Tort And Business Law Essay

Law of Tort and Business Contracts Introduction According to law, tort occurs when a person fails to observe duty imposed on one by law, to ensure there is no injury to a determinate person. In most cases, the remedies for a tort are in the form of unliquidated damages for instance different amounts of compensation, which are determined by the courts of law. The law seeks to compensate the aggrieved party, unlike the criminal cases where the offenders are punished according to law. However, certain cases in tort fall both in the civil and criminal law brackets. Examples include assault and battery. The tort of negligence is addressed in this article, because of its influence compared to the other torts of law. The liability attracted by negligence comes from a basis of duty to practice reasonable care (Geistfeld, 2011, pg 144). First case analysis: Rare Plants Limited In the first scenario of the case, an elderly/disabled member of a coach party slips on a pathway and breaks a leg. After the accident, the member spends time in hospital (8 weeks) and suffers considerable pain during treatment. In this case, the home care is liable to ensure the residents are safe when on the premises. Knowing the premise users are elderly and disabled, the owner will be liable when it is foreseen or contemplated that the actions and omissions may lead to the injury of the residents. The owner of the home care owed the residence a duty of care. From the given scenario, the owner is liable

Analysis Of The Garden Of Earthly Delights

Throughout our class I have been shown many astounding works of art that tantalize the eyes, mind and soul. From the astounding sculptures of Michelangelo the the complex drawing of Da vinci and countless other artist that changed the world of art, architecture and design. Though there was one work that we came across in class recently that made me feel different compared to all the others i ve been shown. It was beautiful yet disgusting, heavenly yet sinister, and more than anything compelling. I am referring to a triptychpainting done by H. Bosch entitled Garden of Earthly Delights . The picture immediately stood out from the rest somewhat having an uncanny modern feel to it. The piece is a 3 panel painting, also known as a triptych, The Garden of Earthly Delights, oil on oak panels, 220 cm × 389 cm with each section showing images of religion, damnation and over all madness. I was instantly intrigued by what my eyes were taking in and then shortly after learning about how there is so much mystery and uncertainty to the work only heightened this feeling. I was hoping that looking the work up on my own time would be able to answer at least some of my many questions; this was not the case. Solid factual information on the pieces is extremely limited including the date of completion, the persons who commissioned it, the purpose for it being commissioned, and most of all the meaning and message the piece was meant to inflict. The accurate dating of The Garden of Earthly

Taking a Look at Magazine Advertisements

Companies have been using advertisements in magazines as means of marketing for many decades now. While the purpose for ads, which is to get the consumer to buy their products, is seemingly obvious. Most of the messages that ads are sending are being received to the viewer s subconscious mind. As Jean Kilbourne touches upon in her documentary Killing Us Softly 4, ads not only tell us what we need to buy, they tell us who we are (Killbourne, 2010). The specific ad I will be analyzing is an ad that was produced by the marketingexecutives at BMW. The ad can be found in many different magazines and the targeted audience for this particular ad is obviously to gain the attention of men. The ad displays a man and women in bed believed (suggested) to be engaging in intercourse with a picture of a BMW covering the women s face. Through the knowledge that I ve gained from Jean Kilbourne s documentary, I can point out that three are three strong messages being displayed in this ad. The ad sends a message that dehumanizes women, uses sex to sale a product, and shows men that they can objectify women without consequences. In the ad the image of a car is shown in place of the women s face. This act of dehumanizationcan affect women in many ways they may or may not even be aware of. That simple act of turning the woman into a thing could cause the viewers to experience distorted self thoughts. An ad like this one can affect the women s self esteem, cause them to devalue themselves, and

Sex Offender Notification System

Since 1994 nationwide laws have been put into an effect nationwide asking for those convicted of a sexual crime be placed on a registered list. In the 20 years since its implementation, the registry has added several caveats such as a tier based registry where the violent offenders were kept at a higher more prominent level. As well as public notice every few months of an offender relocating or living in your area. While some low levels offenders must relinquish 15 years of their life notifying the public and remaining on this list, those on the higher tier of the list must reregister more often and for the rest of their lives. While on the surface it would seem that having such a list, coupled with a lifetime of notification to residents in... Show more content on Helpwriting.net ... Since it s their enactment however some states have seen a dramatic increase in sex offenders whether due to the expansion of the definition of a sexual crime, or the reclassification of some convicts as a result of this law. An example of this would be prior to the law if a teenager was tried as an adult in their state, served time but under the state s legislature was not required to register as an offender. Under the current law, there is a possibility this teenager will have to register for the rest of their life every 3 months. Failure to do so may result in a felony charge or possible life sentence. If they were to go to college they would need to reregister with the state they reside in as well as their home state, and would likely also be rejected for federal aid as the classification may have already pegged him as a convicted

The Feminist Movement During The Romantic Era

During the Romantic Era, gender roles were already set in stone. Women were expected to do certain things, as were men, and they only did such. These clear standards were held very highly in society, however, as many people felt obligated to society to continue with these standards, there were always people who had a different opinion. Women such as Mary Wollstonecraft identified men as the root cause for the need of a change in society. In contrast there were women like Anna Letitia Barbauld who felt that if women truly loved their husban,d, being an equal gendershould not matter. These two approaches, although very different, made up the beginning of the feminist movement during this era. Women were expected to basically be merely an object, even a trophy for their husbands. They were expected to stay home and clean, as well as cook. With all these expected tasks, women hardly had any time to branch out and figure out what they wanted to do with their life. They had no time for leisure activities of any kind because, of course, their activities involved taking care of the house. Women were also seen as the weaker sex, always submissive to their dominant male counterpart. Although the women were submissive, they were held to a higher moral standard. Adultery was twice shamed upon if committed by a woman rather than a man. (Hughes par.3) A woman could be stoned to death, but people would turn their cheek for a man while the woman still was expected to stay beside the man.

Essay on Virginia Woolf’s Between the Acts

Virginia Woolf s Between the acts

Virginia Woolf uses many images in the Between the Acts. Like the other novels I read in the class, the images in the Between the Acts cannot be separated with the story development, and the images themselves construct the story in the book by dismantling the conventional expectation for the novel. However, Woolf uses common and conventional words and images with an experimental way in this novel. This novel constructs the images and the representation with their conventional words and actions of the characters. I think Woof explores how the communal use of the words like songs and cliché makes another meaning or another reversion in their daily life here. The characters in the novel are in the ... All incidents and people in the book can be said to do something between their presence and their absent future and absent hope which is coming to them by the appearance of the war. The occurrence of the nature in the book which is placed mainly is not their purpose or their attempt for the purpose, but the interruption occurring in the everywhere and dispersing to the every place in the book. The interruption from the uncontrollable is the main character in Between the Acts. All words have another meaning which is not intended by the interlocutors so that it can be an another interruption between the interlocutors. It is the book about the control and release of the acts and words. All actions which should be controlled by the owners are dispersed in the whole book without any apparent connection. This book is written by Virginia Woolf who feels the imminence of the war. The characters and the situation in the novel are also confronted with the forthcoming war and feel the insecure ambience of the war. In this insecure background, this book is attempting to grasp something which is not here and also not there in the war. I think it is the hope for themselves and the hope which is dispersed in the nature around themselves. In Between the acts, there is no center which is gathering the story and the characters. It is the story to disperse the center if there is one. It is the story about the between. In between, there is a play which is cut and

Business cycle

Boom: during the boom stage of the business cycle the economy is performing its best. Demand, production and sales figures are high. To meet the high levels of demand and production the business has to create new jobs; by doing this the percentage of the nation has money to spend on goods and services. However as businesses produce greater profits higher wages can be paid to employees growing their disposable income. People businesses in the economy are allowed to spend money as there is a great business available for them.

Recession: customers continue to spend but overall load fall and product services become more costly. As a result to this businesses are strained to reduce the prices of their items to generate ... Show more content on Helpwriting.net ...

Inflation in China accelerated in november, as economic growth picked up and food prices rose. Chinese consumers paid 2% more for good and services in november then they did a year ago, the government s national bureau statistics reported on a Sunday. While that up from a 1.7% annual increase in october, it nevertheless represents tame inflation for the world s second largest economy. A year ago the country was experiencing an annual inflation rate at 4%. the Chinese government prefers to keep its annual inflation rate below 4% a level it seems as consistent with health economic growth and consumer demand. The inflation rate averaged 4.23 percent reaching an all time high of 27.70 percent in october of 1994 and a record low of 2.20 percent in march of 1999. in china the most important components of the CPI basket are food at 31.8 percent of total weight and residence at 17.2 percent. Pros And Cons Of Ration Books And The Rationing System

Ration books With the onset of WWII, the United States needed a system to savor their supplies, so the government put in place the rationing system. They used ration books to get supplies like meat and sugar from grocery stores, a ration book was kind of like a coupon book, you couldn t buy a rationed item without having a ration stampfor that item (National WWII museum). So it s like a mix of a coupon book, and a you have permission to buy this item stamp. But nothing is perfect, not even the ration books, so here are some cons the ration books the rationing system spawned. First, that the ration system/books spawned that was illegal was the black market, since you could only buy something if you had a rationing stamp from a grocery store, people sometimes needed more than they had, so the black market allowed people to buy rationed items for a higher price, and they didn t need the ration stamp for that item (United States History). One aspect of the rationing system was that the food wasn t very fresh, so if people wanted some fresh vegetables they had to make their own gardens (victory gardens) and once they did that their family could enjoy fresh food for a few months while the garden was still alive, many people did this, there were approximately 20 million victory gardens (20,000,000) (United States History). In addition, if you had a ration stamp for an item, it wasn t guaranteed that the store had the item that you needed because there were a lot of

Netflix

Netflix s main goal is to be the first company to expand internet television. They believe that Internet TV is the future of the television industry and will soon replace linear TV. The portability, flexibility and personal aspect of Internet TV is the future and Netflix s goal is to be the first to get there. They believe that if they can dominate this industry then they will have achieved their goals. They do this by sticking to what they have always done: they do not have advertisements, they have their low monthly fee, and their few original shows. Their strategy is to quickly expand into all aspects that are possible, while remaining profitable globally. One big challenge that Netflix will have to tackle, is dealing with bootleg websites. These websites provide more popular shows and movies for free. These websites also offer quicker access to these shows and movies than Netflix. Netflix takes longer to add shows and movies to the website. Most subscribers are satisfied with Netflix s services when they become members, but the one main complaint is that there are not a lot of popular options and they feel like there should be since they are paying for this service. Another reason that is tricky, is because the legality of the content may be compromised. That is one of the biggest factors as to why Netflix has not expanded their content. Running into legal issues makes them no different than their illegal counterparts. They will also have to address the fact that

The Chimney Sweeper

The Chimney Sweeper

Thesis

Blake uses many literary devices to portray the hopeless life of the young chimney sweeps.

I.Irony

II.Imagery

III.Symbolism

William Blake masterfully uses many literary devices to portray the hopeless life of a young chimney sweep in his poem The Chimney Sweeper . The poem has a young, nameless first person narrator which gives the poem a sense of youthful innocence and anonymity that is in direct contradiction to the horrible conditions they suffer. Most of the poem has dark tones that is punctuated by a happy dream of freedom and joy with his true father his creator. The poem ends with a bleak and almost sinister twist of irony that leaves the reader feeling sorrow and shame for the chimney ... Show more content on Helpwriting.net ... He cries when it is shaved but is told it is for the better because the black soot will only ruin it. Tom dreams of thousands of boys sleeping in dark coffins which are opened by an angel. In line 11, the boys are given names which personalize the boys as individuals and rehumanize them for the reader. They are all let free to run and play and cleanse themselves in a river and feel the sun. These images again invoke a sense of childlike innocence that the sweeps were not allowed. We see the boys floating on clouds, playing in green fields, splashing in a river all of which can be equated with heaven and peacefulness. The images of the dream and the reality of the situation are very polarized and help the reader sense the bleak, helpless mood of the poem. Symbolism is evident throughout the poem as well. The color black runs through the poem and symbolizes death or evil just as the black soot of the chimneys brings the death of the sweeps at the hands of their evil masters. Being in a chimney would be very much like being in a black coffin as described in line 12. In line 17, the boys are naked and white which are symbols of birth, life and freedom. The coffin is a symbol of death associated with the chimney. The boys swept chimneys and slept in soot which is very dark and symbolizes death that the sweeps will certainly succumb to. The angel in Tom s dream is a symbol of freedom for the boys. It is the only part of the poem that is hopeful and bright. Christians
