Y

ou would think that after having spent half his life behind bars ̶ nearly all of it in maximum security prisons ̶ Jessy Martinez would have had enough of solitude.

Not so.

U

Jessy, who spends most of his waking hours these days working and going to school, enjoys the time he spends alone in his studio apartment in San Francisco.

“It’s very important to me,” he says. “It’s where I get to reflect, to meditate, where I can envision myself better without any distractions. In prison, it’s a different kind of solitude. You have no control over that solitude.”

Jessy lost control at the age of 16, when he was arrested, convicted and sentenced to serve 100 years- to-life in prison. He regained it two years ago, and is now using it to build a positive life based on self-improvement, community and love.

“I’m doing amazing,” he says. “I’m blessed.”

Jessy grew up in a rough neighborhood in Southern California’s San Fernando Valley, in a household that he describes as “volatile.” His older brother, he recalls, joined a gang when he was 11 years old. A few years later, when Jessy was 14, he became a gang member, too.

Living in a violent neighborhood, he says, kids just naturally came together to protect themselves and their neighborhood from rival gangs.

A couple of years later, it led to his being charged with homicide.

Jessy was shopping for clothes with a couple of friends in a mall one day after school. They saw some guys hanging out who they didn’t recognize and went over to check them out. They turned out to be from a different neighborhood, but they weren’t rivals -- until one of Jessy’s friends tossed an insult their way. When things heated up, his other friend pulled a gun and shot two of them to death.

Jessy says he didn’t know his friend had a gun, but that didn’t matter according to the laws in place at that time designed to prosecute gang violence: Jessy was charged with two counts of homicide, along with a couple of lesser charges. Following his conviction, he received his 100 years-to-life sentence.

“I never believed that I belonged in prison,” says Jessy. “I never believed that I would die there.”

Five years later, Jessy won an appeal for a new trial. Leery of another trial, he agreed to a deal for 30 years. Fifteen years later, he was released after his first appearance before the parole board.

During his time in prison, Jessy says he made an effort to hang out with people who were positive.

He earned his GED. He attended church services, and started reading the Bible. In the beginning, he read it as he would any other book, but then he saw that the biblical stories contained values and principles that he wanted to instill in himself.

Since his parole two years ago, Jessy has been focused on work and education. Through the Project Rebound Program, Jessy is taking classes at San Francisco State University. He is also enrolled in a coding program correspondence course at Columbia University.

While pursuing his educational goals, he works as a case manager for Hospitality House in San Francisco, serving the city’s homeless population ̶ some of whom have mental health issues.

“I’m glad to be in that role,” says Jessy, who, while in prison, tutored other prisoners. “It doesn’t feel like a job because it feels so good. I want to give back.”

Gratitude, he says, is a big part of his life now.

“I’m grateful for a lot of things. I’m thankful for a higher power ̶ for the role it’s played in my life. I’m grateful for my support network.”

He is especially grateful to Mary ̶ a woman who, as a volunteer, visited him every week in juvenile hall at the beginning of his case.

“Throughout my whole journey, she stayed with me,” says Jessy. “She wrote me every month. My family was not very involved, so that really helped me. I’m still in contact with her.”

While busy with school and work, Jessy is also intent on building community. It’s one of the reasons he chose to apply to the Excell Network Program, and attend its meetings. Listening to the stories of his fellow students, he says, motivates and empowers him.

“We’re all going through something,” he says.

“It’s important for people to know ̶ hey, you’re not alone. There is help. Reach out for that help.

You don’t have to go through the suffering on your own. And tell people you love them ̶ life goes by real quick”.

"Me alegro de estar en ese papel", dice Jessy, quien, mientras estaba en prisión, fue tutor de otros prisioneros. “No se siente como un trabajo porque se siente tan bien. Quiero retribuir".

La gratitud, dice, es una gran parte de su vida ahora.

“Estoy agradecido por muchas cosas. Estoy agradecido por un poder superior, por el papel que ha jugado en mi vida. Estoy agradecido por mi red de apoyo".

Está especialmente agradecido con Mary, una mujer que, como voluntaria, lo visitaba todas las semanas en el centro de menores al comienzo de su caso.

“Durante todo mi viaje, ella se quedó conmigo”, dice Jessy. “Ella me escribía todos los meses. Mi familia no estaba muy involucrada, así que eso realmente me ayudó. Todavía estoy en contacto con ella".

A number of the Excell Network students participated in September’s Reentry Conference as panelists, using their experiences to discuss current issues and advocate for positive change.

For the women’s panel, Nicole Bronson, Daisy Gonzalez, Heather Leach, Cynthia Torres-Lozano, and Collette Stroganov spoke on the topic of “The Resiliency of Empowered Women,” each sharing her personal story and what helped her to overcome obstacles and reach goals. The men spoke later in the afternoon, with John Cunningham, Miguel Infante, Jessy Martinez, and Trung Tong discussing the idea of “Redefining Maculinity through a Restorative Justice Lens.” This topic allowed them to delve into how perceptions of masculinity result in different choices in life.

In addition, students Bobby Jones-Hanley, Joseph Krauter, and Heather Leach spoke on panels with other organizations. All the students succeeded in inspiring audience members with their testimonies, using the opportunity to step into a leadership role and encourage others.

HEATHER LEACH “The time in jail gave me a safe place to figure out who I really was”

M

irando hacia atrás en todo ahora, Heather Leach considera su tiempo en la cárcel como un tiempo bien empleado.

ooking back on it all now, Heather Leach considers her time in jail as time well spent.

“I am so grateful for my incarceration, for the length and the severity,” she says. “I needed at least five years.”

She got seven-and-a-half, which turned out to be enough to figure out she really wasn’t who she was pretending to be ̶ a tough kid called “Snow,” caught up in the criminal lifestyle on the streets of Oakland, involved in an abusive, violent relationship with a man who was stalked and shot multiple times by his enemies.

She had grown up as Heather ̶ a country girl from a small Oregon town where fishing and swimming and hunting were popular pasttimes. After high school, she left home to study at Southern Oregon University in Ashland, where she says she “fell in love with sex, drugs and rap.”

“He was my best friend,” she says. “So when my dad died, I fled.”

Heather moved to Oakland, started working as a prostitute and fell in with a hard crowd. Later, she learned the intricacies of credit card fraud and made a lot of money doing that. Although she was turned off by the violence of the crowd she ran with, she did enjoy some aspects of the high-rolling criminal lifestyle.

“It’s fun when you drive a Maserati and have a five-bedroom home that’s paid for when you’re 22 years old,” she says.

There were, however, other aspects of the life that were far from fun. Heather’s boyfriend had made enemies, and they were looking for him. She was walking through a parking lot with him and some friends one night when someone started shooting.

Although Heather escaped unhurt, her boyfriend was shot five times. Miraculously, he survived, but lost a leg.

The brush with death didn’t change things.

“Instead of leaving, I got a tattoo on my ankle that said ‘Pop’s Bitch,’” says Heather. “I looked in the mirror and said, ‘You’re not Heather anymore, you’re Snow.’”

When several of her friends were later arrested and charged with a murder, Heather was pulled in with them. She remained in jail for two years before authorities acknowledged that she had not been at the scene of the crime.

Heather tears up when she recalls a visit to the jail by her mother.

“When I told her I was innocent, she believed me,” she says.

Because of the seriousness of the charges and other factors, it took a while before the case came to trial. Heather’s case was finally separated from the others. She pled out to the charge of kidnapping and was released from jail in March of last year.

During the years she spent behind bars, Heather underwent what she describes as a gradual transformation.

“It gave me a safe place to figure out who I really was,” she says, “and to be away from my violent friends. I built a really strong, positive network while I was there.”

The first year, she stayed in her cell and refused to talk to anyone. She spent the second year reading anything she could get her hands on. Then a kind deputy encouraged her to come out of her cell and start working in some of the programs offered at the jail.

Through the Sisters Program at Walden House, she confronted self-esteem and anger management issues. She began taking correspondence courses and earned two Associate of Arts degrees. When she graduated from the Five Keys Program, she walked proudly across the stage to receive her diploma and was later allowed to hug members of her family.

Since her release, Heather has been busy working and pursuing her educational goals. She was recently promoted at her job at Episcopal Community Services in San Francisco, where she works to find fair market housing for clients over the age of 60. She spends her weekends working for Recovery Survival Network, a housing program for people leaving jail or prison.

Through the Project Rebound Program at San Francisco State University, Heather is taking classes in sociology and business administration.

Once her educational goals are reached, she plans to pursue a career in nonprofits.

While still in jail, she met Julio Escobar and, through him, learned about the Excell Network Program.

“It was one of my goals,” she says.

So far, says Heather, she has reached twothirds of the goals she set for herself while in jail.

Now, she’s making new goals, and looking at the future with hope.

She’s also looking at herself a little differently these days.

“Now when I look in the mirror, I see that I am this beautiful mosaic of all those broken pieces.

I’m more than Heather or Snow. And I like who I am.”

Desde su liberación, Heather ha estado ocupada trabajando y persiguiendo sus metas educativas. Recientemente fue ascendida en su trabajo en Episcopal Community Services en San Francisco, donde trabaja para encontrar viviendas en el mercado justo para clientes mayores de 60 años. JOHN CUNNINGHAM “You can rebuild and re-invent yourself and be effective again”

W

hatever else it may be, John Cunningham Jr.’s life is a tale of transitions.

It is the story of a person being shaped through the years by the changes ̶ and the challenges those changes brought with them ̶ into the man he is today.

The first occurred at the age of nine, when he moved from a mostly Black neighborhood in Oakland, where he had been born, to a mostly White neighborhood in El Cerrito.

“It was one of the biggest social and cultural shifts of my life,” says John. “And it was a great experience, because it taught me a lot about human diversity, acceptance and challenges.”

The second was sparked when an Army recruiter walked onto the football field during team practice one day at El Cerrito High School.

“He was looking snappy and cool in that uniform,” says John, who enlisted immediately after graduating from high school.

After basic training, John was sent to Germany where, for the next three-and-a-half years, he served as an MP. “That was another drastic cultural change,” he says. “It challenged me in ways that I see now have made me the man I am today.”

Upon his transfer back to the United States, John was promoted and selected to work undercover as part of a drug-suppression team in the Army’s Criminal Investigative Division. His territory stretched from San Jose north to the Sierra Army Depot in Susanville.

When his seven-year military career ended, John joined the Richmond Police Department. Nine years later, a family member accused him of sexual abuse. While John has consistently denied the allegation, its effects were devastating.

Upon his conviction, John then confronted what was, perhaps, the most difficult transition of his life thus far ̶ living behind bars.

After 13 years in prison, came another tough transition: integration back into society.

“Anytime you become incarcerated, you become institutionalized,” says John. “That doesn’t bode well when you get out of prison and get back into society.”

Parolees, says John, often lack the information or resources they need to make a good transition. He views the parole system ̶ with its high rate of turnover among parole officers carrying heavy caseloads ̶ as often more a hindrance than a help.

Prior to his release nearly five years ago, John read books about how to make a successful transition. He was also fortunate, he says, to have had a strong support system of friends and family who came to together to make sure he had what he needed when he got out.

“Everybody pitched in,” he says. “I never had to worry about food, clothing or shelter.”

Not long after his release, John attended a support group meeting for parolees that he says changed his life. Offered by Rubicon Programs ̶ a nonprofit whose mission is to break the cycle of poverty in East Bay communities ̶ the meeting so impressed John that he made a fateful decision.

“I said, ‘I want to work for Rubicon. I want to do this work.’”

For the past two-and-a-half years, John has been doing just that. He now helps others make the difficult transition from incarceration to life on the outside ̶ not only as meeting facilitator, but as case manager, workshop coordinator and, since March, as supervisor at Rubicon.

John, who is married and has four children, is also a student at San Francisco State University through the Project Rebound Program. His academic focus in on race and resistance studies.

John was accepted into the Willie L. Brown Jr. Fellowship program, through which he serves as an intern in city government in San Francisco.

He works with Shamann Walton, president of the Board of Supervisors, on the project dedicated to closing juvenile hall and reinventing the juvenile justice system in San Francisco.

John heard about the Excell Network Program during a meeting of Project Rebound students.

“I met Julio (Escobar), and before the Zoom meeting was over I sent him a text message saying I wanted to be in the program,” he says.

Raised in the church, Cunningham is an ordained elder in the Life Connection Church in Modesto. It was his faith, he says ̶ along with Rubicon Programs and the wise advice of his mother ̶ that helped him work through the difficult process that ends in forgiveness and healing.

It is a story he wants to share with others.

“I’m just here to tell my story and to tell people that there is life after incarceration,” he says. “You can rebuild and re-invent yourself and be effective again.”
