DEAN'S WELCOME Public communication actions have been “Trust only movement. Life proved to be necessary for all institutions happens at the level of which intend to raise awareness of itself. This events, not of words ” reality was already perceived and highly sucAlfred W. Adler cessfully introduced one decade ago by the decanal team led by Professor José Francisco Alenza García. From then on the Faculty of Law counted on its own way to channel knowledge and dissemination of the activities it carried out, as well as to inform readers of other news on events or people related to this academic body. In its opening issue it reminded the readers that ancient and wise Romans, when they got interested in new things, in what had happened or was happening, expressed so like this: Quid Novi? Communication is a technical reality, instrumental in nature, but above all it is an essentially human phenomenon. The good deed of Professor Iñaki Riaño Brun, leading our institutional communication, continues to reflect this broadly. According to Alfred W. Adler “life happens at the level of events”, and the events published on this new Newsletter of the Faculty of Law of Public University of Navarre show the life happening in it

Rafael Lara González, new Dean of the Faculty of Law

Rafael Lara: “The Faculty of Law combines academic rigour with efficient management ” Rafael Lara, Professor of Commercial Law and new Dean of the Faculty of Law, is facing the challenge to lead for four years the destinations of a young and dynamic centre with the experience acquired through years of management tasks. the development of the centre has been consolidating throughout the years thanks to the good deed of the management teams that preceded him.

“Ever since I joined Public University of Navarre, back in 1994 –the new Dean states–, I have felt the need to dedicate a part of my academic work to management tasks, too. Thus, for example, between 2000 and 2003, I was Deputy General Secretary, and later, between 2010 and 2018, I was the Director of the Department or Private Law. Today not only do I continue

with that same internal feeling, but I also consider my duty to contribute to continue building that exciting project born at the Parliament of Navarre in 1987 - now from the Faculty of Law. Indeed, the Faculty of Law is an organic and functional reality embedded in the area of general interests collective management of Public University of Navarre, and the daily collaboration of the Faculty with the people holding the highest responsibilities at University is consubstantial.

This is why, actions taken by the Faculty are led by the strengthening of internal connection with the managing bodies of University, notwithstanding the own and individualised actions of the Faculty within the framework of its competences. On the other hand, the Faculty of Law must

“As university body, we must have a natural relation with

the different collectives of the legal and economic society ” include the various coordination demands of the degrees in the different areas of the Departments involved in the teaching programme of the degrees currently taught at the Faculty, which I expect will be implemented in the near future”.

The new Dean of the Faculty of Law is aware that “a good university atmosphere is not something that just happens. Rather, it is the consequence of a work style and the relation between the members of our university community. That is why finding common grounds and coexistence of all the people part of not only the Faculty of Law, but also Public University of Navarre is also a fundamental principle of my work leading the Dean's Office”.

All above mentioned is complementarily

included in the obligation to meet the requirements every institution must meet within the university scope, particularly at Public University of Navarre. Thus, he states that “I obviously remember the Faculty obligation to plan seminars, conferences and many other academic activities, as well as the natural relation with the different bodies and collectives of the legal and economic society, mostly that in the autonomous community area. I believe that I am particularly responsible for our young researchers and lecturers. Indeed, they must find at the Faculty an increasingly good environment for both their academic training and their right professional promotion. This is, no doubt, my biggest endeavour”.

Aritz Romeo, Academic Secretary of the Faculty of Law

Aritz Romeo: “Management processes are the foundation for the academic area to work ” Aritz Romeo is teacher in the Administrative Law area, and has taken on the position of Academic Secretary, focusing on administrative management processes of the Centre. Romeo pointed out that, “although the visible part of the Faculty is the academic aspect, behind the good performance of all the centre's activity is the implementation of a number of management processes which are the foundations for teaching and the rest of the Faculty activities to develop properly”. That is why he highlighted that “management processes must work as well-lubricated gears, for that part - which seems to be hidden - is necessary for the good performance of the most visible aspect of the Faculty”.

A proper implementation of the administrative management processes, which must

always be carried out on the basis of the administrative procedures in force, allows academic activity to develop in a more efficient and optimal way. All that is possible, he states, “thanks to the involvement of the university community and, especially, thanks to the work of the workers in the Administrative Support Unit, whose work is essential for the Faculty activity to work properly”. Management processes are structured on the basis “or a previous planning and a constant improvement through the quality mechanisms established to that end, among which it is worth mentioning the Faculty Quality Guarantee Commission, which analyses the proper functioning of the Faculty not only on an academic level, but also regarding management, always seeking to improve”.

Julen Llorens, Deputy Dean of the Degree in Labour Relations and Human Resources

Julen Llorens: “The courses offered in Labour Relations and Human Resources is cross-cutting, comprehensive and dynamic” Julen Llorens, teacher of Work Law, takes on the position of Deputy Dean responsible for the Degree in Labour Relations and Human Resources. A booming degree, its academic content is focused on the legal, organisational and economic aspects of companies. It offers specific training to advise on work issues, human resources management, planning health and safety and mediation in the work market. Regarding this, the new Deputy Dean highlights “the role of the graduates in this degree as professionals with a higher specialisation level on legal and work issues. Likewise, given the interdisciplinary nature of this Degree, he stresses the fact that the student body receives training in Psychology, Sociology, Business Management and Law. The

student body may decide to choose a specialisation on Company Work Advising or Human Resources Management, depending on the professional profile they want to focus on afterwards. To achieve so, Public University of Navarre has managed to strengthen links with the main economic and social agents of our community. Arising from this, students of the Degree in Labour Relations and Human Resources may carry out guaranteed external internships in state-of-the-art companies of the economic fabric of Navarre.

In this sense, it is worth highlighting the high rate of job placement of our graduates in the years following the end of the academic cycle”.

Leyre Elizari, Deputy Dean responsable for the Degree in Law

Leyre Elizari: “A Law student obtains a training profile fit for their profesional career” Leyre Elizari, teacher of Civil Law, takes on the position of Deputy Dean responsible for the Degree in Law. She is convinced that students educated at Public University of Navarre acquire a level of skill which allows them to access the labour market well prepared. Law studies, she says, “are a degree demanded by students, which is supposed to be established and offers quality education and a wide range of career opportunities. Together with highly experienced professors, we count on young lecturers which offer other competencies, such as the mastering of new technologies or language skills. The effort to increase the number of subjects offered in other languages is big, as well as to incorporate innovative teaching methodologies and activities.

This is why the satisfaction of students with teaching is good, above university average.

No doubt, the fact that we count on reduced groups encourages personalised attention and student's learning”.

Salomé, Deputy Dean for the Double Degree in Law and Business Management

Salomé Goñi: “The Double Degree in Law and Business Management provides a high level of training for students” Salomé Goñi, teacher at the Department of Business Management, takes on the position of Deputy Dean responsible for the Double Degree in Law and Business Management highlighting that “obtaining two degrees makes it possible to obtain a very comprehensive education both in the economic and legal domains, which is very much appreciated by companies. Career paths are those of the degree in Law and the degree in Business Management, but it is also a highly demanded profile for big business corporations, law firms and consulting companies. It is also a very appropriate degree for people looking to sit a public exam. In that regard, labour insertion data cannot be more positive. As the Deputy Dean states, “one year after

finishing their degree, 70% of students had a job very much related with their degree, 20% were preparing for a public exam and 67% found a job in less than six months”.

This is a double degree “which enjoys tradition and prestige, with its own teaching team, which makes the cohesion and teaching quality levels really high. It also counts on an International Programme, which allows students to add international character to the double degree education.

The satisfaction level of both students and lecturers is really high. Required access grades to access are rather high, and to be able to continue studying this double degree for the six years it lasts students must m e e t va r i o u s d e ma n d i n g s t ay requirements”.

Iñaki Riaño, Deputy Dean for the development of strategic actions

Iñaki Riaño: “On a strategic level, the Faculty is focused on internationalisation and multidisciplinary education” Iñaki Riaño, teacher of Procedural Law, takes on the Deputy Dean position, which makes him responsible for the development of the Strategic Plan, Mobility and Internationalisation actions aiming at contributing from the Faculty to meeting the strategic goals of Public University of Navarre. “As centre embedded in a broader university structure, our goal is to contribute to the development and growth of UPNA by meeting a series of strategic lines within the framework of the Strategic Plan 2020-2030. To do so we hold annual meetings with the Vice-Chancellor’s office for Economic Matters, Planning and Strategy in order to draft a document in which we commit to develop a series of

actions embedded in the elements established in the aforementioned Plan. Aspects such as internationalisation, proper management of quality processes or establishment of international double degrees are some of the most important issues of our strategic planning. We must not ignore, naturally, those already consolidated aspects related to the quality of the studies”. Together with this, the Faculty is particularly focused on the development of thorough communication work around the activities developed in the Centre. “We deem it basic that all we do on an academic, training, and research level be known. Including those dynamic and innovative elements used in the learning process of our students”.

MANAGEMENT OF QUALITY PROCESSES

Goals linked to quality at UPNA

Beatriz Rodríguez: “Quality processes are necessary to keep the degrees level ” Beatriz Rodríguez:, teacher of Employment Law, is currently in charge of quality at the Faculty of Law, as well as specifically in the Master's degree in Access to the Legal Profession, taught jointly by UPNA and the Honourable Lawyer's Association of Pamplona. Among her daily tasks is guaranteeing that UPNA meets its goals, both generic and specific, related to the academic quality of the degrees, Hard work, which, however, provides the satisfaction to see the way the Faculty of Law develops in time in a favourable and constant way.

“Processes developed by the Faculty, within the context of those carried out by the University itself, is useful to confirm all those things well done regarding the development of the degrees, as well as to implement the different improvement actions.

In this sense, the Faculty counts on ViceChancellors responsible for quality in each of the degrees, who yearly draft reports presented to a Quality Guarantee Commission with students and external legal professionals present, where the corresponding improvement proposals are posed”.

MANAGEMENT OF QUALITY PROCESSES

Elements composing the quality assurance process

Map of centre processes: quality assurance through an interconnected structure Ensuring quality in the teaching of academic degrees by UPNA and, particularly, the Faculty of Law, is determined by a series of processes that help meet the programmed goals. Firstly, a Quality Commission is placed in the global scope of UPNA. Its goal is to carry out an advising, proposing and monitoring task of the University actions in the matter of quality. In the matter of education, it coordinates the activities carried out by all the Quality Guarantee Commissions of the Centres, especially those focused on ensuring the periodical diploma certification, regardless of coordinating other activities related to quality assigned to any other commission or body. Together with it, and within the scope of the Faculty of Law, just like in

the rest of the Centres, is the Quality Guarantee Commission of the Faculty. Its task focuses on the design, development, inspection and improvement of the instruments ensuring and guaranteeing the quality of the teaching and learning processes of the Centre, and with the continuous improvement of its results. In line with the guidelines established together with the University Quality Commission, and taking the elements integrating the UPNA Strategic Plan as a reference. The task developed in this area uses different elements and processes indicated in the table established ut supra, linked to the documentary support scope, to operational action elements, to strategic goals, as well as to the needs and expectations expressed by the groups of interest

ADMINISTRATIVE UNIT

Reorganisation of the Administrative Unit of the Faculty The academic year 2020-2021 has witnessed the reorganisation of the unit supporting administratively the development of the different actions in the Faculty of Law. In this sense, the person in charge of the unit at the Secretary office of the Faculty, located in the first floor of the building Las Encinas, is Mª Pilar Mendi Aznarez, as well as Mª. Asunción Blasco and María Moreno to carry out specific administration tasks. For her part, Olga Ruiz is in charge of carrying out the administrative management tasks related to the Department of Law. The administrative unit of the Faculty aims at achieving higher efficiency in management of both people and procedures and processes, thus improving and ensuring the

proper quality in the services rendered.

The opening hours are in the morning from Monday to Friday (from 9:00 to 14:00), as well as in the afternoons from Monday to Thursday (16:00 to 18:00). And the contact reference is in the e-mail address: facultad.cienciasjuridicas@ unavarra.es, as well as the phone number 948 166203.

It is necessary to keep in mind that the organisation, quality and processes service count in this regard on a centres and services coordination unit within the framework of the Service to improve the management. It focuses on working jointly with the Centres and Faculties to guarantee an efficient service rendering.

ACTIVITIES DEVELOPED AT THE FACULTY

Seminar about legal implications of Covid-19 In October and November there was an three-session-long online Seminar about the legal implications of Covid-19, offered by the Faculty of Law, with the support of the Centre for Innovation in Higher Education.

The sessions dealt with some of the many questions posed by Covid-19 from a legal point of view, and possible answers to them, thus contributing to the current general context of legal reflection generated by the pandemic and the resulting measures facing it.

Specifically, the posed questions were, among others The ethical and legal dimensions of COVID-19 (D. Miguel Ángel Ramiro, Teacher of Philosophy of Law. Universidad de Alcalá; and main researcher of the project "Legal and ethical determinants of COVID-19"), The constitutional framework of Covid-19 (Mr Miguel Ángel Presno Linera,

Teacher of Constitutional Law at Oviedo University), The rights of disabled people and their relatives before Covid-19 (Ms Inmaculada Vivas Tesón, Teacher of Civil Law of University of Seville), Residential Homes and COVID 19: a glance at its impact and legal consequences (Ms. Leyre Elizari Urtasun, Teacher of Civil Law at UPNA), Research with health data facing Covid-19: ethics and law (Mr José Ramón Salcedo Hernández, Teacher of University of Murcia, main researcher of he European project "Biolaw as global tool for Human rights protection -Pro Human Biolaw-) or The use of health data to control the COVID-19 pandemic: troublesome aspects (Ms Andrea S. Casanova Asensio, Teacher FPUMECD, Department of Civil Law, University of Murcia). All that through videoconferences held on the 2nd and 30th of October, as well as on the 27th of November.

II Seminar on Research and Doctoral Training: “Law in health crisis situations” In October it took place the II Seminar on Research and Doctoral Training about “Law in health crisis situations”. It dealt with relevant questions such as The role of ADR in legal-private conflicts in the new scene (Ms Raquel Luquin, Teacher of Civil Law), Intervention of private companies and inviolability of the household in the 2nd alarm state (Ms Cristina Zoco, Teacher of Constitutional Law), Problems and doubts posed by the implementation of telematic trials (Mr Manuel Richard González, Teacherof Procedural Law), Occupational health and safety in Covid times. A glance through jurisprudence (Ms Mirentxu Marín Malo, Teacher of Employment Law), Watch of employees’ health in the contexto of the Covid-19 health crisis (Ms Julen Llorens Espada, Teacher of Employment Law), Public Administration,

personal data and health crisis (Mr Aritz Romeo Ruiz, Teacher of Administrative Law), Ethical-legal framework for the clinical decisionmaking before the resources limitation in the Covid -19 pandemic (Ms María Jorqui Azofra, Teacherof Civil Law). The projects being developed within the framework of legal doctoral thesis work were presented together with the previous questions.

ACTIVITIES DEVELOPED AT THE FACULTY

“Family protocol. Accepting a challenge to conquer the future” Founding partner of ARPA Lawyers Consultants José Antonio Arrieta offered in October the workshop entitled: “Family protocol. Accepting a challenge to conquer the future” within the framework of activities developed by the Chair of Family Companies at Public University of Navarre. Starting from a practical case, students of the Course on Expert in Family Company Management worked on some of the situations that may arise in this kind of companies. Thus, from a basically practical perspective, different topics were approached, all of them aiming at guaranteeing the continuity of a family company within the family.

Likewise, within the framework of the Course on Expert in Family Companies, taught in the Chair of Family Companies, the seminar corresponding to the

application of Labour Law within the framework of these kinds of companies took place in November.

The goal of the Chair of Family Companies is to foster the study which allows students to provide solutions to the various problems affecting family companies, defined in the mentioned text as “essential instruments for the economic development and well-being of our society”. Together with this, the Chair seeks to become a meeting forum for academics, businesspeople, professionals and students, which enhances a permanent and bidirectional exchange and transfer of knowledge, experiences and curiosity in this domain, thus contributing to bring the business and academic worlds closer and producing mutual benefits and exchanges.

ACTIVITIES DEVELOPED AT THE FACULTY

UPNA own degree in Direction and Management of Cooperative and Social Economy Companies Public University of Navarre has implemented for the academic year 2021-22 the UPNA own degree in Direction and Management of Cooperative and Social Economy Companies, together with ANEL, the Association of Social Economy Companies of Navarre and funded by the Government of Navarre. The degree has been presented in an information event with the following participants: the Dean of the Faculty of Law and Director of it, Rafael Lara González; the president ANEL, the Association of Social Economy Companies of Navarre and coordinator of the degree, Ignacio Ugalde Barbería; the counselor of Economic and Business Development of the Government of Navarre, Mikel Irujo Amezaga, and ViceChancellor for Students, Employment and Entrepreneurship, Cristina Bayona Sáez.

The new degree UPNA will teach offers comprehensive, specialised and miltidisciplinary education focused on professional specialisation on the management and direction of cooperative and social economy companies through legal, economicfinancial and human resources content. It is also in line with the Sustainable Development Goals 2030 Agenda established by the United Nations Organisation. The last few years have seen a “change of socialeconomical cycle, accelerated by COVID19, which places us before a new scenery posing important challenges to society and the economic and business fabric to get a sustainable and inclusive economic growth model”. In order to tackle these new challenges “it is necessary to work to build dynamic, sustainable, innovative economies which are focused on people”

Opening ceremony of the Master's degree to Access the Legal Profession At the end of September the opening ceremony of the Master's degree to Access the Legal Profession taught jointly by the Honourable Lawyers Association of Pamplona (MICAP) and Public University of Navarre took place.

Students, lecturers and lawyers attended. After the presentation Jose Francisco Alenza (Dean of the Faculty of Law and Academic Director of the Master's degree) y Blanca Ramos (Dean of the MICAP) made, Rafael Lara (in charge of quality of the Master’s degree) took the floor to explain the different mechanisms established in the matter of quality guarantee of the degree. After that took place the opening lecture carried out by Beatriz De Pabli (lawyer and lecturer of the Master's degree) about “The Legal Profession in 2020.

Opportunities and challenges from the family law perspective. She has analysed how essential the service the legal profession provides is, fact that was legally recognised during

the lockdown, tackling real cases in the Civil and Family Law, as well as its effect on the way lawyers work.

Simulation of trials in the teaching framework of the Faculty Students registered in the subject Criminal Procedure Law, in the third year of the Degree in Law and fourth year of the Double Degree in Law and Business Management had the chance throughout the academic year to hold a mock trial to experiment the exercise of the legal profession in court. Under tutors Manuel Richard and Iñaki Riaño, the trial took place in the Legal Practice Classroom through the staging of an oral hearing developed within the framework of a criminal procedure linked to perpetration of a crime. Hearing in which the defendant and witnesses were crossexamined, and the oral report of the parties was issued. The trials

counted on the invaluable collaboration of students member of UPNA's theatre group, who played masterfully the roles of defendant victim.

As well as the participation of professionals of the legal area, who acted as judge and experts in a perfectly proper way.

Seminars of the Literature and Law Programme The different seminars corresponding to the Literature and Law Programme of the Faculty took place throughout the academic year.

Through them, a legal analysis on literary works was carried out. It included works of Garcilaso de la Vega (sonet XXXII), Cervantes, Unamuno (San Miguel Bueno Mártir), Pérez Galdós (Cádiz), Jacinto Benavente (Los intereses creados), Edgar Alan Poe (El corazón delator, El demonio de la perversidad or El barril de amontillado), Mary Shelley (Frankenstein), R.L. Stevenson (Strange Case of Dr Jekyll and Mr Hyde), Orwel (1984), Huxley (A happy world), Golding (Lord of the flies) Lorenzo Silva (La Estrategia del agua) o Reyes Calderón (El jurado número 10). Seminars driven by Faculty professors specialised in the different topics approached, which counted on the attendance of students registered in a Programme planned throughout the four years which make up its academic trajectory.

ACTIVITIES DEVELOPED AT THE FACULTY

Extraordinary seminar on Albert Camus Within the framework of the Literature and Law Programme of the Faculty, an Extraordinary seminar on Albert Camus has taken place. It has been taught by lawyer and writer Felipe Navarro Martínez, Professor of Theory of Law and Philosophy of Law at University of Málaga, on “Camus, reader of L'Étranger”.

The conference tackled a series of interesting questions regarding the novel and its legal dimension. Thus, the continuous game of mirrors that Camus’s novel keeps with Der Prozess by Kafka (Camus was a big fan) has been analysed. Camus uses the novel to parody a process and the participating actors (judge, prosecutor, counsel for the defense, etc) to condemn a legal system more concerned about moral judgement than a murder

trial. Camus even pictures himself as a young journalist reporting on a process which has become a show, a parody of justice. Because the reconstruction of events carried out in the process is totally wrong. The story focuses on the previous events (his mother's burial, his relationship with Marie, his friendship with Raymond) and not on the murder. Neither is there any concern for the victim. There is no legal discussion: the events and the Law are not considered, and the process becomes a judgement of Mersault's behaviour from a social and moral imaginary intending to prevail no matter what.

Mersault quits justifying himself when he sees it will be pointless.

Kafka and Clarín Awards Ceremony The Faculty of Law of Public University of Navarre granted the Kafka Award to the best legal story and Clarín Award to the best legal news. The winning student of the V Kafka Award to the Best Legal Story in the student category was Irune Urrutia Briongos, for “Cuello de botella” (bottle neck). The jury rewarded her “skill when dealing with legal issues, sensibility of the message, capacity to attract the interest of the reader and the construction of an outcome which is not shown”. The second position in the Kafka Awards was taken by student Ignacio Escala Estanca for “From the back of the courtroom” and Xabier Pérez Zubillaga was granted a secondary award for the work “In the name of progress”.

The winning student of the VIII edition of the Clarín Award to the Short Legal News was Santiago Alenza Carro for his work “Things being like this”. The jury pointed out “the legal interest that the chosen topic presents”, as well as the style used and the “humanisation of the news with an initial reference to the problem an individual suffered in the framework of the coronavirus crisis, a proper written expression and a right ending”. The second position was granted to Lucy Vallejos Mamani for the news entitled “The ECHR (European Court of Human Rights) supports the migrants’s return in the heat of the moment” and the third position was granted to María Ruiz de la Cuesta Vela for “On the typical haters”.

STUDENTS

David Garciandía, awarded by Fundación Brunet for the work performed

Awards for best End-of-studies project David Garciandía, graduated in the Double Degree in Law and Business Management of UPNA was the winner ("ex aequo" together with María Dolores Martínez Segura) of the University Award Jaime Brunet for Human Rights and Development Cooperation granted by the foundation of that name. The award rewords those end-of-degree or end-ofMaster's-degree projects of UPNA about the defence and protection of the people, and about improvements and proposals in matters related to development cooperation. David Garciandía Igal's work is entitled “Human Rights in China: the legal framework of religious freedom and its practical application” and was supervised by Mr Alejandro Torres, Professor of Constitutional Law. On the other hand, Sandra Gómez was granted the VI

Award to the Best End-of-degree project on Labour Relations and Human Resources for “The limits of the collective agreement applicable in multiservice companies”, supervised by professor Julen Llorens. This award is granted jointly with the Official Social Graduates School of Navarre.

Law students prevail in the debate league The team including Rodrigo Arvizu Sarasa, Christian Artola de Almeida, Luis Echarte Moreno (all of them students of the Degree in Law) and Nicolás de Augusto Oiz (Degree in Management and Business Administration.), have won the XX edition of the Debate League of Public University of Navarre (UPNA), held under the question: Is telework good for companies?.

The winning team beat the secondplace students, of which Garazi Aizkorbe Escriche (degree of Law) was a member. She was also the winner of the Tournament Best Speech. The awards were 750 Eur for the winning team, 400 for the second-best and 100 for the student who won the tournament.

DOCTORATE Doctoral theses

“Scribes and scribe offices in the Señorío de Vizcaya during the Modern Age (XVIXVIII centuries)” Ms. Nere Jone Intxaustegi Jauregi Thesis supervised by Roldán Jimeno Aranguren, professor of History of Law of the Faculty. The already doctor has a degree in History from the University of Deusto (2008) and in Law, also from Deusto (2013). In 2007 she received her doctorate in History from Universidad del País Vasco and in 2020 doctorate in Law from Public University of Navarre .

In her thesis she analyses the job, training and functions carried out by scribes, considered the predecessors of current notaries. As the author explains, “through this research we have managed to bring to light these characters of the administration - there were barely any studies about them - and we have managed to know them in more detail, see the similarities and, especially, the differences with notaries, their successors in the writing of public and private documents”. In this sense, she emphasises that currently notaries sit a public exam, have a comprehensive and exquisite education and there are no family bonds which guarantee that position as notaries. “It is a figure with a halo of respectability and credibility, which scribes lacked. However, scribes did many more things; for example, they were secretaries in the town hall meetings or in General Meetings; they had importance and relevance in the public domain, which does not happen nowadays with notaries”.

Among the main contribution of this doctoral thesis, these characters of the

administration have been brought to light there were barely any studies about them.

“We have managed, among other things, to know their identities, the tasks they carried out or the connections and dynamics among them - explains Nere Jone Intxaustegi -, which has allowed us to get to know them in more detail. Besides, we have brought to life many documents which were in the archives and had never been used”.

Regarding scribes’ offices, that is, their working place, we have focused on how many there were, the quantity and variability, among other things. She has also studied those who unlawfully held them, “which has allowed us to examine diverse legal phenomena such as alienations, rents, withdrawals or sales of scribes’ offices”. The study also considers other legal aspects such as the control scribes were under, through the so-called trial of residence. In this sense, Nere Jone Intxaustegi states that the number of scribes at the time was really high.

BASQUE Andrés Ur r utia Badiola (Bilbao, 1954), is the president of Euskaltzaindia, the Royal Academy of the Basque Language, since 2005. He is a notary, and during his professional career he has joined the practical side of law and the academic one. Docton in Law, he has published around 140 papers as a researcher and he is also a lecturer at Deusto University, in the area of Civil Law. We have been talking to him about the role of Basque in law.

“Basque can provide a new point of view to law, be the bond between our tradition and the wide world we live in, and thus get a worthy globalisation ” How has legal Basque evolved in the last few years?

For legal Basque - in particular - to develop, and for the Basque language - in general - to advance, it has been essential to declare Basque official. From that point on, Basque has been developing in the legal domain, as well as in university studies, public administration (in the laws and other bilingual administrative texts and, less, at court) and in the professions of legal agents such as lawyers, notaries, qualified property registrars, legal representatives, etc.

An increasing number of voices demand the simplification of legal language. How is this topic being approached in Euskaltzandia regarding Basque?

At Euskaltzaindia we know well that trend, especially in the administrative domain.

The situation of Basque, however, is particular. On the one hand, as a consequence of it becoming official, it had to cover a limited legal area (do not forget the separation of powers between the State and autonomous communities, established by the Constitution), which has been mostly achieved through translation. In this translation path we had to create the appropriate terminology and make our own resources to respond to the demands of linguistic pragmatics. At the same time, Basque has had to advocate for simplifying and clarifying the language. Therefore, it has had to move forward in two directions, apparently different but actually

BASQUE compatible. In the Basque Autonomous Country the so called clear language has been boosted. In any case, what is important is to reach a balance between legal certainty and understandability, and to achieve it we must count on the tools offered by a new discipline: the legal linguistics.

How can the academic world and university contribute to enrich the legal language in Basque?

Significantly. Firstly, by using Basque as legal language in the learning process; secondly, by allowing future lawyers to leave university with the skill to use legal Basque fully and easily in their profession and social and legal relations. And, last but not least, by collaborating with other entities, whether legal professional associations, or institutions competent in the Basque area, such as Euskaltzaindia, the official advising institution in the matter of the Basque language. A clear example in the Legal-parliamentary Dictionary, made by the legislative bodies of the Ragional Community of Navarre and the Basque Autonomous Community, under the management of Euskaltzaindia (www.euskaltzaindia.eus).

In your view, is it important to teach law in Basque? Why? In my opinion it is fundamental, in this globalised world where so many languages are spoken. Not only should we learn Basque (or English or other languages), but we should also know the different existing legal systems.

We must master comparative and applied law, since for lawyer it is no longer enough to know a single legal system. This is obvious in the case of Navarre, where various legal systems as applicable and in force (the European Union one, the Spanish one and the Regional

Community one.

How specifically does the learning of legal subjects in Basque contribute to the students’ education?

In every respect. I do not mean to repeat myself, but students understand the existing relations among different legal systems and languages, and learn different ways to learn legal concepts and their respective meanings. An example: for the Spanish term legitima in the succession system, we use the term seniparte in Basque. However, the meaning of senimarte is not the same in the Spanish Civil Code as in the Fuero Nuevo of Navarre (compilation of the Autonomous Civil Law). Something similar happens with the European Union Law. Lawyers nowadays must be able to understand the characteristics and specificities of different legal systems and different languages.

You are a notary and, as such, you know first-hand the practice of law. According to your experience, is Basque used in the daily activity of law?

Very little and, obviously, not as much as we would like. In any case, it is worth outlining that, in spite of the fact that the Basque usage percentage by legal agents is low (between 1.5 and 3% in average), Basque-speaking circuits are being created ie new ways are opening, which are making the legal practice in Basque possible (in court, lawyers’ offices, notary offices...). All that allows Basque to be used not only to relate orally and consult, but also as a written instrument of the legal world from the moment a text is generated, without having to use translations.

“Basque can bring a new point of view to the law and serve as a link with our tradition In your view, what aspects must we boost when educating lawyers to work in Basque?

Mainly, two: firstly, linguistic certainty to work in Basque must be guaranteed for them. To achieve that, legal agents and linguists must work together to generate material in Basque and provide good legal language patterns (both oral and written) in the classrooms. Secondly, usage spaces must be created in society, so graduates in law may exercise their profession in Basque. Certainly, both aspects require a legal and linguistic planning .

Do you think that legal research in Basque is in good health?

There is little research in the legal field in Basque, and it is clear that it depends on Spanish and other languages. This is, among other reasons, because research papers in Basque are not considered to obtain the recognition - and economic improvement of six years researching (sexenios) at university. This is why researchers always prefer to publish in Spanish or English and not Basque. This is clearly unfair worth reporting, but as far as I am concerned, so far no solution has been found.

In the world in general, and at university in particular, there is a growing tendency to internationalisation and to scientific production in English. In the context of globalised science, is there room for minority languages like Basque?

Yes, if we move quickly. It is usual to defend Basque among ourselves, but we do so in Spanish. We hate the obstacles and prohibitions out language has suffered throughout history, and we blame others for our incapacity. We care much less about analysing, defending and taking advantage of the manifestations which Basque has had in the legal field, and it would be a good way to build the current legal Basque. If we move forward along that path and, again, with the right planning established (translations, bilingual exhibitions, papers written by legal linguist experts...), Basque can find its place within the legal science field.

The legal treatment of Basque is different in each of the three territories of Basque: the Autonomous Community of Navarre, the Basque Autonomous Community and the French Basque Country. Are there enough tools to foster Basque in these legal frameworks?

I believe they are being, we are creating tools to that purpose. No doubt that separation damages Basque, but little by little we are all becoming more aware of the fact that Basque joins us, and it is a tool to join, as well as community law. If we mix those two ingredients, we will be able to move ahead to overcome the interstate situation we are currently living. It is a long-lasting task, yes, but necessary.

BASQUE Which aspects must be improve generally speaking in the current regulation of Basque?

We should declare Basque official; I mean, it should be necessary for Basque to be official in all the Basque Country territories. Of course, adaptations should be made, depending on the socio-linguistic reality of each place. On the other hand, we should put all the IT resources we currently have at everybody's disposal so the linguistic rights may be exercised. We should also pay close attention and close to the legal world to be able to answer quickly and swiftly to what is going on in the Basque field.

How can law contribute to Basque?

Well, to begin with, it may rescue and offer

new ways to express oneself. Firstly, it is a fantastic opportunity to analyse our personality, to cultivate out Law with the Basque language, not just through the oral tradition, but its written representation. In a nutshell, it may turn Basque into a full tool capable to explain and name Law. And Basque to law?

First, the opportunity to name legal institutions. Latin made a similar contribution to Romance languages. Basque can provide a new point of view to law, be the bond between our tradition and the wide world we live in, and thus get a worthy globalisation.

“The book is focused on Navarra, and it establishes three stages: the development of the “ius commune” (common law), the Enlightenment and the Modern Age. In the first section they delve into Christian law, starting from the fact that Roman and Canon law (ius commune) is the foundation of the Western legal culture. As the Modern Age started, in the second section she deals with the birth of the modern state, and regarding Navarre, she focuses on the conquest of Castille. “The influence of the Enlightenment in the evolution of law is also dealt with in this second section, as well as constitutionalism and the new codes arising from liberal revolutions and, specifically, from the French Revolution”.

“This work tackles the important presence of Orthodox Christians in Spain, especially as a result of the migration movements of previous decades. It reminds us that one of the main things pending to be solved in the Spanish legal system, in the matter of freedom of conscience, is to give a proper answer to the legal system of religious orders which, having received a declaración de notorio arraigo (legal status of religious orders), lack however a Cooperation Agreement with the Estate specifically applicable for them. “The characterisation of unit-price contracts turns the interpretation into a specific task for which current regulative tools do not offer a coherent solution. “In spite of the total centrality of the political equality principle, it is true that the concept “equal suffrage” has received very little attention by Political Sciences. The main goal of this work is to unveil this theoretical nakedness and offer a theory which, as far as possible, fills that void. Apart from that theoretical approach, the book also includes a review to the legal perspective of the equal suffrage, dealing with the main interpretative lines taken by compared constitutionalism. And lastly, it introduces a new proposal which would enable in Spain and other countries with a similar constitutional regulation which has prevented equal suffrage so far, the adoption of an electoral system fully egalitarian without needing a previous constitutional reform”.
