BENJAMINGAITHERCENTER ACTIVITYRELEASEFORMEMBERS

Whenparticipatinginon-siteactivitiesattheBenjaminGaitherCenter,Iagreetothefollowing:

1. IamawarethatwhileparticipatinginarecreationactivityorprogramofferedbytheCityofGaithersburgDepartment ofParks,RecreationandCulture,certainrisksanddangersmaybepresent,including,butnotlimitedto,thehazardsof travelingpublichighways,ofaccidents,ofinjury,ofillnessandtheforcesofnature.

2. IattestandverifythatIhavefullknowledgeoftheriskinvolvedinphysicalfitnessactivitiesandthatIhaveobtained approvalfrommyphysiciantoparticipateinthesame.

3. Inconsiderationoftherighttoparticipateintheabovereferencedactivitiesorprogramsandinfurtherconsideration ofthearrangementsmadeformebytheCityofGaithersburgthroughitsDepartmentofParks,RecreationandCulture,I dohereby,onbehalfofmyself,myheirs,executors,administrators,andassigns,assumetheabovementionedandall otherrisks,anddofurtherreleaseandholdharmlessandindemnifytheCityofGaithersburgandtheMayorandCity CouncilofGaithersburgandalloftheCity’sagents,officersandemployeesfromanyandallclaimsforinjuriesorlossto mypersonorpropertyortothepersonorpropertyofthirdpartieswhichmayariseoutoforresultfrommyparticipation intheabovereferencedprogramoractivity.

4. Ifurthergrantpermissionforadoctortoadministeremergencytreatmenttomeintheeventthatamedicalemergency requiressuchtreatment.

5. IconsenttotheCity’suseofphotographstakenorvideotapesmadeofprogramparticipants.

6. TheCityreservestherighttorescindthemembershipofindividualsincapableofcomplyingwiththeBenjamin GaitherCenterpoliciesduetomedicalconditionsbeyondtheindividual’scontrolasobservedbytheCenterstaff. Whenparticipatinginanyoff-siteactivities,Ialsoagree:

1. Toobeytherulesandregulationsforeachactivity,followalldirectivesandadheretotheagendaasoutlinedbythe staff.

2. ThatifIdonotclearlyunderstandhowanactivityisperformedordetailsofatrip,Iwillaskastaffmemberpriorto thebeginningoftheprogramtoclarifymyquestions.

3. ToinformstaffpriortotheactivityortripifIhaveanyproblemsmeetingthephysicalrequirementsnecessaryfor participationintheactivity.

4. Iagreetolistencarefullytothedetailsandtimingofthetripandbefullypreparedtomeetandboardthebusatthe properdesignatedplaceandtime. Iunderstandthat,intheCity’ssolediscretion,Imayberesponsibleforpayinganyand allreasonablechargestheCitymayincurasaresultofmyfailuretomeetandboardthebusattheproperdesignatedplace andtime.

Furthermore,IunderstandthatasaparticipantoftheprogramIwillbeexpectedtodeparttheBenjaminGaitherCenter andreturntothesaidlocationwiththegroup. Anydeviationfromtheactivityitinerarywillprecludemefrom participatinginfuturetrips,activities,orotheroff-siteadventures.

Trip&ClassCancellations

1. Tripsandclasseswillbecancellediftheminimumnumberofregistrantshasnotbeenmetbythedeadline. Ifthis occurs,afullrefundwillbeissuedtoallregistrants.

2. Ifthedetailsofatriporclasschange,allparticipantswillbenotifiedandgiventheoptiontowithdrawwithafull refund.

3. Ifaregistrantneedstocancelbeforetheposteddeadline,a$2processingfeewillbechargedandarefundwillbe issued.

4. Ifaregistrantcancelsafterthedeadline,effortswillbemadetosellyourseat,ifnot,arefundwillnotbeissued.
