Queenslandrealestatelawrequiresthatallpeoplebiddingataresidentialpropertyauctionmust providetheirnames,addressesandproofofidentitytotheAuctioneerpriortotheauctioninorderfor theirbidstobeaccepted.

Youcanregisteratanytimepriortotheauction.Thiscanbeatanopenforinspection,orwhen visitingthelistingagencypriortotheauction.Registeringearlywillsaveyouthetroubleof registeringonauctionday

YouwillneedtoprovidetheAuctioneerwithyournameandaddressandsomephotoidentification –e.g.driverslicenceorpassport.

TheAuctioneerwillrecordthesedetailsinaBiddersRegisterandprovideyouwithaBidder number.Thisnumbermustbedisplayedbyyouwhenmakingabidduringthecourseofthe auction.

Ifyouregisterpriortoauctionday,youmaynotreceiveyournumber Whenyouarriveatthe auction,youwillneedtoseetheAuctioneerortheirrepresentative,providethemproofofyour identity,andreceiveyournumberorbiddercardatthattime.

IftheAuctioneercallstheincorrectamountofmisinterpretsyourbid–callouttotheauctioneer andclarifythebidwiththemimmediately

12.Withoutaffectingcondition11,ifthereisanydisputeoverabidortheresult,theAuctioneermay: a re-openthebidding;and/or b determinethedisputeinanyotherwaytheAuctioneerconsidersappropriateinhis/herabsolutediscretion

13.Immediatelyonthefallofthehammerthepropertyissold,theBidderofthehighestbidacceptedinaccordancewithCondition2, mustsign,asBuyer,theContractofSaleintheformdisplayedorcirculatedwiththeseConditionsofSaleandpaythedeposittothe nominatedDepositHolder

14.ThedepositpayableundertheContractofSaleis10%ofthesuccessfulbidoranyotherpercentageorfigurenominatedinthe ContractofSale

15 TheSellerandtheBuyeragreetosignalldocumentsanddoeverythingelsenecessarytotransferthepropertytotheBuyer The SellerandtheBuyereachappointtheAuctioneertheiragenttosigntheContractofSaleontheirbehalf.Thisappointmentisnonrevocable.

16 IftheBuyerdoesnotpaythedeposit,attheSeller'soption:a theresultoftheauctionwillbetreatedasinvalidandtheproperty mayberesubmittedtopublicauctionattheriskandexpenseofthatBuyer;orb.theSellermayaffirmtheContractofSaleandpursue theirlegalandotherremediesagainsttheBuyerastheyseefit.

17 ThedecisionoftheAuctioneerisfinalinallmattersrelatingtotheauction

18.TheBidderconsentstotheuseofelectroniccommunicationinaccordancewiththeprovisionssetoutinChapter2oftheElectronic Transactions(Queensland)Act2001(Qld)andElectronicTransactionsAct1999(Cth)

19.Ifthisdocumentissignedusinganelectronicsignature,theBidderagreestobeboundbytheseconditionsinelectronicformand consenttosigningthisagreementusinganelectronicsignature.
