Duterte on Kapa, others: Shut them down and haul them to courts

P

resident Rodrigo Duterte has ordered the National Bureau of Investigation (NBI) and other government agencies to shut down investment schemes that are proliferating, mainly in Southern Mindanao, for conning people of their hard-earned money.

Interviewed by his friend Pastor Apollo Quiboloy, Duterte said the activities of these investment schemes, including the Kapa Community Ministry International, are clearly a form of estafa.

Several investment schemes have sprouted in Southern Mindanao and have reportedly been branching out to as far as Luzon in recent days. These include Kapa, headed by Joel Apolinario, which promises a 30 percent “love gift” each month. Some schemes, such as the Tagum City-based Rigen Marketing, Jogle and Ever Arm, even promise a return of up to 500 percent.

In the interview, Duterte said the NBI should immediately put a stop to these schemes.

“To the CIDG, the

police, the special investigating teams, including NBI -- that is pyramiding. That is why you shut them down and haul them (to courts) upon my orders,” he said. The CIDG is the Criminal Investigation and Detection Group.

The President said he has been telling people that “when it is too good to be true, it is fraud.

etizens favoring investment schemes are venting their ire on evangelist Pastor Apollo Quiboloy for President Rodrigo Duterte’s statement, ordering rightful government agencies to shut down investment schemes including Kapa Community Ministry-International.

Duterte, in an interview with his friend Quiboloy during the latter’s TV program Give Us This Day on Saturday, July 8, ordered the National Bureau of Investigation (NBI) and other government agencies to shut down investment schemes as its activities are consid-

ered a form of syndicated estafa.

Kadato ang Padalngan or Kapa founded by Pastor Joel Apolinario was mainly underscored during the interview.

Expectedly, it created a stir in social media which obviously came from the

members of the said religious community.

Most of the blames that surfaced the social media went to Quiboloy who is popular with his moniker “The owner of the Universe” that ended up comparing and contrasting his ministry to Kapa.

A Facebook post with a hashtag #KAPAmilya was re-shared several times for a purpose distinguishing the difference between Quiboloy’s ministry and Apolonario’s KAPA. Kapa promised a 30

percent of interest every month of an individual’s donation amount that makes it a hit especially to people in poverty.

However, the issue is far from a religious rivalry.

In Saturday’s interview, Duterte said the NBI should immediately put a stop to these schemes saying these are fraudulent.

Sam and Geo adapting well to new home in Singapore

he two Philippine Eagles sent to Jurong Bird Park of Wildlife Reserves Singapore on Tuesday were adapting well to their new environment, Dominic Tadena, senior bird keeper at the Philippine Eagle Foundation (PEF) said on Thursday.

Tadena, who is in Singapore for one week to assist the bird keepers there during the transition, said the appetite of Geothermica and Sambisig was “back to normal.”

The eagles had been kept in separate enclosures and are quarantined for 60 days.

He said the eagles were given white rat and goat meats around 10 a.m. on Wednesday but the keepers saw the birds started eating only around 3 p.m.

They were fed mostly goat meat on Thursday.

The eagles were loaned out to Singapore for 10 years after the Philippine government and WRS signed last May 20 a loan program agreement to protect the critically endangered species from extinction due to calamities and diseases.

“Yung old place kung saan naka established na sila as their territory e medyo na disoriented sila

ngayon (They have already established the old place as their territory so they are quite disoriented now),” he said.

Geothermica and Sambisig, both captive-bred eagles at the 8.4-hectare Philippine Eagle Center in Malagos, Baguio District in Davao City, arrived in Singapore at 2:14 p.m. on Tuesday.

The two raptors are undergoing a natural pairing process, according to Tadena, the birds’ keeper for two years.

The PEF had initially attempted last year to breed the raptors through a natural pairing process but that it had to be aborted as discussions on the loan program between DENR and WRS began, he said.

“We tried to stimulate them during breeding season last year but we had to terminate it because discussion on breeding loan program started and we expected the birds would be transferred (to Singapore) around same period,” he said.

He explained only raptors with no contact with humans may undergo the natural pairing process while those that had been imprinted on their keep-

Davao City Female Jail,expands facility

T

he Davao City Female Jail (DCFJ) in Maa will soon be expanded with new facilities aimed at decongesting it.

According to Sr.Insp. Rovie Ann Alcantara, DCFJ Warden, 3 new buildings will be completed on August 29 this year and will have a capacity of handling 300 Persons Deprived of Liberty (PDLs) “If that will materialize we will have zero percent congestion,” Alcantara said.

The new DCFJ expansion includes three buildings with three-storeys each and one kitchen facility, the project is worth P42-million sourced from congressional funding.

Alcantara said the female jail is currently congested as it is handling 366 PDLs (formerly called inmates). The current correctional facility is supposed to handle 180

persons.

Meanwhile the Bureau of Jail Management and Penalogy DCFJ will be holding an art exhibit this June 22 to July 4 at Felcris Centrale. Alcantara said they are expecting 20 paintings done by PDLs alongside handicrafts such as coin banks and handbags.

“This is a way to support the schooling of the children of these PDLs as 100% of the proceeds will be given to their dependents. Also we do not want a relapse of our PDLs,” Alcantara said.

This is the second art and product bazaar conducted by the BJMP and DCFJ, the �irst activity was held October last year in Gaisano Mall during the National Correctional Consciousness Week where they were able to raise P10,000. (PIA/RG Alama)

PRRD cites importance of Hajj pilgrimage to Muslims

resident Rodrigo R. Duterte on Thursday cited the importance of Hajj pilgrimage to Muslims as part of the government's decision to sponsor 27 internally-displaced persons last year to Mecca.

"A part of my Muslim character says that ‘yung pilgrimage saHajj mas importante ‘yan para sa mga Muslim kaysa isangmansion (pilgrimage in Hajj is more important for Muslims than a mansion)," he said in his speech during the Eid al-Fitr Celebration in Davao City.

The President appealed to the Commission on Audit (COA) to relax and reconsider its rules when it comes to government spending.

"Sometimes you have to take into consideration really the subculture. If you can understand the culture, then we’d have less friction in the society," he said.

"I am asking COA to reconsider. Ano ba naman ‘yang �ive million? (What is �ive million?) Actually that �ive million is worth billions in terms of your kind, I said generosity, to �inance the poor people na Muslim para makapag-Hajj (for Hajj)," he added.

Ejercito nixes suspending UHC law amid PhilHealth anomalies

utgoing Senator Joseph Victor Ejercito on Friday opposed the idea of suspending the implementation of the Universal Health Care (UHC) law amid the reported anomalies involving bogus dialysis treatments hounding the Philippine Health Insurance Corporation (PhilHealth).

“We should not let patients who badly need dialysis suffer because of the allegations of fraudulent transactions within PhilHealth. PhilHealth should continue providing health services but ensure the authenticity of those who avail (of) the services,” Ejercito told reporters in a text message.

Ejercito noted that the UHC law provides stiffer penalties for unethical and fraudulent transactions, stressing that it should just

be implemented properly.

Ejercito cited that a health care provider who commits an unethical act, abuses his authority, or performs a fraudulent act shall be punished by a �ine of PHP200,000 for each count or suspension of the contract up to three months or the remaining period of its contract or accreditation. It shall also constitute a criminal violation punishable by imprisonment of six months and one day up to six years.

“It will be unfair for the rest to be deprived of PhilHealth’s services. Investigations should continue and appropriate charges should be �iled,” he added.

Presidential Spokesperson Salvador Panelo said President Rodrigo Duterte has ordered the PhilHealth management to �ile criminal charges against those who misused the funds for years.

“The President instructs the institution’s acting President to submit a detailed report on these irregularities. We will put a stop to this corruption and we will make sure that the law on universal health care is strictly enforced,” he said.

This came following the buzz on social media regarding the closure of the US Citizenship and Immigration Services (USCIS) Manila Field Of�ice next month.

“The US Embassy in the Philippines will assume responsibility for certain limited services previously provided by the Manila Field Of�ice to individuals residing in the Philippines,” Trude Raizen, deputy press attache at the Embassy, said in a text message to the media.

On Thursday night, the

US embassy con�irmed that the USCIS will close its Manila of�ice on July 5, 2019, “due to insuf�icient workload.”

“There will be no change in visa processing at the U.S. embassy in the Philippines,” it said.

The USCIS is the government agency that oversees lawful immigration to the US. Among its functions are adjudicating requests for immigration bene�its, processing of applications to sponsor relatives and future spouses including refugee applications around the world.

Aside from Manila, the USCIS �ield of�ice in Ciudad Juárez, Mexico was also closed on June 30.

According to the embassy, the USCIS has also entered into discussions to phase out all of its international of�ices. (PNA)

ith the growing number of Filipinos in Sweden and its ties with the Philippines going on an upswing since the reopening of the Swedish embassy in Manila, the Philippines is considering a foreign post in Stockholm, a Department of Foreign Affairs (DFA) of�icial said Thursday.

“Since their embassy reopened, the relations have strengthened. There have been so many engagements, and so we are also looking at the possibility of having our own post, eventually, in Sweden because there are also a number of Filipinos

he Land Transportation Franchising and Regulatory Board (LTFRB) is set to open the application for franchises of premium taxi services following the issuance by the Department of Transportation (DOTr) of the guidelines of the taxi modernization program last May. “We are �inalizing hopefully today (Friday) or early next week the memorandum circular for the implementation of the taxi modernization program.

The main feature is we will be opening franchises for the premium taxis,” LTFRB chairperson Martin Delgra III told reporters.

Premium taxi drivers will receive regular salaries and bene�its and that they will be required to wear a uniform under the new guidelines issued by DOTr. Premium taxis must have free Internet access for passengers, onboard navigation system or mobile-based application,

dashboard cameras and an automated fare collection system according to DOTr Department Order 2019007 issued last May 8.

The taxis should also be at least Euro-4 compliant and not older than seven years old as re�lected in the Certi�icate of Registration.

Premium taxis will also be reclassi�ied into “Silver” or “Gold” depending on their power rating, leg room, and luggage compartment, among others.

“Ang market nitong premium taxis (The target market of the premium taxis), a large percentage of this I suppose, are those with cars. If they will be taking taxis, the use of private cars on the roads will be lessened,” Delgra said.

The premium taxi classi�ication was �irst introduced in 2015 to improve the quality of the service of the taxi industry, amid the emergence of transportation network companies in the country. (PNA)

President Rodrigo Duterte’s order to the National Bureau of Investigation (NBI) and other law enforcement agencies to close down any operations of illegal investment schemes did not come as a surprise. A lawyer and former prosecutor, the President knows a fraud when he sees one.

On Saturday, the President �inally ended all speculations on his stand on the controversial investment schemes sweeping the region. Prior to that, there had been some posts in social media claiming President Duterte is okay with Kapa, Rigen and all others of the same business. There were even some people who posted a photo of PRRD on the logoface of Kapa.

In the interview which was coincidentally made in the television program of evangelist Apollo Quiboloy, Duterte said the NBI should immediately put a stop to these schemes. The President said he has been telling people that “when it is too good to be true, it is fraud.” Duterte said he is bound to force the stand of the government because these investment schemes “are

into syndicated estafa.”

However, because the announcement was made in the Quiboloy television program, people gave color to the order and blamed the evangelist for ‘insinuating’ the closure against Kapa, which is another religious congregation, although not as big as Quiboloy’s Kingdom of Jesus Christ.

We do not want to see this as a religious row. It is simply a legal order to close what is not legal. People who advocate the scheme cannot justify what is illegal as legal based on their own interpretations. The binding interpretation is that which is founded on existing laws and it has preceded the President’s order when the Securities and Exchange Commission (SEC) issued a cease and desist order on Kapa, revoked its permit and issued advisory against others similarly situated like Rigen.

Nevertheless, President Duterte’s order will be an empty one if the law enforcers in this region will have to act like lame ducks again even when the President has already spoken.

DEADWEIGHT: ACCIDENT, SUICIDE AND SEAFARER’S DEATH COMPENSATION CLAIMS The Finnish-German �ilm “Deadweight” dealt with the legal question on the cause of a Filipino seafarer’s death that has a signi�icant impact in compensation claims. : whether he died by accident or suicide.

The movie by German �ilmmaker Axel Koenzen Axel explores the tough working conditions in the globalised shipping business.

Ahti Ikonen is the captain of a large 35,000-ton container vessel Brugge, which enters the port of Savannah behind schedule. As they are under deadline pressure, he violated regulations by ordering his crew to help the local dockworkers unload the cargo. Unfortunately, it costs the life of a Filipino seafarer James that threatens his career. In the port of Rotterdam, Netherlands unionized dockworkers exploit the incident and refuse to unload the ship and called for a boycott.

In the �ilm, the Filipino seafarer James was some-

what suffering from a depression as his request for repatriation was not granted even if his tenure was already beyond that stipulated in the contract. In a scene he was shown with a head injury after the illegal lashing and later as a dead person The �ilm showed the discussion among the Filipino crew on what will be the tenor of their testimony surrounding James’ death.

If he died due to accident, the heirs will be paid US$50,000.00 and an additional amount of US$7,000.00 to each child under the age of twenty-one (21) but not exceeding four (4) children under the POEA contract. The amount usually is higher if the death is covered by a Collective Bargaining Agreement (CBA).

On the other hand, declaring the incident as suicide will save the owners large amount of payment for death bene�its from the insurance companies.

The employer is liable to pay the heirs of the deceased seafarer for death bene�its once it is established that he died during the effectivity of his employment contract.

However, the employer may be exempt from liability if it can successfully prove that the seafarer’s death was caused by an injury directly attributable to his deliberate or willful act, including killing himself by committing suicide.

The investigators concluded that James died by suicide due to illegal lashing based on the testimony of the crew.

Studies identify as most frequently cited factors for seafarers’ suicide the various work-related problems which included con�licts among the crew, disciplinary problems, work pressure, cancellation of shore leave, various mental health conditions, depression, marital or girlfriend problems and alcohol consumption.

I was elated to see my name in the credits of the �ilm.

In 2014, I was interviewed

by German �ilmmaker Axel Koenzen on the different issues confronting the Filipino seafarers, including the perils of the profession like disability or death due to illness, injury or accidents.

Two years later, the �ilm had its world premiere at the 2016 Berlin International Film Festival.

Deadweight is a measure of how much weight a ship can carry, or the sum of the weights of cargo, fuel, fresh water, ballast water, provisions, passengers, and crew.

The �ilm was aptly described in the 9th Subversive Film Festival in Zagreb, Croatia as “Axel’s nautical piece which deals with the exploitation of the nautical working class that makes the functioning of capitalistic ef�iciency possible. With an accentuated documentary approach, through various observational methods the

�ilm speaks about responsibility, limitations, restrictions, which are symbolic of a time in which instructions are mediated through e-mail and radio, and re�lect the essence of the global syndrome of mediated management - the shifting of responsibility that often falls on the lowest level executioner. The �ilm has adapted, in its making, to the rhythm of the boat, while the author refuses to romanticize the hard and brutal working conditions of its crew.”

Deadweight had its Philippine premier last month at the UP Film Center in Diliman.

I suggested to Axel that it be shown in schools and other venues in time for the National Seafarers Day celebration during the last week of September.

IS BEING RIGHT ENOUGH? People who sit on thrones of power and authority are narcissistic. They usually assume they have every right to rule and change the mindset of their constituencies, obey them as meekly and as tamed like the lamb.

This righteous thinking dangerously borders on totalitarianism. When this happens - as it had already happened over the centuries - leaders who wield scepters of authority are emboldened to impose their despotic designs upon the people in their jurisdiction.

That is why men of power and authority cling to the notion that they have every right to change the world; Or bold enough to alter the mindset of those around them; Or gifted enough with intelligence to re-con�igure the behavior of the people they deal with and their constituencies.

But being right does not equip you – nor anyone – the magical powers of Merlin and his ilk to weave his

wand and voila! From being a handsome prince, you are now transformed into an ugly frog. Or vice versa.

Have you ever heard of the twin words “persistence and tenacity?”

I do not subscribe to the belief, however universally accepted, that being bold and brave – as these qualities have been the adjectives that describe the legendary heroism of men who led nations out of bondage and slavery – are enough qualities to propel them to greatness and glory.

Many bold and brave men who do not possess the characteristic traits of persistence and tenacity are the same audacious herculean guys who give up – defeated and beaten - just as they are at the threshold of success.

Abraham Lincoln, the Great Emancipator, personi�ies what I believe about a leader with “persistence and tenacity.” It was during his watch that the Great American civil

war erupted mainly because the Southern States did not like giving up their practice of slavery.

He was right in pushing for the abolition of slavery and, though it met stiff opposition, causing the South to declare war against its Northern counterpart, his persistence and tenacity to the principles he strongly believed in, changed the course of American political history.

Imagine, if until now, African-Americans were still laboring under the chains of their colonial white masters.

Israel is a nation besieged by its Islamic neighbors surrounding it. There is never a day that is calm and serene.

In fact, uneasiness, anxiety and discomfort stare every Israeli family and household every day, 24/7.

The Israelis are a bold and brave people, having survived the brutal Holocaust that almost wiped out the Jews in Europe – Germany, Poland, France, and elsewhere – during the Second

World War. Their persistence and tenacity as a race proved, to this day, that they will survive the onslaught of terroristic attacks from the east, west, north and south initiated and engineered by their sworn enemies.

They express their right to live in Israel and continue to protect and preserve that right. Since 1948 when the State of Israel was born and the UN voted to recognized it (the Philippines was the �irst Asian country to recognize the State of Israel), the Israelis have exercised persistence and tenacity such that their country has progressed immensely – economically, politically and militarily – as the world’s 8 th most powerful nation in the world today.

Filipinos are ironically and signi�icantly too far away in comparison.

We are a bold and brave people, having endured nearly four hundred years of inhuman Spanish coloniza-

tion, nearly �ive decades of subliminal American tutorship on governance and selfrule and 1,825 days of brutal Japanese occupation.

Yet, we do not have the persistence and tenacity that the Israeli people possess and preserve.

Yes, our inherent rights as human beings are present but these same rights are trampled upon by scoundrels whom we elect and install by “democratic” vote in of�ice.

Filipinos have allowed themselves to become footstools of politicians who have, through generation to generation, masqueraded as dedicated leaders of the nation. This circumstance is an indictment of the confusing identity a Filipino exudes in the present times.

Being right is not enough.

Children’s Games, hoops camp in Padada, Talomo

total of 430 youngsters celebrated their childhood in a day of fun and games in Padada, Davao del Sur on May 30 and in Catalunan Grande, Davao City on June 1.

Rainshowers did not dampen the excitement of the 130 kids who were led by their 13 Ate and Kuya volunteers in the Sports for Peace Children's Games in Padada.

Barangay Captain Vimar Embudo thanked the Philippine Sports Commission (PSC) for giving the children aged eight to 11 years old a day to have fun at the same time be conscious of taking good care

of their environment as a mangrove planting and coastal clean-up was incorporated in the event.

"Katungod sa mga bata na magdula (It's the right of the children to play)," Embudo said.

PSC Mindanao cluster head Ed Fernandez said that letting the children play with each other develop con�idence greater than those who do not. "They make friends and learn values of respect and understanding early in life," he said.

PSC Chairman William "Butch" Ramirez, who also had a fun childhood in Padada, missed the activity as he joined the PSC team

building program in Bataan. But through Fernandez, the PSC chief extended his gratitude to the local government of�icials, partners and stakeholders who made the Games possible.

Water transfer, sack race and kadang-kadang were among the games played by Christian and Muslim children in the event held in partnership with Batch 1980 of St. Michael School of Padada.

Meanwhile, some 300 joined the Children's Games basketball clinic at Dennis A. Uy SFX Remase Gym in Catalunan Grande that was handled by PSC Mindanao staff.

Just as unthinkable?

The Toronto Raptors going up 3-1 against the Steph Curry and the battle-tested champions.

Well, you better believe what you’re seeing, Canada; you’re a win away from making history.

Kawhi Leonard scored 36 points, 17 in the pivotal third quarter, as the Toronto Raptors downed the Golden State Warriors 105-92 on Friday (Saturday, Manila time) to be on the brink of an NBA championship.

“Just (got to) be patient, come in focused and ready to play defense and make some shots,” Leonard said. “As long as we win, I’m satis�ied.”

Serge Ibaka added 20 points off the bench for his best performance in the series, and Pascal Siakam chipped in 19 points for the Raptors, who won despite the spirited return of Klay Thompson, who was on �ire from the �ield, and Kevon Looney.

Game 5 moves back to Toronto on Monday (Tuesday, Manila time).

It looked like Golden State was ready to give Toronto a brutal reality check when the Warriors went up by 11 in the �irst quarter.

But the Raptors, who have shed their reputation as a team that couldn’t get the job done under the bright lights, performed exceptionally well under pressure.

They hung around in the second quarter, then took it to another gear in the third where they outscored the Warriors 37-21.

Thompson scored 28 points to lead Golden State while Steph Curry �inished with 27, but was just 2 of 9 from downtown, 48 hours after producing 47 points in Game 3.

Draymond Green tallied 10 points, 9 rebounds and 12 assists.

Leonard also grabbed

12 rebounds in the game.

Only once in 34 chances in NBA Finals history has a team rallied from 3-1 down to win the title, that being in 2016 when LeBron James led Cleveland back to defeat the Warriors. the Warriors remained without playoff scoring leader Kevin Durant, out the past month with a right calf injury, and lacking him they were no match for the fast-moving Raptors.

Leonard opened the second half with back-toback 3-pointers, giving the Raptors their �irst lead at 48-46.

Toronto closed the third with a 20-6 run to seize a 79-67 lead entering the fourth, Leonard scoring 11 and Ibaka adding 7 in the pivotal span.

Fred VanVleet opened �inal quarter with a 3-pointer for Toronto but was taken to the locker room moments later for 7 stitches after a bloody gash was opened under his right eye when he was struck by the left elbow of Golden State’s Shaun Livingston under the basket.

The Warriors got within 97-89 on a Curry 3-pointer with 2:56 remaining but came no closer.

It could have been the �inal game at 53-year-old Oracle Arena for the Warriors, who move into a new arena next season in San Francisco. The arena has been the club’s home since 1971.

Defensive work dominated early, both teams struggling to make shots and combining for 13 �irsthalf turnovers.

Leonard scored 14 points in the �irst quarter but the rest of the Raptors shot 1-for-13 and the Warriors, led by six points from Looney, jumped ahead 2312 before Leonard scored �ive points in a 7-0 Toronto run.

Thompson caught �ire in the second quarter, going 4-of-5 from the �loor as Golden State led 46-42 at halftime.
