Año made the clarification during an interview amid fears by human rights advocates that the law might be used to clamp down on critics of the government.

A former military chief of staff, Año said the target of the law would be the Communist Party of the Philippines (CPP) and its armed wing, the New People's Army (NPA), as well as groups "created" by the CPP. "Yun lang ang gusto natin, 'yung CPP. 'Yung ibang opposition, 'yung ibang legitimate groups, wala silang dapat ipag-alala doon.

early two months ago, eight Indigenous People (IP) leaders took a stand to impart the truth about the tribal people’s real situation in their areas to the United Nations Commission on Human Rights (UNCHR).

The Ambassadors of Truth, composed to eight IP leaders, flew to different cities of the United States of America (USA) in June to share the 17 atrocities of the Communist Terrorist Group-New People’s Army-National Democratic Front of the Philippines (CPP-NPA-NDF) against the Indigenous Cultural Communities.

On Thursday, August 15, the Ambassadors of Truth returned home in Davao City and shared to the media their struggle of trying to cleanse the false information injected by the CPPNPA-NDF to the UN. According to a member of Ambassadors of Truth

during a press conference held in Francisco Bangoy International Airport, the UNCHR was doubtful of their complaints since the opposite organization have established themselves in the commission.

“Medyo bago sa ilaha ang issue kay ang kanunay nila makita o madungog nila kay ang mga taga NDF. Gipaningkamotan nato na masabtan nila ang atoang agenda, unsa ang nahitabo sa mga IPs sa Mindanao,” said Datu Malapandaw Nestor Apas, chief of Langilan Manobo tribe of Davao del Norte.

After the UN received the complaint, Apas said the commission opted to study the issue first before the giving an assurance to hear the request of the IPs to be included in as a member of the committee.

PH losing banana experts TDF rates fall

T

he Philippines is losing its banana experts to its Southeast Asian neighbors after being pirated by other players in the region who have sought to become a significant force in the global banana trade.

Speaking during “Wednesdays’ at Habi Kape,” Pilipino Banana Growers and Exporters Association (PBGEA) executive director Stephen Antig expressed concern that the country might slowly run out of experts to work on its own banana farms as its Southeast Asian competitors have also started developing their banana industry to the detriment of local growers.

“What is alarming is that they have been pirating a lot of our technical people, offering them three times, four times more than what they’re

getting. It is possible there is brain drain in the Philippine banana industry because, as they say, money is still the best motivating factor,” he said.

Antig said it is worrisome if the brain drain among Filipino experts persists as the success of the Philippine banana industry is largely due to its highly skilled banana experts.

“We are really worried about that. We cannot afford to lose our good technical people who are very experienced in terms of banana growing. Humility aside, I believe we grow

BSP, labor group slam P30 ATM fee increase

A

utomated teller machines (ATM) fees are not going to increase to P30 per transaction as it would be “absurd,” an “outlier,” the Bangko Sentral ng Pilipinas said Wednesday, while a labor group branded it as “highway robbery.”

Increasing ATM fees to P30 per transaction would mean a 100% to nearly 173% increase in the current ATM charges ranging from P11 to P15 per transaction. “‘Yung sinasabi naman,

absurd naman na ‘yung P30,” BSP Deputy Governor Chuchi Fonacier said in an interview with reporters.

The central bank is currently “scrutinizing” banks’ applications to adjust ATM fees higher, after the BSP lifted a moratorium last July.

Earlier this week, Makati City Representative Luis Campos Jr. called for a probe on what he claimed was the "looming increases" in ATM fees following the lifting of the moratorium.

he latest cut in the Bangko Sentral ng Pilipinas’ (BSP) key rates resulted in the same outcome for the term deposit facility (TDF) Wednesday.

Rate of the eight-day facility, which is a day longer given the holiday on August 21, declined to 4.4389 percent from 4.5844 percent during the auction last August 7.

The central bank offered it for PHP40 billion, but banks submitted PHP51.252 billion worth of tenders. The auction committee made a full award.

The facility’s bid coverage ratio, however, rose to 1.2813 from 1.2396 last week.

Average rate of the 14-day facility slipped to 4.4905 percent from

4.6176 percent last week.

Tenders reached PHP40.747 billion, higher than the PHP30-billion offer, which was fully awarded.

Bid coverage ratio also went down after it ended the day at 1.3502 from 1.4809 in the previous week’s auction.

Also, rate of the 28-day facility declined to 4.4961 percent from 4.6033 percent in the previous auction.

It was offered for PHP30 billion but tenders reached PHP45.142 billion. The auction committee awarded PHP30 billion.

Bid coverage ratio went down to 1.5047 from last week’s 2.0900.

Enjoying Kadayawan As Davao City marks the 34th Kadayawan Festival with the main weekend celebration, everyone’s safety and security remains the optimum priority. The Kadayawan is not just a celebration of bountiful harvest, it is significantly a celebration of Davao’s resiliency amidst the constant threats to the peace and order of the city as well as its safety.

To best enjoy the festivities it is important to heed the precautionary measures given by the city government and the law enforcement agencies. The measures to be imposed may be harsh given that revelers of the Kadayawan are in celebratory mode--a stage where there is comparatively less regard for safety and security than plainly having fun. Hence, it is helpful if everyone reviews the friendly reminders and make sure they comply with it. Simple reminders include not wearing jackets as law enforcers will be looking out for

possible suicide bombers in the same terroristic manner as the Jolo, Sulu blast; not carrying backpacks as these are common accessories of concealment by terrorists; submitting cooperatively to security checks in several areas in the city as well as the entry and exit points; and not tagging along young children and infants as well as the elderly.

The success of the Kadayawan will rely heavily on the cooperation of Dabawenyos and the Kadayawan visitors. Everyone’s vigilance will make the job easier for law enforcers. If there’s anything suspicious, the best thing to do is to report the same to the nearest law enforcement personnel. In this day and age where the internet has become an ally in propagating vigilance and expanding awareness through social media, it helps to be alert and conscious of what is going on around the place.

THE GOLDEN RULE The golden rule is one of the primary tenets that simplify the way we should treat other human beings. It is named as the golden rule as every major religion or ideology preaches the same rule which means that this is one of the infallible human nature – the ethic of reciprocity.

The golden rule is grammatically expressed in three forms: directive, negative and emphatic. The first recorded and known usage of the term golden rule was by Charles Gibbons and Thomas Jackson in 1604 but the statements that express the golden rule date back to ancient history.

The golden rule is also known as the golden law.

The Islamic version is that of an emphatic statement and is from the saying of Prophet Muhammad, “None of you truly believes until he loves for his brother that which he loves for himself.” Narrated by Imam Al Bukhari and Imam Muslim. This saying of Prophet Muhammad could be a source of many different teachings.

TRUE SIGN OF BELIEF Loving for your brother that which you love for yourself is a sign of true belief. The Muslim who does not love for his brother that which he loves for himself does not be-

come a disbeliever through it but this only shows the incompleteness of his faith of belief.

Prophet Muhammad said, “The believers, in their mutual mercy, love, and compassion, are like a (single) body; if one part of it feels pain, the rest of the body will join it in staying awake and suffering fever.” Narrated by Imam Al Bukhari and Imam Muslim.

However, being simply able to love your brothers that which you love for yourself does not make one perfect in his faith. There are other obligations in Islam such as acts of worship and the observance of other fundamental belief that will render a Muslim a disbeliever by violating it.

ESTABLISHMENT OF REAL BROTHERHOOD IN FAITH When Prophet Muhammad and his companions migrated from Mecca to Madinah, Prophet Muhammad established different ways in which the Ansar or the people of Madinah could help the Mujahirun or the immigrants from Mecca. Since the Muhajirun left Mecca due to the persecutions that they have gone through, most of them did not bring enough provisions for them to stay, eat and live in Madinah.

Prophet Muhammad established a system of broth-

erhood where one Ansar is bound to a Muhajirun from Makkah which the Ansar agreed to immediately by sharing their homes, food and even other material riches with them. This system has been expedited by the firm belief of the early Muslims in the golden rule that they should wish for their brothers that which they wish for themselves.

A very inspiring example of it was a story related by Abdurrahman bin Awf. He said, “When we came to Madinah, the Messenger of Allah established bonds of brotherhood between me and Sa’d ibn al-Rabee’. Sa’d ibn al-Rabee’ said: “I am the wealthiest of the Anaar, so I will give you half my wealth, and see which of my wives you would prefer, I will divorce her for you, and when she becomes permissible you can marry her.”

‘Abdurrahman said to him, “I do not need that. Is there a marketplace where people trade?” He said, “The marketplace of Qaynuqa’.” So the next day ‘Abdurrahman went there and took some cottage cheese and ghee, and he did that the next day. It was not long before Abdurrahman came with traces of yellow perfume on him. The Messenger of Allah said, “Have you gotten mar-

ried?” He said, “Yes?” He said, “To whom?” He said, “A woman from among the Ansar.”

He said, “How much was the dowry?” He said, “A gold piece equal in weight to a date stone (or a date stone of gold).” The Prophet said to him, “Give a wedding feast even if with one sheep.” Narrated by Imam Al Bukhari.

AVOIDANCE OF GREED AND ENVY Greed and envy and probably two of the worst motives for the commitment of crimes against other persons such as backbiting, theft, robbery, extortion, and others.

By understanding the golden rule fully, the spirit of brotherhood is established better in their hearts and minds, Muslims are also closing the doors through which greed and envy could enter one’s heart by committing one’s self to altruistic motives in dealing with others.

Believers are even compelled to give charity out of good things and not that which is considered garbage in most situations. Allah said, “You shall not attain piety until you spend from that which you love.” Quran 3:92.

He also said, “O you who believe! Spend of the good things which you have legally earned, and of that which We

have produced from the earth for you, and do not aim at that which is bad to spend from it, (though) you would not accept it save if you close your eyes and tolerate therein” Quran 2:267 DIFFERENT TYPES OF LOVE Different types of love could exist between humans and it could be divided into two, natural love and religious love. Natural love is that which exists between the husband and the wife, their children, and family members. Natural love could also be found in people in their friendships, and other relationships with each other that is based on humanitarian love that is based on pity and mercy. The other type of love is that which is upheld for religious reasons such as the love that exists between the believers.

This saying of Prophet Muhammad emphasizes the level of love that should persist between the believers but it does not mean that Muslims are allowed to be unjust towards Non-Muslims. Muslims are still expected to be kind and helpful to the Non-Muslims especially on things that will promote peace and common humanitarian goals that will not lead the Muslim into sinning or violating Allah’s prohibitions.

Some street-smart gents do

It is the way of the coward, truthfully speaking.

It is the “great escape.”

In the corporate world, you can’t do this without dire penalties.

But in government - public servants as they are – employees and officials alike commit the sin with regularity and with impunity.

Our bureaucracy is replete with sad and gruesome tales of corruption, pilferage, theft and plunder.

I haven’t heard of any big fish – real big one (as in BIG) – who has been found guilty and sent to jail. No need to name them but I’m sure the Filipino people remember.

If you have a good grasp of Philippine history and government, even those who purportedly fought for the country’s independence and those who continue to pursue nationalistic ideals, they sometimes sought the easy way out.

Why? Because, either it was convenient to do so at that point in time or they were “persuaded.”

The “easy way out” mentality is the bane of good governance and its backlash reflects on the socio-economic status of its people.

Take a throwback look at all the regimes prior to this incumbency. When you compare the kind of executive leadership each exemplified, one might be able to discover that each regime - each administration - had suffered one weakness common to all when faced with a difficult dilemma: they choose the easy way out.

Confucius said something relevant: “The superior man understands what is right; the inferior man understands what will sell.”

Would you agree that there is really no easy way out?

That everything that comes before us tests our resolve and that as creatures with intellect, we always find solutions howev-

er difficult these might be?

The “easy way out” frame of mind is a temporary escape from reality, much like showbusiness.

But you never really get out of that trouble you are in because it keeps creeping up since it has not been completely resolved.

Thus, we often resort to fault-finding. “That guy is to blame because he delegated his responsibilities to inefficient people and tolerated his men to do their thing,” a collective reasoning of most Filipinos who did not realize that they have the sovereign mandate to throw out incompetent leaders.

Alas, I find Henry Ford’s quote very apt: “Thinking is the hardest work there is, which is probably the reason so few engage in it.”

Therefore, choosing the way out becomes the philosophy of cowards, of the inane and the idiots, of non-thinking creatures who happen to be called “human beings.”

This is not debatable. Or is it?

It is a reasonable but conclusive finding that when people – our leaders in particular – opt to take the easy way out, they do not deserve our respect, our support and our votes.

In a Third World democracy like ours that is struggling to beat extreme poverty, our people, by now, should readily spot who among our national leaders are emerging to be capable and competent to lead the country.

We are being attacked from all sides. Poverty is our principal and number one enemy. Disunity and polarization marked by intense partisanship is another.

Estandarte AN ORDINANCE REGULATING THE OPERATION OF VIDEO-KARAOKE BARS, BEERHOUSES, NIGHT SPOTS, MUSIC BARS, EATERIES AND RESTAURANTS WITH KARAOKES AND VIDEOKES, OTHER SIMILAR NIGHTSPOT AND ESTABLISHMENTS IN THE MUNICIPALITY OF COMPOSTELA, COMPOSTELA VALLEY AND PROVIDING PENALTIES FOR VIOLATION THEREOF WHEREAS, Section 16 of the Local Government Code of 1991, states that “every Local Government Unit shall exercise the powers expressly granted, those necessary implied therefrom, as well as powers necessary, appropriate, or incidental for its efficient and effective governance, and those which are essential to the promotion of the general welfare”; WHEREAS, the influx of establishments offering various kinds of intoxicating substance and allowing the operation of video-karaoke machines and music bars caused numerous complaints among the residents in the Municipality of Compostela regarding the excessive and unnecessary nuisance especially during unholy hours that brought discomfort, public condemnation as they are averse to public health, convenience and safety of its inhabitants; WHEREAS, this reverberates the clamor to address the problem of frequent and amplified noise in the Municipality of Compostela, Compostela Valley regulating the operation of videokaraoke bars, Beerhouses, Night Spots, Music Bars, Eateries and Restaurants with Karaokes and Videokes and other similar nightspots and establishments with the end view of protecting the welfare of the general public.

NOW THEREFORE: Be it ordained by the Sangguniang Bayan of Compostela, Compostela Valley in session assembled that; Section 1. TITLE. This ordinance shall be known as “REGULATING THE OPERATION OF VIDEO-KARAOKE BARS, BEERHOUSES, NIGHT SPOTS, MUSIC BARS, EATERIES AND RESTAURANTS WITH KARAOKES AND VIDEOKES, OTHER SIMILAR NIGHTSPOT AND ESTABLISHMENT IN THE MUNICIPALITY OF COMPOSTELA, COMPOSTELA VALLEY AND PROVIDING PENALTIES FOR VIOLATION THEREOF.” Section 2. SCOPE AND COVERAGE. This ordinance shall cover all business establishments operating as videoke and karaoke bars, beerhouses, night spots, music bars, eateries and restaurants with videokes and karaokes and other similar establishments in the Municipality of Compostela, Compostela Valley.

Section 3. DEFINITION OF TERMS. As used in this ordinance, the following terms are hereby defined as follows: a. ESTABLISHMENTS – a place of business with its possessions and staffs/personnel; b. VIDEO AND KARAOKE BARS – a place where the audio-visual systems are set for musical accompaniment to a song performed by following the words displayed in a video screen. It is also a place where foods, beverages and other intoxicating substances are being offered to customers; c. BEER HOUSES – a place where beer is mainly served, although other forms of intoxicating substance, wine and liquor are also available for customers; d. NIGHT SPOTS – those establishments that are open late at night and provide music entertainers, foods, drinks, liquor, entertainment and music for dancing; e. MUSIC BARS – a place where entertainers like singers with back up bands playing with instruments, dancers are performing to costumers while serving alcoholic drinks, wine, and liquors and other form of intoxicating substance; f. ENTERTAINERS – include group of band singers with instruments, singers and guest relations officers (GRO) of videoke and karaoke bars, beerhouses, eateries and restaurants with videoke and karaoke bars, similar nightspots and establishments who entertain patrons or customers by sitting and conversing, dancing, singing, eating or drinking with them; g. EGRESS – an arrangement of facilities to assure a safe means of exit from the establishment; and h. MUNICIPAL MONITORING COMMITTEE - The Committee duly constituted to monitor the implementation of this Ordinance.

Section 4 – PROHIBITIONS a. No person, natural or juridical, shall operate videoke and karaoke bars, beerhouses, music bars, eateries and restaurants with videokes and karaokes similar night spots and establishments for commercial purposes without first securing a Sanitary Permit issued by the Municipal Health Officer, Mayor’s Permit, Barangay Clearance and paying for other related corresponding fees provided under Municipal Ordinance No. 2014-398 otherwise known as the 2015 Revised Omnibus Revenue Code or any rules and laws that may hereinafter promulgated by the Sangguniang Bayan of Compostela. b. For purposes of this Ordinance, no videoke and karaoke bars, beer houses, music bars, eateries and restaurants with videoke and karaoke, similar night spots and establishments shall be established within one hundred (100) meters radius from any educational, religious or public institutions such as schools, colleges, universities, hospitals or clinics, churches or chapels. c. The following requirement shall be strictly observed in the establishments: ► Operation of karaoke and videoke music, beer houses, music bars, similar night spots and establishments shall be allowed from 7:00 AM to 10:00 PM ONLY, however, establishments with TOTAL ENCLOSURE of the premises to prevent the sound to escape may operate beyond 10:00 PM UP TO 2:00 AM. The establishments shall provide and post in conspicuous places the opening and the closing time.

► Minors as customers or workers shall not be admitted. The operator/owner shall cause the posting of placards in conspicuous places indicating the words “MINORS BELOW 18 YEARS OLD ARE NOT ALLOWED.” ► Customers are prohibited to carry firearms, licensed or unlicensed, deadly weapons and explosives except those authorized by law. The posting of placards indicating “ALL FORMS OF DEADLY WEAPONS ARE NOT ALLOWED INSIDE” shall be strictly complied. ► Adequate spaces and lighting, proper ventilation shall be maintained at all times under satisfactory sanitary conditions. ► Adequate parking spaces for vehicles, dressing rooms for ladies, clean kitchen, regularly sanitized and separate lavatories for male and female, emergency lights, medical kits and adequate sound proofing shall be provided by the owner/ operator. ► The establishment shall be properly enclosed or fenced, provided with a single ingress or egress and shall have no direct or indirect communications whatsoever with any dwelling place, house or building except the single ingress or egress. ► Ban prostitution and showing of lewd shows. ► Ban the use and selling of prohibited drugs.

Section 5. ADMINISTRATIVE PROVISIONS. The following administrative provisions of this ordinance shall be observed for its effective implementation: a. Any person/s who are interested to establish business covered by this ordinance shall only be allowed after complying all requirements provide by Municipal Ordinance No. 2014-398 also known as the 2015 Revised Omnibus Revenue Code of the Municipality of Compostela, Compostela Valley. b. The business as herein indicated shall be established only in an area/zone declared as commercial area, pursuant to the provisions of the Comprehensive Zoning Ordinance of the Municipality of Compostela, Compostela Valley. c. Personnel such as waitress/waiter, food handlers, servers, guest relation workers, etc. shall undergo quarterly examinations and shall secure Medical Certificates duly signed by the Municipal Health Officer. Payments of Medical Examination and Certificates shall be in accordance with the provisions provided in the 2015 Revised Omnibus Revenue Code of the Municipality of Compostela. Failure of the above-cited personnel shall not be allowed to work and the manager or operator/owners are liable to answer any penalties under this Ordinance. All personnel of such business are strictly required to secure their working permit and birth certificates. Minors found working in the establishments covered by this Ordinance shall be immediately referred to the Municipal Social Welfare and Development Office, for appropriate legal actions against the owner or operator. d. Structural design of the building shall be enclosed, to prevent unnecessary noise/nuisance during night time and other materials that can minimize noise/ nuisance shall be used. The operation of business shall be confined only inside the building. In case the owner/operator shall construct a building for business covered by this ordinance, he/she shall first submit to the Office of the Municipal Engineer a copy of architectural design or its blue print and shall secure building permit, electrical permit and zoning clearance. e. Operators/owners shall by all means cooperate in upholding peace and order and shall report to the Compostela Police Station whenever circumstances so warrant. f. All operators and owners are required to comply all rules and regulations under any existing national laws, Municipal Ordinances or any Ordinances that are hereinafter be promulgated by the Sangguniang Bayan of Compostela.

Section 6. MUNICIPAL MONITORING COMMITTEE. For the purpose of this ordinance, a Municipal Monitoring Committee is hereby constituted and authorized to conduct inspection and investigation whenever there are complaints or petitions from concerned parties. It shall be the duty and functions of the Committee to endorse results and recommendations to the Local Chief Executive, copy furnished the Sangguniang Bayan for appropriate actions, as follows: Chief of Police

Chairman Municipal Treasurer or his/her representatives Member Municipal Engineer or his/her representatives Member MSWDO or his/her representatives Member MHO or the Sanitary Inspector Member MPDO or his/her representative Member Joint Inspection Team Member Secretary to the Sangguniang Bayan Member DILG Officer Member Representative from NGO Member Section 7. PENALTIES. Owners/operators, including personnel working of the business establishments found guilty of violating any provisions of this Ordinance shall be issued a Notice of Violation and Citation Ticket are subject to the following penalties; a. First Offense

– a fine of Php 1,000.00 b. Second Offense – a fine of Php 2,000.00 c. Third Offense & Subsequent – a fine of Php 2,500.00 COMPROMISE PENALTY. If the violator voluntarily admits the violation hereof without need for a judicial proceeding, he/she shall be penalized as compromise penalty, to wit; a) First Offense.........................................A fine of P500.00; b) Second Offense……………………………..A fine of P1,000.00; c) Third and Subsequent Offense………….A fine of P1,500.00 and or shall be a ground for revocation of their existing Business Permit or whichever is applicable.

Section 8. EXEMPTION. That one ( 1 ) week before Christmas Day (December 25), New Year’s Day and the day of the Town Fiesta video-karaoke machine operator/s may operate until 12:00 o’clock midnight.

During birthday celebration, wedding day, baptismal day and barangay fiesta day, the use of video-karaoke machine/s may also be allowed to operate until 12:00 o’clock midnight at their own residence or private place where the occasion will be held.

Section 8. SEPARABILITY CLAUSE. If for any reason or reasons, any part or provision of this Ordinance is declared invalid, null and void, the other parts or provisions hereof which are not effected thereby shall continue to be in full force and effect.

Section 9. TRANSITORY PERIOD. All existing establishments prior to the enactment of this Ordinance not in accordance with Section 4(b) and Section 5(b) shall be given three (3) months to relocate their business.

Section 10. REPEALING CLAUSE. All existing ordinance, rules and regulations or parts thereof in conflict with or inconsistent with any provisions of this ordinance are hereby repealed, amended or modified accordingly.

Section 11. EFFECTIVITY. This Ordinance shall take effect upon approval.

of its support to to the construction industry in Davao and Mindanao, Holcim is eyeing to partner with the Davao Constructors Association Center Inc (DCACI).

“We supported them with all the things that are available with Holcim in terms of technical knowhow, innovations, new products, and in fact as we said last time we will put up the best laboratory in Mindanao in Davao plant,” Sumalinog said.

Apart from the techni-

cal laboratory in Mindanao, Holcim also rolled out a mobile lab in Mindanao.

“These vehicles will go specifically to the projects and support the contractors to use the products with right applications and we continue to develop new products,” he said.

To ensure there is enough reserve of limestones, which is also among the factors being considered for expansions, they are now exploring and developing an area in Sarangani.

“In terms of low term direction, we still have enough.We keep on expanding and we have enough reserve maybe not in the adjacent area of the plant and we have a lot of areas. We have started right now exploring and developing and one of it is Sarangani,” he said.

In terms of demand, Sumalinog said with the development in some major cities right now such as Zamboanga, Dipolog, Butuan and the secondary cities in Mindanao,

there is a possibility that Mindanao match Visayas' market demand. Eventually, Sumalinog said Holcim anticipates a 60-40 demand spread in Luzon and VisMin as market.

He also said looking at the demand spread of the entire country, normally 65% of the demand is in Luzon and 35% in Visayas and Mindanao.

“For so long, Visayas is always bigger than the demand of Mindanao. But for the last three years, we are now bigger than Vi-

sayas,” he said.

According to him, Mindanao consumption has now becoming bigger than Visayas except for this year where Holcim slowed down in terms of spending.

“Somehow the demand sharing between Visayas and Mindanao we are now more or less the same or maybe one million higher per month or 12 million bags more for the annual consumption of Visayas versus Mindanao,” he said.

Bangcasan AN ORDINANCE REGULATING THE OWNERSHIP, CARE AND CUSTODY OF ANIMALS CLASSIFIED AS KENNELS (DOGS) AND FELINES (CATS), AND PRESCRIBING RULES FOR THE CONFISCATION, IMPOUNDING AND DISPOSITION OF POTENTIALLY VICIOUS STRAY ANIMALS, AND IMPOSING PENALTIES FOR VIOLATIONS THEREOF, AND FOR OTHER PURPOSES. Be it ordained by the Sangguniang Bayan of Compostela, Compostela Valley in session assembled that; SECTION 1. REGISTRATION AND OWNERSHIP – (a) Local residents, corporate entities or particular member/s of the family residing in the Municipality of Compostela, Compostela Valley who are pet-owners, custodian, keepers, and possessors of animals categorically related and/or scientifically classified to belong in the family of dogs (kennels) and cats (feline) within its territorial jurisdiction, shall register the said domesticated pets in the Municipal Agriculture Office to commence on the First Regular Working day of January on the Year 2019, and until or before the 31st day of January of each and every year. (b) Upon registration of animal possessions, a process of vaccination shall follow immediately. A pet tag shall be assigned to every domesticated pet that bears its respective serial number to serve as its corresponding identification tab for reference of their health and record of vaccination. (c) A fee of One Hundred Pesos (P100.00) shall be collected from the animal-keeper/ owner for every pet tag issued; and in case of lost, the same amount shall be paid for the replacement thereof. The owner or possessor of the registered animal shall ensure that the pet tag is worn by their respective pets at all times. (d) It shall be unlawful for any person or institution to keep an unregistered, unvaccinated and unsecured dog within their territorial domain. All dogs owned three (3) months old and above shall be registered and vaccinated. Dog registration and vaccination shall be undertaken by the Office of the Municipal Agriculturist in each manner that it will be feasible, convenient and safe to all concerned. After vaccination, owners will be provided with certificates of vaccination which will serve as proof of compliance. Owners should present their dog for registration and vaccination every two years. (e) Any person or institution is allowed only to own not more than four (4) registered and vaccinated dogs. However, a person or institution may be allowed to own more than four (4) dogs provided, they will pay an “excess dog tax” of Fifty Pesos (P50.00) for each excess dog and provided further, that they can provide and appropriate care and management to the animal. (f) The owner or possessor of a dog and/or cat who shall fail to register his dog and/or cat within the period prescribe in Section 1 hereof shall be penalized by a fine of Five Hundred Pesos (P500.00) payable within five (5) calendar days from notice thereof; failure to comply therewith shall subject the dog and/or cat to impounding and disposition in accordance with Sections 3 and 4, likewise the corresponding penalty in accordance with Section 8 hereof.

SECTION 2. LEASHING AND PROPER KEEPING OF ANIMALS. (a) Dogs, cats and other domesticated animals shall be kept and nurtured within the premises of the residence or establishment. In addition thereto, owners of potentially vicious dogs or wild cats shall signify the presence of such animal through visible printed words written and prominently displayed immediately outside the said premises. (b) Potentially vicious dogs or cats can be brought for a walk outside the premises of the residence or establishment, provided; that a protective muzzle shall cover its mouth and the said animal shall be held securely on a leash to be accompanied by the owner, keeper or possessor. The leash shall not exceed two (2) meters in length. (c) All dogs must be properly kept on leash within the premises of the owner. Dogs that are brought outside the owner’s premises shall at all times be leashed and muzzled appropriately; otherwise the dog will be considered a stray animal. (d) Any person or institution who owns or desire to own a dog shall be able to provide proper care and keeping to the animal. Any dog owner who can no longer provide appropriate care and management of the dog, that is to comply for its food, safety and shelter including its registration and vaccination, is encourage to donate, sell or dispose to another person who is capable and willing to comply the responsibilities of a dog owner. (e) An animal that attacks and/or bites a person within the territorial jurisdiction of the Barangay shall constitute conclusive presumption that the said animal is dangerous or vicious, and the same shall be summarily removed from the barangay and disposed in an appropriate manner by the Punong Barangay, barangay official or employee designated for the purpose and the Barangay is hereby rendered free and harmless from any liability therefor.

SECTION 3. IMPOUNDING, ADOPTION AND DISPOSAL OF STRAY ANIMALS. a) Dogs or cats found outside the premises of the owner are considered stray dogs/ animals. Stray dogs are immediately secured for impounding at the dog pound. (b) An impounding fee of P20.00 per day per animal shall be collected from the owner/s claiming the pet. c) Unregistered animal/s confined within three (3) days in the impounding area can be adopted by any person provided that he/she will pay for the registration and impounding fee of the animal and provided further, that the adoptive owner can provide proper and appropriate care and management to the animal. (d) Impounded stray animal/s which are not claimed after three (3) days shall be considered abandoned by its owners and shall subsequently be disposed by whichever legally and morally acceptable manner.

SECTION 6. BARANGAY SHARE ON PROCEEDS OF FEES AND FINES. The Barangay is hereby entitled to fifty percent (50%) share on all fees and fines collected within their jurisdiction.

SECTION 7. LIABILITY OF DOG-OWNER/S OR OF PERSON/S IN POSSESSION OF POTENTIALLY VICIOUS ANIMALS. – (a) Dog-owners or any person or entity in possession of dog/s shall be civilly liable for any injury or damage that the dog may cause to another person, after having been lost or escaped from leash, shelter or property yard. (b) Dog-owner/s shall not be held liable to any case whatsoever where the injury was caused by person/s in violation of domicile and/or illegal trespass to dwelling. (c) If there are dogs and/or animals which are proven to be nuisance or constitutes a danger to the community, the owner or possessor thereof shall be requested in writing by the Animal Control Officer through the Punong Barangay or any barangay official concerned to undertake appropriate remedial measures to prevent any harm or injury to any person or property or in the alternative, to remove such animal from the barangay area to the Municipal Animal Shelter, within ten (10) calendar days from receipt of said notice. Should the owner or possessor fail to comply therewith, such animal shall be subject to immediate impounding and disposition exclusive of the maximum imposable fine in accordance with Section 8 of this Ordinance. (d) The owner or the possessor of duly registered dogs or animal shall be responsible for the cleanliness and sanitation prescribed to proper handling of respective pets, and shall remove feces and other forms of waste matters emanating from their pets that tend to litter the streets corners of the barangay. Failure of the owner or possessor to remove such defecated waste matters shall constitute the corresponding penalty prescribed in Section 8 of this ordinance. (e) Commercial Breeding and Animal Training. Breeding of kennels (dogs) and felines (cats) for commercial purposes shall not be allowed within the territorial jurisdiction of the Municipality of Compostela; while training of dogs and/or other animals shall be confined within the premises of a residence or establishment. Failure to comply therewith shall subject the animals herein mentioned to impounding and disposition exclusive of the maximum imposable fine and penalty to the owner or possessor in accordance with Section 8 hereof.

Breeding of kennels and felines shall be considered commercial in nature if any audible or printed advertisement in connection therewith is undertaken.

SECTION 8. PENALTIES. Any person or entity found guilty of violating any of the provision of this Ordinance shall be penalized as follows, to wit: (a) First Offense - - - - - - - - - - - - - - - - - a fine of P1,000.00; (b) Second Offense - - - - - - - - - - - - - - - - a fine of P1,500.00; (c) Third & Subsequent Offense - - - - - - - a fine of P3,000.00 and/or an imprisonment of not less than five (5) days but not more than thirty (30) days upon the discretion of the court.

COMPROMISE PENALTY. If the person shall voluntarily admits the violation hereof without necessarily undergoing judicial proceedings, the Municipal Treasurer or his/her authorized representative shall be allowed to collect the following as compromise penalty: a.) First Offense - - - - - - - - - - - - - - - a fine of P 500.00; b.) Second Offense - - - - - - - - - - - - - a fine of P1,000.00; c.) Third & Subsequent Offense - - - - a fine of P2, 000.00 SECTION 9. SEPARABILITY CLAUSE. In the event that a provision of this Ordinance is found or decreed to be invalid or unconstitutional, all other provisions hereof not affected by such pronouncement or decree shall remain to be in full and effect.

SECTION 10. REPEALING CLAUSE. Ordinances, Resolutions, and other issuances inconsistent with this Ordinance are hereby repealed or modified accordingly.

SECTION 11. EFFECTIVITY. This Ordinance shall take effect ten (10) days following the completion of its full publication in any local newspaper of general circulation within the Municipality of Compostela, Compostela Valley.

The Animal Control Department under the Office of the Municipal Agriculturist shall be held responsible for investigating incidents of human contact with both wild and domestic animals, such as bites. The office may work with local health department, police department, or respective barangay offices.

The role of the Animal Control Officer focuses more on educating the public on proper animal care, and rescuing animals from dangerous or abusive situations. They also pick up dead or injured wildlife and stray animals for disposal or treatment. The position can either be held through the Office of the Municipal Agriculturist, or contracted to the local animal welfare advocate group. (d) The Punong Barangay, barangay official, employee or representative concerned shall not be held liable or responsible for whatever may happen to the animal/s caught outside the premises of a residence or establishment within the territorial jurisdiction of this Barangay; provided, that the penalties imposed under this Ordinance shall be without prejudice to the institution of any criminal and/or civil action by the aggrieved party/ies arising from death or physical injury and/or damage to property.

“P15 is almost 3% of the daily minimum wage in NCR. Worse it is around 4% of the daily of a minimum wage earner in the Cavite economic zone. Doubling the ATM fee would mean banks taking 6 to 8% of the minimum wage of workers per withdrawal. This is highway robbery,” Rene Magtubo, PM national chair, said in a separate statement.

The central bank said the P30 ATM transaction fee is unlikely to happen.

“Outlier na ‘yung P30. A little, maybe, over lang dun sa P15,” Fonacier said on the adjustments the central bank is currently looking at.

“Depends on the particular bank, but I think on average baka hindi naman (above P20). That’s what we are evaluating right now.

Maybe a few increase, hindi naman siguro sobrang laki,” she said.

The central bank has made it clear that ATM fees are going to increase automatically. The adjustment needs regulatory approval and must be justified by the banks.

“Existing prices range from an average of P13, a range from P11 to P15.

he National University (NU) Bulldogs shocked heavy-favorite De La Salle University (DLSU) Green Archers 77-70, in the finals of the 2019 Kadayawan Invitational Basketball Tournament on Wednesday night at the Davao City Recreation Center, Davao City.

The Bulldogs got back at the defending champion Green Archers, who beat them in the eliminations 8672, behind a relentless defense and hot shooting.

Miguel Ocson delivered the goods for the Bulldogs, who are eyeing to duplicate their amazing UAAP 77 championship run in 2014, with 14 points. He was backstopped

by Dave Ildefonso, who was consistent all tournament long, with 12.

The Green Archers, who were looking to make it two in a row in Davao, was paced
