Widow fights back A WIDOW who was forced to pay the top rate of Spanish tax for non-residents on her deceased husband’s Mallorca finca has won €38,000 from the Spanish Supreme Court. Judges ruled that it was discrimination against foreigners from the EU to force the German national to pay the Spanish state tax rate of 34 per cent. On the Balearic Islands the inheritance tax for the property would have been closer to 1 per cent. She won thanks to a 2014 ruling from the European Court of Justice which insisted that the Spanish government apply the inheritance tax of autonomous regions to EU foreigners, and not the higher rate of the central tax authorities. The deadline to apply for such compensation passed in November 2015.
