By Svetlana Marshall ON Friday, the Court of Appeal will determine whether the No-Confidence Motion against the Government was validly passed, Acting Chancellor of the Judiciary, Yonette Cummings-Edwards announced on Wednesday.

The chancellor made the announcement at the conclusion of more than six hours of legal arguments on the validity of the vote cast by expelled Member of Parliament Charrandass Persaud when the No-Confidence Motion was put to a vote in the National Assembly on December 21, 2018. The oral arguments were heard in the appeal case of Compton Reid v The Speaker of the National Assembly, Charrandass Persaud, the Attorney General and Leader of the Opposition – the third of three constitutional cases.

Making the disclosure in the presence of Justices of Appeal Dawn Gregory and Rishi Persaud in the Court of Appeal, the Chancellor stated that decisions will be handed down in all three cases – the Attorney General v Christopher Ram and The Leader of the Opposition; The Attorney General v Speaker of the National Assembly, Leader of the Opposition and Joseph Harmon; and Compton Reid v The Speaker of the National Assembly, Charrandass Persaud, the Attorney General and Leader of the Opposition.

The full bench will commence its ruling on Friday from 15:00hrs in the Court of Appeal. Upon hearing the announcement, Senior Counsel Neil Boston, one of the legal counsel representing Compton Reid, asked the full bench to consider granting a Stay of Execution to freeze the decision of the High Court until the ruling but Justice Persaud indicated it was not necessary as he alluded to Section 40 of the Interpretation and General Clauses Act. According to Section 40 (a) of the Interpretation and General Clauses Act, “in a law prescribing a period of days within which an act is to be or may be done, a period of days from TURN TO PAGE

the occurrence of an event shall be reckoned exclusively of the day on which the event occurs.”

Section 40 (c) also states that “where the day or the last day on which any act or proceeding is directed or allowed to be done or taken is a public holiday, the act or proceeding shall be considered as done or taken in due time if it is done or taken on the next day following not being a public holiday.”

Outside the courtroom, the attorneys in the three cases offered their interpretation based on Justice Persaud’s pronouncement.

“Based on what is called dies non, that is none days, in anytime span the 90 days would not expire before the decision. In other words, on Friday, the 90 days would not have expired…so there is no crisis,” Legal Counsel Robert Corbin explained. Corbin is representing Reid in association with Senior Counsel Rex McKay and Neil Boston.

With the decisions in the three cases set for Friday, there is no need for the court to proceed with hearing of arguments for the Conservatory Order and Stay of Execution which were applied for Reid and the Attorney General.

Those arguments were expected to commence on Friday at 11:30hrs but have now been cancelled.

Weighing in on the issue, Boston said there is no need to proceed with the arguments because the timeline expires on Friday. “You start to count 90 days after the 21st (December, 2018) and under the Interpretation and General Clauses Act it is quite clear that Thursday is a non-dies, so Thursday would not be counted as part of the 90. Thursday is out. Today (Wednesday) is 89, tomorrow is out, and the 90 days will be on Friday,” he explained. He said contrary to notions peddled by some, there will be no constitutional crisis. “The sky will not fall tomorrow,” Senior Counsel Boston said.

Friday’s ruling can either see the No-Confidence Motion being overturned or upheld.

If the panel of judges upholds Chief Justice Roxane George’s decision that the No-Confidence Motion was validly passed in the National Assembly as declared by the Speaker, Dr. Barton Scotland, the Appellate Court has the power to extend the timeframe for the holding of General and Regional Elections in the absence of an extension by a two-third majority of all elected members of the National Assembly.

ing legal minds has said that the court, in keeping with the doctrine of necessity, has the powers to grant an extension to the constitutional deadline.

According to him, “like it or not, the court is in the driving seat” and will determine the way forward – it has the powers to do so. “The court will determine what happens if the time runs out or is about to run out. It will make that determination. No other organ in the state is capable of so doing,” he explained. Given the circumstances, the legal luminary said the court could depend on the doctrine of necessity, and grant an extension.

“If it so happens that the court is in the process of resolving an issue or enquiring into an issue, and the time stipulated in the Constitution has been overshot, then the court could rely on the doctrine of necessity and give such extensions as are required in the circumstances,” he further explained.

President David Granger said he will be guided by the Court of Appeal and GECOM, in his latest address to the nation. “I rely on the Commission’s readiness, the provision of funds and the expansion of time to conduct credible elections by the National Assembly. I rely on the outcome of legal challenges by the Court of Appeal. I rely, also, on public confidence in the institutions responsible for executing these processes. They demand political cooperation, not confrontation,” the President said.

The Guyana Elections Commission (GECOM) said it needs approximately eight months to prepare for elections. The ‘perceived’ passage of the No-Confidence Motion has triggered the need for early elections, but Government has challenged it on several grounds. The Attorney General Basil Williams and a battery of lawyers, in a series of convincing arguments, submitted that the Opposition did not secure an absolute majority as required by Article 106 (6) and (7) of the Constitution for a motion to be effectively passed. Reid, a farmer from Berbice, has challenged the validity of the motion on the ground that Charrandass Persaud breached the Constitution when he failed to inform the Speaker of the National Assembly that he had intention of voting against the list he was extracted from. Charrandass Persaud presence in the National Assembly was also in breach of the Constitution on the basis that he has dual citizenship.

Harmon met with the residents to speak to their concerns in the present situation. Firmly putting away the current rhetoric, the Minister of State affirmed that there is no impending constitutional crisis in Guyana. “There is no crisis. A Chinese philosopher once said that ‘where some people see crisis, others see opportunity’. I believe we have an opportunity now based on what has happened in the National Assembly to have a fresh look at the way in which we work together to develop our country,” Harmon said.

He reminded that the Constitution provides that there will always be a President and government in place and irrespective of what takes place, there will not be a “gap” in government. The Minister of State noted that it is important that Guyanese, as right-thinking citizens, are able to differentiate the truth from propaganda.

He highlighted that this propaganda is primarily being peddled by the Opposition and its leader, Bharrat Jagdeo, who, with his eyes set on the oil production in 2020, is now in such a desperate position that he has begun to “construct” an impression of a crisis in Guyana.

I’ve never seen someone so intense, that wants power so badly that he is prepared to sink to the lowest depths of ingratitude, the lowest depths of coarse behavior, the lowest depths of language that is not consistent with a Guyanese community that seeks for peace and harmony.”

HE IS RUNNING CRAZY Harmon then put into perspective the Opposition Leader’s crass remarks at the Babu Jaan, East Berbice-Corentyne stage, meant to pay homage to late President Dr. Cheddi Jagan, where he called on supporters to “chase” members of the government. “He’s running crazy and this is all because of what is happening offshore,” Harmon said.

“I was listening to the speech and I don’t believe how many times he called Dr. Jagan’s name in that speech, but he went on ranting and raving that the people there must ...chase out the government. What kind of behaviour is this?”

However, the Minister of State highlighted that Jagdeo’s aggressive behaviour

The minister was keen to add, however, that despite the current negative rhetoric, the present government represents “stability” and “order” and will never support or call on citizens to engage in unmannerly or illegal behaviour.

CREATING DIVISION “We should not be cowed by language that seeks to evoke unnecessary ire and emotions of people. It is unnecessary and we believe it is intended to create division among our people,” Harmon said.

During his speech, Harmon also expressed his gratitude for the opportunity to meet with residents in the community and to be brought up to date with the issues affecting them.

“There are many issues which were raised, some of them which we can deal with immediately and others will take a little longer, but be assured that all of the matters which you raised will be dealt with,” he said. At the meeting, it was announced that come next Wednesday, a number of ministers of government will be making themselves available to the public on a one-on-one basis at the Square of the Revolution.

The voters list must be sanitised

THE ruling coalition is ready for an election whenever the Guyana Elections Commission (GECOM) sees it fit, said Social Protection Minister and General Secretary of the People’s National Congress Reform (PNCR) Amna Ally.

As part of an effort to keep supporters confident, the minister, along with Director of Sport, Christopher Jones and other party leaders, conducted a walkabout in Constituency Eight before hosting a meeting at the St. Thomas Moore Primary School on Wednesday.

In an effort to allay fears, the minister and her colleagues urged supporters of the coalition to remain resolute and confident that everything will be sorted out.

The officials sought to bring clarity to a situation of uncertainty which was created after the passage of a no-confidence motion against the government on December 21, 2018, in the National Assembly.

Following the passage of the motion, it was mentioned

that General and Regional Elections were due in 90 days.

Government, however, challenged the validity of the no-confidence vote in the High Court and subsequently appealed the matter after it was ruled that the vote was valid.

Jones also told supporters that house-to-house registration is the best way forward, especially with a glaring need to sanitise the list.

“We are confident that we will alleviate the fear... people get the impression that after tomorrow, March 22, is the beginning of the apocalypse,” he said, adding

Carter Center floats August for polls

…urges use of National Registration Act to sanitise voters’ list

In addition, the date put forward by the Carter Center representatives is also beyond the March 21, 2019 and April 30, 2019 deadline currently being lobbied for by the opposition.

According to the Act: “The commission shall, in so far as practicable, as- certain to its satisfaction whether a change in the residence or domicile of every person named in each report as aforesaid has taken place and, in the event of a change in that person’s residence being so ascertained, his new residential address, and the commissioner, when satisfied that is requisite so to do, shall cause the person’s registration to be cancelled under regulation 38(1)(e), or to be altered as if a claim had been made on that behalf under regulation14(1), as the circumstances permit.”

provisions within the National Registration Act, the Commissioner agreed that the suggestion is a viable option for clearing the list of non-residents. “There is a mechanism by which the list could be cleansed of persons who are resident overseas.

Not interfering with their constitutional right because the same regulation would permit them – if they wanted to be involved in the elections--- to be home at the time of Claims and Objections and to make a claim to go back on the list,” he explained.

“This has surfaced and what the Carter Center has sought to do is to see how they can work around this to come up with a compromise.

Their compromise does not fit neatly into what the law provides for, but they’re suggesting that a list of non-resident people could be generated and could be used on elections day to determine whether anybody came to vote for them.”

Asked his thoughts on the suggestion, the commissioner said that he and his colleagues remain open to the possibility but, at the moment, are still of the belief that house-to-house registration is the best option.

He commented: “So far it is house-to-house [registration] that, for me, will meet the requirement and that takes us to November; but I am not unprepared to explore the possibility of using the law that already exists. But, it would need some regulations for it to be operationalised.”

Alexander added that at

minimum it would require subsidiary legislation.

Meanwhile, opposition-nominated Commissioner Sase Gunraj told the media that the suggestion presented by the Carter Center was aimed at “brokering the gulf” existing between the two positions on the commission.”

He stated that the commission will now have to “consider” the proposal, but then added that resolution of the matter remains with the President and leader of the opposition.

“This uncharted territory has to be navigated by the leaders…those proposals will be considered by the commission and hopefully, the gulf that exists between the positions on the commission can be bridged in short order,” Gunraj said.

Meanwhile, Jason Carter also spoke briefly with the media, stating: “We observed a very productive meeting.

There was a genuine exchange of ideas; there was a lot of political desire to reach a solution. I think, ultimately, our role here of course is limited. We’re not Guyanese; we care about this country; the Carter Center has been here for many, many years, almost 30 years. This country is important to my grandfather; it’s important to me and my family as well but, ultimately, the issues that are being confronted right now are going to require the cooperation of the political leadership of this country and we are optimistic.”

Through the Carter Center, former United States (US) President, Jimmy Carter, had led the first mission to Guyana with the aim of encouraging sustainable development and developing democratic institutions.

This is the second time that representatives of the Carter Center have approached the commission

since the fallout that ensued over the no-confidence motion. Prior to their visit, on Tuesday, GECOM Chairman (Ret’d) James Patterson had informed President David Granger that General and Regional elections can be held by late November 2019, following completion of house-to-house registration.

HAPPY PHAGWAH!

P

HAGWAH, one of the most joyous and people-oriented festivals, is being celebrated countrywide today. Like Christmas, this is a festival to which people look forward since it is underpinned by serious and universal moral precepts and welcomes and involves people of every race, class, culture and creed in its celebrations.

Phagwah first came to Guyana with the 19th-century Indian indentured immigrants nearly two centuries ago and though it was not a public holiday, the sugar industry, the largest employer of labour in the colony, gave their workers a holiday. Many other businesses closed their doors on that day; it was only the banks and some government offices which kept open, but their activity was very low-keyed and many of these offices and even the banks closed early.

After Independence, Phagwah was formally declared a public holiday, giving legal status to a festival which was long and widely celebrated. Hindu festivals always have a philosophic and moral basis and at the same time are celebratory. Being very ancient, over the millennia, various traditions became attached to these festivals. In Guyana, the two most common traditions surrounding Phagwah is the story of Prahalad and secondly, being a spring festival.

Spring festivals were celebrated in all the ancient civilizations and cultures and the time of celebration fell in close proximity to each other. They all used the lunar calendar just as Easter does. In ancient Persia, Nov Roz was celebrated and is still a major holiday in the Middle East and in all those countries where Persian civilization had touched. Even Easter, though associated with the most important day in the Christian calendar, is named after the old Teutonic goddess, Eoster, who had a strong connection with Spring. Since spring was a time when the cold of winter had given way to the warm sun of spring and

crops were sown and some reaped, it became a symbol for the renewal of life. It was a time of joy and relaxation and plenty and festivity and this was manifested in all the ancient Spring festivals. Phagwah was the spring festival par excellence and a variety of foods and sweetmeats were prepared on that day and shared with the community.

The other strand of the festival is the religious one: King Hiranya Kasipu was a king in ancient India who was powerful and wealthy and who had a flair for religion. He, therefore, began to practice extreme austerities (tapasya) until he became such a godly man that he was recognized by the gods. He was offered three boons or wishes which he gladly accepted since he would become immortal by them. His three wishes were that he could never be killed or die by either night or day; that he could never die or be killed on the surface of the earth; and the third wish was that he could never be killed by either Man or Animal. All three wishes were granted, but Hiranya Kasipu suddenly became consumed with pride, arrogance and a desire for power since he now realized he was immortal.

The first thing he did was to declare he was God and all his subjects must worship him and he became murderously tyrannical. Anyone who did not worship him was killed and the country lived in fear. If anyone attempted to offer him any advice, whether it was a wise man or priest, he had him immediately killed. Quite unexpectedly, his very small son, Prahalad, publicly declared that his father was not God and he would not worship him but would continue to worship God. The King decided that Prahalad must die a very painful death by being burnt alive. He had a large pyre built and arranged with his sister, Holika, Prahalad’s aunt, to hold Prahalad in her lap as the pyre burnt. Holika had the quality of being incapable of being burned by fire.

Holika and Prahalad sat in the middle of the pyre which was immediately set alight. When the citizens went to

the pyre next day, they found that Holika was burnt to ashes and Prahalad was unharmed, since the power of being unburnable had been transferred to Prahalad when Holika held him in her lap. This event is commemorated each year, usually the evening before Phagwah day, by “the burning of Holika” which could be an effigy or even a wooden pole or tree branches.

Hiranya Kasipu was furiously incensed when he learnt what had happened and went to the largest temple, shouting that he was God. As he strutted about the temple, he took out his sword and violently slashed one of the columns of the temple saying any other God could come and challenge him now. As he did so, a man-lion, Narasingha, suddenly jumped out of the column and attacked Hiranya Kasipu. They fought and struggled until they came to the steps of the temple. On the steps, Narasingha managed to grab the king by the throat, lifted him off the ground and strangled him. At this time it was dusk, that is neither night nor day; the king was strangled in midair off the earth; and Narasingha was neither Man nor Animal. Narasingha was, in reality, an incarnation of God, an Outar, who had come to save mankind from the tyrant.

The country broke out into wild celebration on being freed of the tyrant. The citizens threw abeer (red water) and red powder (abrak) on each other-- red being the celebratory colour-- sang and danced in the streets and feasted.

Phagwah, each year, is regarded as a re-enactment of these celebrations. In Guyana, people of all races, religions, and classes celebrate Phagwah, bringing much joy and good-fellowship to the Society and each year it cultivates greater and greater social cohesion and unity in a practical and enjoyable way.

As we celebrate Phagwah today, we extend our heartiest Phagwah greetings to all. Happy Phagwah!

I am uneasy with Carter Center intervention Dear Editor,

I

note with considerable unhappiness that the government is meeting with President Jimmy Carter and his organisation.

Many of us have pleaded that the principal political leaders must sit and craft an agenda and agreements to address the deep fears and apprehensions of the Afro and Indo communities.

These fears are extant; the result of post slavery divide and rule colonial policy ignited in the mid-1950s by the ‘Apan Jaat’ campaign engineered by a certain group.

As a young activist, I was involved in the pre-1953 struggle for Independence, witnessed the miasmas of the cold war and the determination of our erstwhile masters to control our natural resources and, more particularly, our way of thinking.

When we hoisted the Golden Arrowhead on the morning of Independence Day and our two illustrious patriots, Dr. Cheddi Jagan and Forbes Burnham, embraced each other, our hope for unity and a new day surged. From my vantage point, external forces and other circumstances placed a wedge between the two major groups and, let’s face the

reality, the two political parties.

The thought of the Carter Center continued involvement in our political affairs is an anathema not only to our independence, but an assault on our dignity as a free people whose ancestors experienced horrors and brutality of slavery – the hardships and woes of indentureship. I hope that our leaders on all sides of our political divide would stand up against this intervention which I warned against in 1992. I believe that our ‘friends’ can serve humanity better if they address the crisis in parts of Europe, the hate shootings we saw recently in New Zealand, the Netherlands and the United States.

On the other-hand, citizens of every ethnic, religious and age group should recognize that our problems are not deep-seated and, therefore, capable of resolution. Key members of every section of our society must be the ‘bridge over troubled water.’

I’ve been to every corner, nook and cranny of Guyana, there is no hate but love among all of our people, be they Amerindians, Indo-Guyanese, African, Chinese, Portuguese and that growing group of mixed people. I believe the lingering suspicions can be erased if we are serious by putting an

end to all forms of injustice and corruption which spiralled over the last quarter century. It is no secret I have written and appealed to our two principal leaders proposing a menu of measures, but I believe difficult and tedious as a process will be, it is worth the effort.

Our young leaders, perhaps, lack the emotional experience of the 50s and early 60s and may do well to call upon the likes of Eusi Kwayana, Ashton Chase, Sase Narine and others who lived through that period and can value peace, love and tranquillity.

Certainly, the involvement of a group with roots in the deep south of the United States can hardly contribute to the dreams and aspirations of Guyanese to be one people, one nation, with one destiny. Hope springs eternal in the human breast and this ‘gongo’ approach and threats coming from statements in the Opposition camp will not help us.

Our young people, journalists, our Pastors, our Pandits, [and]Imaams must work fervently towards a peaceful pathway.

Is this the rise and fall of the enigmatic Cameron?

E

ver since Cameron entered the scene as the Cricket West Indies President in 2013, his tenure as President has been plagued with controversies after controversies.

Be that as it may, he has weathered the storm fairly well to still be there but his PR machinery has been unable to erase the pitfalls from his problems. A careful analysis of his tenure is appropriate at this time and will be done under some key headings: Leadership- Cameron burst onto the scene at the pretty tender age of 41 when compared to the other past Presidents, beating Julian Hunte in 2013. Hunte was becoming very unpopular with some of the dubious decisions that he made with his appointment of CEO and Captain coming out of St Lucia coupled with the acrimonious relationships with WIPA and the players caused by the faulty players’ contracts that his team presided over. To some extent Cameron has benefitted from those problems with the ouster of Ramnarine from WIPA and being replaced by the more prudent Wavell Hinds. Tons of CWI money was being squandered away on legal fees and lost lawsuit awards. These funds are now being channeled directly to WIPA for the benefit of the players.

Some may view this reallocation as a payoff or quid pro quo but the war between the Board and the players union now seems to be effectively dead and Cameron has been credited with this improved relationship. Those who were not happy with WIPA have since left the organisation. Cameron was ‘challenged’ twice for the Presidency. Once when Clive Lloyd was nominated by the Guyana board but was unable to secure a seconder and secondly when Joel Garner and Baldath Mohabir challenged him in 2015. After defeating these challengers, he swiftly sidelined these individuals from the mainstream cricket scene by appointing them to various positions subservient to him. Mohabir was evicted from his post as Chairman of the Marketing Committee and replaced

by Cameron himself. He subsequently resigned from the Board. The leadership displayed during the ill-fated India tour would forever blot the Presidency of Cameron. He did manage to avoid a $42m invoice which could never repair the damage done to his leadership irrespective of how he spins it.

CRICKET DEVELOPMENT Cameron can also be credited with the introduction of the PCL which by all standards has been moderately successful.

For one, it has generated far more first class cricket being played annually but we have not yet witnessed a marked

improvement in the standard of play. The concept is good but needs an overhaul. Not all teams have fully embraced the franchise system after five years in existence. Something is sadly lacking with the franchise system. The payment and the supposedly professionalising of the players have been good but the Boards are not getting the best out of the players for one reason or the other. Cameron has run into a stone wall here. After five years, we still do not have a ton of players banging at the selectors’ doors warranting a place on the senior team. Something is desperately wrong with our cricket and player development programmes. WI has been winning a few matches here and there which do not inspire confidence in our abilities going forward on a long term basis. We cannot continue to bury our head in the sand because of our undying love for West Indies cricket. Cameron does not seem to have the answer for this problem.

SELECTION ISSUESGuyana has won the tournament for five straight years and yet cannot get more than a single player permanently into the test team. Granted there have been quite a few dubious selection decisions that have cast serious aspersions on the relationship and control of Cameron over Browne. GCB has had cause to be aggrieved by these actions which has left a bad taste in our collective mouths with the autocratic methods of Cameron. He probably feels that he has a firm hold on the GCB votes through his unholy alliance with another autocrat, Sanasie, in terms of support for his 2019 candidacy and was using the selection of players as his pawn to secure votes from other countries, hence the proliferation of Bajans in the team and the questionable selection of John Campbell recently.

This was clearly a play for the Jamaican votes.

PLAYERS’ RELATIONSHIPS Even though the Board and WIPA have improved their relationship, the players themselves do not trust the Board and Cameron has done very little to heal that situation. Cameron has continued to display an arms-length relationship with the players as he operates similar to a slave master that owns a bunch of slaves. He thinks that he is the master that sits above them all. The Darren Bravo incident is a classic example of his aloofness. Cameron made an incorrect statement about the contract awarded to Bravo and was instantly greeted with an equally ‘idiotic’ knee jerk response from Bravo. Cameron displayed very poor maturity in dealing with this issue. They were both wrong but Bravo’s response resulted from the other’s inaccurate statement. It called for sober and mature leadership which Cameron clearly showed that he lacked re-

A fifth sister mercilessly killed by a stalker who refused to take “No!” Yet another sister was brutally attached by her partner while accompanying a rural constable to serve what is described as “a restraining order”.

Given that everyone is aware of root causes of the problem and the requirements to address it, expounding in front of microphones and cameras should urgently give way to proactive measures to reduce the incidences of gender based violence. Replace talk by solutions NOW!.

Over the years The Caribbean Voice has partnered with over 200 different entities to raise awareness, hosts workshops and outreaches, engage in advocacy and information dissemination and offer counseling and other assistance. During the Sixteen Days of Activism Against Domestic Violence, held annually from November 25th to December 10th, Voices Against Violence, comprising about 50 entities, activists and advocated, focused on speak outs to raise awareness and provide motivation to

victims to find ways out of their victimization. Imagine this process extended nationally across Guyana in an all-encompassing effort. We hope that this year observance of Sixteen Days of Activism Against Domestic Violence, could see this become a reality!

Indeed collaboration is the definitive framework to tackle this plague that is claiming the lives of so many almost on a daily basis. In effect we agree with a recent editorial in a local newspaper that called for, “a multi-sector and cross-ministerial approach” that would result in community level activism to prevent this scourge. Policy makers and leaders are the ones with the capacity and wherewithal to institutionalize this collaboration that everyone continually demand. Government must reach out to NGOS, FBOs, CBOs, activists, advocates and community leaders, across all divides, in a concerted and continuous effort to bring about needed change.

All of this has been repeatedly expressed across various platforms over time.

Meanwhile The Caribbean Voice is extending a hand for collaboration to anyone willing to fight against this rapidly growing epidemic that is taking the lives of our brothers, sisters and children. We are in the process of formulating a plan in collaboration with the Center on

Relationship with Caricom and fans- This has been the most hostile period for all. Leaders from several countries with the exception of Antigua have called for major governance review. Cameron has responded to them that most of the recommendations were implemented but those which were implemented represented minor adjustments to governance. The WI fans have been most loyal to our cricketers and definitely need genuine leaders with a clear vision for WI cricket. Any poll in the Caribbean or worldwide would definitely show dire consequences for Cameron. His abrasive style is not very comforting.

PRESIDENTIAL TERM LIMITS Cameron had promised to institute this provision of a cap on Presidential term limits into the CWI constitution but has since conveniently forgotten about same. Note that his challenger is now proposing a 6 year term limit which I think is just good enough for any decent administrator to make their mark on West Indies cricket and move on. Very few prior Presidents have served for more than 3 consecutive terms. Instead Cameron is promoting the implementation of an Executive Presidency to cement his control and power over West Indies cricket. This smacks totally of the antics of a proven dictator and should not be tolerated.

In summation, it can be easily deciphered that President Cameron has had a full 6 years to execute his mandate and has scored some moderate successes during this period but has presided over a very tumultuous period of cricket in the West Indies. On a scale of 1 to 10, any incumbent seeking re-election should be hovering in the range between 7 and 8.

President Cameron would be hard pressed to be awarded a 5 at best during his 6 years tenure. A high 4 would be most appropriate.

It is not very easy to deliberate on the rationale used by the 6 area boards in reaching their decisions on which candidate ticket to support. I am sure deals and promises will be made by the President who possesses the distinct advantage of incumbency. One surely hopes that, in the end, WEST INDIES CRICKET WINS! By his own acts, Charrandass’ vote was invalidated - Legal teams opposing the No-Confidence Motion argue

CHARRANDASS Persaud’s breach of the Constitution invalidated his vote in the National Assembly, Senior Counsel Neil Boston told the Appellate Court on Wednesday as he called for the No-Confidence Motion against the Government to be quashed.

Boston said not only was Persaud a “usurper” in the House but the expelled Alliance for Change (AFC) Executive failed to declare his intention to vote against the list from which his name was extracted, as required by the Constitution.

Senior Counsel Boston was among lawyers that appeared in the Court before Chancellor of Judiciary, Yonette Cummings Edwards,

and Justices of Appeal, Dawn Gregory and Rishi Persaud in the case Compton Reid v Speaker of the National Assembly, Charrandass Persaud, Attorney General, Leader of the Opposition and Joseph Harmon. The Senior Counsel

is representing the appellant in association with Senior Counsel Rex McKay and Attorney-at-Law Robert Corbin.

During his spirited argument that stretched for approximately two hours, Senior Counsel Boston explained that

Persaud contravened Article 156 (3) of the Constitution when he failed to notify the Speaker of the National Assembly, Dr. Barton Scotland or the List Representative that he had intended to vote against the list from which his name was extracted. Instead of complying with the Constitution, Persaud waited for the “appropriate time” and voted to bring down his own Government, the Senior Counsel said but noted that the vote was of no effect because it cannot override the constitution – the supreme law of the land.

“It was his intention to participate in the proceeding by a back door method,” Boston told the full bench.

He explained that had Persaud informed the Speaker or the Representative of the List that he was no longer in support of the list from which his name was extracted, he would have ceased to be a member, and therefore would not have been in a position to vote.

According to Senior Counsel Boston, Article 156 (3) is intended to prevent Members of Parliament from voting against the lists from which their names were extracted.

“The intention is very clear, a Member of the National Assembly cannot vote against a list from which his name was extracted. This requirement must be complied with as a matter of constitutional law,” he argued. He posited that Members of Parliament either support the lists from which their names were extracted or resign, noting that they are not permitted to cross the floor.

Boston noted that Persaud’s name was among four names listed on the A Partnership for National Unity + Alliance for Change (APNU+AFC) list for the geographical constituency of Region Six, emphasizing that the electors voted for a party and not a candidate in the system of representative democracy.

“Nobody voted for

Charrandass, they voted for the list,” the Senior Counsel posited, while reiterating that Persaud had no authority to vote against the A Partnership for National Unity + Alliance for Change (APNU+AFC) list.

Boston submitted that Article 156 (3) safeguards the system of representative democracy, and, on that basis, Persaud’s vote on the night of December 21, 2018 was invalid.

Reid, through his attorney, also argued that Persaud breached Article 155 of the Constitution which bars Members of Parliament from having dual citizenship. Persaud is a citizen of Canada. Persaud held valid Canadian Passports from the year 1998 to the present date, and was therefore disqualified from being a Member of Parliament. According to Boston, Persaud was a “usurper” in the National Assembly.

In the High Court, Chief Justice Roxane-George Wiltshire ruled that the vote cast

by Persaud was valid even as she confirmed his dual citizen status. However, the Chief Justice indicated that she had no jurisdiction to rule on whether his presence in the National Assembly was illegal, and as such, could not have nullified his nomination as a Candidate for the APNU+AFC. According to her, the application should have been in the form of an elections petition and not a Fixed Date Application but Senior Counsel Boston disagreed.

According to him, judicial activism was absent when the Chief Justice delivered her ruling, and ought to have interpreted the Constitution in a broad and purposive manner.

He maintained that the application was properly placed and did not treat with the vacancy of a seat in the National Assembly, but the unconstitutional acts committed by a member.

He alluded to Article 163 of the Constitution which

gives the High Court and the Court of Appeal, “exclusive jurisdiction” to adjudicate and determine the matters listed in the said Article (1) (a), (b) (i) (ii) and (iv), (c) and (d).

The National Assembly (Validity of Elections) Act Chapter, 1:04 is constitutionally grounded in the said Article 163 (4), which provides for Parliament to make provisions to facilitate the proper discharge by the High Court and the Court of Appeal of their constitutional mandate of “exclusive jurisdiction”.

Sanjeev Datadin, the attorney representing Persaud, told the Court that Article 64 is clear. That Article states that “All questions as to membership of the National Assembly shall be determined by the High Court in accordance with the provisions of Article 163.”

“That provision is unambiguous” he told the Court while arguing that Persaud’s presence in the National Assembly ought to have been challenged by way of an elections petition within the specified timeframe (28 days after an election) but with that time long expired, Reid has no case.

Datadin submitted to the Court that the National Assembly regulates its own procedures and makes its own rules as guaranteed by Article 165, and only allows the High Court to intervene in the case of membership as stipulated

by Article 64.

Like the Chief Justice, Datadin argued that Article 65 (2) saved “the day,” and validated the actions of Persaud notwithstanding his dual citizenship status.

Solicitor General Nigel Hawke, Attorneys-at-Law Mayo Roberson and Roysdale Forde also submitted arguments in favour of the case brought by Reid, while Leader of the Opposition Bharrat Jagdeo’s Attorney Anil Nandlall submitted opposing arguments.

UNITED States Ambassador to Guyana, Sarah Ann-Lynch, on Wednesday, paid a courtesy call on Attorney General and Minister of Legal Affairs, Hon. Basil Williams, SC, MP, at his Carmichael Street office.

SOME 6450 residents of Timehri North and 200 in Hauraruni on the East Bank of Demerara now have access to potable water, with the completion of several Water Supply System Improvement Sub-Projects in the communities.

The projects were undertaken by the Guyana Water Incorporated (GWI) and the Caribbean Development Bank’s Basic Needs Trust Fund (BNTF), an implementing and funding agency under the Ministry of Finance.

The works in both communities were executed by S. Jagmohan Hardware Supplies and Construction services and the systems were officially handed over to the GWI during two separate ceremonies. In the community of Timehri North, the project entailed the installation of PVC transmission mains, flush out points and booster pumps at GWI’s Timeh-

ri Pump Station and was executed at a total cost of GY$43, 012, 200 during the period of September 12, 2017 and May 11, 2018.

No longer are the residents enduring the hardships of walking long distances to access potable water since they are now accessing water even in the top flats of their homes.

Speaking at the handing-over ceremony, Managing Director of GWI, Dr. Richard Van-West Charles told residents that water quality testing was carried out and the water is safe.

The Community Development Council had reached out to the GWI to provide access to potable water and expressed willingness to make contributions towards this end. Dr. Charles commended and expressed gratitude to the council for bringing the matter to the company’s attention and the BNTF for funding the project.

He alluded to the heeding of President David Granger’s call to bring equity between the hinterland and the coastland as he noted the priority areas of ensuring access to potable water at health facilities and schools.

The Managing Director acknowledged that there still existed many communities which lack access to potable water while assuring that the utility company is working assiduously to find the resources to provide this access.

Meanwhile, BNTF Project manager, Mr. Dikedemma Utoh, stressed the importance of water even as he alluded to this year’s World Water Day theme “Leaving no one behind.” In this regard, he pointed out that no resident of Timehri North was left behind with this intervention.

GWI for greatly improving the lives of the residents.

He pointed out that the previous administration had labelled Timehri North as a squatting area and even demolished some of the houses, an act that created emotional trauma of fear and uncertainty. The resident noted that efforts to provide the community with access to potable water served to bring some much-needed healing. Mr. King underscored that the success of the project has removed the everyday rigour of early-morning and late-night fetching of water for domestic use and

elevated storage facility and the installation of transmission lines. This was done between May 2, 2017 and November 22, 2017, at a cost of GY$24,555,877.

Residents of that community also spoke of the difficulties previously faced in walking long distances to fetch water. One such resident was Pastor Keeshan Banwarie who outlined the various methods which were tried over the years for residents to gain access to potable water.

He said that residents also travelled to Timehri to purchase water for drinking but with the intervention, they

continuous supply. Therefore, further analysis will be done and changes made to the system for more optimum results for residents.

He said that GWI, working along with other stakeholders, wants to ensure the water comes as close as possible or into the home.

Under the project, nine residents were also trained in Water, Sanitation and Hygiene. This was done by the BNTF in collaboration with the Environmental Protection Agency (EPA), the Hinterland Electrification Unit of the Ministry of Public Infrastructure and GWI.

Spurious and outrageous

–– gov’t condemns allegations by Opposition Leader GOVERNMENT has rejected what it called “outrageous assertions” by Opposition Leader Bharrat Jagdeo that President David Granger has colluded with GECOM to delay the hosting of General and Regional Elections (GRE) before April 30, 2019.

The government, in a statement, said it wishes to remind Jagdeo that GECOM is an independent, autonomous agency that is responsible for the administration of elections in Guyana. The Constitution of Guyana, at Article 62, provides that “Elections shall be independently supervised by the Election [s] Commission in accordance with the provisions of Article 162.”

Jagdeo, at his press conference earlier Wednesday, accused the head of state of “abdicating” responsibility to proclaim a date for GRE. He said, “You got your minions at GECOM to avoid even starting the preparations for elections; you’re getting them to delay the elections; you’re claiming that you can’t name an elections date until they are ready, in violation of your Constitutional

authority, and the mandate as a President; you’re devolving that to some other body and then you’re coming to claim now necessity.”

The government said it strongly condemns such statements as malicious and dangerous with the intent to impugn the integrity of the President. As the holder of a Constitutional office, the government said Jagdeo ought to be responsible when making public statements, particularly on matters of national importance.

Article 161 A (1) says the Elections Commission shall be responsible for the efficient functioning of the Secretariat of the Commission, which shall comprise the officers and employees of the Commission, and for the appointment of all the staff to the offices thereof, inclusive of all temporary staff, recruited for the purposes of boundary demarcation, registration or persons and elections and shall have the power to remove and exercise disciplinary control over such staff.

Article 161 (B) makes the role of the political parties and their nominees in the

conduct of elections by the Elections Commission clear.

It says that “the role of political parties and their nominees in the conduct of elections by the Elections Commission shall be limited to their participation in determining policy, monitoring the electoral process and the conduct of the election, but does not include active management of the electoral process.

REGISTRATION Moreover, Article 162 (1) of the Constitution speaks to the Commission having functions connected with or relating to the registration of electors or the conduct of elections as are conferred upon it by or under the Constitution, or subject to any Act of Parliament, and to the provisions of the Constitution.

It states: The Commission “shall exercise general direction and supervision over the registration of electors and the administrative conduct of all elections of members of the National Assembly and shall issue such instructions and take such action as appear to it necessary or expedient to

ensure impartiality, fairness and compliance with the provisions of this Constitution or any Act of Parliament on the part of persons exercising powers or performing duties connected with or relating to the matters aforesaid.”

Additionally, President David Granger has repeatedly emphasised that the Government of Guyana will not interfere or intrude in the work of the GECOM. Jagdeo also falsely accused the President of influencing GECOM by using the government-nominated commissioners and the GECOM Chairman to infringe on the independence of the entity.

It should be noted that following the passage of the no-confidence motion in the National Assembly on December 21, 2018, President Granger said government will abide by the constitutional requirements following the motion.

APPEAL The government moved to the High Court and has now engaged the Court of Appeal to appeal the ruling of Chief Justice (Ag) Roxane George.

On January 9, the President met the Opposition Leader and his team at the

Ministry of the Presidency following which a joint communique was issued. As per that communique, issued on January 10, 2019, the parties discussed the passage of the no-confidence motion, and the time-frames prescribed by the two provisions of the Constitution Articles 106 (6) and 106 (7).

President Granger had emphasised that the government is legal and that it must govern without any limitations on its authority.

He stated that there is no provision in the Constitution which imposes limitation on the government to perform its lawful functions.

He also indicated that the government and the Opposition, by agreement in the National Assembly, can enlarge the time beyond the 90 days contemplated by Article 106 (7) of the Constitution.

President Granger reminded that it is lawful for the government to engage the Court to bring clarity to the provisions of Article 106 (6) and 106 (7) of the Constitution. Pending the conclusion of the legal proceedings, Parliament remains functional.

On February 25, the President wrote the GECOM chairman indicating he is prepared to enter consultations

with him and the Commission to ensure credible elections are held in the shortest possible time.

The President then met with the Opposition Leader on March 6, 2019, at the Ministry of the Presidency where a commitment was made to work towards the resolution of the issues raised

by Jagdeo. Jagdeo had called on President Granger to name a date for the GRE. The President, in response, noted that four processes are taking place concurrently; the National Assembly; the Judicial process; the Executive process and GECOM. He reminded that the President, the Executive or any other person cannot interfere in the Commission’s work and that there is no constitutional crisis. Also, President Granger had invited Jagdeo to be part of the meeting with the GECOM, but he declined.

President: Holi is the festival of friendship and fellowship PRESIDENT David Granger has extended best wishes to the people of Guyana on the occasion of the joyous festival of Holi (or Phagwah).

In his message to mark the occasion, President Granger said Holi is a spiritual event that recounts the adversities of Prahalad, his unshakeable faith and his eventual triumph over the forces of destruction. According to him, Holi is also a secular event that signifies rebirth and regeneration. “These are universal themes which are common to all the major religions in Guyana,” the Guyanese leader said.

Holi ? a colourful and vibrant festival ? was introduced into Guyana by the Hindu

migrants who came to work and live here 181 years ago. The festival, with its origins in Hindu and Indian culture, has become national in character and is celebrated across the country, engendering hope and an outpouring of happiness. Holi fosters the spirit of togetherness. It celebrates our shared humanity, without regard to social differences and divisions. It conveys a powerful message of friendship and fellowship.

I encourage Guyanese everywhere to enjoy the festival of Holi and to celebrate the values of social cohesion and national unity by rejecting the forces of division.

Phagwah or Holi, is a festival of Bharat (India) that has its roots in antiquity and celebrates the coming of a new spring season, the dawning of a new year, and the triumph of good over evil. The exuberance of this festival reflects the collective hope of people for progress, prosperity and the concomitant betterment of their lives.

This festival of renewal most likely pre-dated the Sarasvati Valley Civilisation, the world’s first significant civilisation which existed between 5000 BCE and 2600 BCE. Even though the cultural landscape in Bharat had changed from time to time from the introduction of the Negroids followed by the Proto- Australoids , Dravidians, Mongoloids, Caucasians, Persians, Greeks, Shakas, Kushanas, Huns, Arabs, Turks, Afghans, Mu-

ghals and Europeans, the festival of Holi emerged, survived and flourished in Bharat, the world’s first melting pot. Holi was brought to British Guiana by Hindus who arrived here as indentured labourers to work on sugar plantations 180 years ago; it was sustained by the descendants of the majority of approximately 239,000 Bharatiyas who arrived on these shores between 1838 and 1917.

Phagwah was transplanted from a large sub-continent, characterised by the four seasons of spring, summer, autumn and winter, to Guyana, a small South American land of dry and rainy seasons, and even though global warming is creating climatic havoc, the symbolism of Holi must not be lost. The IAC, therefore, calls upon all Guyanese to regard the great festival of Phagwah or Holi, which celebrates life regardless of demography or geography, and always as a focus for a unified nation.

Phagwah offers pertinent lessons for us to improve on weaknesses THE Ethnic Relations Commission (ERC) takes this opportunity to extend to all Guyanese, especially our Hindu brothers and sisters, greetings on the occasion of Phagwah or Holi, a national holiday. Over time, this event has transcended religious boundaries to become a truly and much anticipated national festival. It is one that serves to bring together, Guyanese from all walks of life, as is evident by the sense of fun and frolic that has become its hallmark.

As the occasion is observed, the commission urges that its significance through the pertinent messages be foremost in our minds. Significant is its underlying messages of the triumph of good over evil as exemplified by the story of Prahalad and which continues to be an inspiration for the advancement of humanity.

Characteristic of this joyous occasion is the plethora of colours that mix and engulf the landscape. That not only signifies the advent of spring and the blooming of flowers, but in the context of our dear nation, a demonstration of the vibrant intertwining of our rich diversity that creates that enviable and beautiful kaleidoscope

It is a reflection of what can be achieved from a combination of efforts as we endeavour together for the realisation of our national motto. WILL NOT INTERFERE The following day, the President met with the GECOM officials and following that meeting, the head of state said, “Let me make one thing clear, the government is in no way interfering or intruding in the constitutional role and duty of the Commission. It is for the Commission to advise me that it is ready and I will then proclaim a date. Naturally, I will like to proclaim a date that is sanctioned by the National Assembly and the Constitution, but we have not intruded in the work of the Commission and we are prepared to support the Commission in what it has been doing. It is not for me to overrule the Commission.”

The President has maintained that the Commission is independent and it is not for him to give instructions to the Commission as to when elections are to be held.

“Once the Commission says it is ready, I will announce a date and I hope that date is as early as possible,” he added.

On March 13, 2019, President Granger yet again wrote GECOM demanding the presentation of the ‘work plan’ to him while re-committing the government to doing everything possible to support the conduct of credible elections ‘…in the shortest time possible.’

Two days later, the head of state addressed the nation indicating that he is awaiting word from the Commission as to its ‘work plan’ and financial needs. In his address, the President reiterated the four processes working con-

currently: legislative, judiciary, executive, and GECOM; the need for free, fair and credible elections, the need to ensure there is public trust in the Elections Commission and confidence in its capability to deliver credible and timely elections.

How then can Jagdeo accuse the President of putting the country at risk when he has engaged the Opposition and GECOM even as he awaits the ruling of the Court of Appeal? the Ministry of the Presidency asked in a statement.

“I shall be able to proclaim a date as early as possible for the conduct of General and Regional Elections…The government is committed to supporting the rule of law and respect for civil rights. The government will remain committed,” the head of state said.

DATE Justice Patterson wrote President Granger on Tuesday indicating that the Commission would be in a position to conduct GRE no earlier than late November.

It is mind-boggling how Jagdeo concluded that there was collusion between the President and GECOM to host elections at the end of November 2019, when, based on the outlined sequence of events, President Granger did all that was necessary to engage stakeholders.

It is absolutely absurd that Jagdeo continues to make spurious remarks aimed at confusing the nation. The Government of Guyana calls on Jagdeo to act responsibly and to be truthful when he seeks to inform the populace. (Ministry of the Presidency)

Holi is a unifying event–– City mayor JOYOUS Phagwah greetings to my Hindu brothers and sisters at home and in the diaspora. The significance of this holiday is dual: it celebrates the arrival of spring and the end of winter. Also, it is a very special time in the Hindu calendar of events, where purity of hearts is emphasised. This sacred holiday recalls the trials and triumph of Prahalad and signifies the victory of good over evil.

Holi is a unifying event that brings people together from all ethnicities, religious persuasions and political affiliations. It is heartening to see people pour on each other water and Abeer. This in itself is an example of how we can extend unity in

other spheres of our social interactions.

The unity demonstrated during this period of celebrations reinforces the fact that social cohesion is necessary if our nation’s motto, One people, One nation, and One destiny is to be truly realised. Moreover, it fosters community spirit, removes those barriers that divide us as a people and showcases the uniqueness of our cultural diversity. I urge us, to allow unity to prevail regardless of our culture, colour or race.

Remember, in unity there is strength, as we celebrate let us pray for peace and embrace unity.

New organisation to represent Guyana’s youth population

MOVE ON GUYANA, a new national youth movement seeking to ensure youth parity in governance, has already been consulting with hundreds of youths across Guyana regarding policies to empower the youth population.

While all of the legal work has already been done to formalise the organisation, an official launching ceremony is expected to be held within a matter of days.

In keeping with its mission, the movement is seeking to inspire and mobilise youths in Guyana to participate in the country’s governance and

development. For one thing, it will be looking to educate youths about the “power and invincibility of the vote” and to ensure that each eligible youth voter is registered.

The movement has said that it will also be seeking to design and operationalize an unprecedented ‘Get Out The Vote Operation’ (GOTV) for the next elections and work at ensuring that qualified, talented young people are permanently integrated into every sphere of leadership in society.

With 54 percent of Guyana’s population being below the age of 40 and the median

age being 26, the movement said it has been observed that generations of young people are absent from the nation’s governance. “MOVE ON GUYANA intends to change this reality by ensuring youth parity in governance of our society. We have consulted with hundreds of young people all across Guyana about policies to empower the youth population and move Guyana forward,” a statement from the movement has said.

MOVE ON GUYANA promises to advocate for better opportunities for young people in business and private enterprises, and to facilitate

education, empowerment and leadership training. “We will promote and facilitate youth representation at levels of national decision making in

First vice president of the club, Simone Buckles, in her welcoming address, told the visiting students to engage and ask as many questions as possible, since it is her belief that there is no stupid question in the process of learning.

Farmer remanded for alleged attempted murder FAZAL Oosman, 39, of Lot 1 Hand-en-Veldt, Mahaica, East Coast Demerara, was, on Wednesday, charged with attempt to commit murder. He was remanded to prison until May 3, 2019.

The farmer is alleged to have committed the act on his reputed wife on February 24, 2019, at the above

…Police Force renamed Guyana Police Service THE Guyana Police Force has been renamed the Guyana Police Service, a statement from the Ministry of Public Security said on Wednesday.

The name change was proposed within successive police reform recommendations over the years. The ministry said the decision

was taken at the first meeting of the Police Reform Change Board (PRCB) which was convened on Wednesday, under the chairmanship of Minister Khemraj Ramjattan.

According to the ministry, the board agreed that the name of the Guyana Police Force should be changed to the ‘Guyana

Police Service’. At the meeting, the Commissioner of Police, Leslie James, and the complete Executive Leadership Team of the Police were present, along with Dr Clement Henry, Project Manager of the Citizen Security Strengthening Programme (CSSP).

UK Security Adviser to the President, Colonel Russell Combe.

Meanwhile, the PRCB came about from the reform work conducted under a CSSP consultancy by well-respected international expert consultants with many years of experience working with the Guyana Police Force, who proposed the need for a ministry forum for managing police reform.

The main agenda item at the PRCB meeting was to agree to the proposed Terms of Reference for the Board.

Such included providing strategic direction, monitoring, guidance and support to the police in order to implement the reform programme. The PRCB will also review the progress being made by the Police with the various reform activities under way. It will also have oversight of all the strands of Police reform activities, which can then be coordinated, measured and evaluated.

The release noted that a number of reports and consultancies have been delivered to the Guyana Police

Force. These all contain important recommendations.

It is the prioritising of these reforms and the implementation thereof that are the main functions of the PRCB. According to the release this is not the start of reform, noting that the process has been on-going for some time by the police themselves, the CSSP and the work by the UK Security Adviser as well as the locally initiated reform coming out of the GPF.

ON Tuesday, March 19, 2019, Commissioner of Police, Leslie James, conducted a historic engagement where his four deputies obtained their Instruments of Appointment as Deputy Commissioners.

During the ceremony, each Deputy took the statutory Oath of Office, as is required under Section 14 of the Police Act Chapter 16:01.

Despite the late handing over of the Instruments, the appointments are in keeping with the period of 2018 when the Force’s new administrative team was installed, the police force said in a release.

The four deputy Commissioners are: Maxine Graham, DSM, ‘Operations; Nigel

Hoppie, DSM, head of Special Branch/Intelligence; Paul Williams (Administration) and Lyndon Alves (Crime Chief) President David Granger, on appointing the deputy commissioners, had said that they will be responsible for four areas of the Force; these are Operations, Administration, Law Enforcement and Special Branch/ Intelligence. “My intention is that the four deputies will be responsible for various aspects of the Police Force, for example, Operations, Administration, Law Enforcement and Special Branch or Intelligence.

What we have done today is we have not only appointed

a Police Commissioner but we have also improved the architecture of the Police Force so that instead of having a flat structure, we now have clearly defined responsibilities in those four deputy commissioners.

So, things will be better. I am sure there will be better performance in those areas and other officers can now look forward to, in due course, filling those appointments. It will help to enhance the specialisation of the Police Force. It will help to spur the career mobility of officers and I am convinced that the efficiency of the Police Force as a whole will be enhanced,” the Head of State had said.

THE Queen’s College Hindu Society ushered in the Hindu festival of colours, Phagwah (or Holi) on Thursday, as it hosted its annual Phagwah show for the diverse school population.

According to the President of the society, Marisha Kissoon, the event is the biggest student- organised activity within the school, attracting all students and staff members into the celebrations of the holiday.

For Hindus, Phagwah has two origin stories: the story of devotion to Lord Vishnu by young Prahalad

and the timeless love story of Lord Krishna and Radha. This year, the society enacted both of these stories, as part of its show. The skits were complemented by an array of dances and musical renditions. Following the show, the students filled the lawns of the college and adorned each other with the colourful powders (and sometimes, unavoidably, water), which, in Hinduism, signifies the change into the season of spring and embracing each other’s diversity.

Trade unionist upbraids Region Ten administration

–– says nursery school sweepers / cleaners being short- changed

By Vanessa Braithwaite VETERAN Trade Unionist Charles Sampson, who is also a regional councillor, upbraided the administration of the Regional Democratic Council (RDC), Region Ten, for not upholding the labour laws as they relate to paying sweepers/ cleaners.

Sweepers/cleaners are expected to be paid the minimum wage, which is stipulated by law to be $64, 200.

The discussion stemmed from a recent report in this publication about nursery school sweepers/cleaners in the region, bemoaning being short-changed and receiving payments for six, instead of eight hours, as stipulated by a circular signed by Education Minister Nicolette Henry.

That document was disseminated to all regional administrations.

While the eight-hour rate allows primary and secondary school cleaners to be paid $49, 000, Sampson said that that was still below the minimum wage and should not be. “I can’t understand why we are paying people below $370, 00 per hour or $64, 200 per month, especially government employees… they are being short-changed.

Minimum wage is a rule that has to be followed, you cannot violate minimum wage and this is government service,” he argued.

Sampson said the cleaners were being robbed and should be reimbursed all monies, once the matter was sorted out. “If we are not paying them people right, we have to give them people their back money, we got to give them people,” he affirmed.

Relative to the specific issue of nursery school sweepers/cleaners in the region being paid for only six hours, Sampson said the matter can be fixed without the bureaucracies put forth by the administration.

Regional Executive Officer (REO) Orrin Gordon stressed that there was a difference in payment because of the six-hour and eighthour work schedules and he had been trying, arduously,

to put systems in place to equate the working hours so all sweepers/cleaners can be paid the same salary. He said he would have engaged several relevant authorities on the matter but the issue had not yet been put to rest.

“It is a conundrum that needs to be sorted out, I want to pay the people, but I did not get a conclusive position when asked for information to move the process along. I have to be guided by instructions,” he said.

Gordon said if he should go ahead and pay the workers the same rates, despite the difference in working hours, it would be a recipe for audit query. He also pointed out that the circular said, ‘not more than eight hours’, which can be taken into context. The REO related that the matter now lies with the headteachers of the nursery schools. “That responsibility is now with the headteachers to make sure the people work eight hours,” he related.

Trade Unionist Sampson said the matter should be sorted out and the sweepers/ cleaners must be compensated properly for their work.

An hourly agreement must be decided upon, soonest, since they were being robbed.

Matters like those, Sampson argued, result in so much industrial issues in the public service system, relative to compensation of workers.

Regional Chairman Renis Morian had ordered the administration to write Minister Henry, stating that the RDC is requesting that all sweepers/ cleaners in Region 10 be paid the minimum wage in Guyana, which is $64, 200.

by Thursday morning and striking workers are to resume duties on Friday, following the signing of Terms of Resumption (ToR), which guide conditions of reinstatement of the 61 workers who were dismissed following strike action on February 15th.

The agreement was signed between the Guyana Bauxite & General Workers Union (GB&GWU) and the Bauxite Company of Guyana Inc. (BCGI). No doubt, the workers who remained in Maple Town, Aroaima, for the five-week period, breathed a sigh of relief after news broke of them being officially reinstated.

Speaking to the Guyana Chronicle, RUSAL employee, Ephraim Velloza, said workers are preparing to galvanize forces to clear the river, as transportation has to be arranged to remove the items, such as barrels, that were used. He related that workers are expected to reconvene on their normal shift system on Friday and anticipate returning to work while awaiting subsequent meetings and additional bargaining with the GB&GWU and BCGI. He said that workers are expressing mixed emotions, since some benefited positively from the strike, but, overall, they are happy that their struggle has paid off. “We want to say thank you to every party that was involved, everyone in the diaspora, we want to say a

big thank you to the government and the union that were working on behalf of us and every citizen who was with us throughout the struggle,” Velloza said.

Elymawell Barkoye, another RUSAL worker said he felt upbeat about the signing of the agreement by RUSAL and the Union, since it demonstrated a forward movement for the workers.

“That is the way forward and I am very happy that both parties could now be able to see eye to eye, let us try to move forward, have a better relationship, and it must not go one way, both parties must strive for a better relationship, since the workers should be the priority,” he said.

Mingo (only name given), another worker at Maple Town, was ecstatic that his means of earning was secured and no longer in limbo. He stressed that if it were not for the government who stood a firm ground and the union, the result would not have been possible. “This fight is not now, it is an almost ten-year fight, and we finally saw the results that we want, not what the government wants or the company wants, but what we want,” he said.

Another worker who did not want to be named said that he wanted the strike to go on a little longer as it was nine years since the workers were fighting for justice.

While the workers were not being paid for the five-week period, he said that it was the first time the company felt tremendous TURN TO PAGE 25 ►

The previous administration, he said, displayed favouritism when dealing with RUSAL’s issue in the past and the workers were never given justice. Many innocent workers were dismissed in the past and the strike sent a strong message that the conditions that caused them to strike in the first place, must never happen again.

“The union has done well and justice has been given out so far but when they go around the bargaining table in another two weeks’ time and RUSAL wants to pussyfoot again, we will block the river again. They have to adhere to rules and laws of the country and the union,” the worker stressed.

In a statement the GB&GWU related that the workers’ struggle, began on 22nd November 2009 and ended with the signing of Terms of Resumption (ToR) which include reinstatement of all 61 dismissed workers and those laid off during the dispute; no victimisation or change of conditions for the reinstated workers; no compensation for time not worked during the dispute; return of the check-off system; and clearing of the Berbice River.

“Both parties have further agreed to recognise the Sovereignty, Constitution and Laws of Guyana and neither shall act in contravention thereof; promised to uphold the spirit and goodwill to which the ToR was negotiated and signed and will do nothing to circumvent same”, the statement stressed.

Another meeting will be held in two weeks which will mark the commencement of negotiations of a new Collective Labour Agreement (CLA). “The parties agreed that in the pursuit of a new CLA and in the Avoidance and Settlement of Disputes the procedure used for dealing with same in the old (former) CLA shall be utilised as an interim measure; and further agreed that all major issues which involve conditions of employment shall be addressed with a view to achieving resolution,” the statement further informed.

As was mentioned by the workers, the GB&GWU stressed that this almost ten-year industrial conflict which commenced during the Bharrat Jagdeo regime, has only been resolved under the coalition government. “Looking back this is a struggle that never should have been. It is a struggle that GB&GWU was bound to come out successful, re-

gardless of how long it went, because the laws were on our side.”

The union also expressed gratitude to the Ministry of Social Protection, more particularly Minister Amna Ally who brought a seriousness and intolerance to the violation of the Laws of Guyana and Guyanese workers; other counterpart unions, the media and everyone, including those in the diaspora, who stood in solidarity with the union and the workers during the trying time. “This was a hard-fought battle and there are miles to go still to ensure that what happened here does not repeat itself, not only with GB&GWU but with any union…”

No confidence in Mohamed Akeel Meanwhile, in analysing the circumstance of their struggle it leaves them to conclude that whereas the Russian managers of BCGI erred, their behaviour and maltreatment of the workers could not have been possible “had our fellow Guyanese not chosen to encourage and participate in the violation of our laws and workers’ rights.” “We must remember that BCGI has in its employ as Labour Adviser, a Guyanese and former Chief Labour Officer Mohamed Akeel, who has more than 25 years of service with the Labour Department. He knows better yet failed to adequately represent the Laws of Guyana protecting the rights of BCGI workers. This brings into question the quality/efficiency of his performance and whether he is best capable of serving the interest of BCGI and the Union in upholding the signed agreement.” “The Union declares today that it has no confidence in Mohamed Akeel. And for as long as he remains in the employ of BCGI his attitude and behaviour toward workers will be placed under the microscope and exposed.

We are convinced that his is the attitude that creates unnecessary conflict, highly suggestive of political and racial overtones.

Guyana can do better and must unite to safeguard our gains as a sovereign nation,” the union emphasised. “GB&GWU commits to upholding its end of the agreement and will not shy away from holding BCGI accountable for same.”

Venezuelan migrants being accommodated at Eve Leary ––additional measures being organised MINISTER of Citizenship, Mr. Winston Felix, has confirmed that a total of 140 Venezuelan migrants arrived in Georgetown Wednesday from Kumaka in the Barima-Waini region (Region One).

The minister informed the media that the migrants were documented, immunised and

taken to the Guyana Police Force’s Headquarters, Eve Leary. Of the total number of migrants, about 70 of them had connections-whether relatives, friends or acquaintances-- in the city, into whose care those persons have since been released.

on the coast, remain at Eve Leary where they are being provided with meals. “We are seeking to source… long-term arrangements for them in terms of accommodation…but so far we are in control of the situation. We have assistance from the UNHCR [United Nations High Commission-

er for Refugees] and IOM [International Organisation for Migration] and we are managing the situation with their support,” Minister Felix said. Additionally, Spanish-speaking Guyanese are on hand to translate what the needs of the Venezuelans are, as well as their concerns to the relevant authorities.

Erwin Bacchus murder trial…

Gov’t pathologist's absence forces adjournment THE trial of Erwin Bacchus, who is charged with murdering Jason De Florimonte, was scheduled to continue before Principal Magistrate Judy Latch man at the Providence Magistrate’s Court, on Wednesday.

However, Government Pathologist Dr. Nehaul Singh, who was scheduled to be cross-examined by defence counsels, Glen Hanoman and Nigel Hughes, failed to appear.

The trial was, therefore, adjourned to April 15, 2019, when Dr. Singh is expected to be present.

Bacchus, 45, a hotel proprietor of 260 Fifth Avenue, Subryanville, was on $1.5M bail after being originally charged with manslaughter. However, the manslaughter charge was upgraded to murder on the advice of the Director of Public

Prosecutions; consequently, Bacchus is now on remand.

According to reports, on August 4, 2018, around 01:00hrs, De Florimonte, who lived in proximity to Bacchus’s hotel, was seen abusing a young woman. Bacchus’s employee, a handyman, intervened and De Florimonte armed himself with a rolling pin and a knife and attacked the handyman, who ran into the compound of the hotel. Bacchus, a licensed firearm holder, drew his firearm and fired two warning shots, but De Florimonte continued to attack the handyman. It was then that Bacchus fired several shots at De Florimonte, causing him to be mortally wounded.

An autopsy conducted on De Florimonte’s remains revealed that he was shot three times about his body.

Belize arrive for historic clash against Guyana

A CONFIDENT Belize national football team arrived at the Cheddi Jagan International Airport yesterday ahead of their March 23 clash against Guyana at the National Track and Field Centre, Leonora in a game with ramifications for both countries.

With a spot at the Gold Cup on the line, the Guyana vs Belize game in the CONCACAF Nations League Qualifier is said to be one of the most important clashes in the two countries’ history, since a win for Golden Jaguars will see them reach the pinnacle of the confederation tournament for the first time, while the visitors are hoping to make a return to the

competition for the first time since 2013 when they made their inaugural appearance.

“We come here to do our job and try to win,” said 33-year-old Woodrow West.

West, a goalkeeper, who competes in Honduras with Club Deportivo Honduras Progreso, opined that “it’s going to be a tough game, but we’re here to win”.

“It’s a complicated game; we’re away from home, we’re on their (Guyana) turf, and we don’t have any much information on them, which makes it a complicated match. So we’ll have to just stick to our game plan,” the Belizean added.

Like Guyana, Belize arrived with several overseas-based players, as West

named the likes of former Montreal Impact forward Michael Salazar and Oxford City defender Mike Atkinson.

Guyana’s first and only outing against Belize was in 2002 in an international friendly in Belize City, where the Golden Jaguars went down 1-3.

H o w e v e r, t h i s t i m e around, West said, the players are ignorant of the composition of the Guyana team.

Nonetheless, they’re here to take their country back to the Gold Cup, with the hope of bettering their 2013 showing when they made an exit in the group stage.

Bacchus Bulls emerge as RG Mining and Samlall 10/10 champions

Bacchus Bulls celebrate after winning yet another title.

BACCHUS Bulls continue to reign supreme with yet another title to complement their vast collection. This time around, they secured the RG Mining and Thakur Samlall-sponsored, 10/10, 4-team tournament which was played on Sunday at the Imam Bacchus ground in Affiance.

The first match saw Bulls comfortably defeating Walton Hall on the strength of an unbeaten half-century from former national Under-15 batsman Wayne Osbourne. Batting first, after winning the toss, Walton Hall made 86-3 from their 10 overs with Suresh Persaud 34 (4x4, 1x6) and Vishwanauth Lall 32 (2x6, 1x4) leading the way.

Off-spinner Wayne Osbourne took 2-12 from his 2 overs then returned to smash an attractive 56 not-out laced with 3 sixes and 2 fours. Former national Under-19 batsman Yogeshwar Lall was also unbeaten at the end on 32 (2x4), as the Bulls reached the target of 89-1 in the 9th over for a 9-wicket triumph.

In the second match, Devonshire Castle inflicted a 10-wicket win against Rising Star who batted first and amassed 87-4 from their 10 overs.

Opener Kurty Jones 35 (5x4, 1x6) and former national Under-19 all-rounder Latchman Rohit 30 (2x4) were the main scorers. Medium pacer Avinash Persaud grabbed 2-10 from his 2 overs. Persaud then returned to score a brisk unbeaten

The final was then contested between Devonshire Castle and Bacchus Bulls who batted first and posted 84 all-out in the 10th over. Former national Under-19 players Parmesh Parsotam 18 and Nathan Persaud 15 reached double figures.

Seam-bowlers Avinash Persaud 3-4 from 2 overs and Dinesh Chattergoon 3-14 from his 2 overs were the wicket-takers.

In pursuit of a seemingly gettable target, Devonshire Castle were strangled by accurate bowling and excellent fielding from the Bulls. The consistent Avinash Persaud’s fluent 31 (4x4) and Basil Persaud’s 23 (3x4) provided some resistance but it was not enough as they were restricted for 70-3 from their 10 overs to lose by 14 runs.

THE Berbice Cricket Board (BCB)-organised Elizabeth Styles Under-21 cricket tournament continued recently in the Ancient County.

Twenty teams are participating in the knockout 50-over tournament, which is being sponsored by US-based cosmetics brand Elizabeth Styles.

Promising players Kevlon Anderson, Adrian Sukhwa and Marvin Prashad each scored centuries for their teams.

Anderson blasted 110 in a well-timed innings as Rose Hall Town Gizmos & Gadgets amassed 349 all out in 48.4 overs versus Bush Lot Rising Star.

He received support from Jonathan Rampersaud (51), Mahendra Gopilall (55) and Nicholas Lawson (23); Latchman Dauna had 2-28 and Nicholas Shivrattan 2-65.

The visitors were then bowled out for 146 in 24.5 overs to lose by 203 runs. Kris Ramnarine (25); Prakash Bharrat (13) and Navindra Prasad (26) were the principal batters as Anderson had 3 for 21 and Kevin Sinclair 3 for 29.

Ashes 2019 shirts to feature players’ names

PLAYERS’ shirts will feature their name and squad number for the first time in 142 years of Test cricket when England host Australia in this summer’s Ashes.

The change comes as part of the International Cricket Council’s (ICC) promotional plans for the new World Test Championship.

The ICC wants to make players more easily identifiable to encourage greater engagement in Test cricket.

Names and numbers have long been used for limited over and domestic cricket.

The only minor change to Test shirts came in 2001 when England introduced a small debut cap number under the Three Lions crest, other teams then following suit.

The world’s top nine sides will take part in the new championships over two years, with the Ashes the first Test series to be included - the top two teams will meet in the final in 2021.

Coloured shirts worn in the 1992 World Cup were the first to feature players’ names, while squad numbers were added for the 1999 tournament.

Names and squad numbers were then added to shirts for the County Championship in 2003.

At least 21 athletes suspected of blood doping - German prosecutor BERLIN, Germany (Reuters) - At least 21 athletes from eight nations across five sports are suspected of blood-doping linked to a German doctor, who was arrested as part of an Austria-Germany doping raid last month, Munich’s state prosecutor Kai Graeber said yesterday.

Five athletes, including two Austrians, were initially arrested on February 27 at the Nordic skiing world championships in the Austrian resort of Seefeld.

The arrests were part of a joint operation with German police targetting a suspected international blood-doping ring believed to have been run out of Germany.

A doctor in the German city of Erfurt was also arrested along with a total of five other suspected accomplices.

Graeber said the doping of the 21 athletes from five sports - three winter and two summer - took place from 2011.

“The timeframe (of doping) is from the end of 2011 to 2019 in Seefeld,” he told a news conference.

“There are three-figure cases of blood being taken out and then being reintro-

duced worldwide in Germany, Austria, Italy, Sweden, Finland, Estonia, Croatia, Slovenia and Hawaii.”

No details on the names of the athletes or their specific sports were made available.

The investigation is ongoing.

Since the arrests, other Austrian athletes have been implicated in blood doping.

Earlier this month cyclist Georg Preidler told police he had attempted doping.

Cross-country skier Johannes Duerr, whose interview with Germany’s ARD television in which he admitted doping triggered the investigation and subsequent raids, was arrested on March 5.

Chennai to host 2019 IPL final on May 12 THE 2019 IPL final will be held at the MA Chidambaram Stadium in Chennai on May 12.

On Tuesday, the BCCI released the schedule for the second half of the IPL - till May 5 - but left out the knockout phase.

However, ESPNcricinfo understands the final will be played on May 12, while the likely dates for the other knockout matches are May 7 (Qualifier 1), May 8 (Eliminator) and May 10 (Qualifier 2). It is also understood that the

BCCI has kept Vizag as a standby venue in case any match has to be shifted due to unforeseen circumstances.

The BCCI had initially released the dates for the knockouts as part of the final schedule, but that was pulled out immediately. It is believed the reason for that was the BCCI wanted to stay flexible with the knockout dates, keeping in mind the IPL will be played during India’s elections, which

will take place across seven phases throughout the country.

With the Central Election Commission imposing certain restrictions in terms of when the matches would have to be played, the BCCI is being cautious about the knockout dates.

In January, the BCCI had released a short initial schedule, restricted to just 17 matches starting from March 23 until April 5. The BCCI had stated that the entire schedule could

not be put out as the dates of India’s elections had not been announced at the time. Recently, the Election Commission of India announced the dates for the general elections, which will begin on April 9, with counting on May 23.

The elections are unlikely to be of any concern to the franchises because the final group schedule allows them to host all their seven home games at their own bases. With the elections

running parallel to the IPL in many of the states where the teams are based, the franchises were initially unsure whether they could play all the home games in their own cities.

FOR the sixth consecutive year, former national cricketer Lennox Cush, through his company Star Party Rentals, will sponsor its 11-race cycling meet at the inner circuit of the National Park on Saturday. It is being organised by National cycling coach and stalwart Hassan Mohamed.

At 09:00hrs the crème de la crème of the country’s cyclists will assemble to do battle in their respective categories.

Last year’s feature 35-lap Schoolboys and Invitational race was captured by Hamzah Eastman in a time of one hour 17 minutes 20 seconds. However this year a new champion will be crowned as Eastman is currently in the

USA racing on that country’s circuit.

Thuran Garbarran was the winner in the BMX Boys and Girls 12-14 years last year while Gerard Barrington copped the BMX Boys 6-9 years event.

John Niles was victorious in the BMX 9-12 event with Adealie Hodge being the top cyclist in the Juveniles category.

In the Veterans Under-50 category, usual suspect Junior Niles will be defending his title while Ian Jackson was last year’s Veterans Over-50 winner.

Cush is expected to assist with the handing-over of prizes at the presentation ceremony.

Pogba says Solskjaer deserves Man Utd job after restoring confidence (REUTERS) - Manchester United interim boss Ole Gunnar Solskjaer has restored the confidence and freedom they lacked towards the end of Jose Mourinho’s tenure and the Norwegian deserves to take over full time, midfielder Paul Pogba has said.

Rose Hall Town Tigers defeated Belvedere United by seven wickets while Ramnarine Memorial cruised past Chesney by nine wickets.

Playing at the Toopoo ground, Belvedere United were bowled out for a meagre 45 runs from 10 overs as left-arm spinner Rondhall Lewis took eight wickets for six runs in a remarkable spell of spin bowling. It is the best-ever bowling figure for any bowler in the entire Ancient County.

Khemraj Mahadeo and skipper Turbhuwan Jagdeo supported with a wicket each. In reply, Rose Hall Town Tigers reached 46 for 3 in seven overs, with Mark Papannah (19) being the principal scorer. L. Bisram (2-2) and T. Khemraj (1-18) were the wicket-takers for Belvedere.

In the other match played, newcomers Ramnarine Memorial defeated Chesney by nine wickets at the Chesney ground. One of the tournament’s favourites managed 98 for 9 in their allotted 100 Balls with former national player Imran Khan top-scoring with 39 while S. Bacchus and S. Khan supported.

Defending champions CSK vs RCB to kick off IPL 2019 THE 2019 IPL will begin with defending champions Chennai Super Kings (CSK) taking on Virat Kohli’s Royal Challengers Bangalore (RCB) at MA Chidambaram Stadium in Chennai on March 23.

The schedule for the first two weeks of the tournament was made public on Tuesday, listing out the first 17 matches, which will take place over two weeks.

In this period, six of the teams will feature in four

games apiece, with Bangalore and Delhi Capitals playing five of their league fixtures, and all teams will have two home fixtures, with only Delhi hosting three games.

Like it was in 2018, IPL has stuck to keeping the double-headers limited to the weekends, with three announced in the first two weeks’ schedule. Incidentally, the start times for the afternoon and evening matches were not listed in the schedule.

Bounty GCC dethrone Hikers in Farfan & Mendes 1st Division hockey league

The Farfan & Mendes 2019 Men’s 1st Division hockey champions Bounty GCC

THE annual Farfan & Mendes Men’s First Division League came to an end on Sunday last with an entertaining clash between top club sides Bounty GCC and defending champions Pepsi Hikers.

With the two sides heading the points table by a large margin, Hikers only needed to secure a draw to emerge as league champions, since GCC trailed them by two points overall. GCC of course needed a win in their quest to regain the title that they last held in 2016.

The match began on an even keel with both defences holding firm but GCC gained the slight edge in the midfield battle in the first quarter of play. After 22 minutes of skilful hockey, GCC’s midfielder Mark Sargeant managed to break the deadlock when he slammed a rebound past Christian Sumeer for the opener.

The second half proved even more action-packed as Devin Hooper intercepted a loose clearance from the Hikers defence, nine minutes after resumption, and drilled the backboard for the second GCC goal.

Despite the 0-2 deficit, Hikers were creating chances, mostly through the outstanding midfield creativity of Jamarj Assanah and

the lurking presence of striker Aroydy Branford.

Midfielder Andrew Stewart, however, was the one to pull Hikers back within one when a Branford shot was saved, but Stewart was there for the put back. GCC pushed further ahead through striker Kevin Spencer who received a slick pass from Meshach Sargeant that split the Hikers defence and took the score line to 3-1 in favour of GCC. Aroydy Branford turned half of a chance into a goal in the 58th minute when he received a long pass and in the blink of an eye sent a flick high into the GCC net. Down by 3 goals to 2, the Hikers threw everything forward and were rewarded with a penalty corner on the final buzzer.

Fans held their breath as Hikers’ resulting shot swiped across the face of the GCC goal just wide of the left post leaving GCC to emerge victorious.

Earlier in the day, Supernova swamped Saints 8-2 to secure third position in the league while Vintage defeated Old Fort 4-1 to secure the fourth position.

Aroydy Branford of Pepsi Hikers received the Most Goals award for the league while Bounty GCC’s Kareem McKenzie received the MVP award.

Cameron calls Simmons hire a ‘bad decision’ which needed to be rectified

KINGSTON, Jamaica (CMC) – Cricket West Indies (CWI) president Dave Cameron says the regional governing body was forced to part ways with former coach Phil Simmons after concluding it had been “a bad decision” to hire the Trinidadian in the first place.In an astonishing admission during an interview with a radio station here, Cameron said Windies performances along with Simmons’ public “utterances” had left CWI with little choice but to reverse course.

Simmons was abruptly sacked in September 2016 six months after overseeing the capture of the Twenty20 World Cup title in India, for what CWI termed “differences in culture and strategic approach”.

“I can’t apologise for it, I’m a trader. And if you make a bad decision, you don’t sit down with a bad decision and try to make it right. You trade out of it and make a better decision,” Cameron said.

“I think we made a bad decision when we hired Phil and we had to get out of that situation otherwise we would not be where we are today. If you look at the performances, the utterances …”

He continued: “For the first time in West Indies cricket I can safely say with the board of directors that everybody is on the same page from the front office to the back office. Phil Simmons was abruptly sacked in September, 2016.

In a statement last week, CWI said it had never denied liability in the Simmons debacle “for no other reason than to ensure an amicable resolution in the interest of West Indies Cricket”.

The organisation also said negotiations were ongoing and hoped to have the matter settled before the court date of March 26.

Cameron said the reason the situation had dragged on was because CWI believed the claim for damages was too high.

“This whole matter, the entire board is fully aware of it. This is no secret … since we parted company with Phil, we’ve been negotiating his settlement,” the Jamaican explained.

“It is normal practice in sporting organisations all across the world (when) you move on from a coach, there’s normally a contractual period where you negotiate what happens after that.

“We believe the number he’s asking for is too high so we’re negotiating. Whatever the number (claim for damages) is, it’s a negotiation and that negotiation continues.”

Cameron is seeking a fourth consecutive term as CWI president in elections here next Sunday, but is receiving a strong challenge from former St Kitts and Nevis cabinet minister, Ricky Skerritt.

However, the incumbent has already secured the support of Windward Islands, Guyana and Barbados, with each of the six territorial boards having two votes.

Seven votes are required to win the election.

Skerritt and running mate, Dr Kishore Shallow, are being supported by Leeward Islands and Trinidad and Tobago, leaving the Jamaica Cricket Association vote critical.

Cameron said he was confident of another term.

“When you have served for the last couple years and you get the majority of the board – and when I say majority, three out of six (boards) – throwing their weight behind you and the independent directors, it says you’re doing something right. I’m looking forward to continuing,” he said.

Vikings upset Pepsi Sonics 74-69 THE recently-formed Vikings basketball club scored a 74-69 win over Pepsi Sonics on Tuesday evening, when the Let’s Bet Sports-sponsored Georgetown Amateur Basketball Association (GABA) Division-2 Knockout tournament continued at the Burnham Basketball Court.

Sonia Rodney, the only female coach in GABA, saw her side led to victory by a team-high 17 points from Seon Lee, while Kevon Dey chipped

in with 15 points.

Rawle Smith (10), Osafo Johnson (10) and Jeffrey Wilkinson (8) also found their names on the scoresheets for Vikings.

Shamar Anderson netted a game-high 20 points, while Troy Glasgow added 14 points.

The contest began brightly for Vikings who took the initial lead, compliments of a 15-12 score-line at the end of the first period.

However, Sonics respond-

ed in the second stanza, netting 25 points while restricting their foes to 12 points to enter the half-time interval in control at 37-27.

The sea-saw nature of the clash continued in the pivotal third quarter, as Vikings outscored Sonics 19-11 to reduce the deficit to 48-46 as they entered the final period.
