IDAPAWAN CITY – The Philippine Institute of Volcanology and Seismology (Phivolcs) has recorded 53 aftershocks following the 8:36 p.m. �irst tremor traced 15 kilometers west of Makilala, North Cotabato on Tuesday.

The latest of the aftershocks were felt at 8:46 a.m. Wednesday, the Phivolcs online bulletin indicated.

Disaster of�icials here have suspended classes in all levels, both private and public schools, and in the towns of Antipas and Makilala following a magnitude 5.6 earthquake Tuesday night that was tectonic in origin.

“Classes were suspended to ensure the safety of pupils while disaster

EIJING -- Chinese Foreign Ministry Spokesperson Lu Kang said on Tuesday China does not want any escalation of tensions that may lead to war in the South China Sea. In a discussion with journalists participating in this year’s China International Press Communication Center’s program, Lu said China promotes engaging in coordination and communication with countries claiming the South China Sea such as the Philippines, Malaysia, and Vietnam to de-escalate tensions and avoid war.

But he also noted that any government cannot compromise on sovereignty and territory issues.

“China doesn’t want a war. There is no doubt to that fact. We do not want an

escalation of tensions,” Lu said.

“And I must be frank here, when it concerns sovereignty and territory – no matter in this government of a big country or a small one – there is no room for compromise, and it is the same with the Chinese government,” he added.

Lu recalled that countries in the South China Sea have sustained stability in the region before the United States government pushed for its “Pivot to Asia” foreign policy in 2010.

“And in past years, due to the disturbances from international forces there are more indeed some escalations of tension,” Lu said.

enate President Vicente Sotto III is seeing smooth working relations with the House of Representatives under the leadership of Taguig Rep. Alan Peter Cayetano for the 18th Congress.

"Absolutely. Second time in history that a Senator becomes Speaker of the House.

He knows us, we know him and I do not mean that literally only," Sotto told reporters on Tuesday when asked if he is expecting a good relationship between both chambers of Congress if Cayetano assumes the top House post.

Earlier, Philippine Institute for Peace, Violence and Terrorism head Rommel Banlaoi claimed that the two are already in the

country and these individuals are linked to the Indonesians responsible for the bomb attack at the Jolo Cathedral bombing last January.

He added the couple is in the Philippines to conduct "intermittent bombing operations".

Tawi-tawi gets 1st floating solar farm

he �ishing island of Sibutu in Tawi-tawi Province will be the �irst �ishing community with a �loating solar farm to power ice-making and cold storage equipment, and serve as a �ish convergence area or "Payao".

In a meeting on Monday with executives of Aboitiz Power led by Tristan Aboitiz and Regional Directors of the Department of Agriculture and the Bureau of Fisheries and Aquatic Resources (BFAR) at the DA central of�ice, Sibutu Island was unanimously chosen to be the site of the multi-function �loating solar farm.

The �loating solar farm, a new technology

employed by solar power generation companies so as to minimize the use of valuable lands, is now being introduced in the Philippines by the Norwegian company SN Power in partnership with Aboitiz Power.

Presidential Spokesperson Salvador Panelo said he was also con�ident that the term-sharing arrangement will not affect the passage of crucial bills pushed by President Rodrigo Duterte.

“Nag-a-agree na nga iyong tatlo (The three have already agreed). They forged into unity. So how can there be disruption,” Panelo said in a Palace brie�ing.

Panelo was referring to the three speakership aspirants who sought for the President’s endorsement-- Taguig Rep. Alan Peter Cayetano, Marinduque Rep. Lord Allan Velasco, and Leyte Rep. Martin Romualdez.

On Monday, Malacañang announced that Duterte has endorsed Cayetano and Velasco under term-sharing for House speakership with Cayetano to serve in the �irst 15 months, and Velasco in the remaining 21 months of the 18th Congress. Romualdez will serve as House Majority Leader.

On July 29, 2018, the House reached a majority vote to install former President Gloria Macapagal-Arroyo as speaker, replacing Davao del Norte Rep. Pantaleon Alvarez.

Under Arroyo’s leadership, there was a delay in the passage of the 2019 budget due to the lower chamber making last-minute amendments to the �inal version of the bill approved by the bicameral conference committee.

was Duterte himself who proposed the 15-21 term-sharing proposal to which they all agreed on.

“All of them were… are realist(s). Kung hindi sila pumayag doon sa ganoong arrangement, eh labo-labo talaga sila, magkakasira-sira sila; iyon ang iniwasan nila (If they didn’t agree to that arrangement, they might never agree, they’ll destroy each other; that’s what they were trying to avoid),” Panelo said.

Panelo noted that the three Speaker bets were ready to agree to whatever suggestion the President would make to end the impasse.

“Whatever the President suggests to them, payag na sila (they will agree on),” he added.

Earlier, Velasco rejected the term-sharing proposal, noting that it would divide the lower chamber.

Panelo, meanwhile, said it will be up to the lawmakers to decide whether to follow the President term-sharing proposal or elect their own House Speaker.

He reiterated that as much as the President refused to meddle on the speakership race, Cayetano, Velasco, and Romualdez had approached him.

“It’s not a question of following the President.

It’s them who went to the President and the President made, kumbaga ‘yun ang suggestion niya (in other words, it’s his suggestion),” Panelo said.

“Nasa kanila ‘yan kasi sila naman ang boboto, hindi naman si Presidente. Ayaw ni Presidenteng makialam, eh gusto nila pakialaman niya (It’s up to them because they will elect their Speaker, not the President. The President doesn’t even want to interfere, but they want him to interfere),” he added.

BPI: ‘Mobile-first mindset’ key to transforming the banking sector

O

wing to the widespread use of mobile phones in the country and the exponential growth of mobile internet, Philippine banks need to embrace a mobile-�irst mindset to be more competitive and innovative, said Bank of the Philippine Islands’ (BPI) Chief Digital Of�icer Noel Santiago.

“Banks should begin the transformation by capitalizing on new technologies, conducting core tech delayering, fortifying its security safeguards, and having a mobile-�irst mindset,” he said in his talk during the recently held 2019 BusinessWorld Economic Forum.

This kind of mindset considers mobile devices as main engagement tools to reach customers, rather than just an option.

Based on an International Data Corporation (IDC) market intelligence report, the number of mobile, internet and smartphone users in the country have shown double-digit growth of 50 percent and 32 percent, respectively. The trend is expected to continue in the years ahead.

Philippine banks are ripe for digitalization, Santiago said, and there are convenient opportunities to leverage on, given that majority or 95 percent of banking transactions are still done through cash and check.

“Digitalization, including the integration of mobile banking tools, will reduce our cost to serve.

There is huge potential for transforming how we deliver our services to clients,” Santiago said.

In fact, these opportunities have already attracted at least 81 �intechs or �inancial technology companies, as well as boosted the number of e-wallets in the country.

Of this, Santiago added, “We have to understand who these players are, and leverage their product offerings and skillset, then integrate them with our own ecosystem. Collaboration is the best approach to tame the disruption and remain competitive and agile.”

Supporting this mindset is Jaime Augusto Zobel de Ayala, CEO of Ayala Corporation and Chairman of BPI, who served as the keynote speaker in the Economic Forum.

“Over the last few years, we have made a deliberate attempt at institutionalizing an innovation mindset across the group.

We believe that critical to our future growth and success is the kind of innovative and disruptive thinking that start-ups and young entrepreneurs embody,” said Ayala.

“Transformation requires clarity of vision, courage to stay on the course, and boldness to disrupt yourself and challenge long-held conventions. It certainly won’t be easy, but I believe it is very much possible,” he added.

Traditional to progressive With the many advances in data infrastructure, Santiago said digitalization will allow banks to streamline digital transactions by incorporating more digital tools to enhance its products and internal processes.

In the past few years, the number of BPI clients doing online transactions has grown to three million. And for the past three years, the bank has booked a total of Php11.6 billion in technological spending to ramp up its digital infrastructure.

Gov Nelson targets 50,000 units to solve DavOr housing backlog

elieving that everybody has the right to the basic necessities in life, Gov. Nelson Dayanghirang targets 50 thousand housing units to be constructed in the next three years in the whole province, to address the housing backlog in the province.

In the groundbreaking ceremony of the provincial government’s housing project in Sitio Magay, City of Mati, Provincial Task Force on Socialized Housing Chief Flordeliza Tabanao disclosed that Gov. Dayanghirang is bent on realizing his aim that no constituent of the province should be left homeless.

“This project covers 15 hectares owned by the Tolentino family. The Governor initiated all the moves for the funding from the Socialized Housing Finance Corporation (SHFC), the sister company of the National Housing Authority (NHA). We would like to reiterate that this is a grant, payable within 25 years,” she said.

The Provincial Housing Task Force has organized the bene�iciaries

now called Mandaya Muslim Bisaya Homeowners Association, Incorporated, as instructed by the Governor.

The groundbreaking covers Phase 1 to Phase 3 of the project, while Phase 4 will be next, as the provincial government made some revisions with the subdivision plan so the area will really be habitable by the bene�iciaries.

EDITORIAL Audit first before modernization Senator Christopher Lawrence ‘’Bong’’ Go has �iled a bill that seeks the modernization of the country’s Bureau of Fire Protection (BFP). Fire Protection Modernization Act of 2019 aims to develop the BFP, ensure public safety by preventing such incidents and in suppressing all kinds of destructive �ires.

Consistent with his desire to be at the service of �ire victims, Senator Go has the welfare and protection of the people in mind. Hence, among the �irst measures he has �iled as a lawmaker is ensuring this time the increase of �ire prevention readiness and awareness. Among the aims of the measure is to increase the number of BFP personnel, to provide adequate training and to buy equipment needed by �ire�ighters. The bill also inclused Fire Protection Services and �ire rescue hotlines to be established in each local government unit (LGU) in the country.

In order to push towards modernization, the bill calls for the phase-out of old and obsolete major equipment and will be replaced by new equipment.

While the intention of the neophyte lawmaker may be noble, there is a need to look at the modernization program which the BFP has embarked for the past eight years and resulted to this deplorable state--the very reason why Senator Go is �iling the measure. How can we do another modernization program after failing in one?

The Commission on Audit (COA) early this year declared that the 8-year modernization program of the Bureau of Fire Protection (BFP) has failed. For the record, the modernization program was launched in 2010, and it was released with a total of P13.17-billion budget from 2011 to 2017. COA was compelled to do a performance audit because despite the program, the country still registered 96,447 �ire incidents from 2011 to 2017 which resulted in 1,924 deaths, 5,750 injuries, and P31.06 billion in property damage. As of June 30, 2018, the BFP only completed 263 out of its target 945 �ire stations which means there are still a backlog of 308 municipalities without a �ire station.

Among other things COA found out include 11 abandoned construction projects out of the 44 ongoing construction of �ire stations, procurement of only 621 trucks out of the target 1,057, 176 out of the 469 �ire trucks delivered in 2015 already had defects as of the following year, and failure of the BFP to have clear agreements with local governments resulting in 34% of barangays visited by COA found to have no organized �ire brigades.

By conclusion, COA doubts that the BFP can ful�ill its deliverables under the Modernization Program by 2020.

Given these premises, if another modernization plan is to be made, an audit of the 8-year modernization plan must be done �irst before the government.

INCOMPETENCE, INEFFICIENCY OR NEGLECT OF DUTY AS GROUNDS FOR A VALID DISMISSAL The employer is mandated to show substantial evidence that the seafarer committed acts of incompetence, inef�iciency or neglect of duty as grounds for a valid dismissal from service.

Incompetence or inef�iciency is the failure to attain work goals or work quotas, either by failing to complete the same within the allotted reasonable period, or by producing unsatisfactory results.

Neglect of duty, on the other hand, must be both gross and habitual.

Gross negligence implies a lack of or failure to exercise slight care or diligence, or the total absence of care in the performance of duties, not inadvertently but willfully and intentionally, with conscious indifference insofar as other persons may be affected.

The employee exhibits thoughtless disregard of consequences without exerting effort to avoid them.

Habitual neglect involves repeated failure to

perform duties for a certain period of time, depending upon the circumstances, and not mere failure to perform duties in a single or isolated instance.

Using the above principle, the Supreme Court ruled in the case of EVIC Human Resource Management Inc., v. Rogelio Panahon, (G.R. No. 206890, July 31, 2017) that the employers failed to show that the seafarer willfully or deliberately caused the alleged accident during the mooring operations or that he repeatedly committed mistakes or repeatedly failed to perform his duties. The single unveri�ied incident on seafarer’s supposed negligence is surely insuf�icient to warrant a �inding of just cause for termination.

The Court found the captain’s Report sorely inadequate in meeting the required quantum of proof to discharge the employers’ burden as the statements contained therein were uncorroborated and self-serving.

It is a settled rule in labor cases that the employer has the burden of proving that the dismissal of a seafarer was for a just or authorized cause, and failure to show this would necessarily mean that the dismissal was unjusti�ied and, therefore, illegal.

Furthermore, not only must the dismissal be for a cause provided by law, it should also comply with the rudimentary requirements of due process, that is, the opportunity to be heard and to defend one’s self.

For a dismissal to be valid, the employer must show through substantial evidence or such amount of relevant evidence that a reasonable mind might accept as adequate to support a conclusion.

When a seafarer commits such violations, he may be penalized by the master of the vessel with dismissal and be made to pay the cost of repatriation and his replacement. Additionally, an administrative

complaint or disciplinary action against the seafarer may be �iled before the POEA, who, after due investigation, may impose penalties ranging from suspension to delisting, depending on the frequency of the violations.

Under the “two-notice rule”, an erring seafarer is given a written notice of the charge against him and is afforded an opportunity to explain or defend himself. Should sanctions be imposed, then a written notice of penalty and the reasons for it shall be furnished the erring seafarer.

It is only in the exceptional case of clear and existing danger to the safety of the crew or vessel that the required notices are dispensed with; but just the same, a complete report should be sent to the manning agency, supported by substantial evidence of the �indings (Skippers Paci�ic, Inc. v. Mira 440 Phil. 906 (2002) Even when an employee is found to have trans-

gressed the employer’s rules, in the actual imposition of penalties upon the erring employee, due consideration must still be given to his length of service and the number of violations committed during his employ. Where a penalty less punitive would suf�ice, whatever missteps may have been committed by the worker ought not to be visited with a consequence so severe such as dismissal from employment (PLDT vs. NLRC , 303 SCRA 9).

WHO IS AFRAID OF LOWER RICE PRICES? After last year’s temporary rise in retail prices of rice and in�lation peaking at 5-6%, we have gone down to about 2.7%.

We have lower rice prices to account for this, since it appears that on average, we are seeing a slight reduction in retail prices in many areas.

Since this and other food items account for more than half of the spending of majority of Filipinos, the lower expenditure for this item is re�lected in lower in�lation.

Republic Act (RA) No. 11203 or the Rice Liberalization Act was signed and approved by President Duterte last February 14.

It took almost 30 years for

government to �i ally pass this law it took more than 30 years under various administrations to get the Congress to approve this vital reform that many opposing lobbies have tried to block.

The cartels that blocked this basic reform, bene�itted from the old quota system that effectively ensured that our rice supply was always not enough since only a few can import rice subject to approvals from the Department of Agriculture, thereby ensuring that prices will be kept high enough.

This bene�itted the cartels since the locals, who produce at higher cost, will not have competition that will force them to produce at

lower cost.

Again, the reality is that middlemen, not farmers make the killing on the rice trade. Keeping it artii�icially high by preventing competition is good for those making their killing as middlemen and moneylenders.

The farmer suffers just the same.

Thus, RA 11203 created the P10-billion Rice Competitiveness Enhancement Fund (RCEF) to help palay growers and their farmers’ cooperatives transition to a new rice regime, where the RCEF will be used to provide farmers tools and equipment, assistance in the production, promotion, and distribution of certi�ied rice seeds, upgrading

of post-harvest storage facilities, credit assistance, irrigation support, and research and development (R&D) support. In short, it will boost the production of rice.

Kudos to the economic team for making this happen.

Its initial effects, as predicted, would be the lowering of retail rice prices felt in the end of the �irst half of the year. This bene�its about 100 million FIlipinos, all of who consume rice daily.

True enough, the Bureau of Customs data shows that 1.43 million metric tons (MT) of rice stocks imported by private traders in various ports in the country, allowing the government to

collect P5.9 billion in tariffs.

The rice cartels always wanted the old quota imposed regime in place so that they could ensure that the supply and its retail and wholesale price could be controlled by them.

With this, affordable rice has arrived at the neighborhood store and is within reach.

The longer term effect , which is desired, is that of improving the growing capability of local rice farmers, or enabling them to transition into growing other suitable crops we alao consume,that may also give them better income than rice. This is something we need to monitor in the coming months.

he Philippine boxing team is gearing up for a busy stretch as it will compete in three major tournaments – capped by its bid in the 30th Southeast Asian Games that the country will host in December.

Roel Velasco, the coach of the men's team, said the Filipino boxers are in the midst of their preparations for the world championships that will be held in Yekaterinburg, Russia in September, followed by the SEA Games three months after, and then possibly, the Olympic quali�iers beginning January 2020.

The world championships is next in the radar of the Alliances of Boxing Association of the Philippines (ABAP), but it is the SEA Games that is the priority of the team as the biennial meet will be held in the country for the �irst time in 14 years.

Velasco is con�ident

that the team can surpass its haul from the 2017 SEA Games in Malaysia, where Filipino boxers brought home two golds, one silver, and one bronze medal.

"Malalagpasan natin 'yung ginawa nila sa Malaysia lalo na at tayo ang host this December," said Velasco during Tuesday's PSA Forum at the Amelie Hotel in Manila.

Two of the gold medalists Eumir Felix Marcial and John Marvin, along with bronze winner Ian Clark Bautista, were with Velasco in the forum.

OS ANGELES - Keith Thurman warned Tuesday he is targeting the destruction of Filipino boxing icon Manny Pacquiao when the two welterweights face off in Las Vegas later this month.

The undefeated Thurman puts his World Boxing Association welterweight crown on the line against the 40-year-old Pacquiao on July 20 at the MGM Grand.

Thurman, 30, has relentlessly fanned the �lames for the contest by stating he plans to send Pacquiao into retirement.

On Tuesday, Thurman took a more respectful tone against Pacquiao, the eight-division world champion who remains one of boxing’s biggest draws as he prepares for the 71st �ight of a two-decade professional career.

Thurman said he plans to take an aggressive approach into the �ight as he chases an emphatic victory.
