How Ugly Trump’s “Big, Beautiful Bill” really is

During Trump’s address to Congress in January, State of the People organizers activists and journalists stood up a 24 -hour streaming channel As the Senate and House debate Trump s big, beautiful bill, State of the People is broadcasting a marathon on its YouTube channel to fully inform the public on the devastating impact of Trump’s bill From State of the People, here are some ways in which the legislation will impact our communities:

Favoring Trump, SCOTUS majority undermines Federal Court Judges

Justice Ketanji Brown Jackson’s dissent

Closing out another term, the right-wing Supreme Court majority gave the Constitution and the Rule of Law the finger in Trump v CASA limiting the ability of federal courts to serve as a check on extreme executive action In its 6-3 opinion in CASA, the right-wing majority sidesteps the issue of birthright citizenship and positions itself as reigning in the power of the federal courts instead of the increasingly out-of-pocket executive branch

At issue were federal court injunctions that prevented Trump’s January 20 executive order restricting birthright citizenship for babies born in the U S to noncitizen parents

Depar tment of Defense’s r etr eat to Confeder ate names is a betr ayal of American values

Marc H Morial, President and CEO, National Urban League

Tr

c o m ) - “Why wouldn’t we want to name it after the great heroes that we do have in the U S Army? They reflect the best of America Inspirational people with inspirational stories

Brigadier General Ty Seidule (Ret ) former vice chairman of the Naming Commission In 2020, as the nation reckoned with systemic racism in the aftermath of

George Floyd s murder, the U S Department of Defense took a long-overdue step: initiating the process to rename military bases that bore the names of Confederate generals men who fought to preserve slavery and divide the Union

This was not a symbolic gesture It was a deliberate act to honor the values of unity equality and democratic service over the legacy of white supremacy That progress is now under threat

Reports that the Department of Defense is considering or being pressured into reverting to Confederate names is more than a policy shift It is a moral failure a capitulation to revisionist history and the weaponization of nostalgia

These bases, from Fort Bragg (now Fort Liberty) to Fort Hood (now Fort Cavazos) were renamed not to erase history but to correct the record These

installations train and house a multiracial, multiethnic force of patriots To ask them to salute the names of men who waged war against the United States who fought and died to preserve human bondage is not just offensive It is indefensible

Let s be clear: Confederate names do not reflect Southern heritage They reflect a legacy of racial terror of rebellion against the United States Constitution, and of treason cloaked in mythology Keeping those names is not about honoring history It is about choosing which history to honor

This retreat fits into a disturbing pattern From school boards banning books about race to corporations quietly walking back diversity commitments, there s a coordinated effort to roll back even the most modest steps toward racial equity And this rollback is rarely framed honestly It hides

behind rhetoric about tradition, neutrality, or not being divisive as if honoring Black service members and rejecting white supremacy is somehow controversial

The National Urban League calls on the administration and the Department of Defense to stand firm Do not reverse course Do not dishonor the generations of Black Latino Native and Asian American troops who have served under the American flag not the Confederate one

This is not a fringe issue

It s a frontline battle in the struggle for truth equity and a truly unified nation

We’ve already seen how quickly progress can be unraveled But we’ve also seen what happens when communities, advocates, and leaders refuse to accept silence and backsliding as the status quo

History will remember what we chose to honor in this moment

T he Supr eme Cour t’s Bir thright Citizenship r uling gets histor y aching l y wr ong

The Supreme Court has found a new way to shrink the Constitution without ever touching it

In Trump v CASA issued on Friday the court’s conservative supermajority claims it cannot yet decide whether President Donald Trump’s executive order denying birthright citizenship to the children of immigrants who don t have permanent legal status is lawful That question they say must wait And so must hundreds of thousands of future Americans who will soon be born on U S soil and have been rendered nationless by decree

In the meantime the majority announced that lower courts may no longer issue universal injunctions relief that protects more than the named plaintiffs in a given case even where a federal policy threatens broad and irreparable harm to classes of people It recast a question of constitutional magnitude as a dispute over judicial housekeeping and in doing so, quietly defanged the judiciary’s ability to confront systemic executive branch illegality before it takes root

To justify this rollback the majority turns to history Justice Amy Coney Barrett’s opinion for the court argues that federal courts lack the authority to issue universal injunctions because such remedies were not traditionally available in courts of equity The claim is that equity at its origin was narrow and plaintiff-specific Therefore so too

must be the injunctions issued today

But the majority, as it has done over and over again turned to the wrong history one concerned with procedural lineage and formalism, not the constitutional tradition that governs rights and remedies

The question isn t whether chancery courts in 1789 issued nationwide injunctions They didn’t The question is whether equity as evolved and applied in constitutional cases, has ever allowed courts to respond proportionally to the scale of the harm And the answer is yes

The majority s move is part of a familiar project on the right: to dismember modern constitutional doctrine by pretending the law never grew They invoke original equity the way they invoke original meaning by narrowing the frame cherry-picking the record and refusing to grapple with how the legal question has changed What’s left is a kind of historical taxidermy, a court concerned with the form of a principle without any thought about the lives the court was meant to protect

The majority s version of equity revives the illusion that constitutional enforcement can be boutique that the courts can vindicate fundamental rights in fragments But constitutional harm does not always occur one person at a time Indeed not now when the executive branch under President Donald Trump has embraced sweeping, often unconstitutional policy by edict, targeting entire classes at once, as with American children of immigrants in this case

Brown v Board of Education is a better historical example for the Supreme Court to rely upon

And even if it were strictly true that universal injunctions are suspect as a matter of judicial authority and it isn’t the point is beside the one that mat-

ters The question in constitutional cases is not whether a remedy mirrors what equity courts did centuries ago but whether it responds meaningfully to the alleged violation at hand That’s why Brown v Board of Education remains a powerful and appropriate historical example this court cannot answer No Brown did not involve a modern universal injunction issued before merits briefing was complete But it did something far more essential that should have guided the court s resolution of this matter: It recognized that when a constitutional violation is systemic the judiciary cannot respond with s u r g i c a l minimalism Brown did not confine its ruling to Linda Brown or to Topeka It invalidated the legal theory of segregation itself, and in doing so made plain that some constitutional harms are so sweeping so deeply embedded that courts must reach beyond the named plaintiff to cure them

As Marbury v Madison declared, it is emphatically the province and duty of the judicial department to say what the law is” a duty that includes not just declaration but enforcement And as The Federalist No 78 envisioned, the courts were to serve as bulwarks of a limited Constitution, empowered to halt unconstitutional exercises of power by the political branches A nationwide injunction in a case like this where the executive unilaterally rewrites the Constitution’s citizenship clause to undo its explicitly clear meaning is not an outlier to that tradition It is its paradigm But somehow that history didn’t make the cut In CASA the court turns away from that obligation It pretends that relief must await final judgment on a policy whose unconstitutionality, if not already self-evident will be proven only after irreparable harm has rippled through hun-

dreds of thousands of lives

Birthright Citizenship is settled law

And in so doing the court leaned on a fiction: that the legality of denying birthright citizenship to children born on U S soil to parents who don t have permanent legal status is somehow unsettled It is not There is no serious historical legal or textual argument to support the view that the 14th Amendment permits such a denial The amendment grants citizenship to all persons born or naturalized in the United States, and subject to the jurisdiction thereof The children of immigrants are born here They are subject to U S law They are citizens That conclusion has been reaffirmed for over a century, including by the Supreme Court itself in United States v Wong Kim Ark a direct repudiation of Dred Scott v Sandford which declared that no Black person descended from enslaved Africans could ever be a citizen It consigned Black Americans to permanent statelessness on the basis that their ancestors had been stolen violently dehumanized and forced into a nation that now refused to recognize them The court rightly corrected that shame But CASA resuscitates that disgrace To pretend that the birthright clause is now ambiguous simply because the brown children in question were born to parents who themselves were born elsewhere is judicial malfeasance

As a result of Friday s decision, even if the birthright citizenship revocation policy is ultimately struck down it will have functioned in the meantime unimpeded unremedied, and untouchable at scale The majority treats systemwide relief as judicial overreach But the real overreach belongs to the executive which has assumed the power to rewrite the 14th Amendment by

fiat And the judiciary s role is not to defer while it happens It is to stop it in its tracks immediately in full and across the board

Beneath the doctrinal veneer lies something even more disturbing: a fundamentally elitist vision of who deserves constitutional protection The court s decision assumes that those harmed by unlawful sweeping policies will have the awareness resources and legal sophistication to vindicate their rights one by one It imagines a legal system in which every constitutional injury patiently waits its turn in court, brought by a plaintiff with standing a lawyer and the means to endure years of litigation

But that is not the country we live in It has never been And the court knows it

Striping lower courts of the power to issue universal injunctions delays justice

To strip lower courts of the power to issue universal injunctions is to deny relief precisely where it is needed most These injunctions have functioned as an equalizer, and sometimes, are the only way to halt a policy that harms thousands who will never make it to a courtroom By foreclosing that tool, the court doesn’t just alter the shape of judicial relief

It redraws the boundary of who counts whose injuries are legible whose rights are enforceable and who must simply live under an unconstitutional regime until their individual case makes it to the top

For this majority to even invoke a concern for judicial authority here is a sleight of hand The question isn t whether courts have too much power It’s whether they have enough to meet the moment And this court has answered no

The court could have taken a narrower path It could have acknowledged the complexity of nationwide injunctions and offered a principled framework for when such

relief is warranted cases involving structural constitutional violations, sweeping executive action or harms that by their nature resist fragmentation It could have said: not often but sometimes Instead, it offered no standard, no guidance, no criteria Just a command: no more At last, here s what today s ruling means in plain terms: If you are aggrieved by the birthright citizenship order if the government tells you your child, or your neighbor that you are not a citizen you must file your own lawsuit Hire a lawyer Survive years of litigation Win And even if you do your relief applies only to you Not to your sister in the same home Not to your mother, your friend, or your infant child unless they were attached to your complaint Constitutional rights, this court insists, must be vindicated one body at a time until the merits of the case are settled Universal injunctions were never a perfect tool But they were at least an acknowledgment that rights mean nothing if courts cannot enforce them beyond the person who manages to make it to the courthouse steps Now even that is gone The court did not revoke birthright citizenship It didn’t have to By disabling the courts ability to halt unlawful policy across the board it made that revocation harder to challenge slower to remedy easier to survive judicial review A right that can’t be enforced for anyone but the plaintiff is a right that will not survive this era And a judiciary that calls that humility has already chosen a side Robyn Nicole Sanders is a civil rights attorney She is a former voting rights attorney for the Brennan Center for Justice, and she clerked for North Carolina Supreme Court Justice Anita Earls from 2021–22

Following the Facts on Child Well-Being

Earlier this month, the Annie E Casey Foundation released its 2025 edition of the KIDS COUNT® Data Book, an annual resource that measures national and state data on economic well-being, education, health, and family and community factors As they sum up their latest findings: “This year ’s trends paint a complex picture: steady progress in some areas setbacks in others and persistent opportunities to do better for kids and their families

Since 2019 seven of the 16 key indicators have improved six have worsened and three have not changed ” Among the troubling results “the number of teenagers disconnected from school or work has risen sharply academic outcomes are still worse than before the COVID-19 pandemic and, most concerning, more young people are dying

As members of Congress continue to debate their spending and slashing priorities for the federal budget, and as Children s Defense Fund continues to urge Senators to reject proposed cuts to critical health, nutrition, and financial stability programs, this is among the many kinds of data that could help Congress determine what choices children, young people, and families in their states need them to make Our nation should embrace every opportunity to lift up what is working and what remains necessary in order for children and families to thrive

One of the report’s features is its breakdown of indicators by state ultimately giving each state a ranking: “Where a child lives continues to matter deeply with stark geographic disparities shaped by local and state policies economic conditions community

investment and infrastructure This year ’s Data Book highlights these patterns clearly:

States facing the biggest challenges are largely in the South and S o u t h w e s t A l a b a m a , Arizona, Arkansas, Louisiana, Mississippi, Nevada, New Mexico, Oklahoma, Texas and West Virginia In contrast, many Northeast and Midwest states rank near the top Connecticut, Iowa, Massachusetts, Minnesota, Nebraska, New Hampshire, New Jersey, North Dakota and Vermont Utah also stands out as a strong performer ” This year, New Hampshire, Vermont, and Massachusetts ranked first, second and third for overall child well-being, and Mississippi, Louisiana, and New Mexico ranked 48th, 49th, and 50th

Where does your own state fall in studies like this and where do your state’s elected officials stand right now on the budget choices that matter most to children and families in your community? Strategic investments in basic needs programs like Medicaid and the Children’s Health Insurance Program (CHIP) the Supplemental Nutrition Assistance Program (SNAP) the Child Tax Credit and the Social Services Block Grant are more than optional line items on a spreadsheet; they are essential, proven tools that help families stay afloat and help children and young people thrive as they grow into healthy, productive adults There are many ways to tally the facts on how much kids count in our nation Choosing children over corporations should be a test too simple to flunk

Senate Sketches #1984.....by Hank Sander s T hose w ho ban books will ban the people in the banned books.

Those who ban books will ban the people in the banned books Burning books is a dramatic action that speaks loudly and forcefully The burning says that not only should the book not be read, it should not exist Those who ban books will ban the people in the banned books

Banning books is too often a prelude to burning books I am speaking out now in order to prevent book banning from becoming book burning Book burning says that the book must not exist Book banning says that the knowledge in the book must not exist Those who ban books will ban the people in the banned books

My friend Lynda Lowery, was a tender age participant in the Selma Voting Rights and Civil Rights Movement She marched the 50 miles in the Selma to Montgomery March in 1965 I read her book when it first came out in 2015 I also saw the book presented as a musical play last year in North Carolina It is a wonderful illustrated book that tells a powerful true story firsthand It is called Turning Fifteen on the Road to Freedom ” It is an inspiration to people of all ages but especially to young people It should not be banned Those who ban books will ban the people in the banned books I was reminded of the banning of books when Lynda Lowrey appeared at the Beloved Community Youth Leadership Camp in Selma last weekend She was the defendant in a mock trial about book banning She was also the most powerful witness The young leaders were able to participate by playing the roles as lawyers jurors and witnesses It was a play, but it was real real real! Those who ban books will ban the people in the banned books

The Beloved Community Mock Trial was held at the Dallas County Courthouse in a real courtroom Real lawyers were on both sides of the issue of whether any books should be banned A community worker served as a judge because the real judge was unable to attend because she just got out of the hospital Youth leaders were asked to participate as lawyers, witnesses, and jurors It was a powerful learning experience Those who ban books will ban the people in the banned books

The group that is leading the movement to ban Lynda Lowrey’s book entitled Turning Fifteen on the Road to Freedom is called “Moms for Liberty ” They are contrary to their own name because they are against liberty, not for liberty Liberty would allow all adults to determine what they read and what their children can read What is wrong with allowing families to decide what they and their children can read? I believe that would be liberty Those who ban books will ban the people in the banned books Those who ban books may eventually ban people related to the banned books Banning of books and burning of books are rooted in the fear of ideas The ideas are representative of the people And fear almost always metastasizes Beware of those who ban books for too often they become book burners Those who burn books will burn the people in the banned books

Book banning is just one step from book burning Book banning and book burning are ways to erase history, destroy knowledge create fear and bring about division Banning books is in the same playbook as banning diversity, equality, and inclusion Those who ban books will ban the people in the banned books

So much of the book banning has to do with Black people “Turning Fifteen on the Road to Freedom is written by a Black woman She is now 75 years old Linda Lowrey wrote the book when she was 65 years of age During the Selma Voting Rights Movement, she started participating at age 13 She was arrested nine times before she turned 15 She is a hero or rather a shero The book tells what our children can help accomplish We really need books about children helping to change things for the better in our time However some want to ban the book Those who ban books will ban the people in the banned books

Someone did an analysis of banned books

Thirty-six percent of the banned books were by or about Black people when the Black population in the United States is just 13 or 14 percent and the percentage of books published by or about Black people is about 4 percent Twentyfive percent of the banned books were about homosexuality Even history books and biographies such as Turning Fifteen on the Road to Freedom are being banned at extraordinary rates Those who ban books will ban the people in the banned books

Alabama once banned all Black people who were not enslaved from residing in the state In 1833, Alabama enacted a law banning free Black people from residing in Alabama In 1834, Alabama expanded the law by prohibiting the freeing (emancipation) of Black people It also made lawful the capture and enslavement of any free people found in Alabama Those who ban books will ban the people in the banned books

Even today there is a powerful overlap between the states in the country banning books and the states that fought to maintain and expand slavery

The overlap is not exact but the correlation is unmistakable Sometimes people do not want a bad part of their history told except by themselves Sometimes individuals history reflects aspects of others history Those who ban books will ban the people in the banned books

Make no mistake

There are those who would ban people of color from the United States of America They want to make America a White, Christian nation again ” Of course the United States of America was never a White, Christian nation again ” Native Americans were here thousands of years before this nation was conceived and birthed

Black people were here 170 years before this country was created Even some people who did not believe in slavery still wanted to send Black people away from these shores At one point President Abraham Lincoln held such views The only people who did not immigrate to this country are Native Americans who were here from the be-

ginning, and African Americans who were kidnapped enslaved and brought here through the Middle Passage All other American citizens are immigrants or descended from immigrants Those who ban books will ban the people in the banned books

When we support banning books we must be careful because book banning is just the first step Book burning is the next step Then comes the banning and burning of people We must be careful because any groups who have been discriminated against in the past may well be in the book-banning playbook That includes not just African Americans and Hispanic Americans, but Native Americans, Catholic Americans Jewish Americans Asian Americans and more Those who ban books will ban the people in the banned books The Holocaust and systematic mass murders in Germany during the 1930s and 1940s commenced with banning of books, then stepped up to burning of books, then stepped up to banning of peoples in concentration camps, then to burning of peoples in the concentration camps Twelve million people were burned to death, including six million Jews and six million others including Roma people (Gypsies), disabled people, homosexuals, Soviets, Poles and millions more If we really want to ban something, let s ban the banning of books Those who ban books will ban the people in the banned books

EarthTalk® From the Editors of EThe Environmental Magazine

Dear EarthTalk: What is Pollinator Month all about and how can I participate? -- E T , via email

Every June people around the world celebrate Pollinator Month It s a time to recognize the huge role that bees butterflies birds bats and others play in keeping our environment and food systems going A big part of that is Pollinator Week usually held during the third week of June It kicked off back in 2007,

Pollinators help around 75 percent of all flowering plants reproduce

when the U S Senate officially approved it Since then, it’s really taken off, thanks to groups like Pollinator Partnership and local conservation initiatives across the country Pollinators help around 75 percent of all flowering plants reproduce That means everything from wildflowers to crops like apples, almonds, coffee and chocolate In fact more than a third of the food we eat depends on them in one

Big Beautiful Bill

Broke: Money, Jobs, Economy

way or another According to the U S Department of Agriculture (USDA), pollinators contribute over $20 billion annually to the U S agriculture industry However, there is a problem with pollinators Their numbers are dropping Some causes of the decline include habitat loss, heavy pesticide use, disease, invasive species and climate change Pollinators are under stress That s where Pollinator Month comes in

•This bill cuts $1 3 trillion in food assistance and health coverage while giving the wealthy that exact amount in tax breaks

•It adds $3 25 trillion to the national debt which will weaken our economy at a time we can’t afford it

Kills jobs and increases energy costs: Puts 1 75 million construction jobs at risk with unions warning, “this stands to be the biggest job-killing bill in the history of the country

•Puts 2 million clean energy jobs at risk and increases energy bills by hundreds of dollars across the country

•Trump and the GOP s budget is the most regressive tax scheme in at least the last 40 years possibly ever The bill will “actively transfer” money from the poorest Americans into the pockets of the ultra-wealthy

•The impact of the “cuts” they are talking about is really a transfer of wealth reduce incomes among the poorest 20% of Americans by 3 8%, while increasing the incomes of the richest 20% by 3 7%

Sick: Healthcare, Medicaid, Medicare and the ACA; Veterans

• Rips away health care from over 16 million Americans through over $1 trillion in cuts to Medicaid Medicare and the Affordable Care Act including the largest cut to Medicaid in American history

• These Medicaid cuts are going to reach down into every corner of our nation’s health care system

Puts over 300 rural hospitals at risk of shutting down, ripping away critical, lifesaving care from hundreds of rural communities across the country

•Seniors will lose care at home and be left with fewer nursing homes and fewer nurses

•Kids with disabilities will lose home care

•And never before has there been legislation so focused on denying care to eligible Americans by adding more red tape and making it harder for anyone who relies on Medicare Medicaid and the Affordable Care Act

•More than 37 million children are enrolled in either Medicaid or the Children’s Health Insurance Program (CHIP), a federal program that provides affordable health insurance to pregnant mothers and children who live just above Medicaid’s poverty threshold

•Combined, Medicaid and CHIP protect nearly half of all children in the United States, beginning with important prenatal care, covering over 40% of U S births as well as nearly half of all rural births and continuing to insure millions of vulnerable children into young adulthood

•Veterans: Over 9 million veterans are enrolled in VA health care and millions more rely on Medicaid, Medicare, or ACA coverage to fill gaps these cuts will gut their care and overwhelm an already strained VA system

•About 1 in 10 veterans rely on Medicaid especially post-9/11 veterans, lowincome veterans, and those living in rural areas where VA facilities are limited

•Veterans of color, women veterans, and disabled veterans are disproportionately impacted as they are more likely to be dual-eligible for VA and public health programs now on the chopping block

•These cuts would force many veterans to delay care forgo treatment or drown in medical debt all while funding more weapons and war

Hungry: Taking food assistance away from our kids and communities

•5 million Americans lose food assistance (Congressional Budget Office SNAP projections)

•Work requirements expanded to age 64 (House Republican reconciliation bill text)

•New red tape around the child tax credit making it harder to qualify for some of the benefits like school lunch programs and SNAP

According to the U S Department of Agriculture, SNAP helps pay for groceries for more than 15 million children in the U S (USDA)

•Could force some states to end their SNAP programs Over the last 50 years, SNAP s nationwide availability has largely eliminated severe hunger and malnutrition throughout the United States This bill walks away from the long-standing, bipartisan, and national commitment to food assistance that made that possible

Additional Impacts:

Endangers our communities by making it easier to buy dangerous firearms and silencers

•The administration proposes a 43 6% decrease in HUD program funding, from $77 0 billion to $43 5 billion This includes a $26 7 billion cut from federal rental assistance programs as the responsibility for rental assistance would shift to the states The proposal also eliminates the $3 3 billion Community Development Block Grant program, designed to support community infrastructure public facilities and programming

•The Department of Health and Human Services budget would be reduced by 26 2% from $127 0 billion to $93 8 billion Within this a new $500 million fund would support the “Make America Healthy Again” initiative designed to allow HHS Secretary Robert F Kennedy Jr to address nutrition, medication, and food and drug quality

•A reform of the National Institutes of Health would reduce its budget by $18 0 million, requiring the closure of the National Institute on Minority and Health Disparities and the National Institute of Nursing Research The Centers for Disease Control and Prevention budget would also drop $3 6 billion

•Another $4 0 billion would be cut by ending the Low Income Home Energy Assistance Program operated by the Administration for Children & Families

•Federal Emergency Management Agency (FEMA) grant programs (-$646 million)

It s not just a celebration; it’s a push to do better by these species and the systems they support There are several ways that one can join Pollinator Month You don’t need to be a scientist or farmer One of the best ways to help is to plant a pollinator-friendly garden Native plants that bloom across different seasons work best like milkweed, lavender, wildflowers and mint You can skip the harsh chemicals, too Neonicotinoids in particular are known to harm bees and other helpful insects

There are also plenty of local events to get involved with during June Garden walks library story times seed swaps, even community cleanups and workshops People are also adding bee hotels bat boxes or simple water dishes in their yards to support pollinators where they live Online toolkits from groups like Pollinator org offer region-specific advice

SCOTUS

We are determined to be part of the solution,” said Josette Lewis Chief Scientific Officer at the Almond Board of California Pollinators are crucial for our food production and for our entire ecosystem ” Laurie Davies Adams CEO of Pollinator Partnership, adds, “Each of us can take meaningful action and it starts in our own backyards ” Beyond just gardens and local events, Pollinator Month also gets schools, businesses and parks involved by encouraging them to plant native flowers and cut back on pesticides

Lots of groups are pushing for pollinator corridors too These help connect habitats so pollinators can move safely through cities and countryside By supporting things like this and sharing what you learn, everyone can chip in to help slow pollinator declines and protect the important work they do Even small things like planting a few native flow-

ers or skipping pesticides really do add up over time Together these small efforts make a big difference for pollinators and honestly for all of us

The majority in CASA essentially hides behind its interpretation that a federal court does not have the authority to issue a nationwide injunction for arguably unconstitutional actions of the Trump administration that impact the entire country This would force impacted individuals to sue in every single jurisdiction to have their rights enforced and could create disparate application of the Constitution based on where a person was living

Writing another formidable dissent Justice Ketanji Brown Jackson pulled no punches rebuking her colleagues and the Trump administration’s erosion of the Constitution

“This perverse burden shifting cannot coexist with the rule of law ” wrote Jackson “As a result the Judiciary–the one institution that is solely responsible for ensuring our Republic endures as a Nation of laws–has put both our legal system, and our system of government, in grave jeopardy ”

The shrug and wink happening between the right-wing majority on SCOTUS and in the other two branches of the federal government should be alarming As Elie Mystal wrote for The Nation, SCOTUS just made it difficult for federal courts to stop Trump from exceeding his authority to end constitutionally protected birthright citizenship

It s a distinction one that lawyers will try to exploit for an entire rearguard action to defend citizenship in this country but one that’s unlikely to make much of a difference if you happen to be born on the Republican side of the tracks ” wrote Mystal “Once you read the fine print it becomes clear that this decision is a historic five-alarm catastrophe ”

Immigrant Rights’ Coalition Immediately Files Class-Action

Testing the limits of the majority s opinion in CASA, a coalition representing immigrant rights advocates, filed a nationwide class-action lawsuit challenging the executive order restricting birthright citizenship The legal coalition behind the class-action, including the ACLU and the Legal Defense Fund still have a separate case making its way through the federal courts that was not considered in Friday’s SCOTUS opinion

“The Constitution guarantees birthright citizenship and no procedural ruling will stop us from fighting to uphold that promise ” said Tianna Mays legal director for Democracy Defenders Fund “Our plaintiffs, and millions of families across this country, deserve clarity, stability, and justice We look forward to making our case in court again ”

On its face, the majority opinion in CASA appears to be a mixed bag Still, it gave Trump enough leeway to feel vindicated in his erosion of the Constitution, a cornerstone of American democracy Unambiguously affirmed in the 14th Amendment, Birthright citizenship has been widely recognized for generations

Citizenship is a right afforded to us by birth not by privilege said Karla McKanders director of the Legal Defense Fund’s Thurgood Marshall Institute “The Trump administration’s executive order is an unlawful attempt to entrench racial hierarchies and establish a second class of citizens in the United States We will continue working to ensure that birthright citizenship a right granted by the U S Constitution is protected, and that families are not torn apart because of this executive order ”

As SCOTUS cannot invalidate the amendment itself outright, it distorts legal analysis to help the Trump administration subvert over 150 years of legal precedent Judith Browne Dianis, executive director of the Advancement Project, called the decision one of the most dangerous and blatantly unconstitutional attacks on immigrant communities and the rule of law in modern history ”

“Through its restrictions on universal injunctions the Court is placing limits on who could be protected from this executive order which means to strip U S -born children of non-citizen parents of their birthright citizenship in a direct assault on the 14th Amendment,” Dianis said “As Justice Ketanji Brown Jackson points out, today’s ruling is an existential threat to the rule of law because it allows the Trump Administration to apply the executive order to many newborns who are guaranteed citizenship under the 14th Amendment but have not yet filed a lawsuit in federal court

While this decision may not directly impact Black Americans the expansion of authoritarian power granted to the Trump administration will certainly find its way to our doorstep One of three Reconstruction Era amendments the 14th Amendment has served as a launch pad for ensuring equal protection and due process and various civil and human rights

“To challenge it erases a core American promise and serves as a calculated step toward authoritarianism,” Dianis said “This reckless and racially motivated executive action is a transparent attempt to silence and disempower communities of color, particularly Latine, AAPI, African, and Caribbean immigrant families And it comes alongside a barrage of executive orders that attempt to dismantle racial equity, voting rights, and immigration protections each designed to chip away at our collective power

Ear l D. Smith

Mr Smith was born on October 17, 1966 He was a husband, father, and grandfather, as stated in his obituary He worked odd jobs, and one of his favorite songs was "Nuthin' But a "G" Thang" by Dr Dre

Although police said his death was a suicide, others claimed he may have been lynched, which has been rampant throughout our history There is considerable history to support that belief

From 1882 to 1968 4 743 lynchings occurred in the U S according to records maintained by the NAACP

The highest number of lynchings during that period occurred in Mississippi with 581 recorded Georgia was second with 531 and Texas was third with 493 Lynchings did not happen in every state There are no recorded lynchings in Arizona, Idaho, Maine, Nevada, South Dakota, Vermont, or Wisconsin

Black people were the primary victims of lynching: 3,446, or about 72 percent of the people lynched, were Black But they weren t the only victims of lynching

Some White people were lynched for helping Black people or for being anti-lynching Immigrants from Mexico China Australia and other countries were also lynched

In a statement rereleased to NewsOne after Tuesday’s results, Mamdani reaffirmed his support for reparations and programs that will improve the lives of the city’s Black residents

“As Mayor I will ensure that my administration meaningfully advances equality for Black New Yorkers, in our steadfast commitment to freedom and dignity for all people New York City participated actively in the slave trade and furthered its legacy through racist institutions, policies and laws; the City should reconcile and repair this legacy of slavery, stolen wealth, and discrimination, the statement reads

As an assembly member, Zohran Mamdani supported New Yorkers for Reparations which is the first phase of a longer saga to repair the harm of anti-Black discrimination from its foundation to make freedom and equality real for all New Yorkers

As Mayor I will work with our state partners to move those recommendations forward,” Mamdani’s statement read I will lead with my core belief that our liberation is bound together; redressing slavery’s harms past to present is necessary to achieving freedom and equality for Black New Yorkers and for us all I look forward to #MakingEqualityReal with you

Zohran Mamdani’s apparent win can only be described as a stunning upset and seems to have shaken both the GOP and Democratic establishment Rep Elise Stefanik a Republican representing New York s 21st congressional district released a statement saying “A radical Defundthe-Police, Communist, raging Antisemite will most likely win the New York City Democratic Mayoral primary ”

Stefanik has long been a staunch Trump ally So deporting undocumented folks without due process, spreading election lies, and engaging in an unnecessary trade war that will only raise costs for working-class Americans is fine, but rent freezes and free public transportation are where she draws the line Got it

Current New York Mayor Eric Adams, who was elected as a Democrat but is currently running for reelection as an independent, called Mamdani a “snake oil salesman” during an appearance on Fox and Friends Adams has faced sinking approval ratings as a result of his corruption

scandal and his subsequent cozying up with the Trump administration after the Justice Department moved to have the case dismissed

Mamdani’s campaign has been noted for its relentless optimism and his willingness to speak to voters on the ground level His campaign largely focused on affordability in a city that has seen substantial increases in the cost of living His key campaign issues revolved around creating more affordable housing, city-owned grocery stores to bring down food prices, and making buses free All of these ideas would be paid for through tax increases on the rich Should Zohran Mamdani win in November ’s election, he will be New York s first South Asian and Muslim mayor

Mamdani s primary opponent, former New York Governor Andrew Cuomo seemed poised to win the Democratic primary He had millions of dollars in funding, backing from the Democratic establishment a recognizable last name in New York politics, and had been polling ahead of Mamdani throughout most of the campaign Cuomo ran on a business-as-usual platform, not really addressing the issues of affordability that have affected working-class New Yorkers He largely coasted on his name, which was a bizarre move considering he left the governor ’s office in disgrace after facing multiple accusations of sexual harassment Yet that didn t stop the very same folks who condemned the accusations from endorsing his mayoral campaign Cuomo conceded to Mamdani on Tuesday night when the early results showed Mamdani had a commanding lead Tonight was not our night Cuomo told supporters on Tuesday “Tonight was Assemblyman Mamdani’s night He put together a great campaign and he touched young people and inspired them and got them to come out and vote

Dan Pfeiffer a former aide to President Barack Obama, said on X (formerly Twitter) that Democrats “have a lot to learn” from Mamdani “What’s happening in NYC is a blaringly loud message to those in the Dem establishment who still cling to old politics recite focusgrouped talking points, and are too afraid to say what needs to be said ” he wrote
