Knowledge is Power: Legal Insight into Whether a Buyer Should Have a Home Inspection One of the most common questions I receive in relation to the purchase of Real Estate is whether or not the Buyer should have inspections. My response is always the same, “ABSOLUTELY.” The more you know the better off you are. Every effort should be made to avoid any undue surprises in the closing process. The most common sales contract used in Collier County is prepared by the Naples Area Board of Realtors (NABOR). All my comments will be in reference to the most recent version of the “Sales Contract for Residential Improved Property.” The Buyer should always ask for the Seller’s prior owner’s title insurance policy and survey. Although Standard B of the Sales Contract provides that the Seller will deliver Buyer a complete copy of the owner’s title insurance policy, this does not always happen. Frequently, it’s a last minute item or is not provided at all. The Contract does provide that if the Seller fails to give a copy of the owner’s title insurance policy, the Buyer will get a credit of $350.00 at the time of closing. But there is no substitute for the policy itself. The policy will provide a road map for outstanding easements, restrictions, and other encumbrances that might affect the property. The sooner the Buyer knows of these issues the better off he will be. Use of the Owner’s survey, can save the Buyer the cost of having his own survey completed, plus alert

him at an earlier stage of any potential problems. The Sales Contract does place the burden of producing a survey on the Buyer 15 days prior to closing, but again, by getting the Seller’s copy the Buyer may avoid that cost and give a head start on any outstanding issues. Any Lender will always require a survey unless it’s a condominium. There are a number of inspections the Buyer may elect to conduct relating to the real property. Anytime I am asked whether or not it is advisable to have a home inspection, radon inspection, mold inspection, or any other type of inspection, I always laugh and say “yes.” It may be too late if the Buyer discovers any problems after the closing. The home inspection must be completed within 15 days of the effective date of the contract. The inspection analyzes whether the major appliances and equipment, sprinkler, well, septic, and various other items are in working condition. The Contract distinguishes between working condition and cosmetic conditions. Cosmetic conditions refer to missing screens, discoloration of floor coverings, or wall paper, scratches, dents, chips, caulking, pitted pool surfaces, cracked roof tiles, and limited roof life. Very commonly, people will ask for a broken appliance to be replaced. For example: many people have asked for new air conditioners. The first thing I ask, is how old is the air conditioner that isn’t working. If the air conditioner

is quite old, I point out the contract provides that no cost to repair that item shall exceed the fair market value of that item, if it is in working condition. The bottom line is I want my Buyer to know exactly what they are buying. Any surprises are always unpleasant. I also get questions about radon or mold inspections. I always recommend both. Radon commonly can be resolved through a simple remediation. Mold is a somewhat more complicated issue. In my mind mold is a symptom of an underlying problem. Some of the more common situations that I have dealt with, include a leaky air handler, leaky shower, or sprinkler heads hitting the defective caulking of a window. Sometimes mold can be a consequence of a leaky pipe, or my own personal situation, simply having wall paper (steam!) in the bathroom. In all those instances, I try to indicate to the client that the presence of this mold allows us to see issues that we would not otherwise see. It gives us an opportunity to fix the underlying problem. The contract does allow the Buyer to object to toxic or pathogenic mold. There are literally thousands of different types of mold but the only thing the Buyer can specifically object to in the standard NABOR contract, is toxic or pathogenic mold. In summary, the more the parties know, the better off they are in consummating their real estate closing. Nobody likes to be surprised and often these problems can be resolved

effortlessly. The above issues are just a few of the issues that come up in a routine closing. Usually these details are worked out through the help of an experienced Realtor and the Real Estate Attorney.

Practical Solutions to Everyday Annoyances in the Real Estate World Dear Mis-Manners, I just got off the phone with a very upset Seller, and thought I would ask your opinion on the subject. In a nutshell, I have a condo listed that originally was a F.S.B.O. (For Sale by Owner). A big portion of my presentation centered around the fact that PROFESSIONAL Agents would show the property, and the security of a licensed agent always showing the property in the Sellers absence. A showing was set, and the Seller went to his friend’s home across the street from him to wait for the showing (and to stay out of the way). At the scheduled time, a pick-up truck pulled into the driveway, and three men got out and went to the front door and entered. All three were dressed in jeans, tee- shirts and running shoes. No sign of a REALTOR in sight (or so my Seller thought). My Seller accused me of giving the lockbox code to anyone so I wouln’t have to leave my climate controlled office. After making a frantic call to the Showing Agent, I was a little relieved to find out he was one of the ‘Bums.’ My Seller is somewhat happier, but he confessed to me if he had answered the door, he doubted if he would have allowed the motley crew in.for the showing. Any comments? /Signed/ Over-Dressed for Success Dear Over-it, You certainly know how to get Mis-Manners’ blood pressure racing. This has been one of my sore points for years. Okay, okay, before everyone hops on the band wagon preaching about “dress down Friday” and the “relaxed work ethic," and all that happy stuff, allow Mis- Manners to get on the soapbox. Can someone give me a hand? Common sense does prevail. Dressed in a three-piece suit or an eve-

ning gown to show farm property or new construction with muddy drives and rough interiors may be a bit out of line. But for typical showings, use a little class and common sense. For both men and woman, a suit or jacket and slacks (or skirt) are always acceptable. Men should wear a shirt and tie, and women a coordinating style blouse. If you like a more casual, yet polished look. A a dressy sport shirt would probably be acceptable (depending on YOUR company dress policy). Khaki type slacks would be fine, but blue jeans are a no-no, as are tennis/running shoes. Shoes should be polished and in good repair, Glittery evening shoes with six-inch heels are out (sorry guys). Grooming is also important. Men need to be shaven (the grunge look doesn't cut it boys), business type haircuts and shower fresh. It applies to women with business hair and makeup. Ladies, if you have a flowing mane of long hair, try to keep it in control, (that look only worked for Cher and Crystal Gayle). Always keep a professional image in mind. While someone in there 20’s may appreciate a trendyhip look, an older retired person may not. Keep that in mind when getting dressed for appointments. Bottom line kids, if you cannot function in a blue blazer or shirtwaist dress, you can at least look and act like a real estate agent from a distance. Do you carry a clipboard, notebook or briefcase on appointments? If not, how do you make notes on questions a Buyer may have on a property? If you have on sweat pants and a tee shirt, where do you keep a pen, keypad, glasses, tape measure, flashlight, cell phone palm pilot, and all the other junk we need during showings? Remember, even if your clients and customers claim they don't care what you look and dress like while working with them … they lied. THEY DO CARE! /Signed/ Mis-Manners

Money & Mortgage Matters: OFHEO Announces 2008 Conforming Loan Limits At this time of year, mortgage professionals anxiously await an announcement by the Office of Federal Housing Enterprise Oversight (OFHEO) on new Conforming loan limits for the following year. This year’s announcement was of particular interest since Congress had been petitioned by many to increase these limits in order to provide liquidity in the troubled Jumbo loan market. With both Fannie and Freddie recently reporting negative news regarding their portfolios, we are grateful that loan limits were not reduced. Conforming loan limits will remain at $417,000 for single family housing. A loan is considered to be “conforming” when it complies with these loan limits and also with all other guidelines set by Fannie or Freddie. The Federal National Mortgage Association (Fannie Mae) was established by Congress in 1938 as an official agency of the federal government. It was created to develop a secondary market for mortgage loans by purchasing and selling FHA-insured mortgage loans (and VA loans starting in 1948). In 1968, Congress divided Fannie Mae into two organizations, the present Fannie Mae as a private stockholder-owned government-sponsored enterprise (GSE) and the Government National Mortgage Association (Ginnie Mae), a government agency within HUD. Although federal ownership of Fannie Mae has ended, HUD and the U.S. Department of Treasury oversee the corporation. Many times you may hear that Fannie and Freddie have an implicit guarantee from the U.S. government. Hopefully we never have to find out! However, both do receive generous federal credit privileges such as a line of credit with the U.S. Treasury, exemption from state and local income taxes and other perks. The Federal Home Loan Mortgage Corporation (Freddie Mac) is another stockholder-owned government-sponsored enterprise (GSE) chartered by Congress in 1970 to keep money flowing to mortgage lenders in support of homeownership and rental housing for middle income Americans. Similar to Fannie, Freddie purchases, guarantees and securitizes mortgages to form mortgage-backed securities.

The Federal Housing Administration (FHA) also announced that its loan limits would remain the same. FHA loan limits are determined by location. Currently, the FHA loan limit for Collier County is $362,790 and for Lee County it is $270,750. Supporters of the FHA have vigorously petitioned Congress to allow the FHA to match its limits to Fannie and Freddie. That bill is currently languishing in Congress. Here is the text of the official announcement. Washington, DC - Office of Federal Housing Enterprise Oversight Director James B. Lockhart today announced the maximum 2008 conforming loan limit for single-family mortgages purchased by Fannie Mae and Freddie Mac (the Enterprises) will remain at the 2007 level of $417,000 for one-unit properties for most of the U.S. Higher limits apply to Alaska, Hawaii, Guam and the U.S. Virgin Islands as well as to properties with more than one unit. The conforming loan limit determines the maximum size of a

mortgage an Enterprise can buy or guarantee. By law the maximum conforming loan limit is based on the October-to-October change in the average house price in the Monthly Interest Rate Survey (MIRS) of the Federal Housing Finance Board (FHFB). The FHFB reported the decline in the average price was $10,685 or 3.49 percent, from $306,258 in October 2006 to $295,573 in October 2007. The combined two-year decline is now 3.65 percent. “While the house price survey data used in determining the conforming loan limit show a decline over the past year, as previously announced and consistent with the proposed new conforming loan limit guidance, the level will remain at $417,000 for the third straight year,” said Lockhart. On October 22, 2007 OFHEO published in the Federal Register a revised Examination Guidance proposal for procedures relating to the calculation of the conforming loan limit and implementation of increases or decreases in the limit. OFHEO published the initial

proposal for comment on June 20, 2007. The second comment period has now closed and OFHEO is reviewing comments received. At the time of the October publication, OFHEO announced that no decreases in the loan limit would be required for 2008, regardless of the price data in the MIRS report.
