5 villagers injured in grenade attack

ive persons were injured here when an unidenti�ied man tossed a hand grenade in a house where a village of�icial was dining with friends Friday night, police said.

Chief Inspector Julius Malcontento, Carmen town police chief, said the grenade attack transpired in a house in Purok Pag-asa, Barangay Gen. Luna, Carmen, North Cotabato at about 6:45 p.m.

Religious leaders, civil society vow to hold interfaith dialogue

fforts to foster interfaith dialogue will continue despite attempts by “militants to drive a wedge among our respective religions and to paint a renewed war of religions,” religious and civil society leaders said in a statement signed in Iligan City Thursday.

The signatories were referring to the Marawi siege staged by the Islamic State-inspired Maute group which entered its 60th day on Friday.

“We will not tire in do-

Congress votes to extend Martial Law until yearend

he Philippine Congress, during a special joint session on Saturday, voted to extend the period of martial law until the yearend.

Results of the joint voting showed that 261 lawmakers voted in the af�ir-

mative while 18 lawmakers voted in the negative.

On the part of the Senate, 16 senators voted in favor of the motion, while four were against it. Meanwhile, 245 House members approved the motion, while 14 rejected it.

In the Senate, it was Senator Gringo Honasan who motioned to extend the period of martial law to �ive months.

The senators who voted against Honasan’s motion were Senate Minority Leader Franklin Drilon, Senators

Paolo Benigno Aquino IV, Risa Hontiveros and Francis Pangilinan.

PCL chair Dayanghirang supports extension of ML

ouncilor Danilo C. Dayanghirang, chairman of the the 16,000-strong Philippine Councilors League, said he strongly supports the extension of martial law in Mindanao as announced by President Duterte.

President Duterte declared the entire Mindanao under martial law last May 23, following clashes between government troops and terrorists

The proclamation, effective for 60 days, is set to end on July 18. However, on July 18, the President called on Congress to extend martial law in Mindanao until December 31 of this year.

of terrorism and rebellion.

“The people of Mindanao has been suffering from this violence for a long long time now and they are hoping that under President Duterte this violence will be minimized if not totally eradicated,” said the veteran legislator.

He said that the eventual solution to the lingering problem will pave the way for the development of Mindanao

“Filipinos would enjoy more disposable income that will enable them to avail themselves of insurance products, be it micro insurance or regular, and consequently contribute to the improvement of �inancial inclusion in our country,” Funa said.

Finance Secretary Carlos Dominguez III has pointed out that the tax reform agenda being pushed by the Duterte admin-

istration seeks to end “decades of unjust taxation that polarized wealth rather than distributed it,” in proposing to shift the tax burden from the lower 99 percent of the country’s population to its wealthiest one percent.

Filipino-owned supermarket chain is opening more stores in Mindanao by the end 0f the year.

irAsia Group Chief Executive Of�icer Tony Fernandes has announced a Davao City- Kuala Lumpur direct route, which will start on December 21 this year.

“We believe Davao has the potential to be the international gateway for ASEAN to the southern Philippines, beginning with this new route to Kuala Lumpur.”

Fernandes said during his speech at the 2017 Davao Investment Conference held today at SMX Davao.

“We can open up Davao to the world, we

verybody has – and needs – blood pressure. Without it, blood can’t circulate through the body, giving vital organs the oxygen and food they need.

Under normal conditions, our heart beats about 60 to 80 times a minutes. Our blood pressure rises with each heartbeat and falls when our heart relaxes between beats. Like the air pressure in tires, our blood pressure can change from minute to minute.

The pressure in tires depends on the temperature and whether you’re driving. Our blood pressure changes with posture, exercise, sleeping, or even the level of our arm when the blood pressure is measured.

A booklet from a blood pressure monitor gives this information: “Your level of blood pressure is determined in the circulatory center of the brain and adjusts to a variety of situations through feedback from the nervous system. To adjust blood pressure, the strength and frequency of the heart, as well as the width of circulatory blood vessels is altered.

Blood vessel width is affected by �ine muscles in the blood vessel walls.”

A blood pressure measurement has two numbers: (1) the higher (systolic) number represents the pressure when the heart contracts and (2) the lower (diastolic) number represents the pressure when the heart relaxes between beats.

The systolic pressure is always stated �irst, and the diastolic pressure second. For example, a blood pressure of 120/80 is stated “120 over 80.”

The systolic is 120; the diastolic is 80.

“When you’re sitting at rest, your blood pressure should be lower

than 130/85 millimeters of mercury (mm Hg) to be considered normal,” informs the book, To Your Health: A Guide to HeartSmart Living, published by the American Heart Association. “A blood pressure reading equal to or higher than140/90 is considered high. Therefore, if your systolic pressure is 130 to 139 or if your diastolic pressure is 85 to 89, it should be watched carefully.”

Just recently, I was admitted in a hospital.

On my second day, the nurse was alarmed when my blood pressure shot up to 150/110. Ten minutes later, she checked my blood pressure again and it was still the same measurement.

“Poor diet, lack of exercise, heavy-duty weight training, even innocuous-sounding activities such as public speaking can make your blood pressure leap,” notes The Doctors Book of Home Remedies. “But when your blood pressure goes up and stays up, that’s cause for concern.”

One in four Filipino adults One in four Filipino adults has high blood pressure or hypertension, according to a national survey. Half of those people who reach the age of 60 are most likely have hypertension, warns Dr. Willie T. Ong, author of Doctors’ Health Tips and Home Remedies.

“High blood pressure, if uncontrolled, can be a deadly disease,” points out Dr. Ong, an internist and cardiologist. “It’s unfortunate that many people do not take the necessary steps to control it.”

In 95% of patients, the cause of high blood pressure is unknown.

“We call this primary or essential hypertension,” explains Dr. Ong. “In

these patients, we can still treat and control the hypertension by addressing some of the risk factors involved. The risk factors we can still change include being overweight, cigarette smoking, high salt consumption, lack of exercise, excessive alcohol intake, and use of oral contraceptives.”

In the remaining 5%, the high blood pressure is due to a speci�ic disease such as kidney disease, illegal drug use, hyperactive thyroid or a tumor.

“We call these cases as secondary hypertension,” Dr. Ong says.

Doctors, however, don’t differentiate between primary and secondary hypertension, because some secondary causes can be completely cured if the main culprit is being addressed. “One clue that we are dealing with secondary hypertension is when a young apparently individual suddenly develops very high blood pressure.”

Dr. Julian Whitaker, author of Reversing Hypertension: A Vital New Program to Prevent, Treat and Reduce High Blood Pressure, wrote: “Secondary hypertension is serious business, but its underlying causes can often be corrected. Don’t forget that it accounts for only 5-10% of all cases of hypertension.”

Dr. Ong also talks about the “white coat hypertension,” which happens when a patient is at a doctor’s clinic and his blood pressure goes up.

But when his back at his home, the blood pressure goes back to normal.

“We label these cases as ‘white coat hypertension,’ which means that the patient’s blood pressure shoots up upon seeing the doctor’s white coat,” Dr. Ong says. “No treatment is given to such patients except reassurance and occasional

monitoring of the blood pressure.”

If the blood pressure is not controlled and lowered down to normal levels, a person may likely end up having a heart attack. “Hypertension hurts the heart by pushing it to the limits,” Dr. Whitaker wrote. “Years of overexertion cause the heart to become weak and damaged – the pump just wears out.”

Risk factor Hypertension is the leading risk factor for heart attack. Medical science claims that 50% of all heart attack patients die before reaching the hospital. But studies show that the sooner the patient is brought to the hospital, the better are the chances of survival.

“A heart attack occurs when the blood �low of that carries oxygen to the heart muscle is blocked because of clogged arteries,” Dr. Ong explains.

“The heart muscle cannot survive with poor oxygen supply and begins to die.”

Hypertension is also the primary factor in stroke, the second leading cause of death in the Philippines after heart attack. Around the world, the statistics on the prevalence of stroke is staggering. “One in six people worldwide will have a stroke in their lifetime,” deplores Dr. Romulo Esagunde, a neurosurgeon and board member of the Philippine Society of Ultrasound in Clinical Medicine Inc. “Every six seconds, stroke kills someone; and every other second, stroke attacks a person regardless of age or gender.”

There are two types of strokes: ischemic and hemorrhagic. “Ischemic strokes happen when a blood clot (thrombus) or a fatty deposit blocks an artery supplying blood to the brain,” the US-based World Heart Federation

points out.

“About 80 percent of strokes are ischemic – due to a blocked artery,” explains The Merck Manual of Medical Information. “Brain cells, thus deprived of their blood supply, do not receive enough oxygen and glucose (a sugar) which are carried by blood.”

The other 20 percent of strokes are hemorrhagic – due to bleeding in or around the brain.

“In this type of stroke, a blood vessel ruptures, interfering with normal blood �low and allowing blood to leak into brain tissue,” the Merck manual explains. “Blood that comes into direct contact with brain tissue irritates the tissue and can cause scarring, leading to seizures.”

A lesser-known outcome of hypertension is memory loss and an increased risk of dementia and Alzheimer’s disease.

“The adverse effects of hypertension on mental functioning have been veri�ied in several largescale studies,” Dr. Whitaker wrote. “It is believed that hypertension’s adverse effects on the brain are caused by the relentless pounding on the small vessels in the brain.”

Hypertension also accelerates the aging of the kidneys. “High blood pressure damages the arteries and arterioles that supply blood and nutrients to the kidneys,” Dr. Whitaker wrote. “As the arteries become stiff and less elastic, blood supply to the kidneys is reduced or, in some cases, cut off, causing damage to the kidneys themselves.”

Maintenance medicines Those who are diagnosed of having hypertension are advised to take maintenance medicines, which are classi�ied into A, B, C and D, accord-

ing to Dr. Ong. A stands for ace-inhibitors, whose generic names end with the common syllable “—pril” (Enalapril, for instance).

“Ace-inhibitors are a must for hypertensive patients with diabetes or heart failure,” Dr. Ong says. Some people who take this develop cough.

Should this happens, the doctor may prescribed him angiostensin receptor blockers as alternative; generally, they end with the syllable “—sartan”” as in Losartan.

B is for beta-blockers.

“These drugs end with “—olol,” like metroprolol or atenolol. “In addition to having multiple bene�its (also used in treating heart attack, angina, palpitations and migraine), they are also cheap,” Dr. Ong says. The negative side: they jeopardize the sexual performance of virile middle-aged men.

C stands for calcium antagonists. “They are the most powerful drugs at the doctor’s disposal,” says Dr. Ong of the drugs which usually end with the syllable, “—pine” (Amlodipine is one example). These drugs can reduce very high levels of blood pressure without interfering men’s sexual prowess.

D is for diuretics. “Recent studies have shown that they may be as bene�icial as the more expensive calcium antagonists,” Dr. Ong says. “Elderly patients respond well to low doses of diuretics but we have just to watch out for potassium depletion.

So if you’re taking diuretics, take two bananas a day just to be safe.”

How long should these drugs be taken?

“Mild cases of high blood pressure may still respond with a change in lifestyle,” Dr. Ong says.

“But more severe cases, treatment is for life.

PSC’s ‘heart of gold’ sparkles when needed most for Marawi

L

ast week, two images about Marawi City came out on social media.

One (which was partly shown on TV) showed at least two armored personnel carriers coming to the aid of a wounded army combatant in the midst of the Marawi �ighting.

Leading the rescuers was a familiar face, B/Gen. Alexander Macario who was inside one of the vehicles that plucked the wounded soldier to safety. The young general you see was the son of my former high school teacher in high school, Ornis Macario, in my hometown, La Trinidad (Benguet).

The older Macario soon left teaching, joined the army and fought in Mindanao when Marcos declared Martial Law. He has retired as a colonel and travels every now and then to the United States to visit some of his children.

n life, nothing is permanent, your strength, wealth, position, fame, everything. In life nothing is sure to come too. Nobody owns tomorrow in order to truly promise or expect anything. In all these truths about the �leeting nature of things, everything is uncertain they say, except death and taxes.

But let us talk about the �irst thing because taxes were not even heard of by our ancestors. It is pretty much a recent invention by human society in order to facilitate services rendered by a central government in one form or another. But death, death has been known by humans ever since. From the earliest human, each one has tasted death or shall taste death. Even Prophet Jesus – peace be upon him, although he may have been raised by Allah to the heavens alive, he will be back on Earth in the last days to establish God’s law, live a normal life, have a family and die.

Allah said in the Quran, “Everyone shall taste death.” Quran 3:185 In many different ways, people prepare for death differently. Because they see it as the end of things for them so they save the best for last so to speak. Some ready their wills so that their properties get transferred to their heirs properly. Some avail of lavish memorial plans to make sure that they get the best cof�in, the best suit, the best

The PSC had earlier decided to host the games after Brunei pulled out in June due to lack of infrastructure.

But evidently after looking at the bigger picture, the PSC decided it cannot go on bankrolling the games when Marawi lies in crumbles and is crying for deliverance.

It reminds me partly of 2009 when the province of Benguet scuttled its foundation anniversary festivities in deference to the hundreds of people who perished due to massive landslides trig-

gered by Typhoon Pepeng.

It is a golden act by the PSC in favor of the greater good. Why am I not surprised by the PSC decision? Truth to tell, the PSC under Ramirez has been one of the golden spots of the Duterte administration with its determination to implement grassroots sports and to weed out corruption in Philippine sports.

Ramirez’ order for sports associations to give an accounting of all �inancial assistance provided them by the PSC must have come as a shocker as it was unexpected.

Consequently, his determination to implement grassroots sports has seen the PSC evolve as one of the busiest agencies. After a national conference in Tagaytay where it reviewed its mandate and spelled out its vision for Philippine sports, the PSC went the rounds in the provinces going as far as Ifugao and Benguet in drumbeating grass roots.

vice-chair Ghazali Jaafar with whom he shared the vision of the PSC ‘for an inclusive sports that will include our brother Moros in the Sports for Peace program.’

Jaafar welcomed him like a long lost brother and the result was that PSC came up with a plan to designate a sports coordinator inside the MILF camp for MILF youth and adults.

This again is a novelty that has not been attempted before.

Ramirez’ off-repeated exhortation to develop grassroots roots as the one that matters most is the battle-cry that is bound to overturn Philippine sports years from now.

We may not see its immediate results but with PSC’s infrastructure in place in the different regions, there is reason to believe that the foundations for the ‘golden age of Philippine sports’ has been �irmly planted on the ground.

And just like any good tree, the fruits are bound to be plentiful and palatable in their own sweet time. (JKL)

In fact, nothing material he ever had in this world will be bene�it of him except for what Prophet Muhammad said, “When the son of Adam dies, all his deeds will be cut off except from these three. Charity that was given which are people continually bene�it from, knowledge which was shared and bene�it the people and a good child that prays for him.” Narrated by Imam Muslim.

In the grave, the human will be questioned of who was his Lord, his prophet and his religion and there he will be punished for giving the wrong answer. He will also be given a taste of Paradise if he is amongst the righteous as a window showing Paradise will be opened for him in the grave or a window showing hell�ire if he is amongst the sinners even if he is a Muslim. While in the Barzakh, the human will remain there without his consciousness and he will regain his consciousness only at the time of resurrection.

And when the time of resurrection comes, that would be a day of horror as each one of us rise from the grave and we are all gathered together in an unfamiliar place. That is something that no horror movie could ever replicate.

Prophet Muhammad said,

“You will be gathered barefoot, naked and uncircumcised.” The wife of the Prophet asked, “O Messenger of Allah, the men and women will be looking at each other?”

Prophet Muhammad said, “The situation will be so terrible that he will not be concerned with that anymore.”

Narrated by Imam Al Bukhari.

And after the resurrection, the measuring of good and bad deeds will begin. The best of good deeds is to worship Allah alone without partners while the worst of bad deeds is to worship others other than Allah. Then all the other good deeds and sins shall be measured too.

After the recompense, one may be entered into Paradise or thrown into Hell�ire and the ultimate justice is served by the most just of all judges, Allah himself. And upon entering Hell�ire or Paradise, the human will stay there forever except in the cases of sinning Muslims who did not worship any other gods besides Allah. He may stay in Hell�ire for some inde�inite time to purify him and he shall be allowed entry to Paradise later on.

Thus, the Muslim prepare for death and gladly welcome it by doing as much good deeds as he could.

Muslims believe that in death, Allah takes away the spirit that is the real basis of the life of humans. That is why humans can’t simply give life back to the dead or make a living person out of dead human body parts like Dr. Frankenstein did by charging it with electricity. The living human body is simply more than the sum of all its parts or the product of all its parts multiplied with each other. God’s work is so complex that the knowledge of the whole human race put together will never match his. Allah said in the Quran, “And they were never given any knowledge except for what Allah has allowed them to be given.” Quran 2:155.

Upon death, no one could do any more harm or bene�it to one’s self and every deed he has done while being alive will pretty much dictate what outcome he would end up with in the rest of his Afterlife after Judgement day.

That is why a Muslim burial is the simplest of all. Muslims who are buried Islamically are buried in simple dirt holes in the ground covered by soil which is left unmarked without any

The Martial Law in Mindanao will be put into consideration because security is essential for businesses there are several factors that must be considered such as business opportunities and potential partners, he said.

He said other factors are long term and that hopefully, the con�lict will be short term.

FEBBIE FAITH RAMOS Her journey as Mutya Ng Tagum 2016

By OLAN EMBOSCADO THE STARS SHONE DOWN on that beautiful night of November 17, 2016 as the Music Capital of Davao Region, the City of Tagum, crowned its new ambassadress of goodwill.

For many, it was simply a night of glitz and glamour but for the beauty and brains Febbie Faith Ramos, the reigning Mutya ng Tagum City who bested other nine candidates, that night was a life-changing moment and a beginning of her new journey as the city’s symbol of beauty, grace and goodwill.

Febbie is a teacher by profession. And being an educator, she devoted her time for her chosen craft and joining beauty contests has never been her priority. In fact, joining last year’s Mutya ng Tagum was her first.

But her genuine desire to help her community through the environmental advocacy of the pageant motivated her to join the competition and represent her barangay – Magugpo East.

By winning, she can have her environmental project implemented in her community.

Although a bit hesitant, her curiousness to learn more things outside of the four corners of her classroom also challenged her to join Tagum City’s most prestigious beauty pageant.

The competition was intense as all the girls did their best to showcase their exceptional beauty, classy wit and grace. But just like what everybody says – there can only be one winner.

Febbie’s beauty, charm and wit brought her to what she never expected – to bring home the crown and reign for one year.

What a graceful win for a first timer like her.

Febbie also bagged the Best in Talent award and her environmental project was chosen as the Best in Project Proposal.

Now being the city’s Ambassadress of Goodwill, she is taking part of the City Government’s

community programs and environmental projects.

What is “Mutya ng Tagum” to you?

Febbie Faith Ramos: “Genuine Beauty with a strong advocate.” I firmly believe that a beauty queen should always transcend beyond her title. That beyond winning a competition is the urge to be a catalyst for change. Mutya ng Tagum for me is a holistic woman who appeals Tagumeños with her helping hand, sound mind and caring heart.

What were your preparations before joining the pageant?

To be honest, I didn’t prepare that much because of time constraints with my work. Even when the pageant was fast approaching, I have to prioritize my students first. But knowing that it was a first for me, I have to start from the scratch in an extremely limited amount of time – the posture, the confidence, the body figure, the talent portion, the Q & A and especially the walk. I was able to do this seemingly impossible task through the help of my handler, Ms. Michelle Sy, my co-candidates especially to Gay Ann and Princess Jade and the organizers of the Mutya ng Tagum 2016.

How relevant beauty pageants to today’s modern times?

In the advent of time, women were known to be just a part of the second class. Through the rise of the feminists, women were given equal rights same as that of men. One activity that pursues the empowerment of women is a beauty pageant – an event of self-expression for women. Today, there are over 86 countries who participated in the latest Miss Universe.

This is a concrete manifestation that pageants can be seen as a social gathering to promote camaraderie among countries.

Beauty pageants are more than just a show. It can be a platform of women empowerment and global relationships.

What have you become after being crowned as the Mutya ng Tagum 2016?

After Mutya ng Tagum 2016, I have become a more confident woman. I always see this endeavor as more than just an event… this was actually a journey for me. This was my journey of being a shy little caterpillar towards a learned and Do you have planned or lined-

up activities as part of your job being the Mutya ng Tagum 2016?

As of now, most of my job entails hosting events – to which I absolutely love! I hope that I will still be given many speaking engagements because I love improving myself for the better.

As the reigning Mutya ng Tagum, how can you promote Tagum City as a tourism destination in Davao Region?

I plan to promote Tagum City through hosting meaningful events like Musikahan or Ugmad (to name a few) I want to showcase the city’s confidence in creating inciting moments for its people and its visitors. I want to exhibit the city’s hospitality and versatility. That in any event, the city is working as one body and one family therefore showing to the whole world that we are one – ultimately high-

lighting that it’s most fun here in Tagum City.

What is your message to the people of City of Tagum and to those reading this article?

To our readers: Making mistakes are essential to be a better person. Keep in mind that you should respond to your lapses for improvement instead of reacting to it poorly – you’ll be attracting unwanted negative energy. Take it from me, a candidate who joined a city-wide pageant without any prior experience.

“Class Project” features documentaries produced and created by college students, starting with projects by the students at Colegio de San Juan de Letran.

Among the documentaries to be aired are “Tahan Na,” about the orphans of SOS Children’s Village. The SOS Children’s Villages is a private, non-political, nondenominational organization that provides long-term family-based care to children in need, and “Tahan Na” tells the story of some of its residents. The documentary depicts how the orphaned children have found their permanent home in the village, with their fellow orphans becoming family and the house mothers becoming their own surrogate mothers.

Other documentaries include “Triple Kayod,” which follows a father juggling three different jobs to support his family, and “Haligi,” which features a father and son as they ride through the streets of Manila in their pedicab.

According to Danie Sedilla-Cruz, channel head of Knowledge Channel, the project aims to give the spotlight to relevant social issues while giving a platform to student producers and content creators who come up with high-quality content for broadcast. The partnership with Colegio de San Juan de Letran will be the first in a series of tie-ups with different schools.

“As the title already implies, there are so many class projects like documentaries, especially by communication students, that are well-produced and should be shared,” says Sedilla-Cruz.

The project aims to give students at the collegiate level opportunities to showcase their work while making use of Knowledge Channel’s platform of educational television. The series will be airing student-made documentaries throughout the coming school year.

Asks errant workers to mend their ways P resident Rodrigo Duterte has assured businessmen that the Philippines is “fundamentally peaceful”.

“The �ight in Marawi would soon be over,” Duterte said in his speech at the Davao Investment Conference 2017 held at the SMX Convention Center here Friday.

He further said that he wants errant government workers who were named through his complaint hotline 8888 to kneel before the public and vow not to repeat their mistakes.

Duterte said he would want to talk to the errant government employees in Malacañang.

“You there, you resign or get out from your authority if you cannot get out of government service, or I resign,” he said.

“But you have to kneel down before the public, and you have to promise the people that we are serving that you have to improve your service.”

Duterte also reiterated his call to the public to assert their rights and lodge complaints against government employees who are giving them a dif�icult time.

“Report to me the name. Name the employee publicly. I will protect you,” he said.

The president however asked the public to

Dimpas represented to the Plaintiffs that his title is clean from any encumbrances as shown by the original copy of his Owner’s Duplicate Copy of TCT No. T-365616, the custody of which he turned over to the Plaintiffs. Trusting on his representation, Expedita agreed to buy the property and name it after her son, Benjamin B. Luy. However, when the deed of absolute sale was presented for registration with the Registry of Deeds for Davao City after going through the process of paying the requisite taxes and expenses for transfer, notarial fee and updating of real property taxes in the total amount of P 172,504.41, registration thereof was denied in view of the subsisting notice of lis pendens annotated by the necessary Defendants-Spouses Sotto who filed with RTC, Branch 16, Davao City, a case for nullification of deed of absolute sale and TCT No. T-395616 of Victor Brian E. Dimpas that Plaintiffs only learned for the first time.

6. Since then, Plaintiffs refused to pay the balance of the purchase price until the Principal Defendant can show proof he won the case with RTC-16 with finality. While, the nullification case was pending, Defendant Victor Brian went away to Norway for good with the P 1,040,000.00 partial payment of the Plaintiffs without leaving behind any property or forwarding address in fraud of creditors.

7. Lately, Plaintiffs got hold of a copy of the Writ of Execution in Civil Case No. 30,453-04, the substance of which states: “Pursuant to Court Order dated October 30, 2015, granting the issuance of writ of execution, you are hereby commanded to execute the Decision of this Court dated May 25, 2015, the dispositive portion of which is hereto quoted: WHEREFORE, premises considered, judgment is hereby rendered as follows:

SO ORDERED.” 8. This RTC-16 Decision has rendered legally ineffective and of no force and effect the deed of absolute sale that legally excused Defendant Victor Brian E. Dimpas from performing his contractual obligations with the Plaintiffs without the latter’s fault or participation to the irreparable damage and injury of the Plaintiffs. Worse, Plaintiffs are not made parties to the case yet they are made to face the legal consequences of the decision as they are currently in physical possession of the property and the owner’s duplicate copy of the certificate of title of Victor Brian E. Dimpas with nos. T-395616.

9. Plaintiffs have no other legal recourse except to sue for rescission of the aforesaid Agreement to Sale and Deed of Absolute Sale on the ground of solutio indebiti or unjust enrichment on the part of Victor Brian E. Dimpas at the expense of the Plaintiffs. He is lucky to have been awarded by RTC-16 with refund of P 2,000,000.00 with legal interest from the Sotto spouses which is the amount he paid to Security Bank. At the same time, he got away with the P 172,504.41 Plaintiffs incurred for unsuccessfully processing of their title and for updating the real property taxes and P 1,040,000.00 that Plaintiffs unduly paid Victor Brian as partial payment of the property if he is not ordered by the Honorable Court to return the said amount to the Plaintiffs with legal interests from the date of execution of the sale on May 10, 2013.

SECOND CAUSE OF ACTION FOR DAMAGES 10. Article 2154 of the Civil Code mandates that if something is received when there is no right to demand it and it was unduly delivered through mistake, the obligation to return it arises (Titan-Ikeda v. PPGI, G.R. No. 158768, February 12, 2008). Here, there was a mistake on the part of the Plaintiffs when they paid Defendant Victor Brian with P 1,040,000.00 as partial payment of the property because of his fraudulent misrepresentation and for acting as a seller in bad faith. He concealed from the Plaintiffs the notice of lis pendens as he managed to secure an owner’s duplicate copy of TCT No. T-365616 in his name free from any liens and encumbrances despite the existence of the notice of lis pendens annotated on the original copy of the certificate of title found in the registry. It is in order that Plaintiffs be awarded with actual damages in the form of restitution of the P 1,040,000.00 down payment plus P 172,504.41 real property taxes and other expenses incurred by the Plaintiffs on the property.

11. As a result of the misrepresentation and bad faith on the part of Victor Brian E. Dimpas, the Plaintiffs were made to suffer the consequences of the RTC decision that could deprive them of their right of possession once a writ of possession is issued in Civil Case No. 30,453-04. This predicament has caused them to suffer sleepless nights and mental anxiety that entitles them to moral damages in the amount of P 400,000.00 and P 400,000.00 exemplary damages to set an example for the public good not to replicate what Victor Brian did to them. In the alternative, Plaintiffs also pray for temperate damages at such amount to be determined by the court in the event the court is unsure what damages to award the Plaintiffs.

THIRD CAUSE OF ACTION FOR ATTORNEY’S FEES 12. Because of this predicament of the Plaintiffs, they are constrained to engage the services of counsel to protect their rights and interest for a fee of P 50,000.00 as acceptance fee and another P 50,000.00 as bonus fee plus P 2,500.00 appearance fee every time counsel will appear in court for which they pray to be awarded with pursuant to the Civil Code.

GROUNDS RELIED UPON FOR URGENT ISSUANCE OF THE ANCILLARY RELIEF OF PRELIMINARY ATTACHMENT EX PARTE 13. The Plaintiffs have a good cause of action for rescission, damages and attorney’s fees against Victor Brian E. Dimpas who is a non-resident of the Philippines who left the country for Norway in fraud of creditors with foreign address at Rune Olavsbraten Gol, Norway and on whom summons maybe served by publication. This justifies the issuance of the ancillary relief of attachment within the contemplation of Section 1 (e), Rule 57 of the Rules of Court.

14. He left the country to avoid prosecution for the fraudulent sale he entered into with Security Bank and the Plaintiffs and to avoid or escape the legal consequences of the aforesaid RTC decision rendered against him and Security Bank.

15. He defrauded the Plaintiffs when he sold the property to them in bad faith by not disclosing the pendency of the court litigation initiated by the Sotto Spouses involving the subject property. He did it by misrepresenting to the Plaintiffs that his owner’s duplicate copy of his title is clean from any notice of lis pendens. It turn out later it is involved in litigation that Plaintiffs only learned for the first time when their deed of absolute sale was refused registration by the Registry of Deeds for Davao City.

Photocopy of the Affidavit of Preliminary Attachment of the Plaintiffs is herewith attached Annex “B” to substantiate the legal ground for issuance of the ancillary relief of attachment.

16. The market value of the land and building subject matter of this case is P 871,500.00.

17. Of late, Plaintiffs received confirmed report that the Sotto spouses deposited for the account of Victor Brian E. Dimpas sufficient amount with the Office of the Clerk of Court, Regional Trial Court, Davao City in satisfaction of the RTC-16 DECISION and WRIT OF EXECUTION, rendered and issued for and against the said Defendant Victor Brian E Dimpas. There is no other sufficient security for the claim sought to be enforced by the action that the Plaintiffs can think of except the said consigned amount, and that the amount due to the Plaintiffs-applicants, or the amount consigned with the Office of the Clerk of Court, RTC, Davao City for which he is entitled to recover, is as much as the sum for which the order of attachment is granted above all legal counterclaims that Victor Brian E. Dimpas and Sotto-spouses may interpose against the Plaintiffs.

1. DECLARING the final Certificate of Sale on TCT No. T-254886, NULL and VOID;

18. Plaintiffs can readily produce the requisite attachment bond from Alpha Insurance to await issuance of the court’s order granting the ancillary relief of attachment to show Plaintiffs’ willingness to put up the same in compliance with the rules.

2. DECLARING the derivative titles under TCT No. T-369033-in the name of SBC then to TCT No. T-365616- in the name of Victor Brian E. Dimpas, NULL and VOID;

19. The issuance of the ancillary relief prayed for by the Plaintiffs maybe granted ex parte according to the Supreme Court in the case of Toledo vs.

20. The issuance of the desired ancillary relief is impressed with utmost urgency before Victor Brian E. Dimpas will have the opportunity to withdraw the amount consigned by the Sotto spouses with the Office of the Clerk of Court, RTC, Davao City in his favor.t PRAYER WHEREFORE, it is respectfully prayed of this Honorable Court that upon the filing of this Complaint and before this case may be heard on notice, a Writ of Preliminary Attachment upon posting of the Attachment Bond, be issued forthwith, ordering the executing sheriff or any officer of the law to attach, seize and/or garnish the bank deposits, monies and properties of the Defendant Victor Brian E. Dimpas.

After trial on the merits, the Deed of Absolute Sale and Agreement to Sale between Defendant Victor Brian E. Dimpas and the Plaintiff Benjamin B. Luy, be declared null and void and ordered cancelled and that same Defendant alone be ordered to pay the Plaintiffs the following sums of money, damages and attorney’s fees: 1. EU continues to empower IPs via DELACSE bangsamoro project

T

he European Union (EU), Konrad-Adenauer-Stiftung (KAS) Philippines, and the Institute of Autonomy and Governance (IAG), through the Democratic Leadership and Active Civil Society Empowerment in the Bangsamoro (DELACSE Bangsamoro) project, remain committed partners of the Indigenous Peoples (IPs) in ARMM in exercising its crucial role in a democratic society.

The Organization of T’eduray and Lambangian Conference (OTLAC) and Timuay Justice and Governance (TJG) together with other IP organizations in the Bangsamoro region, that decided to form a regional political party in 2016 called the Indigenous Peoples Democratic Party, have been further capacitated under DELACSE Bangsamoro’s three-day Advance Leadership Training held in Davao City, titled “A Workshop on Leadership and Party Building for the Indigenous Peoples of Bangsamoro.”

The Advance Leadership Training is a proof of the positive impacts of previous EU financed projects such as the ‘Recognition of the Rights of the Indigenous Peoples in the Autonomous Region in Muslim Mindanao for their Empowerment and Sustainable Development’ (IPDEV) and the ‘Democratic Party Development (DEPADEV) Bangsamoro’ now that IP leaders in the ARMM for the first time ever - have the chance to get together regular-

ly, discuss their concerns and interests and, most importantly engage in political discourse, to be heard. Now these IP organizations understand and appreciate that the way for them to be represented formally in the future Bangsamoro parliament is to become a solid political institution. The way to do that is to organize a legitimate, genuine, and democratic political party; hence, DELACSE Bangsamoro seeks to extend more support by providing technical assistance and expertise from invited reputable political scientists and political party organizers. Learning from these experts should help facilitate the completion of the IPDP’s pertinent documents (e.g. Constitution; and By-Laws and Party Platform of Governance) prior to its application before the COMELEC, and facilitate the general plan of activities of the IPDP in preparation for its official registration as a regional party.

The training also builds on the IP organizations’ knowledge base established through the conduct of basic seminars focused on enhancing participation in political processes in the Mindanao context, advanced leadership and political management courses, to include organizational leadership skills in times of transition, as well as developing policy inputs to the Bangsamoro Transition Commission, both in terms of content and technical skills.

AboitizPower suggests Agus rehabilitation

boitiz Power Corporation President and COO Antonio Moraza told business leaders in an investment conference in Davao City yesterday, July 21, 2017, that with a huge surplus of power in Mindanao, the government can now consider a major rehabilitation of the the decades-old Agus hydroelectric power plants.

The Agus hydroelectric power plants are generating an installed capacity of 727 megawatts (MW) of renewable energy. It currently has a dependable capacity of around 400 MW according to Mindanao Development Authority (MinDA).

With some of the Agus units constructed as early as the 1950’s, many sectors have been calling for an extensive rehabilitation of the facilities so it can operate at an optimum ef�iciency.

“With all the supply coming into Mindanao today, it may be time for the government to �inally decide on the fate of the Agus complex. Perhaps it is time for these old power plants

to be rehabilitated,” Moraza said during the Davao Investment Conference held on July 21 and 22 in Davao City.

He said with more power plants getting built, the perennial problem of the Mindanao power shortage is gone. He emphasises that the region must now take advantage of its energy surplus to spur the economy.

“Now that power supply is no longer an issue, it can be said that Mindanao is truly open for business,” Moraza said during his speech. He said, though, that suf�icient power supply is not the only factor that will bring investments to Mindanao.

He also cited the importance of peace and order, and eradicating corruption and red tape.

In the case of Agus, Moraza cited AboitizPower’s successful rehabilitation of the Ambuklao hydroelectric power plant in Ifugao, a facility built in 1956 that that was abandoned by the government after the 1990 earthquake that struck Baguio.

“We took over Ambuklao in 2008. We invested resources,

brought in experts, and worked with government to make the plant run again. In 2011, we not only brought back the plant, but also increased its installed capacity from 70 MW to 105 MW. With the same amount of water, energy produced has increased by 50%,” Moraza said.

However, Moraza said studies would have to be made in order to determine how the proposed Agus rehabilitation be done and by whom.

AboitizPower has an almost century-old foothold in the power sector in Mindanao.

The company invested in power in Mindanao since the early 1900s when it �irst acquired Jolo Power Company.

Paras paces self

obe Paras is perhaps the most celebrated prospect to come out of high school since his dad Benjie over two decades ago. But as a �irst-timer at Gilas Pilipinas, he’s not spared from rookie duties like lugging heavy team equipment to the gym for practices and games.

“Ganyan naman po talaga sa team, kami naman ang baguhan,” he said.

It has been the same way in Gilas Pilipinas’ games, where the teenager who has �illed up YouTube and Facebook with highlight dunks from his games with Cathedral High School in Los Angeles and in practices has gone through a rough baptism of �ire.

His debut for the national men’s team in the 39th Jones Cup has more or less been an eye-opener for the 6-foot-6 Paras who has logged a grand total of 36 minutes in the �ive games that he has played and was relegated as a reserve in the two others.

Paras averaged two points in those �ive games and clearly struggled to �it in or live up to the hype built around him by fans and media alike who see in the athletic, high-�lying wingman the country’s best chance to �inally put a homegrown Filipino player in the NBA. The sheer weight of expectations has also clearly gotten to Kobe, at least in the �irst few games, where he was so eager to impress that he wanted to go for a dunk right in his �irst touch - and each time ended up taking a bad shot.

That was none more apparent than in his debut game against Canada, where Paras scooted downcourt the moment he got the ball, put his head down, then ended up kissing the ball too strong off the backboard on his layup.

Despite the struggle, Gilas coach Chot Reyes said he understands what Paras is going through and, in fact, admires the

youngster for the way he’s handling everything happening around him, which may be too much for most teens to handle.

“He understands that he needs to shut out all the hype and everything else outside of this team,” said Reyes. “And like I told him, I was very impressed with the way he’s handling things.

Paras has shown his frustrations during games at times and expressed as much on social media, but at least he’s beginning to turn the corner in his last two games with Gilas.

He got a rare start in the game against Japan and looked a lot more relaxed on the �loor, letting the game come to him instead of forcing things. The teenager was more settled in the game against Iraq, where he made two big defensive stands, made one extra pass instead of settling for a three-point shot, and was soon rewarded with his �irst dunk of the tournament.

The kid is beginning to grasp the concept.

“Coach Chot just tells me that I should relax. Kasi nga, nakikita n’ya na nanggigigil ako. He just tells me na, ‘Just play your game.’ And yesterday and two games before that, okay naman pinakita ko so I’m happy with the defense I played,” he said.

“Coach Chot naman didn’t give any promises. You get the minutes that you deserve. So I’m just happy that last game, he started me and that was the �irst time I started since high school. So I’m just happy na may tiwala s’ya sa akin.”

Reyes is seeing the progress, but nonetheless insisted that there will be no special treatment for Paras and fellow amateur stars Kiefer Ravena and Rayray Parks.

“He knows that there are no entitlements in this team, kaya that was the �irst thing I told Kobe, Rayray (Parks) and Kiefer (Ravena) when they said they want to come in and join the program,” he said.

“I’m happy, actually, because there are a lot of 19 year olds out there who aren’t in the (national) team, so I’m looking at it has a blessing that God gave me a chance to be part of the team and learn from professionals, from coaches who’ve been through a lot,” Kobe said.

The only exemption if the PH Teams go abroad is to use the help of corporate sponsors. That’s it. We’ve done it before and it can be done again.

It’s plain and simple.

When you treat the PSC like your own home, you closely look at the budget for the daily, weekly, monthly and yearly expenses. Competing abroad?

I am not against it in the �irst place because we need it to expose our national athletes to a higher level of competition.

But doing that in these

instead, you look after your fellow human beings.

Just treat the PSC like your home. Would you go for a vacation when you see that there are more important and pressing concerns to be attended to? Oh, come on, have you not realized that going abroad is like a vacation? And have you not noticed, our national sports of�icials like to stick to their positions because of the perks that come with it, specially travel abroad for free, thanks to public funds?

I would not mind if you spend your own money, just like the sports of�icials, many,

many moons ago have done.

Now? Ambot lang ug mo gastos sarili nilang kwarta. But if you can �ind a corporate sponsor, say, Phoenix Petroleum that will fund the trip of the team abroad, that would be great but using taxpayer’s money at this time? Hmmmm, dutlan kag konsensiya?

Just think of the children affected by the con�licts in Marawi.

break by holding a sports therapy event for them.

These are troubled times my friends. Can you sleep well in your hotel room knowing that our children in Mindanao and other evacuees are sleeping in temporary shelters?

Let us never waste our scarce resources.

Then, when the time comes, you can tell yourself that you indeed have served the interests of the people by never, never availing of the “promo” as sports of�icials.

Just do the honorable thing in these challenging times.

s a sportsman, Rommel Tan has come full circle.

A bemedalled karateka, one of the country’s winningest coach, and father-coach of child phenom Atsuko Kai-

yel who at seven years old has won two Athlete of the Year awards given by the Dabaw City Sports Council Inc. and the So Kim Cheng Sports Foundation.

A former standout of the National team and graduate of the Ateneo de Davao University, Tan has dedicated his life to the sport of karatedo, painstakingly teaching kids the rudiments of the Japanese martial art discipline at the AAK home inside the Bee�it Gym. Although not recognized as the of�icial NSA (National Sports Association) for karatedo by the Philippine Olympic Committee (POC), Tan believes AAK has taken the lead in uplifting the sport in the country.

“I believe the AAK community is a very strong community which thrives on its own despite not having the full support of government and POC. We are committed to the sport and we will do all means to help kids achieve their full potential in the sport,” Tan said.

Tan’s AAK Davao has won the So Kim Cheng Sports Awards top recognition for

the past �ive years. His daughter Atsuko Kaiyel Tan has won the award twice as well as Gabriel Quinones and Julian Ambrose Ramirez. Darlene Maramara was also a past winner along with John Paul Ponce.

But nothing beats the feeling of a proud father. Tan reached the summit of his sporting career after daughter Kaiyel won her �irst gold in the Adidas Cup as a �ive year old before winning back to back gold medals in her international stints in the Kuala Lupur Milo Cup in 2015 and 2016. This year, Kaiyel settled for the silver.

“This is the highlight if my career. I am completely ful�illed now,” he said.

Tan received his Hall of Fame induction in Saturday’s 23rd So Kim Cheng Sports Awards held at the Grand Regal Hotel. His daughter Kaiyel likewise received her second straight Athlete of the Year plaque.
