The tourist-popular Big Buddha viewpoint and temple complex on the hills separating Kata and Chalong has been closed for safety while the site is inspected for illegally encroaching on protected forest at the top of the Nakkerd Hills.
Bannaruk Sermthong, Deputy Director-General of the Royal Forest Department (RFD), told The Phuket News, “I urge everyone to cooperate by avoiding the Big Buddha area during this investigation.
“Entering the restricted zone could be considered a violation of the National Reserved Forests Act B.E. 2507,” Mr Bannaruk warned. The closure of the site is primar-
ily to prevent further landslides, especially during the current period of heavy downpours on the area. “It is crucial to minimise vehicle traffic and foot traffic in the area. Vibrations from transportation can exacerbate the risk of landslides,” Mr Bannaruk said.
The tourist-popular site was closed after RFD officers seized five rai of land in the surrounding protected forest area appropriated by the Phra Phuttha Ming Mongkol Foundation, which operates the Big Buddha complex.
Officers conducting investigations and inspections of the site are allowed into the area, Mr Bannaruk noted.
“The RFD has granted local government agencies full access to the site to address the situation effectively. Our role is to support their work to the fullest extent.” he said.
Around the end of 2023, the Phra Phuttha Ming Mongkol Foundation, which operates the Big Buddha complex, submitted a request to the Royal Forest Department for access to adjoining protected forest areas, along with a request for exemption from the Cabinet for construction on 15 rai not already dedicated to the Big Buddha complex, Mr Bannaruk explained.
The RFD is currently awaiting the Cabinet’s decision on whether to relax the restrictions on Class 1A watershed areas, he noted.
“The request for this 15-rai expansion was submitted in line with the Cabinet Resolution from June 23, 2020. The Phra Phuttha Ming Mongkol Foundation sought permission to construct within this area in
accordance with the Building Control Act of 1978,” he said.
“The RFD asked Phra Phuttha Ming Mongkol Foundation to submit the request document for relaxation of watershed class 1A to the Cabinet first. If it is approved, the RFD will reconsider the construction,” he added However, construction onto five rai of land has already been completed without permission, and the runoff new construction has caused is now under investigation as the potential cause, or major contributing factor, of the deadly landslide on Aug 23 that killed 13 people and damaged more than 50 homes.

Phuket Governor Sophon Suwannarat has detailed the impact of the three major flood and landslide disasters that have already affected Phuket so far this rainy season, and issued a raft of instructions to officials to improve warning for local residents and implement measures to help prevent any further rain-induced disasters.
The Governor’s missive was delivered at a meeting held at Phuket Provincial Hall on Sept 2, where he later addressed the press to explain his instructions.
Governor Sophon emphasised the urgent need to conduct surveys and install soil movement monitoring stations equipped with tools to detect and warn of potential landslides and flash floods, said an official report of the meeting.
The systems are expected to be effective in providing a warning up to one hour before an incident occurs, covering all high-risk areas in the province, the report added.
Additionally, plans were discussed to plant banyan trees and giant leucaena as ground cover to stabilise the soil. Engineers have also been tasked with designing water retention weirs that can slow down water flow during the rainy season.
Present at the meeting were Phuket Vice Governor Adul Chuthong; Somkid Chukong, Advisor to the Governor; along with Watanapong Suksai, Di-
rector of the Phuket Natural Resources and Environment office, and other key officials.
The details of the disaster reported by Governor Sophon were as follows:
On June 30, 2024, around 4am, heavy rainfall of over 330 millimetres hit Phuket Province, leading to flooding and water accumulation in several areas of Thalang and Kathu Districts. The affected areas in Thalang District include Pa Klok, Thepkrasattri, Srisoonthorn, Cheng Talay and Sakhu subdistricts.
In Kathu District, flooding occurred in Pak Kua Law community, Baan Phakdee community, Baan Nuea community and Namtok Kathu (Kathu Waterfall) community, as well as in Kathu and Kamala subdistricts. A mudslide was reported at 6am. in Baan Hua Khuan, Moo 5, Kamala. The flooding and mudslide affected a total of two districts (Kathu and Thalang), seven
subdistricts, 44 villages, 4 communities, 2,059 households and 6,202 people.
On Aug 23, heavy rainfall of 200mm was recorded in several areas of Mueang Phuket District. This led to flooding and water accumulation in Chalong, Rawai and Karon. At around 5am, a mudslide occurred in Moo 2, Karon burying houses in the area. The disaster affected three subdistricts (Chalong, Rawai and Karon), impacting nine villages, 260 households, and 817 people.
The tragedy resulted in 13 deaths and 19 injuries. Additionally, 170 houses were partially or completely damaged, and one road, Pak Bang Rd in front of Karon Municipality, was also damaged.
Karon Municipality verified the information to ensure accuracy before it was presented to the Karon Municipality People’s Assistance Committee.
The committee met at
Karon Municipality offices on Sept 3 to discuss providing assistance according to the regulations of the Ministry of Interior on expenses for aiding affected people under the authority of local administrative organisations.
On Aug 28, a flood and landslide occurred in the Thepburi housing estate in Baan Kuku, Moo 3, Ratsada. The disaster affected 11 households and 50 people.
In response, Phuket Province declared Moo 3, Ratsada, as a disaster/emergency disaster relief area due to the flooding and landslide.
As part of the initial assistance, Ratsada Municipality set up a temporary shelter at Phim Prapai Place Hotel and provided temporary accommodation at Ratsada Municipality School in the Na Luang area for affected families while their houses are being repaired.
As of Sept 2, five households, consisting of 20 people,
had opted to stay in the temporary shelter. The remaining 30 people are staying with relatives.
Ratsada Municipality is providing food and drinking water to the victims in accordance with government regulations.
Governor Sophon announced that Phuket Province has established guidelines to prevent and address landslide issues through collaborative efforts across all sectors to ensure public safety, said the official report.
The province has developed a master plan for managing high-risk areas, accelerated the use of community-level landslide risk maps to inform residents in vulnerable zones, and coordinated with local administrative organisations to prepare for natural disasters before, during, and after they occur.
Efforts have been made to design and implement a prevention, monitoring, and warning system, particularly in high-risk areas, using modern technology, innovation, aerial and satellite imagery, and other relevant data, the report added.
At the meeting a list of 49 ‘Risk Areas’ for natural disasters was presented.
“These resources will be utilised to maximise benefits in relation to land use, especially for public utilities and building construction,” the report said.
“Soil movement measurement stations equipped with monitoring tools have been set
up in risky areas to provide warnings of landslides and flash floods, with the ability to alert residents up to one hour before an incident,” the report added.
The report made no mention of local residents in Karon complaining of a weather monitoring station on the hill where the Karon landslide occurred failing to provide any warning. Officials later confirmed the instrument was not functioning.
Regardless, the official report of the Governor’s message on Sept 2 said, “The Department of Mineral Resources has partnered with the National Broadcasting and Telecommunications Commission (NBTC) to monitor and issue disaster warnings for flash floods and landslides via mobile phone networks, ensuring that information is delivered quickly and efficiently.”
“To further reduce the risk to life and property, Phuket Province [sic, the Phuket Provincial Office] has planned to plant fast-growing cover crops, such as banyan trees and giant leucaena. The Royal Forest Department is coordinating to obtain seeds, which will then be distributed in target areas by helicopter,” the report added.
“Additionally, the province is working with relevant agencies to design and construct water retardation weirs. Engineers are focused on creating an efficient system that can effectively slow down water flow during the rainy season,” the report concluded.

The RFD has already filed a formal complaint, and provided evidence, to the Karon Police, and formally reported the Phra Phuttha Ming Mongkol Foundation for charges related to the encroachment, Mr Bannaruk confirmed.
Mr Bannaruk said the RFD had reported the required demolition of several structures on the illegal
expansion, including a parking lot and six additional buildings: a multi-purpose facility, a restroom, a water tank installation tower, a water system control building, a passenger waiting pavilion and accommodation units.
“The RFD has also sent a warning letter to Kata Temple and the Phra Phuttha Ming Mongkol Foundation, outlining the cancellation of a previous project approved in 2002 [when construction of the Big Buddha began]. The letter clearly states that all activities related to this project
must cease immediately, and no further extensions will be permitted,” he said.
“According to the law, those responsible for the [landslide]
problem must be held accountable. However, it is up to the Karon Police to conduct the initial investigation, working with engineers to identify the responsible parties and gather evidence for accountability,” Bannaruk said.
“If the investigation concludes that the Phra Phuttha Ming Mongkol Foundation is at fault and they are found guilty, they will be held responsible for covering all damages and associated costs,” he added.
The investigation is currently underway with the
Karon Police, under the direction of Pol Lt Gen Surapong Thanomchit, Commander of Region 8 Police, Mr Bannaruk explained.
“The RFD are requesting an expedited investigation to address the issue promptly and ensure fairness for all involved,” he said.
Mr Bannaruk dismissed the notion that the iconic Big Buddha statue will face demolition, as reported in previous news stories.
The demolition of struc-
tures at the Big Buddha site will apply only to illegal construction on five rai of land “near Big Buddha, not the Big Buddha [statue] itself.” Mr Bannaruk clarified.
“My intention was not to demolish the entire site, but only to address the five rai of land that exceeds the agreed limits. If further evidence is uncovered by the police and the court rules them guilty, then demolition will be enforced as part of the court’s sentencing.” he said.

The Phuket Kwaeng Court has ruled Swiss expat Urs Fehr, called ‘Swiss David’ by Thai media, not guilty in the charge of assault brought against him for allegedly kicking a woman doctor in front of his rented luxury villa in Pa Khlok in February.
The court handed down its decision on Sept 3.
Fehr, the founder of Green Elephant Sanctuary Park in Cherng Talay, was charged with assault after Dr Thandao Chandam, a doctor at Dibuk Hospital, filed a formal complaint.
The incident occurred on Feb 24 when Dr Thandao and her friend were sitting on steps to Yamu Beach near Fehr’s rented villa to watch the full moon. Fehr approached them, demanded they leave, and then allegedly kicked Dr Thandao in the back.
Fehr has consistently denied the allegations, claiming he slipped while approaching her. Fehr and his wife, Khanuengnit, told police and officials they mistakenly thought Dr Thandao and her friend were trespassing on their property.
A video of the incident circulated online, sparking anti-foreigner sentiment and a protest at the beach near Fehr’s villa, amid claims that foreigners were trying to claim the area as a private beach.
Officials confirmed the steps to the beach were illegally built on public land, and they were subsequently demolished.
Kasem Chandam, Dr Thandao’s father, told the press today that Dr Thandao is “saddened by how things have turned out”.
“She’s taking time to decide whether to continue with legal action or let it go, needing some space to gather her thoughts. At the moment, she’s not ready to make any moves,” he said.
Adding to her stress is David’s ongoing claim that the incident was accidental, especially after he was found not guilty, Mr Kasem said.
Though she’s feeling quite stressed, Dr Thandao has chosen not to comment on the court’s decision, he added.
Her legal team and her family plan to request a copy of the ruling to review together before deciding on the next steps, Mr Kasem said.
The case reignited debate online, with renewed doubt on the court’s decision. The controversy centres on Fehr’s wife’s claims of connections with senior Phuket police officers, raising questions about the integrity and transparency of the case. It remains unclear whether Fehr will face deportation now that the court has cleared him of the charge.
While in Phuket in March, Interior Minister Anutin Charnvirakul said, “What happened was the behaviour of a few people, but wherever it happens, we will handle it. You can see that recently it was done. We withdrew the visa. An appeal was submitted to the Ministry of Interior. There is no need to appeal, it’s a waste of time, better to go home.”
Meanwhile, Fehr remains in the country and continues living in Phuket.
LOCAL OFFICIALS IN PATONG ARE ramping up efforts to address ongoing issues in the popular tourist area of Patong by taking steps to improve public safety, cleanliness and order in the area, with particular focus on Soi Bangla and what an official report called the “notorious” Soi Lao.
Led by Kathu District Chief Thammarong Chuay-akson and supported by various local agencies, a team of officials conducted an inspection of the popular nightlife area on Sept 5.
Joining the inspection were Patong Deputy Mayors Sanakorn Keesin and Lalita Maneesri, along with Weerawit Kreuasombat, President of the Patong Entertainment Business Association (PEBA) Weerawit Kreuasombat, who also serves as Advisor to Patong Mayor Chalermsak Maneesri.
The initiative aims to tackle several issues, including drug-related activities, illegal street vending and the “misuse of public spaces”, explained an official report of the inspection.
The primary focus is on Soi Lao, a public alley off Soi Bangla, where illegal activities, including drug sales, have been reported, the report added.
Mr Weerawit revealed that Patong Municipality had received numerous complaints about Soi Lao being encroached upon by private interests and becoming a hub for illicit activities.
AN ASSISTANT VILLAGE headman in Thalang District has warned people to beware the monkeys on Khao Rang (“Monkey Hill”) in Phuket Town after a large monkey ripped the seat of his parked motorbike apart to see what was under it.
The assistant village headman, Suriyan Mai-on, posted a video of the incident online last Saturday (Sept 8), sparking many comments by netizens urging people to be careful when near the popular monkeys.
The park has designated parking areas for cars and motorcycles, but one side near a restaurant is more prone to monkey activity. No monkeys were to be seen when he parked his motorbike near the fitness area, and there were very few visitors at the time due to the rain, Mr Suriyan explained.
Soon after he parked his motorbike, a large monkey arrived and began ripping the motorbike seat cover off with his teeth, then pulled out the stuffing underneath with his paws.

The complaints are currently being contested in court, and local leaders are confident that Soi Lao will soon be restored as a public space, possibly housing a security and tourist assistance centre.
Meanwhile, Deputy Mayor Mr Sanakorn stressed that additional police patrols would be deployed in Soi Lao, particularly at night when illegal activity tends to increase after entertainment venues close.
Patong Municipality is also enforcing stricter rules on food carts operating in public areas, such as Patong Beach, he said, citing concerns about waste, traffic obstruction and general disorder.
The crackdown is part of a broader campaign by the Patong Municipality to clean up the area and enhance its reputation as a safe and beautiful destination for tourists, the official report noted.

Suchada Wachirabirak, 52, who has worked collecting garbage at Khao Rang Viewpoint for 24 years, said the monkeys have been a mischievous presence in the area for years. Ms Suchada estimates there are around 80 monkeys, which often scavenge for food and damage cars.

TWO TEENAGERS WERE killed and another teen remains in hospital with serious injuries after the speeding pickup truck they were travelling in veered out of control and crashed on Thepkrasattri Rd early last Friday morning (Sept 6).
Police were called to the scene, near the Srisoonthorn Municipality offices, at about 3:15am.
Officers and rescue workers ‒ from the Kusoldharm Foundation along with a Srisoonthorn Municipality Rescue Unit and a team of paramedics from Thalang Hospital – arrived to find a white Isuzu D-Max 4-door pickup truck that had veered off the road and onto the central reservation.
The pickup had struck a traffic sign before colliding with a palm tree. The force of the impact had torn the tray from the back of the pickup.
Three male teenagers were discovered injured inside the wreckage. Authorities identified the victims as 19-year-old Nattawut Chahajak as the driver, with Thanawat Songsri, 18, and a 17-year-old as his passengers.
Emergency crews pro -
vided first aid and rushed them to Thalang Hospital for further treatment.
Police were later informed that Mr Thanawat and the 17-year-old had succumbed to their injuries, while Nattawut remains hospitalised.
Investigators believe the accident occurred as a result of high-speed driving, with the truck’s speedometer frozen at 150km/h at the time of the crash.
The police report noted that officers believed the pickup had started hydropaning on the wet road, leading to the crash.
Witnesses reported that the vehicle had been speeding in rainy conditions, causing the driver to lose control.
At last report police were continuing their investigation into the accident.

Police last week began urgently searching for clues regarding the death of a Russian man whose body was found with multiple severe wounds along the Karon Beachfront on Sept 3.
The body of Ilia Orlov, 27, was discovered in the canal near the Naga statue, located about halfway along the beach, at about 1pm.
Karon Police Chief Pol Col Khundet Na Nong Khai arrived and cordoned off the area while forensic officers inspected the scene.
Officers discovered multiple injuries on the body, including a wound around the eye, bruises on the left ear and deep cuts on both arms down to the bone.
Other wounds included a wound on the left leg and bruising under the chin, in the mouth, eye sockets, and around the Adam’s apple, indicating the possibility of being struck by a hard object.
The injuries suggested that the victim had been dead for approximately eight hours before being found, police said.
Found at the scene was a black satchel containing Mr Orlov’s identity documents,
A BRAWL AT A CONSTRUCtion site in Patong in the morning of Sept 6 left two electricians hospitalised with injuries inflicted by machetes.
Patong Police were called to the scene, a worksite operated by Chinnaatch Co Ltd near the intersection of Phra Metta Rd and Ratchphat-anusorn Rd, at 10:40am.
On arriving at the scene, officers discovered three Thai men, ceiling installers, standing outside the construction site.
According to the workers, the altercation involved a group of eight electricians who were subcontracted for electrical work.
Tensions had reportedly been escalating between the two groups, which work in adjacent rooms on the fourth floor of the building.
A verbal argument broke out and quickly turned physical, with machetes being used in the ensuing brawl.
Two electricians sustained injuries and were taken to Patong Hospital by bystanders.
The remaining six electricians fled before police arrived, while the ceiling installers were brought in for questioning at Patong Police Station.
At last report police were working with the contractor to locate the six electricians who fled the scene as they continued their investigation.

Mr Orlov entered Phuket on Jan 24 on 90-day visa-free status. He later extended his stay by leaving and reentering the country at the Satun Immigration Office, police noted.
Although photos of the body showed long cuts down both wrists, a forensic doctor at the scene initially said that the nature of the wounds raised doubts about the possibility of suicide. However, Phuket Provincial Police Commander Pol Maj Gen Sinlert Sukhum said on Sept 5 that evidence obtained by investigators pointed to the possibility of suicide.
Regardless, as the investigation continued, officers from several divisions, including the Region 8 Police Investigation Division, Phuket Provincial Police and Karon Police swept the area for any sign of a weapon used to inflict the wounds. They also reviewed CCTV footage of the area.
Mr Orlov had been staying with his wife at an apartment provided by a Russian couple behind Wat Karon. The couple was earlier arrested by police for overstaying their visas in Thailand. The couple was taken to Karon Police Station for further questioning. Investigations are ongoing, with authorities continuing to search for more evidence to clarify the circumstances of the death, with further details to be reported to the Russian embassy.
PATONG POLICE LAST SATURDAY (Sept 7) brought in for questioning a motorcycle taxi driver who stood accused of sexually harassing a female passenger.
Officers tracked down the driver around 8:30pm last Saturday (Sept 7) at the taxi queue at 200 Rath-U-Thit 200 Pi Rd following a post on social media earlier that day accusing the driver of sexual harassment.
The post did not stipulate whether the harassment was verbal or physical, nor did any official reports from Patong Police. Similarly, the social media channel on which the post appeared was not named.
The driver was questioned in relation to the claims before admitting that “he had flirted with the female passenger” as stated on the social media post.
He was then taken to Patong Police Station, where after questioning officers warned him of his conduct, specifically stating for
him not to engage in any suggestive and threatening behaviour of a sexual nature in future.
The driver, unnamed in police reports, was also fined and issued a warning for operating a vehicle that was not registered and for not possessing a valid driver’s licence.

The Central Investigation Bureau (CIB) has recommended legal action against the developer of the failed The Peaks Residences Condo project for failing to provide compensation to two Australian buyers into the project.
The two Australians filed a formal complaint of fraud against the developer, Kata Beach Co Ltd, at Kamala Police Station on Sept 3.
The men, who were joined by their lawyers, explained to the press that they had paid more than B5 million of the B6mn condo price, but the unit was never delivered as per the contract.
The construction of the project was stopped because the land deed was illegally issued. The entire project was demolished for illegally encroaching on protected forest land in the hills overlooking Kata Beach.
Despite winning a civil lawsuit against the company, the developer failed to provide them with an alternative condo or refund their money, the men said.
During the case it was discovered that the Kata Beach Co Ltd did not have any assets and had insufficient funds to pay the compensation.
A company representative who offered an alternative condo in another project had not legal right to do so, they added.
As a result, the men met with Kamala Police Chief Pol Col Somsak Thongkliang, and filed a fraud complaint against Kata Beach Co Ltd.
The complaint was filed with the support of the Consumer Protection Police Division (CPPD) under the Central Investigation Bureau (CIB).

The complaint stems from al-
legations that the company illegally sold land without a valid title deed to both Thai and foreign buyers. The project was halted when it was discovered that the building permit was invalid from the start, as condominiums can only be built on land with a proper title deed, the lawyers explained.
The deception allowed the company to collect deposits, contract fees and payments for the units, each worth several million baht.

B80 million (more than US$2.3mn) is underway as part of the ‘new Sarasin Bridge’ project, the new Phuket Highways Chief has confirmed. Somkid Kittisopit, Director of Phuket Highways Office, revealed the news during an update meeting with Phuket Governor Sophon Suwannarat at Phuket Provincial Hall on Sept 2.
Mr Somkid, who replaced Phuket Highways Office Chief Yutthana Phitak on Aug 14, gave updates to five major transportation projects “aimed at enhancing travel efficiency, reducing congestion and supporting economic and social development in Phuket”, said an official report of the meeting.
The new Sarasin Bridge project is a key component of the ‘MR9 network, Phase 2’, which connects Phang Nga to Phuket, Mr Somkid explained.
The bridge will span from Takua Thung District in Phang Nga to Thalang District in Phuket, linking Highway 4 in Mueang Phang Nga District with the expressway project that ‒ once completed ‒ will connect Mueang Mai, Koh Kaew and Kathu.
The bridge will also feature a new dualtrack railway across it, which will complete the northern section of the decades-in-coming ‘light rail’ mass-transit system.
Mr Somkid explained that the primary objectives of the new Sarasin Bridge are to:
- Support Travel into Phuket Province: Improve access to Phuket, making it easier for residents and tourists to travel to and from the province.
- Reduce Traffic Congestion: Alleviate traffic bottlenecks on existing routes, enhancing overall traffic flow and reducing travel times.
- Enhance Convenience and Safety:** Provide a safer and more convenient route for drivers, contributing to a smoother transportation experience.
He added that in addition to improving road transportation, the project aims to:
- Connect the Transportation System: Integrate the new bridge into Phuket’s broader transportation network, ensuring seamless connectivity across different regions.
- Support Economic and Social Development: Facilitate economic growth by improving access to key areas, boosting tourism, and enhancing the quality of life for local communities.
- Accommodate Large Ships: Enable large vessels to navigate more easily through the Chong Pak Phra channel (which separates Phuket from the mainland), providing better access to Phuket Province’s port area and supporting maritime activities. The Phuket News

However, years later, the construction remained unfinished, and the buyers were advised to contact the company for refunds.
Kamala Police Chief Pol Col Somsak said that Kamala Police had been contacted by the CPPD, which has already taken initial action on this damage and forwarded the case to Kamala Police Station. Kamala Police had now received a formal complaint and will proceed
with further investigation, he said.
The Australians told the press that they had filed the complaint to seek justice because the money used to buy the property was all the money that they had saved, and they wanted to live in Phuket.
Even though they won the civil case, they still did not receive any compensation. From this incident, they do not want Thailand to be viewed badly in the eyes of foreigners, the men said.
The CIB noted that according to the Consumer Protection Law, the real estate development business is a strictly controlled business, both in terms of contract and advertising. Therefore, selling real estate in a housing project that cannot deliver the real estate according to the contract is considered a negligence of the operator who must be directly responsible to the consumer.
In addition, if there is a situation that is fraudulent or deceptive, it will be considered a criminal offence against the victim. The victim must therefore be compensated for the damage without discrimination based on the nationality of the consumer under the law of the Kingdom of Thailand.
Such actions of the business operator have seriously damaged the reputation of Phuket and Thailand in the eyes of foreigners, the CIB noted.

The Thai Revenue Department is drafting a law to tax the income of individuals residing in Thailand that originates from overseas.
The draft follows the international principle of worldwide income under the residence rule, said Revenue Department Director-General Kulaya Tantitemit.
This principle holds that income earned by an individual, regardless of its source country, must be taxed by the country where the individual resides for a specified period.
The drafting of the law requires an amendment to Section 41 of the Revenue Code.
The amendment would stipulate that individuals residing in Thailand for 180 days or more must pay personal income tax on income earned overseas, regardless of whether that income is brought into Thailand.
Ms Kulaya said the proposed amendment would specifically target personal income tax and would not include corporate income tax or income from mutual funds investing abroad, except for private funds.
If and when it is enacted, the new law would follow a major change that took effect this year in the way income from foreign sources is treated for tax purposes in Thailand.
Current tax law calls for individuals who reside in Thailand for more than 180 days per year to pay taxes to Thailand on income earned locally and also on any income earned abroad that is brought into the country.
Previously, if an individual met the 180-day tax resident requirement and had foreign income, they paid personal income tax on that income
only if it was brought into the country within the year it was earned.
This rule was revised effective from Jan 1, 2024. Tax is now payable on foreign income regardless of when it is brought into the country.
To give an example, Mr A sold shares in an overseas company in 2020, realised a capital gain and banked the money in an overseas account. If he brings the proceeds from that capital gain into Thailand in 2024, he must report it as assessable income when filing a tax return.

ensure that large multinational corporations pay a minimum tax rate of 15% worldwide in the countries where they operate. If a corporation pays less than 15% in any given country, it must pay additional tax to bring the total up to 15% in the country where its parent company is headquartered.
The GMT agreement applies only to multinational companies with global revenues exceeding €750 million ($870mn) per year.
In the first 11 months of the 2024 fiscal year, the Revenue Department collected B1.963 trillion, exceeding its target by 0.4% or B8.44 billion.
The good performance was attributed to government measures to stimulate consumption, such as the easy e-Receipt programme, which increased the collection of value-added tax from domestic consumption.
Ms Kulaya said she expects that by the end of this fiscal year on Sept 30, the department will have met its target of B2.28trn.

More investment funding is expected from revamped units of the Thai ESG Fund, while the fiscal 2025 expenditure budget of B3.75 trillion, which starts on Oct 1, should lead to several disbursements from October to December, said Mr Lavaron.
He said the Vayupak Fund would proceed as planned, with the investment prospectus issued on Tuesday (Sept 10), detailing the guaranteed minimum and maximum returns for investors.
Retail investors can subscribe to investment units on Sept 16-20, while institutional investors can subscribe from Sept 18-20, said Mr Lavaron.
Payment for subscribed units is due from Sept 25-27, he said.
The Vayupak Fund is scheduled to start investing in the SET on Oct 1, with trading expected to begin by Oct 10.
Pornchai Thiraveja, director-general of the Fiscal Policy Office (FPO), said the injection in the fourth quarter offers an upside for the economy, potentially pushing economic

Afresh petition was lodged with the Election Commission (EC) on Monday (Sept 9) seeking the disbandment of the ruling Pheu Thai Party and five coalition partners for allegedly allowing themselves to be influenced by former prime minister Thaksin Shinawatra.
The five other parties named in the complaint filed by Nopparut Worachitwutthikul, a former leader of the 2006 White Pigeon group, were Bhumjaithai, United Thai Nation (UTN), Chartthaipattana, Prachachat and Palang Pracharath (PPRP).
Mr Nopparut’s allegation was based on the Aug 14 meeting of key figures from these six parties with Thaksin, father of Pheu Thai Party leader Paetongtarn Shinawatra, at Thaksin’s residence after the Constitutional Court ruled to remove Srettha Thavisin from office.

Addressing the Senate on Sept 5, Dr Keskamol said there is no specific agency with the authority to oversee social media content effectively because the National Broadcasting and Telecommunications Commission (NBTC) and the Digital Economy and Society (DES) Ministry have separate roles.
The NBTC oversees broadcasting media and telecommunications but has no authority over social media outlets. The DES Ministry, on the other hand, is responsible for online media but does not have the authority to regulate content, she said.
According to the senator, social media outlets lack oversight, resulting in the release of harmful content that can potentially undermine national security.
She proposed that a regulatory agency should be established to monitor inappropriate content with the authority to take legal action against those responsible for such content.
Dr Keskamol also suggested the development of safe and creative media content, the promotion of media literacy among users and the provision of channels for reporting inappropriate content.
“I’m calling for the setting up of a body to effectively oversee social media content and work with platform owners to stop the spread of content that poses a threat to so -
ciety,” she said.
However, the senator’s proposal has raised concerns about freedom of speech.
Nanthasit Nitmetha, president of the Society of Online News Providers, argued that content produced by media outlets and created by influencers must be differentiated.
He said online media outlets are required to adhere to professional standards and be regulated by a professional code of ethics, while influencers are deemed to operate freely.
However, Mr Nanthasit disagreed with any proposal to regulate influencers because it could infringe on their freedom of expression. There is already legislation like the computer crime law that deals with illegal content.
He said anyone affected by online content can report it to the platform owners to have it blocked or take legal action.

Surapong Piyachote is seeking approval from Prime Minister Paetongtarn Shinawatra of the State Railway of Thailand’s (SRT) intent to sign one of the last two construction contracts in the first phase of the long-delayed Thai-Chinese high-speed train project.
Contract 4-5 for the construction of a 13.3-kilometre section of the first phase project has already been awarded to Boonchai Panich Co via bidding, according to the minister.
However, he said the contract signing has been held back due to an issue regarding the site of its Ayutthaya Station, located 1.5km from the Ayutthaya Historical Park. Even though this section’s planned route will not cut through or be adjacent to the Unesco World Heritage site, its proximity has sparked public concern.
According to Mr Surapong, it prompted the SRT to seek consultations with UNESCO and the Office of Natural Resources and Environmental Policy and Planning to conduct a Heritage Impact Assessment (HIA) on the construction plan. The assessment has been completed, and an HIA report has been submitted to UNESCO for consideration.
Mr Surapong said the SRT has also
agreed to reduce the height of the elevated high-speed train track in this section from 19 metres to 17m.
However, the SRT will not consider moving the planned route further away because it will result in a substantial increase in budget and cause the construction to be delayed by another 10 years, he said. He said the SRT had responded adequately to UNESCO’s recommendation and could not afford to delay the B9.91-billion planned construction while waiting for UNESCO’s final opinion on the HIA study.
He said the SRT wants the construction contract signed with the selected contractor by October, which requires the PM’s approval. He added he would seek to talk with Ms Paetongtarn on the matter as soon as possible.

Back from the Southern province of Trang, and what Thais call a ’burning’. A prosaic epithet for what is a momentous event, impressive in its timehonoured rituals, but to an outsider – a curiosity among 200 mourners – sometimes sounding an incongruous note. A farming community dependent on rubber, defiantly putting on a show that it cannot afford, paying homage to Buddhist monks, who depart laden with gifts ranging from electric fans to cloth and cash.
The public solemnities lasted for three days – though the private preparations took far longer. What was unseen was the ritual washing and dressing of the body, the six days of mourning vigil by monks. In the daughter’s case, a raft of duties: booking catering services, including staff and equipment; ordering and preparing food and drink; buying a range of appropriate presents; decking out the temple with gilded casket, flowers and framed photographs; installing a sound system; above all, trying to make sense both of family differences and labyrinthine finances.
My partner, the elder daughter, slept on the spartan floor for a week, beside herself with anxiety the entire time, trying to balance the books (mostly family contributions in sealed white
envelopes ), and ultimately failing. One rogue relative had absconded with half the government grant intended for the occasion.
I arrived on the afternoon of the first day, the fun day, with ‘solemnity’ assuredly not an appropriate word. Collective heads swivelled to focus on Mr Moneybags, enthusiastically welcomed to a party already in high spirits and full swing: 20 tables, each laden with five or six different local dishes – from pork bone stew and vegetable soup to curried chicken. Bottled water, ice, Leo beer and Sangsom rum flowed all evening.
Western funerals are sombre events – hence the epithet ‘funereal’ – but this was party time. And the partying ‘family’ was an extended one: everyone in the neighbourhood seemed to have turned
up to enjoy the free food and drink, everyone from posses of excited children to stick-wielding old men. Two male groups, one hunched over playing cards, the other involved in a board game with dice, spent the evening gambling. They were the last to leave. Gaming for money is rigorously forbidden by law in Thailand , but here was a chance to gamble in the certain knowledge that the police would not come near the place. I thought of Christ expelling the money-changers from the temple, raging that a house of prayer had become a house of trade. Here, nobody turned a hair…
The obsequies on the following day were in stark contrast. Presided over by saffron clad monks, the chanting of the ‘Adhidhamma’ was hypnotic, a ritual allied to the Buddhist celebration of the
cycle of life, death and ultimate rebirth. The sense of a spiritual journey to mark the soul’s tranquil transition to the next realm was moving , the atmosphere palpable, with the whole community of worshippers profoundly involved in a meditation little changed since time immemorial. Black-clad devotees paid homage to the gilded coffin, and made merit with gifts.
Inevitably, there were some concessions to changing times. Throughout the ceremony mourners scurried around taking photographs with their mobile phones; at the conclusion, an engineer removed speakers that had pumped out recorded chanting, and disconnected the fairy lights from impressive banks of yellow and white plastic roses. Back to a world of everyday…
In conclusion, the gilded casket was lifted down, and borne aloft on its short, terrestrial journey to the ‘men’ (crematorium). Minutes later, tell-tale swirls of smoke emerged from the chimney. It only remained for the dutiful daughter to return to inspect the ashes, something my ‘farang’ sensibilities would not allow me to do. Her mother’s bones, I was informed, were ‘lovely and white’ – apparently a good omen…
I came back to Phuket with a battered wallet, and eight passengers in the pickup, including a baby and a motorbike – travellers too poor to afford the bus fare back to Phuket, where they eke out an existence.
Life – and death – still goes on, and so does poverty…. Heigh ho.

We start with Frittura di carciofi e mozzarella, a delicious Mediterranean course of fried artichokes and mozzarella cheese served with arrabbiata and salmorigio sauces. The fried artichokes are a delight – rich and buttery with a slight nutty taste – and pair perfectly with the arrabbiata sauce.
Next, we dig into a Sardinian pasta dish called Lorighittas alla sassarese
– twisted pasta rings with semi-aged Pecorino sheep cheese and parsley. This is an exquisite dish; the pasta is fluffy and light, and the sauce is incredibly creamy.
We are excited to try the all-new Thai menu items, and the first dish to arrive is Yum Yanad Budu, a Phuket pineapple spicy salad with slipper lobster ‘budu’ sauce and lemon sorbet. The salad is beautifully presented and has a unique flavour due to the fermented anchovy sauce (budu) which is popular in Southern Thailand.
A classic favourite, Tom Kha, is placed on our table to accompany the
salad. The soup is served in its own coconut shell, which makes an Instagram-worthy presentation. It’s a dish that pays homage to Thailand’s love of coconuts; inside there is coconut, young coconut flesh, coconut shoots, coconut milk and shrimp paste plus a large Hokkaido scallop, fresh vegetables and a crispy mushroom stick for dipping into the soup. The Tom Kha dish is rich and creamy, and a nice twist on the traditional Thai recipe.
From the charcoal grill BBQ, we choose a 200-gram Australian Black Angus Beef striploin, cooked medium, and served with four house made sauc -
es and Mediterranean aromatic butter. The striploin is tender and juicy, and our favourite sauce is the Bordelaise –roasted beef bones gravy with red wine, mustard and shallots. Scarola strascinata also accompanies our striploin. It’s a simple dish of sautéed escarole (a variety of endives) in extra virgin olive oil and garlic.
Although we’re stuffed, we can’t say no to dessert! When it arrives, we’re stunned by its beautiful presentation. The dessert is Gelato di Pistachio di Bronte con gelo di anguria, a creamy, flavourful Pistachio di Bronte ice cream with pistachio nuts and watermelon gelée.
We leave the restaurant happy and with full tummies. Dining at Isole Creative Island Cuisine is truly a top-notch culinary experience.

Thailand finished the Paris 2024 Paralympics with a final medal haul of 30 to rank a respectable 21st place in the overall table.
Thai athletes competing across a range of different sports in the French capital managed to win six gold medals, 11 silver and 13 bronze.
Leading the way was Saysunee Jana who made Paralympics history as the first female wheelchair fencer to win three gold medals in all three disciplines of sabre, foil and epee.
The 50-year-old won her third gold of the Games by defeating Kang Su of China last Friday (Sept 6) in epee category B. She previously beat China’s Xiao Rong in the gold medal contest of the women’s foil category B on Sept 4 and the same opponent 24 hours previous in the sabre category B final match.
The three golds won in Paris took Saysunee’s overall total to five since her first Paralympics in 2004 in Athens. Over the past 20 years, she has competed in six Paralympics
tournaments.
“I’m very happy and proud of myself. I didn’t think I could do it,” said Saysunee after last Friday’s win. “I can’t describe my happiness today in words. Before the tournament, I expected to win only one gold in epee.”

JANNIK SINNER WON his second Grand Slam title of 2024 last Sunday (Sept 8) when he swept aside Taylor Fritz in the US Open final, shattering American hopes of a first male champion at the majors in 21 years.
World number one Sinner, who won his maiden Slam at the Australian Open in January, became the first Italian man to triumph in New York with a 6-3, 6-4, 7-5 victory.
For 23-year-old Sinner, it was the 55th match win of the season and sixth title.
After his 21-year-old rival Carlos Alcaraz pocketed the French Open and Wimbledon titles earlier this year to take his majors collection to four, the two men have cemented their places as the powerhouses of tennis’s new era.

Para badminton player Sujirat Pookkham won silver in the women’s singles class WH1 against Japan’s Sarina Satomi. It was Sujirat’s second medal of the Games after her bronze in the women’s doubles WH1WH2 event with Amnouy Wetwithan.
Also in badminton, Mongkhon Bunsun claimed a bronze medal in the men’s singles SL3 event after he beat Japan’s Daisuka Fujihara, while powerlifter Kamolpan Kraratpet took a maiden medal in the sport for Thailand when she won bronze in the 55-kilogram class with a 108kg lift in her third attempt.

At times the game was a stop start affair although the intensity of the collisions and the determination to cross the gain line enthralled the crowd and occasional half-breaks ignited passion.
When the first South African scrum drove the All Blacks back it looked like the game would be over very quickly. However, to the All Blacks’ credit they regrouped quickly and were the more dominant team in the first half, especially at the tackle contest. Technically the All Blacks looked the more complete team, but this is a South African squad full of winning belief.
Springboks coach Rassie Erasmus has a wealth of young talent coming through and consequently they are expanding their playing style with players looking to avoid contact and offload the ball, which keeps the team going forward.
The All Blacks’ inability to score a try despite possession and field position will be a serious topic of concern for their coaches. Codie Taylor had an outstanding first half and carried the All Black attack, but the final try scoring pass eluded them. In tight games in your opponent’s red zone, it is imperative to make positive decisions that lead to
tries. Make a mistake and the defence takes over.
Under pressure, especially after halftime, the All Blacks’ discipline also let them down. Their supporters will also be asking why the world’s current best player Beauden Barrett was sitting on the bench.
Meanwhile, Australia endured a complete and utter capitulation as they were hammered by Argentina 67-27 in Santa Fe to suffer their greatest ever Test defeat.
The Wallabies actually led 20 points to 3 and went in at the half-time break leading 20-17.
However, what followed was embarrassing and humiliating as a complete physical and mental break down ensued.
The Wallabies were brushed aside by an Argentinian team who played rugby in
its purest form, with simple, accurate passing and fine support throughout the entire team.
There are rumours that New Zealand and South African rugby authorities want to reduce the Rugby Championship to a biennial affair and instead revert back to tours and tests. The Wallabies’ performance last Saturday will have no doubt have strengthened that argument. Another performance like that and decisions will be made that do not include Australia.

NEW ONE CHAMPIONSHIP two-sport champion Superlek Kiatmookao could be coming for Jonathan Haggerty’s bantamweight kickboxing belt next.
Thailand’s ‘Kicking Machine’ recorded a stunning 49-second win against the Briton in last Friday’s (Sept 6) ONE 168 main event, scoring a knockout with the first elbow he threw in front of a packed and frenzied Ball Arena in Denver, Colorado.
The crowd erupted after Superlek’s astonishing finish of Haggerty, who just about answered the referee’s 10 count but was out on his feet after being knocked flat onto his back by a thunderous elbow.
The win meant Superlek added the ONE bantamweight Muay Thai belt to a collection that also includes flyweight kickboxing gold, and now he is eyeing Haggerty’s other title.
“Jonathan Haggerty is the champion of kickboxing, and if there’s a chance now I’d like to fight for it,” Superlek said after the bout.
Haggerty himself had been eyeing a defence against any of the former ONE kickboxing champs Petchtanong, Ilias Ennahachi or Hiroki Akimoto, but may now have to prepare for Superlek once again.
It was a gruelling camp for ‘The General’, who spent a month training in Denver, while Superlek arrived in the United States only six days before the fight.
Questions had surrounded Superlek’s ability to deal with the punishing altitude in the ‘Mile High City’, but he insisted he would have been ready to go the distance if the fight had not ended so quickly.
“If the fight had dragged
on all five rounds, I was definitely ready. I came here to do that,” he said.
The win cemented Superlek’s status as the greatest pound-for-pound striker in ONE Championship, and perhaps even across any promotion on the planet. But he did not wish to take such plaudits.
“I don’t think I’m quite there yet,” he said. “I still have a way to go in terms of getting used to the ruleset of ONE, and fighting in an exciting style to really bring my style to the rest of the world.”

Ex-football stars set for a battle on Thai greens

GOLFERS LEE WESTWOOD and Sergio Garcia will lead a group of former top footballers to compete in the Reignwood Icons of Football in March next year.
The event, which will be held between Mar 1-2, 2025 at Robinswood Golf Club in Pathum Thani, is a collaboration between Reignwood Park and The Icons Series.
The Icons Series, which brings together the world’s top athletes to compete in a golf tournament, has been held in many countries around the world such as the United States, the United Arab Emirates and England. The March event in Thailand will be the first in Southeast Asia.
The competition will be played in a match-play format between Team England and
English golfer Westwood will take on the role of captain for Team England while Spanish star Garcia will skipper Team World.
The first set of players for Team England includes Westwood, Paul Ince, Alan Shearer, Robbie Fowler, Joe Hart, Theo Walcott and Paul Scholes.

It was very much a family affair at the Alan Cooke Ground (ACG) in Thalang recently as touch rugby made a very welcome return to action and families banded together over the fun, inclusive and competitive format of the game.
A four-team tournament took place on Aug 31 where former players got the opportunity to show off their once formidable shimmies and side-steps, while new, inexperienced participants whet their appetite for glory under the sun’s mid-morning glare.

Following a round-robin schedule of matches, where standards steadily rose with each passing game, both the ACG Aces and the Phuket Pirates finished level on five points, forcing a duel between the two for third place.
During the decider, no amount of swash or buckle from the Pirates could upset the deadlock or ACG defence, but with just a minute left on the clock, a well-worked team try finished off by ace-upthe-sleeve, Jim Layard gave ACG victory, forcing Pirates down the plank into fourth place.

regular time, leading to a suddendeath extra period of play. This format calls for the exclusion of two players from each team, which opens up the field of play. After two more minutes of play, an additional individual from each team is removed until a winning try is scored.
It was during this second phase of sudden-death that the Tigers took advantage of some confusion amongst the Bears, whipping the ball out to their left wing, where young Ollie Hudson preyed on the open space and sprinted in for the winning score, ensuring the Tigers would lift the inaugural Family Touch Rugby trophy.
While it was a great morning of touch rugby for everyone, it was also a privilege to welcome England U-20 international, Grace Layard
as part of the tournament.
Grace had represented England at the Women’s U-20 European Touch Rugby championship in Vichy, France, last month, where she helped her national side to secure the overall title.
“It was so much fun playing at the ACG. I made some great new friends in a sport I love, and had the chance to play with my little sister and Dad, with Mum cheering us on,” said Grace.
The England star admitted to being nervous about playing in the Phuket tournament, but very quickly found her feet.
“The warm and fun atmosphere made it so easy. The ACG surface is great for touch, and the clubhouse was such a good space for the after event function. The organisers did an amazing job all round. The family-oriented tournament was a very welcome and refreshing

The landmark occasion, which sees the hugely popular event celebrate its 30th anniversary, will take place on Sunday, Nov 17 with a total prize fund of US$20,000 (B671,000) up for grabs.
Held across the famous Laguna Phuket destination race course, athletes will have the choice of
entering four different categories: the Elite Individual Triathlon class sees a 50-kilometre bike ride, a 12km run and a 1.8km swim; the Sprint Triathlon consists of a 20km bike ride, a 6km run and a 0.5km swim; and the inaugural edition of the Duathlon is comprised of a 4km and a 12km run and a 50km bike ride.
There is also the team relay option which allows three athletes to compete in the separate components of the Elite Individual Triathlon class, all at the same distance. Applications for all four categories are now open.
A 6km family fun run has also been confirmed to take place on Saturday, Nov 16, while an Open Water Swim presented by TriHub to commemorate the 30th anniversary will take place the same day.
There will be a specific focus on robust sustainability measures, organisers confirmed, aligning with Laguna Phuket Triathlon’s mission.
“Environmental responsibility is part of Laguna Phuket’s long-term commitment,” a spokesperson said. “Laguna Phuket Triathlon will therefore adopt environmentally friendly practices. From reducing single-use plastics, promoting waste
