1. 1919 NASH ROADSTER 6 TELAIO N. 132773

CHASSIS NO. TC96

- Primo modello del marchio Nash. - Uno dei circa 27.000 esemplari del 1919. - Uno dei pochi esemplari rimasti. - Iscritto al Nash Owner Club d’America. - Importata nel 2008.

- First model of the Nash Motors. - One of the 27000 built in 1919. - One of the few remained. - Present in the Nash Owner Club USA. - Imported in 2008.

Nash Motors was an American car manufacturer active from 1916 to 1954. The first car to be marketed under the Nash brand was the 671, aimed at a large market, thanks to its low price. In 1918, 10283 units were produced and in 1919 even 27081. Our example dates back to the 1919 production, of which only 3 cars were exported to Europe at the time. Little is known about its history, which was certainly spent entirely in the United States: it was registered in Utah in 1982. At this moment the car has yet to be registered but is regularly cleared through customs.Soft top and interior appear to be original. Engine preserved but serviced, as is the gearbox. The bodywork was recently repainted, after the photo shoot for the catalogue.

2. 1927 WHIPPET PHAETON TELAIO N. 7918

MOTORE N. 7262

CHASSIS NO. 7918

ENGINE NO. 7262

- L’auto più piccola d’America nel 1926. - Auto rara nonostante le 600.000 unità prodotte. - Versione 4 cilindri cabriolet. - Dello stesso proprietario dal 1998. - Ferma da alcuni anni.

- The America’s smallest car in 1926. - Rare car despite 600.000 unit built. - 4-cilinder cabriolet version. - Same ownership since 1998. - Not used for some years.

The Whipped in 1926 was America’s smallest car. Produced by Willys-Overland, the new brand was intended to replace the Overland as an economical car with a smaller footprint, and was very competitive on the market in both price and performance. Unfortunately the factory closed its doors in 1931 due to the Great Depression. Although around 600,000 examples were produced over the course of five years, Whippets are very rarely seen today. Our car, chassis 7918, is a four-cylinder cabriolet from 1927. Bought by the current owner in 1998, over the years the car has been restored inside and out in the bodywork, but having stood still for some years it requires prior tuning. point before being able to circulate. The wheels turn and work perfectly, as does the steering; the gearbox is not blocked. There is also an additional spare tire with the same design as those fitted.

This BNC 527 type Monza, chassis 27031, was completed on 24 March 1927. It remained in the factory until 3 June of the same year when it was bought by Mr. Lobre, who from 1927 to 1930 will purchase another 5 BNC 527s. We know nothing about the car until 1980, when it was discovered in a semi-abandoned condition, in the Belgian countryside, by Mr. Orsoud, who buys it. In the south of France, a restoration begins but he did not complete. It was bought by an Italian collector who took it to Brescia where the restoration was finally completed in 2003. After being FIVA certified in Strasbourg in 2004, in yellow, it participated in the Mille Miglia from 2004 to 2007. In 2014 it was sold to another collector who, after painting it blue, resold it to the previous owner in 2018. The car is today in perfect condition, both mechanically and bodywork. Perfect for concourses d’elegance and competitions, it is eligible for the Mille Miglia, as it already participated in the editions from 2004 to 2007.

4. 1930 SUNBEAM 16.9 SPECIAL SPORT TOURER TELAIO N. 5159L

MOTORE N. 5158L

CHASSIS NO. 5159L

ENGINE NO. 5158L

- One-off su base Sunbeam 16 HP. - Carrozzeria tipo Boat-Tail. - Pronta per le competizioni d’epoca. - Interno in condizioni eccellenti. - Restaurata in Inghilterra nel 2004.

- One-off, made on a Sunbeam 16 HP. - Boat-Tail Coachwork. - Rady for vintage racing. - Interion in excellent condition. - Restored in UK in 2004.

Funded by John Marston in 1888, Sunbeam was a British company. They started producing bicycles but in 1902 they made their first car, the Sunbeam 10/12, with the chassis purchased by French Berliet concern. From 1907, two years after the Sunbeam Motor Ca Company had been formed, the firm produced their first all-British model: the Sunbeam 16/20 HP. After WWI, the civilian production recommenced in 1919 with 16HP and 24HP models. Our car was originally a Sunbeam 16 HP from 1930, purchased new in Britain. In 1971 was exported to Singapore, were the actual Boat-Tail coachwork was installed, most likely for competition. In 2004 the car was completely restored and arrived in Italy. In 2011, after a further car inspection, was purchased by the actual collector. Today the car is in excellent condition: the wood on the tail is in good condition as is the bodywork. The interior in Bordeaux leather, is in excellent condition as is the strumentations. The engine and mechanics also appear to be in perfect condition. The car is ideal for participating in concours d’elegance, due to its unique boat-tail bodywork, but also for regularity races.

- One of the first BMW models. - Only 150 built. - Excellent condition. - Matching Numbers. - Registered new in Netherlands.

Globalmente è in perfette condizioni.

In 1927, BMW decided to expand its production with cars. They didn’t want to start from zero but by taking over an already stablished manufacturer. The choice fell on a company that had been producing Dixi brand cars since the post-war period. In 1927, thanks to this support, the company managed to produce Austin Seven under license, rebranded as Dixi DA1. The company, in difficult condition, was bought in 1928 by BMW, and from July 1929 the cars were marketed under the Elica brand, renamed DA2. From 1930, a sport version with a roadster bodywork was produced, also intended for competitive use. Produced from 1930 to January 193, the DA3 was built in just 150 examples. Our car was registered new in the Netherland on 06/30/1930, with license plate DZ-07-80. Nothing is known about its past history, although there is a plaque on the dashboard from an international meeting in 1992. Purchased and imported by the current owner in 2016, the car is completely restored. Overall it is in perfect condition. The interior has been redone with modern materials but which reflect the original configuration. The car has its original engine, completely restored.

- Elegant Prewar Fiat Spider. - In the same collection since early ‘80s. - Completely restored in 1983. - ASI Certified. - Original registration.

It all started with the “Balilla” in the 1930s, with which mass motorization began in Italy. The name was the result of propaganda, but sympathy and affection have always surrounded this machine, of which everyone in Italy has a memory. Produced in multiple versions for every need, it became a “vehicle of desire” in examples like this one, convertible and suitable for romantic walks. We know little about our car until 1959, when a new registration certificate was issued. In the early 80s it was purchased by the current owner and completely restored. In 1983 it was certified ASI. It hasn’t been started for about 25 years. The bodywork and interior are in perfect condition, but the mechanics, which have not been used for a long time, require a complete overhaul. The car is idea for participating in meetings and regularity races.

8. 1936 BMW 319 CABRIOLET TELAIO N. 55316

MOTORE N. 75912

CHASSIS NO. 55316

ENGINE NO. 75912

- Affascinante carrozzeria cabriolet. - Restauro documentato eseguito da uno specialista tedesco. - Anteguerra BMW estremamente rara. - Eleggibile ai più importanti concorso d’eleganza.

- One of BMW’s earliest inline 6-cylinder models. - Charming cabriolet coachwork. - Documented restoration by German specialist. - Extremely rare Prewar BMW. - Eligible for the most important concours d’elegance.

L’interno in pelle nera è perfetto. La meccanica è in ordine e perfettamente funzionante.

In 1933, BMW introduced the 303 its first model to feature the kidney-shaped grille, and the first to be equipped with an inline 6-cylinder engine, development of the prior inline 4-cylinder unit, (itself an Austin derivation). In 1934, the 303 was replaced by two models with larger engines: the 1.5-liter BMW 315 and the 1.9-liter 319, with a power of 55 cv. The chassis of 319 took up the 315 and 303 chassis, with independent front wheels and rigid axle rear. The car was launched in a two-seater roadster configuration with the name 319/1, and was capable of reaching 130km/h. The quieter version was then presented, both in sedan and cabriolet configuration. It was produced in all versions in approximately 6646 examples, of which 2066 in the cabriolet version with rear seats, though very few are known to exist today. Our car was registered on 01/07/1936. We know little about its history until 2007, when it underwent a major restoration, by a German specialist, which lasted until 2012. The car was purchased by the current owner right after the restoration and is still in perfect condition. The two-tone red and black exterior is in excellent condition, as is the capote. The black leather interior is perfect. The mechanics are in order and in perfect working order.

- Elegantissima testimone del rinascimento italiano del dopoguerra. - Carrozzeria Unica realizzata da Balbo. - Eleggibile ai più importanti concorsi d’eleganza. - Installato motore Simca 1100 più potente. - Interno conservato.

- Very elegant witness of the post-war Italian Renaissance. - One-off coachwork by Balbo. - Eligible for the most important concours d’elegance. - Presented with a powerful 1100 Simca engine. - Original and preserved interior.

It all started with the “Balilla with which begun the mass motorisation process in Italy. From Balilla derives the entire lineage of the 1100s cars, the connecting link being the 508 C. The Fiat 508 C was introduced in 1937, powered by a 1.089 cc 4-cylinder engine instead of the previous 1 litre unit of the Balilla. Several famous motoring figures implemented the project of the original Balilla in those years: Tranquillo Zerbi, Antonio Fessia, Bartolomeo Nebbia and Dante Giacosa built a car with class performance, but with relatively low costs. The last evolution of this lucky model was the Fiat 508 C that Fiat initially tried to nickname Nuova Balilla 1100 but that motorists called only and always “1100”. It was in production until 1939, it costed LIT 19.500 and was produced in 57.000 units. Our car, chassis 508C219378, has a sone-off bodywork made by Balbo of Turin in 1950. The vehicle previously appeared as a flatbed truck. The car has original license plates. The car is in excellent condition, the body has no defect. The engine was replaced by a more powerful Simca 1100, but the lot includes the original engine dismantled. The interior is preserved.

- One of BMW’s most celebrated Pre-war. - Only 179 built. - Restoration by German specialist. - Multiple articles on car magazines. - Very elegant and sporty, for concourses d’elegance and competitions.

The BMW 327 was presented in November 1937, initially in the Sport-Cabriolet version, and impressed with its harmonious design, a synthesis between the aggressive look of the 328 roadster, presented at the beginning of the year, and the sober and refined one of the 316 and 320 cabriolets. The 327 shared much of the mechanics with its sisters 320 and 326: the chassis was identical tothe 320 while the engine was the 6-cylinder inline overhead valve of the 326, modified in the compression ratio to develop 55 HP. The 328 Sport-Coupé arrived in October 1938, offering a more comfortable and spacious interior than that of the open-top version. It was less popular than the Sport-Cabriolet despite having a more streamlined and elegant appearance. Production, which ceased in 1941 due to the conflict, as for all BMW cars, stopped at just 178-179 examples of Sport-Coupé, while for the Sport-Cabriolet it reached 1124 examples. The example in question, chassis 74170, was registered on 03/18/1940. Nothing is known about its past history, except that it has undergone a major restoration by a well-known German specialist. Since 2012 it has become part of the current owner’s collection, and is in excellent condition. The vehicle has been completely restored with bodywork, interior and mechanics, running perfectly and in perfect condition. It features a 12V electrical system compared to the expected 6V, but this is a change expected during the period of use. The car is ideal for participating in concours d’elegance given the streamlined coupé bodywork, as well as for regularity races.

L’auto è in buone condizioni e perfettamente funzionante.

Carrozzeria Monviso was an automotive coachbuilder active in Turin from 1944 to 1955 established by Alessandro Casalis. The company started the business by building utility veichles, like ambulances and hearses made from war remnants, but also bodies for Fiat chassis. The company’s philosophy was to make those bodies like series products: assembly precision and quality of finishes had to be comparable to the other car manufactures. Modern machinery were adopted, a sort of assembly line adapted to the reduced production capacity of the company, which allowed production times to be significantly shortened. For cost reasons, production was limited to a smaller number of body variants and models available, which however stood out for their construction quality. The flagship model was called “Stella Alpina”, and was product on mechanics and chassis from Fiat 1100, and built with coupé, spider e cabriolet body. In the 50s Monviso built fuoriserie on Fiat 600 and Lancia Aurelia, often commissioned by Ghia, which acquired the company in 1955. This car is a two-seaters cabriolet, built in 1947 on Fiat 1100B chassis. From the standard model the rear doors have been removed and the opening of the front doors has been reversed. The car is un good condition and works perfectly. Small conservative restoration interventions were carried out. The interior, in green leather, is in excellent condition, as is the soft top, in light brown.Eligible for the Mille Miglia (the model took part in various editions of the race) and for the most important concours d’elegance.

We are offering for sale a very special 1947 Fiat 1100, originally owned by Piero Zàini, whose family business was Zaini Chocolate factory in Milan. The Zaini family still manufacture chocolates today and currently have five chocolate shops in Milan. Piero Zàini with his best friend Piero Moscatelli as codriver, took part in the 1949 Mille Miglia and finished 120th in 18h20’13”. This same car took part in the 2020 Mille Miglia with two car enthusiasts. Due to the origin year 1947, it started with Number 122, which was a Start Time in the first 40 minutes of the race. Even though some challenges occurred during the race, the car reached the finish podium in Brescia, ranking 284th out of around 450 cars entered. The car participated again in 2022 Mille Miglia with the Starting Number 136, which was a Start Time in the first 45 minutes; the Fiat completed every stage, made it to every check point in time and finished 191st. For a driver skilled in Time Trials and Average Speed Trials, and with a low and desirable 1.30 factor, the car is well capable to finish in the top 100 of the race. The car has the two Mille Miglia “Seals” from 2020 and 2022 on the steering column, you can see them in one of the photographs. It also has a history file with documentation of the 1949 Mille Miglia, with a 1949 Mille Miglia finishing medal. In the map wallet hanging on the glove box knob, you can see the original 1948 Pirelli roadmap used by Zàini and Moscatelli. Even the personalized entry plaque is mounted on the car dash, by the steering wheel.

Since this Fiat 1100 was a genuine participant in the Mille Miglia, it is featured in the Mille Miglia’s Chassis book Volume III, dedicated to the cars that raced in the Mille Miglia and published by AUTOMOTIVE MASTERPIECES, written by car historian Sandro Binelli. A new copy of this limited edition and numbered book, still wrapped and unopened, will come with the car. The car is fully restored with no rust, the chassis only needs washing of visible dirt. The dashboard is fitted with hidden water temperature gauge and voltmeter, installed in the glove box. An additional spare rim and tire is added to the standard one on the back of the car, and another spare rim is provided, as in one of the photos. The car is fully maintained, had a new balanced drive shaft installed and the gearbox serviced for the 2022 Mille Miglia. It is prepared and ready to take part in the 2024 Mille Miglia. Since the car will be delivered in Milan after the auction for the new owner to collect it, if the new owner is in within 1100km of Calais, then it can be delivered directly to the new owner at no additional cost, rather than having to collect it in Milan. The odometer shows 24,377km, but they’re not verified. Registro 1000 Miglia Certificate with the Milan Registration Number: MI 110267. UK V5C with Registration Number: LXS 773. The 1100 was a popular car, the “average” car of the Italians par excellence, taking them from the Balilla to modernity. Born quiet, it found herself having a sporting DNA and ran, as in this case, with success. This perfectly restored specimen takes us back to its glories, to its participation in the 1949 Mille Miglia and can do it again, being easily enrolled in one of the current Mille Miglia re-enactments.

The Fiat 1100 is a small family car produced from 1937 to 1953. It was introduced in 1937 as Fiat 508 C or Balilla 1100, as a replacement for the Fiat 508 Balilla. The 508 C had more modern and refined mechanicals compared to the 508, including independent front suspension and an enlarged overhead valve engine. In 1939 the car underwent a restyling of the front end and simply became the Fiat 1100 (also inappropriately known as 1100 A to distinguish from the future variants). The car had gained a taller, pointed and more defined grille with horizontal chrome bars, the top three extending back over window-shaped louvres on each side of the redesigned engine bonnet, earning it the popular nickname of 1100 “musone”. No significant changes were made to the car’s mechanicals. In 1948, the 1100 received some mechanical and interior upgrades, and was renamed 1100 B. The revised type 1100 B engine produced 35 hp (26 kW) due to improved inlet and exhaust manifolds, and a larger 32 mm carburettor. The 1100 B lasted only one year, since in 1949 the car was re-introduced with a curvy boot and new name, the 1100 E.

Founded in Turin in 1926, Siata, an acronym for Società Italiana Applicazioni Tecniche Auto-Aviatorie, dedicated itself in the years between the two wars to the production of parts and spare parts for the development of automobiles, almost exclusively under the Fiat brand. Within a short time the company was already able to produce its own brand cars, always based on chassis and mechanics from the Turin giant. The first car branded S.I.A.T.A. it was the Amica, a small two-seater convertible, produced in two versions; the first called Amica 49 (1948-1949) with a tubular perimeter frame built in just 50 examples, the second called Amica 50 (1950-1952) with a steel box frame built in around 300 examples; both fitted the mechanics of the Fiat 500 “Topolino” with SIATA type “B” head, and designed by Mario Revelli de Beaumont.

È stata poi reimportata in Italia e re-immatricolata. Radio originale e sovratappeti tipo originale in gomma. Libretto Uso e manutenzione in copia fotostatica. Certificata ASI.

At the end of WWII, Alfa Romeo was in need to replace the big 6C model. The new car was lighter and smaller, designed under the supervision of Orazio Satta Puliga. It was the “Alfona” for the most, the “Pantera” par excellence, “the family car that wins the races” in the advertising. The Alfa Romeo 1900, built between 1950 and 1959, was the first Alfa Romeo entirely built on assembly line, monocoque and left-hand drive. The twin-cam engine was a 4-cylinder (for a lower taxation), 1.9-liter delivering 90 hp for a top speed in excess of 170 km/h. Giuseppe Busso provided to the chassis, Consalvo Sanesi to the testing, the shape was designed by Orazio Satta Puliga and Antonio Alessio. Gaetano Ponzoni, from Carrozzeria Touring, suggested the finishing touches. Inside there was room for two three-seater sofas. The 1900 four-door sedan was the only model available, until the introduction of the coupe in 1951 and the TI saloon in 1952. A total of 17,243 cars were produced. The 1952 Alfa Romeo 1900 sedan, chassis AR02163 has interiors redone as well as the chrome plating. Bodywork in good condition, some interventions are to be foreseen to make it perfect. Mechanics overhauled in many parts and in perfect working order. History entirely reconstructable with chronological excerpt. The first owner was a company in Genova that used it, presumably, for official purposes and for the management. Several changes of ownership following, then the car arrived in San Marino losing, unfortunately, the original Italian plates. It was then reimported to Italy and re-registered. The car has the original radio and original rubber mats. Use and maintenance manual in photocopy.

- Esemplare Unico su base Fiat 1100/03. - Realizzato da Wendler su commissione. - Prima proprietaria Edna Hill del consolato inglese in Baviera. - Presenza di alcuni vani segreti. - Oggetto di articolo su alcune testate giornalistiche.

- One-off, made on a Fiat 1100/03. - Coachwork by Wendler. - Ordered by Enda Hill, from British Consolate in Bavaria. - Secret Compartments in the car. - Multiple articles on car magazines.

This example of Fiat 1100/103, chassis no. 022049, was ordered new at the Fiat factory by lady Edna Hill, officer of the British Consolate in Bavaria, in 1953. This coupe is a one-off, coachbuilt by Wendler. Lady Hill contacted some important Italian coachbuilders like Viotti and Zagato, but decided to order the car from Wendler. The silhouette was suggested by Edna herself, as many specific of the car like the front inspired to Jaguar XK120, canvas sunroof, meters and reclining seats. The equipment also included two secret compartments, one under the back seats, and one behind the front grill: those spaces make the expert think that lady Hill was’t only a government official but also a secret agent. She kept the car until 2005. In 2013 the car was discovered on a government auction site and in 2014 was registered in Italy. The car is in good condition, despite age, and 200.000 kilometers. The exterior, in cream color, is in good condition and shows the signs of the time from a not very recent restoration. The brown imitation leather interior has been restored and is in good condition. The mechanics, overhauled, are in order.

- Ultima variante della BMW R25. - Certificata ASI. - Nella stessa collezione dal 1996.

- Last variant of the BMW R25. - ASI Certified. - In the same collection since 1996.

BMW’s first new post-war model was a single-cylinder design the 250cc R24 - which arrived in 1948 looking pretty much like the pre-war R23. In mid-1950 the R24 was superseded by the R25, which featured plunger rear suspension but was otherwise very similar. An improved R25/2 version was introduced during 1951 and between 1953 and 1956 came the final R25 variant - R25/3 - featured a new telescopic front fork, full-width alloy hubs and alloy wheel rims as the principal upgrades. We know little about our 1954 example until 1993, when following a restoration it was registered and ASI certified. In the current collection since 1996. Even if it is in perfect condition, we recommend a total overhaul of the vehicle before use, as it has not been used for approximately 20 years.

Known as the “fiancée of Italy”, the Alfa Romeo Giulietta spider embodies the spirit of an era. It was created specifically at the request of Max Hoffman, the American importer for Alfa Romeo. Wishing to propose an ideal two-seater to compete in the popular SCCA races, Hoffman asked to produce a car different from the classic English sports cars, with an outdated design. Designed by Pinin Farina, the Giulietta spider was a fresh, youthful, and elegant sports car.

This 1957 matching numbers example is a sought-after “veloce” version (type 750 F) boasting 80 hp thanks to several changes from the regular version, including the electric pump and two 40 DCO3 twin-barrel Weber carburettors. It is one of the last ones produced without fixed side window deflectors, therefore cleaner in line. The car comes from the US but has instruments in kmh, imported into Italy in 1992, it was registered in 1994. The restoration presumably took place in these two years. The car is in excellent general condition in Red (505) color and black interior with red piping as foreseen by the original trims. As accessories it has a Motorola am/ fm stereo radio, an adjustable navigator light and a fire extinguisher. - The car that saved BMW. - The first BMW with a monocoque structure. - Powered by an air-cooled, rear-mounted, 697-cc two-cylinder engine. - A desirable Coupé variant of Michelotti’s masterpiece in miniature. - Original black plates and log book

The BMW 700 is the first economical car, entirely made by the Bavarian company after the Second World War. Characterized by the sober lines created by Giovanni Michelotti, it will achieve great sales success which will revive the company from the serious financial crisis into which it had fallen due to the incorrect choice to produce luxurious cars in the early 1950s. Initially proposed in the two-seater versions “ Coupé” (E119) and “Cabriolet” (E110), from 1960 it will also be built in the fourseater sedan version, called “Limousine” (E107). The range was enriched in 1962 with the Luxus version, presented at the Geneva Motor Show and reserved for the sedan only, which stood out for its larger dimensions, due to a general increase in length of 32 cm (wheelbase increased by 16 cm) and for the equipment. Our example, chassis number 845894 and matching-numbers, was registered in Padova on 10 October 1963 and retains its original log book and first plate. It is in excellent condition. The bodywork has probably been restored not recently but the interior appears to be its original. It comes in the elegant white configuration with white interiors with red inserts. This is a car that, despite not having a very powerful engine, is suitable for taking part in regularity races.

ASI.

Loved and celebrated even outside the automotive world, the Jaguar E-Type was produced from 1961 to 1975. It was a revolutionary car in design, driving characteristics and aesthetics; it was ahead of its time. Its price was lower than that of competing cars of the same class and this helped sales. In 2004 the US magazine Sports Cars International ranked it first among the Top Sport Cars of the Sixties. This E-type up for auction is a 1963 Series I. The first thing that catches the eye is its “total black” interior and exterior livery; yes, exactly like Diabolik’s legendary car. The conditions of the specimen are superb, “concourse” level. A total restoration was carried out in 19931994, accompanied by extensive photographic documentation. Since 1995 it has been owned by the same owner, who imported it from England. The car is fitted with 72-wire racing-style rims and, in addition, has 4 original chromed wire rims, with new tires. Italian plates and documents are in order. ASI certified.

- Circa 50 built in two series. - Michelotti’s work for Moretti. - Completely restored. - Eligible for the most important concours d’elegance. - ASI certified Targa Oro.

After the war became an automobile manufacturer, with the production characterized by a high degree of finishing and by the possibility of obtaining the models in multiple bodywork configurations which included, in addition to the sedan, also coupé, spider and station wagon. The Fiat 600 and the Fiat 500 put small manufacturers in crisis, and Moretti, from the end of the 50’s, decided to suspend the construction of complete cars to concentrate on the creation of special bodies on large series mechanics. The company’s collaboration with the designer Giovanni Michelotti began in 1953. Michelotti’s creativity was such as to allow for bodywork that was perfectly adapted to both the original chassis designed by Moretti and those derived from FIAT. In 1961 Moretti presented the 750 Coupé: the starting point was the Fiat 600 D. Michelotti managed to design two versions, one for Moretti and one for Vignale, making them different and recognizable despite some common accessories, such as rear windows, to reduce production costs production of these two custom-built cars. The coupé was placed alongside the spider, for which a hardtop was provided. Two series of 750 Moretti were made, for around fifty examples. From 1963, the car was made with a fake aluminum mask on the nose. This Moretti 750, second series, chassis 1428860 and license plate TO527212, was discovered by the current owner in an industrial building in La Spezia. It was complete but in need of restoration, which lasted until 2019. During the restoration it was discovered that the original color wasn’t the blue it has when it was found, but white, an excellent combination with the red interior. The car was exhibited in 2017, with the restoration almost completed, at Automotoretrò in Turin, and obtained the ASI Gold Plate. It is still in perfect condition, restored in all its parts. Everything is documented. The car is ideal for participating in concours d’elegance.

Released in April 1955, the Rolls-Royce Silver Cloud banished the formal upright lines of its predecessors in favor of a more elegant and modern profile. As the first model to have its body, as well as the chassis, manufactured by Rolls-Royce it featured a pressed steel body on top of a straightforward boxsection chassis. The first series came with the familiar 155bhp straight-six engine but a new aluminum overhead valve, 6230cc V8 arrived, as did power-assisted steering, as standard, for the second series. The third series debuted in 1962, and was characterized by an overall lighter weight of around 100kg and a more powerful V8. Our car, chassis n° SJR271, was built in 1965, penultimate year of Silver Cloud production. Little is known about its history. In 2001 it was ASI certified. It is in excellent general condition.

All’interno i sedili ricevono i bianchetti di similpelle bianca. Ford Mustang chassis #7T02A201813 rolled off the assembly line at the New Jersey factory on February 21, 1967, before being shipped to Italy. In spring the car arrived at Zagato. Registered for the first time in June, it was completed in autumn. The changes mainly concern the exterior where the color changes from white to green, square Carello headlights are adopted and a fake air intake on the bonnet. Inside, the seats receive white imitation leather trim. The Mustang was collected by the first owner who covered 46,000 km until January 1983, when it was closed in a shed. In 1995 it was bought by the current owner’s father and restored, maintaining the modifications even though no one had information about the car. In 2018, a photo of the Mustang in front of the factory was found in the Zagato archive, irrefutable proof of the authenticity of the car. In 2019 the car was repainted in the green as it was when delivered to the customer, and was certified by Zagato. It has Zagato, ASI and FIVA certification. Car in perfect mechanical, bodywork and interior condition. The car was the subject of an article in the magazines “Autoitaliana” in the Autumn 2020 issue and “Octane” in the December 2020 issue.

The Lancia Beta was the first new Lancia presented after the acquisition by FIAT. The first version was the sedan in 1972. In 1973 the coupé version was presented, designed by Piero Castagneto and built on the platform, with a shortened wheelbase, of the sedan. Unlike the sedan, the coupé is designed entirely by the technicians of the Lancia factory. The twin-cam engines (the same as the sedan but upgraded) of 1592 cm³ with 109 hp and 1756 cm³ with 119 hp also contributed to the success of the model. Our 1974 example, chassis 007224, is equipped with a 119 hp 1800 engine, and is in original and preserved condition. It has some small signs of superficial rust and inevitable small signs of the time but overall it is in excellent condition. It is sold with new tyres, and the speedometer shows less than 47,000 km. It retains its original log book and first registration plate.

The car was found around 2010 located in a derelict but still original condition. The owner had initiated a restoration which stranded when car was dismantled. Unfortunately, the Giannini-prepared Fiat 750 engine was lost. The car was recently subjected to a thorough restoration, respecting the last body shape brought to the race and in which it remained. Counted among the Automotive Masterpieces, it was published in the book Mille Miglia’s Chassis Volume III. It has Dutch papers and number plates. Ideal for Mille Miglia re-enactments and the most exclusive sporting events for vintage cars. Refined and simple in its unpainted livery, it brings with it the flavor of a bygone era. The one-off 1938 Ogna Fiat 750 Giannini (Domenico Ogna), chassis no. 035785, a car with multiple lives. The diversity and ingenuity of the post war “Etceterinis” is a fascinating subject. Mostly based on affordable Fiat technology, dozens of sports cars were constructed by Italians with a passion for motorsport. This barchetta, constructed around 1946 and raced by Domenico Ogna, is a perfect example of such an Etceterini. The basis is a 1938 Fiat Topolino A chassis of which the engine was prepared by Giannini to compete in the 750 class.

The streamlined aluminium siluro body is supported by a tubular subframe. Initially fitted with cycle wings, it was later on in the early fifties (around 1951-1952), replaced by fixed wings attached to the body, due to new racing rules. The wings were now connected and flow from the lines of the central body in a single shape, however they were still physically separated from, and have been riveted to the central body, with a technique derived from aeronautics. Finally in 1954 a complete new barchetta style body was constructed, with truly integrated mudguards. The new (and last) line closely resembles that of the, even then, iconic Ferrari 166 millemiglia designed by Touring. Same proportions on a smaller scale, same lines, including the groove between grille and headlights. Curious is the massive “American” chrome grille which was typically an aesthetic accessory mounted on the Topolino of the time. Domenico Ogna raced his sports-competition car in a record number of five Mille Miglias. The car raced the 1948 edition with 1038 entry number, ranking 61st overall and 8th in class; the 1949 edition with 237 entry number, ranking 165th overall and 14th in class; in the 1950 edition with 325 entry number, the car did not finish; the 1952 edition with 2345 entry number, ranking 220th overall and 9thin class; in the 1954 edition with same 2345 entry number, the car did not finish. At the wheel, always the owner-builder Domenico Ogna. Co-driver in 1948 and 1952 was Cesare Ogna; in 1949, Guido Zerneri; in 1950, Gianfranco Calini; in 1954, Enrico Ogna. Domenico Ogna also faced the 1949 Circuito del Garda, ranking 11th overall and the 1950 Corsa sulle Torricelle, ranking 9th overall.

At the end of WWII, the Modenese Vittorio Stanguellini returned to racing with unchanged energy and got to work on the new series of 1100 Sport Nazionale, which were raced by several drivers at the 1947 Italian Championship. During the season the 1100 Stanguellini obtained 10 overall and 37 class wins and Nuccio Bertone was one of these successful drivers. But the meeting between Bertone and Stanguellini also led to a business agreement with the birth of a small series of a lightweight “4-seater Berlinetta Special” or “Sport”. It was designed for Carrozzeria Bertone with ponton styling by Fabio Luigi Rapi. Bertone exhibited the first specimen at the 1947 Villa d’Este concours. The Berlinetta was introduced with a Fiat 1100B chassis and a tipo 108 engine (the standard 32 hp improved by Stanguellini to 43 hp).

Restaurata e matching numbers.

Later it was built on a Fiat 1100 E chassis and fitted with the 60 bhp Stanguellini 1100 engine. Bertone bought the Fiat chassis, Stanguellini improved the engine in Modena and later Bertone made the body and fitted up the rest. The Berlinetta was produced between 1947 and 1954, in two different versions with an alloy or steel body. Some Fiat 1500 6 cylinder and Lancia Aprilia were based on this model, built with a welded steel one-piece shell. The price in 1948 was 2.8 million liras as like as a Lancia Aprilia Pinin Farina cabriolet. Thanks to the shape and to the weight it could compete with the Fiat 1100S (51 hp) because it had a max speed of 150Km/h. The Fiat Stanguellini 1100 Berlinetta Special (Bertone) chassis no. 290996 is an example from 1947, first year of production, and raced in the 1951 Coppa Intereuropa with racing number #84. A peculiarity of this car is that in 1954 the renowned Ditta F.lli Giannini of Rome carried out a fine-tuning of the engine, as confirmed by the mortgage reported in the chronological extract. The car has a fiche CSAI and has been the subject of articles in the specialized press. In recent years it has had an intense activity in re-enactment races, including the Mille Miglia.

An “everyday” 1100/103 for the races. The car began its story in 1953 with an important owner: Margherita AsburgoLorena, archduchess of Austria, princess of Bohemia, Hungary, and Tuscany. Later, the car begins a sporting career. In fact, it took part in the XXII Mille Miglia in 1955, sadly without success in the end. A few days later it takes part in the XXV Criterium di Roma, where it has better luck, finishing with an honorable 7th place in class. The history of the following owners is traced, with chronological excerpts. After undergoing a complete restoration, the car embarked on a career in re-enactment races, including the Mille Miglia. Recently, the seller did the following work: checked engine and changed distribution; new wheel bearings and seals; new brakes all around; revised rear diff with new bearings; did all electrics, new battery, new floater of tank, new tyres and so on. A complete reportage of all maintenance it’s on disposal. Car comes also complete with a map of all docs, like Mille Miglia and user manual. Counted among the Automotive Masterpieces and published in the Mille Miglia’s Chassis Volume III book.

As had already happened for the Appia, Flavia and Flaminia, Lancia gave Zagato the task of creating the sport version of the Fulvia. It was launched in 1965 and had the same mechanics as the Coupé, but thanks to improved aerodynamics it reached higher top speeds. It was almost never used in rally competitions but found its natural competition ground on the track. The Fulvia Sport 1600s are the maximum evolution of the model and appear with the second series, equipped with a steel bodywork, with a higher roof and front-hinged bonnet. They are fitted with the “Fanalino” engine and gearbox, have specific recessed handles, stainless steel bumpers with rubber bolts, seats with headrests, electric windows. Only 800 of this model were built. This example has been partially restored in Belgium with new paint, around 5 years ago. The current owner bought it a few months later, still in Belgium. Registered and with Fiva passport.

Potential Buyers are required to consult the Site to view the most up-to-date classification of the lots in the catalogue. Provenance In certain cases, Finarte may print in the auction catalogue the history of the ownership of a lot when it believes that such information can contribute to the study of, or can help identify, the lot. THE AUCTION

Conduct of the Auction The auction is regulated by the General Terms and Conditions of Sale and by the General Terms and Conditions of Mandate. The General Terms and Conditions of Sale can be amended by a saleroom notice posted in the auction room or an announcement made by the auctioneer before the auction begins. If Finarte also allows online biddings, such amendments will be disclosed also through the Website before the auction begins. Bids can be made in person by using a paddle at the auction, in writing prior to the auction, over the telephone or via the Internet (in the latter case, only if allowed in the specific auction). If the Seller is a professional and the Buyer a consumer within the meaning of Article 3 of the Italian Consumer Code, sales made by means of written, telephone or online bids shall be deemed as distance contracts within the meaning and for the purposes of Articles 45 et seq. of the Italian Consumer Code. The speed of the auction may vary between fifty (50) and one hundred and twenty (120) lots per hour. Generally, each bid is made by offering a ten per cent (10%) increase over the previous one. Finarte shall be entitled, at its exclusive discretion, to refuse any person from participating in the auctions. With respect to any prospective Buyer, Finarte reserves the right to make the participation in the auction subject to the prior submission of a letter of reference from banks or the deposit of a sum as a security for due performance of the obligations set out in these General Terms and Conditions of Sale, to be returned once the auction is over. Anyone making a bid at an auction will be considered a party directly concerned by the purchase unless otherwise agreed between Finarte and the same by a written agreement, where the latter declares to act in the name and on behalf of a third party, and this is accepted by Finarte. In the event that a person, who has been given the possibility of making a bid in connection with a lot, has a direct or indirect interest in the same, e.g. a beneficiary or a will executor who has sold the lot, a co-owner of the same or any other party having provided a guarantee in relation to the lot, Finarte will include such information in the catalogue. The auctioneer conducts the auction starting from the bid he considers suitable, taking into account the value of the lot and any competing bids. The auctioneer can open the bids on each lot by making an offer in the interest of the Seller. The auctioneer can also make bids on behalf of the Seller up to an amount corresponding to the Reserve, by putting consecutive bids or in reply to other bids. The fall of the auctioneer’s hammer determines the acceptance of the highest bid, the Hammer Price and, consequently, the conclusion of the purchase contract between the Seller and the Buyer. The auctioneer may, at its sole discretion and at any time in the course

of the auction: (a) withdraw a lot from the auction; (b) review a sale offer relating to a lot, whenever the same may deem that it contains mistakes and/or could give rise to disputes; and/ or (c) adopt any measures that the same deems adequate to the circumstances of the case, e.g. to combine or separate lots, or vary the order of sale from the one set out in the catalogue, provided that the lot is not offered for sale any day prior to the one set out in the auction catalogue. At some auctions, a video screen may be operated. Finarte will not be held liable for both the correspondence to the original of the image displayed on the screen and any malfunction of the video screen. Finarte represents that the lot can be declared an object of cultural interest by the Italian Ministry of Cultural Heritage and Activities and Tourism under Article 13 of the Urbani Code. In such case, or in the event that a procedure has been undertaken in order to declare the lot an object of cultural interest under Article14 of the Urbani Code, Finarte will announce said circumstance before the sale. Should the lot be declared of cultural interest, the Seller shall notify the sale to the competent Ministry under Article 59 of the Urbani Code. The sale shall be subject to the condition precedent that the Ministry does not exercise its pre-emption right within 60 (sixty) days as of the date of receipt of the relevant notice, or within the 180- (one hundred and eighty-) day period under Article 61, second paragraph, of the Urbani Code. In the period when the pre-emption right may be exercised, the lot cannot be delivered to the Buyer in accordance with Article 61 of the Urbani Code. Generally, the Reserve does not exceed the Minimum Pre-Sale Estimate announced or published by Finarte, except in the event that the Reserve is the Reserve is expressed in a currency other than Euros and there are significant fluctuations in exchange rates between the time when the Reserve is agreed and the day of the auction. In such case, unless otherwise agreed between Finarte and the Seller, the Reserve shall be an amount equal to the Euro equivalent based on the closing exchange rate on the business day immediately preceding the auction. No “without limit” bids, “upon examination” bids or any bids covering lots alternative to the one indicated will be accepted. Room Bids To participate in a saleroom auction, all potential Buyers are required to take – before the auction begins – a numbered paddle to make their bids. The numbered paddle shall be provided to each potential Buyer by Finarte’s staff at the registration desk subject to showing an identity document, filling in and signing the relevant registration and paddle allotment form. By filling in and signing the registration and numbered paddle allotment form, each potential Buyer will accept the General Terms and Conditions of Sale included in the catalogue.

Numbered paddles must be used to indicate the bids to the auctioneer during the Auction. If you are the highest bidder for a lot, you must be sure that your paddle can be seen by the auctioneer, and that the number announced is your number. In case of doubt concerning the Hammer Price or the Buyer, promptly call the auctioneer’s attention. All sold lots will be billed to the person and address indicated upon allotment of the numbered paddle and cannot be transferred to other persons and addresses. In case of loss of the paddle, please inform the auctioneer’s assistant, who will provide any potential buyer with a new paddle. After the auction, those who have made their bids in writing will have to promptly check with Finarte if their bids have been successful. The descriptions for cars and motorcycles, including in relation to their history, age, model, changes of ownership, state of preservation and possible restoration processes, technical characteristics, internal and external components, including the engine number (matching number or not) and chassis number of the car – present in the catalogue and/or in any condition report – are given by Finarte in good faith as guidelines to the potential Buyer on the basis of the indications and information received from the Seller, but may not be considered exhaustive and/or verified. All cars and motorcycles – together with the relevant documents accompanying them – must therefore be properly examined by the potential buyer in order to fully ascertain their condition. Failure to indicate any defect, restoration work or of the presence of any non-original part does not preclude the possibility that any such defect, restoration work or presence of a non-original part exist. The descriptions, in the catalogue and/or in the condition report, for watches and gemstones including in relation to the state of preservation and any restoration, are given by Finarte as guidelines to the potential Buyer on the basis of the indications and information received from the Seller, but may not be considered exhaustive and/or verified. All the watches and gemstones must therefore be appropriately examined by the potential buyer in order to be able to ascertain their status. Failure to indicate any defect, restoration work or of the presence of any non-original part does not preclude the possibility that such defect, restoration work or presence of a non-original part exist. Wristwatches declared by the manufacturer as water-resistant may have been opened for examination; Finarte therefore suggests that such watches be controlled by an authorised dealer to check their resistance before using the same in conditions where water is present. Straps made of organic material are associated with the watch for display purposes only. Prospective buyers are aware that the importation to foreign countries of materials derived from endangered or otherwise protected species (e.g. tortoiseshell, ivory) are subject to CITES international rules; prospective buyers should therefore acquire the necessary information on such restrictions before participating in the auction for lots containing, even partially, materials falling within the scope of the above rules. 7. PAYMENT In case of sale, the Buyer shall pay to Finarte the Total amount due immediately – and in any event no later than five (5) days – after the conclusion of the auction. If a lot is the subject of the declaration under Article 4.1.14 above, the Buyer shall pay the total amount due upon expiry of the period for the exercise of the pre-emption right by the competent Ministry. Invoicing of the Hammer Price to the Buyer shall be the exclusive responsibility of the Seller.

The payment of the Buyer’s Premium and of any Expenses can be made in cash, by bank draft, cheque, bank transfer, debit or credit card (American Express, Visa or Mastercard) or Paypal. Finarte may accept single or multiple payments in cash only for amounts up to Euro 4,999.99. In case of bank transfer, the bank details are the following:

Finarte Auctions S.r.l. banca:.BANCO.BPM IBAN.numero.IT65G0503401748000000002588 SWIFT numero BAPPIT21677 In case of bank transfer, in the payment description the Buyer’s name and surname and the invoice number must be specified. Payment by debit card, American Express, Visa or Mastercard can be made only by the card holder or, in case of PayPal, by the account holder. Finarte reserves the right to check the origin of payment received and reject payments received from any persons other than the Buyer. In limited circumstances, and in any event subject to the Seller’s consent, Finarte may offer any Buyer deemed reliable the possibility of paying the lots in instalments. The conditions for payment in instalments must be agreed before the auction. Before deciding whether to grant the possibility of paying in instalments or not, Finarte can request references in connection with the Buyer’s reliability as well as documentation proving his/ her identity and residence. Also pursuant to and for the purposes of Article 1523 of the Italian Civil Code, the transfer of the ownership of a lot from the Seller to the Buyer shall take place only upon payment by the Buyer of the tTotal amount due. In case of non-payment or late payment by the Buyer – within the time limit set out in Article 7.1. above – of the Total amount due, either in full or in part, Finarte shall be entitled, at its discretion, to ask for due performance or terminate the contract for sale pursuant to Article 1456 of the Italian Civil Code, without prejudice, in any event, to its right to claim damages and the right to have the lot sold on behalf and at the expense of the Buyer, pursuant to Article 1515 of the Italian Civil Code. In case of delay in the payment of the Total amount due for a period of more than five (5) business days as from the auction date, Finarte may store the lot with a third party at the Buyer’s risk and expense and charge the Buyer interest on arrears to Finarte at the 3-month Euribor rate provided by law plus five per cent (5%), without prejudice to Finarte’s right to claim further damages. In case of non-payment or late payment by the Buyer, Finarte may reject any bids made by the Buyer or any representative of the Buyer in the course of following auctions, or request that the Buyer lodges a sum in cash as security before accepting any bids. Finarte may offset any amount due for whatever reason to the Buyer against whatever sum owed for whatever reason by the Buyer to Finarte. Cash desk time: Monday - Friday 10:00 am - 1:00 pm; 2:00 pm - 05.30 pm.

8.

DELIVERY AND COLLECTION OF THE LOT

The lot will be delivered at Finarte’s registered offices no later than five (5) business days of the date of the sale. The lot will be delivered to the Buyer (or to any third party authorised by the Buyer by a written power of attorney) only after Finarte has received the Total amount due. Upon delivery of the lot, Finarte will ask the Buyer or any third-party appointee to provide a document proving his/her identity. Before organising the collection, please check with Finarte where the lot is stored. In case of death, interdiction, inability, cessation/winding up, for whatever reason, of the Buyer, duly notified to Finarte, the latter agrees to return the lot, subject to prior consent of all the Buyer ’s assignees, or in accordance with the terms established by the judicial authority. Should the Buyer fail to collect the lot within five (5) business days of the date of the sale, Finarte may: (a) charge the Buyer an amount corresponding to one per cent (1%) of the Hammer Price for each month of delay in the collection of the lot, from the fifth business day following the sale; or (b) store the lot with a third party at the Buyer’s risk and expense. 9.

TRANSFER OF RISK

A purchased lot is entirely at the risk of the Buyer starting from the earliest to occur of the following events: (a) when the Buyer receives the purchased lot; or (b) when the Buyer pays the Total amount due for the lot; or (c) from the date when the five (5) business day payment period after the sale starts to run. The Buyer will be indemnified for any loss or damage occurring to the lot after the sale but before the risk is transferred, but said indemnity may not exceed, except in case of wilful misconduct or gross negligence, the Hammer Price along with the Buyer’s Premium received by Finarte. Except in case of wilful misconduct or gross negligence, Finarte may not be held liable for the loss or damage to the frame or the glass containing or covering prints, paintings or other artworks, unless the frame or glass constitute the lot sold at auction. In no circumstance may Finarte be held liable in case of loss or damage due to any work (including restoration, work on the frame and cleaning operations) carried out by independent experts designated by Finarte with the Seller’s consent, or in case of any loss or damage directly or indirectly caused by, or arising from: (a) changes in humidity or temperature; (b) normal wear and tear or gradual deterioration due to operations on the lots and/or hidden faults and defects (including woodworms); (c) improper treatment; (d) war, nuclear fission, radioactive contamination, chemical, biochemical or electromagnetic weapons; (e) acts of terrorism; and (f) other force majeure events.

10.

SHIPMENT

Upon written request of the Buyer, Finarte may arrange the packaging and shipment of the lot, on condition that the Buyer: (a) has fully paid the Total amount due; (b) provides Finarte with any certificate of free circulation or export licence or any statement and/or certification required for such purpose. Unless otherwise agreed with the Buyer: (a) packaging and shipment expenses shall be for the account of the Buyer, who may request, at least twenty-four (24) hours before the beginning of the auction, estimates of costs should the Buyer decide to entrust Finarte with the packaging and shipping of the lot; (b) the insurance coverage concerning any risk for (even partial) loss and/or damage caused to the lot during transport must be agreed between the Buyer and the carrier without any liability for Finarte; (c) the cost of insurance shall be for the account of the Buyer. The shipment and packaging of the lot to the Buyer shall be entirely at the risk and expenses of the Buyer and Finarte shall in no event be held liable for any action or omission of packaging workers or carriers. 11.

EXPORTATION FROM THE REPUBLIC OF ITALY

Export of cultural goods outside the territory of the Republic of Italy is regulated by the provisions of the Urbani Code. Likewise, export of cultural goods outside the territory of the European Union is regulated to the provisions of Regulation (EC) 116/2009 of 18 December 2008 and of Commission Implementing Regulation (EU) 1081/2012. The export of a lot from the territory of the Republic of Italy may require a certificate of free circulation or an export licence. Obtaining a certificate of free circulation and/or export license is the responsibility of the Buyer. In case of non-obtainment or delay in the obtainment of a certificate of free circulation and/or an export license, said circumstance shall not constitute a reason for the termination or cancellation of the sale, nor a justification for late payment of the Total amount due by the Buyer. 12.

13. SAMPLE TERMINOLOGY Please pay attention to the following sample terminology: • “SANDRO BOTTICELLI”: in Finarte’s opinion, the work is a work by the artist (when the artist’s forename is not known, whether the surname is preceded by a series of asterisks or by an initial or not, it indicates that the work is by the named artist). • “ATTRIBUTED TO SANDRO BOTTICELLI”: in Finarte’s opinion, the work is probably a work by the artist, but there is less certainty than in the above category. • “SANDRO BOTTICELLI’S STUDIO/WORKSHOP”: in Finarte’s opinion, the work is a work by an unknown hand in the artist’s studio/workshop who may have undertaken the painting under the artist’s supervision. • “SANDRO BOTTICELLI’S CIRCLE”: in Finarte’s opinion, the work is by an unidentified but distinct hand, closely associated with the named artist but not necessarily a pupil of the artist. • “FOLLOWER OF SANDRO BOTTICELLI”: in Finarte’s opinion, the work has been made by a painter working in the artist’s style, contemporary or nearly contem¬porary to the artist, but not necessarily a pupil. • “SANDRO BOTTICELLI’S MANNER”: in Finarte’s opinion, a work of the style of the artist and of a later date. • “AFTER SANDRO BOTTICELLI”: in Finarte’s opinion, the work is a copy of a known work of the artist. • “IN THE STYLE OF …”: in Finarte’s opinion, the work is in the style mentioned, but of a later date. The term “signed” and/or “dated” and/or “inscribed” means that, in Finarte’s opinion, the signature and/or date and/or inscription are from the hand of the artist. The terms “bearing signature” and/or “date” and/or “inscription” means that, in Finarte’s opinion, the signature and/or date and/or inscription seem to have been added or from another hand. The dimensions given are height first, width and, possibly, depth. Paintings and photographs are not to be considered framed unless otherwise specified.

PROTECTED SPECIES 14.

All lots consisting of, or containing, parts of plants or animals (e.g.: coral, crocodile, ivory, whalebone, turtle), regardless of their age or value, may require a licence or certificate before export, and/or additional licences or certificates for importation into non-EU countries. The granting of a license or certificate for import does not guarantee the obtainment of a license or certificate for export, and vice versa. Please note that obtainment of an import licence or certificate does not guarantee any export licence or certificate and vice versa. Finarte recommends that potential Buyers check the requirements under their national legislation for the import of goods made of, or containing, protected species into their country. It is the Buyer’s responsibility to obtain such import or export licences/certificates as well as any other document required before making any bid. Please refer to Article 11 of the General Terms and Conditions of Sale.

LEGAL GUARANTEE OF CONFORMITY

If the Seller is a professional and the Buyer a consumer within the meaning of Article 3 of the Italian Consumer Code, and the lot sold can be deemed a “consumer good” within the meaning of Articles 128 et seq., of the Italian Consumer Code, such lots sold through Finarte are covered by the legal guarantee of conformity provided for in Articles 128-135 of the Italian Consumer Code (“Legal Guarantee”). The Legal Guarantee is reserved for consumers. It therefore applies only to anyone who has bought a lot for purposes unrelated to his/her business, commercial, craft or professional activities. The Seller is liable to the consumer Buyer for any lack of conformity existing at the time of delivery of the product “consumer good” that becomes apparent within two (2) years of that delivery. The lack of conformity must be reported to the Seller, under penalty of forfeiture of the guarantee, within two (2) months of the date of which it was discovered. Unless proved otherwise, it is assumed that any lack of conformity which becomes apparent within six (6) months of delivery of the product already existed on the delivery date, unless such assumption is incompatible with the nature of the product or with the nature of the lack of conformity. From the seventh month following the delivery of the lot, it becomes the consumer’s burden to prove that the defect existed at the time of delivery. In order to avail himself/herself of the Legal Guarantee, therefore, the consumer shall first give proof of the date of the sale and the delivery of the lot. To be able to provide this proof, the consumer should, therefore, keep the order confirmation, the purchase invoice or the DDT or any other document suitable to demonstrate the date of purchase and delivery. With reference to the definition of “lack of conformity”, please refer to the provisions of Article 129, second paragraph, of the Consumer Code. Excluded from the scope of the Legal Guarantee are any defects caused by accidental events or by responsibilities of the Buyer - consumer, or by any use of the lot that is incompatible with its intended use. In this regard, it is specified that all the lots, including those having - either in part or in full - an electrical or mechanical nature, must be considered purely for their artistic, decorative and/or collective value and must not be deemed working. In the event of a lack of conformity duly reported in the appropriate terms, the consumer Buyer will be entitled: (i) first, to the repair or replacement of the lot, at his/her discretion, free of charge, unless the remedy requested is objectively impossible or excessively onerous compared to the other; (ii) second (in cases where repair or replacement is impossible or excessively onerous, or the repair or replacement did not take place within a reasonable time or the repair or replacement made previously caused significant inconvenience to the consumer), to a reduction in the price or termination of the contract, at his/her discretion. The remedy requested shall be deemed excessively onerous if it imposes unreasonable costs upon the Seller compared to any other applicable remedy, taking into account: (i) the value that the lot would have if there were no lack of conformity; (ii) the nature of the lack of conformity; (iii) the possibility to implement the alternative remedy without significant inconvenience to the consumer. If, during the period of validity of the Legal Guarantee, the lot shows any lack of conformity, the consumer may contact Finarte according to the terms of Article 14. Finarte will promptly reply to any notice of alleged lack of conformity and inform the consumer of the specific procedure to be followed.

16.

APPLICABLE LAW AND JURISDICTION

These General Terms and Conditions of Sale are governed by the laws of Italy. Any dispute relating to the application, performance and interpretation of these General Terms and Conditions of Sale shall be submitted to the exclusive jurisdiction of the courts of Milan. The above is without prejudice of the applicability to Buyers who are consumers under Article 3 of the Italian Consumer Code and who do not have their habitual residence in Italy of any more favourable and mandatory provisions of the law of the country in which they have their habitual residence. For any dispute relating to the application, performance and interpretation of these General Terms and Conditions of Sale, the court of competent jurisdiction shall be the court of the place where the consumer Buyer resides or is domiciled. Furthermore, any consumer Buyer residing in a Member State of the European Union other than Italy may access, for any dispute relating to the application, performance and interpretation of these General Terms and Conditions of Sale, the European Small Claims procedure under Regulation (EC) 861/2007 of the Council of 11 July 2007, provided that the value of the claim, disregarding all interest, expenses and disbursements, does not exceed Euro 2,000.00. The text of the Regulation is available on the website .eur-lex.europa.eu. Under Article 141-sexies, paragraph 3 of the Italian Consumer Code, Finarte informs any user who can be classified as a consumer within the meaning of Article 3, first paragraph, a) of the Italian Consumer Code that, in the event he/ she has filed a complaint directly with Finarte, as a result of which, however, it was not possible to resolve the dispute arising therefrom, Finarte will provide information about the Alternative Dispute Resolution entity or entities in charge of out-of-court settlement of any dispute concerning the obligations arising from a contract concluded under these General Terms and Conditions of Sale (so-called ADR entities, as specified in Articles 141-bis et seq. of the Italian Consumer Code), specifying whether or not it intends to make use of such entities to resolve the dispute. Finarte also informs any user who can be classified as a consumer within the meaning of Article 3, first paragraph, a) of the Italian Consumer Code that that a European platform for online resolution of consumer disputes has been established (the so-called “ODR platform”). The ODR platform is available at http://ec.europa.eu/consumers/odr/. On the ODR platform, a consumer Buyer may consult the list of ADR bodies, find the link to the website of each of them and start an online dispute resolution procedure for the dispute in which he/she is involved. 17.
