Police Paid Off by Goose Lobby A New Hampshire woman who called police after stopping in a highway median to help some stranded ducklings plans to fight a $100 ticket. Hallie Bibeau of Newfields tells WMUR-TV she was driving on Friday when she had to slam on her brakes to avoid hitting the ducklings. Courts Disagree on Obamacare Opposing decisions cast fate of subsidies in 36 states in doubt Washington Two federal appellate courts handed down contradictory rulings Tuesday on the legality of a central part of the Affordable Care Act that provides insurance subsidies to millions of Americans in three dozen states. The D.C. Circuit Court of Appeals ruled that the subsidies available under the 2010 health-care law may be provided only to residents of states that set up their own health insurance marketplaces. Less than two hours later, the Richmondbased 4th Circuit Court of Appeals upheld the subsidies, ruling in a separate case that the law’s language was ambiguous, giving the Obama administration the authority to allow the subsidies nationwide. The suits argued that Congress intended for the subsidies — in the form of tax credits — to go only to people in states that set up their own insurance exchanges, also

What Happens Now? The Obama administration said it will ask the entire D.C. appellate court panel to review the challenge. If it does, the administration is much more likely to get a favorable ruling, given the Democratic-leaning makeup of the entire circuit. If the court refuses what’s known as an “en banc” review, it increases the likelihood that the Supreme Court would take up the subsidies case, given the split rulings in the D.C. and Virginia circuits. a clear, commonsense case to be made here, which is that intent of Congress was to be sure that every eligible American who applied for tax credits ... would have access to those tax credits whether or not the marketplace was operated by federal officials or state officials.” Republicans, however, immediately cited the D.C. decision as yet more evidence that the law is flawed. “Today’s decision rightly holds the Obama administration accountable to the law. The plain text of Obamacare authorizes subsidies only through state exchanges, not the federal exchange,” said Sen. Orrin Hatch, R-Utah. “The court considered the administration’s justifications and came to an unmistak-

able conclusion: President Obama overreached.” If the D.C. decision is upheld, it would have wide-ranging consequences for states that declined to set up their own marketplaces. The ruling would affect 27 states, and another nine states that partially opted out of setting up their own marketplaces. Those states are instead being served by the federal marketplace, HealthCare.gov. Companies in those states would no longer have to offer health insurance to their workers under the so-called employer mandate, which kicks in next year. This is because under the law, employers are only hit with penalties for noncompliance if one or more of their workers ends up buying health coverage with the help of a subsidy. And it would put insurance financially out of reach for the millions of Americans relying on subsidies to pay insurance premiums. Elephants Are Too Fat, But It’s Tough to Tell Washington African elephants in captivity are packing on the pounds, and experts warn that the rise in obesity is contributing to infertility, which could be detrimental to the survival of the species in zoos. Just like humans, elephants with excess fat are more likely than others to develop infertility. Elephants are so large that it’s difficult for zookeepers to tell the difference between a healthy-weight animal and an obese one. Zookeepers can weigh elephants, but it’s hard to determine body fat. At U.S. zoos, which need to average about six births per year to maintain their population, the current rate is only about three per year. Obesity is suspected to be a major part of the problem. 192 Arrested in Federal Smuggling Crackdown

The Homeland Security Department said Tuesday it has seized more than $625,000 and arrested 192 people in a crackdown on human smuggling along the Mexican border in South Texas. The government’s crackdown is another front in the Obama administration’s ongoing effort to slow the flood of tens of thousands of unaccompanied children and families caught crossing the border illegally. Supreme Court Allows Ariz. Execution to Go On

The U.S. Supreme Court ruled Tuesday an Arizona execution could go forward amid a closely watched First Amendment fight over the secrecy surrounding lethal injection drugs. Who Is He? A former officer in the Russian intelligence service, Litvinenko fell out with the Russian government and became a strong critic of the Kremlin. He came to Britain in 2000 and died in 2006, at age 43, after drinking tea laced with polonium-210 at a London hotel.

Are There Suspects? The two Russians who sipped tea with him before he fell ill have been named as suspects, but they deny involvement and remain in Russia. Until now, the investigation has been prohibited from considering evidence that the Russian government played a role.

Why Now? British officials stressed Tuesday that the timing of the Litvinenko decision and the push to punish Russia after last week’s downing of a passenger flight in eastern Ukraine were entirely unrelated. But few in London believe that.

Washington The black boxes from Malaysia Air Flight 17 are unlikely to reveal what caused it to plunge from the sky above Ukraine, but tiny holes in the scattered wreckage can provide telltale evidence it was struck down by a missile, experts said Tuesday. There could be one hole or there could be dozens — none much bigger than a dime — but they are unmistakable evidence that a missile did the damage. “It’s a very distinct type of damage,” said Robert Benzon, a former lead investigator for the National Transportation Safety Board. While it’s possible that a missile actually hit the airplane, Benzon stressed that surface-to-air missiles are designed to detonate when they come close to planes and spray them with high-velocity particles, much like the spread of buckshot fired from a shotgun. Local Report: Home where autistic twins were locked up was unsafe Rockville A Rockville couple accused of keeping their autistic twins locked at night inside a barren, unlit basement room was ordered not to return to the house until the stench of urine was cleaned and the locks and plywood boards that blocked interior entrance-ways were removed, according to a fire inspection report. The report offers a glimpse into the living conditions at the home, where John and Janice Land have been the caretakers of the 22-yearold sons. The Lands were charged late last week with two counts of abuse of a vulnerable adult and two counts of false imprisonment, according to court records. John Land told detectives he locked the young men in the base-

Donovan Dayton, 54, was shot in the torso at a Capital One Bank branch at about 11:54 a.m. The police department said that two officers entered the bank in response to a call about a trespasser. They found Dayton, who displayed a knife and was “acting erratically.” Police said that Dayton “failed to respond to officers’ instructions” and “threatened the safety of the officers.” Dayton died of his injuries at a local hospital. Reading Between Our Lines Facial recognition technology could soon be used to predict life spans Washington Imagine that an insurance underwriter comes to your house and, along with noting your weight and blood pressure, snaps a photo of your face. And that those wrinkles, mottled spots and saggy parts, when fed into a computer, could estimate how long you will live. Facial recognition technology, long used to guess how a missing child might look as an adult, is getting personal. A group of scientists is working on a system that analyzes a person’s prospects (life span) based on how his or her face has aged. The research is still in its early stages, but the idea of using facial recognition technology has prompted interest from insurance companies who see potential for using it to set premiums. There’s also a potential benefit for individuals: The technology might prod them to change their health habits before it’s too late. The technology involves using a computer to scan a photo of a face for signs of aging. Factoring in the subject’s race, gender, education level and smoking history, it analyzes each section of the face looking for age-related changes that might indicate how the person is doing compared with others of the same age and background. The idea for the project came to Jay Olshansky, a biodemographer at the University of Illinois at Chicago, a couple of years ago during dinner with an insurance underwriter who wanted a better way of assessing people’s survival prospects. Olshansky, who studies aging, knew that people who live longer generally look younger than others their age. He wondered whether that knowledge could translate

The researchers are hoping for at least 10,000 or 20,000 people, but preferably more, to participate. The algorithms work different-

Queen’s Horse Fails Doping Test: A racehorse owned by Britain’s Queen Elizabeth II that won the prestigious Gold Cup at Royal Ascot last year has tested positive for the banned painkiller, morphine. The British Horseracing Authority announced last week that tests on five horses under the care of various trainers showed the presence of morphine in their ‘A’ samples. Andrew Wiggins will sign his rookie contract with the Cavaliers, but it’s still not clear if he’ll play for them. A person familiar with the negotiations says the Cavaliers will sign the No. 1 overall pick to his deal, an agreement that would prevent any potential trade involving the small forward from being completed for 30 days. Wiggins has been linked to a possible trade with Minnesota for All-Star forward Kevin Love. The person familiar with the talks says Wiggins will sign with Cleveland as early as Wednesday. The Cavaliers and Timberwolves have had ongoing discussions about a trade for Love since before Cleveland selected Wiggins first in May. The Timberwolves have always insisted that Wiggins be involved in any package, a stipulation the Cavaliers have resisted. Signing Wiggins to a contract wouldn’t necessarily prevent a trade from eventually happening. Under league rules, Wiggins cannot be officially traded for 30 days after he signs. But the Timberwolves and Cavaliers could come to some sort of agreement before that and then execute the trade after the window closes. (AP)

ACC Settles Into An Era of Stability Commissioner says new schools have meshed with league College Football Welcome to the new ACC. It’s where a founding member is out, a fast-rising program is in, Notre Dame is there, too — sort of — and nobody else is leaving. Where a one-time punchline of a football conference now boasts the Heisman Trophy winner, the reigning national champion and a handful of other individual award winners. And where stability finally has arrived — with its status as a power conference secure entering the College Football Playoff era — leaving its members optimistic about its future. “I think everybody is where they want to be,” Commissioner John Swofford said. “That’s real important.” So, here comes ambitious Louisville into its fourth conference since 2004. There goes Maryland, off to the Big Ten. And Notre Dame is at least dipping its toe into the league, starting a scheduling arrangement this year in which it will play a handful of ACC teams every season while keeping its prized football independence. The War of the Wives Hulu’s new scripted comedy “Hotwives of Orlando” is technically a parody of Bravo’s “Real Housewives” series. As many have noted, trying to satirize the absurd franchise is a difficult task, because the actual shows — from New York to Orange County — are already so much like parodies of themselves. It’s almost impossible to tell the two apart. Making up the main “hotwives,” there’s Tawny St. John (Casey Wilson), who uses her husband’s allergies as an excuse to cheat on him with her trainer; Shauna Maducci (Danielle Schneider), the Jersey native with a shopping addiction; Veronica Von Vandervon (Andrea Savage), described as simply a “rich white woman.” Plus, Crystal Simmons (Angela Kinsey) as a God-fearing housewife who has never read the Bible; Amanda Simmons (Kristen Schaal), Crystal’s sister, clinging to her glory days as a child star in a local prune juice commercial; and Phe Phe Reed (Tymberlee Hill), who uses her catchphrase (“I got to be

Phe Phe, I speak my mind”) to say mean things to everyone. Still, some of the characters remind us a little too much of some of “Real Housewives” reallife cast, Caroline Manzo of “New Jersey,” Phaedra Parks of “Atlanta,” Sonja Morgan of “New York,” Alexis Bellino of “Orange County,” etc.: So much that we decided to put it to the test. Whole New Ball Game and dramatizes his final years. The most radical feature of “Red or Dead” — and one that will try the patience of some readers — is the style. Peace uses short, often incomplete sentences, eschews pronouns and quotation marks, and deliberately repeats phrases and descriptions to excessive length, recalling early modernist works by Gertrude Stein, Ernest Hemingway and T.S. Eliot. Peace’s style often transcends modernist aesthetics to evoke ancient epics and medieval ballads, their repetitive formulas and lilting refrains, their stylized actions and heroic gravitas. He confesses in the final third that “football is my religion,” and the style appropriately resembles liturgical chanting, mystical incantation. For readers who simply want

David Peace turns a Liverpool manager’s life into an epic tale Book Review What Robert Coover and David Foster Wallace did for baseball and tennis, respectively, in the world of sport writing is matched, if not trounced, by what British writer David Peace has done for soccer, first with “The Damned Utd” (2006) and now with his mesmerizing “Red or Dead” ($24, Melville). This is an epic treatment of the career of Bill Shankly, who from 1959 to 1974 led the previously mediocre Liverpool Football Club to a series of triumphs. The first two-thirds of the book is a clipped account of every game the team played during those 15 seasons, complete with stats and attendance figures. The final third begins with his unexpected decision to retire

the straight story, there are a couple dozen books about Shankly to choose from. But “with artistry and craft, with bravery and with strength,” Peace set out to ennoble Shankly’s career into a postmodern epic. Goal! After Shankly retires, it becomes clear that the qualities that drove Shankly and his team to the top make it difficult to live a fulfilling life. Shankly’s wife and team members are little more than names, his daughters are always offstage, and he has nothing to fall back on after he leaves the game. Shankly thinks of football in terms of salvation and redemption, and compares the elusive Football Association Cup to the Holy Grail. T hese mora l qua nda r ies, like those in “The Odyssey” and “The Aeneid,” only enrich Peace’s ambitious novel. As both postmodern epic and ultimate sports novel, “Red or Dead” is a winner.

Kris Jenner will release her first cookbook in October, People magazine reported. “In the Kitchen With Kris: A Kollection of Kardashian-Jenner Family Favorites” will include Jenner’s recipes and tips for entertaining. “I finally got so tired of sharing my recipes one by one with everybody that asked, that it just made sense to do a book and put it all together,” she told E! Former host of “The View” Joy Behar told The New York Post that the recent departure of hosts Jenny McCarthy and Sherri Shepherd is good for the show. “I don’t know who they’re going to get, but [there’s] a rumor it’s going to be conservatives,” Behar said. “It’s must-see TV in the fall, for sure.” She said she will watch the show “for a while.” (EXPRESS)
