Dear Members

T

he recent developments are an indication that economy is facing rough weather conditions and businesses have tough times ahead.

The RBI, the IMF, investment banks, rating agencies have all recently cut their estimation of 2019 growth rate to below 7% and the government is likely to revise the rate to 5.8%. The slew of measures announced by the Finance Minister to stimulate the economic growth shows that government has finally taken note of industrial sluggishness and the urgent need to take remedial measures.

The auto industry had the lowest growth since December 2000 with sales of new passenger cars dropping by 35% year on year. The RBI decision to transfer Rs 1.76 lakh crore to the government as a bailout to overcome the revenue deficit is unprecedented and is spreading the fears that economy is much weaker than what it was told / shown. The RBI bailout provides breathing space to the government but how this transferred amount would be utilized is critical for stimulation of growth.

The private sector investment, the mainstay of sustainable growth in any economy, is at a 15 year low. The picture is gloomy. But, I am confident that Indian industry has faced many crises and come out of them and our entrepreneurs are strong and confident and sail through the tough situations. What the industry expects from the government is to be little soft on tax and stimulus measures.

The various measures announced by the Finance Minister come at a time when the world economy is facing trade slowdown. The multi-sectoral and multidimensional policy stimulus will help impart stability and economy will be able to recover in the coming months.

The comprehensive measures removing enhanced surcharge on FPIs and Domestic Investors, securing transmission of lower repo rates, addressing delayed payments are targeted towards raising investments and stopping of withdrawals by foreign investors.

I am pleased to inform the members that the FTCCI organized five events in the last one month that are extremely useful and successful.

The interaction with Income Tax officials on e-filing, awareness program on GST New Returns, interactive meet on Code on Wages 2019 were aimed at knowledge and information dissemination. The Bankers Conclave on MSME financing opportunities helped the small enterprises materialize their projects and opened up avenues for financial assistance from organized sector. I am thankful to His Excellency Dr Ron Malka, Ambassador of Israel to India for visiting FTCCI and interacting with the members on various business opportunities with Israel.

The new return system is significantly different from the current format with a focus on real-time upload and matching of invoices on a month to month basis.

MNRE issues norms for second phase of rooftop solar programme In a bid to promote grid-connected rooftop solar system and to promote sustainable business models, MNRE comes up with guidelines to provide financial assistance and incentivise the discoms The Ministry of New and Renewable Energy (MNRE) has issued guidelines for implementation of the second phase of the grid-connected rooftop solar programme for achieving the target of 40,000 Megawatt (Mw) capacity from rooftop solar projects by 2022.

The government has set a target of achieving 100,000 Mw of solar power capacity in the country by 2022 of which 40,000 Mw is likely to be achieved from rooftop solar systems.

In December 2015, the centre had approved the ‘Grid Connected Rooftop and Small Solar Power Plants Programme’ for installation of 4,200 MW rooftop solar plants by 2019-20. Of this, projects of 2,100 MW capacities were to receive Central Financial Assistance (CFA).

The government approved PhaseII of the project in February this year. The key objectives of the program include promoting gridconnected rooftop solar plants in all consumer segments, bring 8

discoms at forefront as key drivers for rooftop solar plants and to create additional rooftop solar capacity in the country.

The second phase of the programme has two main components. Under the first component, 4,000 MW of grid-connected rooftop solar projects will be installed in the residential sector with CFA. The assistance has been restructured and higher CFA up to 40 per cent will be given for systems up to 3 kW capacity.

• For capacity above 3 kW and up to 10 kW, a CFA of 40 per cent would be applicable only for the first 3 kW capacity and for capacity above 3kW, the CFA given would be 20 per cent.

• The CFA will not be available for other categories such as institutional, educational, commercial and industrial sectors.

• Under the second component, incentives will be provided to discoms based on the achievement towards initial 18,000 MW of grid-connected rooftop solar plants.

• Since the discoms will require additional expenditure for implementation of rooftop solar systems programme for additional man-power, facilitating infrastructure and capacity building, these will be compensated by providing performance-linked incentives.

• The incentives will be provided for each MWp capacity of solar rooftop, added by them in their distribution area over and above 10 per cent of base capacity installed at the end of the previous year.

• The discoms will submit the cumulative capacity of gridconnected plants in MWp

installed in their distribution area as on 31 March 2019. This will be taken as the installed base capacity for the first year.

• The incentives will be given on incremental rooftop solar capacity installed by the discoms in their distribution area from the installed base capacity at the end of previous financial year within 12 months. Also, an online monitoring system will be set up by discoms to ensure satisfactory functioning of all the solar plants.

State Power distribution companies will have to hand over electricity supply businesses to multiple licensees or franchisees to get central government assistance or loans from the Power Finance Corporation said power and renewable energy minister RK Singh. This will give consumers the option of choosing from multiple electricity service providers like mobile number portability even before the Electricity Act is amended and quality of supply improved, he told in an exclusive interview.

The first step, which was necessary, was conveying that power is not a free commodity. So we mandate maintaining of letters of credit (LC) against power purchases. We are proposing that if states are announcing subsidies, they have to give direct benefit transfer into the accounts of consumers.

For tackling inefficiencies in metering, billing and collection, we want deployment of smart prepaid meters in the next three years.

For theft, we propose giving part assistance to notorious states for setting up aerial bunch cables or underground cabling and setting up specialised police stations on power pilferage.

One more thing which I am doing is that earlier there used to be separate schemes for system strengthening and separate schemes like Ujwal Discom Assurance Yojana for loss reduction. I am combining all and making assistance conditional.

So, the loss reduction trajectory will be set and we will release money only when you fulfill that benchmark.

The loans from Power Finance Corp and REC Ltd will be sanctioned only when the benchmarks are met. It has to be a complete package. The package will also require the distribution companies to have multiple power distribution licensees or supply franchisees in a particular area.

So, in every area, consumers will have options to choose from.

The wire business will remain with the DISCOMs and it will charge wheeling charges. The franchisees

will be appointed through bidding on commission basis. This can be done without amending the Electricity Act. The power ministry’s order to DISCOMs to open letters of credit in favour of power plants has been implemented by all states from August 1. Was there pressure from states to withdraw it, and how many aberrations were reported?

I will not name, but some chief ministers asked for more time. We said no. But they implemented it and now this has become part of the system. No power curtailments were required, barring a few in some states.

The LC order will ensure that there is no increase in DISCOM dues. But how will you recover the already accumulated dues?

The proposed Tariff Policy will mandate DISCOMs to pay on a first-in-first-out basis so the dues get cleared. It also provides that any late payment will attract late payment surcharge and even generators cannot waive it.

He met and submitted a letter to the Prime Minister complaining that there have been malpractices and he gave examples of some firms. That letter was referred to us and we are examining the matter.

Once you have signed agreements, you have to abide by them.

Indian economy set for weakest quarter of growth in 5 years The Indian economy likely expanded at its slowest pace in more than five years in the AprilJune quarter, driven by weak investment growth and sluggish demand, according to economists polled by Reuters.

That would reinforce concerns seen in the minutes from the central bank’s August meeting, which showed policymakers were worried about weak growth and indicated further rate cuts in the next few months to boost the slowing economy.

The poll median showed the economy was expected to have grown at a year-on-year pace of 5.7% in the June quarter, a touch slower than 5.8% in the preceding three months. But a large minority - about 40% of nearly 65 economists - expect an expansion of 5.6% or lower.

“A host of high frequency indicators - consumption and investment - have continued to weaken. The most prominent ones include auto sales, output of consumer durables, cement and steel production.”

The Reserve Bank of India’s central board accepted the recommendations of the Bimal Jalan committee on capital transfer and decided to pay Rs 1.76 lakh crore for the current fiscal year to the government, ending nearly a year of conflict between the regulator and its only shareholder on the quantum of dividend payout.

The adoption of the Jalan committee report ends the discretion enjoyed by the central bank’s board on payouts. From now on, dividend payouts would be based on a formula.

Importantly, the Jalan committee recommendations pave the way for the government to meet its fiscal deficit target for the year.

Booming agritech sector aims at solving supply chain woes 25% year on year growth of startups, 10 fold increase in funding from 2014; says NASSCOM With Indian farmers facing post harvest losses amounting to a whopping Rs. 93,000 crore, a slew of agritech start-ups are now trying to bridge that gap with demand driven cold chains, warehouse monitoring solutions and market linkages that can significantly boost farmer income.

According to a new study from Information technology industry body NASSCOM, these efforts to create supply chain efficiency are the focus of more than 50% of

India’s booming agritech industry, which has received 300% more funding in the first half of 2019 than in the whole of 2018.

In its report “Agritech In India: Emerging Trends in 2019” released this week, NASSCOM noted that India is home to more than 450 startups in the agriculture technology sector, of the global total of about 3,100.

Commerce ministry recommends 5% hike in duty on certain palm oil imports from Malaysia Imports from Malaysia increased from 6,26,362 MT in 2016-17 to 25,96,225 MT in Jan-June, 2019 thus showing an increase of 314%.

The commerce and industry ministry has recommended raising the safeguard duty on certain refined palm oil imports from Malaysia by 5% to curb cheaper purchases of the product.

The ministry’s investigation arm Directorate General of Trade Remedies has recommended the duty after conducting a probe into alleged jump in imports of “refined bleached deodorised palmolein and refined bleached deodorised palm oil” from Malaysia, following a complaint from Solvent Extractors’ Association of India (SEA).

“This has been done to safeguard the interest of domestic industry. It will help limit import of palm oil from Malaysia, thereby benefiting our farmers directly,” the ministry said in a statement.

India currently imposes a 40% import duty on crude palm oil and 50% on refined palm oils.

However, shipments of refined palm oils from Malaysia have since January been levied a 45% duty under the Comprehensive Economic Cooperation Agreement (CECA) with Malaysia, leading to a surge in refined palm imports in the first seven months of 2019 and causing serious injury to domestic producers.

Imports from Malaysia increased from 6,26,362 MT in 2016-17 to 25,96,225 MT in Jan-June, 2019 thus showing an increase of 314%.

Imports from other countries declined from 23,15,292 MT in 2016-17 to 7,25,210 MT in Jan-June, 2019.

Palm oil is used by several industries in food products, detergents and cosmetics, among others.

The ministry has recommended raising the duty for six months.

Stating that it is “noteworthy that import of “Refined Bleached Deodorised Palmolein and Refined Bleached Deodorised Palm Oil” into India from Malaysia under the CECA has been under investigation, the ministry said: “The recent step will have positive impact on domestic industries using palm oil, while giving a boost to palm growers.” https://economictimes.indiatimes. com/news/economy/foreign-trade

Reviving domestic and foreign investments was the focus- Sitharaman announced rollback of surcharge on super rich and long and short term capital gains.

Sitharaman said India’s economy is growing at a faster rate than any other major world economy. At a press conference in New Delhi, Nirmala Sitharaman and senior officers of the finance ministry announced a host of measures to boost the country’s economy.

Surcharge on FPIs rolled back: The focus of her press conference appeared to be investment, both foreign and domestic. Nirmala Sitharaman announced rollback of the surcharge on super-rich and long and short term capital gains. The surcharge had been announced in the Union Budget earlier.

It was estimated that the surcharge affected foreign portfolio investors (FPIs) adversely. The FPIs have withdrawn Rs 23,000 crore from domestic markets post-Budget. The Budget announcement of surcharge on higher tax-income groups reportedly affected 40 per cent of FPIs. The Budget announcement of the surcharge had pushed 14 | FTCCI Review | September, 2019

the effective income tax rate for individuals with taxable income of Rs 2-5 crore up to 39 per cent from 35.88 per cent and for those above Rs 5 crore to 42.7 per cent.

“Pre-Budget position is restored,” Nirmala Sitharaman said.

Relief for startups Listening to the industry din, the government announced a rollback of the angel tax on the startups.

“To mitigate genuine difficulties of startups and their investors, it has been decided that section 56(2)((viib) of the Income Tax Act shall not be applicable to a startup registered with DPIIT,” she said.

Also, a dedicated cell will be set up under a member of CBDT for addressing the problems of startups. “A

startup having any income tax issue can approach the cell for quick resolution of the same,� she said.

The angle tax was paid by the start-up on its end on the funding received from the investors.

Measures to accelerate auto market: For the auto sector, the finance minister announced a slew of measures including lifting the ban on the purchase of vehicles by government departments and allowing additional 15 per cent depreciation on vehicles acquired from now till March 2020.

Nirmala Sitharaman also announced revoking ban on the purchase of vehicles by government departments, which will now replace their old vehicles with new ones.

The auto sector is facing its worst crisis in almost 20 years. Sales of cars, tractors and other vehicles have been declining for months.

Withdrawal of enhanced surcharge levied on FPIs announced, restoring pre-Budget position. It is being done to encourage investment in the capital market, the finance minister said.

On goods and services tax (GST), Sitharaman said all pending GST refund due to micro, small and medium enterprises (MSMEs) will be paid within 30 days. In the future, GST refund on the new application will be paid within 60 days.

No prudent man either way can say anything else except an emphatic yes as the survival and growth of human life and the environment are inextricably interlinked. Climate change crisis is looming large and red alert is issued to the mankind with a warning to take remedial measures to bail out the globe from the ensuing disaster. The utter disregard and neglect by the mankind to the environmental challenges posed by the technological developments threatens the lives of all living creatures. Every one of us will agree that global warming has been steadily increasing and its impact is felt everywhere in every sphere of human life. The Paris conference has come to consensus that all countries should constantly and consistently study the causes and impact of climate change and assess the extent to which the globe is expected to warm up over the medium and long term. As per the Paris Agreement which will come into effect in 2020, all countries have agreed to do their bit to contain their green house gas emission to ensure that mean global temperatures do not rise beyond 1.5 to 2.0 degrees. The underlying realization by everyone in the Paris Conference is that economic ambitions can no longer be achieved by endangering the environment and at the same time green safeguards will certainly yield higher economic returns. That be the objective at macro level, Human Resources Manager at organisation level should use HRM policies to promote the sustainable use of resources for the cause of environmentalism.

Role of Human Resources Management: The understanding, in general, of HR Mangers is that environment and related compliance is the botheration of EHS (Environment Health and Safety) professionals.

HR Mangers should realize that sustainable environmentalism goes beyond regulatory measures. They should accept that environment concerns, policies and practices in the organisation that deal with environmentalism are integral part of Human Resources Management. It is an indisputable fact that environment and human resource are inseparable. No doubt a specialist EHS professional is primarily responsible for attending to and addressing the environmental concerns of the organisation but the HR Manger should also bestow his attention to the environment issues in the organisation that impacts the Human Resources and also have implication to the larger canvass of climate change. The role of HR Manger therefore cannot be underestimated. To discharge the role effectively and contribute to sustainable environment friendly initiatives and practices at enterprise level, HR Manger need to have proper and proactive understanding of the environment eco system within and outside the organisation. Brining business and environmental interests together to support a stronger organisation and a cleaner community should be the ultimate aim of all HR Policies and practices. It is very important to ensure clean and green surroundings in the organisation. It not only saves us from wastage but also provides healthy living. Healthy brain and healthy body obviously leads to efficient and effective working and thus increases productivity and higher Economic Returns.

HRM no doubt plays a vital role in environment management. At the

same time it is incomprehensible to expect him to be the sole person responsible for it. HRM, apart from EHS personnel, should lend his helping hand to the management with proper and proactive HR Policies to address the environmental concerns at enterprise level. The policies so designed should be inclusive or embracing the families of the employees as well addresses all the environment concerns holistically. HRM at the first instance should deal with the issues directly having employee interface and bearing on the environment. Jyorden T Misra points out, “ Eco conscious or colour of green is rapidly emerging in every dimension of our lives and work places are increasingly displaying an organised response to this challenge by bringing in professional consciousness at an institutional level as well as individual employee level.” While contributing to the organisation environment management, HRM should primarily look at the immediate environment concerns that have employee interface and initiate policies and practices to promote environment sustainability.

Corporates should promote and increasingly use web or teleconferencing to reduce travel. Hopefully employees are also increasingly realising and appreciating those practices will go a long way in benefiting people and

Recycling the used paper and paper waste can be thought of as better alternative to do our bit for reduction of cutting trees. Employees should be encouraged to participate in tree plantation programmes being taken up by government and non government organisations. Opens lands and spaces of the organisation should be filled with trees with involvement and ownership of employees by taking care of their survival. Increasing the green cover is only panacea for many climate change challenges.

No replacement, only refills: Plastic containers, polythene bags are used indiscriminating without realizing their adverse effects on environment. Usage of paper cloth

and jute bags should be encouraged.

HRM should provide, wherever possible, large or refillable containers of creamer, sugar, salt pepper and butter instead of providing individual containers to the employees. Proper disposal of e waste go a long way to protect the environment from its crisis.

Omission of green house gas emission: All of us are aware that CFC(Chloro Fluoro Carbon) (R22) gases are still in use in air conditioners and in HVAC system, leakage of CFC gases into environment will cause irreparable damage to the ozone.

The ill effects of ozone depletion are very well known to us. Efforts should be made to avoid usage of CFC gases and develop alternatives to safeguard the interest of nature and environment. The stakes of people at large and mother earth in particular are involved and therefore serious efforts should be made to create carbon neutral environment by everyone of us on the earth.

What HRM can do?

HRM efforts on environment should not restrict themselves to compliance of law but also incorporate green initiatives into their every day work environment. They should ensure environment sustainability through awareness and extensive training initiatives. No doubt the green initiatives and efforts of organizations involve both capital and revenue expenditure. Instead of paying huge price on account of polluter pay liability, cost on green efforts and initiatives should be treated as investment. There is a provision to offset the expenditure on environment protection measures against corporate social responsibility account under the Companies Act.

Understanding Wage Negotiations / Settlement(s) & its implications

In my past Personnel & IR Professional Career many contemporaries asked me a sarcastic question Why Wage Increase / Wage Settlement for every two to three years? An attempt has been made through this article. The simple answer is to maintain balance between Living, Fair & Minimum Wage. ay back in 1990s there were serious IR issues and Unions also in aggressive tendencies due to their Central Trade Union Ideologies.

Invariably no doubt “Trade Unions must work to protect and promote the interest of the workers and the conditions of their employment.” Subsequently, due to Liberalisation, Privatisation and Globalisation there was a considerable change in “Employer-Employee” relations and it’s approach more particularly about Settlement(s) / Agreement and etc., under the I.D. Act, 1947. The objective of the Act is to regulate and harmonize relationship between employers and employees for maintaining industrial peace and social harmony.

Whereas, under an “Industrial Establishment”, where there is an unionized environment, Recognized Trade Union (except single) will serve Charter of Demands (“COD”) for nothing but service conditions and economic demands with an expectation that they can mend employer by way of collective bargaining. Now, it became a two-way process. At the same time, we can also understand from the provision of 19 (2) of the aforesaid Act, there is a caution to Employer for forthcomingsettlement/agreement.

Usually there is a common apprehension in the minds of the employer whether to concede all the demands (ex: unrealistic and unreasonable) raised by the Union.

Certainly not, can be resolved at bipartite level with mutual confidence and fair terms. It is also known fact that few employers will not show willing to issue counter demands by explaining financial position of the 20 | FTCCI Review | September, 2019

company, requirement of necessary productivity level and overall business trends for the best reasons.

It was also proved through established practice that wage settlements are based on employer paying capacity, inflation andregion-cum-industry which is a settled principle. The Hon’ble Supreme Court had also opined the same through its different judgments from time to time. On the other end, Trade Unions also unequivocally accepting for long term settlements, positive view on multi skills, continuous improvement, qualitative product in terms of customer satisfaction and survival of the Industry in long run.

Further, true spirit of wage negotiation process is always

depends upon open-mindedness and trust from both ends. It is also responsibility of both the parties to maintain patience till completion of wage negotiations to avoid conflicts. Under the given situation, there should not be any misunderstandings between the parties; if any breakthrough would lead to grind halt of the negotiations.

The prime responsibility of the negotiation team/ committee is to reduce the gap and maintain industrial peace, social harmony and support for best industrial relations (ER) in the interest of the company and society at large. In turn both the parties will come to closer for a meaningful dialogue for best settlement. However, where the parties are failed to come to an understanding or conclusion on certain demands or issues they are at liberty to seek third party intervention. In the present context the Conciliation Machinery is an effective and would play a vital role in order to reach an amicable wage settlement up to satisfaction of all the parties to the dispute. Finally, it’s a ‘win-win situation’ and how best demands could be resolved without losing productivity and precious time. As the same depends on the knowledge of the union representatives about the concerned industry past, present situation and future expectations, so as to take some realistic stands instead of sticking to rigid and improbable points and further the management representatives also shall have concern over the human tendencies and motivation towards the work to be performed by the concerned workers, so as they can accept the justifiable demands of the union and resolve the issues amicably without leading to confrontation, which would not do good to anyone concerned i.e. workmen or management.

The Employer should act as head in an equitable manner for the welfare of working class/families and extend the settlement benefits to all the members without any undertaking or declaration. Any breach of trust may lead to unrest and Unfair Labour Practices (Fifth Schedule of the ID Act) which will affect organization’s reputation.

Thus an organization has to keep up ethical balance (work-family) while dealing with workmen/trade union(s) in order to maintain industrial peace, industrial discipline. The above few are very much required for rapid industrial growth of the nation in the present era.

Therefore, the Indian Society is not expecting that one more person should die beyond charred in violent clashes between two uncompromised mind set of groups by sticking to their unreasonable and unfair stands, in any case.

Implications Under The New (Indian) Consumer Protection Act, 2019

he Indian consumer protection framework received a much-needed overhaul with the Consumer Protection Act, 2019 (“COPRA”) receiving the presidential assent on August 9, 2019. The new COPRA will set up a new consumer grievance redressal body known as the Central Consumer Protection Authority, invested with wide-ranging powers, including search, seizures and summons and seems a step towards aligning Indian consumer protection laws with the global developments in this space.

Whilst hitherto e-commerce platforms/ online aggregators had the “intermediaries” defence, a key change has been to include such intermediaries under COPRA! Even though COPRA broadly retains the definition of who is a ‘consumer’ (from the 1986 Consumer Protection Act), it has introduced a new ‘explanation’ providing that when a consumer ‘buys any good’ and ‘hires or avails of any service’ this includes “online transactions through electronic means...”, potentially bringing e-commerce platforms/ aggregators within the new COPRA. Hence, potentially not just online marketplaces, but other digital aggregators may also come within the purview of the new COPRA going forward. Absent a carve-out for online aggregators, this is likely to raise multiple interpretations as regards the applicability of the new COPRA for the digital industry and is one more step towards “tech-regulation” by the Indian Government. Potential issues could range from the applicability of COPRA to offshore online aggregators available to consumers in India, extra-territorial application, enforcement issues and a potential “nudge” in future towards “onshoring” of operations/ entities, as has happened with the new Indian IT Intermediaries Regulations, proposed e-commerce policy (framed by DPIIT earlier this year), RBI OPGSP Guidelines, etc.

COPRA has also introduced the concept of ‘product liability’, defined as “responsibility of a product manufacturer/ seller (including electronic service providers), of any product or service, to compensate for any harm caused to a consumer by such defective product manufactured or sold or by deficiency in service”. It would be interesting to assess the implications of the above on e-commerce platforms, adding another layer of compliance for them.

COPRA also requires electronic service providers to provide the District Consumer Disputes Redressal Commissions with documents, information or records in relation to any complaint received regarding any goods or services, including unfair trade practices (which covers sharing of personal information given by the consumer in confidence) alleged by consumers.

All notices under COPRA maybe served on an electronic service provider at the address provided by it on an electronic platform from where the services are provided. It is the duty of an electronic service provider to designate a nodal officer to accept

and process the notices received under COPRA. Though there is no requirement for such “nodal officer” to be physically located in India, similar to what’s prescribed under the IT (Intermediaries Guidelines) Rules, this issue is likely to come up in future.

Under the new COPRA, the Central Government can introduce rules/ notifications to prevent unfair trade practices in ‘e-commerce’ space, i.e. retaining flexibility to issue “bespoke” rules in future aimed at e-commerce platforms/ aggregators (covering both goods and services) from a consumer protection standpoint.

Though the new consumer law

FTCCI jointly with Income Tax Department, Hyderabad has organized an Awareness program on “E-filing Kardaata E- Sahyog Abhiyaan” on 19th August, 2019 at FTCCI Surana Auditorium.

Sri Karunendra S Jasti, President, FTCCI in his welcome Address congratulated the Income Tax Department for registering 82.73% increase in Income Tax Collections during the past five years in the State of Andhra Pradesh & Telangana against country average of 63.5%.

He stated that E-filing is the powerful tool that can deliver significant social and economic benefits. It can provide a strong support to the government for good governance and large population to pay their liabilities to the government effectively. He expressed that the initiatives implemented by the tax administration inspire taxpayers’ confidence and encourage their voluntary compliance.

Sri Abhay Kumar Jain, Chairman- Direct Taxes Committee- FTCCI requested the Department to appoint Jurisdictional Nodal officer to address the grievances of minor technical issues in respect of Self Assessment Tax and TDS. Sri Suder Rajan, Joint Director, Systems, Income Tax Department gave a detailed presentation on Income Tax e-filing - an overview and explained the precautions to be taken while filing the returns. He also explained the recently launched ‘e-Filing Lite’, a lighter version of e-Filing portal with a focus on filing of Income Tax Return (ITR) by the taxpayers. FTCCI has organised a Workshop on “GST New Return Formats” on 22nd August 2019 at FTCCI Surana Auditorium, Federation House.

Sri Karunendra S. Jasti, President, FTCCI in his welcome address said that the New GST Return System has been launched on a trial basis from July 2019, and the fullfledged system will be put into place from October 2019.

This Transition Plan will be carried out in a phased manner. The trial phase will be for users to familiarize themselves with the annexure forms of the new return system.

Our experts here will enlighten us critical issues there in which the Taxpayer may face and how to deal with.

Basing on the deliberations FTCCI will represent to GSTN and Council for modifications. He appealed to the participants to send their issues for representation.

CA Ananthanarayanan, Chairman, GST and Customs Committee, FTCCI in his introductory remarks stated the taxpayers having turnover above Rs. 5 crores has to file monthly returns and Regular taxpayers with a turnover of up to Rs.5 crores can now file GST returns on a quarterly basis against the earlier limit of Rs.1.5 crores, the taxes have to be self-assessed and paid on a monthly basis even for small taxpayers opting for the quarterly return scheme.

Brief description of the Scheme: • A normal taxpayer would have to file FORM GSTRET1(Normal) or FORM GST RET 2(Sahaj) or FORM GST RET-3(Sugam) on either monthly or quarterly basis.

• Annexure of supplies (GSTANX-1) and Annexure of Inward Supplies (GSTANX-2) will be filed as part of these returns.

• All the outward supplies will be detailed in GSTANX-1 • GSTANX-2 will contain details of inward supplies autopopulated mainly from the suppliers GSTANX-1.

• Details of the documents uploaded up to the 10th of

the following month may be edited by the supplier up to the said date (10th of the following month) only If such documents are not accepted by the recipient.

Failure on the part of supplier to upload documents by 10th will have a direct impact on recipients ITC even though tax has been paid.

• If a document has already been accepted (up to the 10th) by the recipient, then such document has to be reset/unlocked by the recipient and only then, it can be edited by the supplier up to the 10th of the following month • Details of document s uploaded by the corresponding supplier(s) [irrespective of the fact whether the supplier files his return on monthly or quarterly (Normal, Sahaj or Sugam) basis will be auto-populated in this annexure on near real time basis and can be accepted or reset/unlocked by the recipient up to the 10th of the month following the month in which such documents have been uploaded.

• Recipient can take action on the auto-populated documents to–Accept, Reject or to keep pending on continuous basis after 10th of the month following the month in which such documents have been uploaded. However, in case of quarterly return filers communication of such rejected documents and any

further action on such rejected documents shall be done only in the return for the next quarter Accepted documents will mean that supplies reported in such document have been received before filing of return by the recipient and the details given in the documents reported in FORMGSTANX-1 are correct.

Accepted documents would not be available for amendment at the corresponding supplier’s end.

However, a separate facility to handle such cases will be provided.

Pending invoices will not be available for amendment by the supplier until rejected by the recipient.

Provisional credit on documents not uploaded by supplier(s) can be reported by the recipient for availing ITC to the extent provided in the Act read with the rules made there under. This ITC is other than that auto-populated in FORM GST ANX-2.

The Federation of Telangana Chambers of Commerce and Industry has organized an Interactive Meet on “The Code on Wages 2019� on 23rd August, 2019 at 03.00 PM at Federation House, Hyderabad.

Sri Karunendra S. Jasti, President, FTCCI in his welcome address said that, The Code on Wages 2019 is one of the most significant policy reforms brought about by the present government. This new code may potentially impact the half a billion workers and employees earning a living through wages across India. The new Code will govern the rights of employees and workers in the organized and unorganized sectors of the economy.

He also said about the provisions outlined by the Code on Wages and their applicability to all employees and workers in India, regardless of the industry they work in or the type of work they do.

Sri R. Ravi Kumar, Chairman, HR & IR Committee, FTCCI said in his introductory remarks, I am confident that The Code on Wages 2019 will improve the ease of doing business in the country. He also mentioned that the continued reforms in labor laws in India is changing the business operations and knowing the provisions of the Code is important for established businesses, start ups and those who are going to start businesses.

laws which were cumbersome and complained upon by many, specially Multi National Companies (MNCs).

Now the time has come to consolidate and simplify the procedures. If we make procedures simple, more people will follow. The objective of the Government is that this new consolidated Code on Wages will benefit 50 crore workers with timely payments irrespective of category and this will provide a level playing field to employers with just one register, one form and one filing of return.

Sri Ch. Dakshina Murty, Head ER/IR, KEOLIS said the Wage concepts are not new to us , this is all there from 1930s. Now the Government is following the trend called One Nation, One Tax, One Wage Code to improve the Ease of Doing Business and smooth functioning of the Industrial economy. He has given a brief introduction about the new Wage Code bill 2019 to participants to understand the background and the circumstances.

Sri Ch. Vijaya Saradhi, GM (HR), ITC Ltd has given a detailed presentation on Code on Wages 2019. The presentation covered Highlights of the Wage Code 2019, Key Issues & Analysis and Features, Comparison of current laws with proposed Wage Code, Important

clauses and Recommendations of standing committee on Labour.

Sri C. Niranjan Rao, Senior Advocate, High Courts of Telangana and Andhra Pradesh has given a detailed presentation on the Code on Wages – An Overview. It covered the Application of the Code, Various definitions of Wages, Contract Labour, Worker and Minimum Wages, Time limit of Payment of Wages, Claims and Procedures under code, Offences, Fines and Penalties.

State level consultation Meeting held at SBI local Head Office

SBI local Head Office organized a State level consultation meeting on 22nd August, 2019. The consultative process was aimed at alignment of banking with National/State priorities and stimulating ideas, covering MSME sector apart from other national priorities. The meeting was participated by Senior Level Officials heading Public Sector Banks in Telangana, Senior Officials from RBI and NABAR. Sri Ramakanth Inani, Sr. Vice President, Sri Krishna Kumari Maheswari, Chairman, Sri Hari Govind Prasad, Co-Chairman, Banking, Finance and Capital Markets Committee, FTCCI attended the meeting. The following suggestions were made on the credit access to MSMEs: i. W i t h the G ove r n m e n t of India putting the development of the MSME sector as top priority, and the S t a te Government’s industrial policy and incentives focused on MSME sector, we expect that the future for MSMEs in the State is brightening up. ii. The growth and sustainability of the MSME sector is dependent on the access to adequate, timely credit finance. The MSMES are facing difficulties in accessing finance, despite the sector under priority lending. This problem is persistent though there are clear instructions from the Reserve Bank of India and the Ministry of finance to encourage flow of funds from the commercial banks to small enterprises.

iii. There is an urgent need to strengthen and streamline the credit guarantee system as in its absence smaller units would continue to suffer neglect in accessing much needed credit for both inception and expansion. iv. The MSME sector suffers from challenges of small ticket size of loan, low revenue per client, and incur high transaction cost due to which the traditional banking institutions refrain from financing these small ventures. v. Banks consider SMEs as a high risk sector owing to low or nil credit rating, higher rate of diversion of the funds, and low turnover, among others. vi. SMEs often fail to raise enough funds due to lack of collateral. Banks and other financing institutions prefer to give loans to entities with best collaterals and security such as residential property, thus crushing the efficiency and scope of growth of the small firms. vii. There is also a need to spread awareness about formal financing opportunities within the MSME sector to grow their credit exposure, limit risks and seek better spreads by developing and Implementing sector-specific policies. viii.To keep the information flowing to the MSME sector of the State and also to provide handholding September, 2019 | FTCCI Review | 31

support, we, at FTCCI, proposing to have a fullfledged MSME Facilitation services with a special focus to financial aspects of MSME sector. As such these services are much needed by the aspiring and existing entrepreneurs in the districts of Telangana, FTCCI will also like to extend these services for the benefit of MSMEs at district level. In this regard we request the participation and support of the State Government, banks and other related institutions in providing facilitation services by deputing their officials. ix. With regard to the credit extension under MUDRA scheme, quite often we have been informed by Micro entrepreneurs that the credit facility under the scheme is not given priority to new micro entrepreneurs. The bankers may consider sanctioning of loans from organized financial institutions to the

new/startup micro enterprises. This initiative will support them in a big in the initial stage and will also encourage the youths to take up new enterprises, especially in the districts. x. FTCCI from time to time is bringing to the notice of the State Government the hardships faced by the entrepreneurs due to non receipt of sanctioned incentives long overdue by more than four years.

We would like to reiterate that timely release and disbursement of sanctioned incentives go a long way in promoting the growth of the industries and in turn helps the units to scale up their production levels. We take this opportunity to request the State Government officials to take priority in allocating funds to release the pending sanctioned incentives which create enormous confidence in entrepreneurs to take further initiatives in the industrial sector.

The Reserve Bank of India, Regional office, Hyderabad organized a programme to create awareness about a new retail forex trading platform, FxRetail on 19 August, 2019 at 11 am at RBI Hyderabad.

Sri T. Ravi Sankar, Chief General Manager, Financial Markets Regulation Department, RBI, Mumbai in his address informed that the Reserve Bank of India announced electronic trading platform for buying/ selling foreign exchange by retail customers of banks, (FX-Retail) by the Clearing Corporation of India (CCIL) on August 5 2019. The issue of transparent and fair pricing for retail users (individuals and Micro, Small 32 | FTCCI Review | September, 2019

and Medium Enterprises) in the foreign exchange market has been raised in various fora and in public interactions. The retail Forex platform will provide transparency while enhancing competition and lead to better pricing for retail customers. He said banks may charge their retail customers a pre-agreed flat fee towards administrative expenses, which should be publicly declared. Overall, this would bring down the total cost faced by the retail customer in the foreign exchange market. Facilitating direct access of retail customers to the market, rather than through price-setting by their banks, would also bring down the risk that banks face in warehousing transactions.

Sri Kamal Singhania, Sr. Vice President, Clearing Corporation of India Ltd. Mumbai in his address stated that the platform had been developed by the Clearing Corporation of India (CCIL) and was being tested by users. This platform would provide customers access to an electronic trading platform through an internetbased application on which they could sell or purchase foreign currency at market clearing price.

FX-RETAIL: Forex Platform for Customers The Clearing Corporation of India Limited (CCIL), through its fully owned subsidiary, Clearcorp Dealing Systems (India) Ltd (CDSIL), is pleased to launch FXRETAIL Platform for the Customers with effect from 05th August 2019.

The platform provides for an anonymous and order driven dealing in the USD/INR currency pair for Customers of Banks. Customers ranging from Individuals, Sole Proprietorship firms, Partnership firms, Corporates etc can avail the access to the platform. One can refer to the Customer Category list on the CCIL website (www. ccilindia.co.in).

Registration The Customers are required to get registered on the platform for dealing. A separate Registration portal https://www.fxretail.co.in is made available for this purpose. At the time of Registration, the Customer is required to provide his profile, details of the Relationship Bank etc. On successful registration, the Customer’s details would be forwarded to the Relationship bank for verification and approval. On approval, the Customer will be provided with the user credentials which would include a login name and password.

The platform can be accessed through Internet using the above user credentials wherein Customers can directly place Buy/Sell Orders as per their requirement. These orders shall be matched on the basis of Price time priority with other orders in the platform.

Trading 4 Customers can trade in Cash, Tom and Spot instruments on the platform.

4 Limit: Customer can place orders and trade based on the Limits set by the respective Relationship Bank. The Bank can set Instrument wise (Separate for Cash, Tom and Spot) or for All Instruments limit for the Customer.

4 Mark up: The Relationship Bank can set Customer wise mark up in paise or percentage terms which can be seen by customers on the platform.

4 Swap points: Facility to the Relationship Bank to set the Cash/spot and Tom/spot swap quotes is provided. All Cash and Tom orders of Customers are adjusted with the Swap Quotes provided by their Relationship Bank. These swap quotes are displayed to the Customer.

Customers can directly place, hit, modify, cancel orders on the platform.

Deal ticket and Reports are also available on the platform.

Settlement On conclusion of a trade, the counterparty for the Customer would always be the Relationship Bank selected at the time of order placement. The trades executed by the Customer on the platform would need to be settled bilaterally with his Relationship Bank.
