low down and enjoy nature’s everyday miracles in one of South Surrey’s most scenic areas where birdwatchers, bikers, and photographers gather for inspiration. Located at the east end of Mud Bay, the Serpentine Wildlife Management Area, better known as Serpentine Fen, offers an easy-to-walk 3.5 km trail located in a triangle between Highway 99, the King George Highway (99A) and the Serpentine River. This protected wildlife area, which features various habitats, is home to more than 130 different bird species that enjoy the open water and an abundant food supply. Extensive freshwater and tidal marshes are important to wildlife populations of birds, mammals, amphibians, reptiles, fish and insects. Commonly spotted species include great blue herons, cormorants, waterfowl, eagles, owls, songbirds, coyotes, shorebirds and more. Learning about wildlife and conservation is a real draw for the community. Local stewardship groups White Rock and Surrey Naturalists Society and Friends of Semiahmoo Bay Society help build awareness of the area’s biodiversity through monthly walks and

events such as World Wetlands Day. Did you know that BC’s wetlands are home to some 300 species of bird, salmon and other wildlife? Almost 8 million waterfowl and 20 million shorebirds migrate through the Pacific every year. Since 1969 the Serpentine site has been managed under a partnership between the Province and Ducks Unlimited Canada (DUC), the leader in wetland conservation, to protect habitat and promote wildlife populations. Other partners include the Habitat Conservation Trust Foundation and the North American Wetlands Conservation Act. DUC’s passionate science-backed conservation work protects wetlands and wildlife and connects people to nature. Their research arm, the Institute for Wetland & Waterfowl Research, shares important scientific findings with government, industry and landowners, such as the effects of wetland drainage on ecosystems, the efficacy of wetland restoration methods, and the potential impact of land-use change on waterfowl populations. DUC also helps manage invasive

Celebrating the best

of indigenous artwork

G

rowing up in the Gitxsan Nation, Cheryl Morgan Gregory was surrounded by magnificent totem poles and handcrafted works of art that honoured her native roots. “I always appreciated the authentic and unique pieces of art that I saw around me,” says Cheryl. “Many of my family members were carvers, and painters. Both my grandmothers spun wool and knit us beautiful Cowichan sweaters. I still wear one of them.” The Gitanmaax School of Northwest Coast Indian Art, on Cheryl’s family land at ‘Ksan, was instrumental in bringing about the resurgence of Native art in Northern BC. Cheryl’s late uncle Victor Mowatt was a master carver and art instructor.

For years the idea of opening her own art gallery occupied her imagination. She envisioned a place that showcased high quality, authentic Native handmade products, and offered them as an alternative to mass-produced items made from synthetic materials. For decades that dream was put on hold. After high school Cheryl went on to earn her Associate of Arts in Indigenous Government Studies, a Native Family and Community Counselling certificate, as well as a Business Administration diploma. Continuing her studies, she received her Master of Neurolinguistic Programming, and from there she went on to work in various administrative positions in the Native and Women’s Communities, while

raising her family. In 2011 Cheryl reached a crossroads in life. It was a defining moment. With the support of her daughters Cheyenne and Amber, she and her husband Jim founded Cheryl’s Trading Post. When Jim found out his wife wanted to realize her dream, he wasn’t surprised. “We have always been heavily involved in our traditional cultures, whether it was fishing, hunting or attending ceremonies,” he says. “The art gallery was simply an extension of that … it grew out of a passion to celebrate and give an outlet to our talented, creative people.” “There aren’t very many Native people selling our artwork,” Cheryl says. “Because we had a lot of friends and family members who are artists, they started bringing us their best art.” One artist is her niece, Michelle Stoney. She was one of two contemporary artists chosen by the Vancouver Airport Authority and the YVR Art Foundation to display their banners in the airport. One of her designs shows a raven transforming into an airplane. “I also sell my auntie Dolly Watts’ book,

mo’ problems: crowdfunding

“I

don’t know what they want from me, it’s like the more money we come across, the more problems we see”. As hard as it is to believe that tax and hip-hop could exist in the same sentence, the lyrics from The Notorious B.I.G.’s hit single Mo Money Mo Problems could not ring truer with regards to startups and the different techniques used to raise cash. While the golden age of hip-hop ushered in a new platform and direction for today’s artists, it too can be argued that today’s online world of raising cash, specifically crowdfunding, is setting the tone for the future while also bringing in new problems. For those not familiar with crowdfunding, it is a way by which to fund projects, business ventures, or not-for-profit organizations through online websites made available to large crowds of people who will then “donate” or contribute money to the cause if it resonates with them. Crowdfunding has gained traction in the last few years, with 2016 seeing crowdfunding platforms such as Indiegogo, Crowdfunder and Kickstarter become household names in the startup world. Currently, there are two types of crowdfunding methods, with the first model being more of a donation or contribution style, and the second model being an investment or equity-style based concept. The first model is usually where a large number of individuals will place differing amounts of monies to finance a specific project in exchange for a reward or some form of recognition by the issuer (for example Kickstarter). The second model is where businesses seeking capital injection will source equity or debt stakes in their companies to venture capitalists

or large groups of investors online (for example Crowdfunder). With startups and business ventures raising financing from crowdfunding models at an estimated US$34 billion in 2015, it really hits home when you consider that BC has the second highest percentage of small and early-stage businesses in Canada. A good chunk of these businesses in BC use alternative sources of raising capital and equity with a good number of them using online crowdfunding platforms. While crowdfunding is a relatively easy way to obtain necessary capital to finance your business or ventures, it is also not without its legal and tax implications. Currently, there is no official tax policy in Canada with regards to revenues and funding received by businesses or individuals for the use of business or income purposes. Depending on the facts and circumstances, income received by a taxpayer under a crowdfunding arrangement could represent a loan, capital contribution, gift, income, or a combination of these methods. Since the terms and conditions of these types of arrangements may vary greatly from one situation to another, the CRA’s approach is to evaluate each situation on a case-bycase basis before making a determination on the income tax consequences of a particular crowdfunding arrangement. However, CRA has issued two specific rulings in 2013 and 2015 with regards to their view on the taxation of these monies received by businesses and individuals. Generally speaking, where funds are received by you as a result of crowdfunding for use in a business or a business venture, the CRA generally considers such funds to be taxable income under subsection 9(1)

of the Income Tax Act. The funds are not taxable if it can be shown that they clearly represent a loan, capital contribution or other form of equity. Interestingly, under the equity method of crowdfunding CRA has no official position to date or any ruling letters. From a legal perspective, BC is one of the few provinces in Canada that has adopted crowdfunding registration and prospectus exemptions aimed at non-public startups and early stage businesses. Startups and early stage issuers intending to rely on the new exemptions must use a funding portal that is either relying on the crowdfunding exemptions or is operated by a registered dealer. In BC registrants would have to comply with the Startup Crowdfunding Exemption and ensure that they meet ongoing disclosure requirements, annual financial statements, and annual disclosure on how proceeds are used. While most certainly, the more money startups and businesses do come across, the more problems they see, it is also a sign of the times where non-conventional methods of capital raising are perhaps ushering in a new era of financing for small businesses and startups. As always, depending on which method of crowdfunding you proceed to use, please remember to consult a qualified lawyer and tax accountant on the pitfalls within securities regulation and tax compliance.

Types of Vacation Homes A vacation home is not always limited to a cabin in Point Roberts, WA or a condo in Maui. Boats and RVs can count as long as they have a sleeping area, and cooking and bathroom facilities.

Is your Vacation Home a Vacation Home? If you bought your vacation home solely for personal enjoyment, you can only deduct your mortgage interest and property taxes (as itemized deductions, if filing a U.S. Form 1040 as a U.S. citizen or resident). If you rent out your vacation home for less than 15 days during the year, you do not have to report the income on your U.S. tax return. You can still deduct your mortgage interest and property taxes as itemized deductions, but you cannot deduct other property-related expenses. Tax Deductions for a Rental Property If you limit your personal use to no more than the greater of 14 days or 10% of the time the home is rented, all rental expenses are generally deductible. You must divide your expenses between rental and personal use days. The rules change if you exceed this threshold (see Personal Use of a Vacation Home, below). For a property that is exclusively a rental property (or has limited personal use), you can deduct numerous expenses including: • Advertising • Travel (if related to your rental activity) • Cleaning and maintenance • Insurance • Legal and professional fees • Management fees

Depreciation is the reduction in the value of an asset (e.g. a building) with the passage of time, due in particular to wear and tear. Expenses Exceeding Income Where expenses exceed income, the overall loss from a rental property may be limited. Generally, losses from a rental property are not available to offset income, other than passive activity income. You can carry forward disallowed passive rental losses to the next taxable year. To maximize the deduction for losses

you need to be actively involved in the rental property. This means performing such management decisions as approving new tenants, deciding on rental terms and approving expenditures. Personal Use of a Vacation Home If you rent out your vacation home while personally using it for more than the greater of 14 days or 10% of the total days it is rented to others at a fair rental price, some or all of the rental expenses that exceed rental income cannot be used to offset income from other sources. The excess expenses that cannot be used to offset income from other sources are carried forward to the next year and treated as rental expenses for the same property.

The key to maximizing deductions is keeping annual personal use of your vacation home to less than 15 days or 10% of the total rental days, whichever is greater. Doing this ensures that your vacation home is considered a rental property. Conversion of a Vacation Home to a Principal Residence An owner of a U.S. vacation home may

not be able to avoid paying U.S. tax on gains arising on a sale of the property by converting it into a principal residence prior to the sale. The capital gains exclusion that is normally available on the sale of a home that was owned and used by a taxpayer as a principal residence for at least 2 of the 5 years ending on the date of sale is reduced on a pro rata basis to reflect the period of rental, vacation home or other “nonqualifying use” since January 1, 2009.

*For a non-resident of the U.S., an election must be filed with a U.S. tax return to be taxed on a net rental income, otherwise a flat 30% tax applies to the gross rents.
