Councillor disqualiďŹed for missing meetings A HORNSEA Town Councillor has been disqualiďŹed from the council after an oversight invoked the breaking of section 85 of the Local Government Act. Councillor Kevin Nicholson received e-mail notiďŹcation on Tuesday, September 8 that he had been disqualiďŹed as a councillor due to breaking legislation for non-attendance at meetings. The rule states: âIf a member of a local authority fails throughout a period of six consecutive months from the date of his last attendance to attend any meeting of the authority, he shall, unless the failure was due to some reason approved by the authority before the expiry of that period, cease to be a member of the authority.â Mr Nicholson commented: âI am very disappointed especially as no warning was given. Itâs been a really unusual time we have all found ourselves in and as a key worker my job changed considerably. I had absolutely no idea this much time had passed with the lockdown period too.â His fellow councillors were also surprised with Councillor Paul Malley commenting: âIt is sad to see Mr Nicholson go in such circumstances and I for one would like to thank him for his services after being elected in 2018 and 2019.â Councils always have the ability to grant members a dispensation from the rule if they request one. This is to cover instances such as illnesses and temporary increased workloads or other commitments. In advice sent from East Riding Council to town and parish council clerks they were advised that should their councils be unable to meet and fulďŹl the six month obligation that they could pass a blanket dispensation for their council members.
