Inspectors, Appraisers, and Brokers—Oh My! Home inspections are conducted by a home inspector, who is someone slightly different than a real estate appraiser. Basically, the home inspector is in a position to determine a given property’s overall condition, while an appraiser is more concerned with a property’s value. A property in excellent condition could have low value purely based on the neighborhood it’s in. Likewise, a home of poor condition could have high value for the same reason. In Fort Collins, Colorado, there are a large number of older homes located near the “old town” district that are literally falling apart. These homes are sublet on a regular basis by the owners and have collegiate hopefuls dwelling under their sagging roofs. Even though internal conditions of the houses are abominable, they often go for $300k+ because of their location in Fort Collins as “central” properties. Though a home inspector may determine a property of this kind has low quality, an appraiser may say it has high value. Another thing to keep in mind is that a home inspector doesn’t traditionally— though in some cases there is crossover— provide building inspection for the assurance of local code compliance. In Wyoming you’re more likely to find some crossover than in larger municipalities. Now you may or may not need code-compliance inspection; this can play into title and associated home warranties, but it may

not. You will very likely need appraisal, and you’ll likely need a home inspection as well. If you can find a certified home inspector, that’s even better—there will be less “fudging” that way. A lender is going to have a better time securing loans, or facilitating the brokering of mortgages, with a home that has passed a certified inspection and been properly appraised. While there are agencies whose specific duty it is to accomplish home inspection and/or appraisal/code inspection, they can be difficult to find without going through some third-party selling agency.

Mortgage brokers can be instrumental in helping you secure such individuals. Additionally, it makes more sense to go through a mortgage broker than a third party selling agency to source a home inspector, as you’ll get a more accurate inspection. The agency will refer you to deliberately lax home inspectors which allow them to drive up the price so they can reap a higher percentage of the sale—it’s a problem internationally. Meanwhile, the mortgage broker is motivated by associated lenders to secure more trustworthy home inspections and appraisals.

Title Agencies: Who They Are, What They Do

Your motorcycle has a title; so does your car, truck, SUV, RV, or boat. Why shouldn’t your house have the same information? A title agency is often simply called an insurance agency, because it’s their job to ensure a property title is legitimate so title insurance can be. The insurance is a protective measure between a lender and/or an owner. Claims against the property could lead to title disputes; so could lawsuits. It must be established in the record to whom the property belongs, and to whom that ownership transfers to once a sale is complete. Additionally, the dependability of the property must be established against possible warranty claims. When there are large sums of money involved in a sale, it’s more likely those involved will encounter persons looking to undercut buyers and sellers for their own ends; which is another reason such insurance is absolutely fundamental in matters of property sale or acquisition. All that being said, you can avoid a title agency; it’s just not wise. Consider this scenario: you rent an apartment, and pay a deposit after signing an agreement noting your deposit. Something happens which forces you to leave early—it’s not your fault, it’s the apartment manager’s fault. You go to demand your deposit back, they know you’ve got them dead to rights, so they act like you never paid a deposit or signed a form. If you don’t have a copy of the form you signed, then you’re out whatever the cost of deposit was, pure and simple. A title agency is kind of like you obtaining a copy of the form you signed. It’s a means of establishing beyond a shadow of a doubt who owns what, and when. You never know what kind of shady characters may try to hoodwink you; having a legal firearm like a proper title is just common sense. Additionally, there are some features of the buying/selling process which fundamentally require such legal precautions. Mortgage lenders will not lend without title insurance. Now the bad news is you’re going to have to foot the bill for a title insurance policy. The good news is, such agencies work for you, and so are looking after your interests as a home seller. Plus, you will end up buying title insurance whether or not you use a real estate agency. With title insurance, you’re protected from financial damage when selling property should your title be rejected by a possible buyer. You’re also protected from suit should warranty breach be posited by a potential buyer. Ultimately, the legal protections of title insurance keep everybody acting “Above Board”. The purchaser is protected against title defects, the lender is protected against spurious titles, and the seller is protected against possibly spurious warranty suits.
