IN FOCUS The Nāmāhoe Unveiled at Kalapaki

by Léo Azambuja Nā Kalai Wa‘a o Kaua‘i, or The Canoe Builders of Kaua‘i, was founded 20 years ago by John Kruse, Dennis Chun and Patrick Aiu. Since then, they have worked tirelessly to build a voyaging canoe on the island.

The double-hulled Nāmāhoe was unveiled on the morning of Sept. 11 at Nawiliwili Harbor.

After a brief ceremony, the canoe was towed to waters just outside the shoreline of the nearby Kalapaki Beach, where it was greeted by hundreds of people.

A day-long ceremony ensued to celebrate the historic moment for Kaua‘i. Named after the constellation Gemini, the Nāmāhoe (twins in Hawaiian) was built with modern materials, but its design follows traditional Polynesian double-hulled canoes.

Never Forget the Dodo

By Léo Azambuja As a child, man-driven extinction was a tough concept for me to grasp. I was heartbroken upon learning the fate of the dodo, a flightless bird from Mauritius Island in the Indian Ocean. Three-foot tall and weighing nearly 50 pounds, the dodo was

Kaua‘i Conservation Expo

The National Tropical Botanical Garden in Lawa‘i, in partnership with the Kaua‘i Conservation Alliance, hosted the Kaua‘i Conservation Expo Sept. 7. The event, held during the IUCN World Conservation Congress in Honolulu, was all about showcasing conservation work on Kaua‘i and in the state of Hawai‘i, and also about promoting awareness.

When we arrived at the NTBG gardens, we saw several booths by all organizations working to help to conserve our island and

on the planet’s more important humpback whale habitats. Every winter, about 10,000 humpback whales travel from the cold waters off Alaska to spend a few weeks here.

There were many other organizations, including Dolphin Smart, Kaua‘i Nēnē Habitat Conservation Plan, Kaua‘i Endangered Seabird

The organizers were so committed to make a zero-waste event that they forgot to bring trash cans, so everything went to recycling or compost bins.

One of the things I learned was that in the span of just over 200 years we have changed our world’s biodiversity so much that all the

They thanked all the organizations, government agencies and also talked about conserving our island and making it a better and more eco-friendly place for our keiki and our future keiki.

One of the organizations was the National Wildlife Refuge at Kilauea Point. The refuge is about conserving and enhancing the native birds, sea birds and their nesting colonies. The refuge has a 725-meter predator-proof fence for the endangered birds to nest safely. The refuge is helping to restore seabird population and it is also educating people about the environment.

Another great organization is the Kaua‘i Invasive Species Committee, a government nonprofit organization working to prevent, control or eliminate most threatening invasive plant and animal species in order to preserve Kaua‘i’s native biodiversity.

The Hawaiian Islands Humpback Whale National Marine Sanctuary was created by the United States Congress in 1992 to protect the whales and their habitat. The sanctuary is within four Main Hawaiian Islands, including the North Shore of Kaua‘i, where it goes from the shoreline to 600-feet deep. It is considered Page 8

You can learn so much at the gardens. They have some of the rarest plants in the world, and even seeds from already extinct plants.

There is a section of the garden called Canoe Garden, because there are 30 types of plants that the Polynesian voyagers brought on canoes when they first arrived on the Islands.

The Polynesians did not know what was here, so they brought plants, dogs, pigs and chickens so that they would have food to survive and to cultivate. Some of the plants were kalo, ‘ulu, hoi, hala, ‘uala, kukui and others.

There are so many things we don’t notice we do that are hurting our island such as cars, trash and even animals. People can help in so many different ways, they can use less cars by taking the bus, buy food from local farms, recycling, composting, beach cleanups and much more.

By Helen Wong Smith The elegant Hawaiian holokū dress became popular among Hawaiian royalty in the 19th century. Inspired by the dresses worn by the wives of the first missionaries in Hawai‘i, the holokū evolved into fitted bodices and sleeves, and were made from the finest fabric available. Noble ladies would wear it to balls and tea parties.

“It’s a very beautiful dress, it’s regal,” said Kaua‘i resident Hau‘oli Wichman, who wore a purple holokū to a white tie event in England in the summer of 2008. She and her sister crafted the dress especially for the event. “I made it because it signified my Hawaiian heritage and I wanted to wear something special to the event.”

400-year-old fruiterer association in England. But Wichman’s dress almost stole the spotlight; she was the only one wearing a holokū. The British told her they had never seen a dress like that and it was very beautiful.

The birth of the holokū goes back almost 200 years; it is traced back to the arrival of the first Christian missionaries to Hawai‘i in 1820.

Reportedly, chiefessess Kalakua and Namahana (both widows of Kamehameha the Great) upon seeing the long, tight sleeves and the narrow skirts of the missionary women onboard the American brig Thaddeus, insisted on being fitted out in the same way.

At the end of the first sermon delivered before Hawaiian royals by the Reverend Hiram Bingham aboard the Thaddeus, Kalakua, also the mother of three of Liholiho’s queens, apparently demanded that “white women cease their stupid singing and praying, and get immediately to work at sewing her a dress,” according to Paul Bailey’s book Those Kings and Queens of Old Hawai‘i.

Kalakua’s demand, however, would have to wait for the next day. Despite the chiefess flying into “monumental rage,” the American women would not work on the Sabbath, Bailey wrote. On Monday, the “strange Christian kapu” was lifted.

Stores of silk and brocade and chintz were brought out, and the deck of the Thaddeus was transformed into a sewing school.

“Mesdames Thurston and Bingham … at once perceived that tight bodices and belts were unsuited to the figures of their new friends, to say nothing of the new climate, so they invented a garment, cool, flowing and graceful – the holokū,” F.H. Wills wrote in The Story of the Holokū published in the MidPacific Magazine in 1913.

Kalakua stood in her “majestic nakedness” on the deck of the Thaddeus, while being measured for her white cambric dress, according to Bailey.

“The deck boiled with anticipation and pleasure. Chatter was endless. The seamstresses were offered bowls of poi, and even pipes packed with tobacco, to make their task easier and happier. Dark eyes, out of dark faces, stared on in joyful anticipation and fascination. When Queen Kalakua stood before them in white magnificence it was a festive and happy moment,” Bailey wrote.

Professor Barbara Lyons attributes the first showing of a holokū by Kalakua, who accessorized it with an embroidered lace cap and neckerchief from America.

Wills wrote the holokū provided a new use for the rich fabrics brought by traders from China for the Islands’ sandalwood, which “had been laid away, or used for mantles to be worn on great occasions.”

Queen Liliu‘okalani in the late 1800s, wearing a holokū. evolution from the Mother Hubbard dress, with a loose-fitting undergarment, the mu‘umu‘u that later came to be worn as an outer garment. In her dissertation, she states “pieces of kapa with calico-style printing were often sewn together for this purpose.”

Lyons provides two versions of how the holokū was named.

holokū saw its share of media coverage as reflected in the 1907 subtitle of an article on theft in Honolulu, “Boy steals and girl buys jag and new holokū – 60 days,” in The Hawaiian Star newspaper.

The same newspaper presented a contrasting account in a 1909 article covering Queen Liliu‘okalani’s fourth trip to Washington D.C. to press her claim for payment for the crown lands, which the U.S. held in her former kingdom. “Her attire at a reception in the home of her nephew, the Hawaiian congressional Delegate [Kalaniana‘ole] … She wore a loosely flowing robe of bronze velvet, trimmed with scarlet satin. It is the Hawaiian court dress, and is called the holokū.”

Making holokū is still a tradition on Kaua‘i. Perhaps one of the most well-known designers was the late Guadalupe Bulatao, famous for her elegant and creative holokū. Today, Barbara Green is one of the leading holokū makers here. A professional seamstress since 1990, she has been making holokū since then.

The holokū, Green said, represents the transition of an old to a new Hawai‘i, from the culture as Hawaiians knew to a a culture they had to get acclimate to because of the changes happening here in the 19th century.

The adoption of the holokū is well documented, but did not sway the high Chiefess Kapi‘olani, well-known defier of Pele, when visiting a mission school in Waimea in 1829. Persis G. Taylor wrote, “Her feet were always clad in stockings and shoes … on public occasions, or when visiting away from home, she wore a tight fitting dress, not even adopting the “holokū (or Mother Hubbard) which afterwards became the national style.”

Sunscreen Found Harmful to Coral Sampled on Kaua‘i

By Ruby Pap The state Department of Land and Natural Resources is asking all ocean users in Hawai‘i to avoid sunscreen containing oxybenzone, also known as BP-3, due to scientific research showing the chemical’s harmful effects on coral. New, unpublished data show Kauai’s reefs are also at risk.

“Sunscreen chemicals wash of swimmers, surfers, paddlers, spearfishers, divers, and other ocean users,” said Dr. Bruce Anderson, administrator at the DLNR Division of Aquatic Resources. “Even if you’re just sunbathing on the beach, using beach showers will wash chemicals into the ocean. Researchers have found oxybenzone concentrations in some Hawaiian waters at more than 30 times the level considered safe for corals.”

Dr. Craig Downs, of Haereticus Environmental Laboratory in Virginia, published research in Hawai‘i last year, spurring DLNR’s request for ocean users to avoid sunscreen containing the harmful chemical.

His original research contained ocean water-sampling data from O‘ahu and Maui, but did not include Kaua‘i’s waters. However, last month, Downs shared with For Kaua‘i Newspaper some yet-to-be-published data about Kaua‘i; and the results show high concentrations of BP-3 at select North and

South Shore locations.

Downs’ original work published in 2015 in the Archives of Environmental Contamination and Toxicology did two things overall: It quantified in the lab how much BP-3 it takes to have toxic effects on coral larvae (planulae) and coral cells; and it measured concentrations of BP-3 in reef waters around the Caribbean and Hawai‘i.

samples taken from reef sites in the Caribbean and Hawai‘i. Sites on O‘ahu and Maui were contaminated between 0.8-19.2 parts per billion (PPB). Concentrations were higher in areas with more people in the water.

In the follow-up study to be published within the year, Downs sampled several other locations in Hawai‘i, including Kaua‘i. Samples revealed high BP-3 concentrations at Lumaha‘i of 468 PPT, with 130 people in the water or at the beach.

“It was a surreal and horrifying day because it was the first time I ever witnessed a number of groups spraying on the aerosol sunscreen when they were waste deep in the water,” Downs said.

PPT, also above the toxic threshold. Hanamā‘ulu Beach also had high concentrations, around 200 PPT, but this was an unusual day with lots of picnicking families present on a holiday weekend.

Downs said when you look at the big picture swimmers are a small but locally significant source of pollution. Sewage is a huge source of BP-3 globally, as well as other personal care products. But the problem is pervasive wherever there are people and coral reefs, especially in visitordestination areas.

The take home message here is to stop

using sunscreen containing BP-3. Even some sunscreens labeled “reef safe” contain BP3, so it is important to read the label. Avoid oxybenzone, oxtinoxate, avobenzone or avobenzine, ethylhexl methoxycinnamate, homosalate, or octisalate/octocrylene. Some of the safe alternatives are sunscreens containing non-nanotized zinc or titanium oxide.

In the meantime, state Sen. Will Espero, D-‘Ewa Beach, is planning to introduce a bill in the next Legislature banning such sunscreens in Hawai‘i.

Hawai‘i Wisdom Pa‘akiki kānaka o Kaua‘i “Tough are the men of Kaua‘i.”

O‘ahu was once inhabited by supernatural beings who ate people. They would extend their hospitality by day, but at night, they would eat their sleeping guests. A canoe came from Kaua‘i one day, and among the passengers was a man who was distrustful of the Oahuans. When the other men went to sleep, he dug a hole under the wall, crept into it, pulled a mat over himself, and waited. Late at night he listened as the hosts came and ate his companions. After the evil beings were gone, he hurried to the canoe and sailed home. He told his friends, and together they made wooden images, hid them in the canoe, and sailed for O‘ahu, where they were welcomed. That night the images were put inside the house, while the men hid outside. When the hosts came around to eat the visitors, they bit into the hard wooden images. The Kaua‘i men burned the house, thus tending the evil on O‘ahu.

Currently, there are close to 200 women enrolled in the program on Kaua‘i. One such patient, Minde Hine, was referred to the program due to a strong family history of breast cancer.

“Several women in my immediate family as well as extended family have had and even died from breast cancer,” says Hine.

“I wasn’t sure that participating in the program was all that important. However, I am very glad I chose to participate and have been in the program for probably 10 years or more.”

Amendments to the Charter of the County of Kaua‘i and Ballot Questions November 8, 2016

General Election Pursuant to Hawai‘i Revised Statutes § 50-11 and Article XXIV, Section 24.03, of the County of Kaua‘i Charter, the Kaua‘i Charter Review Commission is publishing the following Proposed Amendments to the County of Kaua‘i Charter, which the Commission has approved for inclusion on the 2016 general election ballot.

1. Proposing a Charter Amendment to the Charter of the County of Kaua‘i (2015 Codified Version) Articles I – XXXII relating to correcting gender neutrality, grammatical, spelling, and formatting errors.

Ballot Question: Shall the charter be amended throughout to ensure that its language is to the greatest extent possible gender neutral and to make changes to spelling, capitalization, punctuation, formatting, and grammar?

Background: Since its adoption in 1968, the County Charter has been amended several times, resulting in inconsistencies in word usage and formatting, as well as grammatical errors. Further, the charter refers to gender-specific positions, such as “councilman” and “chairman.”

Purpose: The purpose of this amendment is to correct grammatical and formatting errors in the document, without altering the meaning or purpose of its content. This amendment also seeks gender neutrality by changing terms such as “councilman” to “councilperson” and “chairman” to “chair.”

Charter Amendment.

Articles I – XXXII of the Kaua‘i County Charter are amended to read as follows: (the following is a sample of proposed changes; to review all proposed corrections to the charter please go to www.kauai.gov/charter ) Note: Charter material to be repealed is bracketed. New charter material is underscored.

The Charter of the County of Kaua‘i (2015 Codified Version) ARTICLE I THE COUNTY AND ITS GOVERNMENT Section 1.01. Incorporation. The people of the [county of Kaua‘i] County of Kaua‘i are and shall continue to be a body politic and corporate in perpetuity under the name of

[“county of Kaua‘i,”] “County of Kaua‘i”, referred to hereinafter as the “county[.]”.

Section 1.02. Geographical Limits. The islands of Kaua‘i and Ni‘ihau and all other islands lying within three nautical miles off the shore thereof, and the waters adjacent thereto, shall constitute the [county of Kaua‘i] County of Kaua‘i with its county seat at Līhu‘e.

Section 1.03. County Elections.

A. Nonpartisan [Elections.] elections.

County elections shall be conducted in accordance with the state election laws [of the State] insofar as applicable, but all elective county officers shall be elected by nonpartisan elections.

(Amended 2012) B. Offices of the [Mayor and Prosecuting Attorney.] mayor and prosecuting attorney.

1. For the offices of mayor and prosecuting attorney, the names of the two candidates receiving the highest number of votes for these offices in the primary election shall be placed on the ballot for the general election.

(Amended 2012) 2. At the general election, the candidates receiving the highest number of votes for mayor and prosecuting attorney shall be elected. (Amended 2012) 3. Tie votes. In the event of a tie vote for mayor and prosecuting attorney in the primary or general election, the winner shall be determined by a method of chance as determined by the county clerk. (Amended 2012) C. Office of [At-Large Council members.] at-large councilmembers.

1. For at-large council offices, two candidates for each vacant atlarge council office receiving the highest number of votes in the primary election shall be placed on the ballot for the general election. (Amended 2012) 2. At the general election, the candidates receiving the highest number of votes for each vacant at-large council office shall be elected. (Amended 2012) 3. Tie votes. In the event of a tie vote for the last remaining at-large council office in the primary election, the candidates receiving the same number of votes shall be placed on the ballot for the general election. ARTICLE III COUNTY COUNCIL Section 3.01. Legislative Power. The legislative power of the county shall be vested in and exercised by the county council, except as otherwise provided by this charter.

Section 3.02. Composition. There shall be a council of seven members elected atlarge.

Section 3.03. Terms. The terms of office of councilmembers shall be for two years beginning at twelve o’clock meridian on the first working day of December following their election. No person shall be elected to the office of councilmember for more than four consecutive two year terms. (Amended 1980, 1984, 2006) Section 3.04. Qualifications.

A. To be eligible for the council, a person must be a citizen of the United States and must have been a duly qualified elector of the county for at least two years immediately preceding [his] such person’s election or appointment.

B. Any [councilman] councilmember who removes [his] said councilmember’s residence from the county or is convicted of a felony shall immediately forfeit [his] the office.

C. The council shall be the judge of the qualifications of its members and for that purpose shall have power to subpoena witnesses, take testimony and require the production of records. Decisions made by the council in the exercise of the powers granted in this subsection shall be subject to review by the Fifth Circuit Court of the State of Hawai‘i.

Section 3.05. Vacancy in Office. In the event a vacancy occurs in the council, the remaining members of the council shall appoint a successor with the required qualifications to fill the vacancy for the unexpired term. If the council is unable to fill a vacancy within [(30)] thirty days after its occurrence, the mayor shall make the appointment to such vacancy. The foregoing provisions shall apply in the event a person elected as [councilman] councilmember dies before taking office; provided, however, that the vacancy shall be filled by the newly elected council within thirty [(30)] days after the beginning of the new term.

Section 3.06 Compensation. The salary of each councilmember shall be established in accordance with the provisions of [Article] article XXIX of this [Charter.] charter. (Amended 1988, 2006) Section 3.07. Organization of Council; Officers; Rules; Employees.

A. The council shall meet in the council room at the county building or in the Kaua‘i War Memorial Convention Hall for its organization promptly after its inauguration and swearing-in ceremony at which time it shall elect one of its members as [chairman] chair and presiding officer of the

Until such time as the [chairman] chair is elected, the mayor shall preside at the council meetings, provided that the mayor shall not have a vote. The council shall also elect one of its members as [vicechairman] vice-chair who shall act as the presiding officer in the event of the [chairman’s] chair’s absence.

The council shall appoint a presiding officer pro tempore from its members in the event of the absence of both the [chairman] chair and [vice-chairman.] vice-chair. A majority of the entire membership of the council shall constitute a quorum and, except as otherwise provided, the affirmative vote of a majority of the entire membership shall be necessary to take any action. (Amended 1984) B. The council shall adopt such rules as it may deem necessary for the organization of committees and the transaction of its business.

C. The council shall keep a journal of its proceedings.

D. The council may, upon an affirmative vote of at least two-thirds of its entire membership, suspend without pay for not more than one month any member for disorderly or contemptuous behavior in its presence. The presiding officer or the council by a majority vote may expel any other person who is guilty of disorderly, contemptuous, or improper conduct at any meeting.

E. The council shall meet regularly at least twice in every month at such times as the council may prescribe by rule. Special meetings may be held on the call of the mayor, [chairman] chair, or by five or more members.

All council and council committee meetings shall be open to the public except as provided for in [Chapter] chapter 92, Hawai‘i Revised Statutes.

(Amended 2008) F. Council Staff. The council may appoint the necessary personnel for the transaction of its business, and such appointments shall be subject to the civil service and classification requirements. The [chairman] chair of the council shall be the administrative officer of the staff employees. (Amended 2008)

2. Proposing a Charter Amendment to Article XII expanding the duties of the Fire Chief and defining Authority to Execute Powers and Duties Ballot Question: Shall the duties of the fire chief be clarified to include duties currently performed such as addressing hazardous materials, emergency medical services, and ocean safety, and shall the reference to the mayor’s authority to assign duties be removed?

Background: The section of the County Charter relating to the Fire Department was created before the Fire Commission was formed. Therefore, the current language of the Charter does not specifically identify lines of authority in assigning duties. Additionally, the Department has broadened its scope beyond fire control, to include such functions as ocean safety, hazardous materials, and emergency services, which are currently not reflected in the charter.

Purpose: This amendment would appropriately describe the current functions of the fire chief and the Fire Department, as they relate to duties and authority.

Charter Amendment.

Article XII of the Kaua‘i County Charter is amended to read as follows: Note: Charter material to be repealed is bracketed. New charter material is underscored.

ARTICLE XII FIRE DEPARTMENT Section 12.01. Organization. There shall be a fire department consisting of a chief, a fire commission, and the necessary staff.

(Amended 2006) Section 12.02. Fire Chief. The fire chief shall be appointed and may be removed by the fire commission. [He] The fire chief shall have had a minimum of five years of training and experience in fire prevention and [control] operations in private industry or government service, at least three years of which shall have been in a responsible administrative capacity. (Amended 1980, 2006) Section 12.03. Powers, Duties, and Functions. The fire chief shall be the administrative head of the fire department and shall:

B. Provide [an] for a safer community through effective [program and] leadership and programs [for countywide] in fire prevention, [fire control and] fire operations, hazardous materials, emergency medical services, ocean safety, rescue operations and all hazards.

C. Control, manage and account for all property in the custody of the fire department.

D. Execute such other powers and duties as may be prescribed by law [or assigned by the mayor].

Section 12.04. Fire Commission. There shall be a fire commission consisting of seven members. Commission members shall be appointed by the mayor and approved by the council and be otherwise governed by the provisions of section 23.02 of the charter. (Amended 2006) Section 12.05. Powers, Duties, and Functions of the Fire Commission. The fire commission shall:

C. Review the department’s operations, as deemed necessary, for the purpose of recommending improvements to the fire chief.

D. Evaluate at least annually the performance of the fire chief and submit a report to the mayor and the council.

E. Hear complaints of citizens concerning the department or its personnel and, if the commission deems necessary, make recommendations to the fire chief on appropriate corrective actions.

F. Submit an annual report to the mayor and the council regarding its activities.

Except for purposes of inquiry or as otherwise provided in this charter, neither the commission nor its members shall interfere in any way with the administrative affairs of the department. (Amended 2006)

3. Proposing a Charter Amendment to Article XIV Establishing a Zoning Board of Appeals to assist the Planning Commission in providing a due process for Appellants

Zoning Board of Appeals would be a seven-member board that would hear appeals regarding zoning and subdivision ordinances and would conduct evidentiary hearings. The creation of a Zoning Board of Appeals would eliminate the need to continuously hire hearings officers. The members of the proposed board would not be compensated and would be appointed by the mayor with the approval of the council.

Purpose: This amendment establishes a Zoning Board of Appeals that would hear appeals of the planning director’s decisions regarding violations of the zoning and subdivision ordinance, thereby eliminating the need to hire hearings officers to perform this duty.

Charter Amendment.

Article XIV of the Kaua‘i County Charter is amended to read as follows: Note: Charter material to be repealed is bracketed. New charter material is underscored.

ARTICLE XIV PLANNING DEPARTMENT

A. Adopt rules necessary for the conduct of its business and review rules for the administration of the department.

Ballot Question: Shall a zoning board of appeals be established to hear appeals from decisions of the planning director and to conduct evidentiary hearings at the request of the planning commission?

Section 14.01. Organization. There shall be a planning department consisting of a planning commission, a zoning board of appeals, a planning director, and the necessary staff.

B. Review the annual budget prepared by the fire chief and make recommendations thereon to the mayor and the council.

Background: The rising number of contested case hearings has increased the need for the Planning Commission to hire hearings officers. The proposed

program with the advice of the mayor, complementing and reflecting the [S]state and [F]federal [P] programs for the [C]county.

B. Review the general plan and development plans and modifications thereof developed and recommended by the planning director. The commission shall transmit such plans with its recommendations thereon, through the mayor, to the council for its consideration and action.

G. Have the discretion to refer hearings to the zoning board of appeals.

Once the planning commission refers a matter to the zoning board of appeals, the zoning board of appeals shall make all Findings of Fact, Conclusions of Law and Decisions and Orders without further review or approval by the planning commission.

C. Review zoning and subdivision ordinances and amendments thereto developed and recommended by the planning director. The commission shall transmit such ordinances with its recommendations thereon, through the mayor, to the council for its consideration and action.

The commission shall recommend approval or rejection of such ordinances in whole or in part and with or without modifications.

D. Hear and determine [petitions] applications for [varying the application] variance from [of the] zoning and subdivision ordinances with respect to a specific parcel of land and may grant such a variance pursuant to [variance] provisions established by the council [in the zoning] by ordinance.

E. Adopt regulations having the force and effect of law pertaining to the responsibilities of the department.

F. Prepare a capital improvement

[G] H. Perform such other related duties as may be necessary to fulfill its responsibilities under this charter.

Section 14.12. Zoning Board of Appeals.

The board shall consist of seven members appointed by the mayor with the approval of the council. Board membership shall be representative of the community, and at least one member should have knowledge and awareness of environmental concerns by way of the person’s education, training, occupation, or experience; at least one member should have knowledge and awareness of business concerns by way of the person’s education, training, occupation, or experience; and at least one member should have knowledge and awareness of labor concerns by way of the person’s education, training, occupation, or experience.

Section 14.13. Duties and Functions of the Zoning Board of Appeals. In accordance with such principles, conditions and procedures prescribed by ordinance or administrative rule, the zoning board of appeals shall:

1. Conduct hearings in accordance with Chapter 91, Hawaii Revised Statutes regarding the violation of the zoning and subdivision ordinance and the regulations adopted thereunder; 2. Hear and determine appeals alleging error from any person aggrieved by a decision or order of the director regarding the application, interpretation or enforcement of zoning and subdivision ordinances as prescribed by ordinance; 3. Conduct hearings for landuse-related appeals which the board may be required to pass on pursuant to the charter or ordinance; and 4. Adopt rules of procedure for the conduct of the board’s business.

The zoning board of appeals shall be part of the department for administrative purposes and the county shall provide necessary training, administrative, and legal assistance to the board.

Section [14.12] 14.14. Appeals. Appeals from any decision of the planning commission or the zoning board of appeals shall be instituted in the circuit court within thirty [(30)] days after service of a certified copy of the decision of the commission or the board. All commission and board proceedings and appeals shall be in conformity with the Hawai‘i Administrative Procedure Act.

Proposing a Charter Amendment to Article XVIII Relating to the Civil Defense Agency Ballot Question: Shall the county Civil Defense Agency be renamed the Emergency Management Agency and its organization clarified consistent with state law?

Explanation: Hawaii State law recently renamed the “Civil Defense Agency” to the “Emergency Management Agency.”

Therefore, the current language of the Charter referring to the Civil Defense Agency is inconsistent with state law.

Additionally, the Charter does not currently assign a department administrator or director.

Purpose: This amendment seeks to establish an administrator of the County Emergency Management Agency, and ensures that the Charter language is consistent with State law by renaming the Civil Defense Agency to the Emergency Management Agency.

Charter Amendment.

Article XVIII of the Kaua‘i County Charter is amended to read as follows: Note: Charter material to be repealed is bracketed. New charter material is underscored.

ARTICLE XVIII [CIVIL DEFENSE AGENCY] EMERGENCY MANAGEMENT AGENCY

Section 18.01. [Civil Defense Agency.]

Emergency Management Agency. There shall be [a civil defense agency] an emergency management agency whose powers, duties, functions and organization shall be as provided by law.

Section 18.02. Mayor to Declare State of Emergency. The power to declare a state of disaster or emergency is conferred on the mayor. The mayor may declare an emergency when the peace, life, property, health or safety of the community are endangered[, but his failure or refusal to make such declaration shall not preclude the county council from finding that an emergency exists providing that the county council adopt an emergency ordinance in accordance with the charter].

(Amended 1984) Section 18.03. [Civil Defense Contingency Fund.] Emergency Management Contingency Fund. The council shall provide in the annual budget [a civil defense contingency fund] an emergency management contingency fund of not less than $50,000.00 to be expended by the mayor for public purposes during any state of emergency or disaster. A report containing a complete accounting of all such expenditures shall be made as soon as practicable to the council. (Amended 1984) Section 18.04. Organization. The county, under the mayor’s direction, shall provide a county-level administrator or director of the county emergency management agency, and technical, administrative, and other personnel; office space; furniture; equipment; supplies; and funds necessary to carry out the purposes of this chapter.

The administrator or director of the county

emergency management agency shall be subject to chapter 76 of the Hawai‘i Revised Statutes.

5. Proposing a Charter Amendment to Articles XXII and XXIV relating to the percentage of required voters for an initiative petition, a referendum petition, or a charter amendment petition and to specify what is a charter amendment as well as to enable the county clerk to determine whether the proposal is a valid charter amendment.

Ballot Question: Shall the percentage of registered voter signatures required to start the initiative or referendum process be reduced to 10 percent from 20 percent, and shall the percentage of registered voter signatures required to start the charter amendment process via voter petition be increased to 10 percent from 5 percent?

Explanation: Currently, the Charter requires that voters seeking to propose an ordinance or referendum by petition be signed by no less than 20 percent of registered voters in the previous general election. A charter amendment by petition must be signed by no less than five percent of the number of registered voters in the prior general election. This creates an inconsistency in the percentage of voters required to change, enact or reject county laws, and to amend the County Charter.

Purpose: This amendment seeks to decrease the number of registered voters required to propose an initiative or

Amendments to the Charter of the County of Kaua‘i and Ballot Questions referendum, from 20 percent to 10 percent of registered voters in the prior election.

It also seeks to increase the percentage of voters required to propose a charter amendment by petition from 5 percent to 10 percent. This makes the required percentage consistent at 10 percent for those wishing to propose an ordinance, referendum or charter amendment.

Ballot Question: Shall it be specified what constitutes a charter amendment, and shall the processing of a proposed charter amendment via voter petition be revised to enable the county clerk to determine whether the proposal is a valid charter amendment?

Explanation: The Charter currently requires that a charter amendment petition be presented to the County Council. It does not define a charter amendment or its limitations, nor does it specifically authorize a party to determine whether the proposal would be a valid charter amendment.

Purpose: The purpose of this amendment is to authorize the County Clerk, subject to court approval, to determine whether a proposed charter amendment is valid. It also seeks to limit a charter amendment to addressing the form or structure of county government, and not as a vehicle to adopt local legislation.

Charter Amendment.

ARTICLE XXII INITIATIVE AND REFERENDUM Section 22.03. Submission Requirement.

A. Voters seeking to propose an ordinance by initiative shall submit an initiative petition addressed to the council and containing the full text of the proposed ordinance. The initiative petition shall be filed with the clerk of the council at least ninetysix (96) hours prior to any regular council committee meeting.

B. Voters seeking referendum on an ordinance shall submit a referendum petition addressed to the council, identifying the particular ordinance and requesting that it be either repealed or referred to the voters of the county.

C. Each initiative or each referendum petition must be signed by registered voters comprising not less than [twenty percent (20%)] ten percent (10%) of the number of voters registered in the last general election.

(Amended 2012) D. If an initiative or referendum measure is to be placed on the ballot in a general election, the initiative and referendum petitions must be submitted not less than one hundred twenty (120) calendar days prior to the day scheduled for the general election in the county. (Amended 1976, 2012)

ARTICLE XXIV CHARTER AMENDMENT Section 24.01. [Initiation of Amendments.]

Initiation and substance of amendments.

Any amendment to this charter is limited in substance to amending the form or structure of county government. It is not a vehicle through which to adopt local legislation. Amendments to this charter may be initiated only in the following manner: A. By resolution of the county council adopted after two readings on separate days and passed by a vote of five or more members of the council.

B. B. By petition [presented to the council,] filed with the county clerk, signed by registered voters comprising not less than [five percent] ten percent of the number of voters registered in the last general election, setting forth the proposed amendments. Such petitions shall designate and authorize not less than three nor more than five of the signers thereto to approve any alteration or change in the form or language or any restatement of the text of the proposed amendments which may be [made] suggested by the county attorney. (Amended 2012) Upon filing of such petition [with the council], the county clerk shall examine it to see whether it is a valid charter amendment. If the county clerk concludes the measure is a valid charter amendment, the clerk shall then examine it to see whether it contains a sufficient number of valid signatures of registered voters.

Amendments to the Charter of the County of Kaua‘i and Ballot Questions If the county clerk concludes the measure is not a valid charter amendment, the county clerk is required to seek a declaratory ruling. If the ruling finds the amendment valid, the clerk shall then examine it to see whether it contains a sufficient number of valid signatures of registered voters. If the ruling finds the amendment to be invalid, the clerk shall so certify and provide the reasoning for that ruling.

6. Proposing a Charter Amendment Relating to Article XXIV Establishing A Permanent Charter Review Commission.

Ballot Question: Shall the Charter Review Commission be an ongoing commission?

Explanation: The Charter establishes a seven-member commission, called the Charter Review Commission, to study and review the operation of the county government. The current language of the charter states that the Commission will expire on December 31, 2016. A new commission can reconvene in 10 years, with members to be appointed by the mayor and approved by the council.

Purpose: This amendment seeks to remove the expiration date of the Charter Review Commission and eliminates the 10-year intervals between the creation of the commissions, thereby establishing a permanent Charter Review Commission.

Charter Amendment.

Article XXIV of the Kaua‘i County Charter is amended to read as follows: Note: Charter material to be repealed is bracketed. New charter material is underscored.

ARTICLE XXIV CHARTER AMENDMENT Section 24.03. Charter Review. The mayor with the approval of the council shall appoint, with appropriate staffing, a charter commission composed of seven members who shall serve in accordance with Section 23.02C of this Charter to study and review the operation of the county government under this charter. [for a period of ten years commencing in 2007. Thereafter, the mayor with the approval of the council shall appoint a charter commission at ten year intervals.] In the event the commission deems changes are necessary or desirable, the commission may propose amendments to the existing charter or draft a new charter which shall be submitted to the county clerk. The county clerk shall provide for the submission of such amendments or new charter to the voters at any general or special election as may be determined by the commission.

Kenji Burger, Kauai’s Newest Hotspot

By Léo Azambuja Every once in a blue moon, I come across a recently opened restaurant that got it just right from day one. Everything seems spot-on; the service, the ambiance, the prices, and more importantly, the food.

The food!

And that’s exactly how I felt when I left Kenji Burger, Kapa‘a’s newest hotspot, serving the best grass-fed good ol’ all-American burger, all dressed up in – you’ve got to taste it to believe it – Japanese flavors.

“I wanted to create a burger joint that had a Japanese flair to it, and people have been loving it,” said Erik Tanigawa owner of Kenji Burger.

The menu has six burgers, three rice bowls, chicken wings and a few surprises, such as a Kaua‘i-made mochi dessert and the ultra-exclusive Lucky Cat light lychee soda – Kenji is the only establishment in the entire state of Hawai‘i to carry this rarity of a drink from Japan.

Some of other “interesting fun facts” about Kenji, as Erik put it, are the locally sourced grass-fed beef from Sanchez in Wailua and the burgers’ buns; taro brioches baked exclusively for Kenji Burger by the folks at Passion Bakery in Kinipopo. Nowhere else you’ll be able to eat those buns.

Another highlight is the Japanese Sushi Burrito, a fat sushi roll cut in half, easy in the hands and deliciously complex in the palate.

The lanai, with a balcony facing the highway, gets crowded everyday right after rush hour. It is a fun place to sit down and do some people-watching while talking story with your friends or family. The inside has only two tables, but a balcony follows the entire perimeter of the dining room, making it easy to accommodate a crowd. Erik said he has plans to build an additional seating area out the back.

Erik set up mostly everything to be take-out. So you can either sit down and kau kau, or you can take your food home in a bento box, complete with your burger or rice bowl, a drink, dessert and furikake fries. Let me say it again: furikake fries! And I’ll leave it at that.

Kenji Burger’s instant success is no accident. Erik may look young, but he has vast amount of knowledge in Japanese food, both from home and from professional experience.

Born and raised on Kaua‘i, Erik started as a dishwasher at Kintaro in Wailua when he was only 15. He worked his way up to the kitchen there and in other Japanese restaurants, including on O‘ahu. Then he landed a job at a Japanese restaurant at the MGM hotel in Las Vegas, Nev., where he worked for 13 years. He only quit to open his own Japanese catering and food truck in Vegas. He recently moved back home, with his wife and young child.

With all that professional experience, he still values – and validates – his family roots.

Erik is half-Japanese and comes from a family of Japanese migrant plantation workers on Kauai’s Westside. A lot of what goes into his recipes came from home.

“It’s always a mix of family ingredients and things I learned working at Japanese restaurants,” he said of his menu. Ask him about the Tokyo Chicken Wings.

The family affair goes beyond the food. Erik’s father helped to remodel the building to match the vision of the business. His grandfather passed away a long time ago, but he is definitely present there: Kenji is Erik’s middle name, but the real reason he named it Kenji Burger is because it was also his grandfather’s name.

Francisco, Calif. It launched a journey I had started planning nearly a year before.

I had decided to celebrate 70 years of remaining upright, by taking an epic solo adventure on the Mainland.

Concurrently with sincerely wanting to celebrate my longevity was the desire to share this solo journey with people who were beginning to read my blog, mindandthemotorcycle.com and my monthly column in For Kaua‘i.

At times, it felt like I was producing a little show to draw attention to the

ride and the writing. The truth is it was an incredibly personal adventure for me.

A Virtual Eden of Flowers

By Virginia Beck A paradise of trees, a virtual Eden of flowers and rare plants, contributed by the winds and waves, followed by those who came by canoe, or ship, or airline. Kaua‘i is a mixed plate, as we call our local lunches. Mixtures of plants, cultures and races, all brought here seeking one thing; freedom to live in peace.

Kaua‘i’s extraordinary volcanic history gave rise to one the oldest inhabited Hawaiian Islands, splendid beaches, and some

Mālamalama species of birds and plants that you will find nowhere else on Earth. A trip to the Natural History Museum in Koke‘e State Park, above Waimea Canyon, will open your eyes to vivid birds and plants surviving in our wilderness.

One of the great treasures of the islands was the ‘iliahi, or sandalwood tree. Its precious, scented hardwood was in great demand in the early 1800s. It was used for fragrant boxes, jewelry and incense. The Hawaiians used it to perfume their kapa cloth.

The early monarchy agreed to trade with merchant ships.

Large holes equal to the measure of the ships’ holds were dug in the earth, to measure the quantities needed. The island people gathered enough to fill these pits. Unfortunately, it was harvested so aggressively, that it cannot be found on all islands anymore.

Kaua‘i still has some of these plants, known as ‘iliahi . It was

also the name of the beautiful plantation manager’s home up on the slopes of Kilohana, at the base of Waialeale. The property overlooks Līhu‘e, and has the most amazing views.

Grove Farms owns and maintains it.

No trip to Kaua‘i would be complete without visiting the spectacular collections at the National Tropical Botanical Garden. There are native plant collections, as well as the plants brought by the early Polynesian settlers in their voyaging canoes. The immense variety of plantings flow down the valley to the sea, with different ecosystems and habitats along the way, following the water to the ocean, where a protected green turtle colony nests on the beach.

From the amazing trees used in the movie “Jurassic Park” to endangered species such as the wiliwili tree with its brilliant crimson orange seeds, there is something there for every age group. Spectacular palm gardens, bamboo collections, serene

fountains for meditation, and beautiful statuary imported from Europe, mingle with Asian sculpture, thanks to the insight of John and Robert Allerton.

The National Botanical Garden also has a sister garden at Limahuli, on the North Shore, featuring, rock walls and ponds built by early Hawaiians, and different types of plant life, more suited to a rainy valley and streams. Visitors and locals both enjoy hiking in the beauty.

As you travel around the island, notice the variety of microclimates that share our tiny little corner of the Pacific.

From the lush mountains, to the green ranchlands, to the local truck farmers’ fruits and vegetables, you will be surprised again and again. Fascinating starfruit, dragonfruit, luau leaves, and more species of banana than we ever knew.

Surprisingly, the grocery stores carry lotus root, gobo and many oriental foods. Happily, ōlena, or turmeric, is turning up more frequently in our specialty stores. Don’t miss our farmers markets, which move from district to district each day, and a really big one at Kaua‘i Community College Saturday mornings.

“We educate students about bullying,” said Nevaeh Arruda-Kapu, adding students should know what to do if they’re being bullied, that they don’t have to give up, and that there are experienced people at school who are there for them.

“We get involved in a variety of community service projects in addition to National Make A Difference Day in Lydgate Park,” Nevaeh said. “For instance we’ve helped children at the Shriners Hospital in Honolulu. Service like this gives us life skills, and we get noticed.

We get out into the community and it has really helped us spread our Peer Mediation concept to other schools like Kaua‘i and Waimea High Schools.”

Malana said Lydgate Park community workdays are unique networking opportunities.

“In addition to giving back, we broaden our perspective by meeting and reaching out to members of

other organizations who have similar values,” Malana said.

Danica Ola is president of the Leo Club, a youth affiliate of the Lions Club. Leo members acquire skills as project organizers and motivators of their peers.

“We support the Kaua‘i Independent Food Bank and the Surfrider Foundation, and get involved in the community as much as possible,” Ola said. “Beaches are

for local families, we want to help keep our island’s beaches in tip top shape. We are willing to do anything so long we’re helping out. Kaua‘i is small, there’s a tight-knit community and we help each other out.”

morning, I was in heaven, comfortably cruising through the park, feeling a way that only a biker knows. It’s why we acknowledge each other on the road. The rest of the ride was like that, extreme highs and lows and not much in between, great fodder for a writer. I wrote to readers as if they were silent passengers on the back of the bike.

I want to tell you something amazing and I swear it’s true. I posted every day, sharing both the outside and inside experiences of my trip. The only way I could possibly write this anniversary piece was to go back and inhale the ride all over again, something I have not done since my return, never having read a single old post until this week.

The ride has completely come back to life. Reading my stories, I can effortlessly conjure up the sensations that felt so overwhelming back then. I really want to tell you about it all, but that is for another time. It was a precious adventure and I am so fortunate to have lived it and shared it.

In one of my last posts, I wrote, “We haven’t changed the world with our ride; all we have done is taken a break, gotten away from all that is familiar. What we choose to do with this experience is up to each of us. There is more up ahead and while our ride has come to a close, the journey continues and I hope we get to spend some of it together. Thank you.”

Kaua‘i Business Marketplace Excellence at The Computer Hospital

By Léo Azambuja Jeff Elkins is the kind of person who thinks outside the box, even though he works inside the box. A computer box, that is. He fixes computers.

“We are primarily a computer repair shop, but we do a lot of other things too,” said Elkins, owner of The Computer Shop in Old Kapa‘a Town.

Besides replacing broken hardware and getting rid of pesky viruses and annoying trial programs, the shop offers a variety of services. They do network management and consulting, sell new and refurbished desktops, and provide a physical space for real estate licensing tests, screening for airport employment, personal fitness training certification and others.

The Computer Hospital has been around since 1997. Elkins bought the company in 2010, when the former owner passed away. In 2011, it moved to its current location on Ulu Street, right behind the lot where the old Roxy Theater used to be. Today, the shop has four technicians in its staff, including Elkins.

“We’ve been the top computer shop (on Kaua‘i) five years running now,” he said, proudly.

Some of the shop’s success can be attributed to an untarnished reputation. Elkins said there are a lot of charlatans in the computer industry, so it’s really important to find someone you trust.

“We watch our reputation really carefully,” he said. “If you check us out on the Internet, you’ll find we have a sparkling reputation.”

Usually, the turnaround time for a computer repair is three to four days; and this time could be extended due to ordering new parts. As an advice, Elkins said if you’re running a business, and a computer is so important that a few days without it may be an apocalypse, you need to own another computer.

new machine or fix the old one, Elkins says most of the time, it is better to fix it.

“It is almost always not just cheaper, but way cheaper, to fix a machine than to replace it,” he said.

The repair fees at The Computer Hospital are affordable because the staff multi-tasks. They can work on several different machines at any given time, rather than, for example, waiting patiently for a computer to run a diagnostic. House calls, however, are more expensive, and though it’s usually preferable to bring a machine to the store, there are some jobs that have to be done on site, such as network setup or network troubleshooting.

Elkins said in the last five years, there has been a trend of switching to tablets, which are smaller and usually cheaper than laptops. But it’s important to know the purpose of the machine because tablets are not as versatile machines as laptops.

appropriate piece of hardware,” said Elkins, adding a lot of people seek The Computer Hospital for consultation, which a lot of times ends up being free.

Elkins wasn’t always a computer technician. In fact, he got his start in radio, and he used to work at Kaua‘i’s KQNG, popularly known as Kong Radio.

“Believe it or not, back in my salad days, I was a radio top-4Os DJ. I was the original morning show host on Kong (Radio). I was Ron Wiley before Ron came to do the show. I was the original Ron Wiley,” he said.

Back in the 1980s, radio stations started to transition to automation, and many DJs feared losing their jobs to computers, Elkins thought if he could be the guy to tell computers what to do, hew would always have a job. So he embraced the technology.

In 2000, he was working as program director in a radio station in Pensacola, Florida. The computer technician quit, and Elkins took over his job, even though he didn’t have a clue of what he was doing. But he learned quickly on his own. Then a couple years later, he enrolled in college again, graduating at the ripe age of 44.

“I highly recommend college in your 40s. For me, what happened in the 25 years between schools is, I learned how to listen,” said Elkins, adding he graduated second in his class.

He said there a lot of computer scams out there, including identity theft. He advises to never click on a popup window offering a software update, even if it looks legit. It’s always safer to go to the company’s official website and do the update from there.

Holokū and mu‘u

Words have meaning, but meanings can change over time – even when they’re the names of common items – like pieces of clothing.

A couple of Hawaiian words that can cause some confusion are the classic dresses of Hawai‘i, the mu‘umu‘u and the holokū, each of which has referred to a more formal garment over time.

I’ve wondered where you draw the line between the two.

I was chatting with friend Beryl Blaich on the subject. A holokū, she said, is a fitted dress with a train, a longer portion in back that trails behind the wearer. Suzanne Kashiwaeda said a holokū will often have decorative puffed shoulders or sleeves.

Kumu Haumana The Pukui-Elbert Hawaiian Dictionary describes the holokū as “a loose, seamed dress with a yoke and usually a train, patterned after the Mother Hubbards of the missionaries.” The yoke is that shaped piece of a garment that is fitted around the neck and shoulders, and which allows the rest of the garment to hang better. Like an early holokū , a Mother Hubbard tended to cover as much skin as possible – from a high neck to long sleeves and a length that covered the ankle, only the face and hands were visible.

A mu‘u, or mu‘umu‘u, by contrast, is and was a simpler garment – not so fitted, although some are, and shorter, generally. And early mu`u were sewn without yokes.

Generally, the holokū is a more formal garment, and the mu‘u a more casual one.

suggest both genders were often both topless and barelegged. It’s commonly argued that prudish missionaries encouraged Hawaiians to cover up, men in long-sleeved shirts and trousers, and women in attire that covered all but face and hands.

The missionary modesty may have been a factor, but there’s another story.

“I’ve heard that the early Hawaiian women sought out the mu`umu`u for the bright colors,” said Blaich.

And the differences a century and a half ago between the two garments may have been different as well. The 1865 Dictionary of the Hawaiian Language, by Lorrin Andrews, defines a holoku (the book did not use diacritical marks) as “a long flowing garment.” But it describes the muu-muu as “a shift or undergarment worn by females.”

So, the mu‘u seems to have gained a little pretense over time. From an undergarment, it seems to have evolved into a simple outergarment, and in many cases, a pretty fancy outer garment, often primarily differentiated from the holokū by its length.

While a holokū flowed, its bottom touching the ground, the mu`u was absolutely shorter. In fact, an alternative meaning for mu‘umu‘u, both in the 1865 dictionary and today, is cut-off or shortened. And despite what your local dress shop tells you about a fancy, expensive mu`umu`u with a frilly neckline, the Pukui-Elbert dictionary still calls it “a woman’s underslip or chemise; a loose gown, so called because formerly the yoke was omitted.”
