Federal Judge Rules Black Employees’ Racial Discrimina on Lawsuit Against Houston Community College Can Proceed Houston, Tx. Houston Community College (!HCC”), a massive governmental en ty with hundreds of millions of taxpayer and tui on dollars will have to face the music rela ng to racial discrimina on claims brought by nearly 100 black employees. Tuesday, US District Judge Lynn Hughes ruled that three separate race discrimina on cases led by black employees against HCC may proceed and denied HCC’s mo on to dismiss the claims. In one of his orders, the judge writes, “This court has already determined that the black employees have established the elements of municipal liability to hold the college liable.” The judge’s orders permanently dismissed several of the plain s’ claims and allowed other plain s a further opportunity to replead to remain in the suit. Thus, HCC is facing racial discrimina on claims by over 95 former and present black employees. Lead trial counsel for the plain s, Benjamin L. Hall, III, commented: “I am pleased with the Judge’s rulings. HCC wanted all of our clients’ claims dismissed. Judge Hughes discarded that request…For the judge to make such ndings against HCC about racial discrimina on cannot be comfor ng to to the college or its a orneys. Our brave clients have endured enough discrimina on and retalia on at HCC and will now have their day in court to show the racist horror show that exists at that college.” George Hi ner, another lead trial counsel represen ng the plain s, remarked: "!I have worked in mul ple levels of government, been a service provider to governmental en es, and represented governmental bodies. My clients have sued and been sued by governmental en es. I have been surrounded by, exposed to and worked with government o cials and governmental agencies in one capacity or another my en re life…and I can unequivocally state that I have never seen such an abuse of power by a governmental body as is evident in these lawsuits. The evidence points to a systemic bias and prejudice against black employees at HCC. The sheer number of the vic ms speaks volumes about the prevalence of HCC’s legally problema c culture.” The plain s allege that HCC and its leadership devised a"!transforma on program” that was a not-soveiled reason to purge black employees from their jobs. The suit claims that over 95% of senior level black execu ves at the college have been “transformed” or displaced from their jobs since the present chancellor was placed in charge of the college.
