Earth Fare Inc. wants to develop its Mandarin South store as a “modern and more updated operation” of its organic and natural foods grocery chain. That description was included in a request for a zoning exception to sell beer and wine for off-premises consumption or by the glass in the store. Earth Fare did not respond to questions Monday about the elements of the updated operation or whether it is one of the company’s new designs. The Shelby Report trade publication reported last year the 24,000-square-foot Emory Point store in Atlanta was the first of the grocery chain’s locations to use the urban concept design. It said the layout places a greater emphasis on freshly prepared food items, including sandwiches and wraps, juices, smoothies and coffees, plus made-in-house sushi, salads and other entrees and sides. That store also features a 50-seat, indoor/ outdoor cafe with free Wi-Fi. The company announced then that the Emory Point store was the first of its locations to use the new design and wanted to encourage residents to make Earth Fare a preferred location for a coffee break or study session. Preferred Growth Properties, through PGP Jacksonville LLC, is redeveloping the Mandarin South shopping center at 11700 San Jose Blvd. The proposed 27,550-squarefoot Earth Fare location formerly was used as a Winn-Dixie, Wood You Furniture and Ollie Koala’s BackYard, an indoor playground. Plans show the store will have an indoor 62-seat cafe and outdoor cafe seating for 16. Earth Fare opened its first Jacksonville store in August 2014 in the Atlantic North shopping center at Kernan and Atlantic boulevards. Boom in need exceeds skilled labor pool By Jamie Swann, Contributing Writer When driving around Northeast Florida, it’s hard to ignore the changing landscape. New houses are springing up daily and builders are steadily buying more land for new subdivisions. The desire for new homes in Clay, Duval, Nassau and St. Johns counties is climbing so rapidly that contractors can’t get them built fast enough. “Mortgage rates are still low and the job market is good, which brings out buyers,” said Corey Deal, executive officer of the Northeast Florida Builders Association. According to NEFBA, 5,690 new home permits were issued from January through August in the four-county area. That’s up nearly 24 percent from last year’s end-of-August total of 4,330. “The municipalities are doing a great job keeping up with the market,” said Brad Muston, head of

construction for the Jacksonville division of Dream Finders Homes. “They are pumping out the permits as fast as they can.” But with a boom, also comes problems. Some homebuilders say they continue to have trouble finding construction workers for their job sites — and the demand is expected to grow. “It’s a huge challenge, no question about it,” said Muston. “And it’s not only a quantity issue, it’s a quality issue as well. The skilled trades labor market is really tight.” According to data from the Florida Department of Economic Opportunity, the state’s construction industry this year added 22,000 jobs, of which 4,300 were in Northeast Florida. New rule may impact millions of retirement plans

The most common is a trustee of a trust, but fiduciaries can include business advisers, attorneys, guardians, administrators of estates, real estate agents, stockbrokers or anyone with whom someone places complete confidence and trust. Fawbush said the labor depart-

ment is increasing the regulation of retirement plans because it’s estimated Americans have about $24 trillion in assets in such plans. That’s about equal to the national debt, he said. About $7.3 trillion of the total is invested in Individual Retirement Accounts (IRAs), which are regulated by the U.S. Treasury through the IRS. He said at least $95 million, and possibly as much as $159 million, is lost from retirement plans annually due to “conflict-

ed” financial advice. “Some people lose as much as 25 percent of the value of their retirement plan,” Fawbush said. Another reason for the new rule, he said, is that when Congress enacted in 1974 the Employee Retirement Income Security Act (ERISA), IRAs and 401(k) plans didn’t exist. Jacksonville-based Ash Properties seeks a permit to develop The Offices at Flagler Center, a three-story, 50,000-square-foot multitenant building in one of the area’s busiest submarkets. The professional office building is planned at 12574 Flagler Center Blvd. within the 1,022-acre Flagler Center. Ash Properties said the area population is projected to grow by more than 10 percent over the next five years. Ash Construction LLC is the contractor for the $549,832 project. Rolland, DelValle & Bradley Inc. is the architect. Ash Properties, a commercial real estate developer, said The Offices at Flagler Center is planned south of Old St. Augustine Road between Flagler Center Boulevard and Kenan Drive. From 1,000 to almost 16,000 square feet of contiguous space is available. The Class A building will be near the company’s 50,000-squarefoot Shoppes at Flagler Center, whose tenants include Planet Fitness. Flagler Center has attracted major institutions that include Baptist Medical Center South, which is undergoing significant expansion. Companies there include Web.com and Citibank.

so complex and its ramifications so unclear the chamber plans to challenge the rule in court, even though there’s little chance of prevailing. “The U.S. chamber doesn’t make the decision lightly to sue the government,” she said. “It’s not cheap, it will probably end up in a court of appeal and the chances of winning are well below 50 percent.” She said the chamber will nonetheless seek legal remedy because if the rule is allowed to stand as it is written, some retirement advisers may stop offering their services or increase what they charge clients due to the more stringent documentation requirements in the rule. “A lot of people may be left with fewer choices and less advice,” Joe said. UBA Senior Vice President Mark Williams believes the rule will have a greater impact on retirement plans at small businesses compared to major corporations. Look at the list of bills filed at any given period and one would find a slew of land-use bills. Zoning changes, deviations, permits being issued — it’s part of the everyday work of city departments and City Council members. Under a bill introduced last week by council Vice President John Crescimbeni, some of the landowners applying for such changes, exceptions and the like would be denied up-front if they aren’t in compliance or owe the city fines related to those properties. Call it the “bad neighbor” bill. Crescimbeni said for too long he’s seen both commercial and residential property owners seek changes that would end up financially benefiting them. All the while, they’ve had outstanding nuisance liens, fines and viola-

Mayor Lenny Curry’s administration is still evaluating the bill, according to a spokeswoman. He said the big question that’s come up in his discussions with various city departments is how to know when a denial is needed. Different departments issue permits and licenses. It could be as simple as enhancing distance for liquor sales or as comprehensive as complete property rezoning, but Crescimbeni believes the city should not help when “they’ve been a bad neighbor, so to speak.” The bill spells out that violations create expense for the city and hardship for people who depend on the stability of city operations — and non-compliant property owners disrupt that. The denial would happen at the application stage and apply to any department that grants permits and licenses. There are a couple of exceptions. Permits could be issued in certain circumstances to fix deficiencies that resulted in the code violation or fine, but would be limited to that purpose.

As he was pressed Monday night during a heated, hour-long debate with Democratic challenger Patrick Murphy, Republican U.S. Sen. Marco Rubio said he won’t abandon his office for a presidential run in 2020 if re-elected this year. The Senate candidates clashed over their parties’ presidential nominees, Rubio’s Senate attendance record, allegations that Murphy has embellished his resume and near party-line views on gun control, immigration, the Affordable Care Act, climate change and Cuba. Rubio highlighted his accomplishments as Florida House speaker and as a member of the U.S. Senate and contrasted that with Murphy’s lack of signed legislation despite a reputation as being a moderate member of the U.S. House. Rubio also said “God willing” he would serve all six years if re-elected, something Democrats and Murphy have been hitting the incumbent on as they assert he is using

the re-election bid to bolster future White House ambitions. When pressed by ABC chief White House correspondent Jonathan Karl, the moderator of the debate, Rubio replied, “I’m going to serve in the Senate for the next six years. God willing.” “I’m going to be a senator for the state of Florida for the next six years on behalf of the state of Florida,” he added as Karl sought a more direct response. “You can’t be senator and president at the same time.” Rubio’s comment appeared to have caught Murphy off guard, as a few moments later the Democrat rattled off that Rubio still hadn’t vowed to “commit to serving a full term,” as he responded to a question about his own business career. Rubio, who was criticized as being robotic during his failed presidential run after repeating a debate-prep line four times at one event, snapped back Monday, saying, “that’s a line he practiced before I said what I actually said today.” He and Murphy sparred about their par-

He noted Rubio continues to back Trump despite having called him a “con man” whom he doesn’t trust with the nuclear codes and despite derogatory comments by Trump about women, Mexicans, disabled people and veterans. “If you can’t stand up to Donald Trump as a candidate, how in the world are you going to stand up to him as the president of the United States?” Murphy asked. “This is about what he’s done. Think of how unqualified he is.” Rubio repeated a line he rolled out prior to the debate, saying neither presidential candidate is inspirational. And while he disagrees with a lot that Trump says and does, Rubio said he disagrees with everything from Democratic presidential nominee Hillary Clinton. When Murphy asked Rubio if there was anything Trump could do that would cause him to rethink his endorsement, the incumbent shot back, “Of course, like a lot of the things that Hillary Clinton stands for and does.”
