TheConstitutionoftheStudentGovernmentAssociationSenate

PREAMBLE

We, the full-time undergraduate students of Hofstra University, do hereby form a responsible, democratic, and independently selected government dedicated to the principles upon which Hofstra University stands. The Student Government Association shall advocate for all Hofstra undergraduate students through the implementation of policies and procedures, which serve to support and broaden the intellectual, social, cultural, and political needs of all of its constituents.

ARTICLEI.

SectionOne TheStudentGovernmentAssociationshallberesponsibletostudentsofHofstraUniversity throughtheDivisionofStudentAffairs TheStudentGovernmentAssociationshallberesponsiblefor submittingabudgetfortheensuingacademicyear

SectionTwo TheStudentGovernmentAssociationshallhavethepowertosetfees,regulations,or restrictionsuponanyundergraduatecluboperatingunderthepoliciesoftheaforementioned,andshall furtherhavethepowertorecognizeanygroupofundergraduatestudentswhopetitiontobecomean organizationincollaborationwiththeRegistrationCommitteesolongastheyarenon-exclusiveinnature Aclubororganizationwillbedefinedasnon-exclusiveinitsmembershipandactionsifitextendsequal opportunitytoallqualifiedindividualswithoutregardtoProtectedCharacteristics Qualifiedindividuals 1 beingdefinedasthosewhomeettheexpectationsandstandardsoftheorganizations’inherentpurpose SectionThree.TheStudentGovernmentAssociationshallprovideforthecommonwelfareandgeneral well-beingoftheUniversitycommunitythroughsuchpoliciesandlegislationdeemedappropriate SectionFour.NomemberoftheStudentGovernmentAssociationJudicialPanelshallserveina legislativeorexecutivecapacityontheStudentGovernmentAssociation.

ARTICLEII.

Alllegislativepowersgrantedhereinshallbevestedinastudentsenate,whichshallbereferredtoasthe Senate

SectionOne.AllconstituentsandmembersoftheStudentGovernmentAssociation,electedorappointed, shallbefull-timeundergraduatestudents.

A. TheSenateshallconsistofmemberselectedbytheconstituentsoftheStudentGovernment Association.

B. FallelectionsshalloccurnolaterthanthefirstweekofOctoberineachacademicyear.

C. SpringelectionsshalloccurnolaterthanthefourthweekofAprilineachacademicyear.

SectionTwo TheElectionsCommissionshallbethesolejudgeofthequalificationsofitsmembers, campaignfinances,andelectionprocedures,aidedbytheStudentGovernmentAssociation’sAdvisor All membersandpoliciesofsaidcommissionaresubjecttotheapprovaloftheSenate

SectionThree.TheSenateshallassembleatleastonceeveryweekwhileclassesareinfullsession, exceptbytheexpressvoteoftheSenatetothecontrary ThetermsofofficeforallSenatorsandofficers shallcommencewiththefirstSenatemeetingfollowingtheirelectionintotheStudentGovernment Association,andshallterminatewiththeSenateturnovermeetingofthespringsemester

SectionFour.TheVicePresidentoftheStudentGovernmentAssociationshallbethepresidingofficerof theSenate,buttheSenateshallelectitsSecretary,Comptroller,andallCommitteeChairs.

SectionFive TheSenateshallhavethepowertoapproveminutes,monetaryappropriations,resolutions, amendments,andothersuchdocumentsrequiringitsconsideration ThePresidentmay,inwrittenform, vetoSenatorialActionbeforetheadjournmentofthatSenatemeetingexceptwhenconsidering amendmentstotheConstitution.IftheSenateoverturnssaidobjectionsofthePresidentbyatwo-thirds (2/3)vote,thematterinquestionshallstandapprovedwithoutregardtotheobjectionsofthePresident.

A. Thepassageofanyminutes,monetaryappropriations,senatorialactions,resolutionsandother suchdocumentsshallrequiretheaffirmativevoteofatleastamajorityofmemberspresentand votingunlessotherwisespecifiedherein.

SectionSix Executivevetopowershallneverextendtomattersapprovedontheballotbythestudents

SectionSeven.ApersonwhohasnotbeenelectedtotheSenatebythestudents,orbytheSenate,shall notvoteinanySenatemeeting Associatesmaybeauthorizedvotingrightsinstandinglogistics committees

SectionEight.TheSenateshallhavethepowertoimpeachandremoveitsofficersanditselectedofficials inconjunctionwiththeJudicialPanelbysuchmethodsoutlinedintheStudentGovernmentAssociation’s guidingdocuments.2

SectionNine TheSenateshallnotexceedmembershipequivalenttooneat-largesenatorforevery200 full-timeundergraduatestudentsprovidedbytheUniversity’senrollment

ARTICLEIII.

TheexecutivepowersoftheStudentGovernmentAssociationshallbevestedinanExecutiveBoard

(E-BOARD)consistingofPresident,VicePresident,Comptroller,andSecretary

SectionOne.ThePresident,VicePresident,Comptroller,Secretary,andallthechairsoftheLogisticand AdvocacycommitteesshallconstitutetheExecutiveCabinetoftheStudentGovernmentAssociation.The PresidentshallpresideovertheExecutiveCabinet.

SectionTwo TheExecutiveCabinetshallassemblenolessthanonceeveryweekwhileclassesareinfull session TheExecutiveCabinetshallsettheagendafortheSenatemeetings TheExecutiveCabinetshall coordinatetheworkofalllegislativecommittees,refertothemsuchmattersasmaybeintroducedtothe Cabinet,andshallhavethepowertomakeinterimdecisionsonmattersofexpediency.Alldecisionsmade aresubjecttotheapprovaloftheSenate.

SectionThree ThePresidentandVicePresidentoftheStudentGovernmentAssociationshallrepresent theStudentGovernmentAssociationontheUniversitySenateandtheUniversityBoardofTrustees An electedmemberoftheSenatemay,byappointmentofthePresident,serveasatemporarydelegatetothe UniversitySenate

ARTICLEIV.

SectionOne.ThisConstitutionshalltakeeffectuponthecommencementofthefirstSenatemeetingof thesemesterfollowingitsapprovalandshallhenceforthsupersedeandrendervoidallprevious constitutionsandamendments.

SectionTwo ThisfirstsemesterofthisConstitution'sutilizationshallnoticetheretainmentortransition ofthefollowingpositions:theAppropriationsChair,theComptroller,theStudentServicesChairasone oftheAdvocacyCommitteeChairsoftheirchoice,thePublicRelationsChairastheCommunications Chair,theSpiritChairastheProgrammingChair,theRulesCommitteeChairastheClubResources CommitteeChair,thePresident,theVicePresident,theSecretary,theSenators,andtheAssociates.All otherofficesnothereinspecifiedshallbeelectedorappointedinaccordanceofeachposition’selection procedure.

SectionThree AmendmentstothisConstitutionbecomeeffectiveifapprovedbythree-fourths(3/4)of themembersofSenate,orbyatwo-thirds(2/3)voteinareferendumaccountingfortheHofstra

undergraduatepopulation,inaccordancewithlegislationastheStudentGovernmentAssociationshall provide.
