Ecoland Police Station (PS 16) is temporarily located on the ground floor of the Traffic Enforcement Unit Building at Ecoland and will cover barangays Bucana 76-A, Matina Aplaya 75-A, and Matina Crossing 74-A. Baliok Police Station (PS 18) is temporarily located beside the Barangay Hall at Baliok, Toril and will cover barangays Catalunan Pequeno, Bago Gallera, Bago Aplaya, Dumoy, and Baliok.

Among the major highlights of last year’s SOCA was Mayor Sara calling on national government agencies to get three major projects moving by acting on the review of documents and giving final approval such as the pending construction of the Davao-Samal Bridge, a waste-to-energy (WTE) facility, and the rollout of the High Priority Bus System (HPBS).

The mayor also vowed to make the city debt-free by 2022. Other priorities she cited were the con-

struction of infrastructure for the education and health sectors, zero backlog in classrooms, a “state-of-the-art” library, a new city health office and lying-in clinics.

After SOCA, the city government of Davao will be working for the Supplemental Budget No. 3 followed by the preparations for this year’s Pasko Fiesta.

The city will continue the holding of the gift-giving, however, not allowing all types of parties.

Two 30-min power interruptions on October 23 in Buhangin area

avao Light and Power Co., Inc. will conduct two 30-minute power interruptions on October 23, Friday, affecting customers in Buhangin.

These service disruptions will be necessary to facilitate relocation of poles along Milan to Panorama road affected by the DPWH road widening project.

PRO 11 turns over RMFB admin, jurisdiction to DIPO

By ARMANDO B. FENEQUITO JR. he Police Regional Office (PRO) 11 has transferred the administrative and operational jurisdiction of the Regional Mobile Force Battalion (RMFB) to the Directorate for Integrated Police Operations - Eastern Mindanao (DIPO-EM).

In a turnover ceremony on Monday, the PRO 11 gave the supervision of the 2,100-strong RMFB 11 personnel including the Provincial Police Mobile Force Companies.

DIPO-EM Director Maj. Gen. Arnel Escobal said in an interview that the move aims to strengthen its Internal Security Operations (ISO) of the police in the remote areas identified as Geographically Isolated and Disadvantaged Areas (GIDA) in Eastern Mindanao without the worrying the problem of regional boundary.

“This will also include search and rescue operations if there will be natural calamities to happen,” he said.

Escobal said that since all DIPOs become the Area Command of the PNP all over the country, they are now in-charge of securing all the development projects implemented in the remote areas.

“Lahat ng DIPO kasi, will be taken out of Camp Crame. So yung North-

San Miguel rolls out bike program for employees

an Miguel Corporation (SMC) has rolled out a program to provide employees and its extended workforce with bicycles as an alternative mode of transportation as part of its continuing efforts to ensure safety at workplaces, and provide its workforce convenience amidst travel restrictions across much of the country.

The program enables them to avail of bicycles and safety helmets at almost giveaway prices. A bicycle ranges from P2,000 to P3,000 for high-quality, feature-laden bicycles— which they can then pay for with no interest for 12 months. The bulk of the cost for the bicycles is shouldered by SMC. SMC president Ramon S. Ang said the program was prompted by a surge in demand for bicycles among employees as the company continues to safely bring its employees back to work to continue essential operations.

“While we continuously do mass RT-PCR testing of all 70,000 employees and extended workforce to ensure safety in our facilities

and offices nationwide, and even as we observe strict safety and health protocols, we understand there’s also a need to provide convenience and additional safety to many of our workers, when they go to work,” said SMC president and chief operating Ramon S. Ang. “Right now, our transportation system is still limited, and we see that more of our employees are biking to work. So we thought to provide them new bicycles. We bought an initial 1,500 units for our facilities in different locations. Almost as soon as we offered them, all were taken. can be summed up in one amazing event, the UGMAD Festival. This is an event where farmers, fisherfolks and even ordinary households can showcase their produce. CAGRO, as a member of the CNC, sees this festival as an opportunity for them to deliver support and services, not only to farmers and fisherfolks but to households in need.

In 2018, 8,000 hito and 112,000 bangus fingerlings were distributed by BFAR, while 205 bags of rice seed subsidy were distributed

by CAGRO to target beneficiaries. To further improve the delivery of agricultural services, the city government institutionalized and deployed 21 Barangay Agricultural Workers or BAW who will serve as CAGRO’s partners in monitoring and implementing the various agri-fishery related projects and programs at the barangay level. Among the many duties and responsibilities of these workers is the monitoring of backyard and community vegetable garden, under the Gulayan sa Pamayanan at Paaralan Program, provide technical assistance to households and the community in the proper implementation of community-based food production. In turn, these workers are supported by the city government with Php 2,500 monthly honorarium.

Additional personnel was also hired by the city government to operationalize the Farmers Agriclinic, being an integral part of the Hugpong Serbisyo Para sa Tagumenyos.

DAMAGES FOR UNJUSTIFIED WITHHOLDING OF THE SEAFARERS’ TRAVEL DOCUMENTS Manning companies are liable for damages due to unjustified withholding of seafarers’ travel documents preventing them from seeking lucrative employment elsewhere.

The Supreme Court considered the company’s arbitrary imposition of a condition that the travel documents would only be released upon signing of a quitclaim as an act tantamount to bad faith in the case of C.F. SHARP & CO. INC. vs Agustin and Minimo (G.R No.179469, February 15, 2012).

The seafarers applied with the company as sandblasters and painters in Libya.

After passing the interview, they were required to submit their passports, seaman’s book, National Bureau of Investigation clearance, employment certificates, certificates of seminars attended, and results of medical examination.

Upon submission of the requirements, a Contract of Employment was executed between the seafarers and C.F. Sharp.

Thereafter, seafarers were required to attend various sem-

inars, open a bank account with the corresponding allotment slips, and attend a pre-departure orientation.

They were then advised to prepare for immediate deployment and to report to the company to ascertain the schedule of their deployment.

However, the seafarers were not deployed after a month prompting them to request for the release of the documents they had submitted to the company which allegedly refused to surrender the documents.

The seafarers filed a complaint for breach of contract and damages against the company where they claimed that the company falsely assured them of deployment.

They added that its refusal to release the travel documents on the ground that they were already bound by reason of the Contract of Employment denied them of employment opportunities abroad and a guaranteed income.

The company was found guilty of violation of Article 34(k) of the Labor Code, which

makes it unlawful for any entity “to withhold or deny travel documents from applicant workers before departure for monetary or financial considerations other than those authorized under this Code and its implementing rules and regulations.”

The Supreme Court awarded moral damages based on Article 2219 of the Civil Code in relation to Article 21 which state that “any person who wilfully causes loss or injury to another in a manner that is contrary to morals, good customs or public policy shall compensate the latter for the damage.”

The Supreme Court stressed that the company committed an actionable wrong when it unreasonably withheld the documents, thus preventing the seafarers from seeking lucrative employment elsewhere.

The condition that the documents would only be released upon signing of a quitclaim is tantamount to bad faith because it effectively deprived the seafarers of resort to legal remedies.

The Supreme Court likewise affirmed the award of exempla-

ry damages for “a wrongful act that is accompanied by bad faith or when the defendant acted in a wanton, fraudulent, reckless, oppressive, or malevolent manner” Legally speaking, the unauthorized withholding of these travel documents is also a form of coercion that is penalized as one of the prohibited acts under Republic Act. No. 8042, as amended by R.A. 10022, otherwise known as “Migrant Workers and Overseas Filipinos Act of 1995.”

The State is mandated to protect seafarers from all threats and coercion done through the confiscation, retention, or withholding of their travel documents such passports and Seafarers Identification and Record Book (SIRB), which are considered the property of the State.

Agencies and foreign principals found violating POEA rules will be blacklisted or penalized in accordance with R.A. 10022.

POEA rules likewise provide that disciplinary actions will be meted against those found violating Philippine laws, rules, and regulations on overseas employment.

The persons criminally liable for the said offense are the principals, accomplices and accessories. In case of juridical persons, the officers having ownership, control, management or direction of their business and the responsible for the commission of the offense and the responsible employees/agents thereof shall be liable.

Any person found guilty of illegal recruitment shall suffer the penalty of imprisonment of not less than twelve (12) years and one (1) day but not more than twenty (20) years and a fine of not less than One million pesos nor more than Two Million Pesos.

In every case, conviction shall cause and carry the automatic revocation of the license or registration of the recruitment/manning agency, lending institutions, training school or medical clinic.

There is indeed something in smile. Tessa Dare, author of A Lady of Persuasion, penned: “Oh, no. Don’t smile. You’ll kill me. I stop breathing when you smile.”

So, why frown when you can smile. In Quote Me Everyday, Santosh Kalwar wrote: “I was smiling yesterday, I am smiling today and I will smile tomorrow. Simply because life is too short to cry for anything.”

Roy T. Bennett, author of The Light in the Heart, has the same view. “A smile puts you on the right track,” he said. “A smile makes the world a beautiful place. When you lose your smile, you lose your way in the chaos of life.”

Smile to everyone. Smile specifically to your loved ones.

“I like it when my mother smiles,” Adriana Trigiani, the woman behind Viola in Reel Life. “And I especially like it when I make her smile.”

Award-winning author Maya Angelou said that if you have only one smile in you, give it to the people you love. “Don’t be surly at home,” she pointed out, “then go out in the street and start grinning ‘Good morn-

ing’ at total strangers.”

Never underestimate the power of smile. At one time, I was mad as hell when someone took the book I bought. I left it on top of my table before I left for work. When I returned home, it was gone. I really don’t have any problem with it if the person who took it just left a note that he was borrowing it. At least, with a note I can always ask the person if he is already done with the book.

But what really got my nerve this time was the fact that I had some scribbled notes on the said book which I inserted. I was afraid that whoever took the book might just throw away the notes I had written.

I was about to give up when my niece came to my room. “I am very much sorry, uncle,” she said. I was surprised; what had she done to me, I asked myself. She took something from her bag and with a big smile, “Here’s your book which I took without your knowledge. I forgot to leave a note.”

It didn’t matter if the book was lost. What mattered most was the fact that here was my niece and with a broad smile eased all those worries. “A smile is central to our evolution and one of the most powerful tools of human behavior,” explains Dr. Cacher Keltner, a

professor of psychology at the University of California, Berkeley, who has studied the importance of facial expression – including the variety and impact of smiles.

In 1872, Charles Darwin proposed in his book, The Expression of Emotion in Man and Animals that facial expressions are biologically based and universal among humans.

However, the celebrated anthropologist Margaret Mead thought the smile was a cultural behavior that varied between societies.

There are several reasons why people smile. One indicator is that he or she is in love.

American balladeer Barry Manilow, referring to his beloved, croons, “I can’t smile without you.”

“A smile costs nothing but gives much,” someone once wrote. “It enriches those who receive without making poorer those who give. It takes but a moment, but the memory of it sometimes lasts forever. None is so rich or mighty that he cannot get along without it and none is so poor that he cannot be made rich by it. Yet a smile cannot be bought, begged, borrowed, or stolen, for it is something that is of no value to anyone until it is given away. Some people are too tired to give you

a smile. Give them one of yours, as none needs a smile so much as he who has no more to give.”

“Smile and others will smile back,” Jean Baudrillard thinks. “Smile to show how transparent, how candid you are. Smile if you have nothing to say. Most of all, do not hide the fact you have nothing to say nor your total indifference to others. Let this emptiness, this profound indifference shines out spontaneously in your smile.”

But more often than not, people stop smiling. It seems they are carrying the whole problem of the world. Even in the early morning, when they should face the new day with gladness, they are already frowning. There are several reasons but those reasons are not enough to let yourself not to smile.

Here’s one poet said, “If at times you feel you want to cry and life seems such a trial. Above the clouds there’s a bright blue sky, so make your tears a smile. As you travel on life’s way with its many ups and downs, remember its quite true to say one smile is worth a dozen frowns.”

The poet continues: “Among the world’s expensive things, a smile is very cheap.

And when you give a smile

away, you get one back to keep.

Happiness comes at times to all but sadness comes unbidden and sometimes a few tears must fall among the laughter hidden. So, when friends have sadness on their face and troubles round them piled, the world will seem a better place and all because you smiled.”

A smile, according to Charles Gordy, “is an inexpensive way to change your looks.” George Eliot surmises, “Wear a smile and have friends; wear a scowl and have wrinkles. American humorist Mark Twain also stated so: “Wrinkles should merely indicate where smiles have been.” Just a reminder: It takes seventeen muscles to smile and forty-three to frown.

Looking for peace between a husband and wife, or between enemies? The answer to that question is a big smile. As Nobel Peace Prize winner Mother Teresa said, “Peace begins with a smile.” A smile, nonetheless, is a powerful weapon; you can even break ice with it. “...and he smiled a lot. SECTION 2. AMENDMENTS – City Ordinance No. 171-14, Series of 2014 or the Davao City Adopt-a-Dog Ordinance shall be amended as follows: SECTION 1. TITLE – This Ordinance shall be known as “The Davao City Adopt-A-Dog-And-Cat (DADC) Ordinance of 2019”.

SECTION 2. POLICY – It is the policy of the City of Davao to ensure the protection of dogs/cats from abuse; the promotion of adoption of dogs/cats, if practicable and necessary, and the rehabilitation of the same.

It is likewise the duty of every pet owner to ensure that their pet dogs/cats are protected from harm and well cared for. The City will exhaust all means to save the life of a dog/cat and shall resort to euthanasia only as the last and desperate resort. Further, this Ordinance is not intended to hinder the anti-rabies program of the City, and in fact, the “Pet-Friendly” policy of the City of Davao must complement its antirabies program.

SECTION 3. DEFINITION OF TERMS. A. Animal Welfare Non-Government Organization. - Animal welfare nongovernment organization and other interested persons that advocate the welfare of animals, especially dogs/cats.

B. Dogs/cats unsafe for adoption or incapable of rehabilitation - Dogs/cats which aggressively attack a person causing physical injury or death, or behave in a manner that a reasonable individual would believe poses an unjustified imminent threat of physical injury or death or provide signs that it is inclined to attack a person without provocation; a dog/cat afflicted with rabies infection or other contagious diseases, viruses or bacteria or a dog/cat with a severe medical condition that would pose danger to adopting individuals or terminally ill ones. The dog/cat size and weight shall be taken into consideration in determining the classification.

C. Dog/cat safe for adoption - Dogs/cats which are sociable or friendly, do not attack aggressively a person, do not pose as an unjustified imminent threat of physical injury or death and give indication that it is liable to attack a person and in good health condition. The dog/cat size and weight shall be taken into consideration in determining the classification.

D. Dogs/cats safe for adoption but requires rehabilitation - Dogs/cats which are sociable or friendly, do not attack aggressively a person, do not pose as an unjustified imminent threat of physical injury or death and give indication that it is liable to attack a person but with physical and medical condition that shall require minor treatment. The dog/cat size and weight shall be taken into consideration in determining the classification.

E. Euthanasia/Mercy Killing - Humane method of inducement which does not result in a prolonged pain and suffering to end the life of a dog/cat.

F. Impounded animals- Stray dogs/cats whether registered or unregistered caught or rescued and impounded at the City Pound. Rescued dogs/cats are included in this definition.

G. Rescued dogs/cats - Any dog/cat which has been subjected to fighting, abandoned, neglected by its owner or severely maltreated by its owner, keeper, or by persons not the owner or keeper, shall be regarded as a rescued dog/cat for the purpose of rehabilitation.

H. Rehabilitated dog/cat - A dog/cat which has sufficiently regained its physical and medical condition which allows it to sufficiently perform its regular movement.

I. Stray dogs/cats - Any dog/cat leaving its owner’s place or premise and no longer under the effective control of the owner. Registered and unregistered dogs/cats and dogs/cats without owners shall be included in this Ordinance.

SECTION 4. ADOPTION OF DOGS AND CATS. A. If at the expiration of three (3) days from the time of impounding, an impounded dog/cat has not been claimed by the owner or keeper, the City Veterinarian’s Office (hereinafter referred to as “CVO” for brevity.) may initially classify the dog/cat for purposes of permanent or temporary adoption to qualified persons, or euthanasia/mercy-killing in accordance with law.

B. It shall be the duty and responsibility of the CVO to immediately, humanely, fairly, and with care, preferably in consultation with a government-registered animal welfare non-government organization, classify within three (3) days from impounding of the dogs/cats whether a dog/cat is (a) safe for adoption, (b) safe for adoption but requires rehabilitation and (c) dangerous for adoption or incapable of rehabilitation. The CVO shall begin observation for rabies infection on the impounded dog/cat classified under (a) and (b) from the time of impoundment up to the 10th day of impoundment unless the CVO requires a longer period of impoundment. After impoundment, the dog/cat shall be declared cleared and placed for adoption. Impounded dogs/cats under (c) shall be euthanized in the most humane manner so as not to cause pain and suffering to the animal in accordance with law, unless Section 4F of this Ordinance is applied.

C. Any person who is qualified to adopt a dog/cat shall be allowed to adopt a dog/cat determined as safe and cleared for adoption preferably of his or her own choice.

D. After the 10th day of rehabilitation unless the CVO determines a longer period of rehabilitation and after the dog/cat has been cleared for adoption, the CVO shall clear the dog/cat for adoption and declare them safe for adoption including rescued dogs/cats under its care and supervision on permanent or temporary adoption to qualified caring and loving individuals only.

It shall exert utmost efforts so that the dogs/cats will be adopted by qualified individuals who will provide for adequate shelter, protection, love and care for the unclaimed or rescued dog/cat declared safe and cleared for adoption. Any person who is a resident of the City for six (6) continuous months of good moral character, of legal age, has not been convicted of violation of the Animal Welfare Act upon the determination of the CVO, appears to have and actually has genuine concern for the welfare and protection for dogs and cats.

E. If the CVO determines that a dog/cat is safe for adoption but requires rehabilitation, the dog/cat shall immediately be placed under observation until the 10th day of impoundment and clearance, the CVO may then place the dog/cat under rehabilitation or for adoption to persons who shall volunteer to rehabilitate the dog/cat or shall volunteer to have the dog/cat rehabilitated through a private animal rehabilitation center or individual who specializes in rehabilitation of dogs/cats. Otherwise, the dog/ cat shall be disposed of through euthanasia.

E.1. If the dog/cat is temporarily adopted, the adoptive person shall take care and custody of the dog/ cat and may proceed with the rehabilitation of the dog/cat as provided by Section 5.E. The CVO shall determine the period of temporary adoption. Upon the expiration of the period of adoption, the CVO shall determine whether the dog/cat has been rehabilitated and qualified for adoption. If the dog/cat is declared as rehabilitated, the same shall be placed for permanent adoption. If the CVO determines that the same had not been rehabilitated, the dog/cat shall be disposed of through euthanasia.

E.2. The person who temporarily adopted the dog/cat shall have priority in the process of permanent adoption of the dog/cat once the latter is declared as rehabilitated.

F. A dog/cat determined to be dangerous for adoption or incapable of rehabilitation shall be immediately disposed of in accordance with law.

To ensure the safety of the public, all dogs/cats shall be presumed unsafe for adoption and incapable of rehabilitation if within three (3) days from impounding, the dogs/cats have yet to be classified in accordance with Section 4.B of this Ordinance. However, in special instances where the dogs/cats are classified as unsafe for adoption or incapable of rehabilitation, the City Veterinarian may allow the adoption or of the dogs/cats to persons who are known or who claim to be knowledgeable in the field of dog/cat training or rehabilitation. Provided, the dog/cat shall be placed under observation up to the 10th day of impoundment unless the CVO determines a longer period of impoundment. Provided, the adopting persons are informed of the classification of the dog/cat, the reason for the classification, the

risks which accompany in the adoption of such dogs/cats, and the persons who seek to adopt shall do so at their own risk. Provided further, that the classification of the dogs/cats classified as unsafe for adoption or incapable of rehabilitation under this provision are not due to rabies infection or other contagious diseases, bacteria, or viruses.

G. The CVO shall coordinate with animal welfare groups and other interested persons to promote, assist, and support in the adoption, and foster care of unclaimed or rescued dogs/cats, and exert all means possible to avoid the destruction of unclaimed or rescued dogs/cats safe for adoption without causing harm to the public. Notwithstanding, it shall likewise be the duty of the CVO to ensure that the initiative shall not unduly congest the City Pound and hinder the anti-rabies program of the City.

Furthermore, the CVO may, in a just and fair manner, permit the adoption of ten (10) dogs/cats a month unless it determines a different number of dogs/cats taking into consideration the following: the safety and security of the public, the effect on the city’s anti-rabies program, the budgetary requirements for the adoption and rehabilitation program, if any, the number of dogs/cats impounded and qualified for adoption, and the estimated number of interested and qualified adopting individuals.

H. The CVO shall coordinate with and encourage participation of animal welfare groups and nongovernment agencies and other interested persons to help strengthen the adoption efforts of unclaimed or rescued dogs/cats especially if found unfit for adoption to willing and qualified individuals.

I. Temporary adoption is a system of adoption where a qualified person is permitted to have care and custody of a dog/cat for a period as determined by the CVO. Within the period of temporary adoption, the foster may likewise encourage the permanent adoption of the dog/cat under his custody. The adopting person shall return the dog/cat to the City Pound or his authorized representative not more than seven (7) days after the expiration of the period of fostering, for adoption to other persons. If within one day from the return of the dogs/cats to the City Pound and after utmost efforts have been made to ensure that a dog/cat will be adopted, the dog/cat shall be subjected to euthanasia.

I.1. In case the temporary foster and other willing and qualified persons decide to permanently adopt the dog/cat, the temporary foster shall be preferred.

J. The CVO shall keep a record of the identity and maintain the whereabouts of the dogs/cats adopted and the individuals or persons adopting. In cases of change of address and contact details, the foster/ adopter must inform the CVO. K. All dogs/cats placed for adoption should be properly vaccinated, neutered or spayed and registered by the CVO. L. All adopting persons shall comply with the responsibilities of pet owners as provided by Section 5 of Republic Act 9482 including the mandatory rehabilitation of the dogs/cats placed for permanent adoption if the individual seeks rehabilitation of the dog/cat elsewhere.

M. The City Veterinarian’s Office shall ensure the proper and timely disposition of dogs/cats classified as unsafe for adoption or incapable of rehabilitation through means allowed by law to prevent endangerment of the public unless the CVO, in its discretion, acts in accordance with Section 4.F of this Ordinance.

Further, the City Veterinarian’s Office shall ensure the proper and timely disposition of dogs/cats classified as safe for adoption and safe for adoption but require rehabilitation which were unable to benefit from adoption with one day from placing the dogs and/or cats for adoption to prevent endangerment of the public.

N. The CVO shall provide adequate information and notice to the public as to the list of impounded dogs/cats classified as safe for adoption or safe for adoption but require rehabilitation who will be undergoing a period of observation for rabies infection before possibly being formally placed for adoption.

SECTION 5. REHABILITATION OF DOGS/CATS. A. The City Veterinarian’s Office may provide for a dog/cat rehabilitation program at the City Pound which shall undertake the rehabilitation of dogs/cats qualified for adoption including rescued dogs/ cats and other dogs/cats not impounded. The rehabilitation program shall provide for the following: determination of the physical and medical condition of the dogs/cats and determine if the same are capable of rehabilitation within the time provided by the program, the procedure for treatment of the dog’s/cat’s physical and medical condition.

B. The period of rehabilitation which shall not be more than five (5) days unless the CVO requires a longer period taking into consideration the following: the availability of funds, personnel, equipment, and facilities for the implementation of the program, the gravity of the physical and medical condition of the dogs/cats, and the number of dogs/cats placed under rehabilitation. If permissible without causing danger to any individual, the rehabilitation may be undertaken during the period of confinement for observation for rabies virus contamination.

C. The CVO shall determine if a rescued dog/cat which has undergone rehabilitation and recovery procedure, has been rehabilitated. A dog/cat shall be considered as rehabilitated if the CVO has diagnosed the improvement of the physical and medical condition of the dog/cat and cleared the same for release.

D. As far as practicable, the CVO shall have a rehabilitation and treatment facility separate from the regular impoundment area for dogs/cats.

E. The CVO shall seek the cooperation and participation of animal welfare groups and other interested persons in the rescue, rehabilitation and recovery of rescued dogs and cats. The CVO will allow the participation of the animal welfare groups and other interested persons in the informationdissemination drive of the City on the existence of the Adopt-A-Dog-And-Cat Program of the City, including providing information on the possible violation of the Animal Welfare Act, and providing advice and recommendation to the CVO on the implementation of the rehabilitation program, if any.

Furthermore, animal welfare groups and other interested persons may be permitted to undertake the rehabilitation and recovery of the dogs/cats under the care and custody of the CVO, and undertake the rescue of stray or abandoned dogs/cats and turn over the same to the CVO or with the permission of the latter, opt to adopt, permanently, or volunteer to rehabilitate the rescued dog/cat in accordance with the provisions of this Ordinance.

F. The adopting persons may be charged with reasonable fees for the rehabilitation and treatment of the dogs/cats.”

SECTION 6. SEPARABILITY CLAUSE – If, for any reason, any section or provision of this Ordinance is declared unconstitutional or invalid, other sections or provisions hereof not affected by such declaration shall continue to be in full force and effect.

SECTION 7. EFFECTIVITY – This Ordinance shall take effect immediately upon approval.

SECTION 3. IMPOSITION OF SPECIAL REAL PROPERTY TAX – There shall be imposed Real Property Tax Rate of One and a half percent (1.5%) on realty, power plant, civil works, equipment, machinery and other improvements by a DOE-registered renewable energy developer under Republic Act No. 9513, which are actually and exclusively used for renewable energy facilities.

SECTION 4. DISTRIBUTION OF SPECIAL REAL PROPERTY TAX – In proportion to the real property tax and special education fund imposed by the 2017 Revenue Code of Davao City, the special real property tax rate of one and a half percent (1.5%) shall be distributed at nine-tenths percent (0.9%) to the General Fund as basic tax and the remaining six-tenths (0.6%) to the Special Education Fund.

SECTION 5. EXCEPTION – All other realty, equipment, machinery and improvements of DOE-registered renewable energy developer not exclusively used for the renewable energy facility or not necessary for energy generation shall continue to be subject to the impositions of the 2017 Revenue Code on real property tax.

SECTION 6. SEPARABILITY CLAUSE – If, for any reason, any section or provision of this Ordinance is declared unconstitutional or invalid, other sections or provisions hereof not affected by such declaration shall continue to be in full force and effect.

SECTION 7. EFFECTIVITY – This Ordinance shall take effect immediately upon approval.

SECTION 4. EXCEPTION – Advertisements caused to be posted or displayed by the City Tourism Operations Office (CTOO) or by the City Government of Davao shall however be allowed.

SECTION 5. PENALTY – Commercial advertisements displayed inside and outside of the premises of DavaoInternational Airport in violation of this Ordinance, shall immediately be removed, without prejudice to the suspension of their business permit as penalty for the first offense and the revocation/cancellation of business permit as penalty for the second offense and the imposition of a fine in the amount of Five Thousand Pesos (Php 5,000.00) in all instances against the erring party responsible for advertisement(s).

SECTION 6. SEPARABILITY CLAUSE – If for any reason, any section or provision of this Ordinance is declared unconstitutional or invalid, other sections or provisions hereof not affected by such declaration shall continue to be in full force and effect.

SECTION 7. REPEALING CLAUSE – Any Ordinance, local issuances or rules inconsistent with the provisions of this Ordinance are hereby repealed or modified accordingly.

DPWH creates task force to look into alleged department anomalies

T

he Department of Public Works and Highways (DPWH) has created a task force to look into alleged anomalies entered into by employees and officials, after state auditors flagged over P100 billion worth of delayed and unimplemented projects in 2019.

In a Department Order dated October 17, Public Works and Highways Secretary Mark Villar ordered the creation of the Task Force Against Graft and Corruption (TAG) to be headed by Assistant Secretary Mel John Verzosa.

TAG will be vice-chaired

by DPWH Director Gliricidia Tumaliuan-Ali, and count as members DPWH Director Michael Villafranca, DPWH Stakeholders Relations Service officer-in-charge Andro Santiago, and Atty. Ken Edward Sta. Rita.

"The TAG shall investigate anomalies allegedly perpetrated by officials and/ or employees of the Department, based on valid complaints," the order read.

"The TAG, upon observing due process, shall recommend to the Office of the Secretary, through a resolution, the appropriate action(s) to take concerning the erring official(s) and/or employees," it added.

The order also gave TAG the authority to create a Technical Working Group

(TWG) that will serve as a secretariat and aid on the exercise of the TAG's functions.

In its 2019 annual audit report on DPWH, the Commission on Audit (COA) flagged some P101 billion worth of delayed and unimplemented projects, the second straight year of violating the Procurement Law after some P118-billion in projects were recorded the previous year.

COA noted that the records for 2019 cover 2,411 infrastructure projects, school buildings, and farmto-market road projects: P65.9-billion worth of projects unfinished or uncompleted within the specific contract time or required completion date; P31-billion worth of suspended projects; P1.44-billion worth of terminated projects; and P3.2-billion worth of projects which have not been started at all during the year President Rodrigo Duterte on Monday defended Villar, saying the latter has a lot of money and need not be corrupt.

Earlier in the day, Malacañang said Villar continued to enjoy Duterte’s trust and confidence even after the Chief Executive raised the problem of corruption in the DPWH.

Derrick Rose trade to Lakers gaining traction

Derrick Rose transfer plan to the Los Angeles Lakers that did not materialize at the trade deadline is likelier to be consummated this time.

An NBA general manager believes both the Detroit Pistons and LA Lakers are in better position to make a deal now.

“I think both sides were reluctant when they went into in January, February,” a general manager told Sean Deveney of Heavy.com.

“I don’t think the Lakers wanted to make a major move because they thought they could

do something on the buyout market. And I don’t think the Pistons wanted to make a major move because Derrick was happy there. You know, the Lakers wanted to be involved in case the Clippers got involved or someone else, the Bucks or the Nuggets, whoever. So there was interest but not too serious. Now, everything has shifted a little. Now, they’re both in a position to where a deal is much more likely now.”

amboanga City reigned supreme in the Chooks-to-Go Pilipinas 3x3 preseason tournament, beating Bacolod, 21-17, in the final on Monday night at the Inspire Sports Academy in Calamba, Laguna.

Joshua Munzon’s backto-back deuces helped Zamboanga City survive a gritty stand from Bacolod that saw the latter come to within one with less than three minutes left.

With his team just up, 16-15, Munzon went to work, dropping two straight long toms to bring Zamboanga City to

within match point at 2016.

Chris Lalata scored on a two-handed jam to keep Bacolod in the fight, but Alvin Pasaol converted the match point to seal Zamboanga City’s win.

Munzon finished with seven points to lead Zamboanga City, which won P50,000.

Santi Santillan contributed six points, Troy Rike added five markers and Pasaol finished with three.

LIFTING RESTRICTIONS ON SPORTS EVENTS I am not happy that after seven months of lockdown, restrictions on sports activities are still very tightly watched.

Among the human endeavors that the IATF should look upon with favor, sports events should be one of the least sources of viral infection because seating arrangements inside arenas and stadiums can be so numbered so that spectators can practice standard health protocols such as social distancing.

Unlike the malls where hundreds (or thousands) of shoppers habitually troop to and amass, the entry of spectators watching the PBA for example can be limited accordingly.

For this reason, even while the PBA has been allowed to fol-

low the Miami NBA bubble by holding its spectator-less games at the Angeles University Foundation gym in Pampanga, the set up seems to be more like a trial balloon than anything else.

At any rate, the IATF, by giving the PBA its greenlight, may as well permit the other sports leagues to raise their curtains and forthwith hold their tournaments.

The NCAA and UAAP are already behind their annual schedule while boxing, where Pinoy gladiators – several of whom are either reigning and defending titleholders - are itching to climb the ring, remains on hold.

Perhaps, the MP (Manny Pacquiao) Boxing Promotion may lead the way by staging elimination tournaments in four or less weight categories leading to title matches, which, I think might spark immediate response from the boxing circles.

The Philippine Chess Federation might also consider holding an Asian invitational tournament for both men and women in either Subic or perhaps Bo-

racay to revive and boost the country’s now-fledgling tourism efforts.

Cycling is another eco-sports friendly tourism booster. A short ten-lap mini competition for the youths in every region will help discover potentials. Cycling is a sport where the Pinoy, given the right opportunity, can hold his own in the international level.

I wonder though if the DepEd, so consciously apprehensive about the infectious reach of the CoVid 19 virus, can manage to re-institute the aborted 2020 Palarong Pambansa next year.

ikey Garcia says Conor McGregor won’t be the next opponent for Manny Pacquiao. The former four-division world champion Mikey (40-1, 30 KOs) states that it will be him that takes on the 41-year-old Pacquiao (62-7-2, 39 KOs) in 2021.

boxing are promotions that are “going out of business” type of events.

White talked about poor fights that have no intention of being competitive or entertaining being sold to the public.

Mikey claims that he’ll be the next opponent for the former eight-division world champion Pacquiao and he’s “100 percent” sure of that.

Unfortunately for the 32-yearold Mikey, boxing fans DON’T want to see WBA welterweight champion Pacquiao face him. They want to see Manny take on IBF/WBC champ Errol Spence Jr or WBO champion Terence Crawford. As far as the casual boxing fans go, many of them wouldn’t mind seeing Pacquiao take on former UFC star McGregor in his next fight.

Pacquiao hasn’t said who he plans on fighting next, but it would be a let down for boxing fans if he picks Mikey as his next opponent. After two fights at 147, it’s evident that Mikey isn’t big enough to be a factor in the welterweight division.

If the Pacquiao vs. Mikey fight happens, it’ll likely be on pay-per-view, and it could result in poor sales. For the fans that do pay to watch it, they may end up angry afterward at having wasted their money. In some respects, it would be the equivalent of Floyd Mayweather Jr vs. Logan Paul.

In other words, Pacquiao vs. Garcia will be a circus fight that won’t be even remotely competitive. Mikey is a good fighter in the lower weight classes, but he’s too short, too weak, and too slow at 147. Also, Mikey’s historically poor work-rate handicaps him at 147.

“No fight yet. Me personally, I don’t have a fight date yet. I think it’ll be 2021,” said Mikey Garcia to Fighthype. “I saw the Tweets from [Conor] McGregor, but I haven’t seen any from Pacquiao. Are there any responses from Pacquiao yet? I haven’t seen any.

“I only saw what McGregor Tweeted out that his next fight is Manny Pacquiao in Saudi Arabia or the Middle East or something like that. Well, I think he might be right. I’m pretty confident that his next fight is Manny Pacquiao. Manny Pacquiao’s next fight is NOT Conor McGregor.

“Manny Pacquiao’s next fight is with me. So McGregor has to take a number. McGregor’s next fight might be against Manny Pacquiao, but before that, Manny Pacquiao has to fight me first, and that’s 100%,” Garcia said.

It sounds like Mikey is just talking and hoping that Pacquiao will elect to fight him next rather than knowing for sure. Pacquiao fighting little Mikey makes zero sense because he can make more money facing McGregor, Spence, or Crawford.

There isn’t demand from boxing fans in a Pacquiao-Garcia fight, and one primary reason for that is Mikey’s poor showings at 147 against Spence and Vargas. Mikey’s record is 1-1 at welterweight, and he already fought for a world title in 2019 against Spence and lost. Mikey would be the last guy that fans want to see Pacquiao fight at this point.

If it were a stay busy type of situation, Mikey would be a decent warmup opponent for Pacquiao, but it’s not a fight that will attract interest.

In boxing, a world title challenger that gets beaten has to rebuild and get moved back up the rankings before they’re given another title shot. What Mikey is trying to do is go right back in there to challenge for a world title despite getting beaten when challenging Spence last year for his IBF belt.

It’s like a team going to the Super Bowl and getting blown out, and then asking to be put right back into another Super Bowl without earning their way to the game by winning and progressing through the playoffs.
