Last month, Part 1 of our coverage of my favorite event, the 2025 Honors Awards, focused on management professionals. Now, in Part 2, meet our maintenance and supplier honorees.
It’s our maintenance teams who work every day to make sure our residents are happy, healthy and comfortable in their apartment homes, and our suppliers who work to make sure we are all supported in providing those homes. They are both an essential element of our industry. Howard Bookstaff, published an article in March 2025 regarding interacting with ICE at your property. Given that this has been a persistent issue, HAA thought it would be helpful to provide a refresher from his article as well as provide additional resources published by the National Apartment Association.
Please note that this document is not a substitute for legal or operational advice, and HAA recommends contacting qualified legal counsel regarding ICE enforcement activities specific to your properties.
What if ICE agents (Immigration Customs Enforcement) come to my property and ask for information regarding a resident?
You should adopt a policy on how to respond to law enforcement when information is requested. If your policy is to require that law enforcement have an appropriate subpoena, warrant, or other enforcement document before information is provided, follow your policy.
If a resident is removed from my community, what is the status of the resident’s lease?
The answer to this question depends on what is stated in the lease. However, if a TAA lease is used, the status of the lease is unchanged by the resident’s removal. If the resident is the only occupant, and the resident fails to comply with the lease (by failing to pay the next month’s rent), the
eviction process will allow you to regain possession of your unit. If the resident has a co-resident that also signed the lease, pursuant to paragraph 22 of the lease, each resident is jointly and severally liable for all lease obligations. In other words, even if one resident vacates the unit, absent any other agreement between you and the residents that signed the lease, both residents remain fully responsible for all lease obligations.

Earlier this summer, HAA worked with the Houston Real Estate Council (HREC) and the Greater Houston Builders Association to weigh in on a proposed fee increase by Harris County for single family, multi-family, industrial, and commercial permitting.
At the time of print, Harris County Commissioners Court was scheduled to vote on this proposal on August 26th.
In the proposal, the Harris County Engineering Department requested Commissioners Court to direct the funds from new permitting fees to increase personnel for the Permit Department. They estimate needing a total of 30 additional staff members over the next three years.
HAA plans to send a letter to Commissioners Court with our comments and suggestions ahead of their August 26th meeting.
The Texas Legislature recently concluded their first Special Session. Items on the agenda included flood emergency systems and communications, congressional redistricting and reducing property taxes, among other things. The first session was adjourned on Friday, August 15th, and Governor Abbott immediately called the Legislators back for a second Special Session.
No bills passed or were signed by Governor Abbott from this first special session due to a lack of quorum. State House Democrats left the State to deny the Republican majority a quorum, limiting the work that could be accomplished. Democrat legislators took a major point of contention with Republican plans to redraw the Congressional maps, attempting to add more Republican leaning seats in Congress.
Governor Abbott has said he will continue to call Special Sessions until the agenda items he laid out are passed.

Texas prohibits certain individuals from leasing property.
LAST MONTH, HAA reported on the passage of Senate Bill 17 which restricts certain individuals from purchasing or acquiring an interest in real property, including a leasehold interest if the duration of the interest is one year or more. This new law has received a lot of attention and has raised questions with respect to how it might affect the apartment industry. Let’s do a deeper dive into this new law.
What conduct is prohibited by the new law?
The following may not purchase or otherwise acquire an interest in real property in Texas:
• A governmental entity of a “designated country”.
• A company or organization that is: (i) headquartered in a “designated country”; (ii) directly or indirectly held or controlled by the government of a “designated country”; (iii) owned by or the majority of stock or other ownership interest of which is held or controlled by certain individuals domiciled or citizens of a “designated country”; or (iv) designated by the governor of Texas under the new law.
• A company or organization that is owned by or the majority of stock or other ownership in-
terest of which is held or controlled by certain companies or organizations affiliated with a “designated country”.
• An individual who: (i) with certain exceptions, is domiciled in a “designated country”; (ii) is a citizen of a “designated country” who is domiciled outside of the U.S. in a country other than a “designated country” and for which the individual has not completed the naturalization process for becoming a citizen of that country; (iii) a citizen of a designated country who is unlawfully present in the U.S.; (iv) is a citizen of a country other than the U.S. and acting as an agent or on behalf of a designated country; or (v) is a member of the ruling political party or any subdivision of the ruling political party in a designated country. What is a “designated country”?
This new law has received a lot of attention and has raised questions with respect to how it might affect the apartment industry. Let’s do a deeper dive into this new law.

What does “domiciled” mean?
“Domiciled” means having established a place as an individual’s true, fixed, and permanent home and principal residence to which the individual intends to return whenever absent.
Are any transfers of property exempt under the new law?
A “designated country” means a country identified by the U.S. Director of National Intelligence as a country that poses a risk to the national security of the U.S. in at least one of the three recent Annual Threat Assessments of the U.S. Intelligence Community issued pursuant
Yes. The new law does not apply to:
• an individual who is a citizen or lawful permanent resident of the U.S.;
• a company or organization that is owned by or under the control of one or more individuals who are citizens or lawful permanent residents
of the U.S. and not otherwise described as being covered by the law; or
• a leasehold interest in land or improvements constructed on a leasehold if the duration of the interest is less than one year.
How does the new law affect the apartment industry?
Since the exemption applying to leasehold interest is with respect to leases that are less than one year, most apartment leases would not be exempt.
The new law prohibits individuals from leasing if they:
• are domiciled in a designated country; or
• are citizens of a designated country who are domiciled outside of the U.S. in a country other than a designated country and for which the individual has not completed the naturalization process for becoming a citizen of that country; or
• are citizens of a designated country who are unlawfully present in the U.S.
Consequently, if an applicant fits one of these categories, they would be prohibited from leasing a unit for one year or more.
How will the new law be enforced?
The attorney general is required to establish
procedures to examine purchases or acquisitions of an interest in property and determine whether an investigation of a possible violation of the new law is warranted.
If the attorney general determines that the investigation of a purchase or acquisition of an interest in property is warranted, the attorney general will conduct an investigation and determine whether a violation has occurred. The attorney general is authorized to bring an action against property to enforce the new law in a district court and may refer the matter to the local, state, or federal law enforcement agency.
Is a sale of property void if it is made in violation of the new law?
No. A purchase or acquisition of an interest in property in violation of the new law is not void because of the violation, and the validity or enforceability by any person of a purchase contract for or the conveyance of an interest in property is not otherwise affected by the violation.
What can be done if an acquisition is made in violation of this new law?
If a district court finds that the property subject to an action brought under the new law was purchased or an interest in property was other-
wise acquired in violation of the new law, the court is required to enter an order divesting the individual’s or entity’s interest in the property through sale, termination of the leasehold, or other disposition of the interest.
Proceeds from the sale or other disposition of an interest in property under the order is required to be applied first to satisfy any existing liens on the property and then to pay the reasonable costs incurred by the state in enforcing the new law. The remaining proceeds will be remitted to the individual or entity that purchased or otherwise acquired the interest in violation of the law.
The new law can be complicated and how the law will be applied to the apartment industry is not yet clear. As the attorney general establishes procedures to enforce the law, the apartment industry will learn how to adapt to the new law.

A resident makes unfounded claims and demands restitution from management.
A RESIDENT FILED a complaint with HAA seeking return of monies paid, as well as triple damages for duress, suffering and hardship. The resident stated that her apartment was not ready for move-in because the condition of the unit was poor, and she had not agreed to the location. Enclosed was a copy of the move-in condition form. Pictures were also provided.
Management responded to HAA with the following explanation: Management stated that the resident came into the office looking to lease an apartment on August 13 and was shown a model by a leasing professional. At the time, the special offered was a $311.50
total move-in for the remainder of August (with approved credit). The resident stated that she would like a renovated unit near the pool and was informed that a unit was available in close proximity, but not facing the pool.
The resident applied for a move-in date of August 15 and informed the leasing consultant of a recent broken lease (the previous year) and was advised that she might be approved with the requirement of a higher deposit. Upon reviewing the completed application and background check, the resident was informed on August 14 that she would be approved with a $300 security deposit plus a surety deposit in the amount of $175 due to the broken lease. She stated that
day that she would not be able to move in due to the amount of money required.
The resident called back later and explained her financial situation, and management made an agreement with her that she could pay a portion of her deposit upon move-in and the remainder with the following month’s rent. She called several times over the next two weeks and changed her move-in dates to fit with her ability to pay the required amounts.
The resident moved in on August 25 after paying $175 and agreed to pay the $300 deposit by September 3. The day she moved in, she was running late from work, and management stayed an extra 30 minutes after / Continued Page 17
closing to wait for her so she could move in that night. She signed and paid the amounts agreed and took her keys and was shown the location of the unit. She was instructed to complete her move-in checklist and turn it in the next day since it was after hours and told that any minor issues she found would be tended to the next morning by maintenance.
On August 27, the resident came into the office and stated that she had spoken to some people at the mailbox who told her that the property had bad plumbing and mold issues. She then stated that she wanted out of her lease and was turning in keys and wanted all monies returned. She stated that she did not see any of those problems in her apartment but wanted to leave before it happened to her. She was informed that this was not a valid reason to terminate the lease. She began to get upset and said there were roaches and animal feces and that the apartment smelt of urine. Management asked to accompany her to the apartment to inspect and she refused, leaving her keys, a note and the move-in inspection list.
Management inspected the apartment and informed the resident that the carpet and padding had been replaced prior to her move-in and that there were no apparent feces, urine smell or roaches. Several attempts were made to contact the resident, and when she was reached she was asked to come back to the office and show management what exactly she was referring to, but she refused.
During the first week of September, the resident went into the office yelling and demanding three times the amount of money she had paid
and threatened to get an attorney. She left after being informed she would not receive a refund and that her apartment had been leased. Management believed the resident was charged accordingly. Enclosed were copies of the lease, application, move-in condition form and final account statement.
The committee decided in favor of management with an adjustment made. The committee noted that the lease states a security deposit of $300, which was not noted on the final account statement. After the deposit is applied and charges justified, the resident owes the property $1,621.96. The resident may wish to pursue this complaint in small claims court.
The HAA Resident Relations Committees provide an impartial review of resident complaints using the documentation provided by both the resident and management. When the committee finds in favor of the resident, HAA appreciates a direct response from the property to the resident within two weeks and a copy of the payment sent to HAA for our records. When the committee finds in favor of the resident, management may file an appeal. When the committee finds in favor of the management owner, the decision is final. The HAA Honors Awards recognizes members for their commitment to their communities and the apartment industry. Here are the 2025 Houston Apartment Association Honors Award recipients for winning service.
Humberto Rios is Maintenance Supervisor for Q10 Property Advisors and has 15 years of experience in the multifamily industry and has been with Q10 for five years. He oversees maintenance for 20 properties with a total 3,500 units.
Humberto leads the regional maintenance team and has taken over all habitability issues, navigating city issues, coordinating all contractors, timing and pricing. He is Q10’s expert on gates, elevators, boilers, and HVAC. He does everything with a smile and has been hosting quarterly maintenance training sessions for the teams - even implementing surveys for his team in English and Spanish. And if that work load was not enough, he also fills in for maintenance leads that are out for vacation, even working on-call for weeks at a time.
Humberto has a great reputation with his peers, suppliers and with others in the industry. He has promoted 15 people since he has been with Q10, mentoring them along the way and he recruits new staff. Humberto has recruited nine people to work for Q10 and is one of their biggest cheerleaders. The company leadership can't say enough about not only his hard work, but his attitude. He is Stephanie Graves’ go-to for all her maintenance classes and was coteacher with her at the CAM Maintenance Session in March 2025.
Humberto was named Q10’s Maintenance of the Year, is a Certified Pool Operator and holds his EPA and HVAC Certifications. He is also active in his church’s Kids ClubBilingual Group for ESL Kids. Congratulations, Humberto!
Jason Moore is Maintenance Supervisor for the 232 unit Pines on Spring Rain and the 308 unit The Cove. He has been working in the industry for 34 years and with Summit for two years.
Jason has been a strong asset to Summit since he started in 2023 at The Pines at Spring Rain. This community had very involved investors and Jason conformed to the strict deadlines and higher expectations. He successfully helped complete renovations at that community and maintained it according to investor standards with only one other maintenance person.
He transferred to The Cove, a challenging property that required entire roof replacements and foundation repairs on five buildings. The foundation repairs were a challenge as nearly 40 residents were transfered to new apartments and their renovated units post repairs, all while maintaining the normal turns and work orders for the rest of the community. Jason successfully led his team of two and completed all makereadies by the required deadline.
Jason resides at a sister property and will help with anything needed. In March 2024 there was a fire at that community and Jason was one of the first people on-site. On January 1, there was another fire and the service manager was on vacation and the manager was new. Jason took over, communicated with the team and fire department. He stayed for hours until everything was settled. He even came in afterwards to help resident gain access to their items.

Regional Maintenance Supervisor (Multiple Properties) of the Year
Courtney Hill is Regional Maintenance Supervisor for 20 communities in Houston for Summit Property Management. She has more than 30 years of experience in the industry and has been with Summit for more than a year.
Courtney joined Summit in late 2023 and went straight to work on improving maintenance operations. She oversaw 20 different communities all at different stages of renovations. She helped with the acquisitions of two communities and the depositions of two others. She is very knowledgeable and shares that knowledge with her team. She made sure everyone was up to date with all the changes with HVAC refrigerants. Courtney ensured all service managers were trained to deal with the changes and stayed current with city and county policies and requirements. She partnered with Century A/C, where they provided manager training on HVAC Refrigerants helping to bridge the gap between office and maintenance. She implemented regular trainings and calls with the entire company and ensured that each property had a CPO by enrolling them in classes.
Being a female in a male dominated sector, Courtney outshines everyone with her knowledge and leadership abilities. She values training and developing her team members and has worked to unite all the service managers.
Courtney serves on the HAA Education Advisory Committee is a CPO-Certified Pool Operator. Courtney also works in the community and donates her time to assisting single moms with maintenance assistance.

Ricardo Garay is the Lead Maintenance Techncian for Stonemark Management Company’s Cantera at Towne Lake, a 15-yearold property with 366 units. Ricardo has been a part of the multifamily industry for eight years and has been with Stonemark for three years.
Ricardo is a vital part of his maintenance team and knows everything that there is to know about his property, always going above and beyond to ensure that the property looks its best at all times. He jumps in to help all of his co-workers when they need assistance, as well as helps at other sister communities with anything that is needed. Stonemark never receives callbacks on any of his work orders, and many residents request Ricardo to come when they need assistance. He displays a professional demeanor at all times and his supervisor stated he is “by far the best maintenance tech that I have ever had the pleasure of having on my team.”
Ricardo has received nearly perfect scores on all of his company required classes, and there are approximately 40 to 50 required yearly. He is extremely knowledgeable in his field and his apartment community.
Ricardo was named Stonemark’s Maintenance Technician of the Year 2023, holds his CAMT credential and is HVAC/EPA certified.
Ricardo is also very dedicated to his church and family. He and his family have very strong Catholic beliefs, and he and his wife volunteer with a clothing drive every year, which helps many families in need.

Freddie Sanchez is Maintenance Support for Quarterra’s Taylor Heights, a five-year-old community with 363 units. He has been in the industry for eight years and with Quarterra for four years.
Freddie is the gold standard in groundskeeping and property maintenance, earning recognition at the highest levels of leadership for his exceptional work. Paola Rodriguez is a District Manager for Foresight Asset Management and HAA’s top recruiter for the past year and one of our top Go-Getters this year. She has recruited 11 members for HAA. We spoke with her during the Honors Award presentations on how she became a Go-Getter.

I became a passionate recruiter. I have that enthusiasm for – and belief in – being a part of the Houston Apartment Association and I want to bring that enthusiasm to everybody.”

Here are the 2025 Houston Apartment Association Honors Award recipients for supplier service.
Nikki Sekunda is Executive Recruiter for The Liberty Group. She has been with Liberty for more than 9 years and in the multifamily industry for 14 years. She joined their executive search team in 2016.
Nikki started her career with Liberty on their national team and was responsible for opening new offices. Within one year she opened offices in Tampa, Kansas City, Indianapolis, Atlanta, Phoenix and Denver.
Nikki holds her CAS designation and is a graduate of the HAA Leadership Lyceum. Nikki was also one of HAA’s 40 under Forty in 2022 and was asked to captain an Ambassador’s team for 2023.
She received recognition for recruiting the most people to join the Texas Apartment Association’s Day at the Capitol in 2018 and won a trip to NAA Apartmentalize in Denver. In 2019 and 2020 she was co-chair for the HAA NEXT Young Professionals Committee, became a member of the HAA Board of Directors and received the 2019 HAA’s Presidents Award.
During her time as NEXT co-chair, she helped raise more than $15,000 dollars for Goodwill’s CAMT program and alone raised more than $7,000 in giveaway donations for
NEXT’s Casino Night. She was instrumental in helping restructure the NEXT Committee when she was co-chair.
She wrote an article for the July 2022 ABODE titled “Hire Green, Then Help Them Grow.”
She currently serves on NEXT, Education, Community Outreach, PAC, 2023 Lyceum Selection and Expo committees. She is an active member of the careers focus group on the Education Committee. Nikki was also part of the special task force that went through applications for 2023 TAA’s education sessions.
Nikki was selected to join the Product Service Council in 2020 and was elected in 2023 as treasurer of the Council and was Century Club Chair for 2024. She now serves as secretary for the PSC. Nikki also served on a special task force for NAA regarding CAS efforts. She currently serves on the TAA NEXT Gen committee since 2019.
Nikki’s charity work includes supporting the Houston Food Bank, Gulf Coast Regional Blood Center, Foundation for Austism Care and True Knight Academy, a special education school.

Victoria Sepulveda is a Sales Executive with The Liberty Group.
She started her multifamily career on the management side with Mosaic Residential then moved over to the suppliers side with GreenLogic before joining The Liberty Group.
Victoria is an active HAA volunteer and is a member of the NEXT Young Professionals, Go-Getters and is Junior Captain of the Ambassadors.
When asked how she has gotten to this point, she says, “By being involved, by
being motivated by talking to everybody, just putting myself out there.”
“Don't be afraid to talk to people. Don't be afraid. Everybody here is so welcoming. Everybody here is so nice. Just be yourself.”
Victoria also had a big thank you for two important people in her life: “I would like to thank my mother and my grandmother, who have been in this industry many, many years. They are the rocks of my life and without them I wouldn't be here.Thank you so much!”

HAA was well represented at TAA for the TAA Summer Board Meetings in Galveston. During the meetings, HAA presented TAA with HAA’s Fair Share Contribution to TAA’s Political Action Committee of $70,855. Also, Nimcy Gonzalez with Veritas Equity Management received the TAA Community Service Star Award. Nimcy, Experience Director at Veritas Equity Management, was recently honored with the Houston Food Bank President’s Volunteer Service Award
– a prestigious recognition celebrating individuals and organizations who have made significant contributions to community service. Through Nimcy’s leadership, Veritas proudly earned the Bronze Level Award for serving an incredible 100 to 249 volunteer hours. She has played a vital role in organizing meaningful programs both with the Houston Food Bank and in broader community efforts. Thank you for representing HAA so well!
