By the time Smith arrived in Florida, it was clear that she was struggling. One witness said Smith "seemed a bit dizzy" when he checked into the hotel. Almost a week after her death, a judge finally ruled that Smith's body could be released, but it was not until February 28 that it was decided who would decide where to bury Smith. . . That right was given to Richard Milstein, a court-appointed attorney who was representing Smith's 5-month-old daughter Dannielynn at the time.
