National Police arrested Gardiner, who lives in Mijas, for suspected murder after the violence erupted at 1.50am last Thursday. Mr Pender, 53, is said by National Police to have received deep cuts to his neck and body. According to police Gardiner had entered the pub and started making advances to several women. One of these was the victim’s wife, Caroline. Mr Pender is thought to have politely asked Gardiner to stop. When the Irishman went to the toilet it is alleged that Gardiner - who did not know the victim and had never met him before - followed and attacked him.
