How does the service work?

Guildford Shopmobility provides a selection of manual and powered wheelchairs and scooters to anyone of any age group who experience difficulty walking around Guildford Town Centre. This could be as a result of a permanent or temporary disability, frailty, accident or illness.

You choose the support you need. Our local team will talk to you about your requirements and introduce you to a Home Help who has been interviewed and selected by us. We will be available to ensure you receive excellent service and answer any questions you may have. If required we will, wherever possible, arrange holiday and sickness cover to ensure you receive continuous support. All our Home Helps are security checked, to give you peace of mind.

We charge a modest monthly service fee to enable us to support you locally and our charitable work across the county. To make the service as affordable as possible, all our Home Helps and Gardeners are self-employed. That means you pay them directly for the number of hours they work.

PREPARING FOR THE FUTURE TODAY - LPAs Whilst most people have thought about what will happen to them as they get older, there are a surprising number who fail to do anything to prepare. Perhaps there is a reluctance to consider it in any great detail because who really wants to think about their own mortality? However, with the continuing developments in medical science and the fact that we appear to be living longer, everyone should really be asking themselves the question “am I prepared?”

Lasting Powers of Attorney (LPAs) Since 2016, Dementia and Alzheimer’s disease has become the leading cause of death in England and Wales for the over 80s, and therefore the frequency in which older people and their families will run into capacity related difficulties is also likely to increase. Whilst Alzheimer’s and Dementia are perhaps the most common reasons for the loss of capacity, other causes may include strokes or accidents. MYTH - I don’t need an LPA as I am married and if something happened to either one of us we could deal with each other’s affairs. FACT - Even if you are married or have children, if you lose mental capacity, no one has the legal right to make decisions on your behalf without having a Lasting Power of Attorney in place. An LPA allows you to appoint attorneys to act on your behalf. There are two types of LPA:• Property & Financial Affairs • Health & Welfare

Property & Financial Affairs LPA An attorney appointed under a Property & Financial Affairs LPA is responsible for dealing with tangible assets, such as property, bank accounts and investments. The Property & Financial Affairs LPA can also be used whilst you retain capacity, with your consent. Therefore if you feel that you are physically unable to manage your affairs (e.g. you struggle to sign paperwork) then you can ask your attorney to assist you. In relation to your finances, your attorney will be able to gain access to your funds in order to pay for things such as your utility bills and council tax or, if necessary, organise care in your home or perhaps paying for residential care home fees. This could well mean your home needs to be sold, which again your attorney could do on your behalf. Your attorney is then able to seek financial advice as to how best to invest your funds and pay for the fees.

MYTH - If I have all my funds and investments in joint accounts, the joint owner will still have full access to those accounts if I lose capacity. FACT - Even if all of your assets are held jointly with another, a financial LPA is still necessary. Guidance issued by banks confirms that joint accounts can still be frozen if one joint owner loses capacity. In addition to this, a joint owner of property would not be able to sell the property if one of the owners cannot consent due to lack of capacity.

Health & Welfare LPA An attorney appointed under a Health and Welfare LPA will be able to make decisions concerning medical treatment, personal welfare and care. This LPA can only be used if you are no longer able to make such decisions yourself. The benefits of LPAs are that your loved ones, chosen by you, are then legally able to act on your behalf when necessary. By preparing LPAs you have control over who will act on your behalf rather than leaving matters to Social Services or the Courts. If you lose mental capacity without an LPA in place, the only alternative would be for your family members to apply to the Court of Protection for a Deputyship Order. This process is more complex, time consuming and expensive than preparing Lasting Powers of Attorney. MYTH - I am young so I don’t need an LPA. FACT - Unfortunately, we don’t have a crystal ball to see into the future and the same rules apply even if you lose capacity at a young age. It may also be important for business owners to consider who will manage their business if they lose capacity. Will Planning Another important aspect to consider (at whatever age!) is to ensure that you have a validly drafted Will in place. Failing to prepare a Will whilst you have mental capacity can result in significant difficulties for your family members when you pass away. MYTH - When I die, everything I own will automatically go to my spouse. FACT - If you die without a Will, the intestacy rules will apply. These rules provide a strict order in which funds pass to your family and, if you have children, it is possible that all funds will not pass to your spouse. By preparing a Will, you can specify where your hard earned money and family heirlooms will go after you are gone and you can appoint Executors who will deal with your affairs. These can be family members, friends or professionals who you can rely on to deal with matters correctly, and who would be able to manage this responsibility. You can also appoint guardians for any dependents under 18. Wills are especially important if you are in a relationship but are not married as a partner will not be recognised by the intestacy provisions. Wills are also essential if you have vulnerable beneficiaries that need to be protected. Wills can also be used to ensure that your estate passes in a tax efficient way, and we can provide bespoke IHT planning if required. By investing a small amount of time into thinking about these matters, you can ensure that your family are taken care of, but more importantly you can have the peace of mind that you have taken care of your own needs.
