Overview: Stormwater Regulation

Municipal Stormwater Challenges

Addressing Resource Needs

Common Municipal Stormwater Challenges

► Underfunding of Public Works Operations ► MS4 (i.e. Phase II NPDES) General Permit Requirements ► Aging and Outdated Infrastructure ► Total Maximum Daily Loads (TMDLs and Impaired Waters)

MS4 General Permit: Challenges

Construction Stormwater Control

Six Minimum Control Measures

Public Education

Pollution Prevention & Good Housekeeping

PostConstruction Stormwater Control

Impaired Waters (i.e., TMDLs)

Illicit Discharge Detection and Elimination

Public Outreach

MS4 General Permit Construction Stormwater Control ► Soil Erosion Ordinance

Post-Construction Stormwater Controls ► Stormwater Ordinance

Illicit Discharge Detection and Elimination ► Mapping all Outfalls ► Illicit Discharge Ordinance

Impaired Waters and TMDLs Install Infrastructure and Update Local Policy to Address: ► Bacteria ► Nutrients (Phosphorus, Nitrogen)

Aging Infrastructure and Underfunded Operations

Industrial Stormwater Management Changing Role of Municipalities & Implications for Industrial Facilities & Campuses

Existing Requirements: Industrial Stormwater Permits

► Facility is regulated if it has a Point Source Discharge and Industrial Exposure to one of 11 activities ► Permitting Authority varies by state: EPA in Massachusetts, RIDEM in Rhode Island ► Compliance Steps: » Determine Exposure » File NOI » Create SWPPP » Comply with additional requirements

Existing Requirements: Industrial Stormwater Permits

2015: EPA approved new MSGP for industrial stormwater discharges in Massachusetts; regulated facilities were required to file an electronic NOI by September 2015. Permit Requirements ► Public availability of SWPPPs ► New benchmark monitoring requirements ► Electronic filing of reports, monitoring results

Permitted Facilities must File an Electronic Annual Report ► First electronic annual report due January 30, 2017 ► Covers January 1 – December 31, 2016

Drivers for Stormwater Action ► Facilities are designing sustainable buildings that incorporate stormwater management on site ► Municipalities are increasingly seeking help from facility owners through collaborative efforts and stormwater ordinances to address: »

Street and property flooding

»

Pollution loading

Common Stormwater BMPs to Address Flooding

Stormwater Infiltration Systems: ► Pervious Pavers ► Drywell ► Pipe and Stone

Issues to Avoid

ď ľ

If the facility is in control of the design process to assist with an offsite issue, it can avoid stormwater retrofit locations that may have historic contamination issues

ď ľ

Pre-planning can address this issue

Lessons Learned â–ş Accommodate municipal stormwater activity cost planning in advance â–ş This is more cost effective than moving forward at high risk environmental risk locations (which may require remediation) â–ş Stormwater master plans and capital improvements proactively help facilities
