GRAND GENEVA –Making Grand Connections: HIGHLIGHTS FROM THE 2023 SUMMER MEETING

The 2023 Summer Meeting unfolded with a grandeur that matched the stunning surroundings. From July 24 to 26, the resort played host to a series of events that not only fostered connections within the industry but also celebrated milestones, advancements, and camaraderie.

The event kicked off on Monday, July 24, with the GCBAA Board of Directors Meeting and a special Board Dinner. The friendly atmosphere and the beautiful backdrop of The Brute Golf Course set the tone for days ahead filled with collaboration and relaxation.

The following morning, attendees from the Board of Directors, Board of Governors, and Foundation Board members teed off for a round of golf at The Highlands Course. The splendor of the fairways matched the camaraderie of the participants. As the morning progressed, the resort buzzed with activity as equipment sponsors – Bergmann Americas, Hydrema U.S., and Wacker Neuson – prepared for the Tuesday reception.

The "Buy From Within" Reception and Member Benefit Expo unfolded at The Forum

Convention Center on the resort's property. Attendees enjoyed networking and exploring a wide range of industry offerings. This was also the perfect setting to acknowledge the newest Charter Member, CapillaryFlow, whose dedication to excellence was symbolized through a plaque presentation.

As evening descended, guests gathered to celebrate the 25th Anniversary of Sticks for Kids. The evening was marked by joyous laughter, courtesy of the ComedySportZ Entertainment group sponsored by Tee-Off Staffing. Thank you to Janet Deker, Chris Lineberger, and Kevin Breen for fearlessly participating in the evening's entertainment.

Education formed a crucial aspect of the event. Despite a brief pause due to inclement weather, the educational sessions showcased the industry's resilience and adaptability when asked to pause, pivot and transition to safety from the storm. Thank you to all attendees for your cooperation and quick response to help not only the GCBAA Staff but also for a swift transition indoors. Discussions ensued, covering a range of

topics, including an insightful irrigation panel conversation on material supply, demand, and logistical challenges in 2023. Esteemed speakers such as Julius E. Rhodes and Stuart Lindsay took the stage to engage the audience with thoughtprovoking insights. Collaboration was at the forefront, with the sharing of insights from ASGCA members leading to a broader understanding of the industry landscape. As well as updates from GCSAA CEO Rhett Evans on the upcoming 2024 GCSAA Conference & Trade Show that will be held in Phoenix, AZ. Jocelyn Sandoval, Trade Show Manager, gave a quick update on the trade show floor and layout for booth placement and exhibitor opportunities.

The spirit of collaboration continued as ASGCA

members came together for a panel discussion derived from the GCSAA CTS in Orlando. Bergmann Americas unveiled groundbreaking equipment technology and safety advancements.

After an informative and engaging series of discussions, attendees transitioned to The Brute Golf Course for an afternoon outing. The rain could not dampen the spirits of the participants, and the Sticks for Kids Golf Outing proceeded as planned. Eighty-four enthusiastic golfers embraced the humid afternoon for a memorable experience that combined sport, networking, and enjoyment.

As the outing wrapped up, the evening saw the distribution of awards and a delightful dinner. These moments of recognition underscored the

significance of the connections made and the achievements celebrated.

None of these moments would have been possible without the dedication and support of all attendees, sponsors, allied partners, and industry collaborators. This event stood as a testament to the collective effort that propels the industry forward.

As we close the chapter to this year's Summer Meeting, we look forward to the continued growth of grand connections, advancements, and achievements that shape the industry.

PRESIDENT’S PERSPECTIVE

Associations are everywhere and there seems to be one for every conceivable group imaginable. Some have just a few members and others have tens of thousands. Some think the power in an association lies in the number of members they have. I think what is more powerful is the depth of its members’ relationships and the values they share. I have often said the Golf Course Builders Association of America (GCBAA) and the golf business in general is based on relationships more than any other group. This edition explores the unique approach of the GCBAA in recruiting, building the membership base, and emphasizing our mantra of "Buy From Within." By focusing on fostering meaningful connections and representing each other, the GCBAA exemplifies the spirit of a close-knit family.

While many associations focus primarily on acquiring members, the GCBAA recognizes that true strength lies in the quality of each member and the relationships within its community. Membership in the GCBAA is more than just being a number on a sheet; it is an opportunity to become part of a network of like-minded professionals that genuinely care about each other and the collective success of the association. As members of our association, we regularly do things that do not directly help our companies but help the greater good of the association. That is what makes the GCCBA a unique group. By creating an inclusive and welcoming environment, the GCBAA attracts professionals who align with its values and mission.

The GCBAA understands that cultivating those strong relationships is the key to the associations’ success and longevity. That includes competition between members. When that is done in a fair and inclusive way it benefits all members of the association. The GCBAA actively promotes networking events, conferences, partnerships, and collaborative initiatives that provide ample opportunities for members to connect and share knowledge. By encouraging open communication and collaboration, the GCBAA facilitates the development of lasting relationships, fostering trust and camaraderie among its members. Our events are some of the best networking events in golf. As well as being fun. The reception at the Conference and Trade Show is one of the best networking events of the entire week. We lean toward the work hard/ play hard moto. One of our more exciting events is the South Florida Regional meeting typically held at The Breakers resort in West Palm Beach, FL. There is a reason it has become known as the GCBAA Christmas party. The association sets up meaningful education, company spotlights, and other critical informative presentations at our meetings while also having events that are fun and are the backbone of the networking our members participate in.

At the heart of the GCBAA is our motto "Buy From Within." This philosophy is based on helping those that help us. Buy from and support our members in your business operations. When we use each other’s products and services that adds strength to our association and what the GCBAA represents. These companies offer expertise in their respective product lines and that is a valuable resource for

all members. When vendor members see the “Buy From Within” mentality they then support our events in ways that are sometimes not evident but make it better for all involved. When these companies can see the quantifiable difference doing business with the GCBAA brings them they are more apt to network, participate in advertising opportunities, create special deals for GCBAA members, and add to our partner programs that are part of the backbone of our association. Remember, whenever possible “Buy From Within” it helps us all.

Many associations suffer some disconnect because of a gap between their members. The GCBAA sets itself apart by recognizing this challenge. Knowing we are in a relationship business our staff actively works to bridge any gap by organizing events and initiatives that encourage interaction and shared experiences. By creating platforms for members to come together, the association enables professionals from diverse backgrounds to connect, learn from each other, and create a unified front in representing their industry and our association.

The GCBAA places great importance on how its members represent one another. The members of the association are in business to collectively make golf better in our own ways. By actively engaging with members and understanding their unique strengths, the association becomes a powerful advocate for their collective interests. Whether it is through lobbying efforts, public relations campaigns, or industry partnerships, the GCBAA focus is to represent all members with integrity and professionalism. By doing this we increase the reputation and level of respect for the GCBAA.

All that to say, the GCBAA is a great association that places a high value on the relationships we have with one another. The association’s unique approach to membership recruitment and relationshipbuilding sets it apart from others. While most associations value quantity the GCBAA values quality as equally important. The association prioritizes memberships that have meaningful connections and that embody the feeling of belonging to something greater, something like an extended family. As a cohesive and integrated group, we show our strength and knowledge to other allied associations and the golf world in general.

At the end of the day, although we may be competitors in the field, we can still be friends and advocates for each other in all other aspects of the business. We want to see each other, and our association succeed. We hope to see you at the GCBAA Winter Meeting/GCSAA Conference & Trade Show, Phoenix, AZ, January 29-February 1, 2024. I encourage you to join us. Recruit and help us bridge the gap while continuing to grow our association and this great industry!

EXECUTIVE DIRECTOR NOTES

In the journey of life, we often find ourselves faced with situations that are beyond our control. These moments of unpredictability can be daunting, but they also present us with opportunities to grow, adapt, and ultimately overcome adversity. When navigating uncharted waters, it's important to remember that while we can't control everything, we do have the power to shape our responses and attitudes.

Life is full of unexpected twists and turns. No matter how meticulously we plan or how thoroughly we prepare, there will always be factors that remain outside our grasp. It's during these times of uncertainty that we truly discover our resilience and capacity to pivot. Just like a ship adjusting its sails to the changing winds, we must also be willing to pivot our strategies and mindset to adapt to new circumstances.

Imagine a scenario where you've meticulously planned for an event… hmmm, sound familiar? You take into account every possible outcome. You've prepared for weeks/ months, leaving no stone unturned. But on the day of the event, an unforeseen challenge arises. It's in this moment that our ability to remain adaptable comes to the forefront. Instead of being disheartened, consider this an opportunity to exercise your problem-solving skills and creativity. The ability to pivot allows us to turn obstacles into steppingstones and forge a new path forward.

Preparation is undoubtedly crucial, but it's equally important to acknowledge that no amount of preparation can fully insulate us from the unknown. Sometimes, the best we can do is to prepare ourselves mentally for the possibility of being unprepared. This might seem counterintuitive, but it's a mindset that embraces flexibility and openness. By accepting that surprises are inevitable, we can learn to approach them with a sense of curiosity and a willingness to learn.

The excitement of facing challenges head-on lies in our ability to overcome them. Just like when our friend Rhett Evans, CEO GCSAA relishes the ascent and conquest of a daunting peak, we too can find joy in conquering life's hurdles. Each challenge we overcome adds a new layer of strength and confidence, reminding us that we are capable of far more than we might have imagined.

In the midst of challenges, it's tempting to constantly look back, analyzing what went wrong or what could have been done differently. However,

dwelling on the past can hinder our progress and cloud our vision of the future. Instead of focusing on the rearview mirror, shift your gaze to the windshield. The road ahead holds endless possibilities, and our potential is limited only by our willingness to explore the unknown.

So, as we navigate the ever-changing landscape of life, let's remember that while we can't control everything, we can control how we respond. Embrace the excitement of challenges, pivot when necessary, and be ready to face the unknown with an open heart and a curious mind. The journey is unpredictable, but it's in these moments that we truly discover our strength, resilience, and capacity to thrive.

The phrase "new normal" became a catchphrase during the pandemic, often met with a collective groan as most of us yearned for the return of the old normalcy we once took for granted. But now, as we find ourselves firmly planted in this "new normal," it's become apparent that the journey isn't as smooth as we might have hoped. The winds of change bring challenges that we couldn't have foreseen, from labor and material shortages to inflation and a host of social and economic issues. However, while technology has been a lifeline in our recovery, it's frustrating to witness certain groups exploiting the very tools meant to help us weather the storm.

In an era where technology has made tasks more efficient and convenient, it's disheartening to see opportunists taking advantage of our reliance on these very innovations. As we seek ways to bridge gaps and adapt to changing circumstances, there are those who see our vulnerability as an opportunity to deceive and defraud. This serves as a stark reminder that if something sounds too good to be true, it often is.

One arena where this unfortunate reality is especially prevalent is the realm of virtual meetings and communication. Scammers have taken advantage of the virtual landscape by offering tempting lists of attendees for sale. In a time when networking is crucial, the idea of gaining access to a wide range of contacts might seem appealing, but it's essential to remain cautious. The potential consequences of dealing with such dubious sources could far outweigh any potential benefits.

Similarly, as technology facilitates easy and quick communication, another prevalent scam involves emails purportedly from trusted

individuals. Whether it's a message from your own email address or one that seems to come from a respected authority figure, the request for funds or gift cards might appear legitimate. However, it's vital to exercise extreme caution. Double-check the sender's address, verify the request through another communication channel, and refrain from divulging sensitive information until you are certain of the authenticity.

In this landscape of uncertainty, it's heartening to know that organizations and associations stand with their members. The GCBAA Board of Directors, Mychelle, and I want to ensure the safety and wellbeing of our members. We want to remind you that even in the face of challenges, there is a support system in place. If ever in doubt, whether it's about meeting registrations, payments, or event details, reaching out directly for verification can prevent falling victim to scams.

One particularly reassuring aspect of this cautionary tale is the emphasis on personal connection. As technology enables convenient interactions, it's easy to lose the human touch. However, this is precisely where scammers capitalize. The suggestion of a video or face-to-face conversation serves as a beacon of authenticity. It's a way to reestablish that crucial human connection in an increasingly digital world.

The responsibility to protect ourselves and our networks doesn't end with us. By sharing these cautionary tales and best practices with colleagues, friends, and family, we create a web of awareness that extends far beyond our immediate circles. It's a testament to the strength of community and the power of shared knowledge.

As we navigate these uncharted waters, it's clear that the "new normal" is a complex puzzle of challenges and opportunities. Technology, while a lifeline, has also unveiled the darker side of human behavior. By remaining vigilant, cultivating a healthy skepticism, and maintaining a strong connection with our communities, we can confidently sail through the winds of change and emerge stronger on the other side.

GCBAA FOUNDATION'S STICKS FOR KIDS INITIATIVE REACHES KENYA THANKS TO A Generous Contribution

In a heartwarming display of international generosity and a shared passion for the game of golf, the GCBAA Foundation's Sticks for Kids program has made a remarkable impact in Kenya. The initiative, dedicated to introducing golf to young enthusiasts, has received a boost from Rick Phelps, ASGCA, who sponsored and facilitated the shipment of 15 sets of Sticks for Kids Clubs to the eager hands of young golfers in Kenya.

Among the beneficiaries of this thoughtful contribution, The Eldoret Club, situated in the bustling city of Eldoret, received five sets of these clubs. Rick’s visit, which took place in January 2022, demonstrated the growing enthusiasm for golf among Kenyan youth and the significance of such philanthropic efforts.

The Eldoret Club, embodying the spirit of grassroots golf, presents an average Kenyan golf club setting. Boasting a 9-hole course with minimal maintenance, a modest clubhouse, a pool, and on-site lodging, the club thrives on its genuine passion for the game. The City of Eldoret itself has experienced a population surge of nearly double over the past 15 years, translating into a bustling club with a vibrant junior golf program.

Rick noted, "With that growth, their junior golf program is also exploding! They have over 80 kids from the age of 6 to 15. The majority of those kids do not have access to any golf equipment (clubs, balls,

even tees). I saw cobbled-together sets of clubs, most of which were at least 20 years old, that were mixes of junior and adult sizes. Most 'sets' included three or four clubs, including a putter!"

While the process of navigating customs and logistics posed challenges, the determined effort to provide these young golf enthusiasts with proper equipment was a testament to the dedication involved. The impact of this endeavor, as witnessed through the enthusiastic reaction of the recipients,

is undeniable.

The GCBAA Foundation's Sticks for Kids program aims to create opportunities for youngsters to experience the joys of golf while fostering a lifelong passion for the sport. The initiative recognizes that even the simplest gestures can have a profound effect on inspiring the next generation of golfers. A HEARTFELT GATHERING FOR A WORTHY CAUSE

The sun shone brightly on the 5th Annual Rich Mullen Memorial Golf Outing, held on the picturesque 9-hole golf course of Wolf Creek Golf Club. A full field of 11 foursomes came together to celebrate the memory of Rich Mullen, the beloved branch manager of SiteOne Landscape Supply in Champaign, IL, who passed away unexpectedly in April 2018. The event, hosted by Rich's successors, Andrew Marsh, Nick Miethe, and a dedicated team, not only showcased the camaraderie and love for golf but also served a noble purpose.

The day was a testament to Rich's passion for golf and his commitment to helping others embrace the game. This year's tournament raised nearly $3,000, with additional funds expected from auction rounds. A portion of these proceeds are set to be donated to the Sticks for Kids Program, a cause close to Rich's heart. The program aims to introduce young individuals to the sport of golf, echoing Rich's dedication to nurturing the next generation of players.

GCBAA BOARD UPDATE: EMBRACING CHANGE AND ENSURING STRONG LEADERSHIP FOR THE FUTURE

At the beginning of the summer, the Golf Course Builders Association of America (GCBAA) had been busy preparing for the future with a series of important changes to its leadership structure. The Association witnessed a significant milestone in the organization's journey, marked by the GCBAA Executive Board's commitment to strengthening its leadership and fostering continuity.

The GCBAA Executive Board, acting on the commission of the GCBAA Board of Directors, embarked on a thoughtful journey to address crucial matters concerning leadership transitions. This initiative encompassed the replacement of the Incoming President and the appointment of a Director from the Builders category. After rigorous discussions and careful considerations, the GCBAA Executive Board formulated a set of recommendations that introduced substantial amendments to the GCBAA Bylaws. These recommendations were subsequently adopted by the Board of Directors, underscoring the commitment to a progressive and future-oriented approach.

One of the most notable changes in the GCBAA Bylaws is the inclusion of provisions that open up leadership opportunities for Associates within the

organization. While GCBAA's identity is rooted in its builder members, the contributions of the supplier network and Associates have proven equally invaluable to the association's growth and development. By allowing Associates to stand for election to President Elect and President positions, the Board of Directors has paved the way for a more diverse pool of candidates, enriching the leadership selection process and ensuring a well-rounded representation of the association's stakeholders.

To ensure a seamless transition for the upcoming cycle of leadership on the Executive Board, the organization wisely leveraged the "draw of lots" option stipulated in its bylaws. This strategic decision extended the tenure of the current, seated Executive Board members by an additional year, thus facilitating a smoother handover of responsibilities and knowledge to the incoming leadership team.

In line with these developments, Jon O'Donnell has been appointed as the PresidentElect. His background and dedication to the association make him a valuable addition to the leadership lineup. Concurrently, Mike Garbs, a distinguished member of the GCBAA Board, has stepped into the role of Treasurer, bringing his

financial acumen and commitment to the table.

The composition of the Executive Board for the immediate future stands as follows: Judd Duininck holds the position of Immediate Past President, John McDonald, II serves as President, Jon Truttmann as Vice President, and Chris Caccavale as Secretary. GCBAA STAFF AND MEMBERS ATTEND National Golf Day 2023

The anticipation was palpable as members of the Golf Course Builders Association of America (GCBAA) gathered in the heart of our nation's capital for the much-awaited 2023 National Golf Day. After a hiatus from in-person events, the atmosphere was charged with excitement as GCBAA staff and members joined forces with 250 attendees to amplify the voice of the golf industry and advocate for its well-deserved recognition.

Advocacy has been a cornerstone of the GCBAA's efforts, and the 2023 National Golf Day was no exception. With a steadfast commitment

to supporting its members and allied industry partners, the association embarked on a mission to champion vital issues that resonate with the golf community.

One of the highlights of this momentous event was the Community Service Project at the iconic National Mall. The GCBAA showcased its dedication to enhancing the environment by engaging in projects that had a tangible impact. Tasks ranging from spreading wood chips beneath the sprawling cherry tree stands to planting over 1,000 new plants were undertaken with a sense of purpose and enthusiasm. The refurbishment of landscape beds, resodding the German American Friendship Garden, and rejuvenating the surroundings of the Sylvan Theater demonstrated the association's commitment to the environment.

The numbers speak for themselves: more than 315 cubic yards of wood chips, 1,000 new plants, and 240 meetings with Members of Congress. This robust engagement facilitated a productive dialogue with representatives from 39 states and 162 unique House Districts. The event's attendance set a record, making it an unparalleled platform for advocating for the golf industry.

Before engaging in discussions with state representatives, attendees were well-versed in the advocacy priorities. Attendees passionately advocated for a series of crucial topics that

resonate deeply within the golf community.

A prominent point of discussion revolved around modernizing the U.S. Tax Code. We urged for equitable treatment of the golf industry in disaster relief and economic stimulus programs, ensuring that golf businesses are not excluded from benefits that other sectors receive. Efforts also championed H-2B Visas, highlighting the significance of "returning worker" status and exempting them from annual caps.

Or, in nautical terms, an enclosed area on a boat or ship that houses the steering wheel. Call it what you want, most GCBAA members have tremendous power in their wheelhouse. And most golf course builders will be hard-pressed to rely on old tools and tactics in the years to come.

The needs, capabilities, and impacts of your wheelhouse will define the next generation of golf course development, construction, and reconstruction…and the future success of your company.

Changing Needs – Planners and developers of new golf projects require greater accuracy, time adherence, and financial discipline. Investors and planners in new golf projects will allow for less uncertainty in golf course construction projects. Likewise, most such companies are well-stocked with smart young MBAs chomping at the bit to demonstrate their intelligence and capability. Golf course builders will be caught in the middle when the client’s financial and planning team is more sophisticated and capable than that of the builder.

Golf course builders will need formidable skills in the following capabilities, in addition to others:

Financial Forecasting and Estimating –Developers and bankers will look more and more at construction estimates from golf course builders, who are most current and familiar with supply chain influences and exceptions. Financial houses of bankers, investors, and analysts will require greater accuracy and transparency from builders.

Data Management and Analytics –GCBAA members must establish the baseline metrics that define the business segment around golf course construction. Participants – from legal to financial – will rely upon GCBAA metrics when these metrics are shown to be category standards of best practice. For example,

• Unit-Count Measurement – Helping all parties to understand the financial structure which relies upon unit-count accuracy – such as the number of square feet of turf being required and used or the

cost per foot of irrigation components.

•Unit-Cost Pricing – Increased transparency will be beneficial and demanding for golf course builders who must develop pricing and budgeting take-offs on which all parties can rely…and will contest until proven to be the standard of best practice.

• Real-Time Tracking – Builders will be asked to provide in-process financial updates which identify unexpected and / or unbudgeted disruptions to the previously established construction costs and financial projections.

In-Process Project Management – There will be no “black box” in which golf course builders can work and from which they will emerge with final billings. Investors and bankers will require in-process financial updates and communications from the builder. These communications will tie directly to preset measurement metrics and require timely updates and in-process financial revisions.

New and Emerging Capabilities – Future golf course projects are already changing in scale and scope. Investors, lenders, and project developers are requiring more timely and accurate estimates of costs. They will demand in-process communication that reduces lastminute changes to financial projections and agreements.

Builders have begun to invest in technologies that enable efficient process and project tracking. Among the capabilities that will be required in the rising generations of golf course construction projects are:

• Locational and topographical modeling which will enable developers and investors to “see” what the eventual terrain may be. People who lack experience or understanding of golf course construction will want and need three-dimensional models to ‘show’ them what the golf course designer and the builder envision for the golf facility. Note that changing hole counts and courses with various scale will demand sophisticated fiscal management.

• Financial projection software which enables side-by-side comparative analysis of financial alternatives and impacts. Investors, lenders, and owners will seek ever increasing understanding of their

projects and the cash requirements of the builder. Builders who anticipate and serve this new-found need will enjoy continued demand and project capacity.

Enduring Impacts of a Fortified Wheelhouse

– Many of the needs and expectations that will be placed before golf course builders will be too much for those who prefer the comfort of familiarity and “doing like we’ve always done it.” Although holding on to outdated practices may feel safe or comfortable, reliance on this approach will serve as a competitive disadvantage to golf course builders.

Next-generation builders will bring new energy, practices, and expectations for GCBAA members. Among the advantages to be gained are:

• Supply-Chain Advantage – Suppliers have their own pressures so keep your needs highly transparent and time-driven. Advance planning will give golf course builders more reliability within their own supply chains while enabling more gratifying outcomes for all stakeholders.

• Market Differentiation – Some builders will be slow to adopt new technologies while adapting to the new normal described here. Those who are early adopters will be rewarded with more business through market differentiation and advanced capabilities.

• Segment Leadership – Changing demands, emerging opportunities, and the passage of time combine to disrupt the business segment overall. Golf course builders who lead the way to embrace new opportunities will benefit.

“That is certainly in our wheelhouse.” A statement made by so many builders will mean vastly different things a few years from now. Developing a more robust range of tools and talents is the key to expanding the influence of your wheelhouse.

EMPLOYMENT LAW Update

Employment law in America continues to be a dynamic field. The summary below is intended to keep employers well-informed of a few important changes to best position themselves to maintain compliance and, importantly, avoid liability.

OSHA’s National Emphasis Program on Heat

Last summer, our colleagues Tony Stergio and Adam Robertson published an excellent article in GCBAA’s Earth Shaping News about OSHA’s National Emphasis Program (“NEP”) on Heat. The authors discussed the purpose behind the heat-specific NEP, as well as OSHA’s heat guidance. Below is further guidance for the outdoor employers’ consideration.

OSHA’s heat-NEP created a nationwide enforcement mechanism for OSHA to inspect heat-related hazards. Under this guidance any day with a heat index of 80 degrees or higher is considered a “heat priority day” where OSHA will conduct more frequent inspections. Additionally, OSHA’s guidance indicates that they will pay particular attention to sites where workers are performing strenuous work on heat priority days without easy access to cool water, or cool/ shaded areas. Thus, companies in the golf-course construction industry must continue to take proactive measures, including implementing policies, training, and protocols to enforce heat illness and injury prevention programs.

This emphasis program will remain in effect until April 2025. This summer, OSHA remains committed to reducing and preventing heat illness and injury as described in this emphasis program. When OSHA inspects for heat-related hazards it will look for written heat prevention plans which:

• Call for heat acclimatization for new and returning employees.

• Heat-related buddy system for employees.

• Access to cool water and shade on a schedule.

• Training on signs, symptoms, and prevention of heat illness.

Regulators Take Stand Against Employee Noncompetition Agreements

In January, the Federal Trade Commission (“FTC”) published a proposed rule that would prohibit employers from entering into a postemployment noncompete agreement with employees and require employers to rescind existing post-employment noncompete clauses.

It is estimated that approximately 20% of American workers–or about 30 million people–are bound by a noncompete clause. In support of the proposed rule, the FTC contends that noncompetes hinder competition, reduce workforce mobility, and suppress wages for all workers. The FTC rule would apply only to postemployment restrictions, not restrictions on the conduct of current employees. Thus, employers may still require current employees not to engage in competing activity.

If implemented, this rule renders all post-employment noncompete agreements immediately unenforceable . The rule would require the rescission of all existing noncompetes and an employer to notify the worker that the noncompete clause is no longer in effect. Additionally, the rule would supersede any state statute, regulation, order, or interpretation. Thus, businesses should closely follow developments on the proposed rule and begin preparing to protect themselves if it is implemented.

The proposed rule has attracted considerable attention, and the agency received more than 27,000 comments during the comment period. In keeping with the federal rulemaking process, the commission will review the comments and

consider rule changes before voting on the final version. The FTC is expected to vote on the final version in April 2024.

Likewise, the National Labor Relations Board (“NLRB”) recently issued guidance clarifying its position that most noncompetes are illegal under the National Labor Relations Act (“NLRA”) as they serve to suppress employees’ rights to leave employment due to poor working conditions. We expect that employers nationwide will test the NLRB’s new hardline approach in federal courts, which means employers should carefully monitor the enforceability of noncompetes in their respective locations and consult an attorney for any questions.

CROWN Act Legislation Gains Traction in State Legislatures

The Creating a Respectful and Open World for Natural Hair (“CROWN”) Act is a resolution intended to eliminate discrimination based on a person’s hair texture or hairstyle, in housing, education, and employment opportunities. The CROWN Act was originally introduced as federal legislation in 2019. But the bill did not pass the U.S. Senate.

While efforts to pass the CROWN Act at the federal level are uncertain, efforts at the state level are progressing. Twenty-two states have enacted versions of the CROWN Act, amending their anti-discrimination laws to adopt protections against hair discrimination.

While many state CROWN Acts are similar, each version varies. Employers in states with enacted CROWN Act laws should review dress code and personal appearance policies to ensure compliance with applicable laws and integrate this new protected characteristic into management training.

Setting a Course for Paradise–BUILDING POINT HARDY GOLF CLUB AT CABOT ST. LUCIA

By any standard, the nearly complete Point Hardy Golf Club at Cabot St. Lucia is offthe-charts spectacular. However, there are countless challenges that come with building and growing-in a golf course on a small Caribbean Island. The design, construction and maintenance teams had to come up with one innovative solution after another to overcome Mother Nature and a host of other challenges.

A challenging build

Architects Bill Coore and Ben Crenshaw were entrusted with the task of designing a golf course befitting the dramatic coastal landscape, but bringing their vision to life would be no easy feat. Covid hit shortly after construction began, leading Coore and Crenshaw associate Keith Rhebb to stay on St. Lucia for 265 straight days to continue shaping the golf course and keep the project on track. Moving the heavy, rock-laden soil to shape the course’s features through canyons and alongside cliffs took experienced operators and was even more challenging during the island’s rainy season.

“Basically, we had to move a lot of dirt just to get some of these golf holes built and make them playable,” said Rhebb. Working on the severely sloped, rocky site created both short- and long-term challenges, especially with erosion. Rhebb noted that “All the rainfall gathers and runs down these big ravines to the ocean, where it cuts canyons into the cliffs.” To route the course along the ocean while minimizing the potential for erosion, various techniques were used to shore up the coastline and backfill the canyons, enabling Coore and Crenshaw to hug the seaside cliffs with their design and bring the Caribbean into play on half of the holes.

Managing drainage and erosion

The site’s rocky soil meant that some form of capping would be required to finalize the contours and create a suitable growing medium for turf. Shipping in sand-cap material from somewhere off the island was prohibitively expensive, so the playing surfaces were topped with a volcanic pumice sand sourced from a quarry in the middle of the island. The sand was screened off-site then spread 4 inches deep over the roughly graded soil and 12-18 inches deep at green sites. However, using native pumice sand meant accepting some lessthan-desirable soil physical characteristics – e.g., an infiltration rate less than a tenth of an inch per hour.

An emphasis on surface drainage will keep turf healthy and playing well once it’s established, but erosion was a significant concern during grow-in. The maintenance team devised a number of ingenious erosion-control systems to manage surface water until the grass was established.

Grassing

The grass selected for all surfaces is ‘Pure Dynasty’ seashore paspalum. The course was seeded wall to wall with the salt-tolerant turf. A combination of factors, including salt content in the irrigation sources and the impact of salt spray from the ocean, drove the decision to use paspalum.

The irrigation situation

The facility currently uses reverse-osmosis plants to desalinate seawater and irrigate the golf course, lawns and resort grounds, but will eventually hook up to the local wastewater plant and mix the two water sources.

The irrigation system is designed to provide only partial coverage along the edges of the holes. This

intentional reduction in coverage not only decreases water use, it also facilitates the rough-around-theedges look the architects wanted, with a gradual transition from paspalum to the surrounding native vegetation.

Supply ships

Whether it’s irrigation hoses, mowing equipment or anything else, at times golf course superintendent, Damon Di Giorgio, has been unable to get what is needed, when it’s needed.

“In America, if you need something you run down to Lesco and grab it,” said Di Giorgio. Delays due to shipping or customs impacted everything from seeders to soil tests. On one extreme occasion, a weekly supply ship was delayed after being diverted by the French Coast Guard to help rescue sailors on another ship.

Another wrinkle in the agronomic program is getting permission from St. Lucia’s pesticide board to import or use any pesticides that aren’t on the independent country’s short list of approved products.

Finishing touches

Despite all these challenges, the maintenance team repeatedly finds a way to get the job done and keep the grow-in on track. Di Giorgio and his team will be putting the finishing touches on the golf course this summer. If the weather cooperates, Point Hardy Golf Club will open in December 2023.

Iwas sorry to miss the GCBAA Summer Meeting this year, because every GCBAA event I have attended has been nothing but first class. We sent our most “geographically advantaged” members, including incoming President Mike Benkusky, Greg Martin, Todd Quitno from neighboring Illinois, and Kevin Norby from Minnesota to Wisconsin.

There was a continuation of our discussions on how contractors and architects can work together better. The discussion arose organically at the GCBAA December 2022 Breakers meeting and was more formal at the ASGCA education sessions in Orlando back in February 2023.

In speaking with both builders and the architects who participated in the latest panel,

most noted that they learned something from the panel, which is difficult to achieve in such an experienced group.

However, each noted that perhaps because of our decades-long efforts to promote the closeness of our two organizations, the discussions were almost too polite and deferential, with almost too much agreement. One said he expected the session to be more like Seinfeld’s Festivus and it’s “airing of grievances.” He suggested anonymous audience provided questions and/or picking more outspoken panelists to “stir the pot” and highlight some of the trickier parts of the architect-builder relationship.

Even if we have hugged it all out, the discussions are still valuable. Perhaps the next

step might be to take the discussion “on the road” to educate owners, superintendents, and project representatives to make better decisions.

Justin and I are already working with the GCSAA, USGA, and others to create this year’s GCSAA Interactive Learning Stage. If we can land the seminar spots, it may be a great first step in teaching others, which would be of mutual benefit for our two organizations.

I’m looking forward to our next joint gettogethers as both organizations seek to improve educational and professional value to our members.

The Golf Course Superintendents Association of America (GCSAA), in conjunction with other global superintendent groups, is recognizing those who are essential to golf’s success with an international “Thank a Golf Course Superintendent Day,” encouraging all those who love golf to thank their course’s superintendent. “Thank a Golf Course Superintendent Day” 2023 will be celebrated Sept. 12.

In addition to GCSAA, other groups taking part in the global event include the British and International Golf Greenkeepers Association (BIGGA), the Australia Sports Turf Managers Association (ASTMA), the Canadian Golf Superintendents Association (CGSA) and The Federation of European Golf Greenkeepers

Associations (FEGGA). All together the groups represent more than 31,000 golf course management professionals in 78 countries around the world.

The celebration will include commercials that will appear on the Golf Channel and other media outlets and social media messages sharing the many ways that superintendents benefit the game and their communities. Golfers and others are encouraged to join in the conversation on social media using the hashtags “#ThankASuper” or “#ThankAGreenkeeper” depending on their country’s nomenclature. In addition, golf courses and other groups are encouraged to provide special recognition for their superintendent and course maintenance staff on Sept. 12.

CMAA EXPANDS Talent Development Initiatives

Students have long been a very important member community for the Club Management Association of America (CMAA). More than 38 student chapters and colonies exist at colleges and universities across the country. By joining during college, these students are taking steps to further their professional and career development through meetings, events, practical experiences, internships, education, and conferences. Over the past several years, CMAA has expanded its engagement, investment, and outreach with current and potential student members, helping to drive more talent into the club management industry. Students today have many choices in the hospitality landscape and may not even be aware of the wealth of outstanding career opportunities in the club industry.

#ChooseClubs

During the 2023 World Conference and Club Business Expo in February, CMAA officially launched its #ChooseClubs campaign with the unveiling of an educational recruitment video. It is the first component of the full #ChooseClubs campaign that CMAA will be launching to current students, hospitality faculty, and others interested in the field.

The video showcases how clubs are not just a great place to belong; they offer outstanding employment opportunities. The club industry has more than 2,600 clubs with more than 200,000 full-time employees. The club industry is very diverse in the numerous job opportunities available to workers. Most think of food and beverage when they think of hospitality, but clubs go much further than that. There are positions available in Events; Accounting and Administration; Human Resources, Membership, Marketing, and Communications; Golf; Racquet sports; Spa, Fitness, and Wellness; Culinary; and Aquatics.

Clubs are encouraged to share the video in their recruitment efforts, and can access the video via CMAA’s website at cmaa.org.

Verified Club Internship Program

CMAA has launched a Verified Internship Program to elevate and streamline club internship offerings. Because clubs differ widely in their membership size, culture, and offerings, it may be difficult for students to know exactly what they can expect from their internship experience. This verified internship criteria helps manage the expectations of students, faculty, and managers, and holistically showcases what a career in the club industry can look like.

For a club to qualify for designation as a CMAA Verified Internship Program, the following criteria must be met and submitted to CMAA for review annually.

1. Must be a paid internship, meeting all applicable state and federal wage and hour requirements.

2. Must encompass at least 300 hours (inclusive of time worked, education programming, etc.)

3. Must offer at least 10 hours of educational programming opportunities.

Offerings must be completed from at least two of the following categories:

• Department rotations

• Club orientation

• Leadership

• General Manager meeting

• CMAA education

• Purveyor education/tours

• Résumé review

• Interviewing practice

4. Must provide on-going feedback to program interns.

•One-on-one meetings with the direct supervisor or internship program facilitator must be held no less frequently than twice a month.

5. Must complete an end of internship exit interview/program evaluation.

• Student/Intern Reflection – how are you better from this experience? What did you learn?

• This evaluation must be submitted within one month of completing the program

A SEASON OF Regulation

As we wrap up the summer of 2023, the National Club Association (NCA) is anticipating an active legislative and regulatory period. While the congressional calendar is filled with familiar agenda items such as government funding bills, we anticipate the regulatory agencies in Washington will be very active. The White House has been busily clearing regulations for publication over the summer and at the end of August, several have been sent back to the Department of Labor (DOL) and Environmental Protection Agency (EPA) to be finalized.

WOTUS

Earlier this year, the Supreme Court issued a decision in Sackett v. EPA that significantly affected the EPA’s authority to regulate bodies of water that have long been the subject of backand-forth regulatory actions and litigation about what constitutes a “significant nexus” to waters regulated by the EPA. The Supreme Court’s opinion effectively eliminated the use of significant nexus as a test to capture more jurisdiction for the EPA. This decision forced the EPA to review its Waters of the United States (WOTUS) regulation that went into effect in March of this year. The EPA is expected to release a revised WOTUS regulation the last week of August and there is great concern among stakeholders about the process the agency went through to revise the rule due to the fact the EPA did not follow a notice and comment process.

Labor Issues

The DOL has largely been on hold with several anticipated regulations from the Wage and Hour Division on overtime and the Occupational Safety and Health Administration (OSHA) on

“walk-around inspections” and a potential heat exposure standard. In addition to those two regulations, we anticipate movement on worker classification as an independent contractor at the DOL, and union representation elections from the National Labor Relations Board (NLRB). There has been a bottleneck at the DOL due to the departure of Secretary Marty Walsh early this year and the stalled nomination of Acting Secretary Julie Su. While the Senate worked to get her nomination cleared before the August break, it was clear she would fall short of the required votes when Sens. Joe Manchin (D-W.Va.) and Kirsten Synema (D-Ariz.) signaled their opposition to her nomination. With the nomination out of the way and Plan B in effect (to move forward without a confirmed secretary) it cleared the political path for some of the more controversial regulations to be finalized, which is where we stand today.

Heat Regulations

The OSHA heat exposure standard follows a National Emphasis Program the agency has had in effect for more than a year and which was elevated due to a recent spate of record high temperatures around the country. On August 25, OSHA released a regulatory framework on heat injury and illness prevention for outdoor and indoor settings that raises some serious concerns about the direction the agency is taking—particularly with respect to the temperatures the agency is considering “heat-triggers.” Although OSHA indicates these are minimums, the chart provided shows a forecasted heat index of 76 degrees Fahrenheit as the trigger for increased protocols to prevent heat-related illness and injury. It’s a particularly interesting choice since the Department of Energy and the EPA recommend Americans set

their home thermostats to 78 degrees to cool their houses in the summer. There’s a lot more to the framework released by OSHA, and NCA will be keeping members apprised of developments and weighing in with the agency on its impact on clubs.

Walk Around Rule

Another regulation of concern to NCA is OSHA’s resurrection of the so-called “walk around rule.” This regulation would allow workers and their representatives to identify an individual to accompany OSHA inspectors on facility walkarounds, regardless of whether the individual is an employee or if the workplace is unionized. The concern among the business community is that individuals seeking to accompany inspectors could very well be union organizers, environmental activists or other actors engaged in a campaign against the employer or industry, and use the inspections as a means of gathering information about the workplace for the purpose of organizing or obtaining proprietary information. This policy was originally attempted by the Obama Administration in 2013 through a letter of interpretation, but later struck down by the courts and withdrawn by the Trump Administration.

My advice for those interested in government policy and how it affects our businesses is to keep an eye on what’s happening in Congress, but watch very closely what happens in the regulatory agencies. We could be in for a deluge of regulations this fall.

The grant program to date has provided 237 grants to 137 unique grassroots organizations, totaling more $1.8 million (May 2021: 43 grants totaling $150,000; Jan. 2022: 31 grants totaling $150,000, June 2022: 81 grants totaling $750,000, May 2023: 82 grants totaling $750,000). The program was established to support organizations dedicated to increasing participation among golf’s underrepresented populations –Black, Latinx, Asian, Indigenous communities, as well as women, LGBTQI+ individuals, veterans, and individuals with disabilities.

“Diversity, equity, and Inclusion must be woven into the fabric of the game,” said Jay Monahan, Commissioner of the PGA TOUR and executive sponsor of the Make Golf Your Game area of

commitment for Make Golf Your Thing. “This is not an easy task, and it requires all of us to participate fully. The industry coming together to broaden the reach of our great game is positively impacting communities in way none of us can do alone.”

Formally launched in May 2021, Make Golf Your Thing is the industry’s movement to diversify all aspects of the sport. The movement is organized into three strategic focus areas for increasing diversity: Make Golf Your Game (participants), Make Golf Your Career (industry employees), and Make Golf Your Business (industry suppliers). The grant program is an ongoing centerpiece initiative within Make Golf Your Game.

The application period for this fourth phase of funding saw a record 122 applications. Each application was reviewed by a team of 24 volunteers who have extensive experience in expanding grassroots golf organizations. Grantees were selected based on population served, leadership, programming offered, growth potential, and sustainability.

Funding for the grant program is being administered by the American Golf Industry Coalition, a partnership among golf’s leading organizations to promote and advocate for the collective interests of the sport. Financial support

for the program is led by a contingent of industry supporters that are committed to making the sport more welcoming and inclusive for all.

JUNE 15, 2023, CANBY, OREGON/ LAGRANGE, GEORGIA – As the 2023 Ryder Cup approaches, the host venue, Marco Simone Golf & Country Club, stands ready with turfgrasses from Pure Seed and Atlas Turf International. For the first time in the competition’s history, the iconic duel between Europe and the United States will occur in Italy. When the 44th edition of the Ryder Cup begins in late September, the stage will be set with a complete portfolio of championship turfgrasses, including Pure Distinction Creeping Bentgrass, Pure Dynasty® Seeded Paspalum, and PureLinks Fescue.

Marco Simone, located in Guidonia just northeast of Rome, underwent a complete redesign in preparation for the Ryder Cup. Originally designed by Jim Fazio and opened in 1989, the golf course needed to be transformed

to host the world’s largest golf competition. European Golf Design was selected for the job with lead architect Dave Sampson spearheading the redesign. For the turfgrass, the challenge entailed selecting the varieties best suited for the climate, possessing the ability to execute the designer’s vision, and most capable of delivering playability up to par with the legendary golf challenge.

The turfgrasses meeting the demanding criteria are nearly all developed by PureSeed Testing, distributed by Pure Seed, and co-marketed by Atlas Turf International. Pure Distinction Creeping Bentgrass is the greens selection. Tees, fairways, approaches, and collars feature Pure Dynasty Seeded Paspalum, and the roughs are Pure Links, a proprietary blend of tall and fine fescues.

In addition to Royal Greens, Pure Dynasty is the turfgrass of choice at golf courses and sports fields on five continents.

Rounding out the turfgrass selection at Marco Simone is PureLinks fescue in the roughs. The specially designed blend of the highestperforming tall and fine fescue varieties delivers the desired characteristics of playability, color, disease and drought resistance, salt tolerance, and quick establishment.

“In terms of the rough, we always wanted the particular style and look of fescue,” said Sampson. “For playability, the rough is going to be deep, and it’s going to get juicy. And that is what they want. If you hit in the fairway, you’re rewarded.”

Sustainability factored into the entire redesign and specifically regarding the turfgrass.

“We’ve realized a 30 percent water savings by choosing the grasses we have and by getting a state-of-the-art irrigation system,” said Sampson.

The majority of the PureLinks fescue varieties selected are qualified by the Turfgrass Water Conservation Alliance for demonstrating a statistically significant water saving potential across rigorous multi-year drought trials.

“The beauty of a golf course is in the different textures, colors, and heights of the vegetation that challenge the golfer and complement the aesthetics of the environment,” said Rose-

Fricker. “These various turfgrasses bring different traits to the golf course palette, such as salt tolerance, disease resistance, a variety of textures, and beautiful green colors. Together, they create a unique golfing experience for the player and the spectator. From our perspective, it is a chance to showcase the different products we develop, produce, and market around the world in one event: the Marco Simone Ryder Cup.”

Ryder Cup selected Marco Simone as a venue in 2015, and the redesign began in 2017. Among the challenges that Sampson faced were COVID-19 (which caused the original event date to be pushed from 2022 to 2023), archaeology, gas lines, and electric lines.

In addition to the Marco Simone 11thcentury castle, which is an Italian national monument, the property also includes two sites of archaeological significance. The most prominent is the remains of a first-century Roman villa close to the tenth tee box. Working around these protected areas as well as the gas lines and arranging the burial of the five-pylon electrical line, added to the complexity of the job.

“For these reasons, this project seemed to throw out a few more challenges than others,” said Sampson. “You have to be flexible.”

Complicating the task even further are the unique requirements of designing a venue that will accommodate massive crowds of spectators and the hospitality areas essential to Ryder Cup sights.

Once these issues were resolved, the design was completed, and the site was prepped, seeding of the front nine holes took place in the summer of 2019. The back nine were seeded in 2020. Three subsequent Italian Open championships and visits from the Ryder Cup captains of the European and United

States teams gave the finished redesign ample opportunity for assessment.

“Zach Johnson, [captain of the U.S. Ryder Cup team], said when he went over there that the golf course is going to challenge every shot in the book,” said Sampson, “and that, for me, is a great feat. It’s ultimately what you want to hear. This has been an amazing project to be involved with. Unbelievable. I count myself very fortunate.”

All of the turfgrasses featured at Marco Simone, with the exception of two components in the fescue blend, are products of Pure-Seed Testing, Inc. Schaupeter designs include TPC Colorado in Berthoud, Colorado; The Highlands of Elgin in Elgin, Illinois; The Club at Old Hawthorne in Columbia, Missouri; and Highland Meadows in Windsor, Colorado.

PALM DESERT, CA – West Coast Turf is introducing their new line of Ready Play Grass® natural grass sod grown on plastic for instant use.

“We have been growing sod on plastic for several years,” said West Coast Turf’s Arizona operations general manager, Jay Danek. “We are confident in the product we’ve developed over that time and wanted to bring Ready Play Grass to a bigger market. There is a need for a grass surface that can be used right away.”

“The reason its grown on plastic is for the strength of the plant itself,” Danek explains. “Similar to when you buy a plant at a nursery, where the roots are bound in a ball, since they can’t go through the plastic it makes the strength of the sod three to four times of what a normal sod field is by becoming rootbound. The intertwining roots develop a tight mat of rhizomes to firm up the surface, giving it a sturdy base of strength. It weighs about 18 pounds per square foot and can be grown up to 2 inches thick. After the sod is put down, it is not going anywhere. You can play on it instantly. Since we don’t cut the roots, there is no shock factor to the grass and it is able to start rooting immediately—although it doesn’t have to be rooted for use.”

“We start off with a sod product that has been through its growing cycle of anywhere from 8 to 12 months, and then another 6 to 15 months growing on the plastic. We grow it with sod strength and

weight in mind so there is no movement. Our proprietary harvest technique allows for sharp and tight seams so the rolls mesh together perfectly,” Danek said.

Ready Play Grass is ideal for sports fields, golf course tees and driving ranges, and on top of artificial turf fields when a temporary natural grass field is required.

Turf grows more than 30 varieties of grass and is the West’s largest grower of drought tolerant warm season turfgrasses.
