Notifying the birth of a newborn These guidelines are indicative and generic in nature. It is advisable for parents to contact the Public Registry Office before the birth of the child to confirm the registration requirements. In the case of foreign parents, it is advised that they also contact the Expatriates Unit to confirm the requirements to apply for a residence document for their newborn.

You can notify the birth of your newborn: in person by visiting our branch at Mater Dei Hospital or the Public Registry Office in Marsa; or by logging on https://notifications.identita.gov.mt; or by post to Public Registry, Onda Building, Aldo Moro Road, Marsa, MRS 9065, Malta by email to publicregistry.identita@gov.mt Births that occur in Gozo should be notified at the Gozo Public Registry Office.

What do you need to register the birth of your newborn You will need to submit the following documentation: Declaration for Notification of Birth Form, which may be obtained from the Public Registry’s office in Mater Dei or in Marsa, or downloaded from www.identita.gov.mt; The parent/s’ identification documents: Maltese parents to provide a valid identification card; non-Maltese parents to provide a valid residence permit and passport; Parents enjoying refugee status or subsidiary protection must present their Interview Documents and Protection Certificate issued by the International Protection Agency together with any other identification documents in their possession; the original Notification of Birth of a Baby issued by the hospital where the birth occurred; Marriage Certificate (if applicable): an original Marriage Certificate issued by the competent authority if the parents are married, and the marriage is not registered with the Public Registry; Divorce or annulment documents (if applicable): If one of the parents has divorced or had a marriage annulled in an EU Member State, then the parent would need to present an original copy of the final Divorce Decree (Decree absolute) or Annulment Judgment as well as the D180 certificate - Certificate referred to in Article 39 of Council Regulation (EC) No. 2201/ 2003 of 27 November 2003(1) concerning judgments in matrimonial matters.

If the divorce or the marriage was annulled outside an EU Member State, then the parent would need to present an original copy of the Divorce Decree or Annulment Judgment. Parents who have obtained a divorce, annulment, or separation status within the past year or are in the legal process of doing so, should contact the Public Registry for further guidance; Affidavit for unmarried parents (if applicable): parents must take an affidavit to confirm that they are not married or have never been married, in a civil union or an equivalent union. The affidavit may be administered at the Public Registry in the presence of one of our warranted Commissioners for Oaths; Affidavit in the absence of a civil marriage (if applicable) The parents need to take an affidavit: - Where the parents would be married, however such marriage would not have civil effects in Malta; and - Where the parent would not have contracted a marriage, civil union or a union of equivalent status in Malta following their divorce or annulment (and not after a legal separation).

The affidavit may be administered at the Public Registry in the presence of one of our warranted Commissioners for Oaths; any other documentation that may be requested by the Public Registry Office.

Document Format and Translations: Notifiers should consult the most recent version of the ‘Policy for the Recognition of Foreign Public Documents’ available at www.identita.gov.mt Payment The payment to notify a birth is €2.60.

Obtaining your child’s Birth Certificate Once the Act of Birth is registered the parent/s will receive an SMS or email. Birth Certificates may be either ordered online from the Agency’s website www.certifikati.identita.gov.mt or in person from the Public Registry in Malta and Gozo.

Obtaining a residence document for your newborn Should neither of the parents be Maltese nationals, and the parents are residing in Malta, the parents must apply for their newborn’s residence document.

EU Nationals In case one of the parents is an EU citizen, an application must be submitted to the Expatriates Unit’s EU Section.

In order for the child to be issued with a residence document, the parents must be exercising their freedom of movement rights in Malta, and must meet the residency requirements.

Third-Country Nationals If both parents are third-country nationals, they must submit their application to the Non-EU Section of the Expatriates Unit at Identità within six months from the child’s date of birth.

In order for the application to be considered, the conditions set out in the ‘Policy on family members of third-country nationals who do not qualify for family reunification by means of the Family Reunification Regulations S.L. 217.06’ must be satisfied.
