Akumal Breakers -Terms and Conditions of Sale / Closing Process
Terms and Conditions
• All furniture, appliances, tools and supplies are included in the sale.
• Buyer will be responsible for all standard closing costs (Notary, taxes, fees) as well as their own legal counsel. Contract support is available by several experienced and bi-lingual local attorneys.
• The villa is in excellent condition and an inspection can be completed but the villa is being sold as -is and without any warranties or contingencies.
• Buyer agrees to fully honor all future contracted rentals and will receive the rental income at closing. No construction or modifications to be made during the future rental period (usually 3-5 months out).
• Buyer agrees to join Vecinos de Akumal Sur, A.C. (South Akumal Homeowners Civil Association), sign the carta de adhesion (enrollment request) and adhere to the association’s by-laws.
• The rights to the Federal Beach Concession will be assigned to the buyer after the closing. Please note that the concession is currently in the modification process from “ornato” to “general”.
Offer / Closing Process
1. At offer time, the buyer must deposit US $50,000 into a mutually agreed upon escrow account.
2. The buyer will have a term of 10 (ten) working days after the offer to review the legal, tax, rental and physical situation of the property. After this review, the legal contract will be signed whereby the buyer will be required to deposit the balance of 20% of the contracted sales price into the escrow account. At this point, the Notary will be directed to initiate the title transfer process, collect additional time sensitive ”no debt” letters and set the closing date. The balance of the purchase price will be due 7 business days before closing and deposited into the escrow account.
3. Official closing will take place in Playa del Carmen with either Notary #12 or #6. Both are official Quintana Roo state approved Notaries that have been pre-screened and selected by sellers. The Notary represents both the buyer and seller and has already researched and reviewed all of the key documents in order to make a smooth closing.
4. The existing Fideicomiso (Trust) is held by BanBajío (Mexican Bank) and can be transferred to foreign buyers as individuals and to corporations. Corporations must consist of individuals and not additional corporations. Mexican Nationals can purchase the property directly without a Fideicomiso.
