La Società SISAS era un’Industria Chimica di base, operativa dal 1947, e produceva acetilene dal cracking del metano; nel corso degli anni ha avviato la produzione di ossigeno e azoto per, infine, produrre nel 1977 “intermedi” per materie plastiche. La società è stata dichiarata fallita nell’aprile del 2001. Nel 2000 (con la legge 388/2000) era stato istituito il sito di bonifica di interesse nazionale di Pioltello/Rodano, che ha una estensione di circa 700.000 mq ed al cui interno è compreso l’ex stabilimento SISAS, su una superficie di circa 300.000 mq. La Commissione Europea ha avviato, sin dal 2001, una procedura di infrazione comunitaria nei confronti dell’Italia per la mancata rimozione dei rifiuti presenti nelle tre discariche (“A”, “B” e “C”) dello stabilimento ex SISAS. Il 9 settembre 2004 la Corte di Giustizia delle Comunità Europee ha pronunciato, per la mancata rimozione dei rifiuti dalle discariche, una sentenza di condanna nei confronti dell’Italia. In data 19 dicembre 2005 la Commissione Europea, a seguito della nuova procedura di infrazione, iniziata il 5 luglio 2005, ha emanato un secondo parere motivato. Nell’autunno del 2006, il Collegio dei Commissari dell’Unione Europea ha deciso di deferire, per la seconda volta, l’Italia alla Corte di Giustizia per la mancata esecuzione della seconda sentenza di condanna. Al termine di una intensa azione di negoziato, nel dicembre 2006 la Commissione Europea ha concesso una sospensione della decisione di notificare il ricorso, a fronte dell’impegno di rimuovere i rifiuti dalle discariche entro il 31 dicembre 2010. Nel mese di luglio 2009 sono stati rimossi da parte della proprietà dell’area ex SISAS i rifiuti dalla discarica “C”. In ragione dei ritardi accumulati, il 16 aprile 2010 con Decreto del Presidente del Consiglio dei Ministri, è stato dichiarato lo stato di emergenza e, con successiva Ordinanza del Presidente del Consiglio dei Ministri il 30 aprile 2010, è stato nominato Commissario Delegato l’Avv. Luigi Pelaggi. Il 22 luglio 2010 il Commissario Delegato ha indetto una gara d’appalto, a livello europeo, per la rimozione dei rifiuti dalle discariche “A” e “B”, che è stata aggiudicata il 30 agosto 2010. Il 18 settembre 2010 sono iniziati i lavori di rimozione dei rifiuti “pericolosi” e “non pericolosi” dalle discariche “A” e “B”, lavori che si sono conclusi nei termini stabiliti dalla Commissione Europea, con la rimozione di circa 280.000 tonnellate di rifiuti, di cui 91.000 tonnellate “pericolosi”.
SISAS Company was a basic Chemical Industry, operative since 1947, and it produced acetylene from cracking of methane; throughout the age it started oxygen and nitrogen production, and then, in 1977, it started also the production of “intermediates” to make plastic materials. The company was declared failed in April 2001. In 2000 (with the 388/2000 law) the Site Remediation of national interest of Pioltello/Rodano had been established; it has a 700.000 sqm area about, within which lies the ex-plant SISAS, with an extent of about 300.000 sqm. European Commission has started, since 2011, a community infringement procedure towards Italy for failure to remove the hazardous waste inside the three landfills (“A”, “B” and “C”) of the plant ex-SISAS. On September 9, 2004 the Court of Justice of European Communities has given, for the failure to remove the waste from landfills, a guilty verdict against Italy. On 19 December 2005 the European Commission, following the new infringement proceedings, which began July 5, 2005, has issued a second reasoned opinion. In the fall of 2006, the College of Commissioners of the European Union has decided to refer, for the second time, Italy to the Court of Justice for failing to carry out the second sentence. After an intense action of negotiations, in December 2006 the European Commission has granted a stay of the decision to notify the appeal, for the commitment to remove the waste from landfills by December 31, 2010. In the month of July 2009 waste from landfill "C" have been removed by the property of ex-SISAS area. Because of the delays, on 16 April 2010 by Decree of the Prime Minister, was declared a state of emergency and, by subsequent order of the Prime Minister, on April 30, 2010, attorney Luigi Pelaggi was appointed Deputy Commissioner. On 22 July 2010, the Deputy Commissioner has issued a call for tenders, at European level, for the removal of waste from landfills "A" and "B", which was awarded on August 30, 2010. On September 18, 2010 works began to remove the waste "hazardous" and "nonhazardous" from landfills "A" and "B", works that were completed under the terms established by the European Commission, with the removal of about 280,000 tons of waste, of which 91,000 tons "hazardous".
