BROOKHAVEN PRIORITY RELEASE TERMS AND CONDITIONS

To be eligible to participate in the Priority Release Process for the first release of Brookhaven ‘Haven Release 1’ you must agree to the following terms and conditions. 1. These terms and conditions govern the Frasers Property Australia Pre-Market VIP Release Process for expressing your interest in purchasing a property in the Haven Release 1 at Brookhaven (the “Process”). By participating in the Process, you agree to comply with these terms and conditions. 2. Only Prosperity members and eligible referred family members (as defined in the Prosperity Terms and Conditions at https://www.frasersproperty.com.au/Prosperity/Terms) and friends will receive the notification email with a link to participate in the registration of preference for purchase of a property within Haven Release 1 at Brookhaven (each a “Property”). 3. You will be able to submit your registration of preference(s) of Properties by completing the online form accessed via the link (“Registration of Preference”) from 11:00am (AEST) Friday 29th October 2021 until 4:00pm (AEST) on Friday 29th October 2021 (“Registration of Preference Period”). 4. If you are successful in submitting a Registration of Preference during the Registration of Preference Period, you will receive an email from Frasers Property Australia confirming your Registration of Preference. 5. You will be contacted by a sales representative of Frasers Property Australia via telephone on Saturday, 30th October 2021. Prosperity members will get first preference, then eligible referred family members, and then eligible referred friends (“Order of Preference”). You will be contacted by Frasers Property Australia in the Order of Preference based on the time of receipt of your Registration of Preference. 6. When you are contacted by a sales representative of Frasers Property Australia, you may be provided with an opportunity to purchase a Property. If you wish to secure that opportunity, you must: a) pay a holding deposit within 48 hours of the successful phone call made on Saturday 30th October 2021 of $5,000 to the bank account specified by Frasers Property Australia (“Deposit”); and b) return by email to Frasers Property Australia a completed and signed copy of the expression of interest form provided to you by Frasers Property Australia (“EOI Form”) along with a valid receipt showing that transfer of the Deposit has been made. 7. Once Frasers Property Australia confirms receipt of the Deposit and a duly signed EOI Form, a contract for sale and purchase of the Property (“Contract”) will be sent to you or your nominated Queensland solicitor or conveyancer within 10 business days. 8. Payment of the deposit under the Contract and all other conditions of purchase will be governed by the Contract. 9. If you decide not to purchase the Property after payment of the Deposit has been made but before you sign the Contract, your Deposit will be refunded in full. 10. If you fail to submit an EOI form and holding deposit within 48 hours of accepting the opportunity to purchase the property, you will forfeit your priority to purchase.
