Trump legal team urging State Legislatures to follow the US Constitution In the case of a disputed election, Article II, Section I, Clause II of the U.S. Constitution gives the State Legislators the task of appointing electors to then vote in the Electoral College on Dec. 14 for the most recent Presidential election. The State Legislatures do not need any action from Governors, Secretaries of State, Congress, or any other governmental body. The power solely rests with the State Legislatures and since state laws do not supersede the Constitution, they can send electors based on any manner they deem just.
