GO-WV and WVU host HandSafe seminars

The GO-WV Safety Subcommittee, in cooperation with the WVU Safety and Health Extension program, is offering a train-the-trainer hand safety seminar on two dates in May. This program, “HandSafe for the Oil and Gas Employee,” is centered on struck-by and caught-between hazards, job safety analysis, hand and finger injuries and hazard assessments created for the high-hazard oil and gas industry.

Each training date features a four-hour course divided into eight training modules. The modules cover: hand and finger facts; all about OSHA; safety culture; hand and finger hazards; personal protective equipment; machine guarding, tools and lockout tagout; job safety analysis; and hand safety and injury prevention for the oilfield industry.

The first seminar is scheduled for Thursday, May 20, from 10:00 a.m. to 3:00 p.m. at the

Bridgeport Country Club.

The second seminar is scheduled for Thursday, May 27, from 10:00 a.m. to 3:00 p.m. at Berry Hills Country Club in Charleston.

Since this is a train-the-trainer event, registration is limited to 25 people at each session.

Bob Radabaugh Lunch is included in the $75 Safety Committee per person registration fee. All Chair CDC guidelines and state orders will be followed including wearing face masks and social distancing.

GO-WV hosts “Spring Swing” golf outing June 7 Register now to join the fun at the 2021 GOWV Spring Swing Golf Outing on Monday, June 7, at Berry Hills Country Club in Charleston.

EPA methane rule update In October 2019, we reported that the U.S. Environmental Protection Agency (“EPA”) proposed rulemaking revisions to the regulation of methane and volatile organic compounds (“VOCs”). That rulemaking proposed reconsideration amendments to the new source performance standards (NSPS).

The amendments proposed to remove sources in the transmission and storage segment from the source category, rescind the NSPS (including both the volatile organic compounds (VOC) and methane requirements) applicable to those sources, and rescind the methane-specific requirements (the “methane requirements”) of the NSPS applicable to sources in the production and processing segments.

On September 14, 2020, the EPA’s final policy amendments to the 2012 and 2016 NSPS for the oil and gas industry titled “Oil and Natural Gas Sector: Emissions Standards for New, Reconstructed, and Modified Sources Review” was published in the Federal Register and became effective the same day (the “Policy Rule”). A critically important aspect of the Policy Rule is that it, effectively, removed EPA’s ability to regulate existing oil and natural gas sources under Section 111(d) of the Clean Air Act (CAA). The Policy Rule also removes sources in the transmission and storage segment from the source category, rescinds the NSPS (including both the VOC and methane requirements) applicable to those sources, and separately rescinds the methane-specific requirements of the NSPS applicable to sources in the production and processing segments. In addition, the EPA adopted an interpretation of CAA section 111 under which the EPA, as a predicate to promulgating NSPS for certain air pollutants, must determine that the pertinent pollutant causes or contributes significantly to dangerous air pollution. The Policy Rule is clearly beneficial to oil and gas operators and reflected the efforts of the Trump administration to encourage oil and gas development and energy independence.

As noted in a September IOGA News article the

Policy Rule could be subject to reversal pursuant to the 1996 Congressional Review Act (CRA), if certain events occurred. Because now President Biden won the election and the U.S. Senate is controlled, by the slimmest of margins, by Democrats and the U.S. House of Representatives remains controlled by Democrats, the CRA has become a viable option for reversing rules that were published in the Federal Register within a certain time before Congressional action.

By introduction of Senate Joint Resolution 14 (SJR 14) on March 25, 2021, the Senate is proposing to utilize the CRA to effectively void the Policy Rule that became effective on September 14, 2021. Majority Leader Schumer has indicated in a letter that he intends to make this issue a priority following the Easter break. In order to void the Policy Rule pursuant to the CRA, both the Senate and House of Representatives will need to pass identical resolutions and be signed by President Biden. While passage of joint resolutions in the Senate would generally be subject to filibuster thus requiring 60 votes to be considered for adoption, the CRA contains a special provision allowing a joint resolution to be passed by a simple majority of 51 votes in favor. It is only because of this special provision in the CRA that SJR 14 has a possibility of adoption.

Because the Policy Rule removes EPA’s ability to regulate existing oil and gas operations and removes the transmission and storage segments from regulation under the previously effective NSPS requirements, one or more Democratic Senators, such as Senator Manchin from West Virginia, may not support SJR 14. In the absence of all 50 Democratic Senators plus a tie breaking vote

by V.P. Harris, SJR 14 could fail and the Policy Rule would remain in effect.

Because SJR 14 is not subject to being filibustered, it can move toward a final vote fairly quickly if it is ultimately supported by 51 votes. In the event SJR is adopted by the Senate it will then be Methane rule update Continued on page 12

From the Burd’s Nest: A session to remember As we stated from the beginning, the 2021 West Virginia Legislative Session would be like no other ever witnessed. The House and Senate leadership’s COVID-19 precautions for requiring masking up, social distancing and limited access into the Capitol has thus far paid great dividends.

In fact, except for one minor incident, the Legislature has been able commence and remain in session to conduct the important business of the State.

Yes, there have been grumblings on the number of bills have been dealt with in a quicker than normal or expedited manor, and rumblings about the limited ability to lobby viewpoints. However, it’s been my observation that both Speaker Roger Hanshaw and President Craig Blair worked diligently to preserve the process through providing virtual access where possible and accommodating testimony remotely.

As we enter the final stretch of the 2021 Session--that ends at midnight, Saturday, April 10-there have been well over 2,000 pieces of legislation introduced (720 Senate bills and 1,300+ House bills). And, at this point, we can boil this ton of legislation down to a couple dozen bills that will draw our full attention going forward. Those at the top of our list include: • House Bill 2581 that would redefine how oil and natural gas producing properties would be taxed for ad velorum purposes and provide an alternate method of appeal of the proposed valuations. This bill has passed through its committee reference and is currently proceeding through passage in the House. Once passed there, it will be communicated to the Senate for further possible consideration.

• House Bill 2598 that would remove storage tanks of 210 barrels or less containing brine water or other fluids produced in connection with hydrocarbon production activities located in the Zone of Critical Concern from the onerous regu-

lations placed on them as part of the 2014 Aboveground Storage Tank Act. This bill has passed the House of Delegates and currently awaits further possible consideration in the Senate Judiciary Committee.

• House Bill 2842 that would prohibit communities and municipalities from banning the use of natural gas and other manufactured gases like propane. This bill has passed the House of Delegates and currently rests in Senate Energy, Industry and Mining Committee for further possible consideration.

• House Bill 3089 that would establish utility workers as essential employees during a state of emergency and to ensure that utility services can continue to operate or be restored. Oil and gas production is defined under the definition of utility in West Virginia statute. This bill has passed its committee references and is working through passage in the House. Once passed in the House, it will be communicated to the Senate for further possible consideration.

In the category of legislation either supported, or not objected to, by GO-WV that has already passed we have: • Senate Bill 175 is the State Tax Department rule relating to the Downstream Natural Gas Manufacturing Investment Tax Act Of 2020 that established a system of investment credits based on qualified investment property and new jobs created.

• Senate Bill 404 that provides for and establishes the ability to modify a horizontal well permit for a fee of $2,500.

• House Bill 2382 is the Department of Environmental Protection rule relating to requirements governing water quality standards and supported by GO-WV. Burd’s Nest

Fool us again...what the Texas freeze means for you My wife, Lynnda and I don’t have our $1,400 stimulus checks yet but we already spent the money stimulating the economy. We were getting supplies to treat the water in our 10+ year old hot tub. It is what they call a soft tub. Fine for two people and crowded for four. The lining is worn and it has a slow leak. We were examining new hot tubs while waiting for the counter person. We saw what we wanted.

For over 10 years we have been buying our hot tub supplies from this store. The salesman wandered over. He said, “If you are considering buying that tub, today is the day. We held our prices last year but we can’t eat another cost increase.

The price of this tub is going up over $500 on Monday.” We all have heard the price is going up, buy today. It is one of the oldest sales tactics to entice us to buy now. I can still remember the line from a TV commercial the price is going to go up and the kids are going to grow up. That one gives us two reasons to buy.

This time I knew the salesman was telling the truth. In the last three weeks I have attended three conferences where one of the major discussions was resin shortages and increasing costs to processors because of the February ice storm and subfreezing temperatures in Texas. Processors are the people who make the products we use like milk jugs, packaging, shoes and hot tubs. They need resin to make those products.

To explain why we will be seeing increased prices, here is a brief explanation of how we get the many thousands of products we use every day.

This isn’t an ad for plastics. Most product packaging and fresh fruit and vegetable packaging is made from plastics of some type. The purpose is to protect the product and keep it fresh. When I was a kid, things like ketchup, pickles, mustard and even milk were packaged in glass containers. They were heavy to ship, to carry and could break. Hearing the sound of breaking glass in the grocery store was common. Someone had to clean up the mess.

Food was brought home in paper bags. Now imagine if someone put that paper bag on a damp sink or countertop. When someone else, like me, picked up the bag, the bottom fell out. Now imagine three or four glass jars or a gallon of milk hitting the floor and breaking. The aftermath wasn’t pretty. We put our parents through a lot. When my kids dropped a plastic jar of mayonnaise, all we had to do was pick it up and put it back in the fridge.

The raw materials to make food packaging and thousands of products like computers, TVs, cars (especially electric cars), healthcare PPE and my hot tub all come from petrochemicals. In the U.S., this starts with natural gas liquids (NGLs). These NGLs are produced from wells with the natural gas. The NGLs are then sent to a fractionator to break them into separate products like methane, ethane, propane and butane. These base carbon compounds are then turned into various intermediate or finished products. For example, the ethane can be sent to a cracker like Shell is building in Pittsburgh and turned into polyethylene. Crackers like Shell and PTT, if built in the Shale Crescent USA, would have remained in operation during the Texas cold just like they would have during Texas hurricanes. This will provide a dependable resin source for processors in our region.

Today our ethane is sent out of the region since we don’t have any ethane crackers. Most goes to the Gulf Coast for their crackers. Some is sent to Europe by a specially built ship. Ethane can also be burned as part of the natural gas stream. It is much more valuable as a feedstock. Burning ethane is like lighting your fireplace with a $100 bill.

Ethane crackers on the Gulf Coast turn the ethane into polyethylene pellets (resin). Most of these pellets are then shipped back to our region where, according to IHSMarkit, 70% of the demand for polyethylene is. Processors in our region turn the polyethylene into thousands of products.

Spring Swing

La Niña certainly exerted its influence this past winter, with a volatile pattern from winter’s start to finish.

December started with a major cold outbreak with an early snowstorm along the East Coast.

By the end of the month, temperatures rebounded and warm weather ruled most of the eastern U.S. through January.

A brutal February produced record cold temperatures in the Plains and Texas, with persistent snowfall from the Great Lakes and East Coast.

March saw the warmth return.

With the sharp contrast between the warm South and the cold North, an extreme severe weather and tornado season is still our expectation.

sent to the House of Representatives for consideration. The House likewise could consider and adopt SJR 14 in relatively short order following which the Joint Resolution would be sent to President Biden who will likely sign it. At that point the Policy Rule will “have no force or effect.” As explained by the Congressional Research Service, the rule would be deemed not to have had any effect at any time. Even provisions that had become effective would be retroactively negated.

A significant concern with negating rulemaking activities using the CRA is that the agency is barred from issuing another rule in “substantially the same form” as the disapproved rule unless Congress authorizes the agency to do so in a subsequent law. It is not clear that the Biden Administration has any interest in promulgating one or more provisions of the Policy Rule so that limitation may be of little importance in the near term.

It is important to note that SJR 14 only relates to the Policy Rule. Indeed, a resolution may only address one rule in order to retain the special “fast track” provisions of the CRA. Thus, the “Oil and Natural Gas Sector: Emission Standards for New, Reconstructed, and Modified Sources Reconsideration” rule that became effective on November 16, 2020 (Technical Rule) is not negated and remains in effect. The Technical Rule is arguably more helpful to smaller oil and gas operators because if provides some regulatory relief by exempting “low-production” wells from expending significant funds to monitor leaks.

Voiding the Policy Rule would certainly have a negative impact on oil and gas operators in West Virginia and throughout the country. However, the Technical Rule provides some important regulatory relief and it has not been the subject of a joint resolution as of March 26, 2021. But the possibility exists that the Technical Rule could be the subject of negation through the CRA as well in the future.

In February, during the ice storm and extreme cold weather in Texas, ethane crackers and other petrochemical plants on the Gulf Coast lost electric power and natural gas. With no way to prevent freezing, pipes and valves cracked, shutting down plants. Over 80% of U.S. polyethylene production was shutdown. Polypropylene used to make many products for the automobile industry and healthcare products like N-95 masks suffered a similar fate. This is worse than any hurricane.

Until these recent conferences I didn’t understand how serious the damage was. We were told 50% of the production is now back on line. With so many plants damaged at the same time, there is a shortage of physical resources like valves and specialty piping. Experienced human resources who can repair the damaged units are also needed.

The repair process could take months.

This means processors who make the stuff we need and want can’t get resin to meet demand.

Reduced supply has dramatically increased prices processors must pay for resin. In 2020 demand, for services like travel dramatically decreased.

Demand for products globally increased. We can’t expect relief from overseas suppliers. People created home offices and did home improvements.

Students needed pads and computers. My hot tub salesman had a banner year in 2020 selling pools and hot tubs to people stuck at home.

Our region has some unique advantages. The utilities here are set up to deal with cold weather.

Below zero temperatures are not uncommon. Our gas and oil industry is also set up to deal with extreme cold. There will be occasional freezes but we won’t be shut down. Many of you have been on drilling rigs and on frac jobs in subzero temperatures. I can still recall the smell of burning diesel rags thawing out tank valves. It is shocking how fast water freezes in a steel line when pumping is stopped.

America needs a second petrochemical hub.

This freeze is just another incident regional manufacturers supplied resin by the Gulf Coast have had to endure. How many hurricanes have and Gulf Coast floods have to happen to drive the point home we can’t have all of our resin eggs in the Gulf Coast basket? Shell’s cracker coming on line in 2022 will help. We need PTT or someone to build a second and a third cracker. This projects will need NGLs and natural gas from you!

We can expect to pay more for everything like plastic pipe, food and everyday products like my hot tub made from petrochemicals like polyethylene and polypropylene. Some products may be in short supply. Our industry is an essential part to changing this.

When the salesman said our hot tub was in stock, Lynnda told me, “You know what I want.”
