Presidential Spokesperson Harry Roque announced in a palace virtual presser on Thursday, July 9, that motorcycle backriding is allowed with shield and limited for couples only with guidelines drafted by the National Task Force against Covid-19 .

“Itong backriding ay para lamang sa mag-asawa at ito ay magiging epektibo on July 10, 2020. Dapat may shield na katulad sa pino-propose ni Bohol Governor Arthur Yap,” Roque

said.

Roque is referring to the prototype model submitted by Yap, wherein there is a barrier between rider and passenger then there is a handle on the side of the barrier to contain the spread of the virus.

“Kailangan ng mag-asawa na sumunod sa minimum health standards such as wearing of mask and helmet and observe minimum speed limit,” he said.

proved by the NTF and this measure will be implemented in all general community quarantine (GCQ) and modified general community quarantine (MGCQ) areas.

Making a clarification to the word “couple”, Interior Secretary Eduardo Año described a couple as those “living in the same household, whether they are married or they are common-law husband and wife or boyfriend and girlfriend”, and present IDs “with same surnames” as proof of being a couple. If they don’t have the same last name, the couple should have the same address in their IDs.

It can be recalled that Mayor Sara Duterte–Carpio appealed to the Inter-Agency Task Force (IATF) on Emerging Infectious Diseases to allow motorcycle back riding as public transportation within the city, this is due to the clamor of some Dabawenyos whose majority of the wives and partners are still working amid the pandemic.

Some Dabawenyos expressed their sentiments and appealed to the mayor via Davao City Disaster Radio (DCDR) 87.5 to allow backriding as a mode of transportation considering the limited seating capacity of the public utility jeepneys (PUJs).

The OBE, which started on June 1 and will end on August 29, aims to address problems, queries, and other concerns that are commonly encountered before the school opening.

"Under the new normal, like basic education, public service should continue, and find ways to make communications accessible with the public,” Mateo said.

He said OBE will also strengthen the synergy with the DepEd’s Briga-

da Eskwela initiative under the “Bayanihan sa Paaralan” banner for this school year “to engage agencies, organizations, and other stakeholders in contributing to educational needs, especially at this critical time.”

He said learners and parents can send in their concerns and questions through DepEd's social media platforms - Facebook and Twitter - and other media of communication like SMS, phone, e-mail, letter, or walk-in. (PNA)

DepEd reports nearly 18.8 million enrollees for 2020-21 school year

he Department of Education (DepEd) on Wednesday said 18,871,245 learners have enrolled in public and private schools nationwide for the school year 20202021 which begins next month.

Data from the department showed that there are 17,957,202 learners enrolled in public schools and 894,161 in private schools.

Mandin detected many call centers came up with pantries per floor to avoid the crowding of employees while one business process outsourcing has situated its clinic on the first floor to ensure immediate medical check-up of employees with high temperature.

“During the visit, they have many questions inquiring the government on the health protocols,”she said.

Mandin said the local government is concerned with the air flow within the establishments, the signage on the floor conveying social distancing and calibrated temperature scanners.

She acknowledged that many BPOs which gave out back-to-work kits to their call center agents containing face masks and alcohol.

“No signage on the floor and the calibrated thermometer are the minor de-

ficiencies we have noticed and they have promised to comply,” Mandin said.

She also said that two BPOs have also closed down especially the small ones since the enhanced community quarantine.

Mandin also noticed that many call center agents find comfort in the workfrom- home arrangement, while there are complaints on poor connectivity.

She also learned that there are managements of business process outsourcing which expressed difficulties of adding more expenses in their operation like shuttle service for call center agents, meals and work-from-home arrangement, but noticed that their clients multiplied due to their prompt service.

Mandin bared that based on the surveys conducted by restaurants, many customers prefer to eat at home.

She said business establishments also want to be certain that they would not lose so much in their operational expenses.

Mandin stressed the city government ensures that as it allows more business to open, health protocols must be followed.

“The public must be aware that the health protocols are for everyone to follow,” she said.

Mandin also pointed out that every resident needs to follow and set good example in complying with the health protocols.

Based on the IATF guidelines, unnecessary conversation while cooking among workers is not allowed.

“It is the new culture that we have to adopt, though as Filipinos, we are fond of talking aloud while working,” Mandin said.

Dabawenyo beneficiaries to receive SAP 2nd tranche digitally this month

ost of the beneficiaries of the Social Amelioration Program (SAP) for 2nd tranche will be receiving their cash assistance thru digital means such as money remittance or banks within this month of July.

Department of Social Welfare and Development (DSWD XI) regional director Grace Subong announced in One Davao Virtual Presser that the regional office has met with its partner Starpay, a licensed Electronic Money Issuer (EMI) and Remittance Agent, and discussed with them the system and process to be followed for the distribution of the SAP 2nd tranche.

Subong discussed that with the digital system, beneficiaries will be receiving a notification via SMS thru the Starpay. They will be notified on where and when to claim the cash assistance. Some of the remittance center conduits of the Starpay where the beneficiaries can claim their assistance are Western Union, and Lhuillier.

They may also claim it thru banks such as the RCBC.

The DSWD official admitted that resorting to digital payment for the 2nd tranche of assistance was caused by some factors learned through the distribution of the first tranche.

“Before, the DSWD downloaded the money to the LGUs so they can help in the distribution. However, we learned that a major limitation in this system is the availability of special disbursing officers. That’s why we addressed this problem and looked for a partner thru Starpay,” Subong said.

She added that some areas of Davao City also posted challenges in terms of geographic location which made it hard for the government to reach and inform its target beneficiaries.

DavNor prepares housing for the return of Haran IPs

Governor Edwin Jubahib of Davao del Norte said in a virtual presser on Wednesday, that there are 125 houses being constructed in Sitios Tibukag and Dulyan in Talaingod and are targeted to be completed by August.

“Aduna kita gipahimo didto na 125 houses para sa kada pamilya nga naa sa sulod sa UCCP-Haran para sa ilang pag-uli aduna sila sakto nga kapuy-an,” he said.

The governor assured that livelihood will be provided for the IPs upon their return in their ancestral domain in Talaingod.

“Ug sa ilang pag-uli naka-prepare na ang ilang panginabuhian nga atong ihatag sa ila nga suporta para makasugod sila sa ilang pamuyo sa ilang ancestral domain,” he said.

Jubahib added that there are 115 houses in the Freedom Residences in Tagum City being prepared to be used temporarily by

the IPs the moment they return in the province. He said he requested the National Housing Authority (NHA) for these houses to be used by the IPs. The Freedom Residences was an abandoned project of the previous administration for the Armed Forces of the Philippines (AFP) and Philippine National Police (PNP) personnel. But due to the need to allocate housing units for the former rebels, NHA General Manager Marcelino Escalada, Jr. recommended for the reallocation of the units under Administrative Order Number 10. Under the current administration, housing units were improved through the allocation of additional funding in the amount of P160,000 per unit.

“From 1994 na nag-umpisa ang UCCP-Haran hanggang ngayon wala naman tayong nakita na may nag-graduate diyan sa college at wala din tayong nakikita na yung pamumuhay nila ay umasenso diyan sa Haran. Dapat maibalik na sila sa kanilang tirahan sa Talaingod para mabigyan ang kanilang mga anak ng mabuting kinabukasan at magkaroon sila ng totoong maayos na pamumuhay,” Jubahib said.

More than 300 IPs are still holed up inside UCCP-Haran center. The place has been the home of these Lumads who were allegedly displaced by military operations in the hinterlands of Davao del Norte.

“Yung mga IPs na nasa Haran ay hinihikayat natin na bumalik na sila. Makita nila na yung pagbalik nila ay hindi na sila mahihirapan. I-convince natin na hindi na sila magpatuloy diyan sa Haran dahil walang saysay ang pagtira nila sa Haran,” Jubahib said.

Global coronavirus cases top 12 million

lobal coronavirus disease 2019 (Covid-19) cases exceeded 12 million late Wednesday, according to a running tally

by US-based Johns Hopkins University.

The number of deaths from the virus has reached 548,822, with recoveries topping 6.5 million.

The US remains the

worst-hit country with over 3 million infections, while its death toll exceeds 132,000.

Brazil, which has the largest number of Covid-19 cases and deaths in Latin America, has the second-highest number of infections worldwide at over 1.71 million.

Russia, India, Italy,

Spain and the UK are also among the hardest-hit countries in the world.

China, ground zero of the virus, has registered 84,946 cases so far, including 4,641 deaths and 79,802 recoveries.

enator Christopher Lawrence "Bong" Go on Wednesday urged local government units (LGUs) to “carefully and wisely” utilize their respective Special Education Fund (SEF) after the Department of the Interior and Local Government (DILG) called on them to assist the Department of Education (DepED) in preparing for the coming school year.

“Ni piso ay hindi dapat masayang. Gamitin po natin nang tama ang pondo ng bayan upang matulungan ang ating mga kababayan, lalo na ngayon na may krisis. (No peso should be wasted. Let us rightfully utilize public funds to help our countrymen, especially in this time of crisis),” Go said.

Go said LGUs must utilize their SEFs properly to support steps in preparation for the opening of classes.

“Sa tulong po ng pondong ito, mapupunan nila ang mga pangangailangan ng kanilang public school system lalo na't may mga challenges silang hina-

harap dala ng pandemyang Covid-19 (With the help of this fund, they can fill the needs of their respective public school system, especially now that they are facing challenges due to the coronavirus disease pandemic)," he added.

Go, chair of the Senate Committee on Health, said that in using the SEF, LGUs must also ensure that students are able to continue their education without putting them at harm because of the risks caused by coronavirus disease 2019 (Covid-19).

Just recently, the DILG asked LGUs to "assist the DepED in the adjustment of public schools to the new normal" as well as to utilize the SEF to enable them to support their local education needs in the face of Covid-19.

The DILG also encouraged the local governments to convene their Local School Boards to discuss the use of SEF and to support the localization of the Basic Education Learning Continuity Plan crafted by

DepEd. Go said he fully supports DILG's call, and urged anew for the immediate passage of Senate Bill No. 396 which will allow for the expanded application of the SEF. "The expanded use of SEF will give LGUs the flexibility to boost their support to local public schools and facilitate the transition to 'blended learning' amid the pandemic," he said.

Under Section 272 of the Local Government Code (RA 7160), local school boards may only use the SEF for “operation and maintenance of public schools, construction and repair of school buildings, facilities and equipment, educational research, purchase of books and periodicals, and sports development.”

he Philippine economy may be suffering from the impact of the coronavirus disease 2019 (Covid-19) pandemic but it is strong enough to “get back to its feet” and achieve more once it recovers.

During a virtual preState-of-the-Nation Address (SONA) forum Wednesday, Department of Finance (DOF) Secretary Carlos Dominguez III said the government is not dilly-dallying on its program to help the economy recover.

“We will overcome this crisis. We will get back to work. We will get back our economy. And you can be assured that this government is doing its utmost to bring back the economy back to the growth path. It’s true we are having hiccups, we are hav-

ing a bad spot, but we are strong enough to weather the problem and come out probably even stronger than before,” he said.

Economic managers have revised their growth target for this year from a growth of 6.5 percent to 7.5 percent to a contraction of between 2 percent to 3.4 percent on account of the pandemic.

Dominguez reiterated this is the reason why the government is firm on keeping its Build, Build, Build (BBB) infrastructure program a priority.

This program, he said, provides jobs to people which, in turn, will allow them to help in the economic recovery by increasing demand and stimulating economic activities.

“This is a better way to revive the economy than to give hand-outs at this point in time. So we will not slack down on the Build, Build, Build program,” he added.

Dominguez said aside from the infrastructure program, the government will also continue to push for its tax reform program, citing there are several

pending measures like the Corporate Recovery and Tax Incentives for Enterprises Act (CREATE) bill and the proposed valuation reforms on the country’s real estate tax system.

He said they continue to work with legislators on the proposed second package of the Bayanihan 2 stimulus program.

“We are finalizing the terms of the new potential legislation,” he said.

Dominguez said more important to the stimulus program is the return of consumers’ confidence.

“This is the hurdle that the economy is facing –confidence in the future. Stimulus program is important but we have to provide our citizens the confidence that we will overcome this Covid (-19) contagion,” he added.

NEDA chief says data shows economy starting to recover

T

he economy is starting to rebound from the coronavirus disease 2019 (Covid-19) pandemic but returning to positive growth depends on proactive implementation of the economic recovery program, the country’s chief economist said on Wednesday.

“We have prepared the macroeconomic framework as of mid-May and we were looking at data starting March and April. What we are seeing are the following: the monthly data that is coming out on trade, on production, are actually starting to show improvements,” acting Socioeconomic Planning Secretary Karl Kendrick Chua said in a briefing after a virtual pre-State-of-the-Nation (SONA) forum.

Chua, also acting National Economic and Development Authority (NEDA) Secretary, cited the latest results of the Purchasing Managers’ Index (PMI) indicating that manufacturing performance improved to more normal territories in June from the contraction in April and May. “We are also seeing a significant part of the economy actually loosening up from the quarantine, so these are I think important elements to suggest that the economy is starting to recover,” he added.

The government placed the entire island of Luzon under an enhanced community quarantine (ECQ) from March 17 until May 15 in response to the Covid-19 pandemic in the country. This quarantine was extended for

Metro Manila until May 31.

Metro Manila and other areas have remained under a general community quarantine status until July 15.

“How soon or how fast we will reach positive territory is really dependent on how we proactively respond with our recovery program and how the public will respond also by cooperating, maintaining the minimum health standards, social distancing,” he said.

The Philippine economy declined by 0.2 percent in January to March 2020, its first contraction in two decades, mainly due to the impact of the coronavirus pandemic.

Finance Assistant Secretary Jose Antonio Lambino II said the Bureau of Cus-

toms (BOC) surpassed last month’s collection target by 4.4 percent to PHP42.54 billion, as against the June target of PHP40.74 billion.

“This is another sign that there may be a rising economic activity,” he said.

Meanwhile, Chua said the economic recovery program prioritizes sustaining food supply and the Build, Build, Build infrastructure program.

“Build, Build, Build program is one of the key elements of our recovery and that will also create jobs we need. This has been actually given the highest priority,” he added. “At the same time, we are hoping the private sector will be having the same interest and speed as we want to implement this program.”

US FDA authorizes marketing of IQOS as Modified Risk Tobacco Product

T

he U.S. Food and Drug Administration (FDA) yesterday authorized the marketing of IQOS, Philip Morris International’s (PMI) electrically heated tobacco system, as a modified risk tobacco product (MRTP).

In doing so, the US FDA found that an IQOS exposure modification order is appropriate to promote the public health.

The decision demonstrates that IQOS is a fundamentally different tobacco product and a better choice for adults who would otherwise continue smoking.

IQOS is the first and only electronic nicotine product to be granted marketing orders through the FDA’s MRTP process.

“The FDA’s decision is a historic public health milestone. Many of the tens of millions of American men and women who smoke today will quit—but many won’t. Today’s decision makes it possible to inform these adults that switching completely to IQOS is a better choice than continuing to smoke, “André Calantzopoulos, PMI’s Chief Executive Officer, said.

“IQOS is a fundamentally different product than combustible cigarettes and must be regulated differently, as the FDA has recognized. Now—more than ever—there is an urgent need for a fundamentally different conversation on a cooperative approach to achieve a smoke-free future. The FDA’s decision provides an important example of how governments and public health organizations can regulate smoke-free alternatives to differentiate them from cigarettes in order to promote the public health,” Calantzopoulos added.

The FDA authorized the marketing of IQOS with the following information: - The IQOS System heats tobacco but does not burn it - This significantly reduces the production of harmful and potentially harmful chemicals - Scientific studies have shown that switching completely from conventional cigarettes to the IQOS system reduces your body’s exposure to harmful or potentially harmful chemicals.

as a whole, taking into account both users of tobacco products and persons who do not currently use tobacco products The FDA’s decision further builds on the emerging independent international scientific consensus that IQOS is a better choice than continuing to smoke, and follows the FDA’s April 2019 decision authorizing the commercialization of IQOS in the U.S. The FDA’s decision provides an important example of how governments and public health organizations can regulate smoke-free alternatives to differentiate them from cigarettes in order to protect and promote the public health This decision follows a review of the extensive scientific evidence package PMI submitted to the FDA in December 2016 to support its MRTP applications.

The PMI CEO further said “We are excited that this important decision will help guide the choices of adult smokers in the U.S. The best choice for health is to never start smoking or to quit altogether. For those who don’t quit, the best thing they can do is switch to a scientifically substantiated smoke-free product. As of March 31, 2020, PMI estimates that approximately 10.6 million adult smokers around the world have already stopped smoking and switched to IQOS. We believe that this decision can help to further accelerate the transition of U.S. adults away from cigarettes. We, along with our licensee Altria, are committed to guarding against unintended use and fully support FDA’s focus on protecting youth.”

DAVAO’S ‘DIEGO SALVADOR’ Born in Cabanaturan City on January 14, 1924, Luis T. Santos was the son of Nicolas Santos and Illuminada Toribio.

A product of public school education, he went on to earn an Associate in Arts degree from the University of the Philippine and finished a bachelor’s degree from the Ateneo de Manila University.

When war broke out, he joined the guerrillas of Luzon and assumed Kumander Briccio Hidalgo as nom de guerre.

After the conflict, he migrated to Davao with his wife, Catalina Garcia, to open a junk shop, which was chiefly engaged in scrap iron. The couple later established L.T. Santos Timber Co., which exported logs and lumber, and branched into realty by founding Santos Land Development Corp.

In the sixties, Santos was appointed chief of police under the administration of city mayor Carmelo Porras, which earned him the moniker Diego Salvador, after a very popular Visayan radio drama, for his no-nonsense campaign against

criminals. His popularity as a top gun eventually became his ticket to fame.

Setting aside his badge and nightstick, he joined politics in 1965. He ran as candidate of Sen. Alejandro Almendras, Sr. for Congress against Lorenzo S. Sarmiento, a protégé of Rep. Ismael Veloso; he lost. In 1968 he ran against reelectionist Rep. Artemio Al. Loyola, a congressional protégé of Almendras, Sr. but again was defeated. Two years later, he returned to the electoral scene to trounce city mayor Elias B. Lopez, an Almendras bet. In 1976, Luigi, as he was fondly called, was reappointed by President Ferdinand E. Marcos as city mayor.

In 1980, for the second time, Santos had to face Lopez in the mayoralty race which took a year for the Commission on Elections to resolve. Also contesting his position were city councilors Victorio Advincula and Zafiro L. Respicio. Despite efforts to seek the intervention of the President in a protest filed before the electoral body, the Palace eventually took the

side of Lopez who was declared winner in March 1981.

As city mayor, he is best remembered for several accomplishments. He established the Davao City Water District, introduced the World Bank-funded Slum Improvement and Resettlement Program for squatters, and in the 1970’s worked for the expropriation of a 100-hectare Cuison property at the boundary of Catalunan Pequeño and Mintal for use as resettlement site and government center.

During the Cory Aquino administration, Santos ran for Congress and was elected as representative of the city’s third district. He resigned on October 27, 1987 to accept the offer as minister (later secretary) of the Department of Interior and Local Government (November 9, 1987 - December 10, 1991). After serving the government, he accepted a consultancy before retiring.

In 1990, at the height of a coup d’etat, Santos led a police and military contingent to arrest Col. Rodolfo Aguinaldo

in Tuguegarao, Cagayan, who attacked Hotel Delfin. He was cornered in the operation but escaped unharmed. The ensuing exchange of fire cost the life of Col. Oscar Florendo, then Armed Forces of the Philippines spokesman.

During his stint as DILG secretary, Santos was criticized

by Fidel V. Ramos, who resigned as defense secretary to contest House speaker Ramon V. Mitra as Lakas ng Demokratikong Partido candidate for president.

A West Pointer, Ramos wrote Mitra to air his grievance. His letter was quoted in W. Scott Thompson’s Trustee of the Nation: The Biography of Fidel V. Ramos (2017): “The case of DILG Secretary Luis T. Santos is a most glaring one. He is openly campaign for Speaker Mitra and is not even shy in doing so. For the purpose of his personal and official campaign for Speaker Mitra, Secretary Santos has been dangling the threat of the non-release of NALGU-BALGU funds to provincial governors and municipal mayors.”

Ramos said that while he did not wish to impose his norm of conduct on other people, he believed that propriety remained a valid and moral duty of every public official “not to utilize the vast resources of their office.”

In 2001, during the presidency of Gloria Macapagal-Arroyo, Santos’ name was floated to assume the DILG portfolio vice Jose Lina, who was recommended for the department of trade and industry position.

He was at the time president of Kabalikat ng Malayang Pilipino, Arroyo’s party.

Santos had a dozen kids with his first spouse; he was also known as Winchester. One of his sons is Briccio G. Santos, film director and former head of the Film Development Council of the Philippines during the Benigno S. Aquino administration. He later took a second wife, Hilda, and resided at Darong, Santa Cruz, Davao del Sur, after he suffered a stroke as a result of his being chronic smoker. He died on August 3, 2011, at age 87.

Sala Sr. ALL SP MEMBERS ============================================================ AN ACT INSTITUTIONALIZING A DRUG-FREE WORKPLACE IN THE PROVINCIAL GOVERNMENT OF DAVAO DEL SUR AND PROVIDING SANCTIONS FOR VIOLATIONS THEREOF Be it ordained by the 16th Sangguniang Panlalawigan of Davao del Sur in session assembled: Section 1. Short Title. – This ordinance shall be known as “A Drug-Free Workplace Ordinance in the Provincial Government of Davao del Sur”.

Section 2. Objective – This Ordinance aims to ensure that all public officials and employees of the province, both elective and appointive, remain drug free in order to continuously provide effective and efficient service to the people.

Section 3. Scope – This Ordinance covers all elective and appointive public officials and employees of the Provincial Government of Davao del Sur. Contract of Service or Job Order workers are also covered by the provisions of this Ordinance.

Section 4. Definition of Terms – The following terms are defined: a. Authorized Drug Testing – the testing done by drug testing laboratories accredited by the Department of Health (DOH). It shall employ, among others, two (2) testing methods, the screening test, which will determine the positive result as well as the type of the drug used, and the confirmatory test, which will confirm a positive screening test. b. Challenge Test – a drug test conducted as a result of a challenge filed by a public officer who tested positive for drug use in a confirmatory test in an authorized drug testing activity. c. Confirmatory Test – an analytical test using a device, tool or equipment with a different chemical or physical principle that is more specific which will validate and confirm the result of the screening test. d. Contract of Service/Job Order – refers to employment covered by a contract pertaining to lump sum work or services such as janitorial, security, or consultancy services where no employer-employee relationship exists; piece of work of intermittent job of short duration not exceeding six (6) months on a daily basis; all of which are not covered by Civil Service Law, rules and regulations, but covered by Commission on Audit rules; and the public officials or employees involved do not enjoy the benefits received by government employees, including, but not limited to, personal economic relief allowance, cost of living allowance, and representation and travel allowance. e. Dangerous Drugs – include those listed in the Schedules annexed to the 1961 Single Convention on Narcotic Drugs, as amended by the 1972 Protocol, and in the Schedules annexed to the 1971 Single Convention on Psychotropic Substances as enumerated in the attached annex which is an integral part of Republic Act No. 9165 or the Comprehensive Dangerous Drugs Act of 2002, as amended (the “Act”). f. Drug Dependency Examination – refers to the examination conducted by a physician accredited by the DOH to evaluate the extent of drug use of a person and to determine whether he/she is a drug dependent or not, which includes history taking, intake review, determination of criteria for drug dependency, mental and physical status, and the detection of dangerous drugs in body specimens through laboratory procedures. g. Employee Assistance Program – a program that offers assistance to government officials or employees who have alcohol or drug-related issues and problems that may affect work performance. It shall be jointly implemented by the agency, the employees, and employees’ union. h. Mandatory Drug Testing – compulsory submission of a public officer or prospective employee to drug testing as mandated by the Act or by the drug-free workplace program of the agency. i. Public Officer - any person holding any public office in the Government of the Republic of the Philippines, by virtue of an appointment, election or contract. j. Random Drug Testing – drug testing where the selection process results in equal probability that any employee from a group of employees will be tested, and without any prior notice of the date and venue. k. Screening Test – a rapid drug test performed to establish potential or presumptive positive result. It refers to the immunoassay test to eliminate a “negative” specimen, i.e. one without the presence of dangerous drugs, from further consideration and to identify the presumptively positive specimen that requires confirmatory test.

Section 5. Establishment of the Drug – Free Workplace Committee – There shall be a Drug – Free Workplace Committee which shall ensure the proper implementation and dissemination of this Ordinance. The Committee shall be composed of the following: a. Local Chief Executive or Representative; b. Head of the Personnel Department or Representative; c. Head of the Medical Department or Representative; d. Head of the Employees Union or Representative; and e. Action / Focal Person, Provincial Anti – Drug Abuse Council Section 6. Establishment of an Assessment Team – There shall be an Assessment Team to be created by the Local Chief Executive which shall assist in the conduct of substance abuse awareness and prevention programs and implement the Employee Assistance Program for personnel who wish to undergo drug use intervention. It shall be composed of personnel with educational and training background on medicine, psychology, social work, and human

resources administration.

Section 7. Aspects of the Drug – Free Workplace Policy a. Pre – Employment Drug Testing – Mandatory drug testing shall remain an essential requirement for entry into government service. Any applicant found positive for drug use shall be denied entry to government service. b. Substance Abuse Awareness and Prevention Programs – The Assessment Team shall initiate and implement these programs to ensure that personnel are properly informed on the evils of drug use, including its physical, mental, social, and legal implications. c. Authorized Drug Testing – The Drug Free Workplace Committee and / or the Assessment Team shall implement a random selection procedure in order to determine personnel who shall undergo drug testing and if the said team sees the perceived need to include an employee or employees in the drug testing after proper assessment, verification and examination of their work performances and physical manifestations. d. Employee Assistance Program – Any personnel, prior to the conduct of Authorized Drug Testing, may seek intervention through the Employee Assistance Program, which shall provide referrals and additional services to the personnel concerned. A drug dependency examination shall be conducted in order to determine the level of Substance Use Disorder and the applicable intervention. This Program shall not apply to personnel who are found to be positive for drug use after the conduct of confirmatory drug test in an Authorized Drug Testing facility.

Section 8. Guidelines in the Conduct of Authorized Drug Testing a. The Local Chief Executive, in consultation with the Drug Free Workplace Committee, shall determine the frequency and dates for the conduct of an authorized drug testing activity. Information relating to frequency and dates relating to drug testing shall be treated with utmost confidentiality. b. Personnel selected to undergo drug testing shall immediately report to the Local Chief Executive, the Drug Free Workplace Committee, and / or the Assessment Team (to be determined by the LGU). Personnel who, without any justifiable reason, fail to report for drug testing shall be sanctioned. c. Upon discovery that a urine sample tested positive for use of dangerous drugs after confirmatory testing, the result shall immediately be made known to the Local Chief Executive, who shall notify the public officer concerned. The public official/employee shall have fifteen (15) days from receipt of notice to challenge the result of the confirmatory test.

Using the same specimen, a challenge test shall be conducted by a drug testing laboratory accredited by the DOH. All expenses incurred in the conduct of the challenge test shall be borne by the concerned public official/employee. d. A positive drug test result from the challenge test is deemed final and the public official/ employee shall be subjected to administrative proceedings. Failure to file a challenge within the prescribed period shall make the positive drug test result from the confirmatory drug test final. The Agency shall then take the appropriate action.

Section 9. Sanctions a. An appointive public official/employee who refuses, without any valid reason, to submit himself/herself to authorized drug testing, or is found positive for drug use after the conduct of a confirmatory test in an authorized drug testing activity shall be charged with the administrative offense of Grave Misconduct. b. Any elective public official who refuses, without any valid reason, to submit himself/ herself to authorized drug testing, or is found positive for drug use after the conduct of a confirmatory test in an authorized drug testing activity shall be subject to disciplinary action for misconduct in office pursuant to Section 60 of the Local Government Code and Article 124 (3) of the Implementing Rules and Regulations of the Local Government Code. c. Any public official/employee found to have tampered the result of a drug test, interfered with the conduct of the drug test or in the release of drug test results, or violated rules of confidentiality of records shall be charged with the administrative offense of Grave Misconduct without prejudice to the filing of a case for violation of Section 32, Article II of the Dangerous Drugs Act of 2002 which provides that: Article II SEC. 32.Liability to a Person Violating Any Regulation Issued by the Board. – The penalty of imprisonment ranging from six (6) months and one (1) day to four (4) years and a fine ranging from Ten thousand pesos (P10,000.00) to Fifty thousand pesos (P50,000.00) shall be imposed upon any person found violating any regulation duly issued by the Board pursuant to this Act, in addition to the administrative sanctions imposed by the Board. d. The Department of Interior and Local Government shall cause the filing of appropriate cases depending on the violations committed.

Section 10. Confidentiality.

All results of authorized drug testing activities shall be strictly confidential. Only the Head of Agency or the Local Chief Executive, as the case may be, and the members of the Assessment Team shall have access to such results.

Any person, who, having official custody or access to all data and information relative to the conduct of the authorized drug testing, or anyone who, having gained possession of such data and information, reveals their content to any person not authorized to have access thereto, shall be prosecuted for violation of Section 32, Article II of the Dangerous Drugs Act of 2002.

Section 11. Funding – Funds for the implementation of this Ordinance shall be charged in the annual budgetary appropriation of the provincial government of Davao del Sur Section 12. Reporting – The Local Chief Executive shall ensure that a copy of this Ordinance shall be communicated to the Dangerous Drugs Board and the Department of the Interior and Local Government for information. Thereafter, the Local Chief Executive shall also report to said agencies the conduct of authorized drug testing and provide data as to the number of persons who were subjected to drug testing, the number of persons found positive for drug use, and the action undertaken by the Local Chief Executive on persons found positive for drug use.

Section 13. Separability Clause – If any part or provision of this Ordinance is held invalid or unconstitutional, other provisions not affected thereby shall remain in force and effect.

Section 14. Effectivity Clause – This Ordinance shall take effect, after its publication in a newspaper of general circulation and after copies of this Ordinance shall have been posted for ten (10) days in the bulletin board, at the entrance of the Provincial Capitol Building, and in at least two (2) conspicuous places in Davao del Sur, not later than five (5) days after approval hereof.

ENACTING ORDINANCE NO. 20-38 PROHIBITING, REGULATING, AND PRESCRIBING CERTAIN USES OF PLASTICS FOR GOODS AND COMMODITIES, PROMOTING THE USE OF ECO-BAGS AND OTHER ENVIRONMENT-FRIENDLY PRACTICES, AND PROVIDING MECHANISM FOR ITS RECOVERY AND PENALTIES FOR THE VIOLATION THEREOF. Be it enacted by the 16th Sangguniang Panlalawigan of Davao del Sur in session assembled: WHEREAS, Sec. 16, Article II of the 1987 Philippine Constitution declares that the State shall protect and advance the right of the people to a balanced and healthful ecology in accord with the rhythm and harmony of nature; WHEREAS, Section 16 of the Local Government Code (Republic Act 7160) accords every local government unit power and authority to promote general welfare within its territorial jurisdiction, including the promotion of health and safety and enhancement to the right of the people to a balanced ecology; WHEREAS, Sec. 2 (b), Article 1 of the Ecological Solid Waste Management Act of 2000 (Republic Act 9003), declares the policy of the State to adopt a systematic, comprehensive and ecological solid waste management program which shall utilize environmentally-sound methods that maximize the utilization of valuable resources and encourage resource conservation; WHEREAS, the National Solid Waste Management Commission (NSWMC) passed a Resolution No. 1363, Series of 2020, directing the Department of Environment and Natural Resources (DENR) to prepare and implement the banning of the use of unnecessary singleuse plastics by National Government Agencies (NGAs), Local Government Units (LGUs) Offices and all other Government controlled offices.

WHEREAS, the Province of Davao del Sur acknowledges that local government units should act immediately as certain forms of plastics, such as single-use plastic containers and wrappers, sachets, disposable cups, disposable plates, disposable spoons and disposable forks, end up as litters on public places, rivers as well as sea waters. These cause health and sanitation problems to the society as they contribute to clogging of the sewers, flooding, pest infestation, dengue proliferation, above all, degradation of water quality; WHEREAS, the Province of Davao del Sur identifies that there is a need to pass an ordinance that shall selectively ban plastic materials, implement thorough segregation of wastes, and reduce the generation of residual wastes, and ensure proper disposal of plastic waste, consequently prevent the corresponding impact of waste to the environment and to the general populace.

NOW THEREFORE, BE IT ENACTED BY THE SANGGUNIANG PANLALAWIGAN IN SESSION ASSEMBLED THAT: ORDINANCE NO. 20-38 AN ACT AN ORDINANCE PROHIBITING, REGULATING, AND PRESCRIBING CERTAIN USES OF PLASTICS FOR GOODS AND COMMODITIES, PROMOTING THE USE OF ECO-BAGS AND OTHER ENVIRONMENT-FRIENDLY PRACTICES, AND PROVIDING MECHANISM FOR ITS RECOVERY AND PENALTIES FOR THE VIOLATION THEREOF. SECTION 1. SHORT TITLE. This ordinance shall be known as the “SELECTIVE PLASTIC PROHIBITION AND REGULATION AND THE USE OF ECO-BAG ORDINANCE OF THE PROVINCE OF DAVAO DEL SUR”.

SECTION 2. PURPOSE. It is the purpose of the Province of Davao del Sur to protect the environment and ensure public welfare by minimizing if not totally eliminating activities, products and services that generate residual wastes in the province.

SECTION 3. SCOPE AND COVERAGE. The ordinance shall cover all types of plastics that end up as residual wastes. Plastic products and plastics that form part of a product such as semiconductor and electronic products except as container or packaging materials shall not be covered. Other types of plastic that form part of the residual wastes but are not explicitly prohibited, regulated or otherwise mentioned in the ordinance are in the interim considered not covered. It shall also cover all waste generators that produce, use, buy, sell, exchange, provide and dispose said types of plastics covering on residual wastes generators located within the province such as residential, institutional, commercial, recreational and industrial.

SECTION 4. DEFINITION OF TERMS. As use in this Ordinance, the terms below shall have the meaning ascribed to them in this section. Any word or term not defined herein shall be given their plain and conventional meaning, unless the context requires otherwise, and shall be interpreted in a manner consistent with the spirit of this Ordinance.

1. Citation ticket – is a document printed as ticket citing the violation committed by any violator.

2. Dry goods – solid commodities traded in bulk, such as tea, sugar, and grain, fabric, thread, clothing, and related merchandise, especially as distinct from hardware and groceries.

3. Eco-bag or reusable bag – An environment-friendly reusable bag made from cloth or recycled plastic or indigenous materials such as bamboo, rattan, romblon, and other biodegradable materials. Bags made out of different materials that can withstand several uses as containers and for packaging rendering them “eco-friendly” as they serve as substitute to disposable bags.

4. HDPE – stands for High Density Polyethylene plastic or type-2 plastic material. It is a thermoplastic polymer produced from the monomer ethylene and sometimes called

"alkathene" or "polythene" when used for HDPE pipes.

5. LDPE – stands for Low Density Polyethylene plastic or type-1 plastic material. It is a very flexible material with very unique flow properties that makes it particularly suitable to plastic film applications like shopping bags.

6. PET – stands for polyethylene terephthalate, a form of polyester (just like the clothing fabric). It is extruded or molded into plastic bottles and containers for packaging foods and beverages, personal care products, and many other consumer products.

7. Plastic – is a material produced from crude oil by a chemical process and used to make many objects.

8. Plastic Film – is a thin continuous polymeric material. This thin plastic membrane is used to separate areas or volumes, to hold items, to act as barriers, or as printable surfaces. Plastic films are used in a wide variety of applications.

9. Plastic Laminate – a special form of polymer-matrix composite consisting of layers of reinforcing materials that have been impregnated with thermosetting resins, bonded together, and cured under heat and pressure.

10. Polyester – is a synthetic fiber derived from coal and petroleum. It is a category of polymers that contain the ester functional group in their main chain. As a specific material, it most commonly refers to a type called polyethylene terephthalate.

11. PE – stands for Polyethylene, the most popular plastic in the world. This is the polymer that makes grocery bags, shampoo bottles, children's toys, and even bullet proof vests. It is the simplest of all commercial polymers.

12. PS – stands for Polystyrene, a synthetic aromatic hydrocarbon polymer made from the monomer styrene. Polystyrene can be solid or foamed. General-purpose polystyrene is clear, hard, and rather brittle.

13. PP – stands for Polypropylene plastic or type-5 plastic material. It is a thermoplastic “addition polymer” made from the combination of propylene monomers and used in a variety of applications to include packaging for consumer products, plastic parts for various industries including the automotive industry, special devices like living hinges, and textiles.

14. Primary packaging – is the packaging in direct contact with the product itself and is sometimes referred to as consumer or retail packaging. The main purpose of primary packaging is to protect and/or preserve, contain and provide information about the product.

15. Receptacles – shall refer to individual containers used for the source separation or segregation of wastes and the collection of recyclable materials; 16. Residual Waste – shall refer to waste materials that are collected, transferred and transported for final disposal as garbage.

17. Secondary packaging – a packaging that encloses the primary packaging, such as the box enclosing a toothpaste tube. Secondary packaging’s main purpose is the branding display, logistical purpose, protection and collation of individual units during storage and are often used by the beverage, food and cosmetic sectors.

18. Segregation at source – shall refer to a solid waste management practice of separating at the point of origin, different materials found in solid waste in order to promote recycling and re-use of resources and to reduce the volume of waste for collection and disposal; 19. Single-use plastics – are disposable plastics, commonly used for plastic packing and include items intended to be used only once before they are thrown away or recycled.

Examples are, grocery bags, food packaging, bottles, straws, containers, cups and cutleries, among others.

20. Solid waste – shall refer to all discarded household, commercial waste, non-hazardous institutional and industrial waste, street sweepings, construction debris, agricultural waste, and other non-hazardous/non-toxic solid waste.

21. Tertiary packaging – is a packaging that facilitates the protection, handling and transportation of a series of sales units or secondary packaging in order to group everything into unit loads during transit.

22. Tetra Pak – a food container made up of number of components which are layered: paperboard (made from wood), polyethylene (a type of plastic) and aluminum.

Section 5. SOLID WASTE CLASSIFICATION a. Recyclable Wastes refer to any waste material retrieved from the waste stream and free from contamination that can still be converted into suitable beneficial use or for other purposes, including, but not limited to, newspaper, scrap metal, cardboard, glass, used papers, plastics and other materials. b. Residual Wastes are commonly referred to disposable plastics/polymers; are used only once before the same are disposed and neither recycled. These items are things like plastic bags, straws, coffee stirrers, soda and water bottles and most food packaging. c. Biodegradable Wastes are wastes originating from plant or animal sources, which may be degraded by other living organisms. d. Special Wastes are any solid waste or combination of solid wastes that due to its quantity, concentration, physical or chemical characteristics or, biological properties require special handling and disposal.

Section 6. COMPLIANCE CERTIFICATE Each Local Government Unit shall issue a certificate of compliance to all business establishments and individuals thru the City/Municipal Environment and Natural Resources Office (ENRO).

Section 9. USE OF ECO-BAGS AND OTHER ENVIRONMENT-FRIENDLY PRACTICES 1. All residents of the Province of Davao del Sur are mandated to use eco-bags in the dayto-day market transaction.

2. Business establishments, private institutions, and non-government organization are encouraged to develop their own IEC materials, such as but not limited to posters, pins, tarpaulins, and streamers, on the use of environment-friendly recyclable materials; 3. All sectors are enjoined to use Eco-bags in all aspects of their business transactions whenever applicable and the general public shall bring appropriate containers and eco-bags whenever they purchase commodities from stores, malls and public markets.

4. Proprietors, managers, and operations officers of business establishments shall brief or train their respective personnel who will be in the frontline to implement this ordinance.

5. Business establishments are encouraged to give discounts and freebies to users of ecobags.

6. Recovery of tetra packs or doypacks of juice drinks shall be made during occasions and gatherings.

7. Tarpaulins and streamers shall be recovered after their intended use. The City ENRO/ Municipal ENRO shall recover tarpaulins and streamers posted within the City/Municipal after expiration of their permits.

8. PENRO/MENRO/CENRO shall take the lead to ensure recovery of recyclable materials that may be used for making eco-bags.

9. All schools, public and private are required to integrate Solid Waste Management in their Curriculum.

10. Micro, Small and Medium Enterprises (MSMEs) are encouraged to use eco-friendly packaging materials.

11. Segregation and disposal of regulated materials shall be in accordance with Republic Act 9003 (Ecological Solid Waste Management Act of 2000) and Republic Act 6969 (Toxic Substances and Hazardous and Nuclear Wastes Control Act of 1990) and violation thereof shall be proceeded with in accordance of the same laws.

Section 10. PROHIBITED ACTS. The following acts are declared unlawful and prohibited by this Ordinance. a. Littering, throwing, dumping of single-use plastic and plastic food wrappers in roads, sidewalk, parks, terminal, market, establishments, and waterways such as canals, river, sea, or causing or permitting the same; b. Burning of plastic waste materials; c. Distribution, selling and use of Food Container made of Styrofor, Styropor, Styrofoam, Plastic Stirrers, Plastic straw, Plastic Cutleries (knife, spoon, fork); d. Distribution, selling and use of soft plastic, smoked plastic bag, sando bag in packing Dried fish, Meat, Shrimp, Seashell Fish, Fresh miki (noodles) and other wet goods purchased by weight, vegetables, spices & fruits, Rice, corn grits, grains, animal feeds purchased by weight, Bread, banana cue, other street foods, liquid commodities for retail, and Dry goods (canned goods, ready-to-wear clothing, textiles, hardware); e. Distribution, selling and use of LDPE and HDPE for Softdrinks/Energy drinks is regulated within one (1) year from the effectivity of this Ordinance and becomes prohibited after such period. f. Distribution, selling and use of PET bottled water with 1,000ml capacity and below is regulated within one (1) year from the effectivity of this Ordinance and becomes prohibited after such period. g. Mass release of balloons into the open air.

Section 11. INFORMATION DISSEMINATION. Within thirty (30) calendar days after the effectivity of this Ordinance the PENRO shall: 1. Coordinate with LGUs, all commercial establishments, business establishments, health care facilities, and private and government institutions for information dissemination.

2. Require all commercial establishments, business establishments, health care facilities, and private and government institutions to post Information, Education and Communication (IEC) campaign materials.

Section 12. PENAL CLAUSE. Persons who violate the provisions of this ordinance shall be meted with the following fines and penalties: a. For Natural persons or Individual: First Offense

Five Hundred Pesos (Php 500.00) or 8 8 hours Community Service

Second Offense

One Thousand Pesos (Php 1,000.00) or 16 hours Community Service

Third Offense

One Thousand Five Hundred Pesos (Php 1,500.00) or Render 24 Hours of Community Service

Public Officers and agents found to have violated the provisions or of this ordinance shall be dealt with administratively and shall be penalized by suspension. b.

For Juridical Persons/Establishments:

First Offense

Five Thousand Pesos (Php 5,000.00)

Second Offense

Five Thousand Pesos (Php 5,000.00) and suspension of operation for six (6) months

Third Offense

Five Thousand Pesos (Php 5,000.00) and revocation of business permit

A show cause order shall be issued to the establishment before revocation of business permit.

A citation Ticket shall originate primarily from the City/Municipal Environment and Natural Resources Office of the LGU Concerned.

Section 13. COLLECTION SCHEME AND INCENTIVES The penalties shall be paid to the City/Municipal Treasurer of the concerned Local Government Unit (LGU). Fifty (50) percent of the proceeds shall go to the Trust Fund and shall be used solely for solid waste management projects. The remaining fifty (50) percent shall constitute as incentive of the person or agency who filed a report of the same.

Section 14. IMPLEMENTING AGENCIES The Office of the Provincial Governor thru the Provincial Environment and Natural Resources Office in coordination with all City/Municipal Local Government Units (LGUs) and National Government Agencies (NGAs) shall cause the effective implementation of this ordinance.

• Under Section 10, RA 9003 (Ecological Solid Waste Management Act of 2000) o Barangay LGU – segregation and collection of biodegradable, compostable and reusable wastes. o City/Municipal/LGU – collection of recyclable materials, residual and special wastes.

• Under Article 2 (e), RA 7394 (Consumer Act of the Philippines) o Department of Trade and Industry (DTI) – involvement of consumer representatives in the formulation of social and economic policies.

• Under Section 5 (h) (r), RA 9003 (Ecological Solid Waste Management Act of 2000) o Department of Trade and Industry (DTI) – develop and implement a program to assist local government units in the identification of markets for materials that are diverted from disposal facilities through re-use, recycling, composting, and other environmentfriendly methods and encourage all local government agencies and all local government units to patronize products manufactured using recycled and recyclable materials.

Department of Trade and Industry (DTI) shall promote green economic development projects for MSMEs to become more competitive. This encourages MSMEs to adopt climatesmart and environment-friendly strategies and eventually ensures balance among people, planet and profit.

• Under Section 3, RA 9512 (National Environmental Awareness and Education Act of 2008) o Department of Education (DepEd) and Commission on Higher Education (CHED) – shall integrate environmental education in its school curricula at all levels, whether public or private, including in barangay daycare, preschool, non-formal, technical vocational, professional level, indigenous learning and out-of-school youth courses or programs.

All LGU’s of the Province of Davao del Sur should adopt the Provincial Ordinance.

Section 15. MONITORING AND EVALUATION The City/Municipal LGUs shall submit every six (6) months a Self-Compliance Monitoring and Auditing Report (SCMAR) to the Provincial Solid Waste Management Board through the PENRO-LGU for proper monitoring and evaluation.

Section 16. FUNDING SOURCE The Sangguniang Panlalawigan shall allocate funds for the effective implementation of this ordinance which shall cover all expenses to be incurred in the information dissemination.

Section 17. SEPARABILITY CLAUSE If any provision of this Ordinance or the application of such provision to any person or circumstances is declared unconstitutional, the remaining part of the ordinance or the application of such provision to other persons or circumstances shall not be affected by such declaration.

Section 18. REPEALING CLAUSE All ordinances, resolutions, rules and regulations or parts thereof inconsistent with the provisions of this Ordinance are hereby repealed or modified accordingly.

Section 19. EFFECTIVITY This Ordinance shall take effect fifteen (15) days after the lapse from the date of publication in a newspaper of local circulation or after posting the same in nine (9) Municipalities and one (1) City and penalties shall be imposed six (6) months after its effectivity to give enough time for its Information, Education Campaign (IEC) CERTIFIED TRUE AND CORRECT: (SGD) MARIA LUISA C. DPWH thanks PSC for use of facilities for COVID-19 fight

he Department of Public Works and Highways (DPWH) thanked the Philippine Sports Commission (PSC) for its help, recognizing the sports agency’s initiative of offering its facilities as support to the government’s fight against the COVID-19 pandemic.

“We at DPWH has recognized your unwavering support for the conver-

sion of the Ninoy Aquino Stadium and the Rizal Memorial Sports Com-

plex facility as a designated quarantine facility for COVID-19 patients,” stated DPWH Undersecretary for UPMO Operations and Technical Services Emil Sadain in the DPWH’s letter to PSC. In the letter addressed to PSC Chairman William Ramirez, Usec. Sadain lauded the sports agency’s prompt response to the inadequacy of health facilities due to the influx

of COVID-19 patients.

The DPWH official, who also heads the Task Force on Augmentation of National and Local Healthcare Facilities praised the cooperation of the public and private sector.

“The combined efforts of public and private entities have helped in the swift implementation of the national and local healthcare facilities as one

of your urgent measures in addressing the current health crisis,” expressed Sadain.

Dinwiddie, in his sixth season in the NBA, is averaging a career-high 20.6 points along with 6.8 assists per game for the Nets.

n a year where sports is almost forgotten, two young Dabawenyo athletes will be taking their moment of glory amid the silent confines of the quarantine era.

Karatedo’s Robert Lawrence Avancena and Arnis’ Sherhalee Bulaso were named 2020 So Kim Cheng Sports Awards co-Athletes of the Year by the Davao City Sports Council Incorporated after the conclusion of its screening and deliberations last week.

Avancena and Bulaso will be conferred the most presitigious sports award in Davao City from the enduring sports patron So Kim Cheng Sports Foundation Incorporated, which is now on its 26th year.

The award is given every year to the city’s top male and female athletes and is named after the late sports patron So Kim Cheng.

The 13-year old Avancena was a gold medalist in the -55kgs kumite in the 2019 Batang Pinoy National Finals held in Puerto Princesa, Palawan.
