Weak implementation of BADAC blamed on lack of funding

By MAYA M. PADILLO he Barangay Anti-Drug Abuse Council (BADAC), the country’s first line of defense against drug abuse and trafficking, is not living up to the purpose.

BADAC was organized in all barangays to achieve a barangay-level approach of promoting whole-of-government and participatory strategy in suppressing drug abuse and trafficking.

With BADAC, barangay captains are directed to appropriate a substantial portion of their respective annual budget to assist in or enhance the enforcement of the law, giving priority to p r e ve n t ive

or educational programs and the rehabilitation or treatment of drug dependents.

However, not all established BADACs are functioning due to lack of proficiency and appropriation of funding.

Donaldo Rivera, technical adviser of Davao City Anti-Drug Abuse Council (CADAC) told media in I-Speak media forum that some barangay captains have weak implementation of BADAC in their respective barangay because of lack of

proficiency on how to manage development.

“The community development will identify the services in the community. The job of the barangay captain is to manage the development.

Didto na part pa sila hinay,” Rivera said.

Rivera added that there is also lack of understanding to the law among barangay captains particularly RA 9165, Section 51 that

states “local government units shall appropriate a substantial portion of their respective annual budgets to assist in or enhance the enforcement of this Act giving priority to preventive or educational programs and the rehabilitation or treatment of drug dependents.”

Unemployed fire, quake victims can avail of SSS assistance loans

SSS is offering assistance to employees who were affected by the series of earthquakes particularly employees of the mall in General Santos City that was hit by fire and another shopping center in Padada is which collapsed after deadly quakes last year.

Also the reason for such separation must not be the fault of the employee

“Although, the unemployment benefit is so easy to process but the separated employees are required to go to the Department of Labor and Employment (DOLE) because it is the DOLE that releases the certificate that their separation is involuntary.

avao City authorities are now intensifying its biosecurity measures to all entry points in the city following the entry of a new strain of corona virus in the country.

Public Safety and Security Command Center (PSSCC) head Angel Sumagaysay said on Wednesday’s AFP-PNP Press Corps Southern Mindanao media briefing, measures are now being implemented in Davao International Airport if there are passengers who be detected of the said virus.

Sumagaysay said there is a standby ambulance there to ferry the passengers carrying the symptoms of the virus and will be immediately transported to Southern Philippines Medical Center (SPMC) for quarantine.

He said the Bureau of Quarantine of the Department of Health are deploying their thermal scanner in the airport to detect people especially those who are coming from China and Cebu where the

strain of the virus found.

“The local government is supporting these measures to prevent the entry of this virus here, “ he said.

Sumagaysay said aside from the airport, the Bureau of Quarantine will also be deploying personnel in the seaports in the city to prevent the virus entering here.

He said the said office will also implement Biosecurity measures in the three fixed checkpoints in the city particularly in Barangay Lasang, Bunawan; Barangay Sirawan, Toril and Barangay Lacson, Calinan to fight the entry of corona virus in the city.

Sumagaysay said the Department of Health is conducting constant meeting the members of Task Force ERID (Emerging Reemerging Infectious Diseases) to monitor the situation.

He said during their last meeting, the task force did not receive reports of any persons who are positive with the said virus.

Mati City revenue collection increase for 2020, says BPLO

T

he Business Permits and Licensing Office of the City of Mati LGU has reported a 26% increase in their revenue collection for the year 2020 compared to last year from the period January 2 until January 20.

BPLO is conducting a month-long one-stop-shop that started January 2 and will end until January 31.

For the period of January 2 until 20, BPLO collected a total of P23,595,756 revenue from business tax and other permits.

For the same period of 2019, BPLO only collected P18,601,813.42 or an increase of almost 5 million pesos.

There are 129 new businesses while 1,106 have renewed.

BPLO head Salve Marie Castro said their target for 2019 was only P40 million but they have collected a total of P44 million last year.

For 2020, said Castro, they aim to collect P60 million from business taxes, permit fees and other fees from offices like the City Environment and Natural Resources Office, Engineering, City Health, City Planning and Development Office, and the City Social Welfare and Development Office.

ilitary and police authorities here and in neighboring Maguindanao province are in pursuit of motorcycle riding-in-tandem who ambushed and killed a soldier and wounded another on Wednesday.

Lt. Col. John Miridel Calinga, Midsayap town police chief, identified the victims as Cpl. Earl Tabaranza, 31, and Pfc. Meljay Bernal, 30, both members of the Army’s 34th Infantry Battalion (34IB).

Bernal died while being treated in a hospital two hours after they were ambushed at 11 a.m. along the national highway in Barangay Central Glad, about five kilometers from the town center, police said.

“He (Bernal) succumbed to multiple gunshot wounds in the body,” Calinga said in an interview by reporters here.

Tabaranza, meanwhile, remains in critical condition at a local hospital as of posting time.

Col. Glenn Caballero, 34IB commander, said the soldiers were on board a motorcycle heading to the town proper when two gunmen aboard another motorbike opened fire on them.

The victims, who were in civilian clothing, fell from their motorbike on the roadside as the suspects sped off.

Police crime scene investigators found four .45-caliber empty shells at the ambush site.

outh Cotabato province’s efforts to totally eradicate the parasitic filariasis disease has taken a major hit as it confirmed at least 28 new cases in the area.

Jose Barroquillo, mosquito-borne diseases coordinator of the Integrated Provincial Health Office (IPHO), said the filariasis cases were found during a series of surveillance activities late last year in the municipalities of Tboli and Lake Sebu.

He said at least 25 residents of Sitios Falan and Coong in Barangay Maan in Tboli tested positive of the disease during the field tests conducted by the members of the mosquito-borne disease surveillance team.

Three more cases were also confirmed in

Sitios New Tupi and Tinugas in Barangay Ned, Lake Sebu, he said.

“The affected residents immediately received treatment but one case was deferred due to pregnancy,” he said in a report.

During the surveillance activities, Barroquillo said they used at least 131 test strips and conducted vector mapping using carabao bait traps.

To prevent the spread of the disease, he said they distributed long-lasting insecticide-treated nets to the affected residents.

He said they also conducted awareness and health promotion sessions with barangay officials and sitio leaders.

he Philippines is prepared and treating suspected cases of the new coronavirus cautiously, the Department of Health said Thursday as the illness continues to spread globally, claiming at least 17 lives in China.

Due to limited information available on the new strain of virus, the agency is working on an interim guidelines based on Middle East respiratory syndrome coronavirus (MERS-CoV), according to DOH spokesman Enrique Domingo.

“We’re treating it as it was a very contagious illness that can be very fatal...

Right now we’re erring on the side of caution and safety and treating it as if it was

MERS-CoV,” he told ANC’s Early Edition.

“We’ve had SARS (Severe Acute Respiratory Syndrome) and MERS-CoV so we have this structure already ready. We just have to activate it every time there’s a national health concern.”

Dela Rosa, an ally of President Rodrigo Duterte, backed moves to detain Sen. Leila De Lima after drug convicts accused her of alleged involvement in the production and sale of narcotics in the national penitentiary during her stint as Justice secretary.

“I can only infer that maybe this is pursuant to the US 2020 federal budget which includes a provision banning entry to the US of certain Philippine government officials involved in the detention of Sen. Leila de Lima,” Go said in a statement.

“If it is, I have said this many times before and I am saying this again. De Lima’s detention is in obedience to a lawful order of the trial court. De Lima and her lawyer/s were given their day

Virus fears infect global markets

M

arsman Estate Plantation Inc. (MEPI) and more than 600 agrarian reform beneficiaries have signed an 80% increase in the annual lease package making it P90,000 per hectare per year, inclusive of production incentive. This is by far the highest on record in the country’s agrarian reform program.

Victor Mercado Jr., MEPI President and Chief Operating Officer, said “the increase in rental from P50,000 per year was accommodated at the request of the ARBs under the Davao Marsman Agrarian Reform Beneficiaries-Multi-Purpose Cooperative (DAMARB-MPC).

The land that was distributed to the ARBs was donated by the company for free.

Under the latest amendment to the lease contract with the ARBs, the beneficiaries are now paid more than double the industry average of P30,000 to P35,000 per hectare per year.

This is a windfall for the ARBs, as MEPI even paid three years advance rental—from 2020 to 2022.

Mercado also offered the same benefits and terms to the other bene-

ficiaries who have not yet signed on to the lease contract. He said: “We would like everybody in the community to share in the fruits of the land without leaving anybody behind.”

The company expects the remaining 149 beneficiaries to sign the new lease deal. A total of 612 beneficiaries—or more than 80% of the majority— signed the fifth amendment to the Contract of Lease, where they declared that they ratify, defend and support the validity of the said agreement.

Aside from the company and the agrarian reform beneficiaries, the Provincial Agrarian Reform Coordinating Committees (PARCCOM) also participated in the negotiations.

Aside from rental income, MEPI also employs at least one member from

the beneficiary family and provides them and their families with education, healthcare, life insurance, retirement benefits, and other financial assistance.

MEPI, which is based in Sto. Tomas in Davao del Norte, has been engaged in the business of operating a banana plantation since 1969, with total plantation area of close to 2,000 hectares. It is part of the Marsman Drysdale Group which operates various businesses in the Philippines since the 1920s.

In compliance with the Comprehensive Agrarian Reform Law, MEPI opted to donate on September 26, 2000, about 800 hectares of land to its individual ARBs. The donation carried with it the condition that the company will be allowed to lease the land

selling a total of 1,645 units compared to December 2018’s sales of 1,516 units.

Commercial vehicle sales also went up by 1.71 percent to 119 units in December 2019 from 117 units a year ago.

On the other hand, sales of light commercial vehicles declined by 2.91 percent to 1,399 units last December from 1,441 units in the same month in 2018.

For the full year of 2019, HARI sales decreased by 6.1 percent to 33,763 units

from 35,956 units in 2018.

Both passenger car and light commercial vehicle segments registered decrements of 10.8 percent and 2.6 percent, respectively.

Passenger cars sold a total of 17,761 units in the previous year from 19,505 units in 2018, while light commercial vehicle sales went down to 15,095 units in 2019 from 15,496 units in 2018.

Hyundai’s commercial vehicle sales surged by 63.4 percent to 907 units

in 2019 from 555 units in the previous year.

Hyundai's Dec. 2019 sales in PH up 2.9%

HARI sold a total of 3,163 units in December 2019 from 3,074-unit sales in the same month in 2018.

The overall growth was supported by the 8.51-percent increase in sales of passenger cars last month,

President Rodrigo Duterte’s satisfaction rating soared to a record high and even United States President Donald Trump sang a different tune with an invitation to the supposed ‘banned’ leader.

The results of the Social Weather Stations’ December 13 to 16 poll showed that Duterte earned a net satisfaction score of “excellent” +72 in the last quarter of 2019. The new record-high “excellent” public satisfaction with the President’s performance has been called by government officials as proof that Filipinos are impressed with his “legacy of real change.”

Based on the latest SWS survey, around 82 percent of adult Filipinos expressed satisfaction with Duterte’s performance, while only 10 percent were dissatisfied and the remaining 8 percent were ambivalent on the matter.

The poll results yielded an “excellent” +72 net satisfaction rating, higher than seven points from September 2019’s “very good” +65.

The results also revealed an increase in satisfaction with the President’s performance across all geographic areas, as well as among all age groups, both men and women, and in urban and rural areas.

GENEHICHI ISHI’S TRANSPORT SUIT Issuance of franchise under the Commonwealth was very pro-Filipino such that even the Americans, enjoying the best during their occupation of the islands, had their rights greatly diminished. One of the celebrated cases cited in legal opinions affecting the issuance of franchise was the Genehichi Ishi vs. Public Service Commission (G. R. No. 45134).

Under Art. XIII, Sec. 8, of the 1935 Constitution, it states: No franchise, certificate, or any other form of authorization for the operation of a public utility shall be granted except to citizens of the Philippines or to corporations of other entities organized under the laws of the Philippines, sixty per centum of the capital of which is owned by citizens of the Philippines, nor shall such franchise, certificate, or authorization be exclusive in character or for a longer period than fifty years. No franchise or right shall be granted to any individual, firm, or corporation, except under the condition that it shall be subject to amendment, alteration, or repeal by the National Assembly when the public interest so requires.

In the case, the PSC, on December 18, 1929, granted to Ishi

a CPC to transport passengers in the Province of Davao on conditions that (i) the franchisee would not alter the manner of operating his car; (ii) he was not allowed to increase or decrease the number of cars operated or substitute them, such as changing the form of the carriage, and (iii) he was barred from using the franchised car for trip outside its zone of operation as authorized.

Moreover, the CPC issued to Ishi, the PSC ruled, “shall take effect on the date the same is issued and shall continue in force until further order to the contrary from [the] commission.”

Six years later, the Japanese subject filed another application with the PSC on October 23, 1935, seeking authorization to add another Ford automobile claiming the number of public utility vehicles serving the province of Davao could not meet the actual demand.

In an order dated February 14, 1936, the PSC, citing the 1935 Constitution, invoked the provision that only citizens of the Philippines or corporation and entities registered under the laws of the country, with sixty percent ownership by Filipinos, can be issued a franchise, certificate or other form of authorization to op-

erate a public utility. Dissatisfied with the PSC decision, Ishi, filed a petition for a writ of certiorari against the order.

The Supreme Court, in sustaining PSC’s decision, ruled on September 10, 1936, stating: “The question presented is whether petitioner’s application for an increase of his equipment comes within the constitutional prohibition contained in section 8, Article XIII of the Constitution of the Philippines, it appearing that petitioner had been granted, before the Constitution took effect on November 15, 1935, a certificate of public convenience to operate an automobile ‘Ford’ for transportation of passengers in the province of Davao. We must answer the question in the affirmative. Petitioner is admittedly not a citizen of the Philippines, nor a corporation sixty per centum of the capital of which is owned by citizens of the Philippines.

“His application for an increase of equipment may not call for the granting of a new franchise or certificate, but it certainly calls for an ‘authorization’ the granting of any form of which is limited by the Constitution to citizens and corporations above mentioned.

This was clearly admitted by the

petitioner himself when he made the averment in paragraph 3 of his petition for a writ of certiorari that in filing below the application which was afterwards denied by the respondent Commission, he sought for “authority” to increase his equipment. In other words, it is conceded by petitioner that he may not increase his equipment without previously being “authorized’ to do so by the respondent Commission, as provided in express terms in his certificate of public convenience. The phrase ‘any other form of authorization’ used in sec. 8, Article XIII, of the Constitution is comprehensive enough to include the “authority” asked for by petitioner.

“The Constitution provides for the nationalization not only of national resources and all forces of potential energy but also of public utilities, saving solely those rights which were acquired prior to its adoption. This was one of the avowed purposes of the framers of that fundamental law, as declared in its preamble.

We cannot agree to the suggestion that because petitioner is the lawful holder of a certificate of public convenience to operate an automobile ‘Ford’ in the province of Davao, he has a vested right to be authorized to increase

his equipment by the addition of one or more cars. The challenged order of the respondent Commission is in conformity both with the letter and spirit of the Constitution and it must be upheld.”

Commonwealth Act 146, the amended ‘The Public Service Act’ approved on November 7, 1936, further delineated PSC’s authority. The statute was ‘an Act to recognize the Philippine Service Commission, prescribe its powers and duties, define and regulate public services, provide and fix the rates and quota of expenses to be paid by the same for other purposes.’ As to the petition for certiorari, the high court ruled: “The allegations of the petition fail to state that the respondent exceeded its jurisdiction in issuing the order in question.

They do not, therefore, justify the issuance of the writ applied for, in accordance with section 35 of Act No. 3108, as amended. The proper remedy would have been to apply for the review of the disputed order in accordance with said section 35 of said Act. Before disposing of the case, this court deems it advisable, however, to state its opinion on the constitutional question raised in order to decide the case once and for all.”

He was right, damned right.

“Of all the preposterous assumptions of humanity over humanity, nothing exceeds most of the criticisms made on the habits of poor by the well-housed, well-warmed, and well-fed,” American novelist Herman Melville reminded.

It simply means that when you criticize some be sure you know who you are putting in the limelight. I was reminded of an anecdote which was published in Reader’s Digest. There was this well-known New York photographer who went to a socialite party. On his way in, the hostess told him, “Oh I love your photos; you must have an amazing camera!”

The photographer never replied. And so they had dinner and at the end of the night, on his way out, the photographer commented to the hostess, “I really loved the food; you must have an amazing stove!”

“Criticism of others is thus an oblique form of self-commendation,” Fulton J. Sheen wrote in Seven Words of Jesus and Mary: Lessons from Cana and Calvary. “We

think we make the picture hang straight on our wall by telling our neighbors that all his pictures are crooked.”

To criticize means, according to my dictionary, is “to find fault with” or “to point out the faults of.” But criticism also means “to consider the merits and demerits of and judge accordingly.”

The usually unflappable Winston Churchill could handle almost anything in life; he endured the chaos and terror of World War II without losing his cool. But at least there was one event in his life that had a humbling effect on him; that was when he encountered Lady Nancy Astor, the first woman to sit in the British House of Commons.

At that time, the two were staying with Churchill’s cousin, the Duke of Marlborough, at Blenheim Palace. During the dinner, Lady Astor told the British prime minister: “Winston, if I were your wife, I’d put poison in your coffee.”

He looked her straight to the eyes and remarked, “Nancy, if I were your husband, I’d drink it.”

But there’s a Filipino version to that. In a party, a woman told a young man who imbibed too many drinks. “You are drunk,” she said. The young man mumbled but still managed to say, “Tomorrow, I will be sober, but you will still be ugly!”

Their exchange of words may be funny but what if you were the recipient of such offending words?

What if someone will tell you any of the following statements: “Your work put a first grader to shame” (which actually means you don’t know what you’re doing) or “Your acting is no brainer” (another way of saying “It’s boring”).

Some people criticize others because the recipients are better than the critics themselves.

Remember the movie Bituing Walang Ningning, where singing sensation Cherrie Gil told the upcoming phenomenal Sharon Cuneta: “You’re nothing but a second rate, trying hard copycat.”

There are two sides of a coin; the same is true with criticism: it is either bad criticism or good criticism. If someone criticize you, think it over. Study how the person said it and ponder whether what he is saying is true or not.

“Criticism may not be agreeable, but it is necessary,” Sir Winston Churchill pointed out. “It fulfills the same function as pain in the human body. It calls attention to an unhealthy state of things.”

American President Theodore Roosevelt explained it further with these words: “It is not the critics who counts; not the man who points out how the strong man stumbles, or where the doer of deeds could have done better. The credit belongs to the man who is actually in the arena, whose face is marred by dust and sweat and blood, who strives valiantly; who errs and comes short again and again; because there

is not effort without error and shortcomings; but who does actually strive to do the deed; who knows the great enthusiasm, the great devotion, who spends himself in a worthy cause; who at the best knows in the end the triumph of high achievement and who at the worst, if he fails, at least he fails while daring greatly. So that his place shall never be with those cold and timid souls who know their victory nor defeat.”

In most instances, even if you have given your best and done what you think is right, there are always those who will find fault on what you have accomplished.

But don’t be discouraged. Listen to the words of American First Lady Eleanor Roosevelt: “Do what you feel in your heart to be right – for you’ll be criticized anyway.

You’ll be damned if you do, and damned if you don’t.”

To those people who always criticize you, here’s a tip from French moralist and essayist Joseph Joubert. There was this man who interrupted one of Buddha’s lectures with a flood of abuse.

Buddha waited until he had finished and then asked him: “If a man offered a gift to another but the gift was declined, to whom would the gift belong?” The man replied: “To the one who offered it.”

Buddha told the man: “I decline to accept your abuse and request you to keep it for yourself.”

But there are those who crit-

icize you in order for you to be better and to give your very best.

“We need very strong ears to hear ourselves judged frankly, and because there are a few who can endure frank criticism without being stung by it, those who venture to criticize us perform a remarkable act of friendship, for to undertake to wound or offed a man for his own good is to have a healthy love for him,” French philosopher Michel de Montaigne said.
