HAA’s Annual Education Conference and Expo is created by YOU for YOU. Every year thousands of members get together at NRG to network, explore what multifamily has to offer and to learn more about this industry we love. Not only do we throw one of the biggest (and best) Expos, but we offer some of the best education sessions for you to enjoy before you walk the show floor. So don’t miss out on this year’s “out of this world” Expo and Education Conference!

Enter the HAA Matrix

This year we have a wonderful lineup for our Education Conference, starting off the morning strong with two Education Breakout Sessions: A Main Track and, back by popular demand for the third year, a Spanish Track.

Our Main Track breakout session speakers this year are Rich George on “Centered Leadership,” Marci French with “The Work-Life Myth: Beyond the Balance” and HAA’s General Counsel Howard Bookstaff will present a Fair Housing SNL-style session! This year’s Keynote Luncheon speaker is Joshua Evans. Joshua will be talking all about “Change Engage Evolve.” We have a special feature article from Joshua beginning on Page 40 and great information from Rich George starting on page 44. And, as always, Howard’s monthly column starts on Page 11.

The Spanish Track session speakers will be maintenance pros Michael Olvera and Eujenio Rojo, covering “A2L Refrigerants and Regulations” and “Electrical Fundamentals and Meters.” Plus, you won’t want to miss the new mini marketing sessions. You can stop by the Mini Session Corner between breakout sessions to catch a few quick marketing tips led by Sprout’s Barbara Savona.

AT A NATIONAL LEVEL

HAA heads to D.C to lobby for our industry as we remember a dedicated public servant.

AS WINTER HAS come and gone and we are already in spring, HAA is quickly pivoting from lobbying the State Capitol in February to lobbying the Nation’s Capitol during NAA’s Advocate.

At press time, HAA is taking 22 members to Washington, D.C. for the event, almost evenly split between owner/manager members and supplier members. Our HAA crew will meet with all Houston area congressional delegation offices and convey important issues on behalf of the multifamily industry.

First, key tax provisions secured by NAA in 2017 are set to expire this year and HAA will make the following asks to congressional members: 1) preserve the 20 percent qualified business income deduction; 2) enact expansions to the Low-Income Housing Tax Credit (LIHTC); and 2) protect business’ ability to claim state and local tax (SALT) deductions for property taxes.

Additionally, HAA members will ask the congressional delegation members to consider cosponsoring the Respect State Housing Laws Act H.R. 1078/S. 470. This legislation strikes the temporary, federal notice language from the CARES Act, eliminating any ambiguity about the requirement’s expiration in 2020. Currently, only one member of the Houston area congressional delegation has signed on as a cosponsor to this bill, Representative Morgan Luttrell from the Montgomery County area. Remembering Sylvester Turner

While it should be a great and productive trip, the Capitol visit will have a more somber tone this year given the unexpected passing of Congressman (and former Houston Mayor) Sylvester Turner just weeks before Advocate.

We were sincerely looking forward to working with him in this new congressional capacity. In fact, HAA staff had recently introduced Congressman Turner to NAA lobbyist Jim Wilson during an October visit to Houston. At the meeting, Congressman Turner was so gracious with his time and seemed very interested in working with NAA moving forward.

The HAA PAC had also recently hosted Turner at HAA for a September luncheon. Additionally, some of you may remember that HAA hosted then Mayor Turner at HAA’s Annual Business Meeting in November of 2022. These meetings and many more demonstrate the long, fruitful working relationship HAA enjoyed with Turner, even dating back to his days in the Texas State Legislature.

Prior to his brief service in the U.S. Congress representing Texas House District 18, Sylvester Turner served as Houston mayor from 2017 to 2023. Before running for Houston mayor, Turner spent 27 years in the Texas State House, representing Texas State House District 139.

His dedication to the City of Houston was unmatched and he leaves behind quite a legacy of public service. He will certainly be missed.

IS IT FAIR?

Court addresses request for

“Economic

Accommodation.”

APRIL HAS BEEN designated as National Fair Housing Month. Fair housing issues are everywhere! Housing providers deal with fair housing issues during the application process, while addressing repair requests, and in the context of enforcing rules or asking residents to leave.

The most prevalent type of fair housing complaint is related to disability. A significant portion of disability-related complaints pertain to requests for reasonable accommodations under the Fair Housing Act.

The Act makes it unlawful for any person to refuse to make reasonable accommodations in rules, policies, practices or services, when such accommodations may be necessary to afford persons with disabilities equal opportunity to use and enjoy a dwelling. In response to a request for a reasonable accommodation, a housing provider may request reliable disability-related information that shows the relationship between the person’s disability and the need for the requested accommodation.

Question: Does a request that is primarily related to seeking an economic accommodation qualify as a proper request for a reasonable accommodation under the Act?

On February 28, 2022, the United State’s District Court for the Northern District of New York in a case styled CNY Fair Housing Inc. et. al v. Welltower Inc., et. al analyzed this

issue and shed some light on how a court views requests that are primarily related to minimizing an economic burden as opposed the effects of a disability.

Complaint

Hopefully this helps you evaluate particular situations you might have in connection with the operations of your property. All requests should be taken seriously and properly addressed to minimize any potential issue under the Act.

The CNY Fair Housing case focused on the issues of whether a proper claim is made under the Act when: (i) a disabled resident seeks a waiver of a fee for an assigned parking space; and (ii) a disabled resident seeks the waiver of a surcharge for a first-floor unit when the surcharge is imposed for features that are necessary to accommodate the resident’s disability.

Parking

The elderly residents with obvious and apparent disabilities requested a reserved parking space close to the main entrance of the building to access their apartments without significant difficulty. They were told that the owner does not provide designated parking spaces because there were too many residents with disabilities and not enough spaces available. However, the manager advised the residents that they can be provided with an assigned parking space for a $350 fee. The requesting residents could not afford a $350 fee, so they were not provided with a designated parking space.

Surcharge for first-floor unit

An elderly resident had been on a waiting list for almost a year for a first-floor apartment which would accommodate her disabilities. After she moved in, she was informed for the first time that her rent was $15 more than similar units because her unit was in a “prime location” on the first floor and close to the elevator and the front door. A housing advocate sent a letter to the owner on the resident’s behalf and another resident requesting that the rent surcharge for the first-floor unit be waived because it was imposed for features that were necessary accommodations for her disabilities. The owner’s policy did not change and the residents continued to pay a rent “surcharge” for their unit.

In response to the fair housing complaint, the owners argued that the challenges to their dynamic rental pricing policy for firstfloor units and units located near an elevator should be dismissed because landlords need not provide economic accommodations to remedy a resident’s economic status.

The housing advocates responded that courts have recognized that the Act’s reasonable accommodations provisions may require exceptions to a policy even where the disability-related impact of the policy is financial in nature.

Court’s analysis

The court stated that to state a claim for failure to make reasonable accommodations, a party must establish, among other things, that an accommodation is necessary to afford the handicapped person an equal opportunity to use and enjoy a dwelling.

The court considered several examples from other cases:

1. Salute v. Stratford Greens Garden Apartments (NY, 1998). Disabled residents argued that the Act required the landlord, who did not, with the exception of preexisting tenants, participate in the Section 8 program, to accept their Section 8 housing certificates in order to accommodate their disabilities. The court rejected this argument explaining that the landlord’s participation in the Section 8 program is not an accommodation within the meaning of the Act. The court noted that ordinarily the “duty to accommodate is shaped by the handicap” because “it is the handicap that is accommodated.” The court found that the plaintiffs were not seeking “an accommodation that meets and fits their particular handicap,” but rather were seeking to use the Act “to remedy economic discrimination of a kind that is practiced without regard to handicap.” The court concluded that “economic discrimination” – such as the refusal to accept Section 8 tenants – is not cognizable as a failure to make reasonable accommodations.

2. Bentley v. Peace & Quiet Realty 2 LLC (NY, 2005). A cancer patient, who lived on the top floor of a four-story walk-up and had trouble

climbing stairs, sought, as an accommodation, to rent a vacant firstfloor apartment at her current rental rate with a waiver of the 20% rent increase permitted under rent stabilization laws. The court noted that this was an accommodation that “directly relate[d] to her handicap, specifically her inability to walk up and down the stairs to her apartment unit.” The court found that the plaintiff was seeking “an accommodation for her disability without being forced to assume addition rental expenses” and that this was exactly the type of accommodation that falls within the purview of the Act.

3. Martinez v. Lexington Gardens Assocs. (NY, 2018). A disabled resident requested that a family member live with the resident to assist the resident with her care. That court stated that the case was distinguishable from the so-called economic accommodation cases, which hold that an accommodation is not necessary to afford a disabled person access to equal housing opportunities when the accommodation sought does not directly ameliorate an effect of the disability.

4. Hubbard v. Samson Management. Corp. (NY, 1998). A disabled resident requested a waiver of a fee for a reserved parking space close to her building as a reasonable accommodation. The court reasoned that “if the paucity of available unreserved parking near her apartment meant that the resident, due to her handicap, experienced greater discomfort and difficulty than other tenants in going to and from her car, the landlord should have accommodated her disability by providing her, without charge, a parking space close to her building.”

5. Samuelson v. Mid-Atlantic Realty Co. (Delaware, 1996). A disabled resident claimed that his landlord unreasonably assessed rent and late charges after he was forced to terminate his lease early due to his / See Law, Page 69

SHOTS FIRED!

A resident disputes charges, a notice to vacate and eviction following an altercation outside of her unit.

A RESIDENT FILED a complaint with HAA disputing charges and to have an eviction removed from her credit report, her security deposit returned to her and to have her housing voucher reinstated. The resident claimed to have only received a Notice to Vacate via email and requested documentation to prove a correct notice was served to her.

HAA reached out to the apartment property and passed along the information and that response was forwarded to the resident. Enclosed in the management’s response were copies of the lease, application, move in condition form, final account statement, resident ledger and photos. Management also included a photo of the eviction notice that was dated and posted on the outside of the resident’s unit door.

The 30-Day Notice to Vacate was posted on

the door of the unit due to one of the resident’s guests discharging a weapon outside of the unit. Authorities were made aware of this, and a report was filed. After the company spoke to their attorney, they decided that a Notice to Vacate was necessary for the resident. The resident’s deposit would also be held to cover August pro-rated rent, damages, cleaning and legal fees.

The case was heard during a Resident Relations Committee meeting where the committee decided in favor of management with no adjustments. The charges were justified with proper documentation from the management company. The resident owes the property $1,182.50 and the management company does not have the authority to reinstate the residents housing voucher and cannot meet her request.

After the adjustments were made and the other charges were justified, the resident owes the property $4,122.36.

The HAA Resident Relations Committees provide an impartial review of resident complaints using the documentation provided by both the resident and management. When the committee finds in favor of the resident, we appreciate a direct response from the property to the resident within two weeks and a copy of the payment sent to HAA for our records. When the committee finds in favor of the resident, management may file an appeal. When the committee finds in favor of the property owner, the decision is final.

Delegation Tactics for the Control Freak

Have you ever thought or even said out loud; “I might as well do it myself, it will take too much time or effort to show them how”?

More than likely, you have a team around you that is fully capable of getting things done, but instead of delegating, you steal those opportunities from them. If you resemble this remark, there is a better way.

Delegating tasks is not the easy way out for today, it is the longer way to productivity. It is an “investment” in tomorrow, and it is the only way, to real, sustainable growth and progress within any team.

Lacking real delegation skills will lead to being perceived as a micromanager. A micromanager is someone that ensures that they see, do, and are involved with everything. It is hard for a micromanager to let others share the load or the glory.

Micro-Managing is the quickest way to being seen as a control freak!

Maybe at this point you are thinking; “I have tried delegating in the past.” Perhaps the quality or the speed of the work was not good enough and you ended up redoing everything. There is no sense in delegating tasks if you know you will end up redoing them, right? This is categorically WRONG!

The top three excuses you may be embracing for not delegating:

1. You know that you will do the task better yourself.

2. There is not enough time to teach someone else how to accomplish the task.

3. You expect that you will have to redo whatever is done as no one is as good as you. If you are making excuses like these, perhaps it is time to re-evaluate how you are thinking and your vantage point.

Consider employing these thoughts about delegation:

1. Acknowledge the truth. If you feel you are better at accomplishing the task, embrace these thoughts:

• Other people may not accomplish the task in the same way that you would, but that does not mean that what they will do is inadequate. Different is not wrong.

• The people on your team are likely eager to do a great job and all that they need is encouragement, what is discouraging is for you to take over.

2. Train your Team. Your team is always in need of additional training. This is not a valid reason to control and do everything yourself.

• Embrace the truth that training is the only way to be better prepared for the future. If you take the time to develop your team now, they will be better prepared for the next task.

• Short-term training now will provide a huge pay off later.

3. Breathe and Relax. Burdensome stress is the result of applying pressure to always be perfect. While perfection is great, it is usually not the expectation. Progress is a reasonable expectation.

•Take a break. It simply is not possible for you to do everything on your own, nor should you try to be all things to all people.

• Others can do the work, even if you do not think they will do it as well as you will.

4. Embrace a successful plan. If you are the lead of the team and certain tasks are critical for the success of the project, you may need to be involved with higher-level tasks. However, the lower-level or lesser risk tasks should be passed along to other people on the team.

• Delegate the result of the task. Do not demand how it is to be completed.

• Grant the Authority Necessary. You cannot expect someone to accomplish something that is not within their authority. Empower them for success.

• Demand Accountability. If you have properly delegated the task and empowered them, then it is reasonable for them to accept the responsibility.

• Assign tasks based on strengths and abilities. Consideration of training, abilities, aptitudes, and overall strengths should be a consideration when deciding what and to whom a task should be assigned.

• Monitor their progress without seizing control. It is reasonable, at specified intervals over the course of the project, to meet for progress updates.

• Provide support and do not jockey for control. If they are encountering obstacles or challenges, provide support and resources to help them achieve success.

• Expect success. Do not project failure, in turn expect success. Remember people usually live up to their expectations, so expect nothing less than success.

• Be grateful and give praise. When the project is finished, celebrate. People that receive praise about what they are doing right will do more things right. The opposite is true as well. Find the things that went well and focus on producing more of that.

The 6 “W’s” of Successful Delegation

1. Who: First, determine if your team members are ready and willing to accept additional tasks. Who has the proper skills, aptitude, training, and attitude?

2. What: Is this task delegable? Some tasks are not appropriate to delegate. There is a fine line between delegating tasks, and “dumping”

workloads. Know the difference. Be certain that the authority required to succeed is also delegable. Someone cannot be expected to succeed with a task that they do not have the authority to complete.

3. When: Timelines and deadlines are critical with assigning tasks. Be careful to avoid tasks that are passed along with an expectation of “when you find time” or “when you get around to it.” Delegated tasks should be important and therefore should have priority and time constraints.

4. Why: The recipient of a delegated task needs to understand the importance of the task and why they have been chosen for the “opportunity.” Is this additional task going to prepare them for the next step in their career? Is it going to make them more successful in their current role? What was the thought process that led to them being chosen?

5. Where: When delegating a task, the delegate should know the boundaries that exist. Have clear and concise markers along their path to success so that they stay within the lines and are aware of all the rules of engagement.

6. Wow: This is the final rule of successful designation. Be a motivational cheerleader all along the way. Take note: that this is not the expected interrogative word “HOW.” Fight the urge to tell them how to complete the task. When you engage in telling or instructing them how, you are walking the fine line of micro-managing. “WOW” is substituted here to remind you that you need to celebrate the successes along the way as well as at the successful completion of the overall task.

Replace being a control freak on your next project. You can decide now, to let go of some of the responsibility and embrace the opportunity to support the growth of others. By default, you will be supporting your own growth. Encouraging others to be able to “rise to the occasion,” will make it easier for you to create your own succession plan and make it easier for you to succeed. A great leader finds ways to use and expand the talents within their teams. It is guaranteed that when you work with your team and delegate tasks, your job will become easier. You will be able to take time off and you will have less stress. On the flip side your team will find a better atmosphere at work, and they will be more engaged in their own jobs and will be your partner, not simply your subordinate.

Law, continued from Page 12 mental health condition. The court stated that the resident had a claim for relief under the Act, noting that, “it is clear that generally applicable fees can interfere with the use and enjoyment of housing by the handicap.”

6. Marks v. Management Co., Inc. (NY, 2002). A resident, with an AIDS-related medical condition, sought leave to allow a roommate to reside in her apartment while she was away from home. The court found that the resident’s request had “everything to do with the resident’s pocketbook” and was not “necessary in any way to assist her in dealing with her AIDS-related medical condition, or even that it mitigated in any way the difficulties associated with her illness.”

7. Hevner v. Village East Towers, Inc. (NY, 2011). A disabled resident requested reduced maintenance fees, waiver of arrears, and “skewed rent” because of “the financial strain her depression causes.” That court found that these requests would only “remedy her economic status” and not “provide her with reasonable accommodations” which was insufficient to state a claim under the Act.

Conclusion

The court in the CNY Fair Housing case did not find that the requested relief is not cognizable under the Act as a so-called economic accommodation and declined to dismiss the claims brought on the residents’ behalf.

What can we learn?

The CNY Fair Housing case provides insight into how a court looks at certain requests for accommodation. While a purely “economic accommodation” is not recognized as a reasonable accommodation under the Act, each case will be decided on its own merits. The examples provided by the court can be compared to the reallife situations you might run into. You can then determine how a court might analyze your particular case.

Hopefully this helps you evaluate particular situations you might have in connection with the operations of your property. All requests should be taken seriously and properly addressed to minimize any potential issue under the Act.
