he Department of Labor and Employment (DOLE 11) disclosed that payment of the 13th month pay is mandatory despite the pandemic.

DOLE 11 senior labor and employment officer (LEO) Sonia Delfin said in an email interview that the mandatory 13th-month pay is based on Presidential Decree (PD) No. 851 requiring employers in the private sector to pay their rank-and-file employees a 13th month pay.

“Ang submission sa mga companies on the report on 13th month pay usually December,” Delfin said.

The law stipulates that a minimum 13th month pay required by law shall not be less than one-twelfth of the total basic salary earned by an employee within a calendar year. This minimum amount shall be provided

without prejudice to existing company practice and policy, employment contract or collective bargaining agreement.

It also stated that the employer shall pay the 13th month pay on or before December 24, 2020.

No request or application for exemption from payment of 13th month pay or for deferment of payment shall be accepted.

Employers are also instructed to make a report of their compliance with the law to the nearest DOLE regional office not later than January 15 of the following year and the report shall conform the following: name os establishment, address, principal product of business, total employment, total number of workers benefitted, amount granted per

hangin, Malita, Davao Occidental.

Based on reports, the student was found hanging inside the bedroom with a nylon rope on Sunday still clutching his module.

Davao reactivates Peace 911 initiative in Paquibato District

he Davao City government announced on Sunday the reactivation of the Peace 911 initiative in Paquibato District before the month ends.

In a statement, the city government said the comprehensive peace-building and development initiative will now be handled by its new program action officer Aileen Mabanding, who committed to delivering the vision of the program.

“After some needed adjustments were done, we are once again out to restart the program,” it said.

The implementation of the initiative was temporarily suspended in August after it encountered challenges that warranted an urgent reevaluation of some of its aspects.

The bringing of government services, such as health and nutrition and other services to far-flung areas of Paquibato District, will also resume.

“With this, we reiterate that the local government is committed to fully deliver the promise of meaningful

peace and sustainable development to our indigenous brothers and sisters in Paquibato District,” the statement read.

Formerly a hotbed of the terrorist activities of the New People’s Army (NPA), Paquibato District is now slowly coming out of the depressing condition of poverty and hunger, lack of livelihood, inaccessibility of education, and problematic road network and infrastructure that could stimulate local economic activities.

“This situation has gripped Paquibato District for many years and we want to reverse the condition of the people for the better.

The program’s livelihood intervention for the residents —called Peace Economy— will continue after it has already gained an encouraging headway,” it further said.

German sailor helps Mati mangrove refo

By HENRYLITO D. TACIO orld-class offshore sailor Boris Herrmann, who is collaborating on a mangrove reforestation program with a Davao-based foundation, is set to become the first German ever to sail the legendary Vendee Globe Race, said a press statement obtained by EDGE Davao.

A non-stop, unassisted, singlehanded round the world race via the three capes, the Vendee Globe is the Holy Grail for solo sailors. Setting sail from Les Sables d’Olonne every four years, the ninth chapter of this reference race will start on November 8, 2020.

“Only a small group of international top profes-

sional sailors could qualify for participation in this race,” said the press statement released last October 16. “This extreme event fascinates millions of people around the world.”

Previous winners were Armel Le Cleac’h, Francois Gabart, Michael Desjoyeaux, and Vincent Riou.

Herrmann, who comes

from Hamburg, has been involved in a couple of world records in the past, including the Golden Globe Around America, Transpac, Cowes-Dinard, Cape-Rio, San Francisco-Shanghai, Newport-Bermuda, Columbus Route and Giraglia. “(The Vendee Globe) is not the only race that Boris is highly committed,” the statement said. “Boris focuses his energy on ocean research and climate change.”

His vessel – named Malizia II – is equipped with a SubCtech ocean sensor which collects ocean carbon dioxide data on the high seas. “(The collected data) is transmitted to our partners at Max Planck Institute for Marine Research in Hamburg, Ifremer in France and to Geomar in Kiel,” the statement said.

The said institutes make the data available to research institutions around the world. “The aim is to better monitor and understand the effects of climate change on the ocean,” the statement said, adding that his yacht will be decorated with the United Nations Sustainable Development Goals (SDGs).

SDGs has 17 goals, three of which are Climate Action, Life Below Water, and Life on Land. Herrmann is trying to accomplish some of these goals in his own way through sailing.

So much so that in 2018, he teamed up with Davao-

based Mama Earth Foundation (MEF) to offset the team’s carbon footprint.

He reportedly paid for the planting of over 44,000 trees and mangroves over two years.

Just recently, he has gone one step further and created a long-term cooperation with the MEF. “To mark the start of the Vendee Globe, a much further-reaching project is being launched: The Malizia Mangrove Park,” the press statement said. “In order to fill this park, the MEF will plant one million more mangroves in Mati, on the south coast of Mindanao, where the first 44,000 mangroves have already been planted.”

The statement is referring to Mati City in Davao Oriental. “The mangrove existing in the area will be combined in a protected park,” it added.

Herrmann believes mangroves are the “secret weapons” against climate change. “They permanently bind large quantities of carbon dioxide with similar levels of success to that of the tropical rainforests,” the statement said.

“The also form an important habitat for marine and coastal life and protect both the coasts, e.g. from tsunamis, and the reefs off the coast from destruction by sand inundation.”

he Philippine Health Insurance Corporation (PhilHealth) is aiming to settle this month its remaining overdue balance amounting to nearly P1 billion to the Philippine Red Cross (PRC) in order to resume the latter’s conduct of COVID-19 tests chargeable to the state health insurer.

In a Dobol B sa News TV interview on Sunday, PhilHealth spokesperson Rey Baleña said they are now waiting for a clearance from the Department of Budget and Management to proceed with the payment of the balance.

“Kamakailan nga ay pinahayag na meron tayong balanse na kulangkulang isang bilyon at ito ang sa kasalukuyan ang hinihingan namin ng clearance muna. If good to go, kumbaga, agad-agad natin

Asked if it could be settled within this month, Baleña said: “Opo. Hindi magtatagal ‘yan.”

ennis Uy's PH Resorts Group on Monday said it has priced its follow-on offering at P1.68 per share, nearly at the midrange of its indicative offer price of P1 to P2.50.

The Udenna Group’s gaming and hospitality subsidiary is offering up to 450 million primary common shares, inclusive of over allotment option.

“Another achievement unlocked. We are one day closer to our cherished dream of completing Emerald Bay. At the offer price, investors will be given a good opportunity to get in early at attractive valuation levels,” said PH Resorts Group chairman Dennis Uy. Offer period is tentatively set on October 21 to 28, subject to the receipt of the Securities and Exchange Commission's permit to sell, it said.

Listing date is on November 5.

Net proceeds will be used to partially fund the completion of Emerald Bay, its flagship integrated casino beach front resort in Mactan Cebu.

Emerald Bay will be constructed in two phases, with the targeted completion of the first phase by the second quarter of 2022. Upon completion of the first phase, Emerald Bay will feature 122 gaming tables for mass, premium mass and junkets; 600 electronic gaming machines and 270 hotel room bays.

Baleña, nevertheless, assured the public that PhilHealth has enough

funds for the payment of the outstanding balance, as its partnership with PRC on the conduct of COVID-19 tests is part of the overall government response on the health crisis.

PhilHealth president Dante Gierran said on Friday the state insurer will not pay its debt of almost P1 billion to the PRC until all legal issues regarding their memorandum of agreement are settled amid the COVID-19 pandemic.

Avisado assured that the government has enough funds to continue its programs to respond to the COVID-19 pandemic, and although selling of properties is "possible," it is far-fetched at this time.

"Posible pero malayo sa ngayon dahil meron naman tayong pagkukunan at unprecedented nga 'yung ating dollar reserves, talagang lumaki masyado. So wala tayong kaba at hindi na tayo, at this point, kailangan magbenta ng properties," he said.

President Rodrigo Duterte said in April that he would consider selling the assets of the Philippine government if its funds for the fight against COVID-19 and for the assistance to affected Filipinos run out.

Bangko Sentral ng Pilipinas (BSP) Governor Benjamin Diokno however said Duterte was only joking when he raised the possibility, adding that the country does not need to sell its assets to avail of COVID-19 vaccines.

Presidential spokesperson Harry Roque, meanwhile, said in July that the government would sell its assets to fund the purchase of a vaccine to combat the

spread of COVID-19.

In September, Roque said the Philippines would sell its pieces of property in Japan only if necessary.

Avisado said that while there were proposals to sell government assets, the President is not very much inclined to do so at the moment.

"Kaya nga dahan-dahan natin binubuksan ang ekonomiya at makita niyo ang pagbibigay ng mas marami pang paraan ang IATF sa mga activities na kung saan makakapagbalik-sigla sa ating ekonomiya," he said.

For now, Avisado said the government has already identified the funding source for the procurement of a working COVID-19 vaccine, as what the President said last week.

Kaya nga sinabi na ng Pangulo na nakahanap na siya ng pondong ilalaan para diyan sa pagbili ng vaccine," he said.

"Tinatayang aabutin siguro ng mga 20 million ang tatargetin natin na mabibigyan ng vaccine kapag 'yan ay naging available na," he added.

Duterte, however, said that ideally all 130 million Filipinos would be given the vaccine against the deadly coronavirus.

He added that the poor will be given the vaccine first using the list from the government’s Pantawid Pamilyang Pilipino Program.

Nat’l Land Use Act needed to ensure PH food security

A MEDICAL DOCTOR’S WAR DIARY There are very few written eyewitness accounts depicting the emotions and observations the day Davao region was drawn into the global conflict in December 1941. Coinciding with the tragic destruction of Pearl Harbor, Davao City, home to roughly 20,000 Japanese nationals, was also bombed by Japanese Zero planes that same day.

Dr. Santiago Dakudao, first director of the Japanese-owned Mintal Hospital, was inside his room when the first bombs were unleashed. His war diary, written on fragile, onion-skin paper was later found by his architect-grandson, Michaelangelo E. Dakudao, in April 1987, inserted between the pages of a history book that was part of the old man’s library collection.

In clear language, Dr. Dakudao, now retired and successful as investor, realtor, and farmer, described what happened on December 8, 1941, feast of the Immaculate Conception: “We were awakened form out sleep by the heavy drones of devastating planes in the early morning. The calendar on the wood-panelled wood of our bed-

room said December 8, 1941.

The thunderous explosion of the bombs shook the huse from its very foundation. The windows which I had opened revealed a clear vista of the planes in the formation of a 9O11 floating out of the now almost clear morning day. It was remarkable, I thought to myself, that the Americans were out on target practie this early. […]

“Japans truck without warning. The Pearl Harbor of the Americans was vanquished rendering it futile. This was the news we had heard all over the radio but not much detail was given.

The saddest and most alarming information we got was that Manila was bombed, too. The extent of the damage was not yet available to the public. Alas, war was with us.

“Later this morning, I came across Engineer [Brigido] Valencia at San Pedro, the commercial district. The engineer has been a long time friend whose services had been employed in the construction of some of my buildings. He showed me some of the fragmentary shrapnels of the bombs used by the Japanese in

ravaging the Sasa airdrome. This tangible proof of the reality of war gave me qualms about what lay ahead of us.”

Dr. Dakudao had a particularly good impression about the Japanese people. His first encounter with them was as student of Japan Medical School and later as medical director in Davao. Following his resignation, he turned to agriculture and invited Keniche Migitaka, a Japanese, to manage his farm and hired Japanese laborers to cultivate his farms.

Given the destruction the attacks created, Dr. Dakudao did not harbor anger towards ordinary Japanese but strongly disagreed with the way the Japanese Imperial soldiers committed war atrocities. Continuing with his narrative, his diary provides evidence that Japanese landing in Davao via the gulf of Davao happened on December 19, 1941, a day early than widely recorded in many war chronicles and historical accounts: “In the wee hours of the 19th of December, we were awakened by the continuous rapping on the door. I had to

drag myself from bed to go down to check who it was. It was the watchman who was overly excited to inform me that a number of planes were flying all over. A few minutes later, bomb explosions were heard. I had gotten accustomed to these incidences that I accepted the fact that war was with us. Because of this, I managed to return to sleep. We woke up quite early to the new that the city was bombed. By eight o’clock, we were informed of a heavy combat ensuing at the Talomo area. Evidently, the Japanese had already landed. Bombing explosions interspersed with the sounds made from the firing of machine guns filled the air. We also learned that the Japanese troops, in flanking movement, were marching towards Davao City. They were landed one batch after another in Sasa and Talomo. Our troops were caught in between with no escape except towards the hills. The Generoso Bridge was rendered useless by heavy bombing and the escaping civilians had to swim across the Davao River to get to the other side. The casualties from both our Filipino troops and civilians

were innumerable, struggling in agonizing death throes against the formidable weapons of the Japanese. The invaders had tanks, planes and cannons all being nloaded from warships while our own soldiers had only their will to fight against the dreadful armaments of the Japanese.

When our soldiers realized the futility in their struggle against the invaders, they retreated and started fleeing demoralized. The unbearable part was that the civilians became an easy target for the enemies’ bullets. The Japanese soldiers who seemed to relish in the positive ttucome of their military strategy made further attempt to disconcert the civilians by dropping their bombs at random.”

Dr. Dakudao, born in Dingle, Iloilo, on April 12, 1892, his wife Carmen Lacson, a native of Jaro, Iloilo, and his entire family survived the war. Highly esteemed and admired, he died on May 2, 1978 and his remains, along with those of his wife and son Santiago, Jr., were buried at the family mausoleum in Tugbok, which was a former residence when war broke out.

I was totally shocked when the man in-front of me was Hollywood actor Dennis Quaid (yes, the man who appeared in such movies as Breaking Away, The Right Stuff, The Parent Trap, The Day After Tomorrow, and Far from Heaven). He was wearing jacket and didn’t bring anything.

In-front of him was a fat lady who was bringing a lot of bags and a luggage. Seeing that she was having a hard time, Quaid asked: “Can I help you bring some of your bags?”

The woman looked at her and without hesitation, she gave at least two bags to Quaid. He placed them in his shoulder and

everything went fine.

We were inside the waiting area and I couldn’t help but wondered. “Do you know her?” I asked him. “No,” he replied. “But she needs help!”

Quaid may be rich and famous but he also a human being.

He understands well when someone needs help. “Three things in human life are important: the first is to be kind; the second is to be kind; and the third is to be kind,” Henry James reminded.

Until now, I couldn’t forget what Quaid had done. “A random act of kindness, no matter how small, can make a tremendous impact on someone’s life,” Roy T. Bennett wrote in The Light in the Heart.

American journalist Sydney Harris (of “Strictly Personal” distinction) once shared his observation on kindness. “A couple of weeks ago, a fractured bone in my foot made it necessary for me to hobble around with a cane for several days,” he wrote.

“What was pleasant about this otherwise painful experience was the way I was treated by everyone. People opened doors for me, helped me into cabs, gave me room in elevators. Their consideration made it a temptation to keep the cane longer than I need have. My spirit blossomed under this kind of public treatment.

“Yet, the moment I laid aside this symbol of deficiency, people reverted to their old pushing, jos-

tling selves. And it occurred to me that every body has some sort of broken bone somewhere, even if it cannot be seen. Not physical bones, of course, but emotional ones that are just as frail and tender.

“There have been many days when I needed more consideration than on the days I carried a cane; when my mind was troubled and my emotions churned, and no one knew or cared. The little broken bone was minor, but it opened a floodgate of human sympathy.”

The Guardian, an English newspaper, asked its readers of the kindness they have experienced. “Most people have at least one story about a stranger’s kindness to share,” it said.

Several readers responded.

One of those experiences that caught my attention was this: “It happened to a friend and me in Singapore in 2000. After an 8-hour bus journey from Kuala Lumpur (Malaysia), our bus failed to cross the border.

“A woman we had chatted to briefly in Kuala Lumpur, helped us to get on another bus, then took us to her apartment (which she lived in with her two college-age kids) and put us up. Her son took us around the city, we had an amazing meal back at their house, and then they came with us to the airport that evening.

“My biggest regret was losing the piece of paper with their

names and emails on when I lost my rucksack on returning home.

It was the most amazing act of generosity I’ve ever been on the receiving end of, and I wish I could have repaid them.”

The Washington Post also did the same thing to its readers. “We asked readers to submit stories of a time a stranger performed an act so unexpectedly kind that it stayed with them,” wrote Allison Klein, who collected the stories.

I read several of the stories sent and one of those that really amazed was this one, from Sharon Loy of Sedona Arizona: “When I was an exchange student in Paris, age 19, I was pickpocketed my first night there and my wallet was stolen.

“In my wallet was my driver’s license, money and photos – among them my favorite photo of my father, who died when I was 13, and my favorite photo of my sister, who died when I was 16.

“The pickpocket had obviously taken the money and thrown my wallet in a trash can in the metro station. But some kind Parisian saw my wallet in the trash and also the photos in there. He may have wondered if those precious images were precious to the owner.

“This person turned the wallet in to the American Embassy, and the embassy mailed it back to the United States. My photos and driver’s license were waiting for me when I returned home. I

cried then, and I tear up again now, realizing that a total stranger took time out of their day to do a favor for a person they would never meet, or who could never thank them.”

Kindness can happen in some strangest place. Here’s the story of Leslie Wagner from Peel, Arkansas, which was featured in Reader’s Digest: “When the supermarket clerk tallied up my groceries, I was $12 over what I had on me. I began to remove items from the bags, when another shopper handed me a $20 bill.

‘Please, don’t put yourself out,’ I told him.”

The man didn’t listen to her.

Instead, he told a story to her: “My mother is in the hospital with cancer. I visit her every day and bring her flowers. I went this morning, and she got mad at me for spending my money on more flowers. She demanded that I do something else with that money.

So, here, please, accept this. It is my mother’s flowers.”

Now, are you wondering why I am writing this piece? Allow me to quote the words of Nobel Peace laureate Nelson Mandela (whom I personally met when I covered an international conference in Durban, South Africa two decades ago): “A good head and good heart are always a formidable combination. But when you add to that a literate tongue or pen, then you have something very special.”

SECTION 2. AMENDMENTS – City Ordinance No. 171-14, Series of 2014 or the Davao City Adopt-a-Dog Ordinance shall be amended as follows: SECTION 1. TITLE – This Ordinance shall be known as “The Davao City Adopt-A-Dog-And-Cat (DADC) Ordinance of 2019”.

SECTION 2. POLICY – It is the policy of the City of Davao to ensure the protection of dogs/cats from abuse; the promotion of adoption of dogs/cats, if practicable and necessary, and the rehabilitation of the same.

It is likewise the duty of every pet owner to ensure that their pet dogs/cats are protected from harm and well cared for. The City will exhaust all means to save the life of a dog/cat and shall resort to euthanasia only as the last and desperate resort. Further, this Ordinance is not intended to hinder the anti-rabies program of the City, and in fact, the “Pet-Friendly” policy of the City of Davao must complement its antirabies program.

SECTION 3. DEFINITION OF TERMS. A. Animal Welfare Non-Government Organization. - Animal welfare nongovernment organization and other interested persons that advocate the welfare of animals, especially dogs/cats.

B. Dogs/cats unsafe for adoption or incapable of rehabilitation - Dogs/cats which aggressively attack a person causing physical injury or death, or behave in a manner that a reasonable individual would believe poses an unjustified imminent threat of physical injury or death or provide signs that it is inclined to attack a person without provocation; a dog/cat afflicted with rabies infection or other contagious diseases, viruses or bacteria or a dog/cat with a severe medical condition that would pose danger to adopting individuals or terminally ill ones. The dog/cat size and weight shall be taken into consideration in determining the classification.

C. Dog/cat safe for adoption - Dogs/cats which are sociable or friendly, do not attack aggressively a person, do not pose as an unjustified imminent threat of physical injury or death and give indication that it is liable to attack a person and in good health condition. The dog/cat size and weight shall be taken into consideration in determining the classification.

D. Dogs/cats safe for adoption but requires rehabilitation - Dogs/cats which are sociable or friendly, do not attack aggressively a person, do not pose as an unjustified imminent threat of physical injury or death and give indication that it is liable to attack a person but with physical and medical condition that shall require minor treatment. The dog/cat size and weight shall be taken into consideration in determining the classification.

E. Euthanasia/Mercy Killing - Humane method of inducement which does not result in a prolonged pain and suffering to end the life of a dog/cat.

F. Impounded animals- Stray dogs/cats whether registered or unregistered caught or rescued and impounded at the City Pound. Rescued dogs/cats are included in this definition.

G. Rescued dogs/cats - Any dog/cat which has been subjected to fighting, abandoned, neglected by its owner or severely maltreated by its owner, keeper, or by persons not the owner or keeper, shall be regarded as a rescued dog/cat for the purpose of rehabilitation.

H. Rehabilitated dog/cat - A dog/cat which has sufficiently regained its physical and medical condition which allows it to sufficiently perform its regular movement.

I. Stray dogs/cats - Any dog/cat leaving its owner’s place or premise and no longer under the effective control of the owner. Registered and unregistered dogs/cats and dogs/cats without owners shall be included in this Ordinance.

SECTION 4. ADOPTION OF DOGS AND CATS. A. If at the expiration of three (3) days from the time of impounding, an impounded dog/cat has not been claimed by the owner or keeper, the City Veterinarian’s Office (hereinafter referred to as “CVO” for brevity.) may initially classify the dog/cat for purposes of permanent or temporary adoption to qualified persons, or euthanasia/mercy-killing in accordance with law.

B. It shall be the duty and responsibility of the CVO to immediately, humanely, fairly, and with care, preferably in consultation with a government-registered animal welfare non-government organization, classify within three (3) days from impounding of the dogs/cats whether a dog/cat is (a) safe for adoption, (b) safe for adoption but requires rehabilitation and (c) dangerous for adoption or incapable of rehabilitation. The CVO shall begin observation for rabies infection on the impounded dog/cat classified under (a) and (b) from the time of impoundment up to the 10th day of impoundment unless the CVO requires a longer period of impoundment. After impoundment, the dog/cat shall be declared cleared and placed for adoption. Impounded dogs/cats under (c) shall be euthanized in the most humane manner so as not to cause pain and suffering to the animal in accordance with law, unless Section 4F of this Ordinance is applied.

C. Any person who is qualified to adopt a dog/cat shall be allowed to adopt a dog/cat determined as safe and cleared for adoption preferably of his or her own choice.

D. After the 10th day of rehabilitation unless the CVO determines a longer period of rehabilitation and after the dog/cat has been cleared for adoption, the CVO shall clear the dog/cat for adoption and declare them safe for adoption including rescued dogs/cats under its care and supervision on permanent or temporary adoption to qualified caring and loving individuals only.

It shall exert utmost efforts so that the dogs/cats will be adopted by qualified individuals who will provide for adequate shelter, protection, love and care for the unclaimed or rescued dog/cat declared safe and cleared for adoption. Any person who is a resident of the City for six (6) continuous months of good moral character, of legal age, has not been convicted of violation of the Animal Welfare Act upon the determination of the CVO, appears to have and actually has genuine concern for the welfare and protection for dogs and cats.

E. If the CVO determines that a dog/cat is safe for adoption but requires rehabilitation, the dog/cat shall immediately be placed under observation until the 10th day of impoundment and clearance, the CVO may then place the dog/cat under rehabilitation or for adoption to persons who shall volunteer to rehabilitate the dog/cat or shall volunteer to have the dog/cat rehabilitated through a private animal rehabilitation center or individual who specializes in rehabilitation of dogs/cats. Otherwise, the dog/ cat shall be disposed of through euthanasia.

E.1. If the dog/cat is temporarily adopted, the adoptive person shall take care and custody of the dog/ cat and may proceed with the rehabilitation of the dog/cat as provided by Section 5.E. The CVO shall determine the period of temporary adoption. Upon the expiration of the period of adoption, the CVO shall determine whether the dog/cat has been rehabilitated and qualified for adoption. If the dog/cat is declared as rehabilitated, the same shall be placed for permanent adoption. If the CVO determines that the same had not been rehabilitated, the dog/cat shall be disposed of through euthanasia.

E.2. The person who temporarily adopted the dog/cat shall have priority in the process of permanent adoption of the dog/cat once the latter is declared as rehabilitated.

F. A dog/cat determined to be dangerous for adoption or incapable of rehabilitation shall be immediately disposed of in accordance with law.

To ensure the safety of the public, all dogs/cats shall be presumed unsafe for adoption and incapable of rehabilitation if within three (3) days from impounding, the dogs/cats have yet to be classified in accordance with Section 4.B of this Ordinance. However, in special instances where the dogs/cats are classified as unsafe for adoption or incapable of rehabilitation, the City Veterinarian may allow the adoption or of the dogs/cats to persons who are known or who claim to be knowledgeable in the field of dog/cat training or rehabilitation. Provided, the dog/cat shall be placed under observation up to the 10th day of impoundment unless the CVO determines a longer period of impoundment. Provided, the adopting persons are informed of the classification of the dog/cat, the reason for the classification, the

risks which accompany in the adoption of such dogs/cats, and the persons who seek to adopt shall do so at their own risk. Provided further, that the classification of the dogs/cats classified as unsafe for adoption or incapable of rehabilitation under this provision are not due to rabies infection or other contagious diseases, bacteria, or viruses.

G. The CVO shall coordinate with animal welfare groups and other interested persons to promote, assist, and support in the adoption, and foster care of unclaimed or rescued dogs/cats, and exert all means possible to avoid the destruction of unclaimed or rescued dogs/cats safe for adoption without causing harm to the public. Notwithstanding, it shall likewise be the duty of the CVO to ensure that the initiative shall not unduly congest the City Pound and hinder the anti-rabies program of the City.

Furthermore, the CVO may, in a just and fair manner, permit the adoption of ten (10) dogs/cats a month unless it determines a different number of dogs/cats taking into consideration the following: the safety and security of the public, the effect on the city’s anti-rabies program, the budgetary requirements for the adoption and rehabilitation program, if any, the number of dogs/cats impounded and qualified for adoption, and the estimated number of interested and qualified adopting individuals.

H. The CVO shall coordinate with and encourage participation of animal welfare groups and nongovernment agencies and other interested persons to help strengthen the adoption efforts of unclaimed or rescued dogs/cats especially if found unfit for adoption to willing and qualified individuals.

I. Temporary adoption is a system of adoption where a qualified person is permitted to have care and custody of a dog/cat for a period as determined by the CVO. Within the period of temporary adoption, the foster may likewise encourage the permanent adoption of the dog/cat under his custody. The adopting person shall return the dog/cat to the City Pound or his authorized representative not more than seven (7) days after the expiration of the period of fostering, for adoption to other persons. If within one day from the return of the dogs/cats to the City Pound and after utmost efforts have been made to ensure that a dog/cat will be adopted, the dog/cat shall be subjected to euthanasia.

I.1. In case the temporary foster and other willing and qualified persons decide to permanently adopt the dog/cat, the temporary foster shall be preferred.

J. The CVO shall keep a record of the identity and maintain the whereabouts of the dogs/cats adopted and the individuals or persons adopting. In cases of change of address and contact details, the foster/ adopter must inform the CVO. K. All dogs/cats placed for adoption should be properly vaccinated, neutered or spayed and registered by the CVO. L. All adopting persons shall comply with the responsibilities of pet owners as provided by Section 5 of Republic Act 9482 including the mandatory rehabilitation of the dogs/cats placed for permanent adoption if the individual seeks rehabilitation of the dog/cat elsewhere.

M. The City Veterinarian’s Office shall ensure the proper and timely disposition of dogs/cats classified as unsafe for adoption or incapable of rehabilitation through means allowed by law to prevent endangerment of the public unless the CVO, in its discretion, acts in accordance with Section 4.F of this Ordinance.

Further, the City Veterinarian’s Office shall ensure the proper and timely disposition of dogs/cats classified as safe for adoption and safe for adoption but require rehabilitation which were unable to benefit from adoption with one day from placing the dogs and/or cats for adoption to prevent endangerment of the public.

N. The CVO shall provide adequate information and notice to the public as to the list of impounded dogs/cats classified as safe for adoption or safe for adoption but require rehabilitation who will be undergoing a period of observation for rabies infection before possibly being formally placed for adoption.

SECTION 5. REHABILITATION OF DOGS/CATS. A. The City Veterinarian’s Office may provide for a dog/cat rehabilitation program at the City Pound which shall undertake the rehabilitation of dogs/cats qualified for adoption including rescued dogs/ cats and other dogs/cats not impounded. The rehabilitation program shall provide for the following: determination of the physical and medical condition of the dogs/cats and determine if the same are capable of rehabilitation within the time provided by the program, the procedure for treatment of the dog’s/cat’s physical and medical condition.

B. The period of rehabilitation which shall not be more than five (5) days unless the CVO requires a longer period taking into consideration the following: the availability of funds, personnel, equipment, and facilities for the implementation of the program, the gravity of the physical and medical condition of the dogs/cats, and the number of dogs/cats placed under rehabilitation. If permissible without causing danger to any individual, the rehabilitation may be undertaken during the period of confinement for observation for rabies virus contamination.

C. The CVO shall determine if a rescued dog/cat which has undergone rehabilitation and recovery procedure, has been rehabilitated. A dog/cat shall be considered as rehabilitated if the CVO has diagnosed the improvement of the physical and medical condition of the dog/cat and cleared the same for release.

D. As far as practicable, the CVO shall have a rehabilitation and treatment facility separate from the regular impoundment area for dogs/cats.

E. The CVO shall seek the cooperation and participation of animal welfare groups and other interested persons in the rescue, rehabilitation and recovery of rescued dogs and cats. The CVO will allow the participation of the animal welfare groups and other interested persons in the informationdissemination drive of the City on the existence of the Adopt-A-Dog-And-Cat Program of the City, including providing information on the possible violation of the Animal Welfare Act, and providing advice and recommendation to the CVO on the implementation of the rehabilitation program, if any.

Furthermore, animal welfare groups and other interested persons may be permitted to undertake the rehabilitation and recovery of the dogs/cats under the care and custody of the CVO, and undertake the rescue of stray or abandoned dogs/cats and turn over the same to the CVO or with the permission of the latter, opt to adopt, permanently, or volunteer to rehabilitate the rescued dog/cat in accordance with the provisions of this Ordinance.

F. The adopting persons may be charged with reasonable fees for the rehabilitation and treatment of the dogs/cats.”

SECTION 6. SEPARABILITY CLAUSE – If, for any reason, any section or provision of this Ordinance is declared unconstitutional or invalid, other sections or provisions hereof not affected by such declaration shall continue to be in full force and effect.

SECTION 7. EFFECTIVITY – This Ordinance shall take effect immediately upon approval.

IMPOSITION OF SPECIAL REAL PROPERTY TAX – There shall be imposed Real Property Tax Rate of One and a half percent (1.5%) on realty, power plant, civil works, equipment, machinery and other improvements by a DOE-registered renewable energy developer under Republic Act No. 9513, which are actually and exclusively used for renewable energy facilities.

SECTION 4. DISTRIBUTION OF SPECIAL REAL PROPERTY TAX – In proportion to the real property tax and special education fund imposed by the 2017 Revenue Code of Davao City, the special real property tax rate of one and a half percent (1.5%) shall be distributed at nine-tenths percent (0.9%) to the General Fund as basic tax and the remaining six-tenths (0.6%) to the Special Education Fund.

SECTION 5. EXCEPTION – All other realty, equipment, machinery and improvements of DOE-registered renewable energy developer not exclusively used for the renewable energy facility or not necessary for energy generation shall continue to be subject to the impositions of the 2017 Revenue Code on real property tax.

SECTION 6. SEPARABILITY CLAUSE – If, for any reason, any section or provision of this Ordinance is declared unconstitutional or invalid, other sections or provisions hereof not affected by such declaration shall continue to be in full force and effect.

SECTION 2. DECLARATION OF POLICY – Pursuant to the Police Power of the Local Government Unit specifically: Section 16 of Republic Act No. 7160“Local Government Code of 1991”, which states: “Every local government unit shall exercise the powers expressly granted, those necessarily implied therefrom, as well as powers necessary, appropriate, or incidental for its efficient and effective governance, and those which are essential to the promotion of the general welfare. SECTION 4. EXCEPTION – Advertisements caused to be posted or displayed by the City Tourism Operations Office (CTOO) or by the City Government of Davao shall however be allowed.

SECTION 5. PENALTY – Commercial advertisements displayed inside and outside of the premises of DavaoInternational Airport in violation of this Ordinance, shall immediately be removed, without prejudice to the suspension of their business permit as penalty for the first offense and the revocation/cancellation of business permit as penalty for the second offense and the imposition of a fine in the amount of Five Thousand Pesos (Php 5,000.00) in all instances against the erring party responsible for advertisement(s).

SECTION 6. SEPARABILITY CLAUSE – If for any reason, any section or provision of this Ordinance is declared unconstitutional or invalid, other sections or provisions hereof not affected by such declaration shall continue to be in full force and effect.

SECTION 7. REPEALING CLAUSE – Any Ordinance, local issuances or rules inconsistent with the provisions of this Ordinance are hereby repealed or modified accordingly.

SECTION 8. EFFECTIVITY – This Ordinance shall take effect upon publication in a newspaper of general circulation.

ilipino Mark Striegl suffered a crucial loss in his highly anticipated Ultimate Fighting Championship (UFC) debut, bowing to Russian opponent Said Nurmagomedov early Sunday (Philippine Time) at UFC Fight Night 150 at the UFC Fight Island in Abu Dhabi.

Nurmagomedov stunned Striegl with a solid left hook that set up the former's knockout attack.

The referee stopped the contest in just 51 seconds, giving Nurmagomedov his 14th win in his career against two losses.

OF BASKETBALL PRINCES AND BEAUTY QUEENS When Peter June Simon announced his retirement from the Philippine Basketball Association, Davao basketeers wished him well on his next journey.

The first time I heard about Simon’s name was from the late Regino “Boy” Cua, regional director of the Basketball Association of the Philippines-XI (now known as the Samahang Basketbol ng Pilipinas-XI). I recalled him saying that Simon first went to another school before going to the University of Mindanao (UM) Maroons (renamed Wildcats).

“Maliit daw kasi,” said Boy. When UM sports director Joaquin “Boy” Sarabia brought us to cover UM in the National University Games, I had the chance to witness what the “maliit” can really do. In one play, Adrian Mamba’s

lay up just licked the rim, in and out, but before the ball went down, the “maliit” just picked up while it’s on the air and just did a two-handed dunk.

“Kulbaa!”, I said to the late UM coach Mario Babao, who replied, “murag lukton noh ‘ses?”.

In the years that followed, we have seen Simon suit up for commercial squads in Davao like the Coca-Cola Tigers and the next we started seeing him in the Mindanao Basketball Association (MBA) for the Davao Eagles, where he became a star, a superstar, actually, in our own eyes. When the MBA folded due to financial woes, he joined the Philippine Basketball League (PBL).

The biggest news came when UM head coach Atty.Manny Nitorreda, in one of the conversa-

tions with Davao sportswriters, mentioned that Simon is going to the PBA. A big achievement! We were so excited because Simon will be joining the “Millionaires Club”.

You see, every collegiate basketeer always dreams of going to the PBA because that’s where the money is! Why settle for a “talay” of P500, P1,000 per game when you have the potential to earn six figures a month!

The added bonus with Simon is that, he is “guapohon”. And if you see him on TV, “guapohon gyud ng tawhana”. Oh boy, when you see him on TV, pagka pogi na lang gyud.

After 16 years in the PBA, Simon decided to retire.

So far, in recent memory, he is the best Davao basketeer to shine in the professional league. There

was Vito Orcullo of the Crispa Redmanizers, who could have been one of the greatest PBA players from Davao to emerge if not for an injury.

If there’s basketball royalty, I would consider Simon and Orcullo, as Davao’s basketball princes.

Orcullo closely worked with Simon when The Professional Group (TPG) partnered with the Davao Eagles in the MBA. When former SK Federation leader Ana Cualing Sumalinog mentioned Simon’s wife and even thought of creating a fan’s club, I was intrigued. Turns out Simon is married to Binibining Pilipinas-Supranational 2018 Jehza Mae Huelar (ig unsa kaha ni ni Maui Huelar, who played for coach Jun Noel in Cebu?).

I was away, you know, so I have

not “monitored” the girlfriends around our local basketball stars.

But a quick check on social media sites, ka gwapa tood ni Jehza Mae Huelar or Mrs. Simon. There was even a post by Simon on Instagram describing his girlfriend as “walay daghan arte”.

A basketball prince is blessed with a beauty queen. Lovely kaayo di ba?

Anyway, the PBA has resumed action and we will be missing Simon.

We wish you all the best Nonoy (that’s his nickname) on your next journey.

May you and your “walay daghan arte” wife produce future basketball or sports stars and we hope we will still be around to witness it.

In his second Las Vegas fight, the boy from Buhangin lost unceremoniously this time bowing to Mexico’s Jose Enrique Durantes Vivas in the first round of their featherweight bout at The Bubble inside MGM Grand Sunday (Manila time).

Moralde, who survived a bout with the coronavirus, first hit the canvas less than a minute into the fight after Vivas struck him with a short left cross when they got tangled up.

Sensing the Filipino fighter is still reeling from the knowckdown, Vivas poured on the heat launching an of-

fensive barrage down, landing a couple of hooks and following it up with two more body shots that knocked the Filipino out 1:16 into the fight.

The Vivas-Moralde fight served as one of the undercards in the lightweight unification match between Vasiliy Lomachenko and Teofimo Lopez, a showdown won by Lopez.

Moralde (23-4), a natural super featherweight, has now lost two of his last four fights with both losses coming off stoppages while Vivas (20-1) tacked on his third straight win after losing to title contender Ruben Villa in September 2019. Experts saw him as “lethargic and out of rhythm.”
