HSAS Provincial Bargaining on the Horizon It’s hard to believe but our current contract expires in just eight (8) months. In preparation for bargaining, the HSAS Executive Council has appointed Chris Driol as the Chairperson of the Negotiating Committee.

Pursuant to the HSAS By-Laws, Chris has the responsibility of appointing members to the Committee. Anyone wishing to serve on this Committee should write Chris and include the following information: • • • •

Accounting of Money Collected from Special Dues Assessment (Strike Levy) September 8, 2002 to May 17, 2003 In a special called meeting on August 6, 2002 Executive Council approved the collection of a job action levy from HSAS members to provide funding for job action. The levy was to take effect September 8, 2002.

In conducting the strike of 2002, HSAS spent the following: $325,000 from the HSAS Defence Fund $700,000 in loans from the following: • $100,000 Saskatchewan Union of Nurses • $100,000 Saskatchewan Government Employees Union • $100,000 Ontario Public Service Employees Union • $100,000 Newfoundland Association of Public Employees • $100,000 Manitoba Government Employees Union • $100,000 Health Sciences Association of Alberta • $100,000 Health Sciences Association of British Columbia The special dues assessment was structured as follows: $25.00 per pay period.

For those working less than 50% full time, $12.50 per pay period.

Monthly Amounts received from Dues Assessment: September - $59,850 October $45,600 November - $95,000 December - $95,000 January $95,000 February $95,000 March $95,000 April $95,000 May $52,500 Total $727,950 $700,000 in loans was paid back with the balance, $27,950, placed in the HSAS defence fund.

June 24, 2003 Dear Tim, I want to thank and congratulate HSA Saskatchewan for the final re-payment of the loan that HSA (BC) provided during your strike last year.

The HSA Saskatchewan strike was an important milestone in your members’ on-going efforts to achieve the respect and awareness for the important work done by health science professionals. It’s unfortunate that we have to resort to such dramatic action, but, province after province our respective members are doing what they have to, to achieve the recognition that they deserve.

I would like to think we played some, albeit small part, in the HSA Saskatchewan’s recent accomplishments. Of course, the real credit goes to the members, so please pass on our thanks and congratulations.

Member Resolutions To ensure the whole HSAS membership is aware of what resolutions will be discussed and voted on at the Annual Convention, Executive Council requests members to mail, fax or e-mail the Saskatoon HSAS office with their resolution and rationale no later than August 31, 2003.

II. Executive Council Meeting The next Executive Council Meeting has been scheduled for Thursday, September 11, 2003.

III. Executive Council Elections At the beginning of September 2003, nomination forms will be mailed to members’ homes to fill the following seats on Executive Council. Each seat is for a two year term.

Follow-Up to Negotiations A.

Definition of Senior as per Article 21.01

Representatives from HSAS and SAHO have been meeting since January 2003 to define the criteria for determining if a position is senior.

Agreement on a draft definition was reached June 25/03. Before this definition can be implemented, both the HSAS Executive Council and the Health Regions must provide their approval.

Once approval has been received we will place the agreed to definition on the HSAS web site.

B.

Provincial Market Supplement

Negotiations over a Market Supplement for Public Health Inspectors, Psychologist PhDs and Infection Control Practitioners have resulted in the following: Public Health Inspectors – the parties mutually agreed that effective December 19, 2002, the Public Health Inspectors hourly rate would increase 9.57% with Step 6 moving from 26.695 to 29.15/hr.

Additionally, the differentials currently in place between Public Health Inspectors, Seniors and Supervisors will be maintained.

Infection Control Practitioners – The parties could not agree on a Market Adjustment. As a result the matter was referred to Adjudicator Bilson on June 19, 2003. Her decision was to accept the employer’s position which is to track the top rate of the SUN Nurse B Scale effective December 19, 2002. This provides the following: December 19, 2002 – a 6.46% increase providing a Step 6 increase from 27.683/hr to 29.47/hr.

April 1, 2003 – a 3.02% increase providing a Step 6 increase from 29.47/hr to 30.36/hr.

Psychologist PhDs – The parties could not agree on a Market Adjustment. As a result, the matter was referred to Adjudicator Bilson on June 19, 2003.

On June 24, 2003 Ms. Bilson wrote the parties requesting additional information. HSAS is committed to provide more information.

Check the HSAS web site after July 15, 2003 for Ms. Bilson’s decision.

Out-of-Schedule Rates Including: Old Letters of Understanding #13 [Former CUPE 59 Contract] and #14 {Former CUPE 600, SGEU/PSC and SGEU/SAHO Wascana Contracts]

Negotiations to place former CUPE 59 members on the main HSAS wage scales is complete. However, approximately 75 HSAS members have their wages governed by a unique scale or Letter of Understanding #14. Negotiations to place this group onto the major HSAS wage scales has been painfully slow. One of the major reasons for this is that the parties (HSAS and SAHO) have been waiting for the definition of senior to be completed. With this now in sight, it is hoped negotiations to deal with the unique and Letter of Understanding #14 wage scales will progress at a faster pace.

In the event the parties cannot agree on a wage rate for a particular position it will be referred to arbitration for a final and binding decision.

Continuing Education Fund The Continuing Education Fund was established at the October 1990 Annual General Meeting with the purpose of promoting continuing education in areas directly related to one’s present position.

A lottery system is used to select applicants with five (5) names drawn on October 1st and five names on May 15th of each year. Successful applicants are eligible for a maximum of $500.00.

It is the position of HSAS that the responsibility for assuming costs associated with continuing job related education resides with the employer. To ensure our fund is not treated as a primary source, the Education Fund Committee requires members to apply to their employer or other sources prior to making application to the HSAS Education Fund. Failure to do so will result in the disqualification of the applicant.

For the May 15th draw we had twenty-seven (27) applicants. Those chosen were: Name

25th Silver Anniversary Scholarship Award The 1997 Annual Convention established two (2) $500.00 scholarships to mark the 25th Anniversary of our union. The scholarships are awarded annually to a spouse or dependent of an HSAS member enrolled in full-time studies at a post-secondary educational institution leading to a degree or diploma in an area of study currently represented by HSAS. Completed application forms must be received at the Saskatoon or Regina office no later than July 31st for the upcoming school year.

Application forms can be obtained by calling either the Saskatoon or Regina HSAS office.

Grievance Corner This spot in our newsletter is used to make members aware of what articles in our Collective Agreement are subject to current grievances or arbitrations.

Article 19.03 Reimbursement For Meal Expenses This Article requires the employer to reimburse an employee for receipted meal expenses when the employee is required to travel outside the community where her headquarters is based to perform work duties.

employers are requiring members to bring a pager or radio with them during their break and respond if called.

If is the union’s position that in these cases the meal break should be considered paid time as it is not a clear uninterrupted unpaid break from work.

HSAS has been informed that some Health Regions have issued guidelines on both maximum amounts allowed for each meal and time frames within which meals must be consumed. We believe such negates the breadth of our wording.

Please call your LRO if you are required to respond to a call during your unpaid meal break.

HSAS requests members to contact their LRO if they are denied reimbursement for a meal because the cost has exceeded a dollar amount guideline or was consumed outside a particular timeframe.

It is the union’s position that any reasonable expenditure for meals for which the member submits receipts should be reimbursed by the employer.

Article 15.02 Rest and Meal Periods According to this Article members who work a shift of at least five (5) hours are entitled to one unpaid meal period of one-half (½) hour.

It has come to the union’s attention that some

Article 8.02 Progressive Discipline Progressive discipline is a well-established principle in labour relations, and SAHO and HSAS have signified their adherence to this principle in the collective agreement.

Some important aspects of progressive discipline include: 1. Movement away from punishment to correcting an unsatisfactory behaviour; and 2. Inducement and incentive to reform an employee’s conduct by progressively increasing the severity of discipline for persistent misconduct.

A grievance has been recently filed against an employer who suspended an HSAS member for

three (3) shifts for unsatisfactory work performance when this was the first time concerns had been brought to her attention.

While there are certainly cases of misconduct that can lead to serious measures, even where there is no history of similar actions, in this case the union contends that the employer has grossly overreacted in applying such severe discipline at the first instance.

Article 21.04 Selection Criteria This article requires the employer to consider the following when filling an HSAS vacancy:

1. Qualifications, suitability and experience necessary to perform the work and 2.

In the event these criteria are relatively equal, seniority shall be the deciding factor.

A grievance was recently filed against an employer when they didn’t hire a member who in the union’s view was at least relatively equal to the successful candidate on qualifications, suitability and experience and had more HSAS seniority.

Note: Relatively equal does not mean identical but overall equal.

Pension Shortfalls Recent media reports have raised the alarm on shortfalls in various defined benefit pension plans throughout Canada.

Fortunately, at this time the SAHO defined benefit pension plan (now called The Saskatchewan Healthcare Employees Pension Plan – SHEPP) does not have to file a valuation for another year. Additionally it appears that the SHEPP Plan has not been as negatively impacted as other plans by the down turn in the financial markets.

Unfortunately, the same cannot be said about the Regina Civic Defined Pension Plan. HSAS has approximately seventy-five (75) members in the plan. The plan is required to file its valuation in September 2003 and preliminary results have indicated a funding shortfall.

The members in the Civic Plan have two (2) options to deal with the shortfall: Option 1. Accept contribution increases to deal with the shortfall and maintain current pension benefits, or

a lower contribution increase.

All of the unions with members in the Civic Plan, (HSAS, SUN, CUPE, ATU and Firefighters) have met with their members and the consensus is to accept option 1. However, before contribution increases take effect, the unions have requested efforts be undertaken to: 1. review the actuarial assumptions and 2. to lobby the provincial government to reduce the contribution increase by having them lengthen the period over which the shortfall must be addressed and 3. have a valuation completed each year on a going forward basis so that if financial markets improve the valuation can be filed and contributions can be reduced the following year.

If all three (3) of these initiatives fail, employee contribution levels will increase as follows: On the first 39,900 of earnings – increase from 6.3% to 7.9% On earning above 39.900 – increase from 7.9% to 15.88%

Option 2. Accept a pension benefit reduction and The Agenda for Executive Council meetings is posted on the HSAS website ten (10) days prior to meetings. This provides an opportunity for members to contact their Executive Council representative for input.

Representation on Executive Council A. Rural and Urban At the 2002 Annual Convention Executive Council was directed to investigate rural versus urban representation where there may be more than one seat representing the professional or composite group.

As a result of the directive, Executive Council examined the rural vs urban representation for the period November 1997 to April 2003. Here are the results.

For the purposes of this study, urban comprises members from Saskatoon and Regina or 66 ⅔% of the membership.

B. Professions Who are Small in Number There are several professions in HSAS that are small in number. For example, the following professions have less than fifteen members each: Audiologists Orthotists Prosthetists Dental Therapists Music Therapists Orthoptists Several small in number professions have been grouped together with larger groups to form a seat on Executive Council. Council has decided to conduct a survey among these groups to determine if they are satisfied with their current representation or would prefer to be represented by a seat made up of professions with similar numbers. While nothing would be carved in stone, if would be our intent to see if there is sufficient interest to pursue this matter further, or to leave things as they are.

Board of Governors

The Executive Officers are elected from and by Executive Council for a one (1) year term except the President, who is elected for a two (2) year term by the general membership.

The Board of Governors provide guidance and counsel to Executive Council on all matters regarding administration of the Union. Any member having served at least four (4) years on Executive Council, at least two (2) of which as an officer, shall be eligible for election to the Board of Governors for a seven year term.
