Mountain Bike @ Thanyapura Mountain Bike Classic 2017. A new mountain bike race through Khao Phra Thaeo National Park, highlighting ecological tourist destinations, following the popular King of the Mountain Trail Run on the same day. The 10th Anniversary Millennium Resort Patong Phuket Charity Run 2017 is organised in conjunction with the Millennium’s 10th year celebrations. “Engaging with Autism” is the theme and the main objective is to raise funds by collecting participation fees. All funds will be donated to the Phuket Panyanukul School (PPS) to support and improve teaching-learning quality and to gain new and effective ways in educating children with autism. Cultural event @ Rawai Beach & Sapam village Loy Reua ceremony is observed by Moken or ‘sea people’ across Phuket. Participants build a boat from local palm wood and place wooden dolls made in their likeness in the boat before launching it. This removes bad luck, now embodied in the dolls. Witness the ceremony that finishes with ‘ronggeng’ dancing at Ban Sapam, Nga Cape, Rawai Beach, Si Rae Island, Lanta Island and Phi Phi Island areas.

The Phuket Vegetarian Festival is a colourful event held over a 9-day period in October. It celebrates the Chinese community’s belief that abstinence from meat and various stimulants during the 9th lunar month of the Chinese calendar will help them achieve good health and peace of mind. Over the years the festival has grown and developed into a spectacular annual event attended by thousands, with participants flying in from China and other Asian countries.

Loy Krathong is a peaceful and significant festival of lights. Participants release – into the sea, a river or a lake – preprepared candlelit floating vessels, made from sliced banana-tree trunk, that they have filled with symbolic emblems, such as coins, hair snippets and nail clippings. The festival’s purposes are (1) to thank the Goddess of water, Phra Mae Khongkha, for the use water and to apologise for polluting it, (2) to pay respect to the Buddha footprints on Nammatanati river bank in India and (3) to symbolically let go of unhappiness and sickness

PHUKET, Thailand – Cape Panwa Hotel Phuket Raceweek welcomed 41 boats and over 500 sailors and friends for its 14th edition which was held 19 – 23 July, 2017 and saw four days of excellent warm water racing off Phuket’s southeast coast.

“We had an excellent, high quality fleet of boats and sailors this year ranging from a Swan 55 competing for the first time and the TP52 Team Hollywood (ex Origin) through to sports boats, as well as a very competitive group of 40-footers who enjoyed some close racing throughout.

Headquartered at the exclusive 5-star Cape Panwa Hotel, the regatta put on an excellent onshore programme of activities over four nights, culminating in a last night Gala Dinner attended by sailors and yachting and government dignitaries, which was matched by a top quality racing programme managed by a World Sailing International Race Officer and an experienced team of on-water professionals.

We broke our own multihull record this year with 21 boats competing over four classes, including the newly introduced Multihull Cruising. This year definitely had one of the most competitive fleets ever at Raceweek,” said Byron Jones, Managing Director of the regatta’s owner and organiser, Media Business Services Co., Ltd.

Spread across seven classes, the 41-strong fleet included the largest ever number of multihulls at the event, 21, as well as regional yachting luminaries and a diverse mix of sailors from more than 25 countries, including many charter teams from Australia, Japan and around Asia, as well as an all Chinese team chartering at the event for the first time.

After three days of idyllic tropical sailing, it came down to a final day shoot-out to decide many of the podium places and while Ray Roberts’ Team Hollywood (AUS) dominated IRC I, it was a close tussle for second and third, which went to East Marine Emagine (AUS) and Loco (SIN) respectively.

In IRC II, Phoenix (DEN) were the clear winners, while the all ladies team on Sailescapes Farrgo Ladies (AUS) managed to claim second over Krabi Boat Lagoon Piccolo (GBR). In the Cruising class it was Lady Bubbly (AUS) who claimed the honours, while a fast finishing BeauX Esprits (AUS) leapfrogged into second ahead of Who Dares Wins (GBR) in third. Asia Catamarans Hurricane (AUS) defended their title in Multihull Racing while the trimaran Thor (GBR) finished second ahead of Phantom V (AUS) in third. In Multihull Cruising it was an Australian top three: DaVinci, Mojo, Siesta in first, second and third respectively. Another to defend their title, and in the process set a record for winning five consecutive years, was John Newnham’s Twin Sharks (GBR) in the Firefly 850 class. Although winning the last race of the series, the all-Japanese crew on Natsuki Motoyoshi’s Mil Grace (JPN) had to settle for third behind Blue Noze (GBR). The one-design Corsair trimarans racing in the Pulse 600 class went down to the wire with Java Racing (GBR) edging out Multihull Solutions H30 (AUS) for the win, and SuDu Red (AUS) placed third.

Nikita’s Thai/Seafood/International Daily 9am until late Created by its Thai owner 23 years ago, Nikita’s enjoys a sensational location oceanside at Rawai Beach. Customers dine in a lush garden setting right at the sea’s edge with white sand underfoot and enjoy spectacular ocean and island panoramas during the day and a romantic atmosphere at night. Nikita’s boasts no fewer than 18 cocktails, but we settle for a traditional gin and tonic. A Tomato Bruschetta comes as appetizer, followed by an unusual dish, a spicy salad with glass noodles and peeled prawns. The wine list is well chosen – 12 whites and 15 reds, plus five choices available by the glass. A competitively priced Santa Alicia cabernet sauvignon from Chile – full bodied with supple tannins – provides a perfect complement to our meal. Seeking something distinctive for the main course, my friend orders a firm-fleshed and succulent Mahi-mahi (dorado). Served with a creamy white sauce laced with Thai herbs and mashed potato, it is pronounced superb. My choice is a whole, Deep-fried white snapper in fish sauce (sweet and sour sauce is also available) with a Thai inspired salad of crisp slivers of green mango and peanuts. Delectable. It is worth noting that many of the vegetables served here are sourced from Nikita’s own farm. Famous for its thin-crust pizzas – all cooked in a wood-fired oven – the choice includes classics such as Margarita with mozzarella, tomato and basil. All Nikita’s pizzas are celebrated for their lavish toppings. Then there’s English style fish and chips, coated in beer batter, a house speciality. Though Nikita’s emphasis is on seafood and international dishes, there is an impressive range of authentic Thai dishes. We finish in style with a slab of hot, dark chocolate mousse and a scoop of fragrant ice-cream. A sensational and contrasting mix of flavours, textures and temperatures. Barceloneta Seafood Rice by @ Kata Rocks Oceanfront Restaurant Ingredients 8-10 raw red prawns | 250g calamari | 250g cuttlefish | 1 large onion chopped | 1 red bell pepper | 100g Spanish rice | 1 garlic clove chopped | Saffron | 400g grated red tomatoes | 300g mussels | 100g green peas | Extra virgin olive oil | monkfish, shrimps and crab Method Fry the red prawns, chop the cuttlefish and calamari with the extra virgin olive oil; reserve the prawns. Add chopped onions, garlic and bell pepper and cook until soft. Add grated red tomatoes and cook until brown colour. Add rice, salt, saffron and seafood stock. Cook for 12 minutes, and then add the mussels, green peas and red prawns. Finally cook for 5 minutes until the rice is cooked.

Seen from a travel perspective the north-eastern part of Thailand, or Issan as the Thais know it, is relatively untouched, which is all the more reason to go.

The best way to experience Issan is by road. The region is the least developed in Thailand and although cities like Ubon Ratchathani, Khon Kaen and Udon Thani are rapidly developing, the vast majority of Issan comprises swathes of arable land and misty mountain ranges intercepted by roads of varying standards that connect the many small villages. Public transport is surprisingly effective, extensive and affordable, but to really get up close and personal with these roads less travelled, rent a vehicle and go explore on your own. The people of Issan are some of the friendliest and most hospitable you’ll meet

A good place to sample the food on offer is Talat Ha (market five). Drive north along the border to Mukdahan, a small trading town on the banks of the Mekong River. From Mukdahan head west and let Route 12 take you through swathes of more or less arable land, through the province of Kalasin until you reach Khon Kaen, one of the largest cities in Issan and a technological and educational hub. Apart from Khon Kaen University and the city’s silk production, Khon Kaen is known for its grilled chicken, one of the cornerstones in what Thai people consider a typical Issan meal. In fact the people of Khon Kaen province have perfected the art of grilling chicken and in the district of Khao Suan Kwang the dish is considered to be a bit of an art form.

Nonetheless, the company is open to new ideas; it is, for instance, considering introducing a natural option based on wafer thin slate veneers, which can be used both indoors and outdoors for floors and walls, and has recently also been trialed with applications to bespoke furniture on a project in Koh Samui tile-it has two showrooms. The other is on Petchburi Road in Bangkok’s rising star Huay Kwang district. A third showroom was open for 13 months in Chalong, but was closed when work on the new underpass strangled access to the facility. But they were quick to seize a promotional opportunity; the tile-it logo still shines bright and a banner on the building is themed on the film ‘The Great Escape’. It declares: “Building a tunnel? Come and see us at our new, expanded showrooms in Cherng Talay”.

Though floor, wall and mosaic tiles have been around since the Egyptians and Romans, huge strides have been made in recent years in their design and manufacture. A legal professional’s plea

A

lthough I have contributed in the public domain a fair number of articles, covering myriad legal topics, in my eight years in Thailand, my partner has been the primary contributor to this publication over the course of our firm’s operations.

I often find myself admiring my partner’s practical, straight forward, concise and common sense approach to writing legal articles, which tend to resonate the current hot topic ‘du jour’, and often are the catapult for subsequent discussions or evening chats with clients, local friends and professionals in the Phuket community. That said, when my partner asked me this week if I would like to write a piece for Window on Phuket, I jumped on the opportunity to contribute, as it had been some time since I last wrote an article here.

Over the course of the past week, I pondered what issue I should focus on this time around, and thought to myself, “What should I write about that is currently on the mind of Phuket residents – both locals and tourists alike?” Thai Real Estate? Nah, not this time, as that has been done and dusted dozens of times, not only by yours truly… Foreign investment rules, limitations and structuring? No. Too many re-stated statutes, rules and regulations to cite, and I’d rather just talk to people in person about the topic in any event. Employment Law? Naturally, a topic always on the mind of Phuket business people, but also a topic full of legal jargon and jibberish. How about legal liability relating to negligent road accidents, in particular accidents caused by “brake-failing” buses and the like? Bingo. Certainly, the spate of recent well-publicised bus accidents on Patong Hill alone are a cause for serious concern and discussion in the whole of the Phuket community. However, this serious, potentially life-threatening, issue does not seem to be limited solely to Patong Hill, or even Phuket for that matter. As I write this article, I have read that yet again an inter-provincial bus located out of Ubon Ratchatani has slammed into a truck stopped in the middle of the road, causing yet another death and at least a dozen more injuries in Nakhon Rachasima. The bus is ostensibly owned by a ‘tour’ company, according to the report.

When and how will this end? In the wake of the recent accidents at Patong Hill, authorities have promised to conduct various public hearings, hold land transport committee meetings and to set-up police ‘check points’ in an effort to discuss how to resolve the problem and help curtail the sheer number of road accidents. Sure, this could be helpful in certain aspects, and it appears good-intentioned proposals have been made (including going forward with the now infamous Patong Hill tunnel project), but I suspect a lot more will need to be done to really get to the root of the problem. Sometimes, we are asked whether bus or van owners or tour companies can be held liable for the actions of their employed or contracted drivers who cause harm, injury or death to others in road accidents. The general answer is “maybe”, assuming that some agency and/or principal liability can be attributed to the owner or company conducting a tour, or that the owner or tour company acted negligently and breached their duty of care in respect of the use or operation of the bus in question. Thai law does have certain, but limited, provisions covering these legal circumstances and does permit recovery for injured persons where an owner or tour company is found negligent or reckless, or is found to have somehow committed a “wrongful act” causing the harm.

However, these legal principles have limited value, and are applicable only in the context of the harm having already occurred. Furthermore, connecting the owner or tour company to negligence can give rise to several legal issues and defences, thereby further limiting the legal application in practice.

Government agencies and private companies must also continue to work to improve road conditions and step up the traffic law enforcement. Whatever it is, there is no overnight solution, and only robust and cooperative efforts among various sectors of society will ultimately reduce the tragic occurrence of road accidents.

It is no wonder, then, that police only mention the names or companies of the buses in the accidents, and ultimately, at least so far as we are aware, charge only the drivers with reckless driving causing serious injury or death. Overall, therefore, the law does not currently seem to be an effective deterrent to poor driving and maintenance.

In my home country, the United States, this article could be interpreted by some to be a form of ‘ambulance chasing’ advertisement. However, I can say for myself, that I would just like to see the number of ambulances dispatched for road accidents greatly reduced and eventually stopped.

It may, nonetheless, be that there is a a role for lawyers and law firms to take private action on behalf of the countless innocent victims harmed as a result of the high number of road accidents, where authorities have not done so. That being said, it will inevitably require a far broader community effort to quantitatively reduce the number of bus and other road accidents in Phuket and in greater Thailand. Driver education and greater responsibility from owners and tour companies is obviously necessary, as is a continued effort from the media to report and investigate all major accidents and subsequent actions taken by authorities to apply appropriate pressure to work for change.

n some western countries, during the process to transfer ownership of real estate, the law obliges the interested parties to use the services of a public body or representative to protect the buyer by making ‘due diligence’ compulsory. In Thailand however, parties can directly go to the relevant administration to register the ownership or rights in immovable property transfer. But some choose not to. Consequently, some buyers take the risk to be engage (in a purchase) without performing a competent and comprehensive due diligence process and unfortunately stand to lose a lot of money if they don’t comply.

In Phuket, land use restrictions are encompassed under three laws with the relative ministerial regulations. • The Building Control Act • The City Planning Act • The National Environmental Control and Maintenance Act All of these have been enacted within the last 40 years. Due diligence is implemented basically on the title deed, the building, the owner or holder of the immovable rights and legal relations between them and third parties. The title allows certain private use and grants rights to use, possess, own, or to transfer rights by freehold and leasehold. There are three titles to be considered: the Nor Sor Sii Djor (chanote), the Nor Sor Sam Gor and the Nor Nor Sam. The due diligence report regarding the title deed will show all historical transactions and any encumbrances as servitude or mortgage.

The said building has also to be free of any debt, charge or other restriction of private or public laws other than the usual easements. To avoid future legal litigation, the construction must correspond to the correct permit issued. In condominium projects, rules and regulations are even stronger, and some developers use the word ‘condominium’ only for marketing purposes with the result that at the end of negociations the condominium license won’t be issued and the unit will not be registered under your name. In the case of land and building, the owner of both can differ, in this case, one of the assets can be subject to checks made for each particular owner as to his/her criminal and civil background which could impact on the legal process of acquisition. A Thai company can also be the owner of the whole asset. In this case, the buyer can purchase shares and become director of the company. The due diligence procedure will request specific verification in accounting and tax domains. For the above reasons, the first step of your real estate investment should be followed through with due diligence. It makes perfect sense.

Each year at this time, the area around Phuket’s ‘Fresh Market’ becomes congested with food stalls; everywhere is festooned with red lanterns and Chinese dragons, all centred on the Jui Tui shrine. One of the fascinating aspects of Phuket’s cultural traditions is the complex fusion of Chinese religious beliefs with those of the original inhabitants of the island.

It all began in the early 1900s, when tin ore was discovered in the Kathu area and hundreds of Hokkien Chinese were drafted in to do the mining. They either brought their families with them or intermarried with the locals. A thriving community blossomed and, in 1825, the Governor Praya Jerm moved the provincial capital from Ta Reua to Kathu. The Chinese community had such critical mass that an itinerant Chinese opera company visited to entertain them. Here the story gets a little confused, but basically the whole area was struck by a major epidemic and almost everybody except the opera players became sick.

On the first night of the ninth lunar month, the sacred 10-metre lantern pole is raised to facilitate the arrival of the gods, and at midnight, nine lanterns are suspended, one for each god

Following their beliefs, the players had stuck to their religious calendar, which at this time of year required that they observe a strict vegetarian diet and offer prayers to two Chinese gods, Kiew Ong Tai Teh and Yok Ong Sone Teh. The residents attributed their invulnerability to these religious observances. An alternative explanation may be that since Kathu was a swampy jungle and it was the time of the monsoon rains, the visitors may have introduced a malarial strain – to which they themselves were immune – to the local mosquitoes, which thrived in the damp conditions. When the rains stopped the insects’ breeding ponds disappeared and the epidemic abated naturally. Be that as it may, the following year, the Haio Lan and Lian Tui regalia and sacred scripts were brought from China. When this precious cargo arrived at Bang Niao, the whole community went there to welcome the ship.

In a further, rather gruesome, practise, adherents pierce their faces and tongues with everything from skewers to bicycle spokes to axes. Oddly enough, this self mutilation results in little bleeding or subsequent scarring. Stranger than fiction. However it’s not for the queasy, so probably best not to bring the kids!

For most, however, the festival isn’t so fraught. Many restaurants and stalls all over the island will fly yellow banners decorated with red script, proclaiming that they are offering authentic vegetarian dishes – and they are delicious. Somehow the cooks manage to prepare dishes, which are just as tasty as normal meaty fare, but without the meat.

If you wish to practise a strict observance during the festival, here are the ‘rules’: • Maintain maximum body hygiene • Use specified kitchen utensils only for the festival • Dress in white or in very light colours • Behave yourself, physically and mentally • Abstain from eating meat, fish, eggs and milk • No sexual intercourse • Stay away from alcoholic beverages and tobacco • People in mourning should not attend ceremonies • Pregnant women should not attend ceremonies Major shrine locations
