OCD 11 halts Padada search and retrieval operations, deaths up to 9

he search and retrieval operation at the collapsed South Green Marketing Building in the town of Padada, Davao del Sur was of�icially terminated on Tuesday night.

This was con�irmed by Of�ice of Civil Defense (OCD) 11 Operations Head Franz Irag in a message to Edge Davao.

Irag said Padada Municipal Disaster Risk Reduction Management Of�icer Engr. Luke Cadoyas decided to halt the operation around 8:20 p.m. of December 17, since there were no more signs of any person buried inside the collapsed building.

Emily G. Beloy, who was believed

to be alive last Monday, was found dead inside the ruined commercial building around 9:55 p.m. of Dec. 16. Beloy, named as Emily Gollegos in previous reports, was an employee of the establishment. Public urged to refrain from spreading wrong quake info

he Mindanao Peace Council (MPC) is calling the public to stop sending wrong information related to earthquakes and to to get information only from of�icial websites of government agencies to avoid confusion.

Vince Molejon, MPC secretary general, told media in Wednesday’s AFP PNP Press Corps Media Forum that wrong information about the recent earthquakes have been circulating and are being forwarded among members of the family and friends.

“Because of the advent of the social media, just last night there were wrong information circulating about the earthquake. Pakiusap lang check the of�icial websites of the government agencies para tama ang mga information

na ma-gather natin at maibigay sa ating mga pamilya at sa mga kaibigan. Huwag tayong magkamaling magpadala ng mga messages that are not validated as it will just create another level of hysteria among the people,” he said.

He said some information shared about the earthquakes are not based on of�icial reports of the Philippine Institute of Volcanology and Seismology (PHIVOLCS) or any government websites.

Called “the bridge of hope”, the hanging bridge is situated in Purok Alanyag, Barangay Mapula, connecting 23 more areas where an estimated 400 families are residing.

The project was made possible through the initiative of the GMA Kapuso Foundation and sponsors MX3, The Royal Mandaya Hotel, Cemex, Local Peace 911, Armed Forces of the Philippines (AFP) and the Barangay Mapula of�icials.

AFP Chief of Staff Lieutenant General Noel Clement, who was also around during the groundbreaking of the project in July 2019, congratulated the barangay, the GMA Kapuso Foundation and the donors of the project.

He also advised the residents of Mapula to take good care of the hanging bridge.

“Itong tulay na ito, nahitabo because of the bayanihan spirit nga atong giingon ‘no, ang pagtinabangay sa atong tanan nga mga sector para mahimo ug mapadayon atong mga project (This bridge was made possible because of our bayanihan spirit. GMA Kapuso Foundation Founder and Ambassador Mel Tiangco graced the inauguration and told the residents of Mapula to take care of the bridge as it is a blessing from God. Mapula Baranggay Captain Flora Manyawron recalled how dif�icult it was for the people without a bridge there.

DOLE distributes cash for more than a thousand Matinians

T

he Department of Labor and Employment in cooperation with the City of Mati LGU distributed cash to more than a thousand Matinians who participated in their Emergency Employment Program.

The cash distribution was held at the Emmanuel Pelaez Gym inside the Mati City Hall Grounds on Wednesday morning, December 18.

A total of 1,251 residents bene�ited from the EEP with each receiving P3,960 for a total amount of P4,953,960.

Of the 1,251 bene�iciaries, 18 are vendors, 200 are �isherfolks, and 1,033 are from the barangays.

The barangays that bene�ited for the work for cash program are Lawigan, Bobon, Tagbinonga, Mayo, Libudon, Mamali, Don Salvador Lopez, Macambol, Taguibo, Don Enrique Lopez, Dawan, and Don Mar-

tin Marundan.

Last September, DOLE and the City Government of Mati also released the salary of 2,518 workers tapped for the Emergency Employment Program.

DOLE provincial director Rodolfo Castro Jr. said the national agency allocated P5 million for the emergency employment of Mati residents while the City Government under the administration of Mayor Michelle Nakpil Rabat added P5 million more.

Duterte to spend ‘simple’ Christmas celeb in Davao

F

or the fourth time since he assumed the highest of�ice in 2016, President Rodrigo Duterte will be spending Christmas with his family in his residence in Davao City, Malacañang said on Tuesday.

Duterte opted anew to celebrate Christmas without fanfare, Presidential Spokesperson Salvador Panelo said.

“The President, as usual, will be spending his Christmas, with his family, with his grandchildren, children in his house in Davao City,” Panelo told Palace reporters.

“Oo, palagi namang ganoon ‘yun (Yes, that’s what he regularly does),” he added, when asked if the President merely wants a simple Christmas celebration.

Duterte spends Christmas in his home in Davao City each year, even after getting elected as president.

It has also been the President’s Christmas tradition to visit young cancer patients at the Southern Philippine Medical Center in Davao City every year.

Nearly two weeks before Christmas, Duterte played Santa to cancer-stricken Jacob Wong, 5, who visited the President’s hometown Dec. 13. The child received early Christmas presents and even a fatherly hug and kisses on the forehead from the President.

When he was mayor of Davao City, Duterte always hosted a Christmas party for residents at his ancestral home in Bangkal village.

He, however, was no longer able to attend the event when he became president for security reasons, although the annual gift-giving continues.

Ampatuan Massacre: The Trial in summary

ON DEC. 19, 2019, Judge Jocelyn Solis-Reyes, presiding judge of Branch 221 of the regional trial court of Quezon City, will promulgate the ruling on the Ampatuan Massacre case, after over nine years of trial.

The case called the attention of press organizations in the Philippine and of international media groups. The killings that occurred on Nov. 23, 2009 were described as the “deadliest strike against the press in history.”

The massacre underscored the dangers to journalists in the Philippines, as advocates for

press freedom and justice have focused on the months and years of trial.

THE TRIAL AND FACTS OF CASE On Nov. 23, 2009, 58 persons were killed in Ampatuan town, Maguindanao province. The victims included 32 journalists and media workers, two lawyers, six motorists passing the same route, and the wife and sisters of Esmael “Toto” Mangudadatu, at that time the vice-mayor of Buluan town in Maguindanao.

The Mangudadatu women were on their way to Shariff Aguak to �ile Toto’s certi�icate of

candidacy for the 2010 gubernatorial elections.

The convoy included media practitioners, and members of the community press, including broadcasters from TV and radio.

The media practitioners and workers — many of them from General Santos City and Koronadal City — were covering the �iling of Mangudadatu’s certi�icate of candidacy, which his wife, Genalin, would accomplish on his behalf.

The case also exempli�ied the violence that tars the record of elections in the country.

The Ampatuans were the ruling clan in Maguindanao: Andal Ampatuan Sr. was governor of the province and Andal Jr., or Datu Unsay, was mayor of Ampatuan town.

Mangudadatu’s challenge was news, a story that concerned not only the local community, but also the national public.

Then President Gloria Macapagal Arroyo publicly acknowledged the Ampatuans as important allies, making them powerful partisans in national politics.

DEATH AND DISAPPEARANCES The hearings began on Jan. 5, 2010. Identifying so many suspects took time. And some could not be found. By early 2013, only 81 of the 98 arrested suspects had been arraigned. The number of the accused included in the same charge sheet, no one could expect a quick trial.

Eight of the accused died during the period of trial. On July 17, 2015,

Andal Ampatuan Sr. died of a heart attack while in detention.

A potential witness, Suwahid Upham was killed in June 2010. Upham had admitted in a media interview that he was one of those who killed the victims, and that it was Datu Unsay himself who shot Genalyn Mangudadatu, the wife of Esmael “Toto” Mangudadtu.

Witness Esmael Enog was killed after he testi�ied in court that he was ordered by his boss, Alijol Ampatuan, to drive armed men to Barangay Malating, the site of the massacre.

CUMBERSOME COURSE OF JUSTICE Seventy detained suspects asked to be released on bail, which meant the court had to hear their petitions in lengthy proceedings.

The bail hearings for Datu Unsay alone took years, as witnesses were examined and cross-examined by both the prosecution and the defense.

It was only on May 30, 2017, seven years after the trial began, that Judge Solis-Reyes denied Datu Unsay’s petition for bail.

The defense also �iled numerous motions which added weeks and months to the process. Representing three of the accused

overnment lawyers did all they can to give justice to the victims of the Maguindanao massacre case, Justice Secretary Menardo Guevarra said Tuesday, two days before the scheduled promulgation of the court’s decision on the case.

“I cannot comment on that because I might preempt the promulgation. I have no idea as to how it will go but what I can say is that the prosecutors presented all that it can. It did its best. That is all I can say,” Guevarra said when asked of the possible decision on the case.

“As to how the judge will appreciate the evidence, I am not sure about that so let’s go through it and see,” he added.

On Tuesday, Quezon City Regional Trial Court (RTC) Branch 221 Presiding Judge Jocelyn Solis-Reyes ordered Zaldy Ampatuan, one of the accused to be

sent back to Camp Bagong Diwa from his detention at the Makati Medical Center where he is recuperating following a stroke.

A number of setbacks had plagued the Department of Justice in previous administration’s efforts to prosecute members of the Ampatuan clan for the incident on November 23, 2009, which resulted in the death of 58 individuals, including 32 newsmen.

Then Justice Secretary Alberto Agra, during the Arroyo administration, was roundly criticized for his decision then to drop the charges against two of the Ampatuans implicated in the case.

Barely a year into the proceedings in 2010, Senior Assistant State Prosecutor Leo Dacera who led the government’s prosecution team, then 52, died from cardiac arrest.

EDITORIAL KSP Vice President Leni Robredo just cannot resist the political temptation called grandstanding.

On the day she earlier announced she would reveal her report on the country’s anti-illegal drugs campaign, she announced that she is rescheduling it in the aftermath of the magnitude 6.9 earthquake in Davao.

She still did the deferment in grandstanding fashion. Calling a press conference that she is calling it off.

Leni’s voracious appetite for attention is beyond compare. For how can one call people only to say that she is not doing anything.

If she is indeed sincere to defer making her report public, a simple phone call, message, or a note to all media invited would have suf�iced. Clutching her 40-page report, she went to the rostrum to say, “the announcement is off until further notice.”

Why did Leni defer? Is it because had she pushed through with the unveiling of her �indings and recommendations, it would just be drowned out in the attention that will be gobbled up by more important matters like the earthquake situation. Obviously, she

will be overshadowed. Hence, she’s buying time.

Assuming Robredo lets out her report on Monday, it will not stop or change the government and private sector’s mobilization to assist earthquake victims. It would be of no consequence, people know what is more urgent than political grandstanding.

If this report is important and her recommendations urgent, there is no reason to defer or delay. And if this report is credible and valuable, why wait for the storm to leave and come out and tell everyone?

It is obvious, Robredo is hyping up her announcement to grab as much public attention as she can. It won’t be surprising that when the announcement comes, Robredo’s keyboard armies and sympathetic foreign supporters are ready for the drum rolls.

A sincere leader, not thinking of her own political gains, would not sacri�ice immediate solutions to a drug war if he or she has any. At the end of the day, this is not about who the bad guy or the good guy in government is. It’s who has the solution. Not the attention.

The �irst question goes this way: “If you meet a woman who was pregnant, had 8 kids already (three of who were deaf, two were blind, and one mentally retarded), and she had syphilis, would you recommend that she undergoes an abortion?”

While thinking what would be your answer, here’s the second tickler: It is time to elect the next president, and only your vote counts. There are three candidates and here the straight facts about each. The �irst candidate associates with crooked politicians, and consults with astrologist. He’s had

two mistresses. He also chain smokes and drinks eight to 10 martinis a day.

The second candidate was kicked out of of�ice twice, sleeps until noon, used opium in college and drinks a quart of whiskey every evening.

The third and last candidate is a decorated war hero.

He’s a vegetarian, doesn’t smoke, drinks an occasional beer and never cheated on his wife.

The question is: “Which of these candidates would be your choice?”

Don’t cheat; write your answer before knowing who those three candidates are.

Now, if you have already written your answer, here are the names of the candidates: The �irst candidate is American President Franklin Delano Roosevelt. The second is British Prime Minister Winston Churchill. And the third is no other than German dictator Adolph Hitler.

And, by the way, on your answer to the abortion question: If you said “yes,” you just killed Ludwig van Beethoven.

Tricky, isn’t it? The Bible states plainly, “Do not judge, or you too will be judged. For in the same way you judge others, you will be judged, and with the measure you use, it will be measured to you” (Matthew

7:1-2).

But humans as we are, we judge other people. And, oftentimes, our judgment is based on our emotion, our experience – and not on facts.

“We judge ourselves by what we feel capable of doing; others judge us by what we have done,” said Henry Wadsworth Longfellow.

I was reminded of a tale in German song about a contest between a nightingale and a cuckoo to prove which sang more beautifully. As it happened, the only creature around to judge was a donkey.

The nightingale sang �irst.

As its beautiful melody trilled through the woods, the donkey twitched its long ears and looked on with a stupid, puzzled expression.

Then the cuckoo called its simple, two-note song. Suddenly, the face of the donkey registered a serious, appraising look, and then he began to nod. This he could understand.

After all, “cuckoo, cuckoo” isn’t really all that far from “heehaw, hee-haw.”

It comes as no surprise that the donkey judged the cuckoo to be the better singer.

Like donkey, that’s how people also judge. “We all judge according to our own limited perceptions, our biases, our varying degrees of ignorance,”

someone once said.

Seneca pointed this out, too: “A man who examines the saddle and bridle and not the animal itself when he is out to buy a horse is a fool; similarly, only an absolute fool values a man according to his clothes, or according to his position, which after all is only something we wear like clothing.”

Don’t be swift in judging others. “You shouldn’t judge people based on appearances and your preconceptions,” Itachi Uchiha reminds.

On a walk one day, a man was surprised to see another man hoeing his garden while sitting in a chair. “What laziness!” he thought. But suddenly he saw, leaning against his chair, a pair of crutches. The other man was at work despite his handicap.

Here’s what he said based on that experience: “The lesson I learned about snap judgments that day has stayed with me for years now: the crosses people bear are seldom in plain sight.” How true, indeed!

Never judge or you may judge yourself. French author Honore de Balzac used to busy himself in his spare time analyzing handwriting as an index of a person’s character.

He liked to consider himself a master in that art.

One day, an old lady brought him a little boy’s homework notebook and asked Balzac to give his opinion of the child’s potential. He carefully studied the untidy script. “Are you the boy’s mother,” he asked. She answered negatively.

“Perhaps you are related in some way?” Balzac asked again.

The old lady replied negatively once more. “Then I will tell you quite frankly my opinion,” he said. “This youth is slovenly and probably stupid. I’m afraid that he will never amount to anything.”

Hearing those words, the old lady laughed. “But, sir, that notebook was your own when you were a little boy at school.”

It cannot be helped because our situation today – in government, in political circles and elsewhere in other aspects of Philippine life – we discover rather sadly that the good, the bad and the ugly interlope with each other, they being the integral ingredients in the milieu of human existence.

They say art imitates life and vice versa.

A few more winks and a new year – 2020 – will take its bow.

The “good” refers to the positive stuff that has been achieved for the bene�it of the common people (the general public that is more popularly called “grassroots”) in the basic areas of education, public health care, labor and employment, poverty alleviation, food security and peace and order.

The “bad” refers to the un-

warranted corruption in government including the judiciary and Congress, lawlessness due to banditry and insurgency, illegal drugs and human traf�icking.

The “ugly” refers to the unceasing fault�inding by the political opposition and their cohorts against the incumbent administration - fueled by its desire to grab power – in conspiracy with the domestic mainstream media and foreign funders based mainly in the US and Europe. They are joined in this category by rich, in�luential and powerful clans who belong to the oligarchy.

Leadership is a big issue in government set-ups.

Great leaders, I bet we shall all agree, make a great difference.

It is logically accepted that leaders with poor leadership skills generate and produce poor results. Comparatively, good leaders tend to produce good results.

Then, can we assume that

“extraordinary” leaders produce exceptional extraordinary results which are way above expectations?

From this parallel observation, we can deduce who among our country’s leaders (past and present) can be upheld as having produced good results for the country and the people ranged against global economic and political standpoints during their respective incumbencies.

In our contemporary scenario where the good, the bad and the ugly become an acceptable mix, is there a good chance the Filipino people can get over the hump considering the state of economic and political affairs?

The climb is hazardous and steep because the terrain is hilly. The grassroots are at the short end of the rope because the wealth of the nation is unevenly distributed.

Perhaps this quote from Niccolo Machiavelli may help.

He said: “Of mankind we may

say in general that they are �ickle, hypocritical and greedy of gain.”

The last phrase describing the “greed’ of man is very relevant in the Philippine sense.

Only one percent or even less of the more than 100 million population belong to the rich – the pro�ligate businessmen and their families – who, unknown to the millions of poor Filipinos, have connived to apportion among themselves the patrimony of the nation.

Numerous business contracts and deals amounting to billions involving the operation and management of utilities (light and water), energy and oil exploration, real estate development, airport and railways construction, dams and water sheds, banking and insurance, media franchises are being cornered by sectors belonging to the oligarchy.

The nation and our countrymen – we all are – have become hostage to the insatiable greed of scrupulous business-

men and women.

When will this hellish disparity end?

We have survived almost four hundred years of cruel and bitter Spanish colonization, nearly �ive decades of American tutelage, another four brutal years of Japanese occupation.

Aren’t we a resilient people?

Our timidity and tamed obedience are horrendously telling us we did wrong in tolerating the abuses of our colonizers, all of whom toyed with us because we did not raise a hoot nor collectively grumble against their abuses during those sad, tragic times.

Now our very own ugly countrymen are in�licting on us what the Spaniards, Americans and the Japanese have in�licted on us respectively.

ORDINANCE NO. 027-19 Series of 2019 AN ORDINANCE ON BUILDING HEIGHT LIMITS AMENDING ARTICLE VIII SECTIONS 3 TO 6 OF THE AMENDED 2013 COMPREHENSIVE ZONING ORDINANCE OF DAVAO CITY Be it ordained by the Honorable Sangguniang Panlungsod of Davao City in session assembled, that: SECTION 1. TITLE – This Ordinance shall be known as “AN ORDINANCE ON BUILDING HEIGHT LIMITS AMENDING ARTICLE VIII SECTIONS 3 TO 6 OF THE AMENDED 2013 COMPREHENSIVE ZONING ORDINANCE OF DAVAO CITY”.

SECTION 2. PURPOSE – This Ordinance is enacted for the following purposes: 1. Guide, control and regulate future growth and development of the City in accordance with pertinent laws on building height regulations and on allowable urban development mechanisms responsive to the challenges and opportunities of urbanization; 2. Provide an orderly pattern of development that is both transit-oriented and transit responsive; 3. Conform to flight safety regulations and improve disaster-resilience; 4. Preserve view of cultural and heritage sites; 5. Promote and improve urban livability index such as better air quality, sufficient access to sunlight, open and green spaces and urban connectivity and mobility comforts; 6. Provide incentives to the private sector in improving the built environment.

SECTION 3. DECLARATION OF POLICY - It is the policy of the City Government of Davao to manage efficiently the urban landscape where mobility potentials are maximized, greening programs actualized through innovative space provision, and disaster-resilience intensified through building height restrictions. The City shall continue to devise zoning and land use mechanisms responsive to the challenges and opportunities as may be presented by urban growth and development. The scheme for Additional floor-space credits to qualified private individuals or corporations which have allocated open spaces for the public through the Privately Owned Public Open Spaces (POPOS) program and the premium required from developers opting for additional floor areas over and above the regular height limit being imposed by the city are strategies for environment investments. The premium floor space that may be permitted in a zone for a specified fee shall provide the City an avenue for revenue generation that may be devoted to road improvement and greening programs.

It shall be further declared to be the policy of the City to strictly enforce measures in accordance with existing and relevant land use provisions.

SECTION 4. SCOPE OF APPLICATION - This Ordinance shall prescribe the rules applicable to any building construction activity within the territorial jurisdiction of Davao City. This Ordinance shall prescribe the guidelines on the applicable permissible height in relation to the distance from the flight path and with reference to the desired urban densities and in setting relative order to the City’s skyline and preservation efforts. Variance or additional premium height over and above the regular height limit set by the City shall be allowed and permitted provided that it shall not be higher than the limitations set by the Civil Aviation Authority of the Philippines (CAAP).

SECTION 5. DEFINITION OF TERMS - For the purpose of the Rules and Regulations, the following terms and phrases shall mean as follows: 1. Obstacle Limitation Surface (OLS) – is an imaginary surface above ground that sets the height limit for building structures to ensure flight navigational safety; 2. Floor Area Ratio (FAR) is the ratio of the total plot area to the total building area and is determined by the size of the plot and the width of the road in front of the plot; 3. “Comprehensive Land Use Plan (CLUP)” shall refer to the document embodying specific proposal for guiding, regulating growth and/or development; 4. HLURB – Housing and Land Use Regulatory Board; 5. Conforming Use – a use, which is in accordance with the zone classification as provided for in the Ordinance; 6. Green Architecture – building and structure design philosophy that aims at minimal use of non-renewable and/or polluting materials and resources/energy in construction and use of a facility when completed; 7. Green Space- community space consisting of land (as parks) rather than buildings; 8. Privately-Owned Public Open Spaces (POPOS) are physical spaces which are privately owned but legally required to be open to the public under a land-use law and arrangement with the City Government of Davao such as but not limited to plazas, terraces, atriums, small parks, view decks, playground, food park, and alleyways that connects two structures without passing through a regular street.

9. Zoning Map – a duly authenticated map delineating the different zone classifications into which the whole city is divided.

10. Mean Sea Level – the zero reference point from which the limits shall be measured from.

SECTION 6. AMENDMENT TO ARTICLE VIII SECTIONS 3 TO 6 OF THE AMENDED 2013 COMPREHENSIVE ZONING ORDINANCE OF DAVAO CITY - For purposes of providing the amendment and supplemental provisions of Article VIII Sections 3 to 6 of the Amended 2013 Comprehensive Zoning Ordinance of Davao City, the following revisions and amendments are depicted as follows: ARTICLE VIII COMMON REGULATIONS FOR MAJOR URBAN SUB-ZONES “SECTION 3. To provide specific height limits for buildings and structures in the City intended to achieve desired levels of urban densities, respond to transport and traffic concerns with due consideration to the rising demand for water, power, and other utilities, provide precautionary and proactive approach to urban mobility and efficiency and create an ecologically sustainable environment to improve or maintain the quality of life. Height regulations must conform to the restrictions and requirements as set forth in this Ordinance which are generally set lower than the prescribed limits set by the Civil Aviation Authority of the Philippines (CAAP) and providing further that the requirements are compliant with the National Building Code, the Structural Code as well as all laws , ordinances, design standards, rules and regulations related to land development and building construction and the various safety codes.

3.3.10 Tallest Landmark Structure Limitation – The City Government of Davao may allow the construction of a structure which can reach up to 140 meters above mean sea level and which will serve as the City’s tallest landmark and postcard image provided it is to be built in any of the following Height Zones: TO-E; TO-F; AP-D; AP-E; and CHS. Provided, further, that only one tallest structure shall be allowed to be built within Davao City.

3.3.10.1 Criteria for Permitting Construction of the tallest structure - For a structure to be considered and awarded with the privilege of becoming the tallest landmark in the city, the project must meet the following criteria: 1. The building project’s design is unique and should bear semblance to or representation of Davao City’s culture and heritage; 2. It must devote at least 50 percent of its ground floor area accessible to the public.

The summit must also be made accessible to the public for tourism and viewing purposes either for free or for a fee; and 3. The usable floor spaces must be at least 70% non-residential development.

FEES FOR ADDITIONAL FLOOR SPACES 3.4 COMPUTATION of APPLICABLE FEES on ADDITIONAL FLOOR SPACES and the Greening Program Fund 3.4.1 Fees for Additional Floor Spaces above the regular height limit or within the premium height restriction - A project intending to construct up to a height that is beyond the regular height limit of the city but not exceeding the maximum allowable premium height shall be assessed the following: • One-time Processing fee of P 10,000.00; and • P 5,000 per square meter for the usable floor spaces generated above the regular height limit.

3.4.2 Fees for the Tallest Landmark – an applicant for the tallest landmark shall be assessed with the following fees: • One-time processing fee of P 10,000.00; and • P10,000 per square meter for the usable floor spaces generated above the regular height limit being imposed in the height zone Applicants denied to construct the city’s tallest landmark which is above the premium height limit shall be subsequently considered for the premium height limit unless the appli cant or owner has initially expressed written intention that the project will not be pursued if the permission to construct above the premium height has been officially denied or disapproved by the Building Height Regulation Committee. Otherwise, the fees applicable will revert to the scheduled fees for buildings with premium height.

3.4.3 Article 19. Computing for Additional Floor Spaces – The additional floor spaces shall be the usable floor spaces constructed above the regular height limit as imposed by the City.

For purposes of computing the applicable fees for premium floor spaces generated upon applying the premium height limit, the computation shall be as follow:

Total Floor Area Generated above the regular height

Minus Additional Floor Space Credits granted by the City (if any)

Minus total floor area of hallways, stairs and stair landing generated above regular height

Equals Total Floor Area that can be assessed for a fee per square meter by the City

3.4.4 Height Limit Fees Accrual - All fees collected in relation to applications for Premium Height Limit shall accrue to the local funds.

3.5 Additional Floor Space Credits under the POPOS Scheme – Private land owners and/or developers can be granted Additional Floor Space Credits equivalent to a maximum of 3 times the size of the area devoted as a Privately-owned Public Open Space (POPOS), credits of which can be applied in lieu of premium height fees for usable floors built above the regular height limit 3.5.1 Credits can be acquired and applied to the same building project hosting a POPOS 3.5.2 A private landowner can devote his/her plot of land inside an Urban Ecological Enhancement Sub-Zone (UEESZ) for POPOS purposes, acquire Credits for such undertaking, and then apply said Credits to a separate project outside the UEESZ that is intended to be constructed above the regular height limit. For this purpose, the land shall have an encumbrance that is tied to a POPOS Scheme with the City Government of Davao and that the encumbrance shall remain enforced up to the demolition of the building.

In cases where the POPOS ceased operating as POPOS after the Additional Floor Space Credits were already applied, the owner/developer shall be assessed accordingly of all fees and charges applicable to projects without POPOS or without floor space credits.

PROCESSES IN THE APPLICATION FOR PREMIUM HEIGHT LIMIT 3.6 Application Process for Premium Height Limit – All applications must be filed with the Building Height Regulation Committee through the Office of the City Building Official (OCBO).

3.6.1 Application Requirements. All applications shall be deemed complete only upon compliance of the following standard requirements: A. Premium Height Filing and Processing Fee (A non-refundable fee of P 10,000 shall be paid upon submission of documentary requirements; B. Detailed Engineering Design, drawings and perspectives in accordance with PD 1096; C. Zoning Clearance Certification; D. Copies of Land Titles; and E. Other documentary requirements as may be deemed necessary by the Building Height Regulation Committee.

3.7 Application for CAAP Height Clearance Permit – All applications shall still secure, as part of the requirements for locational clearance, a Height Clearance Permit from the CAAP or the relevant national agency assigned in regulating height clearances and/or permits.

3.8 CREATION, COMPOSITION, MEETINGS, POWERS AND FUNCTIONS OF THE BUILDINGS & STRUCTURES HEIGHT REGULATION COMMITTEE OF DAVAO CITY 3.8.1 The Buildings and Structures Height Regulation Committee (BSHRC). There is hereby created the Buildings and Structures Height Regulation Committee to enforce and implement the provisions of this Ordinance.

3.8.1.1 Composition of the Committee. – The Committee shall be composed of the following: Chairperson City Mayor, or in her absence, the City Administrator Vice-Chairperson City Building Official Co-Vice-Chairperson City Planning and Development Coordinator Members: City Engineer City Architect City Legal Officer SP Chairperson or representative, Committee on Housing, Rural and Urban Development (PD 957) Civil Aviation Authority of the Philippines (CAAP) Philippine Institute of Civil Engineers (PICE) United Architects of the Philippines (UAP) The membership of the Committee may be increased or decreased as necessary by the City Mayor upon recommendation of the Committee.

3.8.1.2 Powers and Functions of the BSHRC. The Committee shall have the following functions and responsibilities: A. To act on all applications for building and structure height limits above the regular height set by the City for approval or disapproval; B. To determine the total floor area generated above the regular height limit that can be assessed for premium regulatory fees ; C. To review, evaluate and consider Additional Floor Space Credits in the assessment of premium regulatory fees ; D. To grant Certificates for Allowable Height Above the Regular Limit; E. To submit recommendations and resolutions to the Sangguniang Panglungsod pertaining to height regulation policies and other related schemes; and F. To perform such other functions necessary and proper in carrying out the provisions of this Ordinance 3.8.1.3 Meetings. The Committee shall meet at least once a month or as often as necessary.

3.8.1.4 Appointment of Permanent Representatives. At the beginning of every year, a member of the Committee may name in writing his/her permanent authorized representative.

3.8.1.5 Secretariat – Employees/Officers from the Office of the Building Official shall be selected and appointed by the Committee Chairperson as members of the secretariat. The Secretariat shall accept and process applications for premium height and in general, perform secretariat functions for the BSHRC Committee.

3.8.1.6 Appropriations. Subject to compliance of government accounting and auditing rules and regulations, the budgetary needs for the effective implementation of this Ordinance, including the payment of honoraria, incidental and other expenses to the Buildings and Structures Height Regulation Committee, its secretariat, technical staff and other appropriate personnel, as may hereinafter be identified shall be taken from the available funds of the City Government of Davao.

SECTION 4. HEIGHT REGULATIONS IN LOW DENSITY RESIDENTIAL SUBZONE (R-1) . In R-1 Sub-zone, buildings or structures for human occupancy whether public or private shall not exceed nine (9) meters in height or the limitation that will be set by the CAAP, whichever is lower.

SECTION 5. HEIGHT REGULATIONS IN MEDIUM DENSITY RESIDENTIAL SUB-ZONE (R-2) - In R-2 Sub-zone, buildings or structures for human occupancy whether public or private shall not exceed twelve (12) meters in height or the limitation that will be set by the CAAP, whichever is lower.

SECTION 6. ALL OTHER SUB-ZONES. Within these districts, building heights shall be based on the prescribed Floor Area Ratio (FAR) or as enumerated in Article VIII, Section 3, whichever is lower, applicable, and permitted by the Buildings & Structures Height Regulation Committee of Davao City.

SECTION 7. SEPARABILITY CLAUSE – The provisions of these Rules are hereby declared to be seperable, and in the event that one or more of the provisions hereof are held illegal or unconstitutional, the validity of the other provisions shall not be affected thereby.

SECTION 8. EFFECTIVITY – This ordinance shall take effect thirty (30) days after its publication in a newspaper of general circulation in Davao City and posting for three (3) consecutive weeks at the entrance of the City Hall of Davao and in at least two (2) other conspicuous places.

ENACTED, on the 3rd Day of September, 2019, by a ¾ majority votes of the Members of the Sangguniang Panlungsod, there being a quorum.

Ryan Bernard Go, president of Grand Land, Inc., said they will be upgrading the 20-year old former Grand Mercure Hotel into a business hotel and will be sporting a modern European look.

“It will undergo a facelift and even the furniture will be replaced.

Grand Regal Hotel is used to be the �irst 5 star branded hotel in Mindanao. Right now we are renovating everything. It is still a mid-level hotel and we are not going to do it as a �ive star,” Go said.

Currently, renovations

of the two �loors are ongoing.

Go said they already did a masterplan for the two-hectare space at the back of the hotel. According to him, they on the stage of getting all the permits. The masterplan includes a commercial arcade and a BPO building.

At the roof deck, they will be renovating the pool where a glass house will be built.

The glass house, which will serve is an event area, can accommodate around 200 people.

Go said they are targeting to complete the renovation by end of 2021. He added that they have allocated P300 million for the initial phase of renovation of the 225room hotel.

The renovation is also in preparation for the upcoming MICE Con 2020 scheduled next year in Davao City.

Coral Bay Nickel Corporation, which operates a nickel processing plant in Rio Tuba, Bataraza, Palawan, emerged with the Best Practices award for the Philippines in the Metallic Mineral Processing category.

Rio Tuba Nickel Mining Corp, also in Bataraza, was named runner-up in the Metallic Mineral Mining category, while Agata Mining Ventures was also named runner-up in the Metallic Mineral Distribution category.

In the non-metallic category, LaFarge Holcim bagged runner-up awards in both the mining and processing categories.

The AMA is an initiative of the Asean mining ministers to recognize best practices in sustainable mineral mining, processing, and

distribution among its various member countries.

The Awards, launched in 2017 in Myanmar, saw the Philippines garnering two of the three awards handed out, with Rio Tuba Nickel recognized for best mining practices and Oceana Gold Philippines, Inc. for the best plant. Since then, the AMA has been expanded to six categories with non-metallic minerals separate from metallic minerals.

THERE is no doubt that one of the most memorable aspects of travelling is food as it makes the experience more authentic.

Ampatuans, lawyer Philip Sigfrid Fortun asked Judge Solis-Reyes to recuse herself, �iling six motions and an additional related motion. By 2013, the defense would �ile nine such motions, lengthening the time of trial.

FURTHER DELAY In 2014, the Fortun Narvaza & Salazar Law Of�ice, which represented several members of the Ampatuan family, withdrew as counsel. The defense of Unsay was taken over by the Fortun & Santos Law Of�ice where Sigfrid’s brother, Raymond, is a name partner. Other clients were taken over by other law �irms.

The court gave each motion the time allowed by the Rules of Court.

In August 2019, as defense lawyers were due to submit a memorandum summing up their arguments, lawyer Paul Laguatan, then counsel of Datu Unsay, asked for the re-opening of the trial; which the court promptly denied.

Furthermore, eight contempt and two disbarment cases were also �iled against the private prosecutor, lawyer Nena Santos.

The numerous motions for reconsideration, the time given for the defendants to �ind new lawyers, as well as “delaying tactics of the defense”, tied up the case during the last three years.

“Maraming panahon na ginugol para i-resolve ’yung mga pending motions ng defense na napakarami,” said Nena Santos.

She said the Ampatuans also �iled cases against the witnesses and lawyers for the prosecution.

SUPREME COURT INTERVENES FOR SPEED To speed up the trial, Chief Justice Ma. Lourdes Sereno issued new guidelines in December 2013, which named an “Assisting Judge” to Branch 221 who could take over some of the work in the trial. This allowed the submission of judicial af�idavits instead of requiring all witnesses to testify before the court.

Both the Presiding Judge (Solis-Reyes) and the Assisting Judge could resolve pending motions before them.

Although some of the motions had been appealed to higher courts, the measures “helped a lot,” Santos said, adding that the Supreme Court also assigned several lawyers to assist Solis-Reyes to resolve the numerous motions �iled by the defense.

COMPLAINANTS, WITNESSES The outcome of the trial turns on the testimonies of the witnesses presented by the prosecution and the defense.

The prosecution pre-

sented 134 people, with its key witnesses narrating how they heard the Ampatuans plan the killing as early as July 2009, and as late as November 19, 2009, or just four days before the massacre; how they saw Datu Unsay, at that time the mayor of Ampatuan town, kill the victims and later, heard him give orders to “hurry up” in burying of the bodies.

This number does not include the 58 private complainants who testi�ied on the extent of damage and suffering caused by the Massacre to their families.

The defense, on the other hand, presented several of Datu Unsay’s municipal of�icials, who testi�ied that he was in a meeting at the town hall at the time of the massacre; two former prosecution witnesses who later recanted; and Datu Unsay himself.

KEY WITNESSES: PROSECUTION In its memorandum, the prosecution underscored the testimony of several witnesses: SUKARNO BADAL, who said he saw the Ampatuans plan the killing and Datu Unsay take part in the massacre.

Badal was a trusted man of the Ampatuans. He said he was present in two meetings. In July 2009, he witnessed the Ampatuans as they discussed the plan to kill Mangudadatu. Another meeting in November 2009 discussed more details.

On Nov. 23, 2009, he testi�ied that he saw the victims killed by the accused, among them Andal Ampatuan Jr. Badal was among those initially charged in the information, but was dropped when he turned state witness.

ESMAEL CANAPIA, who said he saw Datu Unsay at the site of the massacre telling someone to hurry up in burying the bodies.

Canapia lived in Masalay village, the place of the massacre. On the day of the killing, he said he saw Datu Unsay with militia men, police of�icers, and some of the other accused in Masalay, telling someone to hurry up in burying the bodies. Canapia was among those initially charged in the information, and then turned state witness.

RASUL SANGKI, who said Datu Unsay told him of the plan to ambush the Mangudadatu convoy on its way to the Commission on Elections (Comelec), and that he was with Datu Unsay and the other accused when the victims were killed.

town. Sangki said Datu Unsay told him of the plan to ambush the Mangudadatu convoy. He was with Datu Unsay when the latter talked to Andal Sr., after which Datu Unsay ordered the group to go on to Masalay.

Sangki said he saw how Datu Unsay and the other accused kill the victims, after which Datu Unsay told him to go to Malating and tell people to say that they saw and heard nothing.

KEY WITNESSES: DEFENSE The defense presented two former prosecution witnesses who had recanted their testimonies, and who told the court that they were forced to sign their earlier af�idavits.

As a witness for the prosecution, LAGUDIN ALFONSO had said earlier that he was near the checkpoint at Crossing Masalay in the morning of November 23, 2009.

For the defense, he said he was instead with Thonti Lawani and Akmad Abubakar, another prosecution witness, in the house of Rasul Sangki.

THONTI LAWANI had earlier said he saw the convoy of Datu Unsay going toward the mountainous portion of Masalay, and later heard gunshots coming from the direction where the convoy was headed. Recanting this testimony, he then testi�ied for the defense, saying that he was not at Crossing Masalay on November 23, 2009.

FABIAN S. FABIAN, a Philippine Airlines (PAL) supervisor, testi�ied that based on their records, Datu Unsay took a �light from Los Angeles, USA, on November 16, 2009, arriving in Manila in the morning of November 18, 2009.

This was corroborated by the testimony of Immigration Of�icer Feliana Ong, who told the court that based on immigration records, Datu Unsay left the Philippines on Nov. 9, 2009, and returned on Nov. 18, 2009. This disputed the claim of Lakmodin Saliao, who said that Datu Unsay attended a meeting on Nov. 17, 2009.

Datu Unsay himself took the witness stand to deny that he was at the massacre site in the morning of the killing, saying that it was impossible for him to be with Mohamad Sangki and Rasul Sangki as the two hated him. Rasul had testi�ied that he saw Datu Unsay and his men kill the 58 victims, while Mohamad told the court that Datu Unsay forcibly loaded two women on a vehicle and ordered his men to con�iscate the bags and wallets of the victims, and then left Sitio Malating with Rasul Sangki.

former councilor of Ampatuan town, said Datu Unsay attended the meeting from 8 a.m. to 12:30 p.m., as can be seen on the Minutes of the Meeting, which was signed by the attendees. Alamada is one of the co-accused in the case.

THEORY OF THE PROSECUTION The prosecution said the Ampatuans executed the massacre; planning the murder as early as July, when Toto Mangudadatu made it clear that he was running for governor to contest the political hold of the Ampatuans over Maguindanao province.

In the memorandum it submitted at the end of the trial, the prosecution recalled the 1995 killing of Akas Paglala and his brother, Omar, as Akas was on his way to �ile his certificate of candidacy for mayor of Maganoy town. The suspect was Zaldy Ampatuan, the son of Andal Sr., at that time the mayor of Maganoy. The Paglalas did not �ile charges, and the Ampatuans went on to consolidate their hold over Maguindanao.

The prosecution presented witnesses who told the court that they heard the plan to kill Mangudadatu as it was being discussed months and days before the killing; saw Datu Unsay, on his way to Sitio Masalay, where the massacre happened; and saw him shoot at the victims himself and give instructions to bury the bodies and later, saw the backhoe burying the victims.

THEORY OF THE DEFENSE The lawyers of Andal Jr., on the other hand, said not enough evidence had been presented to prove that it was Datu Unsay who killed the 58 victims. A memorandum �iled by Unsay’s lawyer claimed that neither the bullets nor the guns used in the massacre were presented in court, nor were “trace evidence” such as �ingerprints, footprints, gunshot residue or DNA, that would have corroborated the testimonies of the prosecution witnesses. The defense added that while the prosecution presented witnesses who saw the killing, these were “incentivized witnesses” who testi�ied in exchange for money or favors, or were relatives of the Mangudadatus. “[A] thorough review of the… evidence… would not let any man rest easy on the moral certainty that the accused committed the acts against him…,” the defense said in its memorandum, insisting that there was no evidence that would prove Datu Unsay killed the victims, nor that

there was a conspiracy to do so.

The defense insisted that Datu Unsay arrived from the United States on Nov. 18, 2009; that on Nov. 23, the day of the massacre, he was at the Municipal Hall of Datu Unsay Municipality where he presided over a meeting with local of�icials which ended at 12:30 p.m., and that he voluntarily presented himself to the authorities on Nov. 26, 2009, to explain his side.

Like the prosecution, the defense argued that the case was politically-motivated: Mangudadatu was a political opponent of the Ampatuans, and some of the witnesses — like the Sangkis — were not only related to the Mangudadatus, they were also members of political clans in Mindanao. Rasul Sangki, one of the key witnesses of the prosecution, was vice mayor of Ampatuan town at the time of the massacre; by 2019 he was Ampatuan town mayor.

PRESUMPTION OF INNOCENCE The constitutional presumption of innocence sets a high bar for the prosecution. The burden is on the accuser to prove the charges, not for the accused to prove his innocence. It is this bar that the defense invoked: the prosecution, it said, has not presented enough evidence to prove that Datu Unsay committed the crime beyond reasonable doubt.

The prosecution, on the other hand, says that the eyewitnesses they presented — who told the court they heard the massacre planned, saw Datu Unsay shoot the victims; and the doctors who testi�ied that the victims died of gunshot wounds, are enough to convict.

CASE RECORDS Judge Jocelyn Solis-Reyes of the Quezon City Regional Trial Court Branch 221 submitted the case for decision on August 22, 2019 and was thus required by a Supreme Court circular to issue her verdict 90 days later in November. But citing the “voluminous records” of the case, she requested an extension of 30 days which the Supreme Court has granted. The promulgation of decision is expected on or before December 20.

The documents of the court case include: 165 volumes of records on the trial; 65 records of stenographic notes; and Eight records of the prosecution’s documentary evidence.

The court received the testimony of 357 witnesses.

Murder charges were �iled against 197 persons.

The accused members of Ampatuan family include the patriarch of the clan, Andal Ampatuan Sr., who was accused of planning the massacre; and Andal Ampatuan Jr., or Datu Unsay, who is accused of leading the killing himself.

Andal Sr., then 74, died in July, 2015 while in detention.

Of those charged, 80 are still at large as all efforts to arrest them had failed.

Ninety-seven are detained in Camp Bagong Diwa in Taguig, including Andal Jr. Eleven of those charged were released on bail.

Eight have either been released or had the case against them dismissed.

GLOBAL ADVOCACY FOR JUSTICE The press community has worked hard to keep the case alive on the news agenda.

Various media groups have joined their advocacies, administering funds for humanitarian assistance for families of the victims and scholarships for the orphans.

The UN-declared International Day to End Impunity (IDEI) for Crimes Against Journalists heightened activities each November since 2009, from candle-lighting to marches to memorial ceremonies in Masalay.

But the crime, the trial, and its outcome are the concern, not only of journalists and the families of the victims. It should be understood by every Filipino as an example of the use of violence as an instrument of politics. It is the same political arena that generates much of the news reported by journalists to the public.

Even without the 32 media victims in Ampatuan, the killing of journalists has long tainted the record of attacks and threats on press freedom in the Philippines. There are too many stories stained by blood and too many perpetrators of such violence are not even taken to courts.

It is therefore important to hear the decision on December 19.

The lessons of the trial belong to the people so these can empower them to end impunity, to change the culture of politics and course of our national history.

For the victims, the decision should allow them �inally to rest in peace, grant their loved ones a measure of justice, and with it, comfort and consolation after their long wait.
