Congress Report

Special Report - Fecc Annual Congress 2015 Towards a Sustainable Future The Fecc Annual Congress 2015 brought together around 200 top leaders of the chemical distribution industry. Our association and activities like the congress, serve as a platform to build and shape the future of the sector. The programme focused on the adaptable and entrepreneurial nature of distributors. It encouraged the delegates to approach these challenging times with an open mind to adequately profit from new opportunities.

When opening the congress, Fecc’s President, Neville Prior shared with the delegates how he believes, that the next few years will see significant change for the industry. Only those companies with the ability to adapt will survive.

Sustainability and Responsible Care remain key words for the distributors’ success in adapting to the rapidly changing market. Standing in for Cornelius and and also President of Fecc, Neville Prior, highlighted the efforts and achievements made by Fecc and its members these last past years.

The Opening session of the Fecc Annual Congress explored the position of the chemical distribution in Greece, with contributions from a panel including industry leaders. Vassos Efthymiadis, President of the Hellenic Association of chemical industries gave the welcome address and gave the delegates an insight into the latest performance of the chemical distribution industry despite the economic collapse under the Greek government depth-crisis. He provided statistics, trends and industry characteristics along with other impacting factors such as climate change strategy and environmental consequences. He concluded with an overview of the European industrial and climatic policy and reminded the delegates that the future global problems are today’s business opportunities. He finally stressed the importance of reviving the local chemical distribution industry and exhorted companies to invest in Greece where the “Chemical distribution industry is still alive” said Vassos Efthymiadis.

Konstantinos Marinos and Theodora Baxevani from DR.D.A Delis gave the keynote address and went over the current Greek economic and industry status in the European environment. “There is a lack of chemical production in Greece and the market depends on imports”, says Theodora Baxevani.

Greece’s chemical industry has suffered because of its focus on the construction business which did not do well in the crisis. They both underlined the fact that the distribution of chemicals in Greece plays an important role in the overall supply chain from the chemical industry to its customers and there is a strong mutually beneficial collaboration between producers and distributors. They concluded that both parties aim for the same objectives of market shares, innovation, improvement, profits and sustainability.

Congress Report The first panel session set the tone of the Congress and kicked-off with a wide range of expert panellists including David Jukes, President EMEA UNIVAR, Karsten Beckmann, CEO Brenntag Europe, Herve Lavollee, General Director, Lavollee Chimie, Claus Barasinski, Head of Channel Management, Evonik Industries and Christopher Erbsloh, Managing Director, C.H.Erbsloh. The panel session “Does Size Matter?” offered the audience an animated and in-depth debate about the advantages and disadvantages of being small versus big company and also opened the possibility to bring in the perspective of a “Medium size dog” and see how they would survive in a competitive market.

The following session on Global Perspective started with Michel Loubry at Plastics Europe who identified five challenges industry faces in Europe from energy and raw materials, future EU investments, skilled work force to waste management and regulatory framework. He then elaborated on how Plastics Europe has been addressing the issues affecting the image of plastics with successful initiatives such as “Operation Clean Sweep”. Paul Gooch, Managing Director at The Logical Group spoke about the chemical distribution market from a supply chain perspective and the importance of risk assessment and mitigation plans in place to prevent adverse impact on supply chain.

Edgar E. Nordmann, Fecc Honorary President and Managing Partner at Nordmann, Rassmann GmbH, shared his very personal and rich experience on how to run a family owned business and how to groom the next generation of leaders despite the many challenges.

Fecc offered this year parallel sessions on New Developing Markets and Compliance & Communication in the supply chain. Matthijs Mulder of ValueChem, presented Responsible Care North of Limpopo River and shared his experience starting a chemical distribution business in the Sub-Saharan Africa region. Nick Powell, Regional Vice-President, Focused Industries EMEA, UNIVAR offered his perspective and shared his in-depth knowledge and experience on growing a successful chemical distribution business in the Middle East &Turkey.

Congress Report Another parallel session on Compliance and Communication in the Supply Chain took place with Ralph Alberti, Director, Verband Chemiehandel e.V. who educated delegates about the chemical security for distributors and how to take care but also know customers. Followed by Jose Cantavella, Project Management SIEfs/consortia, Business Development of ChemSafe who introduced us to the interesting topic of Crisis Communication, dealing with safety topics and the Media.

The session Sustainability, putting it in perspective, helped us understand the complicated subject of sustainability and clarify the misconception that sustainability is only about being environmentally friendly. Phil Hockaday, EHS &Q Director, EMEA-UNIVAR brought to our attention that sustainability is also about “people and money” and therefore a business without profit is not sustainable. He continued on to highlight that Sustainability and Responsible Care go hand in hand.

Martin Hostalek, Senior Vice-President, Environment, Health, Safety, Security, Quality EQ at Merck KGaA told us about Responsible Care in Europe and elaborated on the current status and the future development. He also brought a number of suggestions on how can Responsible Care contribute to sustainability and how we can revitalize Responsible Care.

Steen Nordmark, Chief Commercial Officer at R2 Group explained how owning label could bring added value to both chemical distributors and principals. Jean-Lionel Gros at JL388 continued with his fundamentals of business success followed by the trends in the chemical distribution industry and introduced three models of distribution such as Full Service Model, Low Cost E-Platform, preferred Asian Partnership and how to overcome implementation challenges to become a Top distributor.

And finally the Congress ended with a very lively and outstanding speech from Marc Woods, our motivational speaker who delivered a powerful message of courage and hope to inspire us on achieving our Personal Best!

Press Lunch Improving the public image of our industry and increasing visibility of our association and our members is a priority for Fecc. We were pleased to welcome a record number of journalists from top media outlets, to an exclusive Press Lunch. In a private atmosphere participants had the possibility to meet with top representatives from the industry.

Representing Fecc, the press had the opportunity to meet with; Fecc’s President Neville Prior, Fecc’s Director General, Uta Jensen-Korte, Fecc’s Treasurer, Peter Skou and Fecc’s Vice-President, Francois-Xavier Du Passage. Congress Report Networking The social activities planned were an excellent opportunity to network.

Participants particularly enjoyed the Opening Reception and Gala Dinner. Fecc welcomed delegates and their partners on the roof top of the Grande Bretagne Hotel which offered breath taking views of the Acropolis.

During the Gala Dinner, in recognition for his outstanding contribution to the success of the chemical distribution industry, Neville Prior, Fecc President, presented Douglas Leech with the Fecc Award 2015. When accepting the award, Mr. Leech commented, “ I am honoured and proud to receive the Fecc Award�. The Fecc Award symbolises the recognition to those who have distinguished themselves for outstanding performance in the European chemical distribution industry.

New board member Dr. Peter Manshausen With effect from 1 June 2015, Dr. Peter Manshausen (55) has been appointed to the Managing Board of Georg Nordmann Holding AG. In future, he will direct the international business of the Holding together with the board's chairman, Edgar E. Nordmann, and board member Gabriele Henke. He holds a doctorate in chemistry and has many years of executive experience in various sectors of the chemical industry. Most recently he was the sole managing director of Caldic Deutschland Chemie B.V., the globally operating chemical trading company based in Düsseldorf.

The affiliated companies of the Georg Nordmann Holding AG are active in distribution and the manufacturing industry. Among them are the international chemical distributor Nordmann, Rassmann GmbH (NRC), the biotech company Biomol GmbH, Enorica GmbH, the specialized logistics provider for the pharma and chemical sector, and ROWA GROUP Holding GmbH, whose subsidiaries are manufacturing and distributing high-quality materials for the plastics industry.

VELOX to offer water-based additives in Sweden VELOX, a European leader in the marketing and distribution of raw material specialities for the plastics, composites, rubber, paints and coatings industries, is delighted to announce its partnership with the Dutch company ADDAPT Chemicals BV. VELOX will be distributing ADDAPT’s environmentally friendly additives which are especially produced for a wide variety of mainly water-based systems. The extensive product range includes latest-generation (co-)dispersants (CODIS, DISP), wax emulsions (WaxMul), wetting and levelling agents (BioWet, ADDAPTOL, PolySurF), phosphate esters (Ferrocor Flash), foam control agents (Foamstop), anticorrosion agents (Anticor, TemCor), engine coolants and tackifiers.

These additives are used in various industrial sectors all over the world such as industrial coatings, adhesives, (decorative) paints, plasters/renders/putties, printing inks, foam control agents, lubricants, waste water treatment, cement/concrete gypsum and protective care systems.

IMCD to acquire US specialty chemicals distributor MF Cachat IMCD N.V. announces that it will acquire 80% of The M.F. Cachat Company, including 100% of MJS Sales, Inc. (“MF Cachat”).

MF Cachat fits well with the IMCD business model and strategy and provides a significant platform for further growth in the United States which is a growing specialty chemicals region.

Initially IMCD will acquire 80% of the total share capital from the existing MF Cachat management who will continue to lead the company. The remaining 20%, which is also owned by management, will be acquired at the latest in 2017.

MF Cachat is a leading specialty chemicals distributor in the US with a focus on coatings, construction, plastics, advanced materials and food. With its head office near Cleveland, Ohio, MF Cachat is active in the Midwest, Central, Eastern and Southern regions of the US and represents leading global chemical suppliers in more than 30 states. In 2014, MF Cachat generated revenue of USD 300 million (including USD 3 million of MJS Sales) and has approximately 90 employees.

MF Cachat is an excellent fit with IMCD given their asset light business model and long term relationships with leading global chemical suppliers. The acquisition supports the strategy of IMCD to become a leading global specialty chemicals distributor.

MF Cachat and IMCD will explore opportunities for synergies by offering both companies’ suppliers the possibilities to benefit from each other’s network. In addition it will offer further growth opportunities in the North American market, both organically and through acquisitions.

Piet van der Slikke, CEO of IMCD, commented: “This is a very important next step in the strategy of IMCD to become a leading specialty chemicals distributor in key markets. A position in the US will give us the opportunity not only to grow in this huge market, but also to expand our relations with existing suppliers and customers.

The acquisition will be paid from available cash, existing facilities and an additional incremental term loan facility of EUR 30 million pursuant to the terms of its current facilities agreement and newly issued shares with a value of approximately EUR 85 million. Biesterfeld AG improves operative earnings and develops business activities worldwide In 2014, Biesterfeld AG Hamburg increased its turnover to approx. 1.1 billion Euros and thus continued with its steady growth strategy. Apart from the rise in gross profit, the group of companies also improved its operative earnings (EBIT) to 32.4 billion Euros.

Biesterfeld AG increased its turnover in 2014 by 2.0% to approx. 1078 million Euros. Besides, the group of companies used the financial year to further develop the company structure, to develop business activities and to optimise the product portfolio.

Thus, a rise in the operative earnings by 10.2% to 32.4 million Euros could be achieved. “Despite the inconsistent price and market developments worldwide, the decline in oil prices in the second half of the year and the consequences of the RussianUkraine crisis, we managed to improve our turnover and earnings in 2014 successfully and sustainably”, says Thomas Arnold, Chairman of the Executive Board of Biesterfeld AG. The positive development and the solid, steady growth can be attributed to the strategic orientation of the group. Being a family-owned company, Biesterfeld is known for its close and years of cooperation with its suppliers, its intensive and competent consultancy for clients as well as an extensive product portfolio focused on specialties.

Fecc welcomes Irantzu Garmendia as the new Technical and Regulatory Affairs Manager We are pleased to inform you that Irantzu Garmendia will be soon joining Fecc as the new Technical and Regulatory Affairs Manager.

Irantzu comes to us from the Basque Country (Spain) and graduated in Chemistry. She brings more than seven years of experience in consultancy, as Chemical product's regulatory issues consultant, providing support to the public administration and private companies to comply with REACH and CLP. Her mother tongues are Basque and Spanish, she also speaks English, Italian and is currently studying Chinese.

Farewell Message for Ophelie Roblot As you all already know Ophelie Roblot, previous Fecc’s Health Safety Environment Manager , has decided to leave Fecc after having worked over five years and received a new very interesting job offer in the Lille region in France. This is a great career opportunity for her with interesting new challenges working in the industry. We would like to congratulate Ophelie and wish her all the best in her new job. We would like to thank Ophelie for the wonderful work and contribution particularly to Fecc’s SHE Committee and we regret that Fecc loses such an experienced and qualified coworker.

REACH Implementing Act on Data-Sharing The Commission is drafting an Implementing Act on Data-Sharing in REACH and Fecc welcomes the effort made by the Commission to clarify the requirements for registrants to share information in a fair, transparent and non-discriminatory way under REACH. In a response to the Commission draft on Data-Sharing Fecc reiterated its view that in this exceptional case the introduction of a ‘retrospective applicability’ clause is essential to ensure that all new and in particular existing SIEFs are working in the same transparent way prior to the 2018 registration deadline. Whilst Fecc readily acknowledges there are exemplar SIEF and Consortia which work in a fair and transparent manner we do not want to accept that those existing arrangements which are not operating fairly and transparently should be given a free pass to continue bad practices and that 2018 joint registrants should be burdened with such unfair practices.

8th Meeting of the Exchange Network on Exposure Scenarios (ENES 8) The 8th meeting of ENES took place in Helsinki 20-21 May 2015 and was attended by around 100 participants. The overall theme of the meeting related on how to improve the quality if information available and how to streamline and simplify the communication process in the supply chain.

The first session focused on the elements of the CSR/ES Roadmap on elements which already work and which need further development. Followed by a session on how authorities, manufacturers and downstream user use the information generated. In this session Marianne Lyngsaae from Brenntag shared her experience with the management of exposure scenario information in safety data sheets. The third session was chaired by Uta Jensen-Korte and informed about the latest development on the ‘top-down’ and ‘bottom-up’ approaches for mixtures and about the improved sector use maps.

10th ECHA Stakeholders' Day The 10th ECHA Stakeholders' Day, 27 May, welcomed over 200 participants in person and 355 participants via web-stream to hear the latest news and developments from ECHA, industry and NGOs. The first session provided some advices on how to prepare for the 2018 registration deadline. Douglas Leech from CBA reported about his experience on effective SIEF management. The following two sessions tackled the improvement of dossier quality and risk management.

2015 Helsinki Chemicals Forum The Helsinki Chemicals Forum took place from 28 to 29 May. Keynote speakers at the event included Geert Dancet, Executive Director of the European Chemicals Agency (ECHA), Antti Peltomäki, Deputy Director General and Klaus Berend, Head of Unit from the European Commission.

The panels were covering the following topics: 

Thinking beyond 2020 – SAICM and the future for global chemicals risk management

Globally Harmonised System on Classification and Labelling – how can we get there faster?



Chemicals in products: How to improve communication in the supply chain



Avoiding regrettable substitution: what are the best practices in alternative assessment?

Seminar on Applications for Authorisation 29-30 June ECHA is organising a seminar in collaboration with Cefic and Eurometaux to improve future applicants' knowledge of the authorisation application procedure. The main topics to be covered include the content requirements for applications, the public consultation on possible alternatives, the analysis of alternatives and socio-economic analysis, as well as the formats, manuals and tools for the application submission.

ECHA would like to visit SMEs To promote ECHA’s experts' understanding of companies' business needs in complying with the EU chemicals legislation, ECHA staff would like to visit SMEs in EU countries. They are looking for SMEs willing to volunteer for this staff training programme and to host one of the ECHA colleagues for two days in autumn 2015.

Measuring REACH and CLP Enforcement new study published The European Commission published a report on a study proposing 50 enforcement indicators for regulations on chemicals. The conclusions of the study will be discussed with Member States, national enforcement authorities and the Forum.

Orphan biocidal product authorisations and applications: Member States contacted companies To address one of the issues resulting from the migration between R4BP2 and R4BP 3, Member States have contacted in May all companies with orphan existing authorisations and on-going applications for biocidal products. Orphan authorisations are those for which the unique identifier of the future authorisation holder is missing from the Registry for Biocidal Products (R4BP 3).

Member States were asked to provide ECHA with updated information regarding all of these orphans in the database by 29 May 2015

Art. 95 Biocidal Products Regulation – Model letter In context with Art.95 listings, some Member States are asking for a “Letter of Supply” to confirm the delivery of biocidal active substances from a listed source.

SusChem SME’s Programmes SusChem publishes Guide to SME Funding in Europe Discover the major EU funding programmes for R&I activities and partner up with leading chemical companies in EU collaborative projects SusChem, the European Technology Platform for Sustainable Chemistry, has just published a Guide to SME Funding in Europe. The Guide comprises information about five major EU funding programmes, eligibility criteria, application procedures and timelines.

The Guide complements SusChem's vision for an innovation ecosystem including large and small enterprises, research organisations and academia working together to capitalise on Europe's strengths.

Small and medium sized enterprises (SMEs) represent more than 90% of businesses in Europe and operate in all sectors. SMEs are the backbone of Europe's economy and are key to economic growth, innovation and prosperity.

In the past five years, they have created around 85% of new jobs and provided two-thirds of total private sector employment in the EU. However, accessing finance for research and innovation activities is often difficult for smaller enterprises. The SusChem Guide covers five major funding instruments for research and innovation available to SMEs in Europe.

Fecc Responsible Care Committee In the last RC Committee Meeting, held on 20 March 2015, the committee discussed an incident in Spain which occurred during an unloading operation at a chemical factory in Igualada on 12 February 2015. SIMAR, the company involved, is a member of AECQ but not part of the Responsible Care program (see photo below). More information from the company is currently not available because the Spanish authorities are still in the process of investigation. The media had reported three employees lightly injured and 22 firefighters with breathing problems following an accidental mixture of nitric acid (inside the tank) and iron chloride (or iron sulphide). Fecc continues to monitor the incident and disseminate more information when available.

EU and Turkey announce modernisation of Custom Union Trade Commissioner Cecilia Malmström met with the Minister of Economy of Turkey Mr Nihat Zeybekci to agree to modernise the 20-year-old Customs Union Agreement and to enhance EU-Turkey bilateral trade relations. This result has been achieved under the joint leadership of Trade Commissioner Cecilia Malmström and Commissioner Johannes Hahn in charge of Neighbourhood Policy and Enlargement Negotiations. It follows technical discussions held over the last 12 months that allowed both sides to understand each other's expectations and ambitions for new preferential bilateral trade relations.

Commission publishes updated EU textual proposal on regulatory cooperation in TTIP negotiations The European Commission has ublished the updated EU textual proposal on regulatory cooperation, following the 9th round of negotiations for a Transatlantic Trade and Investment Partnership (TTIP).

This publication is part of the Commission’s transparency initiative and in line with the commitment to publish textual proposals, once they are tabled in negotiations.

Digital single market: the digital transformation of European industry The Council discussed the new digital single market strategy and adopted conclusions on the digital transformation of European industry. A number of important aspects were highlighted, including the importance of targeting areas where action is needed for the digital transformation of industry and of encouraging the development of digital entrepreneurship, especially start-ups Council conclusions on the digital transformation of European industry

Mergers: Commission clears acquisition of certain INEOS chlorovinyls businesses by ICIG and approves ICIG as buyer of divested assets linked to approval of INEOS / Solvay joint venture The European Commission has approved under the EU Merger Regulation the proposed acquisition of a group of chlorovinyls businesses belonging to the chemical group INEOS by International Chemical Investors Group ("ICIG"). In parallel with today's clearance decision, the Commission has also approved ICIG as suitable purchaser for the divestitures offered by INEOS and Solvay to obtain the clearance of their joint venture in the S-PVC market.

The INEOS' chlorovinyls businesses to be acquired by ICIG include the production and supply of suspension polyvinyl chloride ("S-PVC"), sodium hypochlorite ("bleach"), potassium hydroxide ("KOH") and other related products. The transaction includes the production facilities owned and operated by INEOS in Belgium, France, Germany, the Netherlands and the UK, which INEOS committed to divest in order to obtain the Commission's clearance of the joint venture between INEOS and Solvay of Belgium ("INOVYN").

The companies' activities mainly overlap in the production of KOH, which is used for the manufacturing of de-icing liquids, soaps, biodiesel and fertilisers. The Commission concluded that the transaction would lead to less concentration in the market for KOH as a result of the transfer of part of the KOH business previously operated by INEOS, the market leader, to an independent competitor, ICIG. Moreover, a number of other players would remain active in the market.

The Commission has therefore cleared the proposed transaction under merger control rules.
