Cosby retrial could favor defense though publicity a wild card PENNSYLVANIA - A retrial of Bill Cosby on sexual assault charges will likely offer major advantages to the defense, former prosecutors and defense lawyers say, but the enormous publicity surrounding the case may also produce a second jury that is more eager to convict. Judge Steven O’Neill of the Montgomery County Court of Common Pleas in Pennsylvania declared a mistrial on Saturday after jurors said they were deadlocked after 52 hours of deliberations. Montgomery County District Attorney Kevin Steele immediately announced he would seek a retrial. New York lawyer Paul Callan, a former prosecutor, said he thought it would “exceptionally difficult” for the state to win a second trial against Cosby. Callan noted the defense would soon be able to access a full transcript of all the prosecution witness testimony to try to highlight inconsistencies. Linda Fairstein, former head of the sex crimes unit with the Manhattan District Attorney’s Office, agreed that retrials are usually better for the defense. “From my perspective, a retrial is never an advantage because, as a prosecutor, you put your best case on,” she said. New York defense lawyer Harvey Fishbein noted Cosby’s lawyers had shown fewer of their cards, resting without calling any witnesses. The comedian also did not testify in his own defense. “They might decide to re-evaluate that position,” said Fishbein. The prosecution is also under more pressure than the defense in terms of expending public resources, he added. One hung jury raises the possibility of another one, and the government needs to weigh how far it wants to go to win a conviction. (rtr)

‘Cars 3’ Races Past ‘Wonder Woman’ to No. 1
LOS ANGELES - This weekend featured a heated race between four new films that opened in wide release. As of Sunday morning, it appears some have fared better than others. The big winner is Disney and Pixar’s “Cars 3,” which is speeding to $53.5 million from 4,256 locations, putting it in first place. That’s a lower opening than “Cars” ($60.1 million) and “Cars 2” ($66.1 million), but still enough to win the weekend. The first two “Cars” movies combined have made more than $435 million in the U.S. and $1 billion globally. The “Cars” films are far from Disney and Pixar’s highest earners, but “Cars 3” is another example that even a decent opening for the duo is a victory in the big picture. The movie comes from director Brian Fee, who was a storyboard artist on the first two “Cars” films, as well as “Ratatouille” and “Wall-E.” The ensemble voice cast of “Cars 3” includes Owen Wilson, Cristela Alonzo, Armie Hammer, Larry the Cable Guy, Bonnie Hunt,
Nathan Fillion, Kerry Washington, and Lea DeLaria. “Cars 3” bumps “Wonder Woman” out of first place, but the super hero movie continues to show strong. With an estimated $40.7 million from 4,018 locations, the Warner Bros. and DC Comics film is seeing another extremely low drop of 32% from last weekend. Otherwise, Tupac biopic “All Eyez on Me” from Lionsgate and Summit is beating out expectations with an estimated $27.1 million from 2,471 locations. Demetrius Shipp Jr. plays the mythologized rapper. Benny Bloom -- who has two feature films and a long list of music videos on his resume -- directed the film that explores Shakur’s origins, rise, and imprisonment. Shakur’s 46th birthday. “47 Meters Down” is opening to $11.5 million from 2,270 locations. It’s the first major release from Entertainment Studios, which acquired the project from its original distributor, Dimension Films. Mandy Moore and Claire Holt star as sisters who decide to go cage diving, and end up at risk of being attacked by sharks. Finally, “Rough Night,” a raunchy, fem-centric R-rated comedy from Sony, is on track to earn only $8.1 million from 3,162 locations. The project combines the talents of director and co-writer Lucia Aniello, co-writer and actor Paul W. Downs, and star Ilana Glazer -- the three are frequent collaborators on Comedy Central’s “Broad City” and “Time Traveling Bong.” Scarlett Johansson, Kate McKinnon, Jillian Bell, Zoe Kravitz, and Glazer make up a rowdy girl gang who reunite for a bachelorette weekend that goes horribly wrong. Four foreign inmates break out of Bali jail using tunnel
DENPASAR - Indonesian police have launched a search for four foreign inmates, who escaped from an overcrowded prison on the resort island of Bali by crawling through a narrow tunnel dug under the walls, authorities said on Monday. “The tunnel is about 12 metres (39 ft) long and we suspect it took more than a week to build,” the head of Kerobokan prison Tony Nainggolan said, adding that police believed the men were still in Bali and not far from the prison. The four are Australian Shaun Edward Davidson, Bulgarian Dimitar Nikolov Iliev, Indian Sayed Muhammad Said and Malaysian Tee Kok King, Bali police spokesman Hengky Widjaja said. The tunnel had a diameter of 50 x 75 cm (20 x 30 inches) and was found filled with water on Monday morning,
Widjaja said. Kerobokan houses a fairly large number of foreign inmates, given Bali’s status as an international holiday destination and transport hub. The four men were serving sentences for different crimes, from immigration rules violation to drug crimes, Widjaja said.
The remaining jail time for 33-year-old Australian Davidson, who was sentenced to a year in prison for breaking immigration laws, was 2 months and 15 days, while 31-year-old Indian Said had 12 years and 3 months to serve for drug offences. The head of the prison said that 10 guards were
on duty on Sunday night when the escape is believed to have taken place. Indonesian prisons are frequently overcrowded and a war on drugs being led by the government of President Joko Widodo has triggered a spike in the number of convicted drug offenders, stretching an already overwhelmed jail system. The capacity of Kerobakan is 323 inmates, but it currently houses more than four times that number at 1,378, according to government data. Prison escapes are fairly
