Regularisation at last! LIGHT at end of the tunnel for owners of ‘illegal’ homes By Maria Jose Fernandez OWNERS of illegal homes bought in good faith across the Axarquia region are celebrating the latest news that the government is planning to finally regularise their properties. Up until this moment, illegal homes bought in good faith could not aspire to any kind of regularisation; the reason being that the current Urban Planning Law

in Andalucia (LOUA) establishes the status of these homes as illegal, a status which does not expire. This means that the continual threat of demolition was hanging over them like a sword. However, the governing board of the regional government approved a draft law on Tuesday, July 21, which will modify three articles of the LOUA. This in turn is expected to benefit some 25,000 illegal homes bought in good faith, most of them

located in the Axarquia and Almanzora (Almeria) regions. The new draft establishes that a home will be suitable for legalisation six years after being built, as long as it is not located in areas at risk of flooding, in an area of ‘special protection’ or affected by legal or administrative records. The proposal will have to be ratified in the Andalucian Parliament before it can pass into law.
