July 08, 2022 - Defendant Escalante used the Kansas Protection Portal to create a 5 page petition for protection from Stalking in Case 22CV03391 (Doc #1). The doc 1 was transmitted directly from the portal on submission to Joco courthouse at 11:20 Original Docketing event. At 11:21AM and 11:23AM it is affirmed by reviewing the petition doc #1, that it was tampered with added embeds of extra pages.

The added pages of embeds 'evidence' were added without proper amendment process and without a doubt had to be sent to courthouse prior to 11:20AM. Logic does not allow for any other train of thought. The extra embeds were specifically indentifiable and could have only come from Defendant Escalante and Defendant Wilson in advance for this to occur within 60 seconds and 180 seconds. This means two or more people(mother/attorney) conspired upon with a district court officer(burmaster) in advance, and transmitted prior to 11:20AM documents with instruction/directives to add barred pages of 'evidence' to a 5 page petition doc #,1 in which it is still now seen as a new 8 page document, and 3 pages had been added unlawfully to construct a false narrative about the Plaintiff father and to deprive rights. And a protective order without merit was frauded on July 08, 2022, consequentially harming all 3 plaintiffs. As a false protective over the course of now 17 months has removed constitutionally protected liberties, due process, children's rights and due process. The plaintiff never saw his children, the plaintiff daughters ever again. Defendant Wilson is known for gaslighting the district court with lies and bypasses to deceive. He will say Plaintiff had opportunity to see his daughters but the entirety of the facts show Defendant Mother has illegally forged a protective order and she is dangerous. Plaintiff has had to protect the plaintiff daughter from that fact, and the alienation environment that she is affirmed creating with such actions in this civil rights violation filing (continued on next page) Page 4 of 6

On June 13, 2022, Defendants Escalante and Wilson, led a course of malicious actions that violated Constitutional rights of all 3 plaintiffs directly. The Plaintiff father and minor children S.J.E and S.G.E had their Constitution Amdt14.S1.5.8.1 Parental and Children's Rights and Due Process violated on 6.13.22 when mother Janelle Escalante instructed and paid for her civil attorney to enter a district court pleading full of lies about the plaintiff father and children, constituting Perjury in the civil court case of 18CV03813. Perjury forms of misleading with completely false statements, omissions and false assertions are found in the district court entry by the Defendant mother and attorney in the docket entry of 06/24/2022 FILE STAMP 06/24/22, PETITIONER/MOTHER'S MOTION FOR TEMPORARY AND PERMANENT MODIFICATION OF PARENTING PLAN; AND REQUEST FOR EMERGENCY RELIEF PURSUANT TO K.S.A. 23-3219(B), otherwise also known as Doc 192 in Joco 18CV03813.

Example specifically of perjury in this district court motion given to civil judge Paul W. Burmaster can be seen in Line J of Doc 192. The two defendants stated in the sworn motion this false statement of the Plaintiff,

"The father regularly creates issues related to the children’s activities and involvements. There is direct communication with Sophie and this communication, like the communication above, creates upset and issues.

In a really reprehensible act, the father refused to permit Sophie to attend a 4-H fair when she had worked very hard, for months, to prepare – the father refused to permit her to attend because it occurred on his parenting time."

This statement of Line J, by Mother Escalante and Attorney Wilson was an absolute known lie and with intent to deceive the district judge Paul Burmaster, whom presided over the civil custody case 18CV03813.

Janelle Escalante swore in a district court doc 192 that she was telling the truth in doc 192. And she wasnt.

Photographs exist from all the years of 4H fair in which the Plaintiff father was alongside his daughters and father always let the plaintiff daughters attend. There is an admissible Our family wizard, application conversation two weeks prior to the July 2021 4H fair, and Defendant mother is seen admitting in statements th supported a blended father/daughter weekend where the daughters were going to be split and the oldest daughter who was targeted in doc 192 got to attend all the 4H events that she wanted to and father even sacrificed some his time because mother began to be difficult on the matter. And father offered the daughter specifically on Friday July 23rd 2022 and sacrificed a parenting time loss. Only to have mother enter Doc 192 and commit perjury about the father like it never happened. That is atrocious. And other evidence and mothers truthful testimony will indicate that she knew the statement line J was false and intended to deceive the parties judge in a devastating perjurious entry, And the fact of the matter is, she paid her civil attorney Christopher T Wilson to lie on her behalf to destroy the father and daughter relationship by pushing and manipulating the district judge into a hatred of the father, unjustified.

Many other forms of perjury are found in the Document 192. Its factual also that Counsel Chris T Wilson falsified information as "Fact" in the page 3-8 of Doc 192. After a simple review of the section is titled, "Facts Supporting Modification of Current Orders" It can been that those aren't actually facts at all they are malicious opinions pretending to be facts and defendants by design and intent used those five pages to harmfully sway judge burmaster further into hatred of the Respondent Father without justification.

A hearing was held days later on June 27, 2023, and district court transcripts, video of the hearing and witness testimonies will reveal that Judge Burmaster was so manipulated by that time, the judge admitted on record that he didn't even look at the Respondents evidence presentation. And the judge doesnt state its because of legal insufficiency, he states a remark that fools the Respondent in his inexperience. And the judge never viewed counter-evidence that showed Doc 192 was full of lies. The defendant Janelle Escalante and Christopher T Wilson are deemed manipulating the judge with false statements that directly led to deprivation of Constitutional Amdt14.S1.5.8.1 Parental and Children's Rights and Due Process. As the judge never again allowed full due process to the Respondent/Plaintiff Matthew Escalante ever again in the Johnson County district court. Fact.

Defendant Lewanna Bell Lloyd was appointed Guardian ad Litem in the parties custody case in Order Appointing Guardian ad Litem 07/27/2022 FILE STAMP 07/27/22, ORDER APPOINTING GUARDIAN AD LITEM The Guardian has exhibited from day action of her jurisdiction over the case, she is no longer protected by immunities when the following facts are seen. The order appointing guardian ad litem from Judge Paul Burmaster is very specific and she has failed to follow many points and directives in the order appointing. The plaintiff offered a contempt show cause and affidavit alleging facts pursuant KSA 20-1204a to the district court on Oct 10, 2023 and the district judge Burmaster has refused to enter it, furthering the claim as factual that Const Amdt14.S1.5.8.1 Parental and Children's Rights and Due Process has been violated for all 3 plaintiffs. the following lines can be seen in the that contempt offering that was ignored and it shows the guardian Bell Lloyd is guilty of federal offense under 42 U.S. Code § 1986 - Action for neglect to prevent. She has done nothing to stop the abuse of father and children and she is frauding her job responsibilities.

42 U.S. Code § 1986 - Action for neglect to prevent.Every person who, having knowledge that any of the wrongs conspired to be done, and mentioned in section 1985 of this title, are about to be committed, and having power to prevent or aid in preventing the commission of the same, neglects or refuses so to do, if if such wrongful act be committed, shall be liable to the party injured, or his legal representatives, for all damages caused by such wrongful act, which such person by reasonable diligence could have prevented The plaintiffs evidence exhibits show that Guardian had a duty under Kansas Professional Rules of Conduct to report

acts of Attorney misconduct viewed in Section C of this filing and she never did. And she had full knowledge that falsity had been given in pleading from June 2022-Present 2023. Plaintiff has Guardian in statements that she was aware of police reports from the Gardner Police department of custody interference of the minor plaintiff's that Defendant mother was engaged in. And Guardian did nothing but ignore. The contempt filing of her negligence contains this section that is the Order Appointing guardian ad litem directions and what the guardian is doing that is not following them:

Order Appointing Guardian: 1. The guardian ad litem/attorney shall be served with copies of all pleadings and other papers filed herein.

2. Upon presentation of a certified copy of this Order to any agency, school, school district,any pediatrician, psychologist, psychiatrist, hospital, mental health treatment facility, 5. The Guardian Ad Litem shall bill at the rate of $250.00 per hour and shall submit written entries for her time upon reasonable requests by this Court or the parties. Any expenses incurred in the performance of her duties (i.e. medical records, business records and reports) shall be divided between the parties in an equitable manner as determined by this court at a later hearing AND THE GUARDIAN HAS FAILED THE ORDER APPOINTING AND IGNORING IT AND THE DISTRICT COURT HAS WRONGFULLY MOVED TO WHERE THEIR NOT SERVING THE PLAINTIFF CHILDREN AT ALL BY IGNORING THE BELOW: 1. Guardian Bell Lloyd is seen on the dates of June 4, 2023 and June 22, 2023, rejecting the served legal documents that father is legally required to serve her. These were motions were enterd into the docke of 18CV03813. Bell states directly, she does NOT want them 2. The Guardian did not follow process of Bullet Point #1 in the order with Trisha Brown PHD. This is the out-ofnetwork, mental health clinicial for the oldest child S.J.E. Ms Bell did not present Ms Brown on th first contact the legal requirement needed to even disclose one piece of 18CV03813 to the doctor. And Mr Escalante has asked for copies of Guardian report of last 16 months and received none. 5. Guardian is showing affirmative of not billing correctly at all in adherance with ethics and the court order appointing guardian litem bullet point numbered #5.

A review of ALL of Guardian's invoices, few as they are, indicated that Ms Bell does itemized all other mental health clinicians, but Ms PhD Tricia Brown is missing from every invoice ever in 18CV03813. And it appears as though Ms Bell may have never even spoke to the oldest childs clinician in this high conflict divorce. That is largely concerning to any reasonable person, yet alone the father who has placed Ms Bell, a defendant in a federal open pending lawsuit alleging she is neglecting the childrens best interest and civil rights. This is all fact. Rule 110a appears it may be breached by Guardian with the above facts. The hearing for this contempt finding has merit and a fair and non partial judge would agree.

It is further factual, Guardian is not complying either with Div 14 order given by the Court many times in 2023 to 'Work with the Father' This is one of four provision in the Order first given on the day. Doc 192 coming into Order in this case. Ms Bell is then interfering as is to be held in contempt. If any party is not serving in the best interest of children they must account. Father will legally deal with mothers behaviors last, It is apparent officers of the court are enabling mothers malicious behavior of dishonesty, deceiving, and non accountability. (examples of such are Doc #1 22CV03391 very deceiving and doc 192, all with visible deceptions) The guardian is to be held accountable in the show cause and affadavit alleging the facts that all the above previous page are NOT best behaviors. It is factual also the Defendant Counsel Christopher T Wilson and Janelle Escalante are currently attempting to fraud the Plaintiff father for $8,738.50.00 in faux attempt to steal from the Plaintiff in this motion entered by Wilson on behalf of mother, PETITIONER’S MOTION FOR JUDGMENT AND ORDER TO PAY UNINSURED MEDICAL. This motion was offered and docketed on July 21, 2023 in 07/21/2023 FILE STAMP 07/21/23, PETITIONER'S AMENDED MOTION FOR JUDGMENT AND ORDER TO PAY UNINSURED MEDICAL. Those expenses of 8738.50, theyre not able to be claimed, Ms Escalante has failed to follow the Parenting plan, and property seperation provision set forth in 18CV03813, that clearly state mother has a front end obligation to submit the receipts and EOB's in the Our Family Wizard properly and to date she has done none of that since 2021. And the 2021 submission in OFW and not even done properly. Emails were sent in early 2022 from Plaintiff to defendants that was notifying and trying to problem solve for the childrens best interest and inform mother that she wasn't following the rules of child support guidelines either for reimbursments. They both ignored Plaintiff's attempts to fix that issue. And now theye tried to fraud the Plaintiff while the judge in 2:23CV02741 Paul W Burmaster is also consequentially violating civil rights by not letting Plaintiff have due process. This is all a huge problem of illegal fraud, perjury, and constitutional loss on the plaintiff's and that is why the Plaintiff is demanding punitive damages of $105,000.00 As theres also a faux criminal charge about to be dismissed that Wilson has fraudulently formed out of 'Screenshots' to the district judge to push a charge that can't be prosecuted onto Plaintiff. Loss of Liberty was a result of that.

Respondent has been jailed two times by Defendant Wilson and Defendant mothers malicious mislead of the district Judge Paul Burmaster several dates can been in transcripts and witness testimonies that Defendant is rallying the judge into improper conduct that is seen in 2:23-CV02741 Escalante V Burmaster, in the civil rights violations complaints. The defendants have led actions that have devasted the Plaintiff minor children's mental health. They've compromised the health and well being of two children. They have destroyed the work of Plaintiff father has suffered at the acts of attorney misconduct that is viewed in this filing. He has lost dignity, wealth, health, hope and his daughters. And Plaintiff demands justice Tricia Brown and Diane Attenborough, those are both the children mental health clinicians that must be subpoenaed.
