structuring our lives around this ledger.

America Needs Service Workers Free As You Can Afford to Be — And They Need Health Care Universal health care costs money. Going without costs more. By Jill Richardson Our country is founded on a myth that anyone can succeed so long as they work hard. That’s the story of Alexander Hamilton that has swept Broadway: how a “bastard orphan” can become “a hero and a scholar.” According to the lyrics he did it by working harder, being smarter, and being a self-starter. If that’s all you need to do to succeed, then it’s your own fault if you’re poor. And White House spokeswoman Kellyanne Conway has no sympathy for you. If you’re sad the Republican health care bill is going to take away your Medicaid, she says — and it will — you can go get a job. Because your poverty is your own fault.

To quote Ernest Hemingway, “Isn’t it pretty to think so?” The reality isn’t as nice. We don’t live in a society where anyone can get ahead just by working hard. It might feel that way if you grew up middle class, but that’s not the reality millions of Americans live in.

Sociological research confirms this unpleasant truth again and again. As for the people on Medicaid who should just “get a job,” odds are they already have a job. Maybe two jobs. We as a society want people working in restaurants, cleaning our hotel rooms, checking us out and stocking shelves at stores, and doing any number of lowskilled, generally low-wage jobs. Some people even oppose giving those workers a raise because it would either cut into corporate profits or raise prices. Well, we can’t have it both ways. We can’t benefit from low-wage labor while simultaneously blaming low-wage workers for their own poverty. And if you’re truly callous enough not to care if the working poor have access to affordable health care, consider how their plight affects you. Suppose for a moment that 22 million Americans lose their health care, which is what the Congressional Budget Office predicts if the Senate passes the Republican health care bill. What happens? Those 22 million people no longer go for preventative check ups. They don’t treat

medical problems when they occur, before the problems get worse. They wait until they have no choice, and they go to the emergency room. If they cannot pay the bills accrued at the emergency room, the hospital eats the cost. But hospitals must balance their budgets somehow, so they raise prices for everyone else. If you’re insured, then you’re not paying the hospital directly, so the higher prices go to your insurance company. And they pass it on to you in the form of higher premiums. Thus, if you aren’t moved by the human suffering caused by depriving the working poor of health care, perhaps you’ll be moved by your own pocketbook. Unless emergency rooms start declining treatment to anyone who can’t pay, turning cancer patients and gunshot victims onto the streets to die, somebody is going to pay for the care of the uninsured. The question is whether they’ll be able to go for preventative check-ups and treat problems early, or whether they ‘ll go to the emergency room after they can no longer avoid it. For those who rely on Obamacare for their insurance — myself included — the prospects of losing their health care is terrifying. I have several friends with cancer who are literally afraid they will die if the repeal bill passes. And that’s not hyperbole. It’s time we stopped telling ourselves that anyone who’s struggling only has themselves to blame. And as the wealthiest nation on earth, it’s a travesty that we aren’t willing to help them.

GOP leaders want to protect your “freedom” to be poor, powerless, sick, and uninsured.

By Jim Hightower I think of freedom in positive, aspirational terms — as in FDR’s “Four freedoms,” or in the uplifting songs of freedom sung by oppressed people everywhere. But right-wing ideologues have fabricated a negative notion of “freedoms” derived from their twisted concept of individual choice. You’re “free” to be poor, politically powerless, or ill and uncared for, they say — it’s all a matter of decisions you freely make, and our government has no business interfering with your free will. This is what passes as a philosophical framework guiding today’s Republican congressional leaders. For example, they say their plan to eliminate health coverage for millions of Americans and cut such essential benefits as maternity care for millions more is just a matter of good ol’ free-market consumerism. As explained by Jason Chaffetz, a Utah tea party Republican: “Americans

have choices. And so maybe, rather than getting that new iPhone that they just love and they want to go spend hundreds of dollars on that, maybe they should invest in their own health care.” Lest you think that Chaffetz must simply be an oddball jerk, here’s a similar deep insight from the top House Republican, Speaker Paul Ryan: “Freedom is the ability to buy what you want to fit what you need.” Yes, apparently, you’re as free as you can afford to be. As Vice President Mike Pence recently barked at us, Trumpcare’s you’re - on - you r- ow n philosophy is all about “bringing freedom and individual responsibility back to American health care.” The GOP’s austere view is that getting treatment for your spouse’s cancer should be like buying a new pair of shoes — a free-market decision by customers who choose their own price point, from Neiman Marcus to Goodwill. And if you go barefoot, well, that’s your choice.

Frauds and Scams Every day, Texans lose money to scams and frauds. It happens in more ways than you can imagine. Decent, intelligent people are duped out of their life savings by smooth-talking, utterly unscrupulous crooks. These are people who will look you in the eye and lie. You have been warned about mail fraud, telephone fraud, internet fraud and door-to-door fraud. But how will you know it when you see it? Whether they reach you by mail, by phone, by email or by talking to you in person, they will give themselves away if you know what to look for. No matter what the bait they offer you, underneath it is a hook. Don’t get hooked by consumer fraud! FIVE HOOKS: TELLTALE SIGNS OF A SCAM THEY contacted YOU. Think about it. If you look up a business and call to make an order, you know who is on the other end of the deal. With a con artist, all you know is who that person says he or she is. You are already at a huge disadvantage. They dangle BAIT in front of you. It is almost always a large sum of money, like a prize or an easy loan, or a large income. It sounds so easy! But we all know that

people don’t give away large sums of money so easily, or pay large incomes for nothing. Only in daydreams. They want your PERSONAL INFORMATION. Anytime someone tries to get your bank account number, Social Security Number, or other sensitive information, you should automatically be on red alert. Don’t do it. First, YOU have to pay THEM. Don’t be blinded by the promise of a large sum of money in the future. If they are asking you to give them money first, back off. It is illegal for someone to require up-front payment before funding a loan or paying out a sweepstakes prize. And real employers don’t generally ask new hires to shell out money. You have to WIRE or AIRBORNE money instead of MAILING it. This is your last warning: if you are on the brink of wiring somebody money in order to get a prize or a loan, an inheritance or any other large sum of money, STOP! It’s a scam, and they are trying to avoid the stiff penalties for mail fraud. You are about to be robbed. By mail, by phone or face to face, con artists dangle baited hooks in front of honest people every day of

the week. It usually begins with an unsolicited contact from a company, individual or organization you never heard of. You do not know who the caller really is. Real lotteries don’t call you to say you’ve won. You don’t get grants without applying for them. You don’t get easy loans if you have bad credit. Real money is hard to get. It doesn’t just come to you. But there are people who would like to take whatever money you have to lose. Don’t get hooked! We are often contacted by frantic family members of victims of fraud, who are unable to convince the victim that the scam is not real. Phony lotteries and sweepstakes can be very persuasive to some people. Some people are particularly vulnerable to scams. Seniors may be lonely, trusting, and confused. If you are having a hard time convincing someone to stop sending money to a scam artist, you can call this office at (800) 252-8011 for assistance. You may also wish to approach your family member’s bank, where staff may be willing to alert you of withdrawals. In addition, law enforcement officers may be willing to visit the victim; the uniform can be persuasive. A law-abiding victim can sometimes be swayed by the knowledge that it is illegal to receive the

proceeds of a foreign lottery. Victims are often ashamed of having been duped. It can help them to understand that the con artists who perpetrate the scams are highly skilled and sophisticated. Intelligent, educated people can be fooled. WHEN THE BUSINESS CAN’T BE FOUND This problem is as old as the expression “Fly by Night,” which describes the crook who sells you a raw deal and leaves town before you realize you’ve been had. Today, thanks to the Internet, the disappearing business is more common than ever. Every single day, consumers contact the Office of the Attorney General saying, “They don’t answer their phone, return my messages, or respond to my emails. They said they would give me a refund if I changed

You can contact the SOS to find out the name of the registered agent for the business. Unfortunately, crooks tend not to bother reporting themselves to the proper authorities. However, if you have lost money to a business that you can no longer reach, you can try to find contact information from the Secretary of State, or the county clerk where the business is located. But don’t wait for this to happen. Instead, before you do business, make sure the company is real. It should have a real address and real people registered to do business in this state or another state or country that registers real businesses. Seek independent confirmation that the business is what it claims to be. Our best defense is education. Even if you have been scammed already, it’s not too late to arm yourself against its happening again. When people know how to spot a scam, they can stop short before they lose their money. We want you to keep your hard earned money.

Save on Your Summer Road Trip Adventure By Nathaniel Sillin Are you packing up your car and hitting the road this summer? You’re not alone. According to a survey conducted by AAA, road trips are the most popular type of vacation for families in the U.S. in 2017. In fact, 10 percent more families are expected to take road trips this year than last. From driving to the tip of Cape Cod, to seeing the Great Lakes all the way to a drive through the Yosemite Valley in California, there are limitless ways to explore on the road. Whether you’re going to visit family or taking off on an epic adventure, a road trip can be a great way to make travel about the journey rather than the destination. Before you hit the road, make sure your car can handle the trip. Before you pack up your car, it’s a good idea to take your car to a mechanic and ensure that it’s ready for the drive. Having your car inspected and serviced by a mechanic before a road trip can be a worthwhile

investment that could both save you money and prevent an untimely breakdown. Looking into a rental car is an alternative you may want to consider if you’re hoping to avoid wear and tear that might depreciate your car’s value. Consider your options carefully and choose what makes most financial sense for you. Pack for bumps along the way. A flat tire or dead battery can put a serious damper on your road trip, especially if you’re not prepared. Keeping a spare tire in your car and checking your tire pressure and tread should be on your

pre-trip checklist. Along with your bags, bring a few items for preventive maintenance measures on the road. Having jumper cables, coolant and engine oil handy can save you time and money. Map out your trip ahead of time. While just jumping in the car and driving without a set destination can be an enticing idea, the spontaneity will likely result in more expenses. Knowing when and where you’ll stop ahead of time, especially for hotels and outings, will help you stick to a budget. If you still crave the more adventurous aspects of a

road trip, you can make a general plan for your major excursions and routes, while stopping for unexpected attractions and views as you go. Comparison shop to keep hotel prices under control. Booking ahead of time and using comparison shopping websites will save you from driving around to find the best hotel deal when you’re already tired from a long drive. If you do have to book last-minute, consider using hotel coupon books, hotel-booking apps, group coupon sites or reward points to save a little more. Camping could be another alternative to

booking a hotel, which can be particularly cheap if you already have gear like tents and sleeping bags. Managing your mileage could add up to major savings. Though fuel prices may generally be down, the cost of filling up your tank can still add up. To make this cost more manageable, you can take advantage of apps that help you find the best gas prices in your area. In certain cases, you may also want to consider renting a more fuel-efficient car. You can save even more by mapping your trip ahead of time to avoid road tollways and construction that might slow you down. Keep kids entertained to avoid unnecessary stops. Kids tend to get antsy in the back seat, which can lead to more frequent stops and a few impulse buys if you’re not prepared. Packing snacks and meals ahead of time can help you avoid making extra purchases at the gas station, and will often be cheaper. Also have a plan for keeping your kids entertained. Let them choose a few activates ahead of time, like preparing a road trip playlist or making a

game like road trip bingo with sights you’ll be seeing along the way. If you have a tablet or phone, downloading free games, podcasts or movies can be another great option. Protect your home while you are away. One other way to save on your road trip is to ensure that your home is protected while you’re gone. If you can, ask a trusted neighbor, friend or family member to keep an eye on your house. If you can’t find someone to help, you can call US Postal Service to hold your mail while you’re away. Double check that you’ve locked all doors and windows, including the garage door, and that you’ve set your alarms and put your lights on a timer. Bottom line: Road trips can be an adventurous and inexpensive way to see the country, but costs can add up if you’re under-prepared. Planning your stops and packing to anticipate your needs could help you enjoy the ride rather than worry about the expenses.

Smith County Receives Beat the heat at the 2016 Safety Award Eighth annual Christmas

The Smith County Commissioners Court was presented with the Texas Association of Counties 2016 Safety Award on Tuesday, July 11, 2017. Isaac Garcia, a representative from the Texas Association of Counties (TAC) Risk Management Pool, presented the award, which he called a county-wide effort. Counties across the state work hard to prevent employee injuries and to increase workplace safety. Each year, the TAC Risk Management Pool presents awards to recognize counties and governmental entities for their efforts in promoting safety and innovative risk management programs. TAC members participating in the Workers’ Compensation Program are eligible to apply for the annual Safety and Gold Star awards.

“This award is a sincere way of thanking you for your strong commitment to safety and for your participation in the TAC Risk Management Pool,” Ernest Galindo, TAC Assistant Director for Risk Control Services, wrote in a letter to Smith County Judge Nathaniel Moran notifying him of the award. “Congratulations again on this achievement.” The county’s losses for worker’s compensation have been very good in 2016, as well as the past several years, Garcia told the court. He said he expects to see good things continue in 2017, and for the county to apply for the Gold Star Safety Award. Achieving the Safety Award is made possible when each employee contributes to it, he added. Smith County Judge Nathaniel Moran congratulat-

ed Smith County’s Human Resources Team, made up of County Administrator/ HR Director Leonardo Brown, HR Coordinator Esmeralda Delmas and HR Administrative Assistant Jaye Lynn Collins. Brown thanked his staff, whom he said did not often get a chance to be publicly recognized. He also appreciated all of the Smith County department leaders in doing a good job letting their employees know that the county cares about them and provides them with what they need if they ever get injured at work. Judge Moran said the Safety Award is not an award that goes to every county. It takes a lot of work and a lot of years to get there, and achieving that status is a great benefit to county employees, he added.

The City of Tyler Parks and Recreation Department will host the eighth annual Christmas in July Arts and Crafts Fair at the Harvey Convention Center on Saturday, July 15 from 9 a.m. to 5 p.m. and Sunday, July 16 from 11 a.m. to 5 p.m. The event will feature more than 100 booths offering unique, fun, and handmade items for sale. Admission is $2 at the door and donations will be accepted for Parks Department programing. Door prizes will be available. “This event is import-
